We trust that your Excellencies will not deem this improper, because it tends to prevent all disputes which may always arise from General regulations, and because, as long as the Netherlands Company is considered as a respected trading body, it is more consistent with the nature of the case and the dignity of their character to enter into a convention of their own accord than to be put on a level with every body comprehended in the General regulations, besides that we do not want to follow or to observe the opinions which other foreign Nations may have on this Subject, as every one is answerable for his own conduct and is or ought to be free to observe therein such ways and means as he thinks to be consistent with his Character. § 16. The scheme of regulations drawn out by us, as we have the honour herewith to transmit to your Excellencies under exhibit No. 3, or the two first articles thereof, agree with the first article of the Calcutta regulations; this therefore requires no remarks. Our Company's ships never come higher than Fulta; they can therefore not be subject to that enquiry which is thought necessary about the ships that pass Fort William or Budge Budge. Our private navigation is so immaterial that as yet we do not foresee the arrival of any private ships; and if these are to be comprehended amongst the ships subject to the General enquiry, we are willing to make a separate article thereof in our regulations, which in the 14th article treats of the private duty, in order to prevent thereby all misunderstanding and trouble, for which purpose we have also provided by the second article of our scheme against the detaining of any boats that are sent up with goods unloaded from the Company's ships after a General entry shall have been made of the whole cargo, as appears by the first article. § 17. It may also be concluded from the said fourth article of the Calcutta regulations that no more duty will be levied on arrack than the 2½ per cent determined for merchandise in general upon export; by the fifth article of our list, the twelve rupees per leaguer demanded by your letters of the 8th ultimo have been allowed as an acknowledgement to the government, on the presupposition that that liquor will then be duty-free everywhere, wherever it might be imported, although, according to the second article of the Calcutta list, it could sometimes be understood differently. 118. From the fourteenth to the twentieth article of our draft regulation, those rules have been laid down which we considered necessary to prevent goods unprovided with a dustuck from being smuggled or brought into the settlements. On the one hand, setting aside the determination made by the seventh and sixteenth articles of our proposed regulation regarding the toll which private individuals are bound to pay, because in the total amount of the Company's toll with us each is accounted for separately; and on the other hand, whereas the Calcutta list, No. 14, speaks solely of natives at Hoogly and other districts, while our articles concern Chinsura and the other districts belong to the government, we trusted that the good faith and formal assurances of the two chief officers of the Company (in such manner as is provided in the 9th, 10th, 11th, 12th, and 13th articles regarding the toll on Company goods, and the 17th, 18th, 19th, and 20th regarding private goods, and repeated in the 23rd article) would merit attention and credit sufficient to preserve us from such troublesome guests as the so-called sjoukies. Besides this, when, as is fixed by article 11 of the Calcutta regulation and maintained by us in paragraph 18 of this memorial, goods unprovided with a dustuck or invoice are confiscated or declared forfeited upon approaching a custom house or authorized guard post, no precaution of that nature, such as placing a sentry at someone's residence, can be said to be necessary. Consequently, it would imply an unreasonableness if, even after submitting to all precautionary laws, one should still be exposed to that which cannot be reconciled with the dignity and real liberty of a nation. It is therefore that the Director and Council politely request Your Excellencies to be pleased first to test the validity of these assurances in conformity with the proposals made in their own regulation, and that no recourse may be had to any extremities except in case of contravention or violation of the promised faith, without paying regard to abuses that may have taken place and which are impossible if the stipulations are put into execution and faithfully observed, as the Director and Council assure will never fail on their part.

Lastly, as to the twenty-fourth article of our regulations, the contents thereof have no other object than what seems to be requisite from the solemnity of the convention itself, namely that the authority of the Nawab, so long as it has not been publicly rejected, revoked, or declared void, cannot be passed over in an arrangement regarding the tolls, from which even the laws of the sovereign himself have derived, and that the Dewan can demand no more than what is sufficient for him to secure the revenues of the country, as well as entering into a similar agreement as that proposed by us, with the Nawab's concurrence, in order to satisfy both and to keep ourselves forever free from disputes and responsibility on that account. 24. We therefore take the liberty to request that, in case the one regulation or convention for greater security regarding the conducting of the Company's trade and their safety in general should afford matter for reflection before it can be brought to completion, the other regulation or convention concerning the determination of the toll and whatever relates to it may immediately be taken into consideration, concluded, and signed and sealed with us as soon as the differences between both plans shall have been settled and put in order. 460 These regulations, which cannot serve otherwise than to promote the interests of both nations, and the advanced time both for the arrival of our returns from the aurungs and for the dispatch of our European ships, we hope will plead our excuse for being so urgent on this subject, while we likewise hope for the acceptance of our proposal and request, namely that we may have the honor of attending Your Excellencies' meeting in person to prevent all further delay of correspondence on this subject, as we may then verbally refute the objections that might occur at the framing of the convention in such a manner that all further obstacles may be removed out of the way and a finishing stroke may at once be given to the establishing of those regulations, which cannot but prove satisfactory to the concerns of both nations. 25. Learning from the reply to our third memorandum that Your Excellencies are not sufficiently instructed concerning the rights of ownership of the lands within the perimeter of our limits in Chinsurah called Moorish lands, and in what manner those who inhabit them have settled there, and consequently, in whatever degree of influence on the country's government we might consider their power, found little inclination toward the proposal for the cession of the same to the Company under its jurisdiction, for which we take the liberty to assure Your Excellencies will never be experienced from their side.

representing the Diwan, and here in this country the General Government of Fort William will take care that the Netherlands Company enjoys equal freedom, safety, and protection in its trade, not tolerating that any of its commercial officers, agents, or other of its servants in the aurangs hinder them therein, or prevent the servants of the Netherlands Company from entering into negotiations or engagements with the manufacturers, weavers, or any others whomsoever, for the provision of the goods required for the Company. As soon as the head gomastas have concluded the negotiations on behalf of the suppliers of the Dutch Company, both by sending samples and determining the prices of the goods that are needed, the negotiations with the suppliers will be commenced as usual, here or at Cossimbazar, brought into order as quickly as possible, and subsequently sent to the aurangs with the money to make the customary advances, accompanied by a not numerous but sufficient number of gomastas, each party provided by name with a pass from the Director, and at Cossimbazar with an attestation from the Chief. Art: 6 To prevent all complaints about clandestine trade, a gomasta provided with a pass from the Director shall be sent annually on behalf of the Netherlands Company in the month of January to each aurang, to prove that he is stationed and has arrived there to negotiate concerning the collection of linens with the makers and providers of the same. 472 chiefs of the respective subaltern residencies, stating the sum they desire to spend, so that the required passports may be noted, and they may be assisted in such manner as the circumstances of time and business will allow of. Article 8 Whereas no agreement can be reached between the parties concerning the free collection of their own opium and saltpetre, and as the Netherlands Company has for several years past bought and received the bulk of what was sent of those articles from the English Company's agents at Patna, it has been agreed to continue under that principle until further approval from Europe. The English Company therefore undertakes to deliver annually to the Netherlands Company eight hundred chests of opium and thirty-six thousand maunds of saltpetre. Article 9 The delivery of the saltpetre shall take place so early in the season each year that the same is dispatched while there is still water in the rivers, so early that the first lot may be here by mid-October and the last at the latest before the end of December. And regarding the opium, care shall likewise be taken that in due time, and in proportion to the advances, the crude opium required for the preparation of eight hundred chests shall be delivered in the Dutch factory at Patna. Article 10 Henceforth the Company at Patna shall no longer pay the peshkash that has hitherto been raised and disbursed for the freedom of trade in Bihar. Article 11 The Netherlands Company effectively having, according to its privileges, the right to have silver struck into sicca rupees in the king's mint, and in a word to have money coined, the Nawab will be urged, as soon as silver or species fit for coining are brought on its behalf, to grant freedom and access to, and the reopening of, the mint at Murshidabad. Article 12 Care shall be taken that the payment of the duty thereon of up to 2½ percent is made to the king's officers against receipt, and with respect to the duties owed by the Company for its merchandises and those of private individuals at the Bakhshbandar and at Patna, the stipulations made in the separate agreement and the mutually signed regulation shall be strictly observed and complied with. 473 Article 13 Upon the reopening of the mint at Murshidabad, the arrears shall be reduced annually by the mint officials by an amount of 2 to 2½ percent, and the English Company, as Diwan, shall properly ensure the performance of this article. 474 No 54. Separate Article belonging to the Agreement for a Free and unmolested Trade of the Dutch Company in Bengal. The Honourable the English East India Company, and in this Country in their behalf the Governor General and the members of the Supreme Council of Fort William in Bengal, in their capacity of Diwan of the Emperor of Indostan, do guarantee to the Netherlands East India Company in Bengal, Behar, and Orissa all safety and security against any invasions or attacks upon their settlements, either by the Crown of England or any other Power; so that in case it should unfortunately so happen, which God forbid, that the Republic of the United Netherlands Provinces should again be involved in a war with His Majesty of Great Britain, the said English East India Company or the said Governor General and Council, or their official successors, shall, in consequence of their right to the government of this country, leave the settlements of the Netherlands Company in the above-mentioned provinces of Bengal, Behar, and Orissa entirely unmolested, and the effects to be found therein; and they will undertake, if necessary, the care of devising arrangements which on the one hand preserve the Dutch Company from damages, and on the other hand can and must afford security to the party who acts or ought to act offensively. Report concerning the experiences of the Junior Merchant and Provisional Secunde Willem Jan van Midlum on the ninth of this month, pursuant to orders from the Honourable Lord President and Council at Hoogly, having been on a commission to their Excellencies the Lords Great and Small Nawab, to present two Arzidasts sent hither from Hoogly. The Secunde Van Midlum departed from here with the courtier Sheikh Babulla and paid his visit at the hours designated by their Excellencies, namely at nine o'clock to the Great Nawab and at eleven o'clock to the Small Nawab. Having arrived at the Great Nawab's, after some compliments, he presented the Arzidast sent hither by the Lord President and Council at Hoogly, with the request that His Excellency would be pleased to give it favourable consideration and grant a speedy reply. The Lord Nawab, having received and read the Arzi, handed it over to his Diwan, adding to the Secunde that it was certainly true that the Dutch Company had suffered great losses for about four years; that His Excellency himself was surprised that they had not come forward about this sooner, but since they were now making a claim, there might be an opportunity to remedy it; that His Excellency was well aware that the Dutch Company had always enjoyed great privileges for conducting their trade, but that it was a matter upon which a proper answer could only be given after careful deliberation; meanwhile, His Excellency assured that he would make every effort to be of service to the Honourable Dutch Company. Whereupon, after reiterating the request for a speedy reply, the Secunde took his leave with the customary compliments, and repaired to His Excellency the Small Nawab. Having arrived at the Small Nawab's, the Secunde presented the Arzi sent to this Excellency and requested of him in the most becoming terms that the request made therein might be taken into careful consideration, and that a speedy answer might be granted thereto. That His Excellency, having read the Arzi, replied that this was no trivial matter, but of such weight that it could not be answered in two or three days; that it was also not solely of his department, but that it had to be deliberated upon with the Great Nawab; that he would speak with His Excellency about it, and send an answer in four to five days; whereupon the Secunde, with another request for a speedy reply, took his leave, having nevertheless been able to observe from the friendly reception and entertainment of both the Nawabs that their Excellencies were well-disposed to be of service to the Honourable Dutch Company to help them regain their old privileges and were willing to do their best in that regard. We are very glad thereof and have deliberated regarding your request concerning the progress of trade, etc., and have commanded the great and beloved Khan Jahan Khan Bahadur Tetfaretjenh, Faujdar of the customs post at Hooghly, to proceed with collecting the revenues, and to conduct the course of the service and trade of the Dutch and French Companies as was customary of old, which has likewise been confirmed on the part of the Nizamut; and since it is trusted that on the part of the said Companies no oppressions, acts of violence, or partialities shall take place in trade, and that the accounts shall be rendered completely and the dastaks granted for the respective travelers according to ancient custom, someone on the part of the English in the name... In respect to the several other matters and propositions which you have been pleased to lay before us in your fifth Memorandum, we have the honor to observe to you that our letters of the 30th August and 8th September were full and explicit on all the points which you submitted to us; and that although we do not deem ourselves at liberty to deviate therefrom or to accede to the conventions which you have proposed to us, we shall transmit copies thereof to our superiors in Europe by the next dispatch and request their orders and determinations on the several subjects. Our assurances have been so amply given that the trade of the Dutch Company and of individuals under their government should receive every protection and support to be expected from us, that we trust any further assurances on this subject will appear to you, as they do to us, to be unnecessary. abundantly apparent that I have done nothing other than what the public Regulations, the Interest of the Company, and general Justice rendered natural, proper, and indispensable; and that, on the other hand, both the intention and the conduct of the Gomastahs tended immediately to overthrow all these points worthy of consideration. The present Complaint serves greatly to confirm all that I then advanced. It is entirely founded upon that gross fallacy which I have previously exposed, namely, representing adherence to the Government's necessary prohibition preventing all trade with the Company's weavers as a total prohibition of all trade whatsoever in this Land. This last is the only idea that is suggested by the present complaint. It by no means appears from this that the Gomastahs have the least knowledge of any publication of that Government prohibition, or that they know anything of such a prohibition being in force. Notwithstanding this, it is a true matter, to which the whole country can bear witness and which can at all times be demonstrated, that the general Government orders, in which that prohibition is contained, were the orders which I published upon the arrival of the Dutch Gomastahs in these quarters, and that these are the only orders to which I, on this or any other occasion of a similar nature, have had recourse. To prove this, I truly need go no further than to all such of my letters to the Company's Gomastah at Buddaul as the complainants say they have seen. According to their own accounts, everything about which they make representations took place with him; but in order to bring the charge home to me personally, they cite that my letters give orders for the acts of violence which they describe. I am pleased to be able to put this to the test. The enclosed paper contains Bengali copies of all the letters written by me to the Buddaul Gomastah, or by him to me, in relation to the Dutch trade, from the first report of its commencement until the receipt of the complaint which is now being investigated; and I request permission to lay before you herewith translations of those letters in the order in which they were exchanged. First, however, I must make it known here that, on account of a report which was given to me early on, namely, that some of my own servants had entered into secret engagements with the Dutch Contractors at Chinsura (a matter which considerably aggravated the intrusion of their people), I was all the more obliged, out of fear that this would also influence the Company's Gomastahs, to observe all strictness toward them, and particularly with the one at Buddaul who was the farthest removed from my own inspection; this circumstance, together with the report mentioned above, will account for some stronger expressions in the following letters.

I charge you to take care that they do not obtain any of the Company's assortments, nor any cloths from the Company's Kautbundy weavers. In the year 1782 I sent you a copy of the purwannah of the Governor General and Council dated the 19th of Bysack concerning private purchasers of cloths; likewise their order of 1775 respecting the Company's weavers. It is my desire that these various orders now be published and that copies thereof be affixed to the doors of the factories in your quarter, and in order to make them more generally known, you must proclaim them by beat of drum in the villages of the weavers. The first of the above orders, given by me to the Gomastah on the 9th of June, which serves as the foundation for the others, is clearly limited to the Company's weavers; the words are few and plain, such as are commonly used to forbid illicit trade with these weavers; they could not be understood to extend to all weavers, for no such order has ever been given, nor has the Gomastah had any power to enforce such an order; for the transmission of the public regulations together with the letter took away all possibility of misconstruction, and the general publication thereof contained in itself the clearest determination of what was intended, while it simultaneously prevented attempting anything more than what was authorized by those regulations. That the Gomastah understood that my orders related solely to the Company's weavers appears infallibly certain from his answer of the 11th of June, and that same order, and that alone, is either positively expressed or contained in all my subsequent letters, which, although not many, would nevertheless have been even fewer if I had not received information from him that the Company's Dallals intended to manage the affairs of the Dutch (and to have consented to this would in effect have been quietly to hand over all the Company's weavers to that work, which I had either to choose or prevent as soon as the matter was brought before me), and if, furthermore, there had been no room for the reasonable suspicion, cited above, that the Gomastah himself might secretly promote the Dutch provision. I flatter myself, Gentlemen, that I need say nothing more to show that I am clear, both in intention and in deed, of those proceedings at Buddaul ascribed to me by the Dutch Agents, who, however eager they otherwise show themselves on this point, have nevertheless not been able to support their attempt otherwise than by letters which now appear to provide conclusive evidence against them. This is the first and most material part of my answer. As regards my justification concerning what actually occurred at Buddaul and was alleged by the Dutch Agents, I am not yet fully informed in that regard. I have sent copies of their grievances to the Company's Gomastah and instructed him to provide his precise answer thereto, along with all related information.

The time required for this, as well as that which in the present season is necessary for the conveyance of letters, hardly permits that I should already have received an answer thereto; yet upon comparing his letter to me of the 30th of July with the report of the agents regarding what happened on the 18th of Srawban, which is the same day, I cannot doubt that it is the same matter to which both refer; and from the Gomastah's report it appears that the Company's weavers and linens were the point in dispute and that the object of his efforts was to secure them against alienation. I cannot but suppose that this must be the truth, and that the Dutch agents, who do not once note the distinction between Company's and other weavers, have deliberately sought to represent the prohibition as general. I shall, however, transmit the Gomastah's own account as soon as it arrives, and in the meantime request permission to add a few concluding remarks here. The Dutch agents were instructed by their principals at Chinsurah to send a suitable man concerning their affairs to the English Resident. In reply they say, twelve days after the receipt of that order, that they have not been able to find such a man, 488 nor that they will be able to send such a person within two or three days later; and instead of taking that easy course, if they had any grievances to present, they send an inflammatory account to be submitted at Calcutta. One of them, or any person endowed with natural judgment, would have been completely sufficient; and if they pretend that there was no hope of redress from the Resident, why then they had every reason to send someone, because this would then have given all the more force to their representations. To this very day, nearly two months after their complaints, no one has been to see me. That the Company's Dallaals themselves acknowledge that their dependants carry on the Dutch business. 2nd. That they moreover avow that the cloths for the Dutch are procured from the Company's weavers, in palliation of which they allege that there are no other weavers in that quarter but the Company's; a fact which I have never supposed, and cannot admit without further investigation, knowing that to the westward it is otherwise. 491 3rd.
