244 245 22 April 22 April Granted. Points of rescription to Patna. Receipt of the copy books of 1783/4. The procurement contract concluded against the prices of 1780/1. Honorable, most humble servant Bartholomeus Lewis Grenier, Lieutenant in the service of the Honorable English Company. That the petitioner's father, Jean Francois Grenier, former Lieutenant in the service of the Honorable Dutch Company at Colombo, as he, the petitioner, had learned, had passed away there in the year 1783, having appointed by testament as one of his executors the Valiant Willem Godeschalk Koek, under-major at Colombo. That he, the petitioner, upon private report received of this in the month of September 1783, had written to the said Under-Major Koek and requested from him a copy of the testament, with a full disclosure of affairs concerning the estate of the petitioner's late father aforesaid. That he, the petitioner, having received no answer to that letter, and having repeated his request in the last passed year 1784 to the said executors, has until now not received the slightest information as to how that estate has been handled. For which reasons the petitioner takes the liberty to address Your Honors most humbly, with a humble request for your most favorable recommendation to the Honorable Governor and Council at Colombo, to the end that the executors in the estate of the petitioner's said father may be ordered to send hither a copy of the testament, together with the inventory and all other papers relating thereto, and that those papers arriving may come into the petitioner's hands through Your Honors' favor. Having entered into business concerning the deliberative points contained in the successively received letters from the servants at the office mentioned in the margin, dated 26 & 30 March, item 9 and 15 of this month, it is recorded beforehand that the copy books of that office for the year 1780/1, for the conveyance of which the first solely served, arrived here just in time to have been able to be dispatched to Batavia. By the second, or that of 30 March, it being communicated by the servants that they had attempted in vain to bring the suppliers of the linens to be procured for this year to a price reduction, had proceeded, in hopes of our approval, Thus, after resumption of the same, it is approved and resolved to consent to the petitioner's request, and consequently, upon occasion, to present the contents thereof to the Government of Ceylon. Since small lots of linens are already arriving daily, the servants having proceeded to plastering and further repairing the warehouse serving for the storage of those goods, it is resolved to approve this as well, in the trust that proper economy will have been observed in this. Favorable prospect. The servants, in their said letters, further assuring that they have more and more hope of being able to dispatch a considerable quantity of linens, and the prospects of obtaining money there also presenting themselves so favorably that they judge themselves capable of securing the necessary funds even for 800 to 1000 chests of opium, if it should be decided to entrust them with the procurement thereof, it is resolved, in answer to this, to write to the servants that the prospect they have of securing the necessary funds for trade cannot be other than highly agreeable to us, but that they cannot for the present be authorized to purchase the required opium, because of our negotiations with the English government on this matter, with a communication of what has previously been decided about this. Decision thereon arrived at in reply. Along with the servants' letter of the 9th of this month having been received a memorial of the sustained expenses of goods and buildings.

Memorandum of the cost of the following balances and weights which, according to the Honored Hugli authorization, whereby it appears that the same will monthly cost Sa. Rps 270: 12: 12/15, including therein the Matchlockmen mentioned in their previous letter of 30 March, or Sa. Rps 38: 15 29/25 less than was previously brought up for it, it is, after resumption thereof, since the administrators assure that it cannot be arranged with less there, agreed to authorize them to hire and maintain the servants mentioned therein. 252 253 22 April 22 April purchase of borax and the making of racks approved 25000 rupees negotiated, which is desired in the name of Baumgaardt; sent to serve instead of the receipt granted. prices are still noticeably less than those for which they were entered in the books, it is resolved to approve this as well, and to provide for the request of the employees in due time with the balances still required for weighing the opium and spices. The borax having been purchased by the employees at f 27 per cento lb, or 8 stivers less than the last price spent for it, it has been approved to confirm such, as well as the making of 28 pieces of racks, the latter being a consequence of our previously given authorization. Finally, by the employees in their letter of the 15th of this month, received during the meeting, reporting the negotiation of a sum of Sicca rupees 25000 on assignment on the Netherlands against 27 stivers the Sicca rupee and 6 per cent interest per year until the 8th of next, as they could not negotiate more advantageous terms, and for which they had given a receipt to be exchanged against a bond issued by the meeting, with further description of how the lender of these funds had chosen to have the bond drawn in favor of Jan Pieter Baumgaardt in order to use as much precaution as possible against the strict act of the English Parliament for the prevention of lending money to foreign nations; it has been decided and understood, after consideration of both matters, to approve that negotiation, as well as the arrangement made to relieve the lender of these funds from difficulties; but whereas the granting of receipts by the employees for negotiated funds to be exchanged against bonds issued by us causes double trouble and might in time also cause confusion, it has been further resolved to send the employees a model bond, such as they must issue to the lenders of money in order to be exchanged in due time with us against the assignments to be granted. April sequester, to whom the estate of the aforementioned merchant Humbert has now been handed over, to order, out of the first funds to come in from the sale thereof, to pay over to them here the aforementioned sum with the interest still in arrears thereon, until immediate satisfaction, under the offer of restitution in case any creditors with greater rights might appear in the course of time, as all this further appears from that very document which was incorporated herein: To the Honorable Greg s Herklols, President, together with the Members of the Political Council. Honorable and Respected Councilors, The Board of Orphan Masters here has the honor to show Your Honors with due respect: That the merchant Jan Pieter Humbert, appointed as President at the establishment of the Chamber in the year 1772, shortly thereafter took under his custody, both on mortgage and on bond, a sum of A:t Hof 16634:11: /6. That this sum had always remained with him from that time until today, without any difficulty appearing likely to occur concerning that money, whose interest was paid correctly, until shortly after the surrender of this colony to the English arms, when the said merchant Humbert was struck by a stroke and deprived of the capacities to manage his affairs any longer, which brought the Board into the necessity, on account of his distressed circumstances, to employ all possible means to secure the orphans' money, the greatest part of which had been lent to him and the interest on which was then no longer paid; wherefore the Chamber, to that end, repeatedly addressed both the respective Presidents of the Court of Justice here and the Supreme Council at Calcutta, but without obtaining the desired result, as is circumstantially described in the report presented by the Orphan Masters to Your Honors on 8 December 1784, to which they take the liberty to refer. That Your Honors, disposing on that report on 17 December thereafter, left those funds for the account and responsibility of the Board, although all its other proceedings were approved, whereby the same then saw itself forced to do everything possible always towards securing the same, 258 259 29. April 29 April and consequently made a demand upon the curators appointed to administer the estate of the aforementioned merchant Humbert for immediate payment of the owed sum, with the interest still unpaid thereon; which nevertheless was refused by the aforementioned curators, who only accepted to satisfy the mortgage with the interest accrued thereon, but referred the Chamber with its claim regarding the bonds to the Respected Court of Justice. That the Board, informed of the intention of the curators to hand over the estate of the aforementioned merchant Humbert to the sequester, took the resolution to summon their Honors previously for payment of the above-mentioned sum with its interest, in order thereby to prevent the estate from being placed in the hands of the sequester before a judgment in this matter was obtained, for the reason that the Board would thereby be deprived for such a considerably longer time of the actual enjoyment of those funds, which they now absolutely require; but that a defect in the form of the citation, whereby the curators were summoned for the whole sum whereas they should have been cited upon two separate citations, namely one for the mortgage and one for the bonds, an error arising from ignorance of the manner of proceeding, was the cause of the proposing of an exception by the curators, which resulted in the citation being canceled at the expense of the Orphan Chamber. That this cancellation of the citation, although occurred according to the strictest rules of law, nevertheless serves considerably to the prejudice of the Chamber, as it is thereby deprived of the power to continue its proceedings, since immediately thereafter the estate was handed over to the sequester. That the Board, although deferring all respect to Your Honors' aforementioned cited honored resolution to leave the delivery of the funds to the merchant Humbert as President for the account and responsibility of the same, nevertheless, under correction and with all respect, believes that the estate of the aforementioned merchant Humbert is in the first place and before all others liable therefor, because he, as former President and cashier, already took those funds under his custody in the beginning at the establishment of the Board, of which no members are currently present any longer, and that the 88th article of their instruction literally contains "that furthermore neither the aforementioned Board of Orphan Masters itself, nor the President or members of the same, may be held liable in their private persons or goods for

260 261 29 April 29 April for whatever others shall have neglected or disbursed, fully acquitting them of all accountability in that regard. That according to the 39th Article of the aforesaid instruction, all agreements, promises, securities, and all deeds passed before Orphan Masters are of equal force as if they had been executed before aldermen, and that these deeds, by the 48th Article of the Batavian Statutes concerning desolate or insolvent estates etc., are declared preferential, even above notarial deeds. That for more than two years no interest whatsoever has been received by the chamber, whereby it has come to pass that the former and present scribe are already in advance by 2800 rupees for successive unpaid interest as well as otherwise, while the same is in absolute impossibility, due to the aforesaid deficiency, to reimburse those monies or to provide further, and the means to continue properly paying those who enjoy monthly interest on their money. That the Board would proceed with the instituted proceedings before the Honorable Council of Justice without troubling Your Right Honorables in this regard, were it not that the protracted nature thereof, now that the estate is in the hands of the sequestrator, who according to custom must have proper time for its settlement, the absolute lack of money in which the chamber finds itself, together with the necessity to provide for this with the utmost speed, obliged the Orphan Masters to take refuge in that sovereign authority under whose immediate protection they act. It is for all these reasons, Honorable and Respected Sirs, that the undersigned Orphan Masters, animated by those sentiments for the interests of the minor orphans which their duty and their sworn oath impose upon them, turn with the greatest confidence to Your Right Honorables, humbly imploring your aid, with the request that it may please Your Right Honorables to maintain them in this matter, and consequently to order that the sequestrator, out of the first incoming monies from the sale of the above-mentioned estate, remit and pay to them the aforementioned sum with the interest still unpaid thereon up to the actual payment, so that thereby it might be prevented and averted that those persons who for the most part derive their subsistence from the interest yielded by their capitals resting in the orphan chamber do not fall into the otherwise unavoidable danger of perishing from distress and want; all the more so since this direct disbursement cannot cause any prejudice to the other creditors, as according to the above cited, the means of the orphans are strictly preferential; the chamber moreover undertaking to receive these monies chamber under 262 265 29 April Granted in this regard. and journal of Mate Visser on the Bengall Merchant under security de restituendo, in case any persons having superior rights should present themselves in the course of time. The President having produced the two renewed mortgages requested by the resolution of the 1st of March last from the Poor Relief Guardians, for the benefit of the Poor Fund and charged to the Merchant and Fiscal Adrianus Gerardus Kraijenhoff and the Provisional Equipment Overseer Joseph Roselje, the first amounting to Sa. Rop. 7500 and the other fo 4000, and these both papers having been placed in the hands of the Honorable Head Administrator for safekeeping in the Grand Treasury, it was understood to make this record of the matters. On this occasion, the said Merchant Kraijenhoff made known to the assembly that the said mortgaged house had since been sold by him to the widow Pallak, who would gladly keep the mortgage upon the same, requesting therefore that this might be granted and that the mortgage to be executed by said widow Pallak might serve in satisfaction of his own; which being granted, it was understood to record this here as well. After this, the President produced a document drawn up by his Honor showing the reasons why it was not possible earlier to proceed to the contracting for this year, the difficulties that his Honor had with the suppliers, and how they had finally, after stipulating a price increase of 3½ on the Baddaalse and 5 percent on the Sautipoer goods, shown themselves willing to make the delivery; said document being of this content: Since the contracting of linens for this year is to take place on credit, I experience through the ceaseless cross-dealings of the merchants among one another concerning the distribution that it involves quite some more work to bring so many minds to one opinion than had been imagined, which is not a little aggravated by the dilatory and withholding nature of the merchants, and

230 281 10 May 10 May nature of the Bengalis, who never come out with their true intentions all at once, but whenever one thinks that the matter has been settled with them, they raise new difficulties again, which often completely overturn all the preceding work. These are the reasons why this business has been delayed and hindered for more than two months from reaching an end, which I must recount in more detail. When the merchants of Calcutta, who offered themselves to me to enter into a contract for the delivery of piece goods on credit for 1785, and of which I gave notice in our meeting of 22 March, they appeared to be satisfied with the arrangement as it might fall out here, and departed promising to return as soon as the distribution was drawn up and the contract was ready for signature. However, the summons, although repeated, remained unanswered under all kinds of frivolous pretexts. After much inquiry, I finally learned that they had imagined that each of them, apart from their share in the coarse cloths, would be assigned a separate aurung according to each person's choice, or at most two in one weaving district, as had taken place under Mr Ross. To yield to them in this would have involved far too great an unfairness, because our former merchants, who were also to have a share in the procurement, would lose too much thereby, since it was then probable that the least profitable ones would be left for them, just as they had also expressed that one chose Jaggernatpoer and others Herriaal, Baddaal, etc. etc. for themselves. I pointed this out to their gomastas and stated that the circumstances of the time therefore did not allow this to be carried out for the present voyage, but demanded that the distribution should take place as far as possible on a somewhat equal footing. Since those of the coarse cloths and the distant aurungs are the least advantageous to the merchant, if they took the others for themselves, one ran the risk of finding no interested parties for these. I then proposed to them to assign to each of the merchants, as far as was possible, a share in each aurung that suited them, because I found it reasonable to accommodate their wishes for the present as much as was feasible. And I thought it the more necessary to divide all the weaving districts because, if one should happen to fail in the procurement, one could then make up for the deficiency through the others. Three of the Calcutta merchants seemed to be satisfied with this, but three others departed without being inclined to engage themselves. Another difficulty was raised again, namely a demand for an increase in price on most aurungs, on which they strongly insisted. However, except for two weaving districts, they came around, and thus I thought I had now come to terms with them, until the evening before our latest meeting, when all the merchants and the gomastas of the Calcutta merchants raised a new difficulty, namely that a specific time of payment should be expressed in the bonds that were to be given to them. I found great difficulty in this, both because it conflicted with previous customs followed on such occasions, and because, if this were complied with, it could crack the credit of the Company. They then requested to be permitted to propose this to the assembly, as was done, and it was consequently refused them, which also constituted a reason why those from Calcutta withdrew their promise of delivery. The cause of this demand, upon inquiry, arose from the shortage of money never before experienced in Bengal, even to an extremity such as we are now experiencing, and that some among our merchants, who had been hard pressed by the war, in order to obtain the necessary funds, would be compelled to leave the Company's bonds that were to be given to them, by way of private pledge, with those who would advance them the required money. And for this, they would otherwise have to pay a higher interest than the Company allowed them, which they said would certainly amount to 15 to 16 per cent; for which reason they foresaw that, unless the bond contained a specified time of payment, they would not be able to manage so easily with it, but on the contrary, the security of this written obligation could afford them an opportunity to negotiate a lower interest. And these reasons were certainly not entirely without foundation. Finally, then, the contractors, to whom three others have joined themselves instead of the three from Calcutta, have agreed to accept the bonds according to the tenor of those previously granted. Yet they requested that it might be taken into consideration how very much, through the procurement of a principal part of the cargo of the ship for Europe and that sent for India, they had exerted everything that their means allowed; that, toward the fulfillment of the first, they had bid for more than 80000 Rupees in merchandise at the public sale, of which the Japan copper could not be disposed of without loss, while for the piece goods for India they still had everything to claim. For this reason, they hoped for some accommodation and requested that one would grant them some increase on the Baddaal and Sautipoer piece goods, which could not be delivered without loss, asking to consider that the prices of all the aurungs in the year 1777 had been reduced by Mr Ross compared to those of the year before under his predecessor, the first of the mentioned aurungs up to 5 and the other indeed up to 7 1/3 per cent, which at that time, through the benefit of advance payments on the delivery, and also because the procurement of each aurung was assigned to one or two merchants, could still at least

I have examined the contracting memorandum of Mr. Ross for 1777 and found it to be as they state, while no change in prices has been made since; meanwhile, I have informed myself through impartial persons regarding their statement of the anticipated disadvantage, and I must believe they do not complain without substantial cause, although I did not deem it necessary to grant their full demand so directly; speaking further with them then concerning this increase, they finally declared that they would be satisfied with 3½ per cent on the Baddal and 5 on the Santipoer goods; I submit the consent thereto for Your Honors' consideration, as it appears to me to be not without necessity, and in order to leave them no time for new difficulties, I have provisionally and subject to Your Honors' approval consented thereto. For consideration, I further add here that the 3½ per cent on the Baddal goods will amount to Rox 3957:—:— and 5 per cent on the Santipoer goods - 5873:—:— Rox 9830:—:— which sum will differ on the general contracting of Rox 1167766:- by at most 1/0 per cent, a trifle under the present circumstances, not large enough in my opinion to abandon the entire contracting. Since for the present, advance payment in cash cannot be made either in whole or in part, the undersigned suppliers bind themselves to deliver the linens mentioned in the memorandum of tender and assigned to them, against a bond, so that to each of them, for what he undertakes to deliver upon the conclusion of the contract, a bond for the total of his amounts will be issued, to run at the expense of the Honorable Company at three quarters 3 1/4 per cento interest per month, to be redeemed after the completion of the delivery, or as soon as cash is available for that purpose. Article 2. The manufacturing of cloths must be done according to the samples chosen at the meeting, which the suppliers can inspect and examine in the cloth hall, and of which they may even obtain swatches. And falling short therein, the suppliers of such substandard goods shall have to content themselves with such lower prices for them as the council shall deem fair, or, if the same are entirely unacceptable, that they be left for their account; these, however, must remain in the Dallaan until next January. Article 3. The linens must above all have their full length and width, without anything lacking, and also keep as close as possible to their weight and thread count fixed by the samples, and possess all requisites ordered by the respective petitions, which shall be announced and presented to the suppliers by the servants in the cloth hall in the clearest and most detailed manner. Article 4. The price differences falling from Auel to dom and from dom to Ceem are set at 4 per cento, so that 100 Auel becomes 96 dom and 92 Ceem, with which the suppliers remain satisfied.
