the first and the last in his private capacity and the second petitioner in his quality, plaintiffs of that arrest upon such monies as have proceeded from a house, sold at public auction within our Territory, of a certain Citizen by the name of Jan Matthys Lasboom, who had moved from here to reside under the Danish flag, for partial recovery of damage suffered from the said Lasboom by the Petitioners, according to their Petition submitted to us on the 4th of this month and the account, etc., submitted alongside it; and concerning which, and in particular the summoning of that affair, it is complained and maintained in the aforementioned Letter and Protest as if the petitioners had acted and proceeded wrongfully against subjects of His Danish Majesty, whose Judicature or forum ought to belong at Fredriksnagoor and not here at Chinsurah. We shall, in compliance with the respected requisition of Your Esteemed Worships, briefly treat herein how far the aforesaid Royal Council appears to be right, and how far the Protest of the aforesaid Gentlemen Duntzfeld and da Cruz is inconsistent with the Rules of Law, and therefore untenable in a matter such as this. Although it is beyond dispute that every Nation or every people has its laws, and that the subjects of one cannot be summoned into Court or made to stand trial before the other, there are nevertheless cases, not included under that general Rule, which are separated therefrom, and especially such as pertain to commerce, for the security and protection of which the laws, among all peoples, admit a notorious exception. To confirm this, we might merely ask how it is customary to proceed in Copenhagen when it happens that a merchant vessel of another Nation is arrested there: and whether the Owners thereof, just as is customary among all Nations, would not have to stand trial there before the Admiralty Court, if they wished to contradict the attachment of ship and cargo or to litigate over the illegality thereof. We are of the opinion that in such cases the Judge whose subordinate made the attachment is competent regarding the party to whom the Property belongs, whether concerning persons or concerning their goods, because it would be the only way to submit the arrested property, or the legality of the arrest, to the judgment of the one whose subordinate has wronged or become indebted to his own. The maintained referral would be of no avail: indeed, no Admiralty Court would waive its Privilege and declare the Arrest or attachment illegal, and that by virtue of that contention that the forum ought to be held at the place where it is claimed that the Debtor or his Property belongs. Now this general law of nations, according to our laws, extends to every individual, and it is by virtue thereof that every private individual among us may arrest and cause to be detained his Debtor, in his person or property, wherever he finds them, until security has been given to him for the satisfaction of his claim: and the arrested party is obliged to stand trial before the Judge by whose order the arrest occurred, by virtue of the well-known rule arrest founds Jurisdiction. It is also on the foundation thereof that we maintain that the arrest requested of us by the aforesaid Petitioners Eelbracht, Dolle, and Hof has been legally laid and already decreed by virtue of the Defendant's non-appearance and by virtue of the first default. Had the Gentlemen Respondents been pleased to Appear on the first appointed court day, or to send someone on their behalf, they certainly would have been at liberty to put forward all such exceptions as they believed ought to be considered against the legality of the Arrest, instead of protesting against it to Their Authorities after the lapse of time, and troubling ours with that Protest. This would have some appearance of reason were it affairs of state: but in Civil questions such a Protest is of not the least application, powerless, and of no value. Had the Gentlemen Duntzfeld and da Cruz believed they could satisfactorily prove in Law that the arrest requested and granted by us was wrongfully laid, and that the same therefore ipso facto ought to have been dismissed

settled by referring the petitioners and plaintiffs to the Court of Justice at Fredricknagoor, what reason is there then, if those motives were acceptable, why those gentlemen should not have been permitted to expect from the equity of this Council that it would be disposed of with fairness and that immediate justice would be done therein. The failure to appear in court, or properly to instruct the solicitor assigned to their honors in order, if necessary, to insist upon the cancellation of the arrest and the sustained referral, makes the entire question, at least that regarding the arrest, subject to our jurisdiction according to our manner of proceeding. By that default, Messrs. Duntrfeld and da Cruz have brought upon themselves the obligation, should they so decide, to answer before us; being unable to derive any benefit or advantage from the sustained incompetence and declinatory exception, which might then have applied and could possibly have been valid had they deigned to acknowledge us or placed confidence in our administration of justice; whereas those gentlemen will now have to accept that, upon further non-appearance, we shall allow the proceedings to continue from default to default, as is customary according to procedure. Your Honors know that we are entitled to do so, although, in order to justify our conduct where and when appropriate, we take the liberty of demonstrating with respect upon what, or upon which grounds, we establish our opinion. The laws of our country, founded upon those of the Romans, are, for the instruction of all high and lesser courts, treated and described in the Dutch language in the well-known work entitled the Roman-Dutch Law by Mr. Simon van Leeuwen. We find indicated therein the force, nature, and character of the said laws, with an indication as to how far they are consistent with and brought into practice with the Dutch style and custom of the daily administration of justice; what a judge is bound to do, and what he ought to leave to a higher or other competent court. It teaches us how cases are instituted at law and how the same, according to the Sovereign's Ordinance on the matter of justice in the cities and in the countryside, must be prosecuted and brought to a conclusion; and it is thus that we, as privileged and lawful judges, let this and other legal authorities serve as our guiding rule. Regarding the daily or ordinary judge, it is shown in the Roman-Dutch Law, Book V, Part VI, page mihi 527, that whoever desires to sue someone at law is certainly obliged to do so before the daily competent judge; and, what is more, the plaintiff, according to the general rule, is considered bound to follow the court of the defendant. According to the general rule, that is to say that one cannot summon or cite before the court someone who belongs outside our jurisdiction by direct summons, or as it is called in raw action; but, as general rules in turn have their specific rules and one must therefore pay heed to the matter in which the lawsuit is instituted or commenced; thus the aforementioned Roman-Dutch Law, Book V, Part VII, page 532, clearly teaches when anyone must submit to a foreign jurisdiction, or becomes subject to the jurisdiction of a judge to whom he does not belong. The jurisdiction, says the author, which arises from the mere presence of the person, or the location of the property, takes place whenever one person, for certain matters, has the person of another seized and detained in the place where he finds him; or places an attachment upon his property where it is situated; whereby he is compelled by the power of the judge, if he is attached in his person, not to depart from that place until he has satisfied the claim; or if his property is attached, to see the same executed for the debt; or must

must (NB) be able to answer for himself there before the Judge; that which one calls arresting, for arrest establishes jurisdiction. Now, in order to give those against whose persons or goods such an arrest was granted the opportunity to oppose it, in so far as he maintains the arrest to be unlawful; the summons is thus made, whether by edictal or ordinary citations, and one wrongs no one but oneself by not appearing and, as it were, declining the Judge. For besides the fact that one thereby indicates a probable inability to bring forward anything against the legality of the claim and the arrest grounded upon it, there follows, according to law, precisely the contrary of that which one might or could otherwise claim and propose, namely the annulment of the arrest as improperly executed and the referral of the action to the presumed competent Judge. Now, in accordance with this doctrine of our laws, Messrs. Duntzfeld and da Cruz ought to have submitted to us that which they presented to their authorities by way of protest, and which the latter comes to write to Your Right Honorable Worships. We have already noted what is necessary concerning the unacceptability of that conduct, and we might find some reason for their displeasure and the resulting protest had the adverse party, as it might have done, had those gentlemen summoned by the tolling of bells and the posting of an edictal citation at the as also appears in the Roman-Dutch Law, Book V, page 542, where one reads: tacitly, jurisdiction is acknowledged if someone, being called before a Judge to whom he does not belong, takes no objection against it for referral to his ordinary Judge, but pleads the case there without objection, whereby he is understood to consent, tacitly, to the jurisdiction of the Judge. avenue of our village. But now that greater complaisance and courtesy have been observed than we were obliged to do according to the strict meaning of the law, those gentlemen wrong us as well as their accusers. We are willing to believe, however, that this step arises from ignorance of our administration of justice; but far from conceding any incompetence in the petition of the petitioners and the consequence thereof, we are so certain and untroubled regarding the legality of what has occurred that it would be ill-conceived to believe that we would be deterred by so presumptuous a protest, or could come to the opinion that the accusers should be ordered to abandon their action instituted before us and, with the arrested money, follow their opposing parties to Fredriksnagore. This would indeed be absurd and entirely overturn our manner of proceeding. The law itself is all too clear for us in this regard, for in the Roman-Dutch Law, Book V, Chapter XIII, where it is treated how such persons as nationals, though not residing under the jurisdiction of the Judge before whom they are called, are summoned, it is also treated in paragraph 4 what must be observed in that respect concerning foreigners, or such as do not belong under the jurisdiction of the Netherlands State, and here in the Indies under its General Chartered East India Company: if he (the defendant, says the law) resides outside the common jurisdiction of these Lands, the summons is made by edict, that is, public proclamation at the outermost boundaries, after the prior tolling of the bell, before the Court, by a Bailiff, and before the cities or villages, after prior request to the Judge of the same place, as before, done by his messenger; which having been done, the same summons (citation) is posted there and a duplicate thereof sent to the defendant. Had this method now been followed, and had the accusation against Messrs. Duntzfeld and da Cruz therefore been made known before the eyes of the public before our court, along with the reasons why we deem it necessary to cite their persons before the same, then, and only then, would it have had the appearance of what the Royal Council at Fredriksnagore remarks, namely as if one wished to compel Danish subjects to appear before a foreign Judge. But now, since we have used that polite precaution of urging Your Right Honorable Worships that notice of those accusations might be given and the defendants warned by their own authorities of the legal proceedings instituted against them; what is more, to facilitate the manner of legal practice unknown to foreigners, to recommend the interest of the aforesaid Messrs. Duntzfeld and da Cruz to the care and attention of a skillful solicitor, we certainly could not expect such impertinence. Nor do we know how to reconcile the first answer of the aforesaid Royal Council at Fredriksnagore with the latest request of those gentlemen. All that can be inferred from it is precisely that about which the Danish gentlemen complain, namely the asserted coercion regarding the right of each other's jurisdiction. For however much we acknowledge once again the correctness of those gentlemen's observation that every creditor ought to seek his debtor at his own forum, we nevertheless trust that Their Honors will also be pleased to do us the justice of admitting that there is no rule without exception; and that, in this case, the aforesaid petitioners Eilbracht and Os were indeed well-founded and we were justified in granting them the request for the arrest of monies resulting from the sale of a house within our territory, as the property of their debtor, the aforementioned Jan Matthijs Lasboom, whose certum domicilium still leaves very many misgivings.

We do not decide, nor can we yet decide, what final ruling will be made in the case pending before us. Besides the aforementioned decree of the attachment, we were also obliged, by virtue of the first default, to grant the Party's request to provide security for costs. If Messrs. Duntzfeld and Da Cruz can bring themselves to have their rights defended before us, for which there is indeed still time, they are obliged to comply with our aforementioned ruling before being able to contest the suit. In such a case, they lose none of their right to obtain the lifting of the attachment and the release of the funds, if they can verify their counter-accounts and demonstrate in court that the other party has claimed and attached too much. But if, through non-appearance, they allow the usual terms to expire further, all exceptions, however peremptory, lose their validity; and in such a case, from default to default, we will ultimately have to pass judgment in such manner and form as, after the submission of the parties' evidence, shall be found to be proper and just. For, says Gaill in his observations on Imperial practice, and particularly regarding attachments, see page 1053 of my copy, legal proceedings must conclude where they began; it would consequently be improper and inconsistent with law and equity if, in accordance with the request of the aforementioned Royal Council at Fredrichnagoor, the attachment were annulled and Eilbracht and associates were directed to seek their rights against the aforementioned Messrs. Duntzfeld and da Cruz in the aforementioned place, as long as the legality or illegality of their action and the attachment founded upon it have not been adjudicated in court. Indeed, just as confidently as the 136 Right Honorable Royal Commandant and Council at Fredrichnagoor dare to assure that the Plaintiffs will obtain all compensation that the Danish laws and the circumstances of the case permit; just as surely do we trust that Your Honors, for the honor and maintenance of the jurisdiction of this Council, could and might answer those Gentlemen that their subordinates will obtain that justice which the Dutch laws and the nature of the dispute shall indicate to be necessary and lawful; without the question presenting any obstacle as to whether our previously cited treatise regarding the legality of our conduct in granting the attachment in question is not applicable solely to subjects of the Dutch state, and whether foreigners are not exempt therefrom. For besides the fact that we have demonstrated above from Roman-Dutch Law that no distinction is made between Nationals and Foreigners, and how proceedings must be conducted against persons and goods not belonging under the common jurisdiction of the United Netherlands in case of a claim and lawsuit, which maxim is held as a general rule and guideline in the Indies; so we also learn from President Bynkershoek, from his treatises on Civil Law Cases, the first volume, page 140, that Foreigners in the Netherlands are subject to the Judicature of all Courts, and that none are exempted therefrom except public Envoys. Supreme Court of Justice, but in The Hague, where there is a lower magistracy, the President considers it extremely improper that permission must be requested beforehand, namely when the arrest is requested against the person and not against the goods of someone's debtor; for, writes His Honour on page 21 of the said treatises: "The matter is true in itself; one may in The Hague arrest the goods of foreigners, but not their persons. Why is that, you will say, since the Hague Court has high and low jurisdiction? But the sovereigns seem with this to have wished to take care that one might be in The Hague in all safety, whether to have access to the Prince or to pursue one's lawsuits." The same reason, namely a free and undisturbed transit of foreigners through this Colony, especially of English officers, moved the Political Council here on 21 January 1764 to decree that in case of a request for arrest by one foreigner against another, permission must first be requested and obtained from the Director, although otherwise our Instructions show that the Council, and if there is periculum in mora, the President and in His Honour's absence the Fiscal, can and may grant arrest without distinction for or against whom, indeed unconditionally upon valid evidence; provided that within a certain short time the arrest be pleaded before the full Council, and proceedings and judgment be held regarding the cancellation or maintenance thereof, which is why the same is granted to all petitioners under the usual proviso of periculo Petentis. Then, as our subordinates no less than those in The Hague or elsewhere require no permission when merely requesting an arrest on the property of any foreigner wherever it might be found or traced, if it is proven that it can and must serve as security for their claim against the debtor, we are indisputably obliged, in case of a petition, to advocate their interests and accept their complaints, lest we act against the laws and cause disorder in the course of Justice. We may even flatter ourselves with the favourable prospect that Your Honours are of the same opinion, and that the reasons we have brought forward will be found weighty enough to excuse yourselves most politely from the request of the Danish Gentlemen. 139 18 November 18 November reasons, to make our request to have the said attachment lifted and to let the petitioners pursue their rights before the court in Your Honors' colony, with the assurance that they will obtain such compensation as the laws and circumstances of the case permit. Since the administration of justice, according to our constitution and customs, does not belong to our assembly, but rests entirely with the Court of Justice, or the separate Council established here for that purpose by our High Principals, we have forwarded copies of both Your Honors' letter and the said petition to it, and have received in answer thereto a detailed representation justifying what has been done in this matter, which we have the honor to present herewith to Your Honors. It contains everything that could serve as an answer in this matter, and we do not doubt that Your Honors, after reading it, will be convinced along with us that our Council of Justice in this case has not only done nothing contrary to universally accepted and established laws, but also that with respect to Messrs. Duntzfeld and da Cruz, as subjects of another power, all courtesy and precaution have been observed that can be shown to foreigners in such circumstances, without prejudicing the lawful rights of our own subjects; and it is on that account that we believe those gentlemen are very wrong in saying that an attempt was made to force them to stand trial before a court other than their own. We very readily grant the general rule cited by Your Honors, that every creditor ought to seek his debtors at their own forum, but we request that Your Honors also be pleased to grant the rule that a creditor may seize not only the goods or property, but also the person of his debtor wherever he finds them. This is the case here; the creditors find funds belonging to their debtor in this place, and it is therefore also here that they seek to attach them; should their claim be deemed unlawful or not legally proven, the seizure or attachment will be lifted at their expense. For this reason, we hope that Your Honors will please be so good as to excuse us from the request made to lift the said attachment and to refer the petitioners to Your Honors' court; and we can, with great confidence, assure Messrs. Duntzfeld and da Cruz, should they see fit to bring their interests before our Council of Justice, that such impartial justice will be done to them as the laws shall show to be legitimate. In the letter written by this assembly to the Danes under date of 2 December 1785, which was found by Their High Nobilities to be very improperly stated, namely that the injuries done to us by the English were also contributing causes that our sovereigns were brought to the necessity of breaking with Great Britain, and all the more so because the Company never gave any cause or occasion for that destructive war which the English inflicted upon the Netherlands: thus it has been resolved, in respectful response hereto, to set down that the true meaning thereof was that the injuries done from time to time by the English Nation to us in our commerce, and whereby the Company also had to suffer, are regarded as those contributing causes, and not to imply thereby that the prejudice inflicted upon the Dutch Company would alone have contributed thereto. 148 laid down. The following regulations, in which those formerly made are included, are introduced: Art 1. Weavers employed by the Company shall (in common with all other Ryots of the Provinces) pay nothing under the name of revenues beyond what is specified in their Pattas (title deeds), which must be framed according to the fixed, established dues of the Government; they shall not be subjected to any arbitrary, indefinite tax of Zemindars, Farmers, or Collectors, for any reasons whatsoever. That the Commercial Residents shall, at the time when they register the Company's Weavers, as is ordered in the fourteenth Article, take an inventory of their engagements with the Zemindars &c. on account of revenues. A similar statement must be delivered by the Zemindar or Farmer regarding his claims on the Weavers &c. to the Collector, and in case of any complaints against Manufacturers, Gomastahs, Mohurrers, Dallaals, Peons, and other persons belonging to the factories, No weaver who is employed by the Company shall be arrested by any Zemindar or other person belonging to the collection of the revenues, nor shall they be harassed with Peons or summonses to appear before their Cutcherries, whether on account of arrears of revenue or judicial matters. The mode of proceeding against them, both regarding revenues and justice, shall be as the following regulations show. 149 Art 14. and who are employed in the transport of the Company's investment, for non-payment of revenues, the Collector or Farmer shall first present his claim in writing to the Commercial Resident, who, in case the weaver is then actually employed by the Company, shall satisfy the actual debt and deduct it by Kistbundy from the balance due to him or future advance without hindering him in his labour for the public investment. And if they are unwilling to settle the matter in that manner, the Collector, being requested to do so, shall summon the party and have the summons served by means of the Commercial Resident, who shall compel the defendant to appear on the appointed day, either in person or by a Vakeel. In cases of breach of the public peace or other crimes, after prior complaints to the Provincial Adawlut, a summons shall be sent to the Commercial Resident with a full copy of the complaints; and the same shall compel the defendant to appear on the appointed day, either in person or by a Vakeel; meanwhile, he shall transmit to the Provincial Adawlut all information which he has gathered concerning the matter, with his remarks made thereon. Article 7. The Company's Commercial Servants stationed in such districts must not be treated with any contempt; this would be detrimental to their business and could have other ill consequences. Nor are they to act as if there were any just opposition between the Departments of Revenue and Commerce. 6. The Commercial Resident, or his assistant, shall be at liberty to summon all weavers or manufacturers before him, and also to send people into all districts where cloths are fabricated, in order to know from themselves whether they are willing to engage for the preparation of any part of the Company's Investment, and this without let or hindrance from the Zemindar, or other renter, or Proprietor of the lands which such people inhabit. 8. If any Zemindar, Farmer, or Proprietor of Lands should refuse admission to the Commercial Department, or make use of threats or punishments to deter manufacturers from accepting any advances from the Company, he shall, upon conviction thereof before the collectors of that district, if he be a renter, lose his farm; and if he be a Talookdar, be fined or punished. And in order to prevent all disputes between the Agents of the English East India Company and individuals, especially with the Agents or Gomastahs of the French, Dutch, or Danish Companies, it is hereby ordered that no weaver, while employed in the manufacture of the public Investment, shall accept advances from any other person whomsoever, until he shall have finished the cloths previously contracted to be delivered to the Company, and have refused to accept any further advances from the Company's Agents at the rates and according to the quality and assortments which he has been accustomed to make. 10. And for the better ascertaining the number of weavers in each district employed in the Company's service, as well as the nature and extent of their respective engagements, it is hereby directed that at the end of each year or after the expiration of each contract, the Commercial Resident or his representative shall sign the settled account of such weavers and receive the weaver's signature to the counterpart thereof; which latter shall remain at the factory or kothi, always to serve as evidence of the settlement of affairs whenever called for. 11. fails to deliver cloths at the fixed times for which he has agreed, the Company's Agent shall be free to place peons upon him and keep him under restraint. If any weaver in the service of the Company shall be convicted of having sold cloths, either in person or by means of any of his relatives, apprentices, or agents, to other merchants or traders of whatever description, while he is deficient in his deliveries according to the stipulations made in his contract with the Company, such offender shall be punished after a regular trial and conviction in the Courts of Justice. And whereas practices have occurred of selling cloths produced with the advances of the Company to private individuals in a clandestine manner, probably because it best suits such merchants to purchase, without risk of arrears, goods that are already finished and of a finer quality, such as are produced by the Company's weavers who have been enabled to do so through long-standing support and advances; It is therefore resolved and ordered hereby that the purchasers of the said cloths, who are likely aware that they belong to the Company, whether from the secret and clandestine manner in which they obtain them or because it is publicly known that the weaver offering them for sale is employed in the service of the Company, shall, if the matter be proved, be subjected to punishment by the Adawluts according to the nature of their offense; and the cloths purchased in that manner shall be confiscated. It is nevertheless to be understood that the Board thinks proper and intends hereby to except from this rule all purchases made openly and fairly in the public marketplace or bazaars. And whereas those whose interest it was to make such purchases have alleged that the Company's weavers cannot be distinguished from others, it is hereby ordered that the Commercial Resident shall cause a list or register to be posted in the Cutcherries of each Pargana, indicating the weavers employed for the Company in that Pargana, and that this list shall be altered every week or month, according to the changes that shall occur weekly or monthly in that regard. The Collectors of revenue shall, upon a written request to that effect made by the Commercial Resident, provide all necessary assistance for the protection of the weavers and the security of the Investment. Weavers with whom compulsion is used to enter into agreements, or who are not paid for their cloths according to the agreements voluntarily made between them and the Company's servants or contractors, may complain, in the first place, if the injury is offered by native agents, to the Commercial Resident or contractor under whom they act. If the injury is offered by the Resident or contractor himself, or if he gives no redress against his agents, complaint may then be made to the Collector of the district in which such weavers reside. And the said Collector is hereby required to enter into an intelligent and impartial examination of such complaint, and if he judges it expedient, to represent the same to the Commercial Resident or contractor, to receive his answer, and determine thereupon either to dismiss the complaint or to refer it to the Presidency. And the weavers, if dissatisfied with the conduct of the Collector, may themselves represent their case at the Presidency (by a delegation of not more than ten of the number of complainants chosen from among themselves). However, in order that encouragement may not hence be taken for false or frivolous complaints, solely with the view of eluding the performance of fair agreements, or of procuring improper advantages, all manufacturers are hereby informed that complaints which are found to be really groundless will be duly punished; and of this Collectors are also desired to take proper notice. The extension of commerce must be promoted not so much by all contending for the labor of one man, even though he excels others in his craft, as by bringing more hands to work, even though new or less skilled. All merchants obstructed in their fair trade, conducted according to the foregoing regulations, are to have the same recourse as is stated in the last two regulations. Weavers who have reason to complain as above of the conduct of other traders towards them are, if employed by the Company, to have recourse for protection to the Commercial Resident; if not so employed, they must address themselves to the Collector or to the Dewanny Adawlut. All persons whatever employed for the Company in the districts, either in the revenues or otherwise, are likewise subject to these rules.

Obliged, since no satisfactory answer or settlement of affairs was to be obtained from those Gentlemen, to proceed to sending a Commission to Their Honors, in order thereby, if possible, to achieve our objective and thus finally see an end to the grievances and complaints so often brought forward concerning infractions of the Privileges and prerogatives granted to us for conducting free Trade as well as for the import and export of our goods upon payment of the stipulated Toll, along with whatever else still needed to be settled. We had already resolved upon this on 14 June of the previous Year, but suspended the execution in the hope of a speedy reply from those Gentlemen, because finally the long-awaited Fox Packet had arrived on the coast, with which Their Honors looked forward to the orders from Europe regarding the Trade in these Provinces, cited in their letter of 25 March 1785; but as this reply failed to appear, and in the meantime several unpleasantries regarding the matter of the Tolls and the respecting of our Dustucks occurred to us again, mentioned in the Resolution of 26 July, we took the decision on that day to let the same proceed, and chose for the execution, as possessing the required knowledge and abilities for it, the merchants Jacob Eilbracht, Trade Bookkeeper, Dispensier, and invoice keeper, and Cornelis van Citters Aarnoudsz, Chief of Patna, then present here, with the addition of the Bookkeeper and provisional First Sworn Clerk Teunis van den Broeck to assist in translating the necessary Papers; the points to be negotiated were determined by that Resolution, and in the subsequent one of the 30th thereafter, there was inserted the instructive Memorial drawn up afterwards and the Credential given along to the Calcutta Government, as well as the draft Arzie to the Gentlemen Nawabs on this subject, prepared in accordance with the aforementioned previous resolution. All this appears in further detail from the accompanying Report with its Enclosures, which was submitted and drawn up for us in this regard by the First in that commission, the merchant Eilbracht aforesaid; therein Your High Honors, if you please, will find not only the inducing causes from the very beginning, but also what occurred during the same and what the outcome was; everything described so circumstantially and clearly, and accompanied by such remarks relative to our situation in the present critical time, that without unnecessary repetition, nothing needs to be added here. We therefore respectfully request to be allowed to refer thereto 159 Reflections thereon; some remarks regarding this. Merchant Verspyck being assaulted on the public road by some officers; resolved to complain about this. Kassembazar brief. and to the Resolution of 18 January of this Year, in which latter our remarks thereon are briefly recorded, and from which it also appears that a Copy thereof was offered to the Gentlemen Masters with the ship Hinloopen, in order to enable Their High Mightinesses, concerning our situation, to obtain therefrom the necessary light in Their deliberations; we have also, according to what was recorded in that Resolution, expressed our thanks to the said merchant Eilbracht for the zeal and goodwill shown, both in the execution of the Commission itself and in the extensive report of matters, which is considered to have been prepared with a true desire to maintain and advocate the Company's rights and privileges, although we have not been able to conform completely with all that appears therein, whether with respect to personal remarks, or to what concerns our circumstances. Our further correspondence with the Calcutta Government, beyond that which relates to the aforementioned commission, was occasioned by an unpleasant incident that befell merchant Verspyck at Kassembazar, who was assaulted and mistreated on the public road by some officers belonging to the English Encampment at Berhampour, as the Kassembazar letter of the 12th prior, with its Enclosures, inserted in a separate Resolution of 19 July of the past Year, serves to show; as appears from the said Resolution, this was regarded by us not only as insulting to merchant Verspyck but also to the entire Nation, regarding which one could expect nothing less than equitable Satisfaction, which we also resolved to request, with emphatic complaint about this, from the Calcutta Government; but since we then still lacked the necessary evidence to substantiate these complaints and to identify the perpetrators, we contented ourselves for the time being with giving an account of the matter, presenting our view that this case ought not to be investigated or decided by the ordinary court-martial, before which Military men can only be tried in matters that relate to their service, but not when they make themselves guilty of public crimes, as the letter also inserted in that Resolution indicates; the Kassembazar servants sent us shortly thereafter, along with their letter of the 18th of that month, also with the Correspondence mentioned therein inserted by resolution of the 22nd, the aforementioned evidence, as far as they could obtain the same, after which we brought in our personal complaints about this offensive incident in a letter that is also incorporated in that Resolution.

Disputes at Cassembazaar over the freedom of our village. Shortly thereafter, we received such an answer to the first one dispatched as can be found in our resolution of 26 July; what further occurred regarding this is described in our successive resolutions of 16 August, 3 and 14 September, 21 October, 21 November, and 27 December, to which, in order to avoid a continuous and tiresome repetition, we take the liberty to refer. Coming, in conclusion of this, to that of 17 February last, it appears that we are hitherto unaware of what consequences these instituted proceedings before the court-martial have had. For this reason, we also decided on that day to request the Calcutta gentlemen to be informed of this, which has since occurred, but whereto we have as yet received no answer, which we nevertheless expect shortly; although, by the junior merchant De Vriese, recently sent to Calcutta concerning our grievance over the detention of the opium fleet there, it is reported to us to have been understood from Governor Macpherson that this matter had reached its conclusion, and the verdict thereof would be imparted to us shortly. By resolution of 28 June 1785, it appears that informal notification was given to us by the Calcutta government of the conclusion and ratification of the definitive peace articles between the mutual sovereigns, which we answered in equally polite terms. According to a letter recorded under the resolution of 2 September, an application was made by the same again for the conclusion of a cartel for the surrender of mutual deserters, which we, however, for reasons cited in the resolution, declined for the present. At Cassembazaar, just as in the year 1781, some unpleasantness again took place over the freedom of our village Kalkapoer; in our resolution of 21 November last, the same is described in detail, alongside the correspondence conducted regarding it by the First Signatory with His Excellency the English Governor-General Macpherson, upon whose private letters to Mr. Ives for the removal of our complaints, however, this had no effect, as the resolution of 9 December shows. Whereupon the Director wrote again to the aforementioned Governor-General about this, under date of 10 December, such as the letter inserted in the resolution of 17 February last demonstrates; communicating on the same day to the assembly that, according to the letter of His said Excellency, the decision of this matter remained suspended, because a similar dispute with the French nation was taking place, after the settlement of which a decisive answer would be given to us, which we still await. 161 Correspondence with the Danes. Sir William Jones, one of His Britannic Majesty's Judges, having issued a warrant, grounded upon the depositions of eight witnesses, for the apprehension of the person named La Cosse, who escaped from a guard that was conveying him down from Dinapore to be tried in the Supreme Court of Judicature on suspicion of having murdered a native named Chingi, we request that, as an act of public and general justice, Your Honors will cause enquiry to be made whether the said La Cosse is concealed at any of your factories or is under the protection of your flag, and in case he should be discovered, that Your Honors will cause him to be seized, apprizing us thereof at the same time, when the necessary officers will be sent to receive him into custody and convey him to Calcutta, in order to be examined on the heinous crime laid to his charge. We have had the honor to receive your Nobility's esteemed letter of the 5th of this month, and in accordance with your Nobility's desire made known to Messrs. Dunkfeld and Da Cruz, as executors of the estate of the late Captain Lasboom, the attachment granted by the Council of Justice at Chinsura on the amount of the proceeds from the sale of Captain Lasboom's house there. We do not doubt in the least that your Nobility will be pleased to take such measures as are required by the circumstances of the case, and have the honor ever to remain with high esteem, undersigned, your Honorable Nobility's humble, sincere, obliged servants, signed Le Fevre, C. The termination of the commission decreed to Calcutta at the session of 26 July of this year, and the departure of the Patna chief, the merchant Cornelis van Citters Arnoldsz, with whom the same was assigned to the undersigned, requires of me, according to bounden duty and the orders given thereto, to deliver a written report to the Council of what took place therein; and at the same time to supply my humble considerations To the Honorable Worshipful Lord! 168 regarding the present state of the Company's affairs in this Country, and what is to be expected from such an arbitrary authority as the Calcutta Government comes to exercise over this Country, the rights and liberties of the nations established here, and in particular those of our Company. In order to deal with so weighty a matter with such clarity and distinctness that I may be understood and comprehended abroad as well as within this country, it appears necessary to me, in the first place, to direct the attention of the assembly to what preceded the commission itself, upon the retaking possession of our settlements from the English after receiving positive news of the peace between both Sovereigns, and what finally gave occasion to let it take effect. Paragraph 3. The actual and essential purpose, the revival of our rights and liberties and, by virtue thereof, the unmolested exercise of our commerce, was from the very beginning, when we were to take re-possession of our places in Bengal, Bihar, and Orissa, regarded as a point that above all had to be kept in view in order, when it should be the proper and suitable time, to reclaim those privileges and their broadest scope, and for that purpose, among other things, to cite the respected orders of the Honorable Supreme Indian Government, contained in the 27th section of the general letter to this assembly dated 27 July 1784, and those contained in the secret missive of 20 July 1781, only received with the one just mentioned in October 1784, because the war caused the inconvenience that the original thereof was not delivered in the year 1781, or, owing to the outbreak of the war, was thrown into the sea. Paragraph 4. From the request made by this assembly to the Supreme Government in Calcutta, as shown by the separate Resolution of 4 October and the credential delivered to the commissioners by virtue thereof for the retaking of our possessions, it appears that nothing was thought of at that time regarding the necessity of a free trade as being required for the prosperity of the country; and according to the 2nd article of the instructions delivered to the commissioners, they were specially ordered that, if for any reasons they could not yet decide upon the surrender of our factories, to request permission for the unloading of the ship Straalen, which had then arrived in the Ganges from Batavia, and the storage of the goods brought by it in Chinsura, in places that in such a case would be found suitable for that purpose, and that to this end the necessary orders might be dispatched, both to the shore guards and elsewhere, wherever it was found
