219 rupees with the interest thereon since the 21. March 1781 at 3/4. percent per month, on certain merchants in Souratta, Beramje Souraabje and Harmootje Rettingie, textile suppliers of the Dutch Company, and that in payment of a like sum which we had negotiated to them on the 21. March 1781 for the Noble Company, on two bonds in the names of Saa Gosaeltjent Kapoortjent and Saa Kapoortjent Singa; and the said suppliers, whose payment of this bill of exchange had been ordered by us, as soon as the same was presented to them for payment, handed over or placed into the hands of the said heirs of Bhaijsa—since they had no cash on hand at that time—immediately in payment or deduction of the said 100000 rupees, a parcel of textiles stored in a warehouse, to the value of 50000 rupees, and furthermore undertook to pay the remaining sum out of the goods remaining in their custody; to which end they immediately delivered the keys of the aforementioned warehouse, where the goods were stored, to the aforementioned heirs of Bhaijsa; whereby, the aforesaid bill of exchange having thus been realized, we could never have suspected that Your Honors, upon taking over the Directorship, contrary to all rights, would have deprived it of its effect. Yet this was done by Your Honors when you, notwithstanding all representations and protests made against it by the more-mentioned heirs of Bhaijsa stating that these goods had already become their property by the aforesaid transaction, proceeded to cause this warehouse, 220 after the keys to it had been refused by the aforesaid heirs, to be broken open with force and to remove the goods from it, while all the remaining goods that the said suppliers were further to give in payment of this bill of exchange were likewise removed by Your Honors. Your Honors were addressed several times concerning this unlawful conduct at the time we were your prisoners of war, by the then Director Mr. van de Graaff, and most recently after His Honor's exchange and upon his departure from Souratta, by letter of the 28. January 1782. And it is now that we, upon the express order of our High Superiors, request Your Honors and expect from your equity, to credit the Noble Dutch Company with the amount of the aforesaid bill of exchange, which has been deprived of its effect by Your Honors' conduct, together with the interest. The claim you are now pleased to repeat, respecting the heirs of the Banyan merchant Baysa, we can on no account admit. You must well know, we are not ignorant of the mode of providing investments for the Europe market by making considerable advances; consequently, the goods outstanding of your investment, on which advances had been made, as well as those deposited in your warehouses in town, could not be considered otherwise than clearly the property of your Noble Company, and, on the capture of your factory, became that of ours, the same as all other Dutch property whatever. Surat, 7th March 1786. Had the assignment you mention taken place, the heirs of Bayser would no doubt have had some proof to shew that the goods were given as security for the money their father had lent to the Dutch Company; his bonds were his security, and there was no endorsement thereon conveying any other collateral security. Even had any assignment been made after the rupture with Holland, it could not have been admitted, and we must observe, it is to the highest degree improbable that one should have been made before, or an order given for the disposal of goods in Surat which were evidently provided for exportation. This is so well known a matter that it needs no proof, nor do we wish, very far from raking up past matters, to heal the breach and now that peace between the two Nations has been restored, to revive again as much as in us lies that good correspondence and harmony which previously so happily prevailed, and we shall therefore confine ourselves herewith solely to demonstrating to Your Honours, your superiors and the whole impartial world, firstly, that the bill of exchange or assignment in question was granted not after hostilities against the Dutch had commenced here, but on the contrary and at a time when we had an indisputable right to do so, and secondly, that Your Honours' council of that time paid no regard to the same bill of exchange or assignment, but put themselves by force of arms into possession of those goods which were given in pledge in payment of the aforesaid bill of exchange and had immediately become the property of the heirs of Baijsa, without paying any heed to all the representations and protests made by the aforesaid heirs, nay, notwithstanding their steadfast refusal to deliver to Your Honours the keys of the warehouses wherein these goods were stored. Concerning the first point, it cannot be contradicted by any impartial person nor by Your Honours yourselves that we, as Ministers of the Honourable Dutch Company in this place, had the right to dispose of and arrange the goods, merchandise and possessions of the same Company, up to the moment that our factory was taken by Your Honours' arms.

was taken, even to such an extent that we would have been able to destroy them without being indebted for any reckoning or accountability in that regard to anyone other than our superiors, indeed even without Your Honour being able to blame us on that account, and according to this rule we were also permitted to resell these linens, which we had caused to be made for the Company, or to dispose of them in another manner at our pleasure. It is true, Gentlemen, we have always been in the firm confidence that in the event of a breach of the peace between Great-Britain and Holland, the possessions and properties of the Dutch Company at this place were safe and secure, as well by reason that Souratta, until the moment of the late War, was always considered as a neutral place, but principally because we have resided here under and upon the reliance of the firmans and privileges of the sovereign, which were granted for the assurance of a complete safety and protection, and which by Your Honour yourself, for and on behalf of the Honourable English Company as Governor of the Mogul's castle, were very expressly and most solemnly repeatedly guaranteed; and we therefore could not in any way expect that which has happened here. But nonetheless there could arise in us an apprehension that in case of a breach of the peace, of which people at that time began to whisper in the town, it would be very difficult for us to dispatch the Company's linens from Souratta, and that it was therefore better to dispose of the same and to discharge the negotiated moneys in order thereby to be freed from the payment of interest; nothing is more natural than this, and nothing less could our superiors expect from ministers who have their interests at heart, however strange and improbable Your Honour may please to call the same. And to this end we resolved on the 9th of June 1781, five days before the Directorship was taken by Your Honour's troops, to make restitution to the heirs of Baijsa of the sum of one hundred thousand ropijen, which they had lent to the Company on the preceding 21st of March, and to do so out of those moneys and goods which our linen suppliers owed and had in their possession. We therefore on that day granted to the aforesaid heirs the assignment or bill of exchange drawn upon the linen suppliers of the Honourable Dutch Company, Beraamptie Souraabjie and Hurmootjie Rettingjie, of which we have the honour to attach a copy hereto under No. 1. And we ordered the said suppliers on the aforesaid 9th of June to satisfy this assignment or bill of exchange out of the amount which they had in their possession belonging to the Honourable Dutch Company, as appears from the order also attached hereto in copy under No. 2, which was immediately delivered to them, while the bill of exchange itself was handed over in person to the aforesaid heirs of Baysa early the following morning, being Sunday the 10th of June, by the then secretary of our council, Egbert Nicolaas Wiardi, and accepted by them, as appears from his sworn declaration No. 3. Whereafter the aforesaid suppliers immediately proceeded to the execution of the aforesaid order, by handing over to the heirs of Baijsa the keys of a warehouse in which a considerable quantity of goods was stored, and thus delivering or transferring the same goods into their hands in part payment of the bill of exchange accepted by them for settlement, as it did not suit them to pay in cash so expeditiously. The first point having been proven, namely that we disposed of the Company's properties at a time when we had an indisputable right to do so, we appeal with respect to the second point to the personal knowledge and presence of the Honourable Gentleman, Your Honour's Chief, and Council of that time, holding ourselves assured that their integrity and sincerity will not allow them to deny that the heirs of Baijsa, immediately after the shipyard was taken and while we were still confined in the same, showed the aforesaid assignment or bill of exchange, which is still in their possession to this day, and insisted that the goods be left untouched as their property or pledge, and that when the keys of the warehouse were demanded from them by the Chief et cetera, they steadfastly refused the same, without Your Honour having been pleased to pay any regard thereto, but instead proceeded, in order to get to the goods, to have the doors broken open by force. It therefore does not matter in what manner the contracts for commissioning goods for the European market are made here; it is enough that we have proven that the ownership of the goods passed for the payment of the heirs of Baijsa, and that they were not Dutch property at the time the Directorship was taken by British arms, and we may rightly, with regard to Your Honour's allegation that if we there

that we should have had knowledge thereof, is of no more force than that which Your Honours were pleased to cite in your letter of the 7th of March, and which we, in our letter of the 16th following, have refuted as clearly as extensively, for if that argument held, then all dispositions which any subject might make regarding his property from the time that war was declared on his sovereign until the moment that the fortune of war made him a prisoner would be null and of no value, a strange proposition which has perhaps never before been advanced, and is contradicted by daily experience, since all sovereigns have always respected what had been done prior to the actual conquest, at least the capture, of a place; moreover, in our aforesaid letter of the 16th of this month, we demonstrated that we could never expect to be attacked and overcome in a neutral place as this previously was, where our security and privileges were even guaranteed, and now we declare, namely those of us who were here at the time the Directorship was taken, most solemnly and formally in addition, that we were ignorant of any declarations of war anywhere at the time we granted the bill of exchange. On the 24th of February of this year we addressed ourselves by letter to Your Honours' Chief and Council at this place, with the request to indemnify the Noble Dutch Company for the amount of a bill of exchange, in the sum of one hundred thousand rupees with interest, as we had granted on the 10th of June 1781 to the heirs of the Banyan merchant Baijsa on certain merchants in Souratta, Berampje Souraabje and Harmootje Kettingje, linen suppliers of the Company, in settlement of an equal sum which we had negotiated from the said heirs on the 21st of March of the same year in the names of Sja Gosaaltjent Kapoertjent and Sja Kapoertjent Singa, but which, by Your Honours' aforementioned Chief and Council, when the Directorship was taken on the 14th of June 1781 by British arms, was deprived of its effect by the violent breaking open of the warehouse and the removal therefrom of the goods which, by the aforementioned merchants Berampje and Harmootje, after they had accepted the aforementioned bill of exchange, had been given in pledge or payment thereof, or had been mortgaged therefor, as Your Honours will please learn from the copy of this our letter enclosed herewith under Lit. E. However much we, in all fairness, had to expect that Your Honours' Surat Ministry would have complied immediately with this requisition, we observed, on the contrary, from the letter with which their Honours favoured us on the 7th of March last, that they did not please to admit this claim, mainly on the grounds that it would be in the highest degree improbable that the bill of exchange, assignment, or transfer in question would have been made before hostilities between England and Holland had commenced here, or that an order would have been given for the disposal of goods in Souratta which were clearly destined for shipment, etc. And since we, from the tenor of the aforesaid letter, a copy of which is enclosed herewith under Lit. and the linen suppliers of the Noble Dutch Company, Berampje Surabje and Harmootje Kettinghje, granted to the heirs of the Banyan merchant Baijsa and in their possession up to this moment, is dated the 9th of June 1781; secondly, from the order upon the aforementioned suppliers to satisfy the aforesaid bill of exchange to the said heirs from that which they held belonging to the said Noble Dutch Company; and thirdly, from the solemn declaration of Egbert Nicolaas Wiardi, who was secretary of our council at that time, that the aforesaid bill of exchange was delivered to the heirs of Baijsa at their own residence and accepted by them on the morning of the 10th of June 1781, and thus five days before any hostilities between Great Britain and the Republic of Holland had been heard of, which three documents were annexed to the aforementioned letter under numbers 1, 2, and 3, as they are also enclosed herewith. We could therefore not but be extremely astonished when, instead of a prompt consent in accordance with equity, their Honors, by their letter of the 21st of March aforementioned, annexed hereto under letter D, thought fit to cast another obstacle in the way, and, under the pretext that the draft or assignment had taken place pursuant to and after the declaration of war had been published at Bombay, to persist in their refusal. A proposition which sounded so strange to our ears, Right Honorable Lord and Sirs, when we considered what the consequences would be if all dispositions which any subject might make regarding his property from the time that war was declared on his sovereign until the moment that the fortune of war made him a prisoner of war were to be null and void, and which showed us clearly that their Honors intended to persist in their refusal under whatever weak and frivolous pretexts it might be; wherefore we were then obliged to reply to the said Chief and Council by our letter of the 26th of the frequently mentioned month of March, demonstrating the aforesaid and making a solemn declaration that at the time the bill of exchange was granted we were ignorant of any declarations of war, stating that we would address ourselves in this regard to the place where we may hope to obtain satisfaction, in the manner that your Right Honorables will be pleased to learn from the letter itself annexed hereto under letter E. And it is as a result of this necessity that we take the liberty to address this to your Right Honorables, with an urgent request that your Right Honorables will be pleased to give the necessary orders or otherwise arrange that the Noble Dutch Company be indemnified for the amount of the frequently mentioned bill of exchange or assignment to the sum of one hundred thousand rupees with the interest, which has been deprived of its effect by your Honors' Chief and Council here as aforesaid. Although we in no way doubt that your Right Honorables will be abundantly convinced from this enclosed correspondence between their ministry here and us of the validity of the right of the Noble Dutch Company to the requested compensation, we hope that your Honors will forgive us if we briefly reiterate in this: That we granted this bill of exchange at a time when we had the most indisputable right to dispose of the property and possessions of our masters, without the reasons brought against it by the Surat Chief and Council being of any force or application; for the unusualness in the Indies or at the place where they are made of making arrangements about and disposing of goods that have been prepared to be transported detracts nothing from the right that everyone has to dispose of the goods again or to cede them for debts at the very place where they were produced, and no one of sound mind will maintain that someone is not permitted to dispose of his goods as long as he has not been deprived of his natural liberty; besides that the disposition made by us regarding the goods of the Noble Dutch Company is very proper and natural, indeed could never be otherwise, for although we could by no possibility imagine anything other than that we and the goods of the Company at Surat were safe.

In reply to our letter of 26 October 1784, by which we demanded from Your Honors the restitution of all the possessions and privileges that the Dutch Company held before the war, Your Honors were pleased to reply to us by your honored letter of 3 November 1784 that the Noble English Company, by its latest treaty, had ceded and transferred the city and pergunnah of Brootchia to Madajee Scindia Bhadur, who was now in full possession of its sovereignty; and when Your Honors subsequently informed us by your letter of 6 January 1785 that you had resolved to follow the example of Bengal in the restitution of the Directorate as far as local circumstances would permit, we requested from Your Honors in our reply of the 22nd of the said month an explanation of this reservation, whilst already protesting against it in advance. To this our last letter we have never been honored with any reply, nor have Your Honors, as far as has come to our knowledge, taken the slightest step to restore to us the factory of Brootchia with its privileges, etc., to which, however, the Noble English Company is indisputably obligated pursuant to the 5th Article of the peace concluded between His Majesty the King of Great Britain and the Republic of the United Netherlands on 20 May 1784, by which the said His Majesty expressly bound himself to return Trinconomale as well as other cities, forts, harbors, and possessions which were taken during the war by His Majesty's arms or those of the English Company, in whatever part of the world it may be, without Your Honors' pretext that Brootchia has been ceded and transferred to Madajee Scindia Bhadur being able to avail the English Company, since it possessed no power to give away anything by way of gift, sale, or under whatever name it may be, which had not yet been ceded to it by any treaty. We therefore find ourselves entitled and, according to the express further orders of our superiors, obligated hereby repeatedly to demand back from Your Honors, Gentlemen, the factory at Brootchia taken from us by Your Honors, with all the prerogatives and privileges which the Dutch Company had and possessed there before the war, not doubting in the least that Your Honors will nevertheless, according to good faith and in compliance with the concluded peace treaty, promptly satisfy this our legitimate requisition. To the Right Honorable and Most Respected Sir Rawson Hart Boddam, Esq., President for all affairs of the British Nation, and Governor of His Majesty's Castle at Bombay, together with The Council. Right Honorable and Most Respected Sir, Gentlemen. When Your Honors' administration at this place, in the year 1778, saw fit to obstruct the Honorable Dutch Company in a privilege that it had freely exercised until that time, namely, to export its merchandise free of tolls to whichever place desired throughout the entire Mughal Empire, after having paid the customary tolls upon importation at Surat, we addressed ourselves, for the purpose of redress and the removal of these obstructions, first to the aforesaid administration by our letters of the 5th of October 1778 and 22nd of February 1779; and when this proved fruitless, to Your Honors yourselves, by missives of the 30th of April, 13th of September, and 27th of November, likewise of the last-mentioned year 1779. In reply to which Your Honors, in your rescript of the 18th of December following, were pleased to state: "we cannot take upon ourselves to decide in a matter of so much importance, but for your complete satisfaction we shall arrange the entire subject in order and transmit it to the Honorable Court of Directors, our superiors, with faithful copies of every paper, whose explicit orders we shall request for our guidance." But to our further letters of the 26th of February and 26th of September 1780, and the proofs annexed thereto showing that the Company has always exercised this right undisturbed, even after Your Honors became masters of the Surat Castle, Your Honors have never honored us with any reply. The right itself, however, is of too great importance, and the damages that the Honorable Company suffers from the obstructions placed upon it by Your Honors are too substantial for us to defer any longer urgently requesting Your Honors, Gentlemen, once more to remove the aforesaid obstruction, or to inform us in your reply, with which we hope to be honored, what prevents Your Honors from allowing us to enjoy such an undeniable right freely and without opposition. And in the event that Your Honors should still be awaiting orders from your superiors, we further request that Your Honors, in order to prevent greater disadvantages to the Honorable Dutch Company, may be pleased to accept the provisional accommodation proposed by us in our missive of the 25th of February 1780, namely, that a separate account be kept of the merchandise we shall export, or otherwise, if Your Honors deem it better, that we meanwhile deposit the amount thereof in specie with Your Honors yourselves, or wherever you shall see fit, until this question is finally decided. Finally, we request permission to acknowledge the receipt of Your Honors' letter of the 8th of this month. Short demonstration of the true state of the Honorable Company at the office of Souratta, as the same was found in comparison with the financial year 1784/5 and the established budget of the year 1755 upon the closing of the trade books of the year 1785/6 as of the end of August of the year 1786; namely: I. General indication and comparison of the profits and charges of this against the financial year 1784/5; to wit: The true profits of this financial year amount to ƒ 198077:3:— In the year 1784/5 the same amounted to ƒ 226573:4:8 Thus now less ƒ 28496:1:8 The charges amount to (including the travel allowances amounting to ƒ 1648:—:— provided at Cochim to an under-merchant, a bookkeeper, and an assistant sent hither and charged here to the pay account of the recipients) during a full year or the course of the books of 1785/86 ƒ 54635:16:8 In the year 1784/5 the same amounted in 10½ months to a sum of ƒ 46345:13:8; amounts, as under Article III, for a full year to ƒ 49503:8:8 Thus in this financial year more ƒ 5132:8:— The greater incurred charges added to the lesser attained profits, it thus appears that this office in the present financial year has advanced less than in 1784/5 by ƒ 33628:9:8 And taken on its own, or if one deducts from the true profits attained in this year amounting to ƒ 198077:3:— the incurred ordinary true charges amounting to ƒ 54635:16:8, it thus appears that this office during the course of these books, or in one year, has advanced by ƒ 143441:6:8 II. General comparison of the profits and charges against the established budget with annexed reasons from which the differences take their origin; as: For the profits there are set down by the memorandum of retrenchment dated 9 May of the year 1755 ƒ 867000:—:—, which reduced by 25 percent or in Dutch money amount to ƒ 693600:—:— And the same amount to ƒ 198077:3:— Thus less ƒ 495522:17:— The origin of this so disadvantageous difference with respect to the profits is principally to be attributed: To an incomparably lesser supply of trade goods compared to the times according to which the cited memorandum was formed, as the same consisted merely of ample two-thirds parts of the cargo of a single ship, which moreover arrived here so shortly before the rainy season that one had no more than one and a half months' time for the sale; otherwise the prices of the goods at present, apart from the spices, are generally much higher than at the time the aforementioned memorandum was drafted. The charges are fixed by the memorandum of retrenchment and general regulations on the provision for the servants at about ƒ 119500:—:—, which now according to current value is ƒ 95600:—:— The same amount in this financial year to ƒ 54635:16:8 Thus less ƒ 40964:3:8 Which lesser amount was primarily caused by a general reduction of the establishment in this directorship. The amount expended by the Present Honorable Director during the time he was a prisoner of war to preserve the Honorable Company's garden Zorgvrij and the dwelling standing therein from total ruin, which amount, pursuant to Their High Excellencies' qualification granted on August 23 of the said year, has been transferred in favor thereof to the debit of this account with: 694 florins 10 stuivers. Pursuant to the aforesaid Political Council resolution of July 7 of this year, there was transferred to the debit of the Account of Douceur and to the credit of this prior year account what the first named had previously been debited too much for calculated douceur on merchandise collected but remained unpaid to the Honorable Company, and which after the transfers still remained before, up to: 3184 florins 2 stuivers. Pursuant to the same resolution, there was written back to the debit of the Account of Contracting and to the credit of this account the previously calculated interest on the 100000 rupees advanced to the Honorable Company on March 21, 1781, by Saa Gosaaltjent Cappoertjent and Saa Cappoertjent Singa; which had to be satisfied to the said merchants upon a bill of exchange granted on June 9, 1781, by the Honorable Stern Lord Councillor Extraordinary of the Netherlands Indies and then Director of this Directorate Willem Jacob van de Graaff upon the linen suppliers Beramje Souraabje and Hormogie Rettingje, which bill of exchange was deprived of its effect by the violent and unlawful conduct of the English in breaking open the warehouse and carrying off the linens from whose proceeds the payment had to be made, and these merchants remained unpaid: 2460 florins, making 5644 florins 2 stuivers. Examined Rozeneier Upon closing the Trade Books of the year 1785/1786, Disposition taken in the Council of Policy at Souratta the undersigned Trade Bookkeeper has found such on Tuesday, 2 Jannuarij Ao 1787. Debtors, Creditors, and outstanding Accounts as follow below and overleaf, with a brief demonstration of their origin; Namely: Debet. Conditionally Paid Monies - - - - ƒ 3927:12:—: These monies may be cleared, now that the claims of the families of all the remaining and absent Moorish seafarers, to whom the sum mentioned in the text was paid out, have been cleared. Having detailed the origin of this in the latest preceding memorandum, inserted by resolution of 8 februarij of this year, I refer most obediently to the same.
