And it was resolved with unanimous votes to remain lying at anchor, in order that, if we should fortunately get to sea, we might not generally be destitute of anchors. We therefore immediately send the longboat to Voltha so that, if Your Right Honourable should deem it fit that we set sail with the upcoming spring tide, anchors and a rope could immediately be sent down with the same longboat, as the pilot objects to lying here any longer with three anchors, of which we now have only one on the bow. I have likewise sent my empty water casks with the longboat to Voltha to be filled. With my rations I shall manage well enough, although I have already provided for a month and it has expired. Dear Fredriks I wrote to you the night before last, and promised to repeat it last night. I must now explain to you why I did not. In my former letter I wrote to you that we had that day boated the anchor and cable, but being dark before the boat floated, it was thought imprudent to send off the boat in the night. The people during the night let the boat ground at high water; the consequence was that the boat opened, and is wrecked. All day yesterday we were Worth Fredriks I wrote to you the evening before last and promised that I would resume this yesterday evening; I must now give you an explanation why I did not do it. In my previous letter I wrote to you that we had that day shipped the anchor and rope into a vessel, but since it was dark before the vessel came afloat, it was judged imprudent to send off the vessel in the evening. The crew let the vessel ground at high water during the night. The consequence of that was that the vessel broke to pieces and was lost. We were busy the entire day yesterday trying to get the anchor into another boat. This vessel also gave way and met with almost the same fate as the former, so that we, for that day, had no other remedy than to put the cable on board the sloop; as the officer would stay no longer, and the pilot had told me that if I would have the anchor carried to the outside of the creek at low-water mark, he would then go there at high water to heave it into the sloop. I readily agreed to this. I told them that if I succeeded in this, I would let a white flag fly from the top of my house, and I also did this at the moment the work was accomplished. This was a little before noon; the sloop was then lying below the point and could not fail to see the flag; notwithstanding this, he weighed around half attempting to get the anchor into another boat. This one also gave way, nearly shared the same fate as the other, so that we then had no remedy for that day but only to put the cable into the sloop, as the officer would stay no longer. The pilot having told me that if I would get the anchor carried to the outside of the creek and lay it at low-water mark, that he at high water would bring the sloop upon it and heave it up. 392 393 24th April 24th April Cossimbazaar, the appointed curators, namely Merchant Iohan Wilhelm Salomon van Haugwitz, Junior Merchant Iohannes Cornelis Heyning, and Book- keeper Jacob Coenraad Kayzer, containing a request that, in view of the uncertainty of the state of the estate, they may enjoy the Benefit of Inven- tory, as the petition itself further demonstrates. To the Honorable, Worshipful Mr. Isaac Titsingh, Director and supreme commander over the Honorable Company's important trade and interests in the kingdoms of Bengal, Behar, and Orixa, together with The Members of the Worshipful Council of Po- licy of this Factory. Tuesday Right Honorable Sir Mr. Isaac Titsingh The true balance of the Company's petty cash under today's date amounts to ƒ 34093:5:- or Pr:. 27274:9: 17/215 in specie /:signed below:/ Hougly ult:o April 1787. /:signed:/ J:s Widman, of which, as customary, it is understood to keep this note. - Subsequently, the Honorable Director currently in office presented an official address from the Council of Preference and Justice of this factory dated the 25th of the recently passed month of April, dedicated to this assembly, containing, in detail, Their Honors' remarks were read the usual statement of the cash balance in the petty cash here in Hougly, as of the ult:o of the preceding month of April, reading as follows. - In the morning; all present. remarks 398. 399 29th May 29th May remarks and reflections on the custom which has hitherto taken place in settling the procedures regarding preference and concurrence on insolvent estates, namely by not considering the actions and claims of native creditors, or more properly the Banyans or agents of such persons who happen to die insolvent, by reason of the manner in which they are instituted, as anything other than concurrent, whereas these debts, however, mostly originate from advances that the Banyans, as cashiers and financiers of their respective masters, generally make, both for the promotion of trade and for the settlement of all household expenses, such as paying the baker, butcher, butter and milk farmers, tailors and suppliers of materials for clothing, and further everything that is included under the title of household expenses, under which drinks, provisions, house rent, servants' wages and the like are understood, for which the seller or supplier, if he could show in his own person that he was not paid, would irrefutably have and enjoy the right of preference, wherefore Their Honors are of the opinion that regarding the judgments of Preference and Concurrence, an arrangement ought to be made, more, or rather specifically, to accommodate such people as otherwise, like the Banyans, for their good-hearted accommodation and serviceability are reduced to poverty and, as is already the case with many, 400 401 29th May 29th May are plunged into the utmost contempt, not without having a distressing influence on the management of the Company's affairs, the Banyans generally having been distinguished and wealthy merchants with whom such important matters as relate to trade in this country were conducted and executed, whereas at present one hears nothing but complaints of a general decline, lack of means, and consequently of credit to undertake any important business and to continue or promote it as before; with such further reasons to urge this opinion of Their Honors as that address comes to show further, at the end of which this assembly was requested, in case of approval, to issue and promulgate a publication, whereby on the one hand it is distinctly stipulated and enacted which expenditures by the Banyans henceforth shall be preferential and in what degrees, and on the other hand made known that this accommodation, solely serving as a legal safeguard against damage and for the revival of credit, shall not extend to legalizing an unlimited and unverified credit to the Company's servants and subordinates, to the prejudice of other legitimate creditors, or that, by this precautionary measure, the Honorable Company could in any way whatsoever become entangled in accountability or reimbursement of debts contracted by the Company's servants and others, of whatever nature

Wednesday the 25th of April in the year 1787. In the morning, present all except the members Van Haugwitz and Krayenhoff due to occupation. Having proceeded to the deliberation on the right of preference and concurrence in the case of the secretary of this Council as sequestrator against all known and unknown creditors of the insolvent estate of the late merchant and First in the Cloth-hall, the Honorable Jan Pieter Humbert, of which the proceedings have now been brought to the stage of judgment, consideration was given to the custom that has taken place until now, namely to consider the claims and demands of the native creditors as nothing other than concurrent, and this because those members, ignorant of what the laws dictate regarding the right of preference, in good faith sacrifice all their wealth to one or another of the Company's servants or subordinates whom they serve as banians, through advances, whether in pure cash money or to defray other expenditures, both for the promotion of household and trade affairs, and usually let themselves be appeased with private promissory notes or mere promises of restitution of that which is consequently furnished and trusted, with this unfortunate consequence for many: that, upon the decease of one or another whom they have served in this manner, there is no other possibility for them to prove and verify their claims and demands than merely according to their books or notes kept thereof, as the insolvency is not seldom accompanied by that deplorable circumstance that no accounts, books, or papers are to be found in such an estate, from which it has then resulted that such creditors 404 405 29th May 29th May creditors, as banians, drawing up and submitting the accounts thereof with their claims, have strictly been placed among those who are concurrent and not preferred, without reflecting, or considering from the nature and context of their accounts, how the banians in general are not all promoters of affairs in matters of commerce, but, as stated, cashiers and financiers of their respective masters, generally paying, and most of the time advancing such charges and expenses as must serve not only to defray all outlays, but even such as the eating, clothing, and housing, both of their masters and of a numerous number of body servants, because, in a word, to the banian are referred for payment bakers, butchers, butter and milkmen, tailors, and suppliers of the cloth for the same, with all such persons who, if they could show in person not to have been paid, would indisputably have and enjoy the right of preference, at least for such items as served for food and cover, thus also the linen belonging thereto, etc., item the labor cost thereon, whether it serves for body, table, or bed, and in a word everything that is understood under the name of movables, furniture, and household effects, or else under a title of household expenses, including drinks, provisions, house rent, servants' wages, and the like, on which the seller or supplier, being able to prove his right of ownership from lack of payment, indisputably has the right of legal hypothec, tacit pledge, and consequently a notorious preference above many others; descending also to such people as the banians here, who are usually in advance for their masters for such items under the name of household expenses, regarding which that which is found stipulated by the laws according to the Roman-Dutch Law, the Law Book, the 14th Volume, pages 359 to 81 1/2, comes very much to their advantage, and wherefore the Council is of the opinion that regarding the judgment of preference and concurrence, an arrangement ought to be made, somewhat more, or rather especially, for the accommodation of such people as would otherwise, like the banians, be brought to poverty because of their good-hearted obligingness and serviceability, and, as is already the case with many, the and

406 407 29th May 29th May are plunged into the utmost state of contempt, not without an altogether distressing influence on the management of the Company's affairs, since the Benjans have generally been distinguished and wealthy merchants with whom such important matters relating to trade here in this country were directed and carried out, whereas one now hears nothing but complaints about a general decline, lack of wealth and consequently also of credit to undertake any weighty affairs and, as before, to continue or advance them; circumstances which deserve the attention of the Court; since, as servants of the Company, it cannot be a matter of indifference to them to see their masters' affairs decline or flourish, especially since the latter principally depends on the prosperity and welfare of such Company subjects as the aforementioned Benjans by maintaining and protecting them for the compensation of all lawful actions and claims: so it is, in order to achieve this salutary objective and in the trust that this opinion of the Council will also agree with the more expert understanding of the Honorable, Respected Lord Director and Council of Policy, from whom, as the local authority, an approbatory resolution and statute in casu subjecto should in the first place proceed, in accordance with the proposal of the Honorable Lord President, understood to respectfully give notice of all this to the said Political Council by means of a transmitted extract from the minutes of this Council and to request their Honors' esteemed opinion on the matter, and, in case of approval, at the same time to request the issuing of a publication whereby on the one hand it is distinctly stipulated and enacted which expenditures by the Benjans shall henceforth be preferred and in what degrees, and on the other hand it is made known that this accommodation, serving merely for a judicial safeguard against damage and for the recovery of credit, shall not serve to legitimize an unlimited and unjustified preference for the Company's servants or dependents to the prejudice of other lawful creditors, or that, by this precautionary law, the Honorable Company should in any manner whatsoever become entangled in the assumption 408 609 29th May 29th May or compensation of debts that are contracted in this regard by the Company's servants and others of whatever kind; but on the contrary, to prevent such a misunderstanding, the advertisement issued in 1734 against borrowing money and granting credit shall also remain in force and be renewed; besides which, by the disposition of the Council over accounts on which preferential payment is maintained, nothing shall be validated other than that which is conscientiously judged and found not to be superfluous or fraudulent, but based on a true and lawful right of preference. After the reading whereof, the Lord Director declared that these considerations and remarks were altogether grounded in reason and equity, and that the proposal made to change the custom hitherto followed in judging the preference and concurrence on behalf of Benjans or business agents would deserve full approval, provided that those people on the other hand were also held bound and obligated to ensure that their accounts, upon which justice would subsequently have to be administered in case of insolvency, are properly closed monthly and mutually signed by their masters and themselves, since in default thereof it would not be possible to proceed with certainty upon those accounts which they might frame from their own books and notes when instituting their actions and claims; that the Lord Director, however, was of the opinion, as His Honor further believed, that it was not within the competence of this assembly to make such a considerable change in a custom that has been followed for so long and has thereby been converted, as it were, into a local law, or at least that one ought not to proceed to do so without first knowing the approval of the Honorable High Indian Government in this regard, to whom alone, as our supreme authority, the power has been given to alter the laws of the country in such manner as may be found necessary and proper as occasions arise; and that the disposal of this matter must be deferred to the High Indian Government. He therefore proposed to respectfully present this matter to Their High Honors at the earliest opportunity and to request Their High Honors' approval hereupon; all of which having likewise been so understood by the members who have no seat in the Court of Justice and could thus vote on this matter, it was approved and resolved in conformity therewith: understood to conform with the proposal of the Lord Director, and accordingly, in due course, to make the necessary representation and proposal concerning this to the Honorable High Indian Government. To the Right Honorable, Respectable Mr. Mr. Isaac Titsingh Director over the Honorable Company's Interests in Bengal etc. etc. 426 427. 29th May 29th May And first of all that of Chaloup the Chinsura This having appeared in the Ganges in the month of February last from Batavia via Malacca, was found to be of the same construction and rigging as the two sloops sent hither last year from the Head Place; and since it thus also has a hoeker rig, which is much too tall to ride out a storm at sea or in the Balasore Roads, we are of the opinion that the same could be used more suitably as a Pilot vessel in the river, if a snow rig were installed; upon this proposal it was approved, with the consent of the present Equipment Master, to proceed with this alteration, and thus to have the masts moved. — Both these masts must be shortened by 4 to 5 feet from above, and the cross-trees lowered in proportion, in order thereby to obtain longer mastheads, which gives a great deal of firmness to the upper rigging. New mast partners in the deck of four-inch planks where the masts stand, and to insert a deck beam into the hold is necessary, because the beams near the mainmast lie too far apart from each other. Four new chainwales, with their chain plates, bolts and deadeyes are also needed for the masts. The main topmast should be fitted with a long masthead instead of a mizzen topmast; but the mizzen topmast being unfit to serve as a fore topmast, a new one must be made in its place. — The crossjack yard is too weak and too short for a foresail yard, and the gaff also falling 8 feet too short, because the mainmast now stands further forward, two new spars are needed for this; while a new jibboom is also required for the broken one. The sails must all be altered in proportion to the rigging, and in addition, be further increased with a new foresail and a fore trysail. — The main shrouds, main stay and collar, likewise the topmast backstays are unserviceable and parted, for which new ones are required, as well as for the greater part of the running rigging, which is worn out. The forecastle should be lengthened by 3 to 4 feet, and the windlass stand so much further aft, in order to be able to place the foremast on the forward side of the same.

According to the letters of the 6th and 17th of this current month, by the first of which the commanding Secunde there has employed all possible means to dispose the merchants to enter into the contract of the tender on the conditions written to him pursuant to the resolution of the 17th of the previous month, however without any fruit, because they excuse themselves in all sorts of ways from a firm commitment for the delivery and stand by the previous promise, namely that, if according to their request they receive payment at the appointed time, they will not fail to fully satisfy what is demanded, without the Company needing to be in embarrassment for the required goods; thus, following the opinion of the Secunde, who attributes this unwillingness to nothing other than mistrust, it would be best to cease all dealings regarding them until such time and while one can make them more manageable through greater and more powerful means; whereupon, having deliberated, it is, considering the uncertainty in which one finds oneself regarding the supply of money, not permissible to promise more to those merchants than has already been done, thus still less to make the firm promise they desire, because such would solely be to flatter them at present with an empty hope, and in the case of a disappointing outcome to further jeopardize the credit of the Company, which one unfortunately experiences from day to day in Bengal all too severely impaired, approved and resolved provisionally to delay this contracting until one obtains certainty upon the arrival of the ships to what extent the desire of those merchants can be met, and in the meantime to acquiesce in the proceedings of the said Secunde and the assurance given by the suppliers that they will have the required goods manufactured in advance. 440 440 29th May 29th May Resolution to delay therewith, as also with that of the Silk and Mochta. Whereupon, after deliberation and considering that, however much it were to be wished that the suppliers could have been brought to accept the proposed condition, so as thereby to have at least some security for the fulfillment of the quantity of cloths undertaken by them to be procured, the reason brought forward that the promised advance can only be very defectively met does not permit insisting on this most strongly, and it is better to grant the desire of the merchants now, in order to obtain from there at least some of those cloths which, because of the considerable prices fetched at the European sales, cannot well be missed from the return cargo, rather than having to proceed to purchasing here afterward, as it appeared in the previous year that the linens procured from that factory differed considerably to the advantage in quality and price from those bought here; it was approved and agreed to grant the requested increase without any restriction, with a recommendation to the servants to make every effort to make the quantity to be procured as large as will be feasible; furthermore, to approve the further advance made by them of Current Rupees 5000:-:- on this delivery and Current Rupees 3000:-:- on borax. Regarding the poor prospect that the servants state in that letter to have concerning the money negotiations there, since nothing comes of all the promises made for paying into the treasury, and the persons who had promised to do so now attempt to evade it with all kinds of pretexts; it was agreed to express the regret of the council, in the continued hope that the servants will succeed better than it appears thus far, as there is absolutely no possibility of providing them with any assistance from here, for which reason the recommendation already made will also be repeated to negotiate, whenever the opportunity arises and if possible, some sums for the Hugli treasury as well. Examination of the persons to be mentioned hereafter by the undersigned, in the presence of the Captain at Sea and Master of the Equipage Jacob Fredriks. The Quartermaster Frans Beyhagel states upon the successive questions put to him: That while lying at anchor with the chaloup De Verwagting off Ingeli, between 10 and 11 o'clock in the evening of the 16th to 17th of April, the Sub-Lieutenant Thompson of the ship Rotterdams Welvaaren came on board the chaloup, bringing an order to set sail immediately for Kisserijen, where they also arrived the following morning around eight o'clock. That Mr. Bolt then requested him to enter the creek with the chaloup to take in an anchor and cables, but that he refused this for the reason that at low tide there was so little water in the creek that the chaloup could barely lie there, and that moreover the banks were so steep that the vessel, in taking in the anchor, would run great danger of capsizing; that Mr. Bolt, however, wanting to persuade him to this, not to mention saying that many large vessels came into the creek etc., he had supported his refusal by demonstrating that one could not steer the sloop as one wished and that fending off with bamboos or otherwise could be of no effect. That Mr. Bolt then requested that his crew might come ashore to assist, which he readily agreed to by sending off all the Europeans and Moors who could be spared. That these men, with the help of coolies, went to work and sought to place an anchor onto an oelak, but being unable to effect this, fastened the same alongside the oelak; that during the night a plank of that vessel sprang, so that it sank. That the following morning another, smaller oelak brought a cable on board the chaloup, after which it returned, and he with his crew likewise went ashore and attempted to work the anchor into it, but that, having nearly accomplished this, this vessel broke apart and also flooded with water. That he thereupon agreed with Mr. Bolt that the latter would have the anchor brought to the beach during the night and, this having been done, would have a flag waved in the morning, whereupon he would take the same on board the chaloup; but that he, not seeing the signal in the morning and the aforementioned Lieutenant Thompson not wanting to return to his ship by force, was obliged to sail downstream, where he transferred the cable and reported on the state of affairs, whereupon a ship's council was convened and he was dispatched with another officer to Fulta. That coming before Kisserijen again the day after, thus one day after the appointed time, he saw the signal flag waving, but having positive orders to sail immediately to Fulta, he did not dare to linger to take in the anchor, since the officer was charged with dispatches for the Honorable Director. That he, not understanding English and the said Lieutenant Thompson serving as interpreter, does not know whether the latter refused to take in a second cable, but absolutely denies that this was done by him. And That he is ready to confirm the above under solemn oath, as well as that he never said or gave to understand to Mr. Bolt that the latter as seller was obliged to deliver his goods on board, which he also, because of his aforementioned ignorance of the language, could not do; but that he did see the said Thompson in a dispute of words with Mr. Bolt and afterwards learned that the aforementioned Thompson had said something of the kind. The Boatswain Stoffel Bartels states that the Sub-Lieutenant Thompson came on board the chaloup in the evening of the 17th of April, bringing with him orders for the Quartermaster F. Beyhagel to sail immediately from Ingeli to Kasserijen, without to his knowledge stating the reason thereof. That they carried this out and arrived at the designated place around noon on the 18th, whereupon the aforementioned Lieutenant and Quartermaster went ashore and, as he had understood, were requested by Mr. Bolt to enter the creek with the chaloup to take in an anchor and two cables; that the Quartermaster refused this for reason of the danger that was involved therein, since the sloop was too heavily laden to sit in the creek, so that the same could easily capsize upon taking in the anchor, whereupon it was resolved to bring the same on board with an oelak; wherefore they went to work, but could never succeed in fastening it any further than alongside the vessel. 458 29th June 29th June meeting therein pinched right through the oelak, causing a plank to spring and the vessel to sink; that Mr. Bolt thereupon, on the morning of the 19th, had a small oelak sought, with which a rope was brought on board, and that when the same had returned to the creek, they attempted to bring the anchor into it, but this vessel also gave way; that an agreement was then made that Mr. Bolt would have the anchor brought to the low-water mark at night, to be fetched from there the following morning upon a signal to be made; that this signal was not made, and the Second Lieutenant Thampson absolutely wishing to go on board Rotterdam Welvaaren, they departed that morning from Hisseryen and arrived at Ingeli, from where they sailed again that same night of the 20th and anchored in sight of Hisseryen. The sailors Gerrit Glysteen and Jan Nieman agree in everything with the statement of the boatswain, in so far as it concerns the embarkation of the anchor and rope, the breaking of the oelaks, etc., with this addition, that they and another sailor, Jonas Wieholm, and the majority of the Moors worked on shore and stood up to their armpits in the mud without being able to get the anchor into the oelak.
