300 301 28 March 28 March. inhabitant of Morsidabaad, did on the 22nd of the month of May 1782, Christian Style, or the 12th of the month of Seeth 1191, Bengali, in the time of Mr. Campbell before the Duwanij Adalet or the court of justice at Calcatta, institute complaints upon and against the suppliant, containing: that he demonstrated that from Hadjee Mehendi, inhabitant of Chinsura, he was rightfully and genuinely claiming an amount of eighty thousand rupees: of which amount and sum, twenty-three thousand had been delivered and received by Meer Mahmed Sadekchan, inhabitant of Medinipoer, and that he could not obtain the remainder, amounting to a sum of fifty-seven thousand rupees, but that all kinds of evasions were sought for the payment thereof, That, in consequence of these complaints of the aforementioned Mirza, the well-mentioned gentleman of the court summoned the suppliant, where about two years were spent with the hearing and examination of both parties; when the aforementioned gentleman, by the disposition of Providence, came to pass away, without the complainant having proved anything in the very least. That after the death of the aforementioned gentleman, the administration and disposition of the court of justice, and the cases pleaded before it, were assigned to Mr. Petrie, before whom the aforementioned case was again pursued and brought forward, without the complainant having proved anything of his instituted complaints there either, but was dismissed as a false accuser; as the suppliant holds the dismissal thereof from the said Adalet, signed and sealed, and supported by legal authorities, in his hands, and takes the liberty to submit the same herewith. That the said Mirza was thereby also condemned to the restitution of all such legal costs as the suppliant was forced to incur, as appears from the said dismissal, a condemnation upon and against the said Mirza, arising by reason that he is dependent on and an inhabitant of the said Duany Adalet or the Calcutta court, and after completed investigation, as said, nothing having been proved. 302 303 28 March 28 March concerning taking legal advice. The delivery of His Honorable Worship's communication, at the last session, having shown a willingness to procure a portion of the goods required for an upcoming return fleet, to ask them whether they were prepared to bind themselves thereto on the conditions agreed upon with the Lord Director; whereupon the Merchant Eilbracht requested, before proceeding to this, to be allowed to read out the following document containing further objections of Eilbracht against the inserted bonds. The deplorable circumstances of the times in which one presently finds oneself in managing the Company's trade in Bengal are no slight object of reflection and contemplation, particularly on account of the indescribable lack of money into which this unhappy country has been plunged by a ruinous domination and the exhaustion of its treasures; they demand serious attention to how one shall manage not to leave the Lords and Masters in embarrassment regarding return shipments and how to protect oneself from loss and accountability. Reflections on this have repeatedly caused me to commend the untiring efforts and exhibited devotions of the Honorable Lord Director, and I confess that it is more than one could ever have expected in so fatal a period, to see His Honorable Worship succeed, without any significant relief of money and with the known scarcity thereof, in dispatching four return ships to the value of over 33 tons of gold. My attention has been no less engaged concerning the proposal made recently in the assembly by the aforementioned Lord Director regarding the entering into of a new contract for the procurement of two shiploads of returns pro patria for this current year 1787. We have already deliberated and voted upon it, and, being the only one who differed in opinion from the assembly concerning the legality and necessity of concluding the same, I have further examined my affirmative consent, not only against reason, but against the orders which are in force with respect to this department of the Company's service here in Bengal. If the assembly 306. 307. 28 March. 28 March. will grant me its esteemed attention to the considerations previously presented and subsequently arisen, it will undoubtedly justify me in putting the same into writing. To entering into the contract, as proposed by the Lord Director, I gave, after refuting my reasons why it appeared to me uncertain and even useless, my conditional consent, and especially upon the assurance of His Honorable Worship that the contract of last year had been fulfilled, and His Honorable Worship was thereby encouraged to a new conference with members belonging under our investiture, with the exception of such as belong elsewhere and are beyond our reach. The difference in opinion between the assembly and mine consists in this: that the members collectively agree with the proposal of the aforementioned Lord Director, and that, in my opinion, the bonds ought not to be granted to the contractors directly for the full amount of the accepted delivery, but in proportionate parts by installments; proposing the first 1/3 part from the day that the contract is closed and signed, the second in the month of August upon the arrival of the expected ships, when it is ordinarily decided whether the work of the Company in the aurangs proceeds, and the last third part in, or at the latest by the end of October, if it then appears that the condition concerning the delivery is being fulfilled, and otherwise according to the exigency of affairs. I understood it thus in order to accommodate the Company with respect to the interest; but the assembly finds this impracticable and sticks to the proposal; but since, with favorable interpretation, I cannot agree thereto, I request that this may serve as reason against it. The second point of objection likewise resides in a difference of opinion regarding the force and value of the bonds. As to the force, I maintained that, according to my understanding, they serve instead of money that would otherwise have to be provided for the procurement of linens according to the contract, by virtue of which the bond is granted. 308 309 28 March 28 March I alleged that whether the Supplier expended his own money, or money negotiated through pledging or selling the bond, for the Company's account in the aurangs, and fully or satisfactorily fulfilled his Contract, this bond could be paid to him or to the lawful holder, but not otherwise. The meeting, on the other hand, was of the opinion that the Bond had to be considered as having been issued in lieu of Ready cash that was needed for the provision of Linens that the Contractor had undertaken to Deliver. That the value thereof therefore implied that he could pledge or sell it in order, for lack of own ready money, to seek to acquire what was needed upon it; and that, this having occurred, the Company was obliged to satisfy this pledged or sold bond to the lawful holder, whether the Contract on account of which it was granted was fulfilled or not; since that remained just as much at the Company's risk as if the value of the bond had been provided in Ready cash from the Cash office. Against this it was maintained by me that it made a very great difference whether the Company traded with its own money, or with that of the Supplier or someone else; that in the first case the Director, upon whom the making of the advances devolved, could arrange the matter in consultation with the Council in such manner as prudence and circumstance came to require, whether by paying out the full amount at once or in proportioned terms, in proportion to the assurance that it could be immediately employed in the aurangs and was directly disbursed, which could well be verified; and that, in case of mistrust or worrying Reports, it would be improper to proceed with any or further advances; whereas in the second case, or when a bond is granted, and particularly now, when it is known that the merchants, out of their own insolvency, must negotiate it, it is impossible for the Director to verify when the value thereof is spent on the Delivery of linens for the Company in the aurangs, if no report is immediately made and proof shown of that sale; that it would therefore be a very great hardship for the Company to have to pay the Bond upon presentation to another who had become Owner or lawful holder of it, without having had the benefit of the Contract 310 311 28 March 28th March on account of which, and not for counted ready cash, it was granted, under which illicit practices could be concealed. And it was on that ground that I argued: that, just as little as the first or principal holder of the Bond could obtain payment beyond what he had fulfilled of his Contract, a second, third, or subsequent Owner and presenter of the same, in like manner or for the same cause, could claim nothing more than what the Company had enjoyed through the Contract and the value of such a Bond upon it. The meeting, however, persisted in its opinion. I was thus outvoted, and the Director was of the opinion that it would be an infringement of the Company's Credit to deliberate upon the differing opinion and thus establish what was necessary regarding it for now and the future. But since I did not dare to take that responsibility upon myself, I deemed it necessary to declare myself thereon in writing, in order not to become jointly answerable for the disadvantageous consequences which might unexpectedly result therefrom; having all too well before my eyes the respected order of the Honorable High Indian Government by formal Rescript of 15 July 1774, whereby Their High Excellencies, for further interpretation of what was written by Letter of 14 July 1770 concerning the damage that the Company might suffer through the advances of money, namely that such is understood in the sense that the Director must make the advances with so much circumspection and precaution that the Company suffers no damage thereby, except in cases which human foresight cannot prevent, were pleased, for further precaution, to add this notable point, that no advances may be made by the Director in his private capacity and thus before the Contracts are concluded with the merchants in full Council of Policy, but all such expenditures must take place with the foreknowledge and consent of the entire Council, or those who might constitute the majority in voting; in the expectation that both the Director and every Member of the meeting, remaining just as responsible for their votes as the Director, will always properly and as necessary pay heed to the persons to whom the funds are advanced, as well as to their means, Credit, and Reputation, the reality of which in this Country can always be well ascertained. 342 313 28th March 28 March are, and their insolvency as well as disreputable qualities have now for two years been recorded in the Company's papers, it might at times appear questionable to Their High Nobilities how or why an unlimited trust is now placed in them, if the reasons for this should not distinctly appear from the resolutions of this assembly. I am even of the opinion that, since the assembly takes the value of the bond in the same sense as if the money negotiated thereon had effectively been received from the Company's treasury, it would be necessary and not superfluous for the Honorable Company to stipulate, in the contract or in a separate specific article, a sufficient precaution against damage which might arise in the event of an unexpectedly breaking out rupture, concerning which the present circumstances of the times in Europe and that which has been announced in the public English newspapers, subject to correction, recommend all circumspection; whilst I have reason to believe that, as long as the Company's funds are in the hands of neutral persons like the suppliers, the enemy has no right thereto, for if their properties are secure, it follows naturally that all that is entrusted and confided to them as merchants must be regarded in the same light, especially in a country like this, where sovereignty is not absolute, and the European nations' residency and security is envied by him who, up to now, although in name, is credited with supreme dominion over it. I very respectfully request that these reflections, for my peace of mind, may be inserted into the resolution, and the objection regarding the bonds may be presented on this occasion to Their High Nobilities for their decision. And after this, each member having been asked by His Honor, head for head, whether they remained persistent in their advice given herein at the last meeting, which was answered in the affirmative, it was approved and agreed to keep this record of all this, for the disposal at will of the well-mentioned Honorable High Indian Government. 329 17th April 17th April and little less to your Honourable Assembly, who filled places of great trust and importance among the members of your Honourable Board individually, particularly under the late President, and that Golluck Chund had considerable property in your settlement of Hougly, which by reason of his imprisonment was wasting daily, and solicited us on that account to enlarge him from prison, he being ready and willing, and offering to join Golluck Chund in such security as we should think necessary and require, and to deposit with us certain instruments bearing the seal of your Honourable Company and the signatures of the members of your Honourable Board, which he called Dutch East India Company's bonds, payable to him or his order, which bonds he proposed to deposit with us as collateral security for the faithful discharge of Golluck Chund's debt, with power for us to present the same and to receive the amount from your Honourable Board in case they made default in discharging such debt by the time agreed upon, under such terms of security. The case to which I allude is briefly the following. Whilst Golick Sjent Mitter, in the capacity of banyan, was in the service of Mr. Tiretta, he gave occasion to Mr. Tiretta to bring an action against him in our Court to recover divers sums of money which had been improperly introduced into his accounts and taken from Mr. Tiretta's cash, in which action Mr. Tiretta obtained a judgment upon the clearest evidence for many thousand rupees, and Golick Sjent was committed to our public gaol, there to remain without bail until it was paid, together with the costs of the suit. 331 17th April 17th April Liberty, but from that day to the present I have not seen either of them, lukchund mitter and Ramkanto they immediately betook themselves to Chinsura and there they remain, having such security in my Hands (as I imagined that I had) Golluckchund's not having executed the Bond was a matter of no consideration with me, when the time of payment arrived I sent Mr. Tiretta's Bond with my own, together with the Instruments deposited as a Collateral Security to Mr. van den Broeck's reply to this application, whereby he unfolds the fraud and misrepresentation that had been practiced upon Mr. Tiretta and me by these men, surprised me not a little, the Instruments which had been passed upon us as Bonds of your Honourable Board being nothing more as he said than Contracts which Ramkanto Mitter never performed so as to entitle himself to payment of the sums mentioned therein. under these security I did not nor did Mr. Tiretta hesitate an instant to accede to his solicitations and a Joint and several Bond was accordingly prepared from Gollukchund Mitter and Ramkanto to Mr. Tiretta for the amount due to him under the aforesaid Judgement, in which a Covenant was inserted from them that the said Bond should be recoverable against them in your Courts of Justice, and a like Bond was prepared from them to me for the Costs of the suit against Golluk Chund, with Endorsements thereupon respectively setting forth that Bonds of your Honble Company were deposited as Collateral Security and to be received by us in case of failure in them in payment of their said Bonds. These Bonds were executed by Ramkanto Mitter, who thereupon got an order from me to the Sheriff of Calcutta to discharge Golluckchund from his Custody, Ramkanto promising to bring Golluckchund immediately on his enlargement from Prison to my House to execute the Bonds on his part; Golluckchund was set at Sheriff of Calcutta to release Gollick Sjent from his prison in consideration of his solicitations, as Ramkanto promised me to comply, and pursuant to which, Goluk Sjent, immediately after his discharge, would be brought to me, and prepared me an obligation, whereby Goluk Sjent Mett and Ramkanto Mitter bound themselves to Mr. Tiretta for the amount due to him by virtue of the aforesaid judgment, under special submission, in case of non-fulfillment thereof, to the Judicature of your Courts of Justice, as well as another obligation in the same manner as the former in my favor, for the legal costs incurred in the case of Golleek Sjent, both of which being provided with endorsements showing that bonds of your Honorable Company had been pledged as a collateral security, to be received by us in case they should be negligent in the payment of the aforesaid obligations. These conditions and security, neither I nor Mr. Tiretta hesitated for a moment to agree to his solicitations, in case they should fail to settle their debt at the appointed time. Under all such terms and security, obligations were executed by Ramkanto Mitter, and he thereupon obtained an order from me to the Sheriff of Calcutta to release Gollick Sjent from his prison. Goluk Sjent obtained his freedom, but from that time until today I have seen neither of them; they departed immediately for Chinsurah and there they remain. 17th April what one of those natives who is under arrest brings forward in his defense. Mr. van den Broeck, upon this request, wherein he revealed the fraudulent deception which these people committed against Mr. Tiretta and myself, surprised me not a little. The instruments which had been presented to us as bonds of your Honourable Board were nothing other, as he stated, than agreements which, having never been fulfilled by Ramkanto Mitter, gave him no right to the receipt of the sums specified therein. Matters being thus situated, since neither Mr. Tiretta nor I have received the least part of our demands from Ramkanto Mitter or Golluck Chund, we have sent their bonds, together with the instruments which they made us believe to be bonds of your Honourable Board, to Messrs. C. L. Eilbracht and W. H. Verboon of Chinsurah, whom we have duly constituted our attorneys with full power, jointly and severally, to act in the premises as the rights of the parties and the strictest rules of justice shall require. And I do hope that your Honourable Board will give effect thereto by permitting and ordering the persons and effects of the offenders to be attached until full satisfaction shall be made by them. After resumption whereof, His Honour communicated that the said Goluck Sjend Mitter has already been under arrest in the Factory for some time, but that, by an Arzi submitted and a contract annexed thereto, he had sought to prove that he transferred all his goods to his uncle Ramkanto Mitter, on condition that the latter should take over and pay his debts, and that consequently not he, but the said Ramkanto Mitter, was liable for the satisfaction of his debt to Messrs. Tiretta and Hamilton, to which, however, the latter in turn claimed to be in no way obligated. For which reasons the Director deemed it necessary that an inquiry be requested as to how far the assertion of Gollucksjend Mitter regarding the contract entered into with his uncle accords with the truth, and in case the same truly took place, whether such is compatible with the customs and usages of the natives, in order to be able to distinguish the actual debtor, or rather the one who is competent to satisfy this debt, and to compel him to discharge it, since the credit of the Company, with whose name and papers transactions were carried out in an unauthorized manner in this matter, could suffer considerable damage if one did not endeavor to provide every possible satisfaction to the foreigners involved herein. All of which was likewise so understood and resolved by the Council, on the proposition of His Honour, it was approved and understood provisionally to arrest the aforementioned Ramkanto Mitter likewise in the Factory, and to commit the investigation of these matters to the Dorpmeester. Two Curators in the Gerardina Cloppenburgh, widow of the late senior merchant, Secunde of the Directorate and Chief at Hassembazaar Gregorius Herklots, containing, for the reasons cited therein, a request that this assembly may be pleased to appoint Curators in order to accept, salvage, and settle the estate left behind by her late husband under Benefit of Inventory, or such other manner as shall be deemed necessary, as said Request further shows. To the Right Honorable Mr. Isaac Titsingh, Director over the Company's important Trade and Interests in Bengale, Behaar and Orissa, along with the Gentlemen Members of the Political Council. Christina Gerardina Cloppenburg, widow of the late senior merchant, Secunde of the Directorate and Chief at Cassembazaar Gregorius Herklots, respectfully submits that the petitioner, by mutual Will executed on 20 October 1766 before the then First Sworn Clerk Pieter Hoff and witnesses, was named and appointed as sole and universal heir of her said husband. That the petitioner is unable to salvage her estate or to determine how matters stand with the deceased's estate, because no formal books or notes of importance have been found by which she could guide herself. Could I have persuaded the pilot to bring the sloop into the creek, much trouble and time would have been saved, but this he would not do. You know the anchor is thirty-seven hundred pounds weight, and they have taken the 19th instant coir cable. The pilot says they cannot carry the other cable now. This is strange, but your pilots are strange fellows; indeed the boatswain says the sloop could carry ten cables. I can only say that I have tendered them the other on the 18th instant, agreeable to the Captain's request, as also an anchor of nearly the same weight, very old, and much worn, so that it can hardly be trusted.
