The expenses incurred this year for the Commission decreed to Calcutta, are the principal cause that the determination has been exceeded, for at Cassembazaar and Patna nothing has been written off to the debit of this account. No other gifts having been made than some highly necessary presents and Durbar expenses, is the cause of this important difference to the good. The decrease in Military personnel in this Directorate, who all ordinarily draw their wages, is the cause of this difference. The decrease of this arises at this Head Office due to the making and repairing of extraordinary matters, such as the laying of roofs and the making of bridges, which had fallen into decay through old age, whereby the determination by the Memorandum absolutely had to be increased. Only two sloops having been on hand, this is the cause of the lesser amount consumed than the determination. Nothing having been determined for this in the Memorandum, this amount must therefore have been caused by the extraordinary expenses on the buildings at Patna. f Due to fewer patients in this Hospital, this Account has, in accordance with the payment, decreased. By necessary expenses this account has increased against the determination. Concerning these two, by the arrival of only two ships, this account has decreased against the determination. Nothing having been provided to the Faujdar of Daroga according to the old custom, this is the reason for its decrease. — No servants being kept other than the most strictly necessary ones who cannot be spared, causes this difference to the good against the Memorandum of Menage. He was made a prisoner of war along with the other Company's servants, and was thereby relieved of that obligation by which he had voluntarily bound himself to the service of the Dutch Company, but to which, by the fortune of war or that of a prisoner of war, he could neither be faithful nor was obliged, being released therefrom by a parole to the enemy until further notice. It could then, in that situation, supposing he had been forced, alone or with others, to serve the enemy, not be called a crime of desertion, even if after the end of the war he had not returned to his assigned post or come under the nation to which he belonged. He was indeed noted in Your Honorable Assembly of 9 September 1785 among the absent, but not among the actual deserted servants of the Company. Having been summoned upon this premise by the Fiscal Office to account for his absence, on 10 December 1785, without any non-appearance or petition on his behalf being taken into account then, a default was granted against him, and by virtue thereof bodily apprehension if he could be caught, and otherwise three successive citations of fourteen days each. This disposition stirred his family and authorized agents present here into action. They demonstrated that de Bruijn had never had the intention to become disloyal, whether by taking service with the enemy or by leaving the Company's service or territory; but that out of necessity, not finding sufficient subsistence to maintain a heavy household, he had to choose the course of engaging himself as a private clerk in the service of Mr. Richard Johnson, with whom he had departed for Hyderabad, and from where obstacles had prevented him from returning to Bengal; nevertheless, as soon as the Company's establishments were returned by the enemy, he had sought to show that, far from wishing to be disloyal, his commitment to the Company had shown him the necessity of wanting to place himself again under its flag and jurisdiction, as in fact had ensued at Paleacatta and from there to Jaggernaikpoeram, where, actually performing the Company's service, he is to be found up to the present. They therefore requested that their principal not be regarded as a deserter, and consequently no longer be summoned as such, but might be considered as someone who was removed from his property and possessions by necessity and never had a thought of disloyalty, and granted against 142 143 23 Febry. 23 Febry. showing the sworn reports inserted. against whom, therefore, no warrant for bodily apprehension could have been issued, because that only takes place in case of manifest and willful desertion, with an order and qualification to the Fiscal Office not to execute the said warrant against the petitioners' principal, but on the contrary to cause it to be noted at the foot thereof that it has lapsed in his regard, so that he may, with an easier heart, when the opportunity presents itself, return in safety to resume his service anew as before. We, disposing upon the request of the petitioners, grant the same and interdict the Fiscal Office from putting the aforesaid warrant against de Bruijn into execution, and consequently deemed it unnecessary that he be summoned further, as indeed ensued. Of this we have had the honor to inform Your Honors, and it appears from the extract of your resolution of 31 January 1786 that Your Honors have been pleased to conform to our disposition. The Honorable Lord President presented the following Extract of Resolution taken in the Council of Policy at Hoogly Friday the 22nd of December 1786. The Honorable Head Administrator Bogaardt having drawn up, and having been examined today upon submission, a statement of findings of the spices from the consignment brought by the ship Schoonderloo, which follows here below. [insertion] wherein it appears that upon opening, reweighing, and garbling of the aforesaid spices, against the invoiced weight of 3530 lb Nutmegs 1380 lb Cloves 308 lb Mace, shortage, dust, grit, and white leaves were found as follows, on: the Nutmegs: 583½ lb or 16 1/100 percent Cloves: 98 lb or 7 1/10 percent Mace: 59 lb or 19 1/20 percent Thus it was resolved to write off the one and the other according to custom, following the statement of findings, provided that the two reports mentioned therein are sworn according to the regulations in the Indies, and that the refuse of the spices is dealt with as is proper. That the former Director Johannes Matthias Ross, departing from here during the recent war, sold the house and grounds belonging to His Right Honourable called Welgeleegen to the Armenian Chojas Petrus. That the latter in turn ceded and transferred the same to the English doctor Bartholomeus Hartley, which latter disposed of the aforesaid house and grounds in favor of the petitioner's principal, who thereby became the actual and lawful owner of the said dwelling, all clearly and circumstantially described in various documents drawn up according to the style customary in Calcutta, and which, if required, can be produced. That these transfers, as much on account of the war as the ignorance of the successive owners of the aforesaid house, were not made in accordance with our laws and customs, yet the Lord's dues have not been defrauded and the Honourable Company has thus remained without loss. Wherefore the petitioner, in the name of his principal, respectfully requests that Your Right Honourable Commissioners of the Month together with the Secretary may be pleased to authorize the conveyance of the aforesaid house and grounds to now proceed in accordance with our laws and customs, so that the petitioner's principal may thereby be placed in the quiet and full possession of his lawfully acquired property and the irregularities that have hitherto taken place in this matter may come to an end. A ditto ditto also executed in Calcutta whereby Morad Elias, on the 19th of March 1785, transfers the house to Bartholomeus Hartley for a sum of 30000 guilders. 5. A receipt from the Fiscal and Village Master of this colony, A. G. Krayenhoff, whereby he acknowledges having received, on the 3rd of February 1786, a sum of 900 guilders for 5 percent Lord's dues on the sale of the house in dispute by Choja Petrus to Bartholomeus Hartley for a sum of 18000 guilders. 6. And finally, a proof of ownership granted on the 5th of May 1786 by the aforesaid Hartley to Mr. John Kinloch, showing that Hartley, having raffled the house for a sum of 50000 Sicca rupees on condition that the drawer should pay him 5 percent on the aforesaid amount, Kinloch had drawn the same and had also paid the said premium amounting to 5000 rupees to Hartley. With the request that Your Right Honourables may now be pleased to decide upon his petition. The Council, now ruling upon the contents of the petition, declares, according to the transfers exhibited in court and specified above with day and date, the Company to be entitled to the Lord's dues due on each transfer that was executed after the restoration of this colony under the Dutch government: thus, from the first transfer, by Morad Elias one thousand two hundred and fifty rupees, from the second, by Bartholomeus Hartley fifteen hundred rupees, and from the third, by John Kinloch as the latest owner two thousand two hundred and fifty rupees; enjoins and orders the Fiscal's office to watch over the Company's interest in this matter and to ensure that the same be properly paid; sets a period of three months for this purpose, and declares the house to be bound and executable therefor, in case of non-payment.

The undersigned Purveyor has the honor to present to your Honors that, by the disposition regarding the finding of the discharged cargo of the hooker ship De Standvastigheid, which recently returned to Batavia, according to the same, the officers of that vessel were improperly credited and credited on account for the entire deficit below the permitted allowance on the Arrack, amounting to 2418 kannen at ƒ 810:4:-. Regarding the difference between his statement and the statement made by Junior Merchant Boers concerning the ransom money paid by him, as found noted in the account of Captain-Lieutenant Straalen, more broadly mentioned in the latest resolution, the following writing having been submitted by him, Boers: that it will be seen that from that small vessel he will likely not be able to depart from there within a short time, that then he will have to ask further orders from the Ceylon Government, for which, with the good monsoon at hand, ample occasion will present itself. 166 167 23 February. 25 February. Decision thereon to be sent thither. Now also to accept the bill of exchange with the interest to be charged thither. was found not to be in conformity: to report to the Commander, Right Honorable and Venerable, that this money, according to my statement, was paid by me, and without that I could never have gotten out of the country, which monies I shall account for on Ceylon according to a specific account and receipt; and if the same should be refused to me with condemnation, I bind my person to satisfy the advanced monies with interest upon the first order. Spaniards, from Europe over the [illegible] to the Manilhas and vice versa, item to serve for notification, the elucidation cited therein concerning the 5th and 6th Articles of the Preliminary Peace, recently concluded with the Crown of England. 2. in order, according to the further resolution of Their High Excellencies dated the 22nd of the said month of August, to have the powder that in future might be reported as spoiled made good to the Company with two capitals, and also to have the Head of the Artillery, if the weather permits such, inspect and turn the powder every two months, with instructions to have a report made of the slightest defect found therein. 3. in order, pursuant to the Decree of the 29th of that month, to omit no letters, however small, from the bundles being copied for the Netherlands, but to have them all copied therein together with the annexes, and to send duplicates to the Capital. - Note: this latter cannot take place from here because those bundles are sent directly to Europe with the return ships. And 4. In order, pursuant to the above-mentioned decision regarding the transmission of cases on appeal by the Court of Justice, to have noted each time in the covering letters the names of the attorneys of the litigating parties in Batavia, of which points, where required, copies or extracts have already been issued. To comply with the honored order of the Honorable High Indian Government in the aforesaid dispatch and the extract received alongside it from Their High Excellencies' resolution of the 7th of that month, to provide in a reasoned report, demonstrating the grounded reasons, what sort of vessels are deemed the most useful, capable, and advantageous for this office and river, with the addition of the molds or such drawing and description according to which the same could be constructed, in order to be further examined by experts at the Capital; it is understood to instruct the Master of the Equipage, to whom the extracts hereof have already been issued, to gather information hereupon from foreign as well as our own shipbuilders and architects, to collect their arguments and instructions, and to furnish the assembly with a report thereof as soon as possible, in order to propose the best therefrom to Their High Excellencies. On the circular order, framed in the said dispatch and the extracts received alongside it, both from the letter of the Lords Masters of 5 November 1785 and Their High Excellencies' resolution of 7 September 1786, concerning the precise treatment and demonstration in the letters of the profits and charges; it is understood to respectfully show that the Company in this Directorate has no other principal advantages than the profits gained on the sale of merchandise, the revenues from the Lord's Dues, the leasing of the villages and bazaars, and some few recognition monies, as the toll on private trade currently yields no profit, and that consequently, in the specification of the one and the other here, for the present no other method is to be followed in the reporting than that which has already long taken place in the letters and further accompanying papers. 176 177 2 March 2 March Action or Actions could have been obtained at such prices as where the Actions of the Honorable Company were sold at the same time in Amsterdam, the same in such case will be able to provide himself with one or more Actions from one of the other Dutch chambers; and that finally Their Right Honorable High Worships have further taken into consideration how it might happen that in the Indies, among the offices to which the rank of Senior Merchant belongs, some might be found regarding which the High Government judged that the obligation to possess an Action would be too burdensome for those who would be appointed to such posts, and thus the said High Government was left the freedom, in such case, to report those offices regarding which they believe some exception ought to take place; after which Their High Excellencies are pleased to order compliance with that said obligation by the annual renewal of the declaration as dictated by the form and the transmission of proof thereof, leaving it to those who already occupy the said posts whether they wish to submit to this obligation, with orders to notify Their High Excellencies thereof, while the ministers at the respective outer stations are simultaneously charged with the inquiry whether among them offices are found to which the rank of Senior Merchant belongs for which it would be too oppressive to have to possess an Action, with orders, in that case, to clearly point out all reasons upon which their understanding is grounded; it was thus resolved to have this serve as information for them. Decision to obediently comply with the order and made arrangements, to properly notify the servants at the inner offices thereof with transmission of the necessary extracts, and regarding the said inquiry to submit to Their High Excellencies the opinion of this assembly that those who hold the offices of Chief at Kassimbazaar and Chief Administrator here, and to which the rank of Senior Merchant in this Directorate belongs, can furnish the ordered Action, with a declaration by the Honorable Chief Administrator Bogaardt, namely that, soliciting to become Second of the Directorate, he will make a remittance in the next season for the purchase of an Action on his account. According to the Extract from the Minutes of the resolution in the Council of the Indies on 15 August 1786 and the excerpt cited therein from the letter of the Lords Masters of 23 November 1785, recommending the most strict inquiry into the treatment and care of the sick in the Hospital, as well as whether the distributions of what is necessary and serviceable for their recovery and relief are performed properly, or rather whether various defects are found that require provision and improvement, with orders to send the reports that will be submitted thereof to the High Government; it is approved and resolved to charge and most earnestly recommend to the Outer Regents of the hospital here, being the Captain of the Sea and Equipment Master Fredriks and Ensign Commandant van Amelungren, to whom the aforementioned Extracts have already been delivered, to pay the closest attention hereunto and to satisfy the further order regarding this, and to present the report to be received from them in due time to Their High Excellencies. 180 181 2 March 2 March Opinion of the Council regarding the increase of the boarding money of the Military in this Directorate. A Further Extract from those Minutes to the ministers and servants at the outer stations circular, ordering, in fairness, conscientiously, and keeping in view the requirements noted in the aforementioned Home letter of 23 November 1785, both in relation to the Company and the soldier, to make a further statement as to how far the boarding money and rations of the non-commissioned officers and privates were to be increased, so that it could then be disposed of by Their High Excellencies; it is, since this assembly judges that both the non-commissioned officers and Privates, with the boarding money they enjoy in this Directorate and the allowance of Rations now so graciously granted to them by the Lords Masters, which will be dealt with further hereafter, can reasonably subsist, Approved and Resolved to report thereupon that a further increase in this Directorate appears unnecessary for the present. To Ensign Commandant van Amelungren, to whom an Extract thereof has also already been delivered, it is resolved to recommend the prompt execution of what was also ordered by Their High Excellencies in that resolution, to draw up and transmit to the Honorable Brigadier or the Head of the Militia at Batavia the list required by the repeatedly mentioned letter of the Lords Masters of 23 November 1785 of the amount that was deducted from the military's wages or paid by them for uniforms and clothing. That the Cassembazar office differs with the general office by a sum of ƒ7066:3:— The books kept at this office, and the papers relating thereto, suffer from so many defects that it is beyond our power to supply your Right Honorable and Honors with the considerations requested of us regarding all items, necessary for that adjustment. The undersigned members of this assembly, according to the commission entrusted to them of the 30th of January last, having served with a report on the 20th of February regarding the examination of the trade and pay books of the year 1785/6, now let follow that of the Directorate, on which it is to be remarked. Secondly, in their journal, page 48, an invoice sent hither has been entered at: ƒ38592:9:8.
