Willem Jacob van de Graaff, Extraordinary Councilor of Dutch India, as well as Governor and Director of the Island of Ceylon and its dependencies, together with the Council there. Noble, Honorable, Valiant, Wise, Prudent, and Most Discreet Sir and Friends. Since sending our last letters to Your Honor, dated 6 August last, with the chartered ship De vlugge Trekvogel, by which the receipt of the instructions from the Most Noble Lords Seventeen, and likewise from the Right Honorable Lords Directors of the Amsterdam Chamber to this government concerning the transfer of the de Meuron regiment to Ceylon, was communicated to Your Honor, and of which our last letter the duplicate accompanies this one, there have successively arrived here between 25 October and 2 December last, with the Württemberg troops, those four chartered private ships, named Josephus de Tweede, 't Fortuijn, de Drie Gebroeders, and de Vrouwe Johanna, which are destined for the transport of the said de Meuron regiment to Ceylon, as well as on the 20th of the recently passed month of January, the fifth ship chartered for that transport, the Susanna. 126 Of the same five ships, the first four, after proper cleaning, and the time that passed while awaiting the last of them to regulate the embarkation, having been put in readiness again to convey the de Meuron troops to Your Honor's government, there have been, according to the capacity of their holds, divided thereon as follows, according to the accompanying lists, the officers, non-commissioned officers, and privates, namely: On Josephus de Tweede: 1 Colonel 11 officers and Cadets 15 non-commissioned officers 122 soldiers On 't Fortuijn: 16 officers and Cadets 43 non-commissioned officers 210 soldiers On de Drie Gebroeders: 13 officers and Cadets 34 non-commissioned officers 189 soldiers And on de Vrouwe Johanna: 1 Lieutenant Colonel 13 officers and Cadets 26 non-commissioned officers 172 soldiers The remaining men of the said de Meuron regiment shall likewise be dispatched with the aforementioned fifth ship, the Susanna. The Most Aforesaid Lords Seventeen having been pleased to instruct us beforehand that 127 the oft-mentioned de Meuron regiment should be conveyed to Trincomalee, as it was thought that the said four ships would arrive in False Bay, and that they thus could have departed from here to Ceylon again by the beginning of the month of September last. And also the Right Honorable Lords Directors of the Chamber of Amsterdam, in a further communication, assuming that the said ships should not take in the de Meuron troops for the said transport in False Bay, but in this Table Bay, that with the time of their departure from here it would nonetheless turn out that those vessels should direct their course to the said bay of Trincomalee. And moreover having observed from the letter written to Your Honor by the said Right Honorable Lords Directors of the Chamber of Amsterdam dated 6 January 1787, and enclosed to us flying seal, of which we only had the opportunity to send one to Your Honor with the Vlugge Trekvogel, and the two others received are enclosed herewith, that Your Honor will also be expecting those ships in the bay of Trincomalee. We have therefore requested the report and considerations of the Sea Captain and Interim Equipage Master here, Johan Arnold Voltelen, and other sea captains who are acquainted with the fairways in the bays of Ceylon, whether the present season still permitted the aforementioned ships to call at the bay of Trincomalee; and it having been stated by them that although the bay of Trincomalee can still be called at, and what is to be observed therein to obtain the pilots, yet because of the inconveniences and the uncertainty that accompany it, it was deemed better and necessary by them that these ships should first call at Tuticorin in order to receive the pilots and Your Honor's orders there.

received, where the troops will have to be disembarked, a copy of this notice has been handed to each skipper of the aforementioned four ships, in order that it may serve for their guidance upon calling at Ceilon. Furthermore, since the Right Honorable and Highly Esteemed Gentlemen Directors of the Chamber of Amsterdam, because the soldiers in the de Meuron Regiment who were enlisted for no longer a period than three years might demand their discharge instead of allowing themselves to be transported to Ceilon by force, have likewise desired that some time prior to the embarkation, it should be made known to them explicitly that those who demanded their discharge on account of their expired term of service would be able to obtain the same, but that they would then at the same time be obliged to depart for Europe at the very first opportunity, which measure Their Right Honorable High Esteems hoped might be employed with success to induce these men, who were engaged solely for three years, to enter into a new engagement of five or at least three years, the undersigned Governor also on 31 December of the past year dispatched a written order to the Colonel or Commanding Officer of that Regiment, to bring the aforesaid order to the knowledge of the soldiers of the regiment in a suitable manner, so clearly and distinctly that they could claim no ignorance thereof. Whereby, on the occasion of certain requests made by the said Colonel to our meeting of the 8th of the past month of January, we required of His Honor an accurate list of all the men who could not cross over on the aforementioned four ships, with the addition of the term of their engagement and its expiration, in order that such of them whose contracted time having expired did not re-engage in the Regiment, might, pursuant to the aforesaid instructions, be sent to the fatherland at the first ship's opportunity, and thus prevent the same from continuing to wander about here in the colony. However, since the said Colonel has not yet complied with this requisition, we are unable to state to Your Honors how far the regiment might find itself reduced thereby, and also how many men will consequently remain to be embarked on the ship Susanna; if, however, the statement comes in still in good time, we shall send it to Your Honors alongside this. Furthermore, as we have been charged by the Right Honorable and Highly Esteemed Gentlemen Directors of the Chamber of Middelburg to give Your Honors the necessary notice, upon the departure of the de Meuron regiment to Ceilon, of the instructions successively sent to us concerning the said regiment, insofar as this will have to serve for Your Honors' future guidance, we have, in compliance therewith, [illegible] Whereby now also go over such [illegible] sealed packets as we have received here from the Fatherland for forwarding to Your Honors, just as we likewise present to Your Honors two packets with the secret signal flags for the return ships in the coming year 1789. The cargo space in the aforementioned currently departing ships Josephus de Tweede, De Vrouwe Johanna, and De Drie Gebroeders having also permitted sending Your Honors with them some cargo on the previous as well as newly received requisitions, we have therefore availed ourselves of this opportunity not only to enclose the copies and extracts of all the same highly respected instructions, but also extracts from our resolutions taken from time to time concerning the said Regiment, or should anything appear therein that Your Honors might think could serve for its elucidation, the said copies and extracts will be made known in the register accompanying this.

Likewise, per the ship 't Fortuijn from here are dispatched fifteen barrels of copper duiten brought hither with the ship Belvliet from the fatherland. Of all of which the bills of lading and invoices enclosed herein are transmitted herewith, to which is also attached an invoice of account closed under the ultimate of August, on account of less calculated soldier recruitment premiums and provided advanced pay to some recruits who passed through here from the Luxembourg regiment, as well as another invoice, whereby to Your Honours' government has been charged the monthly monies provided here to some of the aforementioned recruits now departing with the ship de drie gebroeders to Ceylon. On the 23rd of the just departed month of January, having two deceased and 7 disabled persons, safely arrived here at the roadstead, being the return ship Doggersbank dispatched by Your Honours, with which we received your kind letters of 12½ November of the past year, we thank Your Honours for the dispatch, both of the letter for the commander of the state's squadron, Mr. Silvester, to Batavia, as well as of the letters and goods for the Malabar government and for the ministers at Surakarta, while postponing the reply to the further contents of Your Honours' aforementioned writing until a further shipping opportunity, we must in the meantime, with relation to the vessels de Paarl and de Draak, impart the following: The first-mentioned ship de Paarl, having on the aforesaid 12th of November very unexpectedly appeared off Robben Island and from there here at the roadstead. Which vessel, according to the account given thereof by the officers after the departure from Ceylon, on the 26th of December following in south latitude of about 17 degrees and longitude of 93 degrees, was overtaken by a fierce hurricane, in which the main and mizzen masts went overboard and were lost, and furthermore the ship became considerably leaky and in such a helpless condition, that the officers were obliged to resolve to call at the island of Mauritius, where upon inspection of the cargo it was found that all the saltpetre had dissolved, the coffee beans and a large part of the pepper through the leakage, the seawater taken aboard, and heating in the ship were entirely rotten and spoiled, which consequently had to be thrown into the sea, while the linen bales were also wet and damaged, yet were immediately washed out again in fresh water, bleached, and dried. Whereupon the officers, through the purchase of one of the ships stranded at the island of Mauritius in the same hurricane, provided the said ship de Paarl again with spars and having repaired the damage sustained, the same departed from Port Louis on the 15th of April of the past year, turning its prow toward this corner, but on the 15th of May was overtaken by a heavy storm from the west, and the body and seam joints through heavy working were once again opened up and the ship having become considerably leaky, and the stormy weather continuing with contrary winds, whereby the crew was exhausted and the victuals almost entirely consumed, the officers were compelled on the 3rd of June following to bear away for Rio de la Goa, in order to be able to caulk the ship there as much as possible and to provide themselves with the missing provisions. Pursuant to that resolution having arrived on the 30th of June at Rio de la Goa, and the ship having been caulked and repaired inboard and outboard, the same departed from there again on the 12th of October. The ship thereupon here, upon examination by nautical experts and shipwrights, having been found that by no possibility could it be put in a state again to leave this bay, much less to transport the cargo contained therein further to the Netherlands. We have therefore deemed it best for the interests of the Company and accordingly resolved to make use of the ship de Vreede, chartered by the Chamber of Zeeland and presently present here, to convey to the Netherlands the remaining cargo of that vessel for the Presidial Chamber, for which it was destined, that cargo still consisting of: 413 bales of linens 67 bales of cotton yarn 1600 ditto of cinnamon 76 ditto of cardamom 198399 lb. of pepper 16650 lb. of sappanwood 147837 lb. of cowries 1 case with 12 lb. of cinnamon oil Except for 27 bales of linens which, having been found wet, damaged, and rotten, had to be sold here by public auction; while the captain appointed to the aforementioned vessel de Paarl, Cornelis in 't Anker, retaining his rank and wages, is to repatriate with the aforementioned fluyt ship de Vreede, in order to account in Europe for the cargo being sent over therewith, and especially the bales of linens that were washed out on Mauritius and remained unmarked. The ship de Draak having also appeared here at the roadstead on the 3rd of December last, which, according to the report of the officers, through enduring many disasters in a flying storm and fierce hurricane, whereby from the 25th of March in south latitude of 22 degrees 22 minutes and longitude of 34 degrees 48 minutes it was overtaken, with the loss of all its masts was compelled to call at the aforementioned island of Mauritius, where upon inspection of the cargo, all the saltpetre was found dissolved, the coffee beans and a large quantity of the pepper wet and through heating entirely spoiled and rotten, a lot of bales of cinnamon, and

The officers of the vessel the Draak, just as those of the ship the Paarl, in order to enable themselves again to put to sea, have likewise purchased one of the stranded ships, and having applied the masts, spars, etc., thereto, that vessel now finds itself, through this repair, in a condition to continue the voyage to the Netherlands. The command of that vessel having been transferred to the Captain Lieutenant Anthonis van Rhijn stationed thereon as commanding officer, as he was found, after previous examination by the Master of Equippage Pro Interim and the written report given by him in that regard, to possess the requisite experience to be safely entrusted with such a command; whilst to replace the officer's post thereby fallen vacant, the Cadet of the Marines Egbertus Weegenaar, who had been stationed here on the permanent packet ship de Meermin, has also been promoted to Sub-Lieutenant on the aforementioned vessel de Hoop and appointed, with a halving of salary to f 18:—. There also having been placed on this vessel de Hoop to cross over with it to Ceylon 4 soldiers of the Regiment of Meuron, who remained behind here as invalids, two months' pay and service money has been provided in advance to each of them, as has been noted in the accompanying memorandum drawn up thereof. In our respectful letter of 5 April last, we had the honor to inform Your Excellencies of the arrival of Mr. Buchanan, envoy of the Nawab Mahomet Ali Khan, transmitting copies of the letters we received with him, both from the aforementioned Nawab and from the Governor of Madras, Lord Campbell. § 2. He has only, adding that this was done in his private capacity, given 12 articles, which he said he would recommend to the Nabab, if we on our part would also undertake to send the same to Your High Mightinesses, to sign with him and, if the Nabab approved them, to bring them into the form of a treaty. § 10. In these articles, which accompany this in copy and concerning which we deliberated with all emphasis in our meeting on April 25, the matter of the Tuticorin pearl fishery has been left pretty much on the footing as it was in the treaty with Mr. Dott. § 12. But regarding the Mannar pearl fishery, the same contain notable changes. In the treaty concluded with Mr. Dott, the share of the Nabab is set at one-sixth of the lease sum, if the Nabab chose to receive that in money. In these articles, on the contrary, it is set at one-quarter. In the course of 40 years, the Mannar pearl fishery has been worth around 1500000 rd:s to the Company, being on average 37500 rd:s per year. According to this calculation, the one-sixth share according to the treaty with Mr. Dott amounts to 6250 rd:s, and according to that same calculation, the quarter share as it is demanded in the aforesaid articles amounts to 9375 rd:s, and thus 3125 rd:s more each year. § 13. This difference is certainly quite large; nevertheless, it appears to us that it were to be wished that the Nabab, however onerous this may be for the Company, might always choose, when holding a fishery, to take his share in this manner in money. Thereby not only would much trouble and unpleasantness in the fishery be prevented, which, however one manages it, are always more or less to be feared from it, but we even think that if the bidders for the lease are assured that the Nabab will send no tonies, the higher lease sum in such a case will amply make up for that by which the portion in money relative to the whole lease sum is greater than is the portion in tonies that the Nabab keeps in his option to send to the fishery, relative to the number of tonies that are used for it by the Company. § 14. It is for this reason that the undersigned Governor has taken very great pains to persuade Mr. Buchanan that he would make no change in his proposals regarding the number of tonies that the Nabab shall be allowed to send to the fishery, from that which was established in the treaty with Mr. Dott.

After having held many conversations about this, Mr. Buchanan was nevertheless persuaded, instead of this most unreasonable demand of the Nabob, to put in the 9th article of his proposal that the person whom the Nabob sends to Mannar to direct his tonies in the fishery, shall be permitted to fish on whatever banks he finds suitable without any hindrance or impediment of whatever kind. § 18. The fifth article explains clearly the motive why a portion in the Mannar fishery is given to the Nabob, and this consequently excludes the possibility of deducing from the aforementioned 9th article any detrimental consequence regarding the ownership of the banks, and since Mr. Buchanan judged that the intention of the Nabob is satisfied by this article, there remains no doubt that the true aim thereof is only, as Mr. Buchanan in several conversations held about this also did not disguise, to reassure the Nabob concerning what ill-disposed persons have repeatedly suggested to him, namely that the Company only causes the Mannar pearl banks to be inspected for appearances' sake, and that it keeps the true condition thereof hidden in order thereby to avoid the unpleasantness of permitting any tonies of the Nabob to this fishery. § 19. Also, it is more by reason of its strangeness than on account of its weight that we have considered it necessary to make these few remarks about it. § 20. 148 namely that the person who on behalf of the Nabob will have the management over his dhonies, as a mark of honor and distinction for His Highness, shall be allowed to fly the Nabob's flag near his residence, and that he may moreover have with him a guard of 50 sepoys commanded by an officer, Mr. Buchanan has declared to be two points which the Nabob recommended to him in his instructions in the most emphatic manner, and all efforts made to persuade Mr. Buchanan to leave that out of his proposals have been fruitless. We therefore only remark in this regard that this matter, in our humble opinion, through the addition that it is done solely for the sake of honor, and especially that the person who has the management over the Nabob's dhonies shall otherwise be subject to the laws and regulations of the Ceylon Government, at least has somewhat fewer inconveniences than the earlier demands of the Nabob, especially insofar as he also claimed jurisdiction over his people therein. § 21. It states that the Company, without interruption, shall continue to retain the full and peaceful enjoyment of its trade and all its privileges in His Highness's lands of Madura and Marawa, and although the exclusive right of the Company in the linen trade is not explicitly named therein, what is said at the conclusion thereof clearly shows that it must be understood under this, especially when one connects with it what is said in the article immediately following, that from both sides the sense and true meaning of the aforesaid proposals shall be observed in the most well-intentioned and unconstrained meaning of the words. 149 § 22. The value of the Company's trade on the opposite coast cannot well be calculated, as that depends on the smaller or larger quantity of linens that it may suit the Company to have collected there; but if one calculates the collection as it has taken place in recent years, which on average amounts to nearly 250,000 rixdollars in purchase, one may safely assume that the Company, after deduction of all expenses and of the burdens borne on the Madura coast on account of that trade, can retain in pure profits thereon nearly 60,000 rixdollars a year. § 23. This trade can easily be expanded without the burdens of the Madura coast thereby becoming greater, if the Company should think fit in due time; and whether this happens or not, a new confirmation of the Company's rights and privileges can also notably serve to ensure that, when the Company has no competition in trade to fear, the merchants can all the better be kept to delivering nothing but good and sound goods. § 24. The matters having been brought in this manner before Your High Nobilities' eyes, as we have taken the liberty to do above, and having been taken into consideration by us with all attention in our aforesaid meeting of April 25, and considering further that after the efforts already made, it would be useless to attempt further whether Mr. Buchanan would be willing to make any alteration in his proposals, it appeared to us that the true interest of the Company demanded that we sought to gain as much time by protracting the negotiations as was necessary to bring all the foregoing under the eyes of Your High Nobilities; and on that same day we accordingly resolved with unanimity of votes to acquiesce in the proposal of Mr. Buchanan, namely that the aforesaid articles drafted by him, after they shall have been approved by His Highness the Nabob, shall be

approved, also on our side, presented to your High Excellencies in the form of a treaty signed on both sides, solely in order that, if your High Excellencies approve them, they might be ratified by the same without further lapse of time. § 25. Mr. Buchanan thereupon sent the aforesaid articles to the Nabab. The answer which he received thereto he communicated to us in a letter of 19 June last, a copy of which accompanies this, whereby your High Excellencies will see that the Nabab, not satisfied with the aforesaid proposals, approved the same only under this condition, that Mr. Buchanan should further insert therein that he will also in the future participate for one-half in the Tuticorin Chank diving. § 26. This diving, according to a specification drawn up by the inspector thereof from the year 1770 to the year 1787, calculated one year with another, has yielded nearly [illegible] per year. Besides that the surrender of half thereof therefore still amounts to a considerable sum, it is moreover to be presumed that this article, by having the Nabab participate therein, will certainly not improve, and that consequently the half which the Company would now still retain for the future will probably even be worth less than it formerly was. § 27. Concerning the pearl fisheries, past customs still provide some semblance of right, but regarding the Chank diving it is evident that the Nabab has never had any rights thereto and that it has always been regarded and administered as a property of the Company. The Nabab's demand not only to participate therein henceforth for one-half, but that he also wishes it to be considered as a favor that he allows the Company to retain the other half, is so strange and invalid that it can in no respect be a point of inquiry, except insofar as the Company deems it convenient to consent thereto for the promotion of other interests. § 28. It appeared clearly that Mr. Buchanan himself was somewhat dismayed thereat. Already in his first conversations with the first undersigned Governor he had assumed that the Chank diving would not be spoken of, and now that this answer of the Nabab arrived, he related to the Governor in confidence that the Nabab, upon his departure from Madras, on his special question how he should conduct himself regarding the Chank diving, had answered him that if the rest conformed to his objectives, he did not consider the matter of the Chanks to be an affair of much importance, and he therefore left him master to act therein according to the findings of matters. We are therefore not disinclined to think that the confirmation of the Company's privileges by the 10th article at Madras made an impression that had noticeably weakened the Nabab's inclination to conclude with the Company on such a footing as Mr. Buchanan had proposed to him, and that he therefore made the less difficulty in commending the article of the Chank diving to the Envoy in a manner which, as Mr. Buchanan points out in his aforesaid letter of 19 June last, must cause the negotiations to cease if it were not accepted. § 29. With this consideration, we also thought we had to take into serious consideration the very notable warning which Mr. Buchanan makes in this letter of his, that if things could not be brought to a conclusion according to his proposal now made further therein, he would consider himself obliged, in the capacity of Agent of the Nabab on the Madura coast, to take steps for the defense of his interests that might be detrimental to the trade of the Company, and of which it might become possible that, once done, the conclusion of an agreement as was now offered would thereby be prevented. § 30. In the alternative in which we consequently found ourselves, we had to come to a decision. We had either to take it upon ourselves to have the demand of the Nabab on the diving of the Chanks further inserted into the aforesaid articles proposed by Mr. Buchanan, or we had to suspend the negotiations and await the outcome for the rest. § 31. Whether Mr. Buchanan would really have resolved, in case the negotiations had been broken off, to take such steps to the detriment of the rights and privileges of the Company as he warned in his aforesaid letter, we cannot say for certain; but the emphatic addition which he made thereto in his public capacity, that in such a case he would pay no regard to arrangements of whatever name to which His Highness the Nabab has not given his confirmation by treaty or other written instrument, seemed to us to deserve too much notice not to take into serious consideration. § 32. In case we had broken off the negotiations, the consequences thereof might have become of a most harmful influence on the Company's state and trade on the opposite shore and have brought many things there into great confusion. By, on the contrary, taking over the aforesaid articles with the point of the Chanks inserted therein, in order to present them to your High Excellencies for approval, we gained time for your High Excellencies to be able to judge for yourselves what course it may be advisable to take in this matter for the interests of the Company. § 33. On these grounds we resolved in our meeting of 21 June to write to Mr. Buchanan, in answer to his aforesaid letter, the letter which accompanies this in copy, dated the 30th of the same month, and thereby to take it upon ourselves to [illegible] the aforesaid proposals now still with [illegible].

augmented by the point regarding the shank diving on the terms stated therein, to Your High Noble Lordships. The receipt of this letter was acknowledged by Mr. Buchanan in a letter dated the 1st of this month, a copy of which is also attached hereto. §34. The first undersigned Governor made great efforts to persuade Mr. Buchanan to insert into his aforesaid articles a confirmation of the Treaty with the Prince of Madura of the year 1710 and the Treaty with the Teuver Lord of the year 1759. However, this gentleman declared that, as he had no special instructions for this, he could not agree to it. Nevertheless, after everything was settled with him in the aforesaid manner, on the day before the mutual signing of the articles drafted by him, he accepted the authenticated copies of both the aforesaid treaties, so that, if necessary, it might be evident what rights and privileges belong to the Company according to the same. §35. After everything had been arranged in this manner and the aforesaid articles had been put into the form of a treaty, we further resumed the same in our meeting of the 7th of this month, and resolved to sign them, as was done on that very same day by the first undersigned Governor and Mr. Buchanan, who at the same time, for greater assurance of the sole purpose for which the aforesaid articles were put into the form of a treaty and signed, also signed a separate article, a copy of which is attached hereto. §36. An authentic copy of the aforesaid articles is attached hereto. It is written twice in Dutch and twice in English. In the Dutch, the name of the Company appears first, and in the English, the name of the Nabob. Mr. Buchanan took one Dutch and one English copy with him, and we have kept one Dutch and one English copy, which we shall send in original to Your High Noble Lordships with the first ship departing from Galle. Furthermore, we have agreed with Mr. Buchanan that we would request Your High Noble Lordships, as we take the liberty of doing hereby, that in case Your High Noble Lordships approve the aforesaid articles, to execute the ratification not only on the Dutch, but also on the English copy. The Nabob will do likewise, and in this manner the documents will be exchanged after they have been mutually ratified. §37. We hope that the policy pursued by us in this matter will be approved by Your High Noble Lordships. As noted above, strictly speaking, we have done nothing other than to simply accept the proposals of Mr. Buchanan, after having first tried everything possible to reduce the onerous burden contained therein for the Company, in order to submit them to Your High Noble Lordships. §38. In case Your High Noble Lordships decide to approve the aforesaid articles, we take the liberty of humbly submitting for your consideration whether it might not be necessary, for the sake of propriety, to send a commission from here to the Nabob for the exchange of the ratifications, considering that he has now sent two embassies to the Company. §39. We also take the liberty of asking Your High Noble Lordships whether it would please you, in case the aforesaid articles are ratified, that Mr. Campbell, Governor of Madras, should also sign them in his public capacity. We think that he will not refuse to do so if requested by the first undersigned Governor, and since the Nabob in effect is nothing other than an instrument in the hands of the English Government, it appears to us that this could be of service in more than one respect. We commend Your High Noble Lordships and the interests of the Company to God's safe keeping, and remain with all respect and fidelity, Right Honourable, Highly Esteemed, Widely Ruling Lord, Right Honourable, Severe Sirs, Your High Noble Lordships' humble and very obedient servants. 156 Upon the further express verbal orders of Your Right Honorable Worships, after exchanging mutual compliments—which consisted in the fact that the Company being honored with a second embassy from the Lord Nabab, whose credentials had been read out in the meeting that same morning, we were charged by the government to compliment the Lord Ambassador on behalf of the Company on His Honor's arrival here, while at the same time expressing the special pleasure the Company would have if all matters could be settled both on the part of the Honorable Company and on the side of His Highness—we commenced our commission and made a beginning by proposing to the Lord Ambassador that he be pleased to state to us in writing: in how far the drafted articles of treaty (which the previous envoy here on behalf of the Lord Nabab, Mr. Dott, had confirmed by his signature) did not agree with the sentiments and intentions of the Lord Nabab, in order to clearly ascertain this, and subsequently regulate all matters and bring them into such a state that they might serve to the satisfaction both of the Honorable Company and of His Highness the Lord Nabab. The said Ambassador thereupon informed us in the most friendly terms that, before proceeding to a written observation on the written treaty of Mr. Dott, who had exceeded his powers, he requested to be allowed to have an answer in writing to the proposal made to be able to hold a pearl fishery on the banks of Mannaar in this season still, as 30 or more thonies had already been made ready on behalf of His Excellency the Lord Nabab for this purpose, which lay ready to be able to hold a fishery in this season still. We informed him upon this that we were already instructed on behalf of the government to give notice to the Lord Ambassador that in this already elapsed monsoon there was no longer any possibility of holding a pearl fishery on the banks of Manaar, and that one could thus begin with the regulation of affairs for the future, but that we would on the following day transmit the aforesaid answer in writing to His Honor, 157 and at the same time point out therein how and for what reason it was impossible to be able to fish in this season. On the 18th in the evening, by order of Your Right Honorable Worships, we would send the said answer in writing to the Lord Envoy of the following tenor: The undersigned members of the Political Council, commissioned to enter into negotiations in the name and on behalf of the government of Ceylon with Mr. Buchanan, envoy of His Highness the Nabab of Karnatika, have the honor, in answer to His Honor's written question put yesterday to the Lord Governor, to inform him further in writing by this, as they already had the honor to do orally yesterday, that according to constant custom, before a pearl fishery can be proclaimed, the banks must first be inspected in order to discover whether they are covered with mature oysters. That in case the banks are found to be sufficiently covered with mature oysters for that purpose, the leasing is subsequently held upon the reports that come in from it, and that this inspection takes place in the months of November and December, in order to be able to proceed with the actual fishery early in the spring, which must be commenced in February, in order to get the work done early in March, as otherwise the northern monsoon prevents the fishery. That without such a preceding inspection no fishery can be held, but that even if such were possible, this is nevertheless impracticable now and would be lost labor, because the suitable time for it has elapsed, and the northern monsoon is about to break through daily. The Lord Envoy will therefore please understand that the daily fishery proposed by His Honor cannot be entered into at present, and that it is consequently unnecessary to have the thonies of the Lord Nabab come up. I have now to propose to you, that as the rights and proportions of His Highness the Nabob and the Honorable Dutch East India Company to the pearl fishery of Tuticorin and Manaar have long been a subject of dispute between His Highness and the Honorable Company, and as they are not yet clearly understood by the parties, a negotiation to remedy this misunderstanding and to place their respective rights and proportions on a clear and permanent establishment by treaty may be entered upon. Agreeable to your request to be informed what were His Highness the Nabob's objections to the treaty proposed by Mr. Dott, I acquaint you that I have seen a copy of His Highness's letter to Mr. Dott, disapproving in general terms his having exceeded the powers delegated to him, particularly in the instance of proposing an exclusive right to the Honorable Dutch East India Company of the trade in the Tinnevelly Country, which His Highness was not inclined to grant to the injury of his friends and allies the English, and other circumstances in that treaty not immediately connected with the subject matter of dispute, the pearl fishery. His Highness has informed you what appointment he has been pleased to honor me with. For the present, I wish to confine the subject of negotiation to the pearl fishery only, and I beg leave to state what has been the ancient usage and long-established custom, as mentioned by His Highness in his letter to Pieter Sluysken Esqr., member of your council, dated 30 October 1770, and is as follows: The rights of the circar (exclusive of the rights of the Polygars) are twenty boats and ninety-six and a half thonys. Besides these, the circar is entitled to what is fished up at any one time every day from each diver, and also the whole of what is fished on any one day of the week. Lastly, two pearls in ten (one-fifth) of all the large pearls. An officer of the circar is to attend the fishery with troops and a bazaar, to hoist His Highness the Nabob's colors during the fishery, and to receive the customs of the bazaar for the circar. To forward the end proposed, I would recommend that in lieu of these various rights or claims of His Highness, such general proportion of the whole fishery as appears to you to be just and right on free and liberal principles be stated by you and proposed as the basis of a treaty, to be laid before His Highness the Nabob without delay for his approbation. On the 3rd of this month, pursuant to your Most Noble and Right Honorable order, the following reply was dispatched by us in a letter to Mr. Buchanan, namely: Regarding that which the honorable gentleman was pleased to propose to us in his memorial of 22 March last, we have the honor to submit the following in reply. Concerning the pearl fisheries, both on the Madura Coast and at Manaar, everything was determined with great clarity in the negotiations with Mr. Dott. But if your honor should nevertheless maintain that some obscurity is to be found therein, we request your honor to be so good as to point out specifically wherein, in your honor's view, that consists. In the act of authorization granted by His Highness the Nabob to Mr. Dott, it is true that nothing more is stated than that His Highness had given full power to his faithful friend Mr. James Dott to treat with the Governor of Ceylon concerning the pearl fisheries of Tuticorin and Manaar; yet in the letter written at the same time by His Highness to the Governor, it is stated that His Highness sent Mr. Dott to treat concerning the pearl fisheries and other matters, and it is very clear that this latter could have no application other than to the remaining interests on the Madura Coast between the Noble Dutch Company and His Highness the Nabob. However, without making this a point of contention for the present, we shall now only observe in that regard that it was already shown to His Highness in a letter of 22 February 1787 that, strictly speaking, in the treaty concluded with Mr. Dott, only the matter of the Madura pearl fishery was further regulated, and in the amicable agreement that of the Manaar pearl fishery; and that furthermore, in the aforementioned treaty, nothing else was done than to declare on both sides that everything should remain on the previous footing, without any alteration.

160 The latter is in accordance with what His Highness has declared on several occasions to be in all respects his sole desire. His Highness has further repeated this declaration in the most friendly manner in a letter written on 6. febr: 1787. and thus several months after the conclusion of the aforementioned treaty; and the Noble Dutch Company demands on its part nothing more nor anything else. By this mutual declaration recounted here before, nothing new or that which did not already exist has therefore been desired or stipulated from either one side or the other; and thus Mr. Dott cannot be considered to have exceeded the power with which he was invested by His Highness. His Highness was nevertheless answered to his aforementioned letter of 6. febr: that the Governor would gladly await what His Highness stated in this letter that he intended to note further regarding the transactions with Mr. Dott; but as this has not happened since, Your Honour is kindly requested, if Your Honour should find anything in particular necessary to note on the aforementioned mutual declaration, or the brief extension thereof, to be willing to do so piecemeal. In the friendly mission of Mr. Dott, it was evidently the intention of His Highness to remove thereby everything that now and then gave rise to difficulties; and although the letter of His Highness, also brought by Your Honour, on this occasion speaks only specifically of the pearl fisheries, one may nevertheless not doubt, from the benevolence with which this letter was written, that His Highness likewise had this same friendly purpose in the mission of Your Honour. This good purpose will nevertheless be achieved only very incompletely if all other mutual interests on the Madura coast between the Noble Dutch Company 161 and His Highness the Nabab are not included in this further negotiation. During the holding of the latest Tuticorin pearl fishery in the past year, arrangements were made regarding the flag of His Highness and the bazaar, by which one could abide for the future as far as this fishery is concerned; and regarding the Mannar pearl fishery, everything has been regulated in the friendly agreement with Mr. Dott in a manner that must be considered in all respects sufficient to properly manage the tonies of His Highness in this fishery, in case His Highness chooses to have them; yet this would be arranged in the most convenient manner and at the same time serve to the greater benefit of His Highness himself, if His Highness declared once and for all that he wished to keep to the enjoyment of a sixth part of the entire lease revenue, as this was left to the choice of His Highness in the aforementioned friendly agreement. In the Tuticorin pearl fishery, instead of more or less a fourth part, which is even now incomparably more valuable than was formerly the value of the number of stones according to which this is calculated, half has been allotted to His Highness; and instead of the 96. ½. stones in the Mannar pearl fishery, which at the time of the free fisheries perhaps amounted to not even a fiftieth part of the whole, a sixth part of what the Mannar pearl fishery will yield upon leasing has been ceded to His Highness, if His Highness wishes to profit from that instead of the fixed number of tonies. It therefore appears, Sir, that the Noble Dutch Company has been utterly equitable in this transaction of hers, and has shown all reasonable regard for the interests of His Highness the Nabab. Their Honors are also, for their part, very much inclined to cooperate eagerly toward this, yet they trust in the most complete manner that Your Honour, perceiving the reasonableness of all that is alleged above, will find that, with what has been shown here before on the part of the Honorable Dutch Company, everything has been done that can in fairness be demanded of Her Honour. On the 4th of this month, a missive was thereupon received by us from the Lord Ambassador Buchanan of the following content: In answer to your Remarks on the written state of His Highness the Nabob's Claim which I had the honor to present to you the 22nd ultimo, I beg leave to observe to you that I conceive His Highness to be the best Judge of the Powers granted by him to Mr. Dott, and of the extent of those powers as well as his intentions thereby, and I have asserted, as I do now, that His Highness wrote to Mr. Dott disapproving of the treaty for the reasons I have already assigned to you: for those reasons I am inclined to confine myself to the subject matter of dispute, the Pearl fishery; Mr. Dott having introduced in that treaty sundry articles foreign to the Pearl fishery, and the treaty being finally disapproved and not ratified, is also a sufficient reason for me to avoid making it the rule I am to go by in a subsequent treaty; But if you mean to connect the matters of the Honorable Dutch East India Company with the Pearl fishery, as conditions to be proposed by you for extending the share of it which His Highness the Nabob is already entitled to, I can have no objection: In addition to His Highness's Claim already stated to you and contained in his letter to Peter Sluysken Esq. Dated 30 October 1770, the following is the Conclusion of that Letter: These Customs were settled and established in the Government of Tismal Naigue the Raja of Madura, 163 whose Dalaway was Munachen Rangaijah in the month Tye of the year Mammadhe, answering to January 1730, and to be continued whilst the government of the Carnatic should last. The above are the terms which were settled by the Rajahs of the Carnatic with the people of Colombo, therefore this right of the Cirear is incontrovertible as to Tutucorin, the whole Pearl and Chank fisheries of this place is the property of the Circar, what right then have the Dutch to half of that pearl fishery, and the whole of the Chank fishery. I considered the ground of ancient rights to have been so often disserted and so well canvassed on former occasions, that in place of resuming it, I recommended to you to put an end to every dispute of these complicated rights and claims, by a fair, generous and adequate offer on your part to His Highness as a general proportion of the whole fishery, and such as may incline him to secure to you trade and other privileges in His Highness's Country, which I trust will thereby make it his Interest, as it is my wish, to continue and extend. To now, in satisfaction of Your Right Honourable's esteemed order, set down our thoughts concerning this in the report of our commission, we initially believe, with submission to wiser judgment, from all these letters of the Lord Ambassador, which we have respectfully presented to Your Right Honourable from time to time for perusal and answering, that it may sufficiently be presumed that the Nabob's full intention is, either in a friendly manner or else by an unfriendly visit, to compel the Company to make a generous offer of an equivalent for the share that His Excellency believes he ought to have in the Pearl fishery and which lawfully belongs to him. The report of the first undersigned's commission of the year 1770 in this same matter to His Excellency the aforementioned Nabob shows how the first undersigned attempted to dispute the Nabob's unfounded pretensions, 164 to dispute, yet had to return with the matter unaccomplished. The negotiations of the Pulicat Chief Blaauwkamer certainly went further, as can be seen from the letters received thereof, yet this has likewise been without fruit. The first undersigned nevertheless believes that in this matter, at the proper time, one could have dealt advantageously for a moderate sum, rather than now that an ambassador on the Nabob's behalf is here to regulate this matter. The first undersigned therefore does not know in what manner one will be able to keep this affair pending in order to await a better opportunity. Mr. Blaauwkamer says verbatim in one of his letters dated the 28th of January 1786: It appears to me that parsimony in this matter must entangle the Company in expenses and losses which a reasonable settlement could prevent all at once. And that, hypothetically, a lakh of pagodas or more, if it could not be otherwise, cannot come into consideration compared to the damages which the Company in time will have to erase if the affair of the Pearl fishery remains unsettled, and we undertake to fish with our own vessels and people. In this same letter Mr. Blaauwkamer further says: I must therefore, without conviction I may say, acknowledge that the Pearl fishery in itself does not seem worth that much, especially at a time when there is such an unheard-of lack of money; but the designation matters nothing here. The disputes regarding the Pearl fisheries remaining undecided will be and remain the cause of disastrous consequences, which, even if they can be concluded through negotiations, will cost double.

I remain silent about damages and obstacles in, yes possibly a complete standstill of the Company's trade, as well as about the far-reaching insults, which Their Honours and we will have to efface, and which notoriously come down upon the Dutch nation. I pray to God, that I completely deceive myself in this ghastly prospect. Therefore I heartily wished that the Tuticorin disputes could have been settled by that way. His Honour says further: In bringing complaints, and in claiming too strongly old customs, it is always to be feared that one is also suspicious of this from the other side, and in raking up, even the making of any apparent right, one extracts a proof that it is we who encroach upon old customs when we see our advantage in it. Their High Honours note in their highly esteemed letter of 30 December 1768 that it is sufficiently to be seen by what his Excellency, the Lord Nabob, is driven, and how much they seem to remain active at that Court, not only to fatigue the Dutch Company by never before heard pretensions, but also to attack its never yet doubted privileges and prerogatives through one channel or another, or gradually through intrigue ways to lead to the disputing of a right which the Company can never cede without falling from one into the other ruinous circumstances etc. With all that, Their High Honours at that time, for the reasons given in the mentioned letter, grant to his Excellency, the Lord Nabob, to be allowed to fish with 96 ½ stones on 20 tonies, however under such conditions as are mentioned therein, but with which his Excellency the Lord Nabob, as it seems, does not at all want to keep himself satisfied or content, and from which subsequently the negotiations at that Court assigned to Mr. Blaauw kamer arose, but also all without effect. Finally, the Lord Ambassador Buchanan in his last letter dated the 4th of this month, written to us, states completely that his Excellency the Lord Nabob rejects the contract made with Mr. Dott and therefore has not ratified it, as being mixed with other matters that are not related to the Pearl Fishery. His Honour says among other things finally in this letter: It is indisputable that the Pearl fishery and that of the chanks at Tuticorin belong to the circar of the Nabob. What right, pray, do the Dutch have to half of this Pearl fishery and to the entire chank diving? I consider that over the pretext of the old rights enough has already been disputed and refuted. But on this occasion, instead of looking over it further, I have recommended, in order to make an end to all these disputes and complicated pretensions, to make a generous offer from your side to His Highness for a general share in all the pearl fisheries, and such an offer that can move him to now secure your trade and other privileges in the country of His Highness, concerning which I flatter myself that in that way you will look after your and his interest, as is my wish that shall happen and I may come to know. Mr. Blaauw kamer says in his repeatedly mentioned letter that he will write further of the performance of a vakil whom he says to have sent to the Court; but of this performance of his or further negotiation we have found nothing, and thus we return to the matter to set down further herewith, upon your Right Honourable's express verbal order, our thoughts related to this narrative. 168 through the instigation of his allies, to maintain his pretension, or to involve himself further in a dispute with us, in order thereby, as much as possible, to make our trade both on Cormandel and on Madure difficult, and through which certainly more damage is done to us than by a generous equivalent, by which everything could be removed out of the way. Now it remains for us to choose whether we shall limit ourselves to the made and as yet unratified contract with Mr. Dott, as envoy on behalf of His Highness, the Lord Nabab, and limiting ourselves thereto, it remains for us to consider and compare the claim of His Highness against ours. If, as said before, one wished to come to a generous offer, we believe that one could at least make a presentation of 50,000 gold pagodas, 6 trained elephants, and 6 stallions, provided that His Highness, the Lord Nabab, would then have to renounce entirely, both for himself and for all his successors in time, all pretensions to the pearl fishery both at Aripo and at Tutukorijn. However, if His Highness might not be satisfied with this, but absolutely desire to have a share in the fishery and to let his flag fly in it, we think with submission that one could offer him a fifth part in the pearl fishery at Mannaar, and that this would be sufficient to see whether one could not thereby finally make a complete end to all dispute with that court, and furthermore still permit him, during the holding of a fishery, to send 50 armed sepoys under an officer, who, as soon as the fishery was ended, immediately with their flag brought along on behalf of His Excellency the Lord Nabab, would have to depart; all, however, under this condition, that 169 His Excellency on his part should always help to promote the Company's interests both on the coast of Madure and Cormandel, and clear all obstacles against it out of the way. For the rest, we further respectfully note in this matter that, in case His Highness wished to let himself be content with this equivalent as a share in the fishery, the same would come to amount annually to only three to four thousand rixdollars, considering that now for 20 years, except for the Tutucorin fishery of the last past year, no fishery has been held, which does not weigh up against the vexations which one, on account of this dispute, has had to endure at all the Company's trading places along the Coast of Cormandel and on Madure, over and besides the loss that the Company itself finds herein in its trade; which one cannot maintain other than by great force or compliance with very great expenses. Through all these generous offers it might well happen that the aforementioned Nabab, through instigation of ill-disposed persons, or out of stubbornness, insisted on an even greater part in our pearl fishery, and we must therefore respectfully confess that it appears to us in everything that if one, as Their High Excellencies elsewhere rightly remark, proceeding from one step to the other in his favor, we should finally let all our old privileges be contested to our own prejudice. Yet one can at least undoubtedly believe that we, principally in these disadvantageous, yea moneyless times, should maintain ourselves better by all cash payments in good coin species, than by asserting our true right, which we believe to have at all our trading places both on the Coast of Cormandel and on Madure, in another manner; for experience in the last war between Holland and England has fully taught us that we, because our factories everywhere in the Nabab's land were abandoned, and thereby the trade of the Dutch stood still, were desired there, but principally at Tutucorijn and the subordinate factories, more than any other nation; and it is moreover still very well known to us how in earlier days, whenever the Maravas, or Theuvers at Kilkare, often acted so grossly that we had to break up that factory, and thereby as it were strangle the Theuver by the throat, they then each time came with hanging paws, as the saying goes, and begged that that factory might yet be re-established again and our people return there.

As soon as Tuticorin, after the end of the recent war, was again occupied by the Dutch, the linen trade there flourished again within six months, as before. In Negapatnam, the inhabitants also long in the most heartfelt manner for our return, and this cannot be otherwise; for our contracting of large quantities of linen and the advancing of large sums of money make the land and the people flourish. Undeniably, the Lord Nawab has his interest in this, and thus one can deduce from it whether His Highness is not very much concerned with helping to promote our trade. If one now wishes to consider our affairs from this perspective, then we believe, subject to wiser judgment, that if there is no other way, there would still be one means by which the Nawab would naturally have to seek our friendship, and we believe we may consider it universal; however, initially it would be somewhat oppressive for the servants who would have to suffer under it for some time. We presuppose that as soon as our trade ceases and the right of possession is maintained only at our factories by one or two servants, and we decide rather to pay 10 percent more for the goods on Ceylon if the linen traders bring the same hither, to which we could lend them a helping hand with our sloops and vessels, we could then perhaps make the Nawab quickly sing a different tune, and the oppressed subject himself would show him well enough how the Nawab renders him incapable of making any profit, and thus could yield him nothing. The result might possibly, and also possibly not, be that we would initially collect somewhat less, but it could also be that Ceylon would thereby receive an influx of coast people and weavers; good pay and being well treated would be preferred by the Malabar and the coast dweller over oppression and having to suffer all kinds of vexations that the poor people endure under an indigenous government. This is the utmost of what we have cited here before; for if we could believe that the Lord Nawab would let it come so far, we would also have to set down here the advantages that we believe the Company would obtain through these measures, and compare them against the higher cost of the linens that we would have to pay for them here on Ceylon. However that may be, according to our humble view, it cannot be that the Lord Nawab would be indifferent as to whether a sum of more than three lakh pagodas more or less circulates in his land; however, we still prefer the latter way. The undersigned, hoping herewith to have satisfied Your Right Honorable's esteemed order according to their humble knowledge, have furthermore the honor to call themselves with all high esteem, was undersigned, Right Honorable Sir, Your Right Honorable's very humble servants, was signed, Pieter Sluijsken and G. That without such a prior inspection no fishery can be held, but that even if such were possible, this is nevertheless impracticable now and would be wasted effort, as the suitable time for it has passed, and the northern monsoon is about to break daily. The envoy will therefore please understand that the actual fishery proposed by His Honour cannot be entered into at present, and that it is consequently unnecessary to have the tonies of the Nabob come up.
