granted, states nothing more than that His Highness had given full power to his faithful friend Mr James Doott to negotiate with the Governor of Ceylon regarding the pearl fisheries of Tuticorin and Manaar; but in the letter from His Highness written to the Governor at the same time, it is stated that His Highness sent Mr Dott to negotiate concerning the pearl fisheries and other matters: and it is very clear that this latter could have had no application other than to the remaining interests on the Madura coast between the Noble Dutch Company and His Highness the Nabob. But without making this a point of question for the present, we shall now only remark regarding it that already by a letter of 22 February 1787, it was shown to His Highness that by the treaty concluded with Mr Dott, strictly speaking, only the matter of the Madura pearl fishery was further regulated, and by the friendly agreement that of the Manaar pearl fishery, and that furthermore by the aforesaid treaty nothing else was done than to declare on both sides that everything would remain on the former footing, without any change. This latter is in accordance with what His Highness has declared on several occasions to be, in all respects, His Highness's sole desire. This declaration His Highness reiterated in the friendliest manner in a letter written on 6 February 1787, and thus several months after the conclusion of the aforesaid treaty; and the Noble Dutch Company also desires on its part nothing more, nor anything else. By this mutual declaration related here, nothing new, or that which did not already exist, was thereby desired or stipulated by either one side or the other; and thus Mr Dott cannot be considered to have exceeded the power with which he was vested by His Highness. To His Highness, nevertheless, it was answered to His Highness's aforesaid letter of 6 February that the Governor would gladly await what His Highness in this letter said he intended to remark further regarding the negotiation with Mr Dott; but since this has not happened since, Your Honour is kindly requested, if Your Honour should find it necessary to remark anything in particular on the aforesaid mutual declaration or the brief elaboration thereof, to do so point by point. In the friendly mission of Mr Dott, it was evidently the intention of His Highness to clear out of the way everything that from time to time has given rise to difficulties; and although the letter of His Highness brought along by Your Honour this time speaks specifically only of the pearl fisheries, one may nevertheless not doubt, from the benevolence with which this letter was written, that His Highness likewise had this same friendly purpose in the mission of Your Honour. This good purpose will nevertheless be achieved only very incompletely unless all remaining mutual interests on the Madura coast between the Noble Dutch Company and His Highness the Nabob were included in this further transaction. At the holding of the latest Tuticorin pearl fishery in the past year, arrangements were made regarding the flag of His Highness and the bazaar, by which one could abide for the future as far as this fishery is concerned; and regarding the Manaar pearl fishery, everything has been regulated in the friendly agreement with Mr Dott in a manner that in all respects must be considered sufficient to properly manage the dhonies of His Highness in this fishery, in case His Highness chooses to have them; but this would be arranged in the most competent manner, and at the same time serve to the greater advantage of His Highness himself, if His Highness declared once and for all that he wishes to abide by the enjoyment of a sixth part of the entire lease revenue, as that was left to the choice of His Highness in the aforesaid friendly agreement. In the Tuticorin pearl fishery, instead of more or less a quarter part, which even now is incomparably more valuable than formerly was the value of the number of stones by which this is calculated, half has been allotted to His Highness; and instead of the 961 stones in the Manaar pearl fishery, which at the time of the free fisheries perhaps did not amount to a fiftieth part of the whole, a sixth part of what the Manaar pearl fishery will yield upon leasing has been ceded to His Highness, if His Highness, instead of the specified number of dhonies, wishes to profit from that: It is thus evident, Sir, that the Noble Dutch Company in this transaction of its has been utterly equitable, and has shown all reasonable consideration for the interests of His Highness the Nabob. Your Honour's friendly advice, tending to establish on a firm and unshakable footing on this occasion that which can serve to remove everything that in the future could give rise to any misunderstanding

In answer to Your Honors' remarks on the written conclusion of the pretensions of His Highness The Nabob, which I had the honor to present to Your Honors on the 22nd past, I take the liberty to point out to Your Honors that His Highness must be the best judge of the power he gave to Mr. Dott, and of its extent, as well as of his intention in that respect. And I have already assured, as I do now, that His Highness has written to Mr. Dott disapproving the Treaty, for the reasons that I have cited to Your Honors above, and for these reasons I must limit myself regarding the matter in dispute: The Pearl Fishery. Mr. Dott having inserted several articles into that Treaty unrelated to the Pearl Fishery, and the Treaty being finally disapproved and not confirmed, is also sufficient reason for me not to make it a subject of negotiation in the subsequent Treaty. In addition to the pretensions of His Highness the Nabob, which I have already presented to Your Honors and contained in his letter to Pieter Sluijsken, Esquire, dated the 30th of October 1770, the following is the conclusion of that letter. These customs were concluded and established during the government of Tismal Nairao, the Rajah of Madura, whose Dalawa was Munachee Rangaijah, in the month of Jiye of the year Munmadt, corresponding to January 1780, and to continue as long as the government of Carnatic shall exist. The foregoing are the expressions that were settled by the Rajahs of Carnatic with the people of Colombo; therefore, the right of the Circar is indisputable. As far as Tutukorijn is concerned, the entire pearl and chank fishery of that place is the property of the Circar; what right do the Dutch then have to half of this pearl fishery and to the entire chank fishery. I have taken into consideration that the subject of the ancient rights has been so often and so well contested on previous occasions, that, instead of citing them again, I have proposed to Your Honors to make an end of all these interconnected rights and pretensions, through a candid, generous, and equivalent offer on Your Honors' behalf to His Highness, as a general portion of the entire fishery, and such as to persuade him to secure Your Honors' trade and other privileges in His Highness's lands, of which I flatter myself that Your Honors by this means will restore his interests to him, as it is my desire to make them continue and expand. Agrees, Dijbrands, Clerk. 18 Gerhard Examined. The Tutukorijn pearl fishery shall be divided into two equal parts between the High Contracting Parties. It shall be at the choice of His Highness the Nabob to send to the pearl fishery as many tonis as the said Company shall send thereto, or to permit the fishery to be rented out in order to receive half of the net proceeds thereof in money. Art. 1. 2. The contracting parties shall cause the banks to be inspected according to custom, and when they shall be judged rich enough to be able to hold a fishery thereon, the chief of Tutukorijn shall give notice thereof to His Highness the Nabob, and he shall at the same time send a copy of this notice to His Highness's agent or land agent at Tianwelli. And if His Highness or his agent, after the expiration of five weeks counted from the day of the aforesaid announcement, has not declared his choice, as mentioned hereinabove, to the chief of Tutukorijn, the Company shall consider such as a consent that the fishery be rented out, the publication of which shall be made according to custom. 3. If His Highness agrees that the fishery be rented out, all rights whatsoever on the banks that he shall have rented for that season shall be relinquished to the renter. He shall be permitted to do with the pearls and oysters as he pleases, and to manage the fishery without being subject to any hindrance. 4. No. 15.

The colours or flags that the high contracting parties are accustomed to fly during the pearl fishery, the bazaar of victuals, and all other things of that nature shall remain on the customary footing. 5. In consideration that His Highness the Nabab allows and encourages his subjects to come to the pearl fishery on the banks of Mannaar and Arripo, he, as prince of Madura and lord of the country of Maarua, shall have for his share a fourth part of the net proceeds of the said fishery. 6. It shall be in the choice of His Highness the Nabab to send to the fishery, instead of the aforesaid fourth part of the proceeds of the Mannaar fishery, as many tonies as amounts to one fifth of the number used by the Company for that purpose, that is to say, 36 tonies with five stones or divers in each when the Company holds a full fishery of 180 tonies with 900 divers. The same proportion shall be maintained when, after the inspection of the banks, it is found that the number of tonies must be increased or decreased, so that if the Company sends 5 tonies, the Nabab may add one. 7. If His Highness chooses to send his tonies to the Mannaar fishery as mentioned hereinbefore, if His Highness the Nabab sends his aforesaid share of tonies to the Mannaar fishery pursuant to the notice given thereof, the person who shall be entrusted with the management of the said tonies may fish on whatever banks he deems fit without any hindrance or impediment of any kind. If, after the inspection of the Mannaar banks has been held, they are found rich enough for a fishery, notice thereof shall be given to His Highness the Nabab in the same manner as stated above in the 2nd article of this treaty, and if His Highness, after the expiration of five weeks from the day of such notification, does not make his choice known as mentioned above, it shall be regarded as agreed to accept his fourth part of the proceeds of the lease. The person entrusted with the management thereof may fly His Highness's flag close to his dwelling as a mark of honour and distinction for His Highness, and moreover may have with him a guard of sepoys of His Highness, consisting of a company of fifty men and no more, commanded by an officer. He shall for the rest remain subject to the laws and regulations of the Ceylon Government. 8. [illegible] 10. The Company shall without interruption continue to hold the full and quiet enjoyment of its trade and all its privileges in His Highness's lands of Madure and Maarua in the same manner and on the same footing as it has had them for many years, and have the freedom to increase them whenever it deems fit. The intention of this article is not, however, to prevent the inhabitants of the aforesaid lands of Madure and Marrua from being permitted to trade in fine cloths or other sorts of goods which the Company has not reserved for itself alone. 11. The high contracting parties have agreed that the sense and true meaning of the aforesaid articles of the present treaty shall be observed by each of them in the most benevolent and unconstrained meaning of the words, and if any disputes should arise concerning the trade of the Company or the pearl fisheries, the contracting parties bind themselves to employ and put into effect the most suitable and decisive means to remove them and to do justice without any delay. 12. It is finally understood that when His Highness gives his consent to the articles of this treaty, the same shall be ratified and exchanged by the high contracting parties as soon as possible. 186 your Honour will agree that I have acted in this whole negotiation, I have brought the original before your Honour's eyes, just as I now, at the requisition of your Honour, bring a copy of the letter from His Highness. The conditions of his approval of the propositions are expressed in the following paragraph of his letter: "Upon examining these articles, we were not a little surprised to notice that there was no stipulation whatsoever regarding the Chank fishery at Tuticorin; for this reason, His Highness the Nabob of the Carnatic has charged me to inform your Honour that he cannot regard the articles now proposed as a complete treaty until the matter of the Chank fishery is mentioned therein. For this reason, he requests your Honour to have the same added thereto, and as a proof of his friendship for the Lord Governor van de Graaff, and to demonstrate his goodwill towards the Dutch Company, he will consent to receive the same portion of this fishery as has been proposed for the pearl fishery at Tuticorin, and cannot agree to less." His Highness expressing himself so clearly, while at the same time leaving me no alternative or means to negotiate, clearly shows his desire to settle all disputes through this treaty. For this reason, it depends on your Honour to decide whether your Honour, by granting these conditions (which in themselves are certainly no object to dispute over), will now by treaty secure to the Noble Company its ancient trade and privileges in His Highness's country, or rather, by leaving this matter unsettled any longer, and for an object that is not to be compared with the advantages that the Company can secure for itself by this means, expose to a future disposition the completion of a matter that is so greatly to be desired. This is no new claim of His Highness, nor a consequence of the propositions concerning the pearl fishery, but a part of His Highness's claims from several years ago, as your Honour can see from what I have indicated in a previous paper, containing the letter from His Highness to Pieter Sluijsken, Esquire, in the year 1770, in these words: "with respect to Tuticorin, the entire pearl and chank fishery of this place is the property of the Circar." This is, just like the pearl fishery, a long-disputed property, which is daily decreasing in value, just as the use of this article is also no longer so much sought after. With the inclination I have to favor the interests of the Noble Dutch Company by preference, I should be extremely sorry if, leaving this 187 matter unsettled, I should find myself obliged, as agent of His Highness and for his interests, to take steps that might cause damage to the trade of the Company, and perhaps hereafter exclude the treaty now offered on such easy terms. A treaty that has been brought forward principally through the friendly intervention of Sir Archibald Campbell, and which, through his absence, will once again, as before, become an object of dispute. In case your Honour does not wish to grant this condition, it may, when I return, be my duty, against my will, to correspond with the Danish merchants of Tranquebar to offer them and receive from them such propositions as I shall think tend to the advantage of His Highness, in that country conforming myself in no way to any regulation to which His Highness has not given his confirmation by treaty or any other written instrument expressing his consent. Then, that which has primarily moved me to acquiesce in the aforementioned manner, as I hereby do, in the repeatedly mentioned proposal of Your Right Honourable Sir concerning the chanks, so as to insert that also into the aforementioned articles, is the very friendly and well-meaning addition attached by Your Right Honourable Sir to his letter, that if this takes place, Your Right Honourable Sir, in your capacity as agent of His Highness the Nabob, will consider yourself bound to take together with me such measures as I would recommend to Your Right Honourable Sir, and as might be approved by His Highness the Nabob, in order to prevent all harmful undertakings of whatever name against the trade of the Noble Dutch Company, in accordance with the true sense and intention of what is contained in the above-mentioned articles, and concerning which I shall have the honour to have the necessary proposals made to Your Right Honourable Sir by the chief of Tutucorin, Mr. Mekern. The chank fishery, of which His Highness, wishing to settle the disputes, now asks to receive no more than one half: I had not had the intention to include the same in the treaty, because His Highness had given me to understand that he had a right to this entire fishery, although it is admitted that the Honourable Dutch Company has for a long time exercised a right, to which His Highness was prevented from paying attention due to more pressing matters; and I take the liberty of saying that, the Company having been permitted to exercise this right without interruption for so long a time, this is the best reason that can be adduced to cause them to consent promptly to the moderate conditions of His Highness's letter. I shall only suppose that His Highness had said, Your Honours have for a long time enjoyed an advantage to which I had an entire right; it is now time for me to resume that right; Your Honour would not have waited to agree that it would have been to the interests of the Honourable Company to grant these claims in order by this means to secure a great advantage. The 12th article, Your Honour will do me the justice of acknowledging it, was arranged to prevent all interruptions or innovations in the trade of the Company until the ratification of the treaty; if perchance the same succeeds to the advantage of His Highness the Nabob in the chank fishery of this year, the known sincerity in the equitable conduct of Your Honour in this matter will agree that the advantage of this article must be mutual.

198 his Ambassador Plenipotentiary, properly provided with his full powers, to the Lord Willem Jakob van de Graaff, Extraordinary Councillor of the Indies and Governor of Ceylon, in order to negotiate with him, and the said Gentlemen Willem Jakob van de Graaff and James Buchanan have consequently agreed concerning the following articles: Article 1. The Tuticorin Pearl and Chank fisheries shall be divided into two equal parts between the High Contracting Parties. The Chank fishery shall, according to custom, be leased out to the highest bidder, and the net proceeds thereof shall be divided equally. It shall be at the choice of His Highness the Nabob to send as many boats to the Pearl fishery as the Noble Dutch Company shall send thereto, or to permit the fishery to be leased out in order to receive half of the net amount thereof in money. Article 2. The Contracting Parties shall, according to custom, have the banks inspected, and when they are deemed rich enough to hold a fishery thereon, the Resident of Tuticorin shall give notice thereof to His Highness the Nabob, and he shall likewise send a copy of this notice to His Highness's Agent or Governor at Tinnevelly. And if His Highness or his Agent, after the expiration of five weeks reckoned from the day of the aforesaid notification, has not declared his choice, as mentioned hereinabove, to the Resident of Tuticorin, the Company shall consider this as an agreement that the fishery be leased out, of which publication shall be made according to custom. Article 3. If His Highness agrees that the fishery be leased out, there shall be ceded to the lessee all rights of whatever kind to the banks which he shall have leased for that season. He shall be allowed to do what he wishes with the pearls and oysters, and to conduct the fishery without being subject to any hindrance. The colours or flags which the High Contracting Parties are accustomed to fly during the pearl fishery, the bazaar of provisions, and all other matters of that nature, shall remain on the customary footing. Article 4. In consideration that His Highness the Nabob permits and encourages his subjects to come to the pearl fishery on the banks of Mannar and Arippu, His Highness, as Prince of Madura and Lord of the country of Marawar, shall have for his share one-fourth part of the net proceeds of the said fishery. Article 5. It shall be at the choice of His Highness the Nabob, instead of the above-mentioned fourth part of the proceeds of the Mannar fishery, to send as many boats as amounts to one-fifth of the number which the Company employs thereto; that is to say, thirty-six boats with five stones or divers in each, whenever the Company holds a full fishery of one hundred and eighty boats with nine hundred divers. The same proportion shall be maintained when, after the inspection of the banks, it is found that the number of boats must be increased or decreased, so that if the Company sends five boats, the Nabob may add one. Article 6. If His Highness chooses to send his boats to the Mannar fishery as mentioned hereinabove, the person who is charged with the direction thereof may fly His Highness's flag close to his residence as a token of honour and distinction for His Highness, and moreover may have with him a guard of His Highness's sepoys, consisting of one company 200 of fifty men and no more, commanded by an officer. For the rest, he shall remain subject to the laws and regulations of the Government of Ceylon. Article 7. If, after the inspection of the Mannar banks has been held, they are found rich enough for a fishery, notice thereof shall be given to His Highness the Nabob in the same manner as stated above in the 2nd article of this Treaty; and when His Highness, after the expiration of five weeks from the day of such notification, does not make known his choice as stated hereinbefore, it shall be regarded as an agreement to accept his fourth part of the proceeds of the lease. Article 8. If His Highness the Nabob sends his aforesaid share of boats to the Mannar fishery pursuant to the advice given thereof, the person who shall be charged with the direction of the said boats may fish on whichever banks he thinks fit, without any hindrance or impediment of whatever kind. Article 10. The Company shall, without interruption, continue to retain the full and peaceful enjoyment of its trade and all its privileges in His Highness's lands of Madura and Marawar in the same manner and on the same footing as it has had for many years past, and shall have the liberty to increase them whenever it sees fit. The intention of this article, however, is not to prevent the inhabitants of the aforementioned lands of Madura and Marawar from being permitted to trade in fine linens or other sorts of goods which the Company has not reserved for itself alone. present treaty shall be observed by each of them in the most well-meaning and natural sense of the words; and if any disputes should arise concerning the trade of the Company or the fisheries, the High Contracting Parties hereby pledge their good faith to mutually employ and implement, in the most well-meaning manner, the most competent and effectual means to remove them and to render justice without any delay. It is finally understood that when His Highness gives his consent to the articles of this treaty and the General Government of the Netherlands Indies also approves them, the same shall be ratified and exchanged as soon as possible by the High Contracting Parties. Until that time, they shall be considered by both parties to have their full force and validity. Article 2nd The Contracting Parties shall cause the banks to be visited as usual, and when they are judged rich enough for a fishery, notice thereof in writing shall be sent to His Highness The Nabob by the Chief at Tuticorin, who shall send a copy of the same to His Highness's Agent, or Land Regent, in the Tinnevelly Country; and at the end of five weeks from the date of such notice, if His Highness or Agent does not signify his option as above to the Chief of Tuticorin, it shall be considered by the Company that he consents to farm the fishery, public notice of which shall be given as usual. Article 3rd If His Highness agrees to farm out the Fishery, there shall be ceded to the farmer all rights whatsoever over the banks he shall have so farmed for that fishing season; he shall do with the pearls and oysters what he pleases, and shall manage the fishery without being subject to any interference whatever. Article 6th shall permit and encourage his subjects to come to the Pearl fishery on the Banks of Manar and Aripo, His Highness as Prince of Madura and Lord of the Marawar Country, shall have as his share one fourth part of the clear product of this Fishery. Article 7th His Highness the Nabob shall have the option that instead of the above one fourth part of the produce of the Manar Fishery he shall send one fifth of the number of Jonies which the Honorable Company send, that is, thirty-six Jonies, with five stones or divers in each, when the Company holds a full fishery of one hundred and eighty Jonies with 900 divers: the like proportion when the visitation of the Banks may require an augmentation or diminution of the whole number of Jonies, so that for every five Jonies the Company may send, His Highness shall send one. Article 8th After the visitation of the Manar Banks, if they are found rich enough for a fishery, notice thereof shall be given to His Highness the Nabob in like manner as described in article 2d of this Treaty, and at the end of five weeks from the date of such notice, if His Highness does not signify his option as above, he shall be considered as accepting his one fourth part of the produce of the farm of this fishery. Article 9th If His Highness the Nabob chooses to send Jonies as above to the Manar fishery, the person charged with the direction of the same shall as a mark of honor and distinction to His Highness display His Highness's flag or colors near the house he occupies during the fishery, and moreover have a guard of His Highness's sepoys to consist of a company of fifty men and no more, commanded by an officer; in other respects to be subject to the laws and regulations of the Government of Ceylon. If His Highness the Nabob shall send to the Manar fishery his proportion of Jonies as above in consequence of the aforesaid notice, the person having the direction of the same shall fish on these Banks wherever he may think proper without any restriction or hindrance whatsoever. Article 10th The Company shall continue to exercise uninterrupted the full and peaceable enjoyment of all their trade and privileges in His Highness's Country of Madura and Marawar in like manner and on the same terms as they have done for many years past, and be at liberty to extend the same if they think proper: the intention however of this article is not to hinder the inhabitants of the Countries of Madura and Marawar to trade in fine cloths, or such other manufactures as have not been solely carried on by the Company. Article 11th It is agreed by the high contracting parties that the spirit and real intention of the above articles of Treaty shall be supported by each on the most honorable and liberal construction of the terms, and that if any dispute shall arise in the pursuits either of the Company's trade or the fisheries, the contracting parties hereby pledge their good faith to each other that the most direct and effectual means of redress and justice shall be granted without delay.
