Whereupon, having deliberated and taken into consideration that the military establishment of this Government cannot permit a large detachment, at least for the present, the more so as the ministers exclude the troops of the Regiment of Luxemburg from the requested relief, and it is therefore inadvisable to divest oneself too much of national troops; yet that on the other hand one cannot entirely comply with that exclusion, because besides the aforesaid inconvenience of weakening the national force, this would also give cause for some resentment to the aforesaid Corps. It is resolved and agreed, in order to comply with the request of the aforesaid ministers as far as possible without own inconvenience, to detach to Koethiem two hundred European and one hundred Eastern soldiers, and to include among the Europeans a detachment from the Company of artillerymen of the frequently mentioned Regiment; likewise to summon the Lieutenant of artillery Heupner from Trinkonomale and have him proceed to Koetsiem; and for the transport of the aforesaid troops, to have the ship the Leviathan return from Tutukorijn. Beside the aforesaid missive, having also received from the ministers a letter for the Lord Commander of the State's warships in the Indies, whom Their Honours suppose to be here or to appear shortly, it is resolved, in consideration of the fact that there is no news as to where the State's Squadron is presently located, and that there is also not the slightest ground to foresee when it will be here, to detain the aforesaid letter here until further news regarding this is received. 463 given, with instructions to take, in accordance with the condition and situation of each place, all measures that are necessary and possible to be prepared against all events; that to this end the servants must put themselves into a good state of defense in good time and be exceedingly careful in the admission of ships and vessels, without letting themselves be misled by foreign flags, and that they must therefore have all vessels accurately examined, as far as this can be done, before they approach their shores. Furthermore, regarding the special orders that the said Chief D: E: Mettern requests in his aforementioned letter for his information and to govern himself accordingly, it has been approved and understood that he shall be instructed by a secret letter: 1st: To be mindful in good time, and in proportion as incoming reports make it more and more necessary, to secure as much as possible everything of value that can for the present be spared to any extent, especially the cash, with the recommendation that this must be done in a manner that causes as little commotion as possible. 2nd: That for the rest, and in so far as it can be done while observing these measures, for the present and until one has more definitive news, in the internal administration, both at Tuticorin and at the sub-stations subordinate to it, one must proceed by letting things remain on the customary footing, so that in the meantime trade may continue undisturbed as much as possible; regarding which, however, the Chief shall nevertheless have to ensure as much as possible that the accounts with the merchants are kept as tight as can be done, and that the linens, as they come in, are shipped off in the sloops available there, whose commanders shall be warned quietly by the Chief that they must make sure always to be ready to set sail at the first order and even at the first signal. 3rd: That if it should come to the point that any European power on the Madura Coast should take measures against the Company which in an indubitable manner, and such that one may reasonably inquire about it from the Company's side, indicate a hostile objective, the Chief shall have to ask the reason thereof through a delegation, or if that cannot be done, by letter; and that he, depending on the answer he receives thereto, and even if he receives no answer within a reasonable time, shall have to act according to the circumstances of the matter, in so far as concerns the taking of measures not to become altogether a prey to the power that the Company's possessions on the Madura Coast

Madurese coast, threatens to attack by force, with special orders that, to prevent this, whenever such an intention becomes apparent, and at the same time that it is about to occur by a power which is so far above that which the Company has there that it would be mere recklessness to wish to resist it by force, We must then send all the military to Ceylon, except for a few whom the Chief will find necessary to retain there, for which, as goes without saying, those who are least fit for military service must be taken; that We, even without letting it come to that extreme, may gradually send back to Ceylon the ablest soldiers as they can be spared and circumstances advise; and that he likewise, if circumstances warrant it and he deems it advisable, may also at the same time permit some civil servants to cross over to Ceylon. 4th. Finally, since, as matters appear to this Council thus far, there is every reason to suppose that if any European Power should wish to take possession of the aforesaid Company's possessions by actual force, it will on this occasion act very differently from what an enemy is accustomed to do in an open war, the Chief shall be instructed that, with all such further servants as he shall deem necessary to maintain the Company's rights, he must for the present and until further orders remain on the Madurese coast, and not leave this place unless forced to do so by actual violence; with further instructions that, if it comes to that, he together with the Council, in the name of Their High Mightinesses and the Company, solemnly protest in writing against this violence, and deliver to the one by whom We are overcome in this manner a proper inventory of all Company property, with a stipulation if possible for freedom for the persons and goods of private individuals, in order that they may proceed to Ceylon or to Cochin, as shall best suit them, and that We, in accordance with this instruction, must also give the necessary orders to the factories subordinate to the Tuticorin Chiefship, as soon as We find that this is necessary by reason of the circumstances of the matters. Lastly, it was resolved to now carry into execution the Resolution taken on the 15th of February last, for the enlistment of a company of free Javanese, on the condition that they will be provided with one rupee and one parra of Rice per month, until they can drill properly, when they shall be paid just like the regular eastern troops, and that the Company's Moors will also be called to arms, likewise at the pay of one rupee and one parra of rice per month, until they perform regular military service, when they will again be paid on the same footing as before. Further, it was approved to write to the Servants at Jaffnapatnam, to send from their supply of gunpowder, which as of the end of August last consisted of 28131 7/8 lb, 10000 lb to Trincomalee at the first opportunity.

465. as well as to keep the Company of Sepoys, which is garrisoned there, ready to march, and to have them depart for that place at the first summons from the Trincomalee officials; with authority also granted to the officials to take such measures for the reinforcement of the Jaffna garrison for as long as they should have to be without the said Company of Sepoys, as was done in similar circumstances in former times. And as the weak garrison of Manaar also requires reinforcement, it has further been resolved to summon from Gale and send thither the Eastern Company of Captain Kietjel; and, in return, to authorize the officials at Gale to arm the citizenry there, and to have them, according to their strength, occupy one or two posts that can best be entrusted to them, precisely and on the same footing as was done in the recent war: likewise to reinforce as much as possible the European and Eastern Companies garrisoned there, and for that purpose to enlist as many men as they might be able to obtain, provided they are good and capable people for military service. It was furthermore approved and agreed to write to these Trincomalee officials to request, in addition to the aforementioned Company of Sepoys from Jaffanapatnam, also the two Companies of Easterners detached to the Wanni; with authority also, if capable men can be obtained to reinforce the Eastern and Sepoy companies, to enlist them into service. And whereas the Wanni, through the dispatch of the aforementioned two Companies of Easterners, is left too exposed, and ought to be provided with at least as many men as will be necessary to be protected against the marauding of the Kaffir robbers, who have made incursions there from time to time and have unsettled the inhabitants with murder and arson: it has therefore been resolved to authorize the Commander and Land Regent, the Honorable Nagel, to increase the number of the Wanni archers, fixed by resolution of 2 August 1785 at 24 men, to one hundred men; and it was also approved, on account of the meager pay of these archers, consisting of 2 rixdollars and one parra of rice per month, which the Honorable Nagel has already frequently complained makes it impossible to obtain men even up to the established number, to grant to the aforementioned Wanni archers, over and above their aforementioned allowance, one free uniform per year; and that Commander Nagel shall also be authorized, in case of need and if it cannot be otherwise, to slightly increase their monthly pay according to the state of affairs, provided this is done as though he does it of his own accord, and subject to the further approval of this Government. Since at this juncture it is very necessary that letters travel back and forth with as much speed as is at all possible, in order the sooner to receive reports from the subordinate stations and to dispatch orders thither, it was further approved to write to the officials at Jaffonapatnam, Trinkenomale, the Wanni, Kalpettij, Manaar, and Silau to reinforce the Lascarin posts as much as is deemed necessary for that purpose, with authority to enlist as many additional Lascarins for this purpose as they shall deem proper. 467. should it occur that any European Power on the Madurese coast were to take measures against the Company which indicate a hostile intent in an unmistakable manner and such that we may reasonably take notice of it, he shall, through a commission, or if that cannot be done, by letter, inquire after the reasons thereof, with qualification to act according to circumstances based on the answer he receives thereto, in so far as it concerns taking measures so as not all, especially as far as the military is concerned, to fall prey to the power which would wish to attack the Company's possessions on the Madurese Coast by force; yet that the Chief for himself, with all such further servants as he shall deem necessary in such a case, must remain on the Madurese Coast and await the violence, with orders, when it occurs, to protest solemnly against it, and then also at the same time to hand over a proper inventory of the Company's properties on the Madurese Coast. We have on this occasion had to resolve to send Captain-Lieutenant Heupner, appointed by Your High Nobilities as Commandant of the Artillery at Koetseem, to Trinkenomale as an officer in whom we place great trust, as Head of the Artillery and engineering there. We shall nonetheless, as soon as circumstances permit, be able to let him transfer to Koetseem, and shall meanwhile inform the Gentlemen Ministers of Koetseem thereof, with the offer that if they approve, we shall send another Artillery Officer to observe Heupner's post there in the meantime. The servants at Trinkenomale have been instructed that, for the reinforcement of their garrison, they may requisition from the Wanni the two Companies of easterners stationed there, as well as a Company of Sepoys from Jaffanapatnam; and to reinforce the number of officers garrisoned there, there have already been ordered thither a Captain-Lieutenant, with three subaltern officers of the Infantry and one subaltern officer of the Artillery, who are to depart this very day. We furthermore take the liberty respectfully to submit to Your High Excellencies' consideration whether it might not be strongly advisable, even if Mr. Silvester with his squadron cannot come to this side of the Indies, that they at least send a ship, even if it were only a frigate, to Trinconomale, as in many cases it would be good if a ship of the state were currently stationed there. With the aforesaid our very respectful letter, we have at present nothing else to communicate than that we proceed with all possible diligence to have everything placed in a proper state of defense. With the detachment at Cochin we hope that it may soon be sent back to us. We have already given orders to see to what extent it is possible to reinforce both the Eastern Company and the Company of Seapoys somewhat by taking into service some young men suitable for military service. But since that will not be able to help much, we very respectfully request Your High Excellencies, if it can be made possible, to be pleased to send us a good reinforcement of Easterners; otherwise we would be at a loss to provide in an adequately sufficient manner for Jaffna and Manaar. In case it might sometimes be necessary before we can make arrangements for it, we have written to the chief of Trincomalee and to Lieutenant Colonel von Drieberg, and authorized them, for as long as the present circumstances make it necessary, to consult and decide separately, together with Captain Lieutenant Heupner as head of artillery and engineering, on all matters requiring secrecy, in the exact same manner and on the same footing as took place during the last war. From our general letter, which departs at the same time as this one, Your High Noble Excellencies will see that the Court of Kandy continuously conducts itself amicably toward the Company, and on the occasion of the recent embassy that was here, the first ambassador, in a private conversation with the Governor, apparently in a semi-confidential manner, assured him of the court's good sentiments toward the Company, and that we could rely on its assistance should it be necessary. In addition, he took it upon himself to ensure that Trincomalee will be supplied from the Kandyan territory with provisions as much as possible, and we would have nothing further to report concerning this court compared to the previous, were it not that the undersigned Governor, on 18 December last, communicated in our meeting that in a separate letter of 9 February last, in reply to what Your High Noble Excellencies wrote in your most respected secret dispatch of 17 November 1786, he had humbly suggested for Your High Noble Excellencies' consideration whether Your High Noble Excellencies might not approve that, in the arrangement with the court to give it a share in the areca-nut trade and half in the elephant trade, the matter of the sea coasts be left untouched, in order not to mix or connect this question in any way with any other matters whatsoever, and that Your High Noble Excellencies, in a most respected separate letter of 31 July last, had replied thereto that Your High Noble Excellencies could not grant authorization for this, because Your Excellencies realized all too well that the aforementioned court would thereby fall into the impression that the matter of the sea coasts was regarded as a disputed point left undecided and reserved for it to bring up again in time, with orders, consequently, to declare resolutely and without equivocation upon the relinquishing of a part of the two aforementioned branches of trade that one thereby considers the article of the sea coasts as finally settled, and for the rest will abide strictly by the treaty. The Governor, who further communicated in the meeting the rest that was remarked on this subject by Your High Noble Excellencies in your aforesaid most esteemed separate letter relative to this matter, declared that he made this communication because this point appeared to him to be of such great importance that he thought it should be brought before the council for deliberation. It was considered by us beforehand that the sea coasts were ceded to the Company by a solemn treaty, in which all formalities customary on such occasions were observed, and have since been possessed by Your Excellencies by virtue of and in accordance with the same treaty, and that the right of the Company thereto, in our humble opinion, cannot become more legitimate or indisputable through any further or other arrangements than it already is by virtue of this treaty. Not to speak now of various other consequences that might arise from further proceedings in due time, or be connected therewith, it appears to us, even for the present, not without objection that if the court refuses to accept the aforesaid arrangements with the conditions that your High Excellencies please to have attached thereto, namely that one ought, in return for this favor, to have sufficient assurance regarding the peaceful possession of the beaches, whether the king, and even much more so foreigners who might come into a position to wish to make use of it, might not in due course sometimes be able to deduce against the Company from such an offer, or at least seek to infer, that if we ourselves had held that our title of possession to the beaches was so lawful and indisputable that it required no other or further assurance, we would not have taken any steps leading thereto. One cannot be too cautious in matters of this nature, and we hope, therefore, not to do wrong in being obliged to submit beforehand this our humble observation, whatever much or little ground it may have, to the more enlightened eye of your High Excellencies. For if the making of such a declaration might produce an effect contrary to the good intention of your High Excellencies, it will perhaps afterwards be difficult to bring things with the court back into the state in which they currently are. For these reasons, we believed we might hope that your High Excellencies will favorably accommodate our having taken it upon ourselves, whilst awaiting your High Excellencies' further orders hereupon, to direct matters as far as possible in such a way that the final settlement with the court concerning the above-mentioned portion in the Areca and Elephant trade remains deferred for a little longer. Lest in the meantime it might sometimes serve for some greater ease in the further 475. further deliberations concerning that which your High Excellencies shall find in this matter to be of sufficient weight to merit it, we take the liberty here briefly to bring further under the eye of your High Excellencies that which, according to our humble view, may be somewhat noteworthy regarding what occurred and was transacted with the Court concerning the beaches during and since the latest war, in order to determine the path that corresponds most with the true interest of the Company, which at least for the time being is held with the Court. Already before the war, the Court made several attempts to regain the beaches. Up to that time, it always made the proposals thereto by way of requests; but when the war with England had now broken out, the matter changed considerably in appearance, and the Court now demanded the beaches back in a tone that placed the Right Honorable Governor Falck at that juncture—the more so as an embassy of the English was in Candia at the same time—in considerable embarrassment, so much so that His Honor found it necessary, in the instructions given to the Company's Envoy, the then Secretary Billing, to qualify him to declare at last and when it could not be otherwise, that no Governor may surrender a place belonging to the Company other than by force, and the Lord Governor was therefore compelled to await orders from your High Excellencies, but that His Honor, nevertheless very grateful on account of the King's adherence to the Company's interests, would allow himself to be persuaded to leave the King unmolested in the possession of the lands of Tamblegam and Kattoekolanpattoe, which the Company had lost near Trinconomale, and which were then occupied by the King's people, provided that the sovereignty of the Company over these places remained acknowledged, etc., etc.; and that if this still did not appease their minds, the Envoy might, as if of his own accord, add that the lands of Koetjaar and Tambekadewe would also quietly be left in the possession of the King under the same conditions. 476. on the old footing, the Company's aforesaid envoy, it is true, evaded making such a clear declaration, but that he was now and then obliged to express himself rather intricately with regard to the beaches, in order thereby to advance the request with which he was charged, to obtain permission for peeling cinnamon in the King's territory, which had been refused in the preceding year, appears very clearly from the report of this embassy of 10 April 1782. Moreover, the Kandyan court dignitaries repeatedly referred in private conversations to promises that were said to have been made to the Court on that occasion. The peeling of cinnamon was thereupon permitted. In the following spring, the Kandyan envoys brought up the requests of the Court concerning the beaches anew, in such a manner that the Right Honorable Governor Falck, in order to avoid all hateful disputes in that regard during the audience which is held in the presence of many, caused the Disava de Cock, first alone and afterwards accompanied by the secretary Billing, to speak with the envoys in their lodgings about this matter, in order to bring it somewhat to a standstill. And it was not until after lengthy exchanges of words that they were able to persuade the Disava of the Four Korles that the dispute regarding the beaches ought not to be touched upon at a time when the French were still masters of Trincomalee. At the farewell audience, the Kandyan Disava nevertheless repeated his representations most wearisomely, and refused to depart without some decision that was somewhat more than dilatory. The matter finally became so precarious that Mr. Falck found himself compelled to have the aforesaid Disava de Cock deliver in writing to the Disava of the Four Korles the declaration which is inserted in the Colombo secret letter of 7 February 1783. The Company's envoy, who departed for Kandy shortly thereafter, was likewise instructed, just as in the previous embassy, to treat the matter of the beaches in a dilatory manner, and to present to the court dignitaries, as often as the opportunity arose, that this matter could as yet absolutely permit of no settlement, for reasons that had been made known to the Disava of the Four Korles during his recent embassy to Colombo. He did so, and the Kandyans were satisfied with this for 477. for that time; also, the peeling of the cinnamon was again permitted this year as usual. A few months thereafter, the news was received on Ceylon that the preliminaries of peace had been signed in the spring of 1783; and it was now thought necessary to speak in more earnest language. At the Colombo secretariat, the record kept of what was transacted with the Kandyan envoys in the autumn of 1783 is no longer at hand, and we can therefore not say too precisely what occurred on that occasion; but in the letter delivered with that embassy, the matter of the beaches is mentioned as usual, with the addition that the answer concerning what had been written to Batavia in that regard would by now have arrived. The Company's envoy, who subsequently went upcountry in the spring of 1784, was already, upon his first arrival in the King's territory, addressed with emphasis on the matter of the beaches by the Disava of the Four Korles, Dumbara Ralahami. He thereupon first pointed out the reasons which had caused Your Excellencies' answer not to have been received sooner on Ceylon, and then declared that Your Excellencies had testified that Your Excellencies had, for their part, observed the peace treaty without the least violation, and might therefore demand the same of the Court, since the obligation rests on both sides; adding further that Your Excellencies were very much displeased with the Governor Falck, because His Honor had not better understood the interests of Ceylon, and thus had wished to place the Court in danger by altering an important article of the peace treaty. He sought with various arguments to make this declaration acceptable; but when he finally added to it that the Dutch alone could boast of having always kept their word, the aforesaid Disava of the Four Korles asked him whether the Dutch truly kept their word, and this being answered with yes by the Company's envoy, the Disava continued, why then the promises so often made in writing that the sea beaches would be ceded again were not fulfilled. Cinnamon peeling was thereupon denied, and subsequently, after having first made a fruitless attempt to see whether it was possible to cause the Court to change its mind, the decision was taken on our part also to prevent the Kandians from gathering salt. In the spring of 1785 the customary Kandian Embassy arrived. It insisted anew, as usual, upon the return of the seashores, and it was on this occasion that the Lord Governor Falck, probably in order not to make the estrangement even greater than it already was by a repetition of the aforementioned declaration made by the Company's Envoy, said to the Kandian Envoys in the first audience that within a short time the fleet of the States under the command of the Lord van Braam was expected to arrive here, and that this commander of the warships would take cognizance of these disputes, for the reason that he had been sent directly by the Lords States to the Indian regions to act as a mediator in all differences between whatever state and power it might be, adding thereto in the second audience that concerning the disputes in which the Court was with the Company regarding the seashores, when the Lord van Braam should arrive here, the matter would be further deliberated with him. Things stood on this footing when the undersigned Governor assumed the administration. Now, to make new requests to obtain permission for it without having a more favorable opportunity for doing so than he foresaw when writing his respectful separate letter of 10 February 1785, and while it appeared to him that for the present there was not much hope of a change in the step which the Court had taken to prevent the Company from peeling cinnamon in the upper lands, We thought that it was not advisable. We even thought that it would produce nothing but a harmful effect; but when We afterwards received report upon which We believed we could rely, that if a way were opened to the most well-disposed among the Kandian Court dignitaries to employ themselves in a suitable manner for the Company, this would probably have a good effect, We thought, as he had the honor to inform your High Mightinesses in his respectful separate letter of 20 May 1785, that he therefore, and for such other reasons as are mentioned in this letter, could and had to change some measures, the more so because such estrangements with the Court in particular, if they are of some duration, also make an impression even outside the country which it is best to avoid as much as it can be done. By assuming the contrary, one would simultaneously have to admit that Mr. Falck intended to give the Kandiyans a warning here concerning the arrival of Mr. van Braam, which certainly would still have been too untimely then. Upon granting the aforementioned authorization, the Governor nonetheless most emphatically commanded the Envoys that they must treat this matter with the utmost circumspection, without binding the Company to anything in any manner whatsoever; and this also took place to that extent, though it certainly did not accord all too well with his intention, as is clearly evident from the aforementioned instruction, that the Envoys made use of this authorization as early as occurred, and which he considered necessary to overlook because of the reasons they provided for it in their report, and especially because of the good and faithful intention with which it appeared to have been done. In the letter sent to the King with this embassy, in reply to the letter from the Court Grandees that had been brought here during the lifetime of Mr. Falck, it was nonetheless stated in so many words that the Governor was sorry to be unable to do anything concerning the proposal made in the aforementioned letter of the Gentlemen Court Grandees; that Your High Nobles had recommended to his predecessor in the Government, the Noble Lord Governor Falck, a strict adherence to the peace treaty with the greatest emphasis; and that he also hoped that the King himself would recognize how very much the mutual interest, as well as the interest of the mutual inhabitants, made a strict adherence to that same treaty absolutely necessary. The Envoys who subsequently came down in the autumn of 1785 treated the matter of the coasts, both in the first and in the second audience, with reasonably great modesty; and although the letter they had brought along was very detailed on that matter, the first Envoy, upon the Governor's statement that he would send the answer with the Company's ordinary Ambassador, was satisfied with that, without asking for any further explanation, as usually was accustomed to occur otherwise. In the reply to this letter, written on 16 August 1786, the King was told with regard to the coasts that the Governor, in the first letter he had had the pleasure to write to him, already had to remark that the matter of the coasts was an affair entirely beyond and above his power, and that he therefore could have done nothing else than to send the copy of the aforementioned letter to Batavia according to custom. In the letter from the Court that was received in reply thereto with the Embassy that was here in the past spring, the matter of the coasts is spoken of only very briefly; nor did the Envoys mention it either in the first or in the second audience. In the latest letter to the Court of 1 March 1787, which was brought upcountry with the Merchant Raket, the same matter was passed over entirely in silence; and from his Report that was sent to Your High Nobles, it appears that the Court Grandees who accompanied him did not say a single word to him concerning the same, neither on the journey nor during his stay in Kandy, of which there has been no example for several years. In the meantime, the Company has allowed cinnamon peeling in the King's territory without hindrance, which has caused the harvests during three years to turn out reasonably well, and meanwhile matters have, at least to that extent, changed for the better, so that since then nothing unfriendly has occurred from either side. The Company's envoys have been received in the Candian territory with even more than ordinary kindness, and contrary to the custom of earlier times, the court grandees, whenever an embassy has been here, have come to spend an evening at the Government House, which has afforded the opportunity to speak and interact with them more familiarly than can conveniently happen at ordinary audiences. This has indeed served to ensure that the Court, despite perceiving the motives behind it now as well as in the year 1784, has received with a sort of pleasure the proposals made to it concerning the areca and elephant trade, however much those matters are not of such importance as to affect the Court substantially, in terms of the interest of the matter, as one might imagine at first glance; as Your Right Excellencies yourselves have already remarked in your highly respected missive of the 17th of November 1786, pointing out that the decline in the elephant and areca trade, especially in the former, is certainly not unknown to the Court, and that one could therefore not seem to expect to be able particularly to gratify or oblige the Court with their partial cession. And that is indeed the case: how little interest the Court takes in the elephant trade has already been shown from what was indicated above regarding the proposal made in the year 1784. Up to now, it also seems to take not the least measures to profit therefrom, and as for the areca trade, on the approximately 800 amunams 483. which were delivered last year for the account of the King's depas, the Court, above the ordinary purchase price of 3 rixdollars the amunam, has profited no more than roughly 2000 rixdollars. This time, up to now, the Court has also not delivered much more, and even if it should afterwards double and even triple the aforementioned quantity, that is not an object of such very great consideration. If that which appears in the report of the commissioners to the conference of the 1st of May 1766 is indeed well-founded, as Your Right Excellencies observe therefrom in your aforementioned separate letter missive of the 31st of July last, that the matter of obtaining a share in the aforementioned two articles was formerly of so much importance to the Court that one must largely attribute the previous war to it, so that in earlier times no consent could be granted for that sharing, it is very credible that under it at that time were included matters of much greater importance and extent than the present arrangements mentioned above contain. What effect the measures maintained for some time will continuously have in the meantime cannot certainly be foreseen with so much foundation that one would dare to rely upon it. It is consequently also not possible to determine how far the Court, along the lines currently maintained with it, can continuously be kept on the terms on which we now stand with it, yet we think that one cannot do better than to let it continue thus, as long as it can to some extent be maintained on that footing. Meanwhile, more time elapses in the process, and consequently the matter of the coasts does not become any worse thereby than it formerly was. We even think we may add that, just as with all temporal matters, the impression they make in the beginning generally diminishes as they move further away from the time to which they belong, one may also to some extent presume this regarding this matter. Against this, to be sure, falls this consideration: that even if one currently achieves the objective with Candia to the extent that the matter of the coasts is not, or only rarely, mentioned,

484. 5. compliance is spoken of, and one can meanwhile keep matters on a tolerable footing, one nevertheless has to fear that at inconvenient times the Court will again, just as it did at the outbreak of the English war, come forward with it in an urgent manner, and this objection retains its full force. However, a treaty as lawful and formal as we have with Kandia was unable to prevent it from happening this time; thus we do not see what further or greater security further negotiations with Kandia, even assuming that they also yield a favorable outcome for the present, will give the Company on that point for the future. On these grounds, subject to correction, we think that if Your High Excellencies might approve of adhering for the time being to the present measures with regard to the Court of Kandia, we shall thereby make the best progress regarding the matter of the beaches, and that we therefore ought not to bring it up as long as the Court remains silent about it, or might only speak of it in such a manner that one can amicably avoid it, in order to prevent entering anew into extensive discussions about it. We even dare to add with great confidence that, as we view matters, this is the only possible way to continue living in friendship with the Court, as long as one cannot use forceful means against it. If, however, the Court speaks again of the beaches after this, in a manner that makes it necessary for us to handle it with greater seriousness on our side as well, it goes without saying that this must be done, for as far as the matter itself is concerned, in the affair of the beaches no alteration can certainly be permitted. The secret letter which Your High Excellencies had the goodness to write to us on the 23rd of November last reached us on the 26th of this month via Cochin, and on account of the shortness of time we request permission to defer our humble reply thereto until a following opportunity. The ship De Pollux departed from the bay of Galle on the 8th of this month to continue its voyage thither, and we take the liberty of presenting herewith to Your High Excellencies the duplicates of our respectful missives of the 5th of October and 29th of December last that were dispatched with it. Aside from the provisions mentioned in our said letter, some equipment goods were also supplied here to that vessel upon a further requisition submitted by Captain van Straalen, as appears from the entry in our resolution of the 14th of this month, which 486. accompanies this in extract. Since then, or rather on the 17th of this month, the chartered ship Dordrecht also departed from Galle with a cargo for Europe, costing purchase price with the charges ƒ 254,876:10:8 Dutch currency, according to the Galle short invoice annexed to the enclosures; alongside which we have the honor to present to Your High Excellencies the copies of the letters that were dispatched therewith to the Fatherland and the Cape, both by us and by the Galle officials. We would gladly have had this ship make a voyage to Cochin to fetch a cargo of rice, while the return goods were being gathered for it; and since it did not seem decisive to us whether the voyage from Batavia to Ceylon in order to repatriate was to be regarded as the one inland voyage for which the said vessel might solely be used according to the charter-party, this intention of ours was announced to the skipper Pleun van der Piessen by an extract from our resolution of the 10th of October last; but he took exception to this in a written address, and upon that we resolved in our resolution of the 13th following to excuse him from that voyage. And since we have had no better success in that regard with the ship De Maria, with which we likewise attempted to have it make a voyage to Cochin according to our resolution of the 19th of November, but against which the skipper Pier Zeskes protested, as appears from the entry in our resolution of the 2nd of this month; we have deemed it not unserviceable to give notice thereof to the High Respected Lords Seventeen and the Chamber of Amsterdam, in case Their High Mightinesses might perhaps approve of making some further stipulations in that regard in the charter-party in the future, as it could be very useful if such ships, when they arrive here from Batavia and cannot immediately be laden for Europe, could meanwhile be used for this or that voyage. Since of the stipulated 121 lay days for the unloading and loading of the ship Dordrecht, 51 days were still remaining, and Your High Excellencies instructed us to arrange the commencement of the lay days to the greatest advantage of the Company, we have, in the uncertainty whether this might not sometimes [illegible] as many lay days

Since we were uncertain whether the private ships returning from Ceylon were also bound to the departure dates determined for the Company's return ships, we ordered the Captain at Sea and Equipagemeester Andringa to furnish us with his advice regarding this matter, after having informed himself with the skippers of the ships Dordrecht and Maria. And upon the report served by the said Andringa, that both skippers had declared that they adhered to their charter parties, which stipulate that they must depart whenever the ships should be fully laden, and that they consequently made not the least objection to departing outside the otherwise appointed times; yet that he, Andringa, for his own part, could add nothing other than the example of Batavia, from where four private ships were sent back to Europe this year in the months of May and June: we resolved at the session of the 6th of December last to let all repatriating private ships depart as soon as they should be fully laden, for the present and until we shall have received further orders on this matter from your Right Excellencies. Hitherto, the repatriating chartered ships here have not been provided with the secret orders and signals which we receive annually from the Netherlands and the Cape to [illegible] the ships De Dolphijn in 1783 and Factor in 1786 departed from here; but as we have now received so many sets thereof that all our return ships could be provided therewith, we thought we would do no wrong by also having them issued to the chartered ships, in case they might sometimes be of use to them in this critical time. We found the less difficulty therein because the officers of these ships have taken the oath of loyalty to the Company, and we have therefore resolved on the 10th of this month to have a set thereof handed over to the skipper of the ship Dordrecht, upon properly signed receipts, and not to hand them over to him until he should already be on board to sail away; for the ship the Maria we shall do so in the same manner. 488. The chartered ship De vlugge Trekvogel, which according to our respectful letter of the 29th of December was sent back to Gale, and arrived there on the 27th of the said month and was unloaded of its remaining cargo, we have ordered thither, and it is thus the bearer of this. We have written to the servants at Gale to ship therein as much coir as they might have on hand, and regarding this, as well as concerning the provisions that might have been supplied thereto, we refer to the report that the said servants will have the honor to make thereof to your Right Excellencies. Regarding the cargo of the ship De Pollux delivered at Gale, the servants disposed thereof by their resolution of the 29th of December last, which is transmitted in copy among the enclosures of this letter, and we have approved this resolution, to which no exception can be taken, by our resolution of the 2nd of this month. The findings on the delivered cargo of the ship De vlugge Trekvogel are inserted in our resolution of the 18th of this month, which accompanies this in extract, and to which we take the liberty humbly to refer. We must nevertheless note therefrom that the 6 large mirrors received therewith were found damaged and even two of them broken, that instead of 1 small case No. 23 with 100 lb of vermilion, there was delivered a small barrel No. 23 with 50 lb of vermilion; and that 6 barrels of beer, 2 half-aams of olive oil, and 1 half-aam of linseed oil were delivered empty. As the matters that are now in dispute are of too extensive a nature to have a prospect of being able to settle them before this year's season for the fishery passes, and fittingly another year's advantage would also be lost, I have taken the liberty to recommend to His Serenity, as I also do to Your Honour, that Sir Fort St. George, 27 January 1787. In the treaty that I signed with him, properly speaking, nothing else was done than to regulate the portions of the Nabob in the produce of the pearl fishery at Tutukorijn on a much more advantageous footing than it was previously, and in the friendly agreement (convention amicale) absolutely no mention is made of anything except that which relates to the pearl fishery at Mannaar. Furthermore, in the aforementioned treaty it was declared on both sides that everything should remain as it was before, as I also pointed out to the Nabob in my letter, of which I send you herewith a copy with its translation into English. What is subsequently stated in the aforementioned treaty concerning the Parruas; the exclusive right of the Company in the cloth trade; that which shall be observed regarding the merchants of the Company, their servants and subordinates, and free trade in general; as well as what is stated regarding the Chankos fishers, is merely a consequence of this general declaration and has only been added to demonstrate more clearly wherein, among other things, the rights and privileges of the Company consist. The Nabob has declared and still declares that he has no other desire than that these ancient rights and customs be observed on both sides and that everything remain on the old footing. Our Company asks for nothing else, it desires no novelties; it remains therefore to be known whether the rights and privileges of the Company made known in the treaty, as well as those which it possesses besides, although they are not named in the treaty, belong to it. No one who knows our possessions on the coast of Madura can call this into doubt; the Nabob himself, or at least those members who have been appointed by him on the coast of Madura, cannot be ignorant of it. In the pearl fishery that was held about 20 years ago at Manaar with 180 tonies, it was agreed that the Nabob would add 30 tonies on his account, which, together with the Company's tonies, makes 210 tonies, of which the Nabob's 30 tonies therefore constituted one-seventh part. In the treaty that I signed with Mr. Diodati, it was established that this proportion would serve as a guideline in all fisheries that would be held henceforth. Thus, you see that in this, too, nothing is to be found that does not conform to previously established custom, except that it was left to the Nabob's choice to accept in cash a one-sixth part of the net proceeds of the fishery lease, if he so preferred instead of sending a number of tonies that would constitute one-seventh part of all the tonies used for the fishery (his own included). If that happens, it is true that the harm will not be very great, since all the local people who attended the inspection of the banks, except those who were sent on behalf of the Nabob, declared that in their opinion it would only be better if the fishery were delayed for another year. Meanwhile, these kinds of troubles can only be very disagreeable when preparations have already begun for a settled matter. If, after the latest advices I received from Tutucorin, anything further should occur that is good for you to know, Sir, Mr. Mekern will take the liberty of informing you of it, and if he finds from the further orders of the Nabob to his Regent that matters can still be settled, he will do what may depend on him so that the fishery may still take place this season. The custom of all times was that when the Company thought it proper to have the pearl banks on the Coast of Madura inspected, the Chief of Tutucorin informed the Regent of the Nabob thereof so that he might send a thoney to attend it. This time, in consequence of what was arranged with Mr. Dodt, it was agreed that the Nabob, in consideration of half the profit having been ceded to him, would send, instead of one thoney, several to carry out the inspection of the banks jointly with the Company's thoneys. As for the pearl banks off Mannar, the Company, as is natural, has always had them inspected whenever it deemed it necessary, without informing anyone, and consequently without the participation of the Nabob or anyone whosoever. In the last fisheries that took place in the years 1766, 1767, and 1768, the inspection was likewise carried out solely with the Company's thoneys without the Nabob having anything to do with it. That was done likewise in the late part of the year 1785. In the second inspection that I caused to be made in the spring, it is true that some thoneys of the Nabob presented themselves and claimed to be admitted to the re-inspection of those banks which took place at that time, but it is also true that the coming of these thoneys was merely a consequence of the misconduct that the Nabob's people sometimes take the liberty of committing, and had I known it more in time, I would certainly have had the authors arrested to send them to the Nabob, so that he might punish them as they deserved. There is no one, even among the Nabob's people who know what the banks of Mannar are, who would maintain to you, Sir, the contrary of what I have just put forward, if you threaten them with your displeasure should they presume to deceive you.
