270 28th March A surety delivered to the Head Administrator. Resumption of a formal requisition of Batavia for 1787 and to pass some resolutions themselves. The surety posted for the Sea Captain and Master of Equipage Fredriks to the amount of Sicca Rupees 1600:-:- having been produced and examined, it was agreed to note the same, as well as the handover of that document to the Honorable Head Administrator. Finally, the Lord Director submitted and thereupon resumed the outgoing Formal Requisition of Batavia for the year 1787, of which it was agreed to keep a record, as well as of the approval of the ordinary resolutions of 2nd and 13th March, also the separate ones of 10th and 24th January last. Subsequently, the Lord Director produced a letter written to this council by Mr. Solomon Hamilton, Advocate in Calcutta, containing a narrative of the fraud committed against him and his principal Mr. Edward Tiretta by the natives Ramkanto Mitter and Goluksjend Mitter, both natives of this colony, with two of the Company's bonds from those which were provisionally issued to the merchants upon the contract then made in the year 1785, with the request that the persons and property of the said natives may be secured until such time as they shall have made full satisfaction in this regard, for the attainment of which attorneys here in Chinsurah have been appointed by him, Hamilton, as appears more fully from the letter itself, which, with its translation, is inserted here. I beg leave to represent to your Honourable Board a circumstance in which two persons named Ramkanto Mitter and Golluckchund Mitter, who reside within your settlement, have practised great deceit and injustice towards me and Mr Edward Tiretta of this Town, and little less towards your Honourable Board. The case to which I allude is briefly this: while Golluckchund Mitter was in the service of Mr Tiretta in the capacity of banyan, he gave cause to Mr Tiretta to bring an action against him in our Court of Justice to recover divers sums of money which he had improperly entered into his accounts and taken from Mr Tiretta's cash. In this action Mr Tiretta obtained a judgment in his favour upon the clearest evidence for many thousand rupees, and Golluckchund was committed to our public gaol, there to remain in custody without bail until it, together with the costs of suit, were paid. While this man was thus in custody under execution of the judgment, Ramkanto Mitter came to Mr Tiretta and me, representing himself to be the uncle of Golluckchund Mitter and a man of considerable property who held posts of great trust under the members of your Honourable Board individually, and particularly under the late President, and that Golluckchund had considerable property in your settlement of Houghly which, by reason of his imprisonment, was daily going to ruin. He therefore solicited us to release him from prison, as he was ready and willing and offered to join with and alongside Golluckchund in giving such security as we might deem necessary or require, while presenting certain instruments bearing the seal of your Honourable Company and the signatures of the members of your Honourable Board, which he called Dutch East India Company's bonds payable to him or his order. These bonds he proposed to deposit with us as a collateral security for the faithful discharge of Golluckchund's debt, with power for us to present the same for payment and receive the amount thereof from your Honourable Board in case they made default in discharging such debt by the time agreed upon. Under such terms of security, neither I nor Mr Tiretta hesitated an instant to accede to his solicitations.

to receive, in case they should remain in default of discharging their debt at the appointed time. Upon all such conditions and security, neither I nor Mr. Tiretta hesitated for a moment to grant his solicitations, and pursuant thereto, a bond was prepared for us whereby Golukchund Mitter and Ramkanto Mitter bound themselves to Mr. Tiretta for the amount due to him by virtue of the aforesaid judgment, under special submission, in case of non-fulfillment thereof, to the judicature of your courts of justice, as well as another bond in like manner as the former in my favor, for the costs of suit incurred in the matter of Golukchund, both of them being provided with endorsements showing that bonds of your Honorable Company had been left in pledge as collateral security, to be received by us in case they should remain neglectful in the payment of the aforesaid bonds. These bonds were executed by Ramkanto Mitter, and he thereupon obtained an order from me to the Sheriff of Calcutta to discharge Golukchund from his imprisonment, as Ramkanto promised me to bring Golukchund to me immediately upon his release in order also to execute the bonds. Golukchund obtained his freedom, but from that time until today I have seen neither of them; they departed immediately for Chinsura, and there they remain, having such securities in hands as I thought I had, I judged the signing or not signing of the bonds by Golukchund to be of little importance, and sent the bonds toward the due date, together with the documents that had been given in pledge as collateral security, to Mr. van den Broeck at Chinsura, with the request that he would be so good as to ask those people for payment, and in default thereof, to present those instruments for payment and receive the amount thereof from your treasury; the reply of Mr. van den Broeck to this request, whereby the fraudulent deception which these people practiced upon Mr. Tiretta and me is unfolded, surprised me not a little, the instruments that had been passed to us as bonds of your Honorable Board being nothing other, as he said, than contracts which, never having been fulfilled by Ramkanto Mitter, gave them no right to the receipt of the sums specified therein. After resumption of which, the Honorable Director communicated that the said Goluckchund Mitter has already been under arrest in the lodge for some time, but that he had attempted to prove by a submitted petition and a contract annexed thereto that he has transferred all his goods to his uncle Ramkanto Mitter on the condition that the latter would take over and pay his debts, and that consequently not he, but the said Ramkanto Mitter, was liable for the satisfaction of his debt to Messrs. Seretta and Hamelton, against which, however, the latter in turn claimed to be in no way obligated, for which reasons he, the 280. Resolution to arrest the other one as well and to demand of the village magistrate the investigation of this matter. Honorable Director, deemed it necessary that an inquiry should be made into how far the claim of Goluckchund Mitter regarding the contract entered into with his uncle is consistent with the truth, and in case it actually took place, whether such is compatible with the customs and usages of the natives, in order to be able to distinguish the actual debtor, or rather the one responsible for the satisfaction of this debt, and to compel him to pay it off, as the credit of the Company, in whose name and papers transactions were carried out in an unauthorized manner in this matter, might suffer significant injury if one did not try to provide all possible satisfaction to the foreigners involved herein; all of which being likewise understood by the council, it has been, upon the proposal of the Honorable Director, approved and resolved to provisionally arrest the aforementioned Ramkanto Mitter as well in the lodge, and to demand of the village magistrate the investigation 221. Two curators appointed for the estate of the late Herklots. of this matter. Furthermore, a petition was read from Christina Gerardina Cloppenburgh, widow of the late senior merchant, second in command of the Directorate and chief of Kassembazaar, Gregorius Herklots, stating for the reasons cited therein, she requests that this assembly may be pleased to appoint curators in order to accept, clear, and settle the estate left by her late husband, under benefit of inventory, or in such other manner as shall be deemed necessary, as said petition further shows. That she, petitioner, is not able to clear her estate or to determine how matters stand with the condition of the deceased's inheritance, because no formal books or notes of importance have been found by which she could be guided. That she, petitioner, thus finds herself in a very lamentable condition and absolutely does not know how to help herself out of it other than with the assistance of two or more accredited members who may support her, petitioner, with counsel and action. 208 17 April Points of Reply to Kassembazaar Certain errors committed in the books of that trading post having been rectified, it is understood and agreed to note as follows: By the marginal disposition upon the report of the completed examination of the Directorate Journal for the year 1785/6, inserted in the Resolution of the 2nd of the past month of March, the commanding second at Kassembazaar was ordered to specify in detail and demonstrate the origin of the errors discovered in the books of that trading post, which could not be verified here, in order to dispose further upon the arrival of that statement as should be found proper. In fulfillment whereof, the said second, by letter of the 8th of that month, also gave several reasons for these errors, which, however, according to the minute resolution of the 13th following, were very deficient 306 and proved nothing, as was written to him under the 20th of the same month with the recommendation to examine these entries with greater accuracy, and still to let the desired elucidation reach this administration. Upon the declaration of the said Honourable Chief Administrator that the cash and expense accounts for the months of January and February, received along with the third or last letter of the 26th March, have been found in order upon examination and recalculation, it is understood to approve and pass the same, as well as to note that received alongside the said missive sent over by the servants is the settlement with the linen supplier, with notification that he has properly accounted for his balance amounting to Sicca rupees 2053: 7 1/15 in the treasury under the 15th February last. In answer thereto we have the pleasure to acquaint you that we shall make out two separate drafts according to your request on the Honourable the Director and Council at Chinsura to be granted directly after the arrival of our ships which we expected the month of August and September. It was made known by the Lord Director that he had primarily convened the meeting to communicate to the same the misfortunes which the ship Rotterdams Welvaaren has encountered, because of which that vessel has possibly not been able to put out to sea up to now; reading aloud to that end several letters received concerning this, which, in order to make the narrative coherent, insofar as they relate to this, are to be inserted herewith, and of which the first is from the Captain of that vessel, Gijsbertus Matthias Weitzel, who, having previously departed for on board, wrote under the 4th of this month in the following manner: Right 310 24th April Right Honourable and Respected Sir. Inquiry that he shall have made upon the return of the sloop: Whereby the failure of the enterprise to provide the ship with an anchor is mainly attributed to the unwillingness of the crew of the sloop, who refused to contribute their share to bring the same on board, which His Honorable Worship judged should not pass unnoticed, wherefore he declared his intention to have an inquiry made into this upon the return of the sloop, in order, if necessary, to have the guilty punished for this and to deter others in similar cases from refusing their help and assistance, even when requested by strangers. Preference and Priority in Insolvent Estates, namely with regard to the claims and demands of Native Creditors, or rather the Banyans or business agents of such persons who happen to die insolvent, which, on account of the manner in which they were instituted, were considered as nothing other than Concurrent, whereas these debts, however, mostly originate from advances that the Banyans, as cashiers and financiers of their respective masters, generally make, both for the promotion of trade and for the settlement of all household expenses, such as paying the baker, butcher, butter and milk farmers, tailors, and suppliers of cloth for clothing, furthermore everything included under the heading of house expenses, among which are beverages, provisions, house rent, servants' wages, and the like; upon which the seller or supplier, if able to demonstrate in person not having been paid, would undeniably have and enjoy the right of preference. Wherefore Their Honours are of the opinion that, regarding the judicial preference and priority, an arrangement ought to be made, somewhat more, or specifically to accommodate such people, as otherwise, like the Banyans, brought to poverty by their good-natured readiness and obligingness, as is already the case with many, they are plunged into the utmost contempt, not without having a grievous influence on the management of the Company's affairs, the Banyans having generally been prominent and wealthy merchants with whom such important points as relate to trade here in this country were directed and carried out, whereas nowadays one hears nothing but complaints about a general decline, lack of means, and consequently of credit to undertake any important business and to continue or advance it as before, with such further reasons to urge this opinion of Their Honours as that petition further demonstrates, at the conclusion of which this assembly was requested, in case of approval, to issue a proclamation whereby, on the one hand, it is distinctly stipulated and enacted which expenditures by the Banyans shall henceforth be preferential, and in what degrees, and on the other hand made known how this accommodation, serving only as a judicial safeguard against loss and for the revival of credit, shall not extend to legitimizing an unlimited and indiscreet crediting of the Company's servants and subordinates to the prejudice of other lawful creditors, nor that, by this precautionary law, the Company could in any manner whatsoever become involved in answering for or compensating debts incurred by the Company's servants and others of whatever nature, but that, on the contrary, to prevent such a misunderstanding, the proclamation issued in the year 1734 against the lending of money and the granting of credit shall also remain in force and be renewed, as can all be seen in more detail in the minute itself, which is inserted here.
