first deducted and credited to the agio account as a profit of pagodas 12:12:40, and thus no more is actually disbursed for the pagodas calculated on Ceylon than pagodas 157:6, which with 8 percent agio make 169:20 new Nagapatnam pagodas, which corresponds closely to the 169:10:40 new Nagapatnam pagodas stated on Extract Nos. 1 and 2, which difference of 1½ fanams is to be regarded as a calculation error. Thus, in Colombo they are under the mistaken impression that the payment in Nagapatnam of the aforementioned 150 pagodas takes place with 162 new Nagapatnam pagodas, whereas the contrary was just now demonstrated most clearly, these additional 12 pagodas constituting precisely the 8 percent that is taken as a profit to the credit of the agio account. And concerning this we are further obliged, for the elucidation of Your High Nobilities, to note that in the report already rendered to Your High Nobilities on 30 July regarding this Ceylon bill of exchange account, it was poorly expressed, as it conceded what was stated in the Colombo letter of 27 December 1776, namely that he who pays 180 ducatoons on Ceylon receives back in Nagapatnam 150 old pagodas or 162 new pagodas. The aforementioned manner of payment of the bills of exchange drawn from Ceylon on Nagapatnam we already find in a Nagapatnam resolution of 16 December 1769, which was subsequently submitted to Your High Nobilities for approval in a letter of 14 October following, decided in the following manner: to pay the assignments drawn from Ceylon in such a way as was done before the introduction of Netherlands currency, namely reducing their amount in guilders to 96 stivers per pagoda, the resulting number of pagodas which were old being paid in as many new ones without adding the 8 percent agio, and taking the aforementioned agio to the credit of the Honorable Company into the exchange account, in which case the remitters, according to a further demonstration provided thereof, still enjoy a small profit of a generous 2¾ percent. Your High Nobilities were pleased to approve this proposal by letter of 14 July 1770, and the same has since remained in use at Nagapatnam, so that the 180 ducatoons or 300 rixdollars paid in Colombo are in no way settled in Nagapatnam with 150 old, but indeed with 150 new Nagapatnam pagodas, which, brought over to Colombo, are worth there to the Company at 10 3/8 Indian stivers 184 19/16 ducatoons or 308 1/16 rixdollars, thus the remitter has solely a profit of rixdollars 8 1/16 or 2¾ percent, as cited in the above-mentioned Nagapatnam letter, but by no means rixdollars 39:26 or a scarce 11 percent, as is assumed on Ceylon regarding the receipt of 162 new Nagapatnam pagodas or rixdollars 339:26 for the paid rixdollars 306 on principal and agio, on these grounds, especially because Your High Nobilities in the aforementioned letter to Coromandel of 14 July 1770 acknowledged the profit of 2¾ percent, we deem it unnecessary that the bills of exchange should be drawn up in a different form than the models show, of which a copy is enclosed herewith under No. 4. We are even of the opinion that no change in the model bills of exchange needs to take place, even if Your High Nobilities might one day deem it proper to order the Ceylon ministers, when accepting money on bills of exchange to Nagapatnam, instead of the 2 percent agio that... ...places where silver money is the standard currency, or places where the pagoda has been adopted as the standard currency, we are still of the opinion that the forwarded models cannot be followed without prejudice to the Company. We therefore find ourselves obliged to bring our difficulties in this matter once again to the attention of Your High Nobilities. Merchandise item Import Reijnier De Klerk, Governor General, and the Councilors on behalf of the State of the United Netherlands and the General Dutch East India Company in the Indies, send greetings to all who shall see or hear this read, to wit: Whereas we notice from time to time how certain residents of this capital and other Company dependents arriving from abroad repeatedly wear clothes of cloths or fabrics that, to all outward appearances, were not woven in the United Netherlands, and well-founded reason is thereby given to us to assume that some self-interested persons, regardless of the prohibition in force against the import and sale of all kinds of European woolen manufactures that are not manufactured in the United Netherlands and its jurisdiction, all too often undertake to provide themselves clandestinely with foreign manufactures, and subsequently to retail and dispose of them again among the good community to the no small disadvantage and noticeable prejudice of the traders in our own fatherland; So it is that we, wishing to provide against this, and having considered not only that one of the foremost duties of a blessed colony ought mainly to consist in the pursuit of the general utility and benefit of the land from which it took its origin, and to cooperate according to its capacity to cause the inhabitants thereof to increase in prosperity through permitted channels, but also that, in order to fulfill that obligation, the devising of suitable means for procuring a large and growing sale of manufactures and other goods made in the United Netherlands and under its jurisdiction ought to be held among the least of the objects of the attention of the high government of these lands, while for the attainment of this purpose in all these regions, an effective resistance to the importation and sale by foreigners can be of service; Have this day in the Council of the Indies resolved and determined to prevent, in the most efficacious manner, the clandestine import and sale of foreign manufactures, or rather such as are not brought from the Netherlands with Company ships, in all the establishments of the Company in the Indies, and consequently, with renewal of the interdict by edict of March 29, 1754, to enact and command, as is enacted and commanded hereby: Firstly, that from now on, whether here or elsewhere in any places under the authority and obedience of the Dutch East India Company, it shall not be permitted to import or sell any kinds of woolen manufactures, whatsoever they may be called or from wherever they might come, that are manufactured outside the aforementioned provinces and the territory of the Generality. Secondly, that, with the exception of the silk fabrics brought by Company ships directly from Bengal, Japan, and China, or brought from the last-mentioned empire with the junks destined hither and the Macanese traders arriving here annually for trade, likewise, neither in the capital nor in any of the respective outer factories, shall it be permitted to import or dispose of gold or silver lace, buttons, hats, saddles, harnesses, iron, steel, shoes, boots, beers, wines, brandy, or other drinks that have not been transported with Company ships from Dutch ports; all upon confiscation of the imported, sold, or purchased goods, and four times the value thereof in addition, to be forfeited by the person who shall be found to have violated this prohibition, to be divided one half for the Company and the other half for the officer who shall make the seizure, provided the same shall be bound to satisfy the informant sufficiently and according to reasonableness. And in order that what is written above may be countered and prevented with earnestness and vigor, we strictly command the shahbandar and license master, and the subordinate attendants of the harbor boom, to keep and cause to be kept a strict watch over all foreign or suspect vessels, as well as to inspect them strictly; Further enjoining and commanding the respective courts of justice along with their officers, and all other magistrates whom this might in any way concern, both here in the capital and in the outer factories, to execute the same strictly according to its contents and cause it to be executed, proceeding and causing proceedings to be taken against the violators of this our prohibition, without any connivance or deviation, as we have found such to be proper in that manner. Foreign nations and ships And to the end that everyone may guard against harm, and no one may be able to pretend any ignorance hereof, we further command that this shall be published everywhere throughout all the Indies, at the establishments of the Dutch Company, and posted not only in the Dutch language but also in the customary local languages, at the places where it is customary to make publications and notices. as well as in the rescription to request once more with serious and respectful urgency to leave the point of the bills of exchange on the old footing, with the dutiful notice that use will be made this year of the permission to accept thirty tons of gold on bills of exchange if that amount is offered, but that one will nevertheless not be rescued thereby to the required extent, and therefore repeatedly to implore that a prompt and complete satisfaction may be obtained of the thirty-eight and sixty tons of treasure respectively requested as most urgently needed in the demands for 1779 and 1780. However, in order nonetheless not to leave the matter entirely unaddressed contrary to the absolute desire of the Lords Majores, and since it is now observed that their Noble High Mightinesses have converted their provisional order in the respected missive of 17 October 170 suited to the condition of that time into an explicit command to fix the reimbursement of the ducaton at seventy stuivers, it is—lest it might sometimes happen, contrary to the fair trust of this government, that the Lords Majores should not be pleased to condescend to the aforesaid request to accept the ducaton at seventy-two stuivers—approved and understood to have the bills of exchange drawn up twofold, namely with the extension of the reimbursement to seventy-two and to seventy stuivers per ducaton, with the addition of the express condition and obligation of the counters or receivers to have to content themselves with the receipt of seventy stuivers for the ducaton or the latter extended sum on the bill of exchange in case it does not please the Lords Majores to resolve upon disbursement at seventy-two stuivers, and thus to leave it to their Noble High Mightinesses' free and generous disposition to cast a favorable reflection upon this alternative arrangement, in the hope that their Highnesses will in all events be pleased to regard this middle course, however unusual, as the only expedient that this government has been able to devise in order, on the one hand, to defer with dutiful obedience and respect to the orders of their Noble High Mightinesses, and on the other hand to defend as far as in them lies a resolution which is believed to have been taken on lawful grounds. The Ordinary Councillor Vos having declared to be of the opinion that the order of the Lords Majores must be followed literally. While the Extraordinary Councillor Caan declared to the contrary that, although his Honor at the session of 7 July 1778 had been of the opinion that the actual execution of their Noble High Mightinesses' instruction to calculate the ducaton at seventy stuivers ought not to be suspended, his Honor nevertheless fully conformed with the opinion of the Governor General and the other member gentlemen to arrange the bill of exchange twofold in the manner aforesaid and to leave the disbursement of the ducaton, whether at 72 or 70 stuivers, to the pleasure of the Lords Majores, of which, at the request of both their Honors, this note is made. And concerning this matter it has further been resolved not only to give notice to the Ceylon and Bengal ministers of the above-mentioned permission and granted freedom of the Lords Majores to draw annually three and one ton on the aforesaid footing, but also to the ministers in Coromandel, Malabar and Surat by sending an extract from their Noble High Mightinesses' missive, that if they should at any time find themselves in the necessity of borrowing funds on behalf of the Company and remitting them by bill of exchange to the Netherlands, they must therein regulate the value of the reimbursement to be made of the specie accepted on the bill of exchange according to the stipulation with respect to Ceylon, as well as observe the same distribution regarding the time of payment as is done at this capital. With relation to the order of the Lords Majores [illegible] the skippers of the ships Held Woltemade and Ritthem, Hendrik Elders Junior and Cornelis Cornelisz, regarding whom their Noble High Mightinesses had been informed that, contrary to the articles of war and the instructions for the principal commanders on the Company's ships, they had fired several needless shots in the roadstead of Cowes, which was taken very amiss by the English, alongside the other officers who might have given orders or consent for the firing of the shots, in case they were still in the Indies, to cause them to be disciplined according to their deserts in the aforesaid matter, it has been approved and understood to reply that skipper Hendrik Elders Junior with the ship Groenendaal and skipper Cornelis Cornelisz with the ship Ritthem had both returned to the Netherlands before the receipt of their Noble High Mightinesses' missive, and that on that account the orders with respect to them could not be carried into execution. High Noble, Right Honorable Lord and Honorable Lords, In compliance with an extract from the minutes of what was resolved in the Council of the Indies on April 8 of last year, tending toward Your High Excellency desiring our report concerning the three model amendments recently sent hither from Ceylon, as appears from the Ministers' dispatch of January 25 of this year, concerning the mints in that colony, which would best correspond with the intention of the Lords and Masters; having let our thoughts dwell on this, we shall first see what the Lords and Masters, by their letter of October 30, 1776, dated at Middelburg, note thereanent: "To this end we must further insist on a distinct and precise arrangement of the mint yields, so that among other things the amount in money of the gold and other materials used for the minting of the specie may clearly appear." Not intending to enter into details, we merely state that, to remove all objections for the future, after mature deliberation, it has been approved and determined by us to decree: Firstly: 231. 227 1863 Firstly, that no one who has been appointed Executor of an estate shall be allowed to be discharged therefrom at his request, except by Your Honors, after first obtaining thereupon, if deemed proper, the report of the Court of Justice or of the Aldermen, according to how the case in hand shall be disposed. That such Executor having been discharged from the administration conferred upon him, Your Honors, in case no further Executors have been appointed by testament, shall have to confer that administration upon the Curator ad lites or upon the Orphan Chamber, according to whether the aforesaid estate, had no Executor been appointed, would have devolved upon the one or the other. Which order Your Honors shall have to follow strictly in assigning estates, unless you judge that the Company's interest requires departing from it, as occurred in the case of the deceased Commander of Sumatra's West Coast K. Palm; of which cases Your Honors shall then have to report to us the reasons that moved you thereto. Secondly, that whenever it might be doubtful whether the administration could indeed be entrusted to the appointed Executors, the Court of Justice or the Board of Aldermen shall then have to give notice thereof to Your Honors, in order that Your Honors might decide according to the findings of the matter, with the understanding, however, that in the assignment 232. of the Estates either to the Curator ad lites or to the Orphan Chamber, the order established hereinbefore in case of requested discharge must be followed. And hereby are also altered all previous dispositions whereby in the aforesaid case the power was given to the Court of Justice and Aldermen to discharge from the administration such Executors as are deemed unfit for it. Thirdly, that whenever the Executors were prevented, either by death or by absence, from accepting the administration or from requesting their discharge, the Court of Justice or the Board of Aldermen shall in that case likewise have to give notice thereof to Your Honors, in order to be able to dispose of the matter on the footing mentioned hereinbefore. And as by this arrangement there will probably in future come under the management of the orphan masters estates which do not immediately devolve upon them by virtue of that office, we have, in order to prevent difficulties which then often arise in demanding payment of the wage accounts here in this country, ordered that the orphan masters shall be instructed, upon presenting such accounts arising from estates which have not devolved upon them as orphan masters, to exhibit at the same time proper proof of their capacity, and to ensure as much as possible that the documents 233. 229. 1864 Letters and Papers upon which payment is requested are in such order that the disbursement of the demanded funds can be made thereon with confidence. 4 Servants item Linens item Import Offices, it has been approved to issue a circular regarding improvements so that, as long as the extraordinary shortage of men continues, the wages of the common soldiers shall be raised to ƒ 16 and those of the corporals to ƒ 18 per month. Notice. Whereas it has come to the attention of the High Government of these lands that, notwithstanding the interdict in the ninth article of the short extracts concerning the free navigation to the west of India, namely, that the ships and vessels belonging to the servants, Burghers, and other subordinates of the Company shall not be permitted to sail for foreigners, nor transport goods for the same on freight, or the owners or shipowners make them participate therein in any way, nevertheless, the fourth article of the extracts, permitting the masters of such ships and vessels from the main Offices of the Company's possessions to the west of India among others also to head towards foreign establishments, is not well understood or is improperly interpreted, and private traders presume to deduce therefrom that they are at liberty to transport linens manufactured at offices of foreign Europeans to this capital and to import them here, it is therefore, to remove the misconception in this matter and further to declare the intent of the aforementioned ninth article, approved in the Council of India on the 24th of this current month of September, to interdict the bringing and import here to the capital of all western linens, by whatever name called, which were not woven within the jurisdiction of the Company's possessions, or were purchased at offices of foreigners, to all and everyone, whether for themselves or for others on freight or on commission, as the same is hereby interdicted, under penalty of confiscation and forfeiture in addition of four times the value, half for the Company and the other half for the seizing officer. Charging and commanding therefore, hereby, most emphatically, the respective officers of Justice, the Shahbandar, and the farmer of the Import and Export Duties here, to watch with the required exactitude against the clandestine unloading of foreign linens. And to the end that no one may pretend ignorance hereof, this notice shall be published and affixed in the usual places, both here and at the Offices to the west of India. We therefore recommend that the secretarial clerks of the papers henceforth pay more attention to this, and take care for a prompter dispatch of the Coromandel papers that are sent over via Ceylon. Right Honourable, Highly Esteemed, High-Commanding Sir! In compliance with your Right Honourable order to report the nature and condition of the native timber that could serve or be used in strength and durability for spars and masts for ships, the undersigned has the high honour herewith to show that gorgas and kienagas woods are counted among the heaviest timbers delivered here, on account of the plentiful moisture these woods contain, which serves as a heavy burden for the ships in rough weather when they work heavily. To this is added that these timbers are very poor in strength and durability, wherefore the undersigned judges that they ought not to be used otherwise than in times of scarcity of domestic timber. And regarding the statement of the master craftsman at Gale, Jan Vogelsang, in his report, that in making fore- and mainmasts for ships of 140 to 150 feet, which often must be assembled and joined together out of several pieces, one half could be made with domestic and the other half with gorgas, or indeed kingas, the undersigned is of the opinion that joining the common gorgas or kinagat to domestic wood, which is more durable, is a waste of the domestic timber. For when such a mast becomes unserviceable and the native wood decays and rots away, the domestic wood that is still good can be employed or used for few purposes on account of the bolt holes and nails in it, which will then result in greater damage to the Honourable Company.
