839: The 25 June 1789 Paragraph 6. The petitions of the losing parties before the Landraad of Gale and Mature must be addressed to the Commander at Gale, and the cases decided before these two bodies must be pursued in appeal before the Court of Justice at Gale. Paragraph 7. The petitions of those who have lost their lawsuit before the Landraad of Trinkonomale must be addressed to the Chief there, and the cases decided by said body must come in appeal before the Court of Justice at Trinkonomale. Paragraph 8. The Presidents of the Landraad must therefore send the petitions presented to them by the losing parties, together with the records of the trial, to the commander to whom they are addressed, except those of Silau, which must be sent by the President of the Landraad there to the Honourable Colombo Dessave, who will have to deliver them in person to the Governor, as well as the petitions wherein relief is requested from the interlocutory orders of the Colombo Landraad. Paragraph 9. When sending the aforesaid petition and documents, a report of the Landraad containing their considerations on the merits of the petition must be attached thereto. Paragraph 10. The Commanders of Jaffnapatnam and Gale, and the Chief of Trinkonomale, must bring the petitions addressed to them, along with the documents, for deliberation by the Political Council, as to whether or not the requested relief ought to be granted. Paragraph 11. The decision of the Council must be set down by way of an apostil at the head of the petition, which must subsequently, with the documents, 840 The 25 June 1789. must be sent back to the President of the Landraad from whom it was received. Paragraph 12. If the requested relief is denied, the President must give notice thereof to the parties, with permission to the prevailing party to proceed with the execution of the Landraad judgment. Paragraph 13. The relief having been granted, notice thereof must likewise be given to the parties, and subsequently the apostilled petition, with all the records of the trial, under a proper register, must be sent by the Landraad by requisition letters to the Court of Justice before which the case in appeal must be pursued. Paragraph 14. The Court of Justice must, without summoning the parties or admitting any further papers, review the received documents in accordance with the resolution of the 8 June 1773. Paragraph 15. If it is found that these documents are clear, and the case requires no further investigation in order to pronounce judgment upon it, the Court of Justice must immediately render justice upon the documents served before the Landraad, and thus approve or alter the judgment of the Landraad, as their Worships shall deem in good justice to be proper. Paragraph 16. But if the Court of Justice judges that the documents are not entirely complete, or that the parties, either the appellant or the appellee, could still bring forward something in their defense, their Worships must then issue an interlocutory order, pointing out what the parties shall still have to prove. Paragraph 17. Against these further proofs, the party against whom they are produced may submit cross-interrogatories or other proofs, and 841 The 25 June 1789. proceedings shall subsequently continue therein according to customary practice. Paragraph 18. Nevertheless, all Courts of Justice under this government are recommended to have everything handled and settled as summarily and as inexpensively as can possibly be done. Of the Secretaries Paragraph 1. The Secretary of the Landraad must keep a precise record of all cases brought before the said body and of the pleadings held concerning them, provided with the decisions or sentences of the Council. Paragraph 2. He must keep protocols of all letters, bonds, and other instruments passed before the Landraad, so that interested parties can always have recourse to them. Paragraph 3. He must keep a separate book of all orders issued by the government to the Landraad. Paragraph 4. He must promptly assist the people who desire any orders or other papers from him, so that they suffer no damage through his fault. Paragraph 5. The Secretary must attend to the collection of all fines imposed by the Landraad or the commissioned members, and he may disburse nothing from them except upon signed warrants from the President. Paragraph 6. Once every six months, the Secretary must draw up an account of the fine moneys received and disbursed, and this account must be collated against the rolls and warrants by commissioned members, and signed as approved. Paragraph 7. Likewise, he shall draw up an account once every six months of the lords' dues on real estate for which title deeds were passed before the Landraad, and submit it to commissioned members to be collated against the protocols and signed as approved.

Regarding the stamped paper, it has also been resolved, subject to Their High Excellencies' honored approval, to exempt the Sinhalese and Malabars litigating before the landraad from the use of stamps, in so far as the summonses are concerned, in order not to make the way too difficult for those poor people to obtain proper justice, as the manifold legal costs would otherwise only deter them from applying to the aforementioned landraad, and this on the other hand would give some of the well-to-do Natives ground to disadvantage and oppress the poor. Extract of the Resolution taken in the Council of Ceylon. 113 6 843 The 25th of June 1789 § 13. Before entering upon their office, the secretaries must take the oath according to the formula drawn up for that purpose. § 14. The secretaries must also provide security for the proper administration and accounting of the moneys entrusted to their care as stated above. § 15. Annually, just like the president and members, the secretaries shall have to take the customary oath of purgation, according to the formula existing for that purpose. Of the Messengers and Interpreters. § 1. The duty of the interpreters is to interpret faithfully whatever the parties say orally, or to translate all writings that shall be given to them for that purpose by the president or secretary. § 2. For that purpose, he shall have to be present not only at the sessions of commissioned members, but also whenever there is a meeting of the landraad. § 3. He shall also, if necessary, have to attend all executions and sales. § 4. The duty of the messenger is to serve all summonses, arrests, executions, and other legal notices, in so far as this has not been assigned to the village headmen here before. § 5. He shall likewise have to be present as a bailiff at the sessions of commissioned members and at the meeting of the Landraad. § 6. He must carry out all executions, and act as auctioneer at the sales, as well as collect the auction moneys and salaries. § 7. The messengers and interpreters shall not take any presents, gifts, or favors from the people who have a lawsuit before the Landraad or are about to have one, 844 The 25th of June 1789 nor demand any greater salary from them than what has been allocated to them. § 8. They shall be obliged, as often as the Landraad imposes it upon them, to purge themselves thereof by oath. § 9. Upon entering upon their duties, they must take the oath according to the formula drawn up for that purpose. § 10. The messengers shall have to provide sufficient security for the proper accounting of the moneys that they must collect as stated here before. Of the Salaries. § 1. The secretaries shall, for drawing up the papers and for providing copies, enjoy their salary as indicated below. § 2. In cases amounting to up to One hundred fifty rixdollars in money, they may, according to the allocation by the resolution of the 19th of August 1774, charge half of the salary that has been allocated to the secretary of the Court of Justice. § 3. But in cases amounting to more than One hundred fifty rixdollars in money, they shall have just as much salary as the secretary of Justice enjoys. § 4. In disputes over lands, four bearing coconut or jaggery trees shall be appraised at one rixdollar, and one amunam on eight parras of sowing ground at ten rixdollars, and the salary calculated accordingly. § 5. The salary of commissioned members and interpreters for attendance at executions and sales, and the salary of the messengers in serving legal notices, shall also have to be calculated as has been stated in sections 2 and 3.

845. The 25th of June 1789. Established at Trinkonomale and the Chief there appointed as President. Section 6. The secretary shall receive, for accounting for the auction moneys, four percent of the proceeds of the movable goods, and two percent of the proceeds of the immovable goods. Section 7. The messenger shall receive, for the collection of the auction moneys, one percent of the movable and one half percent of the immovable goods. Section 8. From the proceeds of the movable goods, the secretary must further withhold one rixdollar of every thousand rixdollars, and the amount thereof he will have to account for annually to the diaconate of the place. Section 9. Since by the manner of proceeding among the natives prescribed hereinbefore, the commissioned members, secretaries, messengers, and interpreters will have more to do than formerly, and will have to sit almost daily, attendance money is hereby allocated to them for the sessions. Section 10. For the first session in a case, the attendance money shall be calculated as follows: for the secretary, one rixdollar the two members, each three-quarters of a rixdollar the interpreter and messenger, one-eighth of a rixdollar Section 10. When in the same case a session must be held for the second and third time, only half as much shall be received for attendance; but for the fourth and further sessions no attendance money may be charged. And furthermore, in consequence of these arrangements, it was approved and agreed to also establish a Landraad at Trinkonomale, whereof the jurisdiction shall extend only over the three provinces Koetjaar, Kattoekolompattoe, and Tamblegam, and to appoint the Chief there as President thereof, with authorization to the officials to appoint the necessary members and secretary for the said council, and to nominate them to this Government for confirmation. Furthermore, it was approved to place once again a junior surveyor at Manaar, according to the determination in the regulation, as being very necessary in disputes over lands. Resumed three reports received from Jaffna from the Honorable Dissave Schreuder, Pay-Bookkeeper van Ebbenhorst, and Tomb-keeper Williamsz, wherein they, in compliance with the resolution of the 22nd of February last, indicating the motives that have caused them to advise the abolition of the farm of both the oeliammers and of the private slaves, mainly consisting herein, that if such a farmer strictly adheres to the issued orders that bind them to any direct execution in the country, his intervention does not appear necessary now that the number of oeliammers is better known than formerly, and that if, notwithstanding these orders, he nevertheless does so, such can greatly tend to the harassment of the inhabitants. 846. 847. The 25th of June 1789. Whereupon deliberation having been held, taking into consideration that through the introduced farming out of the aforesaid oeliammers and slaves, one is now provided with more accurate tombos of those servants, and therefore the intervention of a farmer in that regard is no longer so necessary now as at the introduction of those farms in order to guard against the frauds of the village headmen, it was approved and agreed to provisionally suspend the farm of these two articles and consequently not to allow the same to be farmed out for the coming financial year. In order nevertheless to ensure as far as possible that the oeliammers and the private slaves properly perform their obligated service to the Company, or that in default thereof the obligated service money is properly paid by them, it was furthermore approved and agreed here to write to the officials of Jaffenapatnam regarding the aforesaid oeliammers: 1. That the full number of oeliammers, according to the best and most reliable indication thereof at hand, must be entered into the books as of the first of November next, at 12 schellingen per head, for the benefit of the country's revenues. 2. That complete freedom shall be left to these people, whether they wish to work, or whether they choose to pay 12 schellingen per year for it. 3. That in order to know this, the tombo-keeper, as soon as it can be done, and in particular as timely as is necessary to have a report thereof before the end of August next, shall hand over to the Honorable Dissave proper lists of names of each church or district separately, and that the Honorable Dissave must immediately send these lists 848. 849. Continuation. to the native headmen to whose department it belongs, to ask each one individually per head which of them are inclined, in the course of the coming year, to pay the chikos moneys instead of working. 4. That the Honorable Dissave will have to employ therein all such means as he shall deem most fit to be able to be assured of the authenticity of these statements, and that in the inquiry as to who wishes to pay the aforesaid 12 schellingen, action was taken properly and according to the intention of this Government. 5. That the Honorable Dissave must cause reports to come in promptly, and as soon as they have come in, must give them to the Lord Commander, who shall hand the same over to the tombo-keeper. 6. That the Honorable Dissave will have to guarantee the incoming of the moneys of those who choose to pay the chikos moneys of 12 schellingen, while retaining his recourse against the native headmen who have made the statements, and who shall be answerable to him for that. That the thombo-keeper, to all the oeliammers who perform their obligated service at Jaffanapatnam, both on the vessels and on land, shall cause them to be issued after their completed labor, after the name shall have been filled in thereon, as well as the days worked; and in order that this may occur regularly and without errors, those under whom the oeliammers work shall send proper nominal lists, signed by them, to the thombo-keeper of the oeliammers who must have the Chikos, to the end that he may thereupon cause the oelie Chitos to be issued, and these lists the thombo-keeper shall have to submit annually alongside his account for the justification thereof. 11. That for the rest of the people who are employed in the country for this and that undertaking, of which further mention shall be made below, the oelie sittos shall have to be issued by the Honorable Dissave in the same manner as has been stated above concerning the tombo-keeper. 12. That to this end the tombo-keeper shall cause to be delivered to his Honor as many oelie settos as the Honorable Dissave requests from the batch which have been signed by the Lord Commander for each church separately and placed into his hands. 13. That the Honorable Dissave shall have to give a proper receipt to the thombo-keeper for this, and consequently be accountable for it. 14. That the thombo-keeper once every three months, beginning with P=mo September next, and thus four times a year, shall draw up a list of the heads who in the most recent three months have properly performed their oelie service, and to whom, accordingly, customary oelie Chitos have been issued by him; and he shall draw from this list a brief summary, separately for each church or district, which he shall have to hand over to the Lord Commander, who, after having examined the same, shall grant an order thereon upon the administrator, who shall thereby be instructed to credit the general account of the oeliammers entered in the books for the amount of the oeliammers mentioned therein at 12: schellingen per head, to the debit of such accounts from which this must be written off according to custom and pursuant to standing orders. 15. That likewise the Honorable Dissave shall have to draw up an identical list every three months of the oeliammers who have worked under his Honor's supervision, in order to present it in like manner to the Lord Commander, who thereupon, in the aforementioned manner, shall grant the order upon the administrator to credit the oeliams account for this, to the debit of the improvement of agriculture, of which a separate account shall be kept in the books. 16. That an extract of this account must be given each year by ult=mo aug=t to the Honorable Dissave, who shall have to append thereto a report to the Lord Commander, indicating what he has done during the course of that financial year for the improvement of agriculture, specifically for what purpose the oeliammers were employed by him and what they have accomplished; and this account and report shall subsequently have to be sent in copy to this government. 17. That the Honorable Dissave, with a proper note, shall send back the oelie sittos remaining with him after the conclusion of each financial year to the thombo-keeper, who shall again grant a receipt for them to the Honorable Dissave, to serve for his discharge. 18. 880. The 25th of June 1789. Resume of a Jaffnapatnam resolution whereby is submitted the proposal of the lord Commander not to farm out the chay-root digging any longer. Decision thereon. Having been resumed by circular letter a Jaffnapatnam resolution of the 12th of March last containing the decision of the officials to submit to this government the proposal of the lord Commander Raket, henceforth no longer to farm out the chay-root digging, but to have this work performed without the intervention of a farmer, by the adigar, under the supervision of the administrator, provided that there is paid to the diggers for each pound of chay-roots which they deliver to the Company, two stuijvers, of which one third shall be assigned to the head under whom the diggers stand, and for which he shall have to ensure that the diggers properly supply their contingent, or in default thereof, shall have to make compensation to the Company for the missing quantity, at the redemption price. It is after deliberation approved and understood, to approve the aforesaid proposal, and consequently provisionally and until further 881. continuation orders not to farm out the chay-root digging, but to assign that work to the administrator at Jaffnapatnam, and concerning this to write to the officials: 1. That the administrator will have to obtain from the thombo-keeper a proper nominal list of all those who are obliged to dig chay-roots, and who have hitherto been employed in that work. 2. That as soon as he has that list, the administrator must place each of those diggers on a proper tax, from which it is hoped that the total quantity shall at least yield no less than what the lease has yielded on average in recent years, and that as soon as the said list is ready, a copy must be sent hither. 3. That these diggers, in so far as their digging work is concerned, shall be directly under the direction of the administrator, and that two Indian stuijvers shall be paid for each pound of chay-roots delivered, to be divided in such manner as the lord The 25th of June 1789. That the officials must meanwhile take into consideration whether there ought not to be some difference in the payment between the Karredivo roots and those of the so-called Seven Places, or if that cannot be done, to increase the tax of the Seven Places roots according to the measure of the difference that seems equitable to take place here. 5. That to the administrator shall be granted, as is granted hereby, five per cent, instead of 1 1/4 rixdollars per baar, on all the roots which he shall ensure are delivered to the Company, both of the Karredivo and of the Seven Places, which quantity of five per cent shall be sold together with the roots of the Company, and that these five per cent shall be paid to him according to the lot price which the roots fetched, both on cession to the weavers etc., and on sale by auction, in the manner ordered by letter of the 6th of August 1787, while this government, if this arrangement meets expectations, shall further take into consideration what further gratification it may be equitable for the administrator to enjoy hereupon. 6. That the administrator, on the other hand, shall have to guarantee the proper receipt of that which, according to the list, the assessment amounts to, which the diggers must deliver, and that he shall have to pay according to the redemption price for that which falls short; yet, if there are nonetheless lawful reasons which merit an exception in this matter, the same must be shown to this government, and he shall not be released therefrom except by further disposition of this government. 7. That the administrator must make a list of the weavers, dyers, and painters, with an indication of the quantity of chay-roots which each of them ought to have, 884. The 25th of June 1789. continuation in order to be able properly to carry on his trade, both of the Karredivo and Seven Places, which may be given to them for the encouragement of these manufactures at the prices hitherto paid by them for the same, and that the administrator shall have to give a copy of the aforesaid list to the Honorable Dessave. 8. That the administrator shall have to give to each of these persons a certificate signed by him, indicating the quantity which he may have, which certificate must be brought by the holder thereof to the Honorable Dessave, who will countersign it as seen in case the man to whom it was given actually exercises the trade for which he is known according to the list given to him by the administrator; and in the contrary case, he shall return the certificate granted by the administrator to him, with the necessary remarks thereon. 9. The 7th of July 1789. continuation statements of the provisions made from the Equipment warehouse to the barks and sloops belonging locally here over ten years, being five years before the war from the financial years 1775/6, 1776/7, 1777/8, 1778/9 and 1779/80, and five years after the war in the financial years 1782/3, 1783/4, 1784/5, 1785/6 and 1786/7, which took place under his administration. Which papers having been submitted by the Lord Governor to the first visitor Berghuijs, the same has submitted the report inserted below, which, together with the fourteen comparisons presented by him of the provisions made in the aforesaid ten years to the barks and sloops belonging locally here, having also been circulated among the Honorable Members, from which it appears that the provisions made in the financial years 1782/3 to 1786/7 to the bark de Liefde exceed the provisions made in the financial years 1775/6 to 1779/80 to the bark de Falck by ƒ 9858:17:—; and that this excess provision originates from: 1. That to the bark de Liefde two sets of heavy and two sets of light sails were 909. The 7th of July 1789. continuation provided as spares upon departure for Trinkounamale and Cochim, which provisions were not made to the bark de Falck; 2. from the cost of a set of heavy and a set of light sails that were provided to the bark de Liefde in place of those lost and blown away in a heavy storm at Tutukoryn; 3. on account of the anchors, grapnels, cable ropes, iron hawsers, buoy rope, octant, wheel hawsers, and tarred lines provided in place of those lost in the aforementioned storm; and 4. from the higher cost of sailcloth, iron bolts, shrouds, tar, etc. than in the years before the war. That the excess provisions to the bark de Jonge Willem Arnold in the last five years, compared against the provisions to the bark de Falck in the first five years in the amount of ƒ 140:17:—, originates partly because the first-named was hauled up and launched from the shore, and partly from the sails provided as spares. That although in the last five years sails, cable ropes, etc. were provided to the bark de Gustaaf in place of those lost in the heavy storm at Tutukorijn, nevertheless the 910. The 7th of July 1789. continuation provisions made to the said bark in those five years, compared with the provisions to the bark de Falck in the five years before the war, amount to less by ƒ 225:4:8. That likewise the provisions in the last five years to the barks de Kanneeltuijn and de Hervatting, compared with the provisions made to the bark de Falck in the first-mentioned five years, amount to less: the provisions to de Kanneeltuijn by ƒ 337:14:— and to de Hervatting by ƒ 647:4:8. That the provisions made to the sloop Kolombo in the last five years, compared with the provisions to that same sloop in the first five years, show an excess of ƒ 2088:3:8; and that this originates: 1. because this sloop was hauled up and launched from the shore in the last five years, and for that purpose wheel and mooring hawsers, mooring ropes, soot, tarred marlines, buoy rope, tar and green soap were consumed and written off; and 2. by the additional provisions made in place of unserviceable items, such as anchors, mooring ropes, grapnels, Dutch ropes, shrouds, wheel and mooring hawsers, white, 911. That the excess provisions to the sloop Sunda in the four years after the war, compared with the provisions to that same sloop in the four years before the war, amounts to ƒ 5727:19:—; and originates: 1. because this sloop was hauled up and launched from the shore up to two times after the war, which happened only once before the war, and on account of the higher cost of those equipment goods after the war; 2. on account of the additional anchors, mooring ropes, double and single ties, shrouds, cable ropes, wheel and iron hawsers, etc. provided in place of unserviceable items; and 3. on account of the higher cost of sailcloth, tar, iron hawsers and other equipment goods from the homeland that were provided annually according to the regulations. That the provisions made in the financial year 1785/6 to the cargo boat de Jonge Martijn, compared with the provisions made to that same vessel in the last five financial years before the war calculated on average 912. The 7th of July 1789. continuation for one year, amounts to an excess of ƒ 91:6:8; and arises from this boat having been hauled up on the shore after the war, and for that purpose mooring ropes, iron, wheel and mooring hawsers, tarred and white lines, buoy rope, tar and soot were consumed, and also from the additional anchors, grapnels and mooring ropes provided in place of unserviceable items. That the provisions made in the financial year 1786/7 to the sloop de Baars, compared with the provisions made to that same sloop in the last five years before the war calculated on average for one year, amounts to an excess of ƒ 242:9:—; and originates from the high price of Surat canvas that was provided out of necessity in place of Dutch sailcloth, and also on account of the higher cost of iron hawsers and tar. That the provisions made in the financial year 1783/4 to the sloop Schilpad, compared with the provisions to that same sloop in the last five years before the war calculated on average for one year, amounts to less by ƒ 224:8:—; and arises from the provisions of anchors and mooring ropes in place of lost and unserviceable ones in the years before the war, which
