249. Extract of the Regulations for the Administration of Justice in the respective Courts of the Dewani Adalat, drawn up by order of the Court of Directors in 1787, and approved by the Governor General in Council; printed at Calcutta in the said year and since introduced throughout Bengal. Section 25. That any person, etc., provided that where any witness or witnesses may be of such a rank, caste, or quality that it may be, according to the prejudices of the country, improper to administer an oath to them, the judge of the court may dispense with their being sworn, on their subscribing a declaration to the following effect, to wit: if the witness be a Hindu: "I will faithfully answer such questions as shall be put to me by the Court in the cause now before the Court according to the truth. I will declare nothing not warranted by the truth. If I declare anything not warranted by the truth, I shall be deserving of punishment from Ishwar, etc." And the testimony and deposition of such witness or witnesses so subscribing shall be read and received as good evidence in the cause, and be filed and recorded in like manner as if the witness had been sworn. Below stood: For the agreement and the translation, signed: Cs. J. van Nierop, Sworn Clerk. Agreed: C. J. van Nierop, Sworn Clerk. 250. No. 584. 9. Today, the 20th of January, in the year 1791, appeared before me, Cornelis Johannes van Nierop, sworn clerk of the Bengal Secretariat, authorized and sworn in that capacity to draw up and pass all notarial deeds, in the presence of the witnesses to be named hereafter: The Honorable Mr. Johan Carel Lodewyk Blume, Junior Merchant in the service of the Dutch East India Company here, who handed to me a paper on which was written in the Dutch language: The Honorable Mr. Ross, remaining indebted upon settlement of accounts with Goratchan Mukketje for the amount of 19283 rupees 12 annas, I hereby promise to pay the same to him on behalf of His Honor, as one of his co-attorneys, at the latest in February next, or earlier and immediately following the conclusion of the public auction to be held of His Honor's left-behind effects, and out of the proceeds incoming therefrom. Below stood: Chinsura, the 25th of December 1782, was signed: C. Blume. Furthermore, there were set upon the aforementioned paper some characters unintelligible and illegible to me, which consequently cannot be inserted here; The Appearer requesting me to register the same in the protocol and to make thereof an act in due form, all of which is done hereby. There also appeared before me, sworn clerk, and witnesses, the native merchant named in the aforesaid paper, Goratchan Mukketje, who declared that the aforementioned Bengali characters were placed by his own hand upon the written bond, as proof that Mr. Johan Carel Lodewyk Blume had fulfilled his engagement, and that he, Appearer, had received the previously mentioned amount of nineteen thousand two hundred eighty-three sicca rupees and twelve annas to His Honor's satisfaction, and consequently promised to indemnify him against all further demands and claims on that account. Thus done at Hooghly in Bengal in the presence of Jacob van Spierenburg and Anthoni Brand, clerks, as witnesses. Was signed: Johan Carel Lodewyk Blume, and Goratchan Mukketje in Bengali. No: 592 N:o 10 Appeared before me, Cornelis Johannes van Nierop, sworn Clerk of the Bengal Secretariat, in that capacity authorized and sworn to make and pass all Notarial Acts, present the witnesses to be named hereafter, Mr. Teunis van den Broeck, First Sworn Clerk of Police and Secretary of Justice here, in the capacity of former co-attorney of the Director Johannes Matthias Ross, who repatriated in December 1782, Today, the 4th of March, Anno 1791. Who showed me two original auction rolls of the effects that were left behind here by the appearer's principal, the aforementioned Mr. Ross, and sold at public auction in the year 1783 by the late Bookkeeper Johan Willem van Hall, requesting that I note the amount of each separately and register it by act. And it has appeared to me, the sworn Clerk, and the witnesses, that the first of those auction rolls, namely that signed on the 10th of February 1783, amounts to a sum of fifteen thousand eight hundred eighty-two rupees, ten and one-quarter annas sicca, and that the other, which is dated the 30th of June thereafter, amounts to six thousand seven hundred eighty-eight rupees, and two annas sicca, together making an amount of twenty-two thousand six hundred and seventy rupees, twelve and one-quarter anna sicca, of all of which, at the requisition of the appearer, an act in debita forma has been drawn up and granted, which is this present one. Thus done at Hoogly in Bengal, in the presence of Harmanus Bloemink and Anthony Brandt, Clerks, as witnesses. 261. Mr. Bacheracht reflection thereon Continuation have disadvantaged, I have thoroughly examined all the papers relative to that matter; the result of my findings I shall set down in all respect. Section 51. The sale of copper being one of the most important branches of the Company's profits, one must conclude from such principles alone that he left no means untried to promote the sales to the best of his ability, and thereby to have the pleasure of bringing all advantages to the Company in an article that had fallen so greatly into decline since the year 1769 due to the large supply and the intrigues of foreign nations. Section 53. On 12 February 1777, upon handing over authority to his successor, Mr. Bacheracht turned over a remainder of 348321 pounds. One finds that under the date of 29 March, Mr. Ross immediately sold 300,000 lb thereof at f 7: 46: —: 2/5. If, besides such a notable increase, there was still a prospect of extraordinary profit, one cannot presume that Mr. Bacheracht could have been ignorant thereof; and knowing such, one may ask why he, if self-interest went above duty, was powerful enough not to enrich himself through a direct sale rather than granting that advantage to his successor. The great fortune made here could be no motive to make him disdain such a thing, for indeed his estate account indicates the contrary; great friendship for Mr. Ross could not be the motive; that which had occurred while serving here as chief administrator, of which more under the article of the Wakiel, had laid the foundation for a reasonable distrust. That no good understanding existed is clearly evident from what occurred with the opium in 1777 shortly after the departure of Mr. Bacheracht, regarding which the plan had already been formed without his knowledge, although he was still present here. Section 54. The true motive for this manner of acting was... 262. Reason for the manner of acting of Mr. Ross Administration ...was the envy that Mr. Ross bore toward his predecessor, through such considerable sales, and at the same time he tried to instill in the government a favorable idea of his superior abilities by means of the higher price, as if this were owed to his superior industry and zeal for the master's service. His passion for trade, as well as his connection and understanding with foreign merchants, was known to everyone here; no one could or might doubt the sale, seeing the money paid in full. At the end of March he made a new demand for 400,000 lb, which arrived in the autumn; as of the end of August 1778, 300,000 lb were sold and paid for. For 1778/9 he had previously demanded 300,000 lb again in January, which, having been sent, together with the previous remainder amounted to 448321 lb, of which on 15 May 1779 446500 lb were turned over, whereby the entire remainder amounted to only 1821 lb. Meanwhile, in that year a demand had again been made for 300,000 lb, which found no market; notwithstanding which, in 1780 they proceeded to an equal petition, of which, due to the shipwreck of the vessel De Jonge Hellingman, only half was received. However much he is reproachable for making his rash demands, I find among all those who knew Mr. Ross closely no one who harbors any doubt that he would have found an outlet for that entire quantity as well, even if to his own loss, solely to maintain his own reputation, had he not been prevented herein by the fatal consequences of the war. is the question whether he disadvantaged the Company through those prices and what way out he found with them. Section 56. One cannot assume of a merchant that he would purchase such large quantities without the intention of making a profit thereby. The considerable sums to be found with the English enabled Mr. Ross immediately to pay the value. Through a rapid sale, the Company got the money directly into its hands, whereas had the copper remained in the warehouses, loans on heavy interest would have had to be negotiated for what was needed. Far from the Company being disadvantaged by this, it drew a considerable benefit from that sale; at once he boasted of a substantial price increase. The copper, which otherwise could not be turned over except in small lots, was disposed of all at once; the warehouses were emptied; the interest on the advanced capital ceased, and the money realized for it immediately found a profitable employment. Remarks thereon: In spite of all the effort made, I cannot find out at what prices it was successively sold; there is no doubt that these will have been proportionate to what was paid to the Company. One may even assume that the bazaar price was higher, since it makes a great difference whether one buys small lots of 5, 10, or 22 Maons for private needs, or purchases such an important quantity all at once, which must immediately be encumbered with the accrued interest on the advanced capital until it is disposed of. Besides his desire to distinguish himself through that sale to the detriment of Mr. Bacheracht, his speculation was to be able to force the prices by being the sole master of what was sent. Far from achieving his aim in this, it is evident from the general testimony of all merchants that since 1769 copper steadily fell in price from year to year due to the enormous quantity imported from Europe. Since Mr. Ross once proceeded to the rash step of buying up the whole lot and made such a fine showing in the books, which gave a favorable idea of his insight into commerce, his vanity could not tolerate that this should subsequently be called into question; he continued on the same footing. Yet, having grown wiser at his own expense, self-interest set bounds to his ambition; instead of f. 7: 46: -: 24, the Company was in 1778 credited no more than f. 7: 43: 10: 22, which seems to me of much speculation and caused the prices during His Honor's administration to fall beneath each other, whereas it appears that in those years it was disposed of at f. 7: 44: 9: 12, approximately corresponding to that for which Mr. Bacheracht parted with it in small parcels. In the last two years, however, in order to unburden himself of it, he had to take recourse to extraordinary means. Section 57. The various reports that have come before me in my investigations regarding the prices for which it was again disposed of have long kept me in doubt whether or not I should believe the declaration of the merchants in the meeting that they received no copper upon the delivery contract of linens. After having maturely weighed and investigated everything, it seems to me that, as far as concerns the Company's affairs, one may rely on their declarations; regarding Dacca alone, a supply of copper upon the contract appears to have taken place. Section 58. On the other hand, it clearly appears that Mr. Ross engaged in large private trade. The late packer L'Amy testified to me that in two years he received from His Honor circa rop: 3000: -: - for linens sorted by him for dispatch with foreign ships. It also appears to me how he sent considerable quantities of copper to the country of Assam, from where he received Mogadaeties in return, which found a ready sale along the entire Coromandel and Madura coast, and how copper was also supplied to foreign contractors for the linens from the provinces of Behar and Orissa. However, that there was no possibility of disposing of the whole quantity in his private linen trade is evident from the large remainder which he still had on hand in the house Welgelegen at the outbreak of the war. Knowing no way out for this, it would, without the powerful mediation of Mr. Hastings, have caused his ruin. Remarks thereon: The aforesaid statement extracted from the English books cannot be suspected of fraud and dishonesty; all the less so since it is unanimously confirmed by Bookkeeper van Hall, who acted as auctioneer at that time, and by our merchants who were present at the auction. If Mr. Ross has made himself guilty, it is through his private trade, which was so extensive that I am assured several ships of foreign nations in which he held a share were successively chartered and dispatched by him. Paragraph 60. Regarding the second point, namely the removal of the Wakiel, I take the liberty to demonstrate how necessary it is that a Director, upon whom the negotiations with the country's Regents and all that relates to political governance particularly incumbent, has a servant whom he can fully trust for the performance of what pertains thereto. It is not possible strictly to determine which reasons prompted Mr. Ross to his dismissal. Your Right Honorable and Highly Esteemed Sirs will please note that this should have taken place with the prior knowledge of the Council; however, circumstances may occur in which, while reporting his dismissal to the Council, he would also feel obliged to disclose the reasons for it, which disclosure might appear ill-advised and questionable. One might incline to the view that the matter was so situated, since the following words appear in the separate resolution of 25 September 1775: "to let serve as information the opinion of Their Right Honors that as long as the Company's courtier or Wakiel remains under suspicion in the Durbar, it is best to employ another in his place." On the other hand, it is supposed that a private grudge gave rise to it, which stemmed from the following. 266: Paragraph 61. In the year 1770, when a claim made by the Durbar or Moorish Government at Hooghly, relating to the actions and extortion of the former Fiscal Saumaise, was to be settled, the said Wakiel was employed for that purpose by Mr. Bacheracht. During his negotiations, he discovered that Ram, under-banyan of the then Chief Administrator Ross, was also meddling in that matter and was engaged in instigations. He made this known to his master, Director Bacheracht, who summoned Mr. Ross, presented him with the blameworthiness of his conduct, reproached him in the sharpest terms, and brought him to his duty. This embittered Mr. Ross so much against the Wakiel that immediately after taking over authority, he had him arrested, from which arrest he was only released after a long time and solely upon the intercession of his son-in-law and the Munshi of the English Governor Hastings. Paragraph 62. If of the above two motives the first is true, it does not absolve Mr. Ross from neglect of duty, because he was then obliged to inform Your Right Honorable and Highly Esteemed Sirs in his separate dispatch of the motives that had induced him thereto, and to demonstrate their validity frankly. Which remains the true reason is undecided. If the latter is the case, it indicates an arbitrary abuse of entrusted authority, the more reproachable as the victim is of honor and standing. Since nothing can be decided with certainty on this matter, I have judged myself obliged to present both views to Your Right Honorable and Highly Esteemed Sirs according to my findings, as the only points that come into consideration for and against in this case. 267. little prospect of redress came from Europe, and the merchants' pretense of not being able to deliver better goods because of their little authority over the weavers, as they could only obtain a piece on the sly due to the arbitrary conduct of the English, which they had to take as they could without being able to object much against its inferior quality, caused His Honour to resolve to look for means to furnish the Company if possible with this article in sound assortments and in a less troublesome manner. Experience had taught him repeatedly that the complaints of the Bengal merchants were not always based on such good grounds as they claimed to make the government believe, and even were they founded, His Honour knew how little redress was generally to be obtained by making public complaints to the English, a means that his predecessor Mr. Bacheracht had tried all too often in vain, and was therefore rejected by him; in the meantime, the Company had to be served and its demands satisfied with sound goods. Henry Halsey was the contractor or supplier of the coarse linens that the English Company required. The collection of the same took place under his immediate supervision as he continually traveled around in the Aurung; it was therefore to him that Mr. Ross judged it best to address himself in order to obtain the desired redress. The complaints of the merchants were presented to him, and he was most strongly urged to remove all reasons for them. Those objections were so concisely refuted by him, Halsey, and declared with so much semblance of reason to be unlawful and feigned, that one had grounds to assume that his defense in this regard would prevail with the English Government, and thus all further stir about that subject would be useless. It was these reasons, so far as it appears to me, that persuaded Mr. Ross to enter into a contract with Halsey himself for the procurement of a part of the coarse linens; His Honour trusting that this agreement would also serve to protect the merchants against all further vexations, as one might naturally assume that he, Halsey, having himself become a supplier of the Company and thus more or less dependent on Mr. Ross, would not proceed immediately with that arbitrariness against our merchants as before. The proposal was thus made to Halsey for the first time in 1778, and accepted by him on the condition that, as he according to the order of his superiors on pain of forfeiture of his post was not allowed to deliver any linens to anyone other than the English Company, he would make the delivery to us under a native name. The outcome of this plan seems to have answered the expectation completely, as the Company obtained sound coarse cloths since that time; Mr. Ross continued therewith annually until the outbreak of the war. 268. It is known that the English Commissaries, upon taking possession of this colony, immediately seized the trade books, and that they compelled Mr. Ross as well as all other servants to make a full disclosure of affairs. After the books were closed and they had them in hand, their first work was to summon before them the merchants who were found debited in the same for advances made, and to exhort them to the fulfillment of their contracts. All appeared except Collinaat Moekersja, the native name given by Halsey, who, although standing in debit on the books for circa two lakh rupees upon delivery, was not to be found. The Commissaries therefore asked Mr. Ross for elucidation, which he was obliged to give them. However, in order not to make Halsey unfortunate, with whom he had already spoken and who had promised him the delivery of the linens, he resolved to conceal his name and simply undertake to see to the delivery of Collinaat Moekersja. The Commissaries were satisfied with this, and this therefore remained as it stood. According to my report, Mr. Ross fell ill some time thereafter, or in September 1781, to such an extent that he was bedridden for more than two months, and sometimes without memory, at least not able to perform any business. Halsey in the meantime had his linens ready, and it is said that he also offered the same for delivery; but whether the illness of Mr. Ross or some other causes prevented this is uncertain. This is known, that the same took no effect, and it was heard that Halsey in the meantime, profiting from the opportunity, sold the said linens with a considerable advance to the Portuguese, without concerning himself further about the fulfillment of his contract. 269. As a consequence of this, Mr. Ross was addressed when His Honour was de novo addressed by the Commissioners for the satisfaction of the debit of Collinaat Moekersja. The above-mentioned conduct of Halsey, in His Honour's judgment, no longer merited considering the concealment of his name, and this also seemed indifferent to Halsey because, having left the service of his masters, he was also on the point of departing for Europe. Mr. Ross therefore gave the Commissioners complete elucidation of the entire matter, and referred them to Halsey to demand from him what he had enjoyed under the name of Collinaat Moekersja upon the contracting of the Netherlands Company. He was prosecuted at law, but denied having anything outstanding with the Company; however, he acknowledged that he owed accounting for those funds to Mr. Ross, and agreed, as Mr. Ross declared how those funds were actually advanced for the contracting for the Netherlands Company, to satisfy the same, provided that the Commissioners would accept in return English Company bonds, of which he held a great quantity that had been given to him by the Board of Trade as an advance; this was refused by them because the English bonds at that time already suffered a discount of twenty to twenty-five percent, and the affair of Halsey thus remained stalled once again. In the meantime, the time determined for the departure of Mr. Ross began to approach; many fruitless attempts were made on both sides to mediate the matter, but nothing availed; Halsey remained obstinately upon his stance. The consequence of that would in all probability have been that this had prevented the departure of Mr. Ross, had Mr. Hastings not energetically taken an interest in His Honour's behalf, being now also extremely indignant at the conduct of Halsey, and ordered the Commissioners to content themselves with the transfer of the claim of Mr. Ross onto the English Company in order to be able to prosecute him, Halsey, thereafter for it at law. This took place on the last day of Mr. Ross's departure, when His Honour executed a power of attorney upon the First Commissioner on the part of the English at Chinsura, named Mr. Charles Purling, appointing His Honour as his attorney to prosecute Halsey at law in the aforementioned matter and to compel the payment of what had been enjoyed by him. Mr. Ross departed thereupon; Halsey followed him shortly thereafter, yet not before he, on account of his lawsuit then already pending before 270. the Court in Calcutta, had furnished security for double the amount of that claim; this he did by depositing as many English Company bonds as that sum amounted to, and it is those bonds which thereafter, when the case was decided in favour of Mr. Ross, or actually the English Company in the name of Mr. Ross, were sold publicly by summary execution. From the preceding detail I trust that Your Right Honourable Grand Worships will form a true idea concerning the attorneys of Mr. Ross in Calcutta, he having had no other attorney there than the aforementioned Mr. Purling, and for no other purpose than, in order to facilitate His Honour's departure, to recover the monies advanced to Halsey upon the delivery of linens. For further elucidation I take the liberty to present herewith to Your Right Honourable Grand Worships a newspaper printed in London, which I have cut out as far as it relates to this matter, and of which the translation follows verbatim: One finds mentioned in one of the daily papers that just before the news came to India of the declaration of war against Holland, Mr. Ross, Governor of the Dutch colony at Chinsura on the Ganges, entered into an agreement with Mr. Halsey, an English subject, to provide him with linens and other piece-goods of that country to the value of 20000 pounds. Pursuant to their customary method of contracting, the Dutch Governor had advanced the money to Mr. Halsey. When the English troops took possession of Chinsura, this transaction appeared from the books of the Netherlands Company. The Governor-General and Council of Fort William addressed Mr. Halsey for this money, as belonging by right of conquest to the English Company, because he had not delivered the linens stipulated in the contract. Mr. Halsey acknowledged that he had not fulfilled his contract with the Dutch, but that he was prepared to fulfill his engagement to them, if they would indemnify him. The Supreme Council insisted upon the immediate reimbursement of the money advanced to him by the Dutch. Mr. Halsey at last agreed to this, rather than bring the displeasure of the Council upon himself, and offered bonds granted by the Governor-General and Council themselves in payment; but they refused to accept the same, and desired to be satisfied in cash. Mr. Halsey found this refusal so strange that he would not obey that order; the Supreme Council brought Mr. Halsey before the Supreme Court of Judicature in Calcutta.

Mr. Halsey prepared himself after the first verdict to depart for Europe, the Supreme Court granted a writ of Ne Exeat, and a judgment having been rendered to the detriment of Mr. Halsey, he was obliged to satisfy in cash to the Governor-General and Council the entire sum received from Mr. Ross. As this is a matter generally known, nothing can more clearly demonstrate the decayed state of the Company's credit, where the Company's government absolutely refuses to accept its own bonds in payment, which then suffered a loss of 25 per cent. Number 14 By a circular extract from the General Resolutions of the Castle of Batavia taken in the Council of the Indies on the 14th of November 1762, the respective trade bookkeepers at the outer stations being ordered annually at the closing of the books to submit in writing and report to the Council of Policy on the state of the debtors, indicating the origin of each person's debit, and what likelihood there may be for the recovery thereof; which, at this Board on the 30th of May 1777 was also made applicable to the subordinate offices, whose debtors must therefore also be included in that report, the undersigned, in obedience to these orders, has the honor to present: That at the closing of the Hooghly trade books of 1787/90, the following debtors were found therein: Ram Kissor: 4049:6:8 guilders. This entire debt amounted to 6070:—:8 guilders, and the settlement thereof was determined by resolution of Council to be in three installments, as took effect with the first in the year 1777/80 by the payment of 2020:14:— guilders; but since then, both through the war and the death of this debtor himself, nothing has been received from this. By resolution of the 2nd of March 1790, the Honorable Lord Director has already recorded the necessary measures regarding the settlement of this debt, the result of which is expected at the end of the coming month.
