To the Right Honorable Sir Mr. Izaac Fitsingh Councilor Extraordinary of the Dutch Indies as well as Director over the Honorable Company's interests in Bengal, together with the Members of the Honorable Council of Policy of this Factory. Right Honorable Sir and Much Respected Councilors Pursuant to Their High Noble Honors' honored order by Their Most Respected rescript dated 13 July 1773, contained in the marginal disposition of that date on the trade books of 1769/70, stipulating that a list shall be drawn up annually by the Trade Bookkeeper showing how all charged and running compensations have been dealt with, the undersigned has the honor, in obedience thereto, to show how all entries concerning any compensations have been handled in the financial year 1789/90, which settlements were made conform Their High Noble Honors' intention, whether by collection or otherwise, and which still continue to run; namely: Compensations that continued to run by full name as of primo September 1789, being: Johannes Matthias Ross: f 15300. -. - arising from the ordered compensation of the premium of insurance for the ship Hercules in the year 1777, as well as for commission monies calculated and enjoyed from the cash office in 1777/8 by him as well as by the Honorable Head Administrator Brueijs on sold Japanese bar copper. Hooghly. As appears from the cash account of the month of April 1790 and vide page 63 of the journal of the year 1789/90, this amount was duly paid into the cash office. This account still continues to run in this manner. On the account of Charges and Compensations there further ran under the aforementioned date: The compensation ordered by Their High Noble Honors for some silk fabrics found missing in the year 1781 at Ceylon in chest No. 545, which was charged to the authorized agents or guarantors of the repatriated merchant and second-in-command Leonaard Verspijck, as having held the authority ad interim and the administration of the warehouses at the Kasimbazar factory at the time of the dispatch of those fabrics, amounting to f 406. 7. - Furthermore, the amount too little accounted for in the year 1785/6, vide the journal of that financial year, page [illegible], for the deed of A. De Visser: f -. -. 8 These 8 pennies were settled on the main account under ultimo August 1790. Sum: f 406. 7. 8 The account of Previous Years' Profits and Losses was in this financial year throughout the entire Directorate likewise not credited with anything, but solely debited: At Hooghly: on account of a discrepancy discovered at the closing of the previous books of the year 1788/9 between the balances of the annexes of the provisions and those in the trade books; which mainly arose because, when accounting for the proceeds of sold arrack etcetera in that financial year, the amount for the empty leaguers was not deducted, thus set too high in those small books, and afterwards in the journal of the trade books of the said financial year it was once again included, amounting to: f 3694. 11. 8 Further, the amount calculated too low on Batavia's invoice of 28 October 1789 for 3815 lb of sappanwood delivered short in the past year by the officers of the ship Eik en Linde, which pursuant to Hooghly's resolution of 26 March last was debited to this account with: f 97. 5. 8 Sum: f 3791. 17. - Herewith the undersigned hopes to have complied with the very honored order mentioned at the head of this, and furthermore has the honor to call himself with all high esteem, Right Honorable Sir, the 4th of March 1791, Your Right Honorable's very obedient servant was, signed, J. In this regard, no written instructions have yet been received from the Netherlands and thus it still remains. The adjacent sum of ƒ 4: 5: 8 was settled on the general trade books at the office on the last of August 1796. See page 95 of the ledger of the year 1786/90: the cost calculated back from Patna of 19 pieces of Lachooriasses, brought in too short by the Chamber of Delft in the year 1779 per the ship 't Huijs te Krooswijk. 277 26th January 26th January ceded 500 chests of Opium, in accordance with the secret resolution of the ultimate of the most recently passed month, made by letter of the 2nd of this month reading as follows: Kalkatta To His Excellency The Right Noble and Well-Born Lord Charles, Earl of Cornwallis Governor-General along with The Right Honorable Members of the High Council of Fort William Right Noble and Well-Born Lord, Right Honorable Lords. We have until now delayed making a request to Your Excellency and Right Honorable Lords for the delivery of the 500 chests of Opium ceded to the Netherlands Company in the past spring, in the daily expectation that through the arrival of our European ship we would be enabled to pay for the same in cash; yet as this still remains absent and the time for the dispatch of that opium to Batavia approaches rapidly, we find ourselves compelled to request Your Excellency and Right Honorable Lords to be pleased to give the necessary orders for that delivery and to grant us credit for the amount thereof until the arrival of the said ship, by which we are reliably informed that we shall receive thirty-four chests of bar silver, out of which we assure Your Excellency and Right Honorable Lords that that payment will be made at the earliest. We hope that Your Excellency and Right Honorable Lords will be pleased to consent to this our instance, out of consideration that nothing but a confluence of unforeseen misfortunes is the cause that we cannot comply with the condition of cash payment, since our richly laden Batavian ship was wrecked on the coasts of Arracan and the European ship was forced by heavy storm, in August last, to seek one of the harbors of Ceilon to be repaired of the sustained damages, whereby the same has been delayed on its voyage hither. In the margin: Houglij, the 2nd of January 1790. 278 26th January 26th January assistance for the obtaining of compensation for the damage inflicted by the St. Michael upon the Straalen, as also for its... while, in compliance with the collective resolution of the same date, concerning the matter of the compensation for the damage caused by the English ship the St. Michael to the Company's ship Straalen, it was also written to those Lords in the following manner: Kalkatta To His Excellency The Right Noble and Well-Born Lord Charles, Earl of Cornwallis, Governor-General along with The Right Honorable Members in the High Council of Fort William Right Noble and Well-Born Lord, Right Honorable Lords. However much we have tried not to trouble Your Excellency and Right Honorable Lords with the matter of which this treats, we nevertheless find ourselves compelled thereto by reason of the unreasonableness of the persons involved therein. The case consists briefly in this: our Company's ship Straalen lies at Voltha, the usual anchorage of our ships, and was run aboard there in November last at night around eleven o'clock with the flood tide by an English private ship belonging to Kalkatta and named the St. Michael, whereby, with the loss of the figurehead lion, a portion of the cutwater, and the sustaining of other damages, it was knocked from both its anchors and driven onto the shore; it has since been gotten afloat again, but so battered that work is ongoing up to now for the repair of the defects caused thereby. As it is contrary to all rules of prudence to set sail in this river by night and with the tide, particularly under a dark moon, and to pass the berths of other ships, this accident can be attributed to no one else than the managers of the English ship, and it is therefore nothing more than just and reasonable that its shipowners compensate the damages inflicted through their imprudence in this matter, a view which was supported by the Kalkatta master of equipment, who was consulted about this by ours. 279. 26th January 26th January Convinced they would readily proceed to this compensation for damages, we have, without troubling Your Excellency and Your Honors with this, had the same demanded of them; but instead of satisfying our reasonable claim, they, or rather their agents Messrs. Burrell and Dring, who say that the actual shipowners reside in Madras, refer us over to the Judge, without whose condemnation they will hear of no compensation. Since it would not be becoming for us, nor can it be required of us, to enter into litigation with private persons before a foreign Court of Justice for or on behalf of the Dutch Company, especially in a matter such as this, which can be regarded as nothing other than a dispute between Nation and Nation, on both of which, on the 5th of this month, an answer was received to both previous letters, with its translation reading as follows. we find ourselves, however much against our inclinations, obliged to trouble Your Excellency and Your Honors with this, and to request the same to assist us in obtaining the compensation for the damage caused to our Company by the subordinates of Your Excellency's and Your Honors' Government from those whom it concerns. That the undersigned had acted upon the express order of the government or the ministry, without having made the seizure himself. 2nd. That the sense and meaning of the word calange would apply as much to those who made themselves master of the ship and cargo as to the officer of justice himself. As far as the first reason is concerned, it should be noted in that regard that an officer, whether he receives express orders or not, does nothing except for and in the name of the government or authority whose authority and supreme command he guards, and for the maintenance of whose proclaimed laws and orders he proceeds to sue and summon all offenders before the Court, in order to have it decided there whether the authority, in its legislative power, has been offended or not, and whether, in consequence thereof, the prescribed punishment and penalty attached to that offence ought to be adjudicated or denied. Febij 19e Feb:ij as the advocate and defender of the authority of the government, and in consequence thereof, he is, and remains, in whatever manner he may come to act, always the officer of Justice who by the edicts and statutes is properly destined and meant to share in case of confiscation upon violation of the laws of the country; and who without the lawful authority and the assistance of the government is not in a position to make seizures of that nature, such as the taking of ships. He may, with his ordinary servants, apprehend single persons, but in momentous cases, the power of the government comes, without hesitation, to his side for the protection and enforcement of its laws. The second reason, consisting in: that the sense and meaning of the word chalenge would apply as well to those who made themselves master of the ship and cargo as to the officer himself, is according to the undersigned's understanding, salvo reverentia, in the nature of the matter, too much mingled and entangled: for it is quite one thing that the government orders its subjects and subordinates to secure open violators of its commands and laws, and quite another to proceed against the same for the maintenance of the laws and the punishment appointed for their crime, because the latter is performed, or can be performed, by no one other than the officer of Justice, to whom, in the discharge of his office, such help and assistance is granted by the government as is deemed fit to enable him subsequently to come forth with that chalenge or judicial claim which the laws prescribe and demand. To the first, namely the apprehension and securing of criminals, the government intervenes with its lawful power and authority if necessary, and the latter, namely the instituting of an action, depends solely upon the one who, in the name of the government, makes demand to have the penalty determined by the law executed against the criminals, or, what is the same, who comes to chalenge them at law: consequently, according to the undersigned's understanding, no chalenge is made except by the officer of Justice alone, as soon as he, through the assistance of the government in securing the criminals, has been enabled to do so. 291. 19e. Far from it. Equity and justice require that they be well rewarded: but that reward cannot, under correction, be made from that portion which the law expressly assigns to the officer who makes the chalenge or judicial claim; and it is also for those reasons that the undersigned in his intendit submitted the twofold statutes appointed for confiscation; namely that of the Sovereign of the first of July 1606, and that of the High Government of these lands of 1665, which both expressly assign 1/3 to the officer, and of which the latter also determines 1/3 for the informers, who, in this case, would properly be those of whom this ministry made use to enforce the laws of the Sovereign, and to enable the officer to institute his judicial claim. 293. 2nd March We have examined the weight of the opium delivered this Season to the Dutch East India Company and are induced to think from the result of it that the Deficiency in Question is only that which might be naturally expected from the long Interval that has elapsed between the Dispatch of the opium by the Contractors and the Examination of it by the Gentlemen deputed by you to inspect it. It is well known that this Drug, as manufactured in India, Contains a great Portion of aqueous and volatile Parts, which are lost by Evaporation; the weight of it, therefore, must necessarily diminish rapidly until it be reduced to the consistence of an extract. If, in future, you can make it convenient to receive the opium on its arrival in Calcutta, we are well assured that you will have no Cause for Similar Complaints. Accompanying we have the pleasure of forwarding to you, according to your request, a Copy of your account Current with the English East India Company for the Purchase of the opium above alluded to, exhibiting a Balance due to us of Sicca Rupees 81,124. 1. 15. For which reason it was agreed to note this in reply, although one cannot expect that any redress will follow thereon, just as little as that an earlier collection, even if the supply of money permitted it, would make any change herein for the future, since evaporation, if that is truly the cause, must take place just as well in our warehouses as in theirs, in case the cakes are not properly dried before packing. Yet from that representation one may only hope that the Contractor, seeing with what circumspection we act herein, will in future take care that the delivered weight is more in conformity with the stated weight, because an earlier receipt cuts off all opportunity for such pretenses. In the year 1785, according to the reports of our servants from Patna, out of the juice delivered by the contractor to a quantity of 700 chests of opium, which were then ceded to the Dutch Company, no more could be accepted than an amount that could fill only 386 chests, and this because the juice was so bad. As some doubts have arisen among our High Superiors in Europe concerning this report of our said servants in Patna and concerning the price paid by them to the contractor, Their Honours have ordered us to make precise inquiries regarding the latter. 26 May consisting of a President, a Secretary, and eight members, which Committee will be changed monthly and without distinction must receive from any individual such written remarks as everyone is free to make regarding the interests of the Colony, with the said Committee having to give notice of its proceedings every fourteen days to the General Assembly, which it must convene for that purpose, while the President and Secretary of that Committee shall likewise hold those posts in the General Assembly. Consequently, it was proposed to proceed to the appointment to the aforesaid posts by ballot, and taking immediate effect, it was found upon the first count of the votes that there were twenty-eight votes in favor of Mr. Jaques Maximin de verinne as President of the Committee and eighteen votes in favor of Mr. Louis Firmin Singlet de Neuville to fill the post of Secretary, and as the aforesaid number of votes constituted the majority, they were thus appointed to those posts. Upon the second count of the votes, Messrs. Geffrier, Blouet, Deonna, Michelet, Le gou, Ferlus, Pelon, and Rabot were freely chosen by the majority to fulfill the purpose of the establishment of the Committee; and after they had accepted this, they were instructed by the General Assembly to attend immediately to the duties of their office, to which they bound themselves by Oath, sworn into the hands of the Assembly, which on its part undertakes to protect them in everything concerning the public good. It was proposed by motion to increase the number of the committee by one member and to admit therein Mr. Richemont as a Citizen, to hold a seat there during the time previously fixed by the assembly. Following the dismissal of Mr. Montigny, a Citizen made the following proposal: It is expedient to offer the authority over the Colony to Mr. De Fremont, commander of the sipahis, until such time as orders shall have been received from Pondicherry upon the report to be made to the assembly of the Citizens and the Gentlemen Administrators regarding the situation in which we find ourselves. Which motion having passed unanimously, Mr. de Frimont was requested to present himself to the assembly; whereupon Mr. the President offered him the Command over the Colony in the name of the assembly. He answered that according to the form of the Government, known as well to the assembly as to him, in the absence of the Commandant of the place the Command devolved by right upon the one who succeeded him immediately in rank, that consequently the Command belonged to him until Mr. Montigny returned, proposing at the same time to leave matters in their primitive state until that moment. Which, having been rejected in accordance with the resolution of the assembly, the said Mr. de Frimont said that he refused the Command of the Colony, but considering the grievous consequences that might arise from the situation of the Colony if he as well as the officers under his orders suspended their functions and abandoned the Citizens to themselves, he consented to retain the Command of the Troops in order to contribute as much as in him lay to the maintenance of peace and public order, acting in concert with the officers appointed over the different parts of the administration of the Europeans and the Natives; and he signed Premont solely for that which concerned himself. Mr. De Fremont having retired and this matter being taken into deliberation, the assembly unanimously resolved to accept the offer of the said Mr. de Fremont, and that he should consequently have the command of the Troops as previously. And with respect to the order to be established in the various branches of the administration, both internal and external, it was decided that the Committee should be vested with the necessary powers to administer them until the receipt of orders from Pondicherry. Wednesday 10 August 1. 25th August 318. 23 August and Council to answer the contents of Your Honours' letter of the 8th of this month, that neither by the Director nor by the Council have any orders been issued to prevent the entrance or exit of this colony to anyone, whosoever he may be, belonging to the French nation, and that the grounds of the complaints which Your Honours think to have on that account were probably caused by the peons at one of the gates, who are ordered not to let any armed people enter, having, out of a misunderstanding of that order, about 7 to 8 days ago refused entrance to a single person who, armed with two pistols and a cutlass, wished to enter the village; if this should be the case, you, Gentlemen, have been very incorrectly informed that such should have taken place concerning several persons, as Your Honours' letter states, because upon a strict investigation into this it has appeared that no one except this single person, whom one does not even know whether he belonged to the French or another nation, has been turned away. The Director and Council consider that Your Honours ought to be convinced that such an order has not been given here, since Your Honours are fully aware that not only several subjects of the French nation live in this village, Thus it is agreed to record this herewith.
