352 353 6 april 6 april particularity that fully fourteen days earlier discourse had occurred concerning this in the convened Court of Justice, with expressions of astonishment, as well by strangers as on our own side, regarding the tranquility and indifference of the said Ross and his negligence in using precautions; concerning which I trust that the measures will not be ignored which the Commissioners on behalf of the French Company took when in 1788 the rumor of a rupture with England became active again; since the reasons given in excuse of Ross in an address to the Noble High Indian Government in the same spring of 1788, aside from an abundant defamation against both the Eilbrachts, contain nothing other than a concatenation of inventions in defense of a bad case. That now also from the junior merchant Johannes Cornelis Heyning, not at my requisition, but likewise on behalf of his Lords and Masters in the manner as aforesaid, a statement under oath be demanded regarding the communication made by him early, I believe in April or May 1781, to Ross concerning the plausibility of the news of a war, his proposal how he thought one could act for the preservation of the Dhaka linens already contracted for and made ready, and finally that the original letter from Ross, in the hands of my brother and constituting Annex L.a A: to his memorandum, is the answer to that notification and proposed precaution. 4th. Declaring further that all the conclusions drawn from my Memorandum of March 1785 are considered by me to be erroneous, as placing in an adverse light my view, which was never by my excuse for attending the committee to grant acquiescence to incorrect reports, as it can never be denied that there were rumors of war; the resolution of this Council of 27 March 1781 (early enough) even confirms those rumors; what falsehood is there then in the Eilbrachts maintaining that those rumors really existed; according to their understanding a useful use could have been made thereof in the service of the Company; if that is not so now, let the Lords and Masters judge that; to what end so much spitefulness; why such time-wasting verbosity. I do not desire to explain who gave occasion or cause for the brought-up deficiency in the conversation, and the disturbance of the good harmony or sociability through what occurred in 1780; but when one recalls the event of 19 December of that year, and the violent infraction upon the right of domicile in the dead of night by way of public housebreaking by means of armed soldiers provided with loaded muskets, then committed upon my person and property, then truly one must stand amazed how anyone can come forth in defense of Ross, after one Annex A: a 354 355 6 april 6 april willingly sacrificed a fellow member of the assembly to such an unlawful public violence. Ross is defended; but who among his defenders is there who will provide the actual satisfaction for this public violence and the enormous damage caused thereby; it is true the garrison, after I had been carried off from my bed away from wife and children, and my emptied house was left as a prey, stood under arms at the meeting convened in the morning, the bullet was upon the musket; yet of this particularity no one dared demand that it should be noted down, along with the resolutions since annulled by Higher Authority, and it is now a painful answer to me to have to recall again such a striking event intended to cause deadly terror: from the simplicity of the recently received orders it also does not appear that this will seem pleasing; And since this is now dealt with publicly, I request the insertion of this address also into the general resolution of today, and an immediate execution for the Lords and Masters of the requisitions specified in the 1st, 2nd, and 3rd points; so that for those who have not suffered thereby, it must almost be tedious, having the honor to remain with due respect (was signed) Right Noble and Severe Sir and Councilors, after the reading of which, on the declaration of the Noble Lord Director that the requests appearing therein ought to be complied with so as not again, like recently, to experience the displeasure of the Lords and Masters, and his Honor's proposal made accordingly being approved and resolved to send a letter today to the Gentlemen of the English Government requesting authentic copies of the testimonies mentioned therein given recently at Calcutta by some of the Company's Servants regarding the surrender of this place in the year 1781 to the English arms, and pending the answer thereto in the meantime to have the requested statements provided by the Council members, the merchant Lodewyk Reael de Bas and junior merchant Johannes Cornelis Heyning, as desired by requisition of the Lords and Masters. Insertion of the defense of the Junior Merchant against the petition presented against him to the Lords Gentlemen Seventeen. the declarations being drawn up to comply with the further request made by the said Merchant Eilbracht, with the aforementioned authentic copies, as soon as received, to be presented to Their Honorable Right Worships; after which the aforementioned Junior Merchant Heyning, requesting an annotation hereupon, declared that it deeply aggrieved him to find himself drawn without his knowledge into a matter with which he has never wished to meddle, and that he was not inclined to comply with the requisition; but upon the demonstration by the Honorable Director that such was demanded of him by the Merchant Eilbracht in the name of our Lords and Masters, he declared for that reason to obey; of all which it is understood that a note shall be kept. Upon the petition presented by Roelof van Slaphorst and J: Gabriel La Font to the Honorable Right Worships the Gentlemen Seventeen, which was handed to the Junior Merchant Paulus van Grieken according to the note in the resolution of the 27th of the previous month, the following reply has been received today. In reply to the copy of the petition presented by the heirs of the late Mr. Moize La Font to the Honorable Right Worships the Gentlemen Seventeen, handed to me by order of Your Right Honorable and Honors, I request permission to assure Your Right Honorable and Honors that the balance due to the aforementioned heirs, with the interest accrued thereon, will without fail be remitted to them in the coming autumn. Insertion of and disposition on some remarks submitted by the merchant Eilbracht regarding the execution of an order of the superior authorities. Friday, the 9th of April Anno 1790. Morning; absent the Captain at Sea and Equipagemeester Sevien, to the anchorage of the ships. During the reviewing and collating of the dispatch prepared to be sent with the ship Het Spaarne to the Noble High Indian Government, for the signing of which the meeting was primarily convened, the following writing was submitted by the merchant Jacob Eilbracht: At the recent meeting of the [illegible] of this month, when the joint resolution of the 26th of last month was reviewed, the improper wording used therein regarding a certain writing and annexes submitted by me at the session of the 10th of August 1786 having been changed at my request, to have it bound as an appendix after that resolution, for which the word to insert was used, with the intention, if I remember correctly, that further deliberation would take place concerning the contention of the Noble Lord Director and the secretary, namely that that binding or inserting would take place with a brief description of the orders of the Right Honorable Lords Principals and the signature of the secretary alone by order of the meeting, and not, as I believed it ought to be, by all those who passed the aforesaid resolution of the 10th of August 1786 and on that day refused me the insertion of the one and the other; so may it be permitted to me, since this matter directly concerns me, to submit my opinion regarding this also in writing. It is very well known that it makes an infinite difference to bind in a writing or to insert it, that is, to incorporate it into another like a resolution. Now, the binding in, or even inserting with the aforesaid short annotation, solely by the secretary by order of the meeting, cannot be reconciled with the order and intention of the Lords and Masters, and of the Noble High Indian Government, both dictating that the rejected documents are still to be inserted into the secret resolution of 1786, thus to be accepted and adopted by the meeting and not by the secretary by order of the meeting; it being my opinion also that that appendix or annex to the resolution, with the date of 26 March 1790 at the head, and with the incorporation of a copy, or with the notification that this insertion has been sent separately in copy, as is often done with other papers, should also be sent in authentic copy to the Netherlands and Batavia; in proof that the aforesaid defective passage of the resolution of 10 August 1786 has been redressed and corrected, as ought to have occurred on the day of the receipt of the order or immediately thereafter. This my opinion and the decision to be made thereon, I humbly request may be entered into today's joint resolution. Below was written: Hoeglij, the 9th of April 1790. Signed: Jacob Eilbracht. By disposition on which, however much it was understood that it was all the same whether the meeting itself or the secretary by its order signed the appendix mentioned therein that is to be added behind the secret resolution of 10 August 1786, provided that one complied with the desire and orders of the Lords Masters and of the Noble High Indian Government by insertion of the writing with the five annexes mentioned therein; and the distinction made—that by the former signature those documents would be accepted and adopted by the meeting and by the latter, on the contrary, by the secretary, as requested—appears far-fetched; nevertheless, in order in this extraordinary case, of which there is no precedent here to serve as an example, not to make a misstep again and to meet the impatience of the High Rulers, as well as to give him, Merchant Eilbracht, full satisfaction, it was Approved and Understood to comply with his desire in this as well, and thus to have the said appendix signed by the meeting, but to refrain from sending it to both the Netherlands and Batavia, because the received order solely dictates the transmission of the copies of the writing and annexes themselves, as is done in the present dispatch with the first set and will take place on subsequent occasions with the rest, unless the Noble High Indian Government might be pleased to order otherwise in this regard. 361 363 9 April 9 April Item, of a note submitted by the Honorable Head Administrator concerning the affair of Mr. Ross. Blom and Bogaardt, and so it was agreed to record this hereby. On this occasion, regarding the subject, the declarations granted and sworn by the merchant Lodewyk Reael de Bas and junior merchant Johannes Cornelis Heyning pursuant to the request made by the aforementioned merchant Eilbracht at the session of the 6th of this month were also produced by the Honorable Director, both reading as follows: No 304. Today, the 7th of April 1790. Appeared before me, Teunis van den Broeck, First Sworn Clerk of the Bengal Secretariat, authorized and qualified in that capacity for the making and executing of all notarial deeds, in the presence of the witnesses to be named hereinafter: The Honorable Lodewyk Reael de Bas, merchant and first warehouse master in the service of the Honorable Company here, Who, after the request made for that purpose by the merchant Jacob Eilbracht by a petition inserted into the Hooghly resolution of the 6th of this month at the requisition of the Honorable High and Mighty Lords Majores and for the defense of the truth, declared: That in the year 1781 he, the deponent, was junior merchant and second warehouse master in the Company's service here, and thus had no seat on the Council of Policy, although he was a member of the Court of Justice. That he, the deponent, already in the spring of 1781 or in the month of May of that year heard talk of an impending rupture between the Republic of the United Netherlands and the Crown of England. That, among other things, being in Calcutta in that month, to the best of his recollection, at the house of the President of the Board of Trade there, Mr. Philip Milner Dacres, he had met in company the French merchant Monsieur Areau senior, residing at that time in Calcutta. That the said Areau had on that occasion told him that the Crown of England had declared war on the States, 2: 366 367 9 April. 9 April had declared war, but that he, the deponent, placing this communication alongside the other rumors circulating on the same subject, had given little credence to it, and had answered this by expressing his astonishment that the Crown of England, being already at war with three powers, could make yet a fourth into an enemy. That he, the deponent, upon his return to Chinsurah, which took place shortly thereafter, being convened to attend a meeting of the Court of Justice, had related the above-mentioned news publicly in the council chamber. That, however, no heed was paid to this story by anyone, for the reason that people generally agreed with him, the deponent, in the view that, namely, one could not expect that England would be capable of such a move, and therefore placed this among the general rumors upon which no reliance could be placed. That the deponent does not recall ever having expressed himself in such words concerning Mr. Ross as those of which the report speaks; that he could not do so because he believes that Mr. Ross knew no more of the war than others; furthermore remarking on the subject that people usually reason a great deal a posteriori about such matters. Who, following the request made thereto by the Merchant, Trade Bookkeeper, Dispenser, and Invoice Keeper Mr. Iacob Eilbracht in an address inserted into the Hoegly resolution of the 6th of this month, upon the requisition of the Right Honorable Lords Majores and for the defense of the truth, declared: That he, the deponent, from the year 1779 until 1781, stayed at Decca on behalf of the Company for the collection of the arrears from the former linen suppliers, and was also commissioned by the late former Director Johannes Matthias Ross for the collection of the Decca linens required for the Honorable Company. That he, the deponent, to the best of his recollection, in the month of March 1781, without being able to determine the precise time, received information from a certain English gentleman at that place, who had received a letter from London, that in England war with Holland was considered inevitable and expected daily. That he, the deponent, immediately thereafter wrote a letter to Mr. Ross, of which he has no draft, so that its contents are not fully known to him, but that he nonetheless remembers having informed His Honor of this news, with the request to know how he, the deponent, was to act with the goods in his custody in the event of a rupture with England. That he, the deponent, in reply thereto from Mr. Ross received the letter of which Mr. Eilbracht makes mention in his aforesaid address. Noble High Indian that the resulting scarcity of money will still considerably increase from time to time Decision to propose this to the Noble High Indian Government in the postscript of the letter now to be dispatched. by the disturbances in which the English find themselves entangled with Tipu Sahib, and which obliges them to export considerable sums of money from the Country for the support of their Troops, to which must be added that the prices, especially of some of those European goods, are this time charged considerably higher than previously, all of which gives reason to fear that on the stipulated advances, not even the charged prime cost will be recovered; Proposal to send the unsaleable items to Batavia. so, after this had been discussed at length, it was understood that some of those articles might possibly be of service at the Principal Place, and that it was rather to be preferred to send the same thither than to sell them here for whatever they might fetch or to retain them in hope of a better market, which is a distant prospect, whereby they would be subject to decay, since in both cases the Company would be exposed to certain loss; and accordingly it was Approved and Understood to propose in the Postscript of the letter now to be dispatched the poor success expected from the sale, and therefore respectfully to suggest to the same High Authority whether it would not be most expedient and most consistent with the interests of the company to send all such of those goods which might not fetch a 50 percent advance here to the Principal Place. The Honorable Director communicated that the poor success of the auction held yesterday, which was to be continued today, had caused His Honor to judge it necessary, before proceeding further therewith, to convene the meeting in order to discuss the matter and to determine the absolute lowest prices at which the goods may be let go; showing for that purpose that the auction, as is known to the present Members who attended, was conducted for Ready Cash, and that of the European Merchandise, with the exception of the Corals and a little Spanish green, nothing was sold, since the remainder, although buyers did present themselves for some Articles, could not fetch any price that could yield any noteworthy percentage above the purchase cost; arising not only from the very great scarcity of money prevailing generally throughout the country, but also because some of those goods are this time charged considerably higher than previously, or than those received in 1787 by the ship Hinloopen, by whose prices they had regulated themselves in drawing up the Indent against which those brought by the Spaarne have been supplied; in proof whereof producing the Invoices of both those ships, which, being exactly examined, it was found that: The Red Lead received with Hinloopen is charged at f11½ and that per the Spaarne at f15½ the hundred pounds. On the subject of the cargo of the ship Belvlied wrecked at Arracan, pursuant to the resolution taken to that end at the last session, the following words were written to Mr. George Syler at Kalkatta: To Mr. George Syler Sir, The Noble Director has this morning produced in our assembly a letter received by his Honor today from yourself, dated the 19th of this month, accompanied by another addressed to you by the commander of the sloop Tenng of the day before; With particular dismay we have learned of the absolute refusal of the Raja of Arracan to deliver up to you the salvaged copper from the wrecked ship Belvlied, and his desire to obtain payment for it, which was confirmed verbally to the Director by Mr. Lawson, with the declaration that he demanded fr: 25. per maund for it; although from his account that in that country there is neither law nor justice and everything depends upon his will and desire, we may not flatter ourselves with any change for the better, we have nevertheless thought fit, before coming to any decision regarding the proposition in your letter for the recovery of the copper fished up by that Raja, to delegate the Member of our assembly, the junior merchant Heyning, to you in order to learn from you at what price you would be willing to relinquish the copper salvaged at Arracan to our Company, in case we, setting aside the contract previously entered into with you, should authorize you to purchase the aforesaid copper from the Raja of Arracan for your own account and risk and convey it hither. — We request an answer to this as soon as possible, in order to be able to send you our final decision on this subject. 394 395 4 May 4 May To The Honorable I: Titsingh Esqr directed, after raising many difficulties against the proposal made to him, namely because at present so little reliance could be placed on the Rajah of Arracan, calculated that in case that monarch would still be satisfied with the price of 25 sr: for which he purchased the copper, the maund thereof, with the charges of provision money to his agents, premium of insurance, interest, and freight charges, would come to cost here in Bengal fr: 33: 6: 10, besides any commission or compensation for himself, which being added thereto would raise the price to the full value of that article in this country, as everything appears more in detail by that letter itself, which with the translation reads as follows: To the Honorable Isaac Titsingh Esqr Sir, I have been honored with your secretary's letter of the 20th instant informing me that your Honor had deputed Mr Heyning, a member of your Council, in order to confer with and be informed by me at what rates I should wish to deliver the copper which might be obtained from the Rajah of Arracan, in case you should, in deviation from the engagements I had entered into, authorize me to purchase the said copper from the Rajah and to convey the same to this country on my own private risk and account. I have explained to Mr Heyning that my reason for desiring either to be authorised by you to purchase this copper or to be exonerated from any further charge or commission from you relative thereto, arose from my not conceiving myself at liberty to make any such purchases from the Rajah on your account without first affording you the option of determining thereon. Right Honorable Sir and Gentlemen, Having been ordered by your Honors by resolution of the 20th of this month to make inquiries with Mr Tyler at Calcutta as to how much the Japanese bar copper, which according to his letters is now being fished up by the Rajah of Arracan from the lost ship Belvliedt and which according to the reports he received from his agent there he could obtain in preference to other merchants at the price of 25 rupees per maund, could be delivered here with all expenses calculated thereon; I have the honor hereby to report as the outcome of that commission that I repeatedly spoke to the said Mr Tyler concerning this and made the necessary proposals, but found him entirely disinclined to engage himself definitely; giving as reasons that because the Rajah had already shown he did not keep his word, he could thus suffer much more disadvantage than had already befallen him in obtaining the small portion already delivered here; that even if he could obtain the copper at 25 rupees per maund, it would with all expenses amount to about 34 rupees, not counting commission fees and compensation for trouble, which together would thus bring the purchase costs very high; to which Mr Tyler, as proof of the Rajah's already demonstrated inconstancy and arbitrariness, also brought to my attention how that prince now demanded payment from his agent for the copper already fished up, calculated at the price that was offered for it, without caring about the protest made against it and concerning the breaking of his previously given word; declaring on that account that he considers his previous engagement null and void and at present cannot enter into any new one, except in an indefinite manner for the purchase with reimbursement of his expenses and commission, and prior cancellation of the previous contract. My commission having thus ended fruitlessly, I further request permission to give as my opinion that all the difficulties mentioned above clearly seem to demonstrate that Mr Tyler only sought to make the requested authorization palatable in his letter in order to have an opportunity to indemnify himself for the losses which he says he has already suffered, and for which the means would certainly have been provided to him if the requested indefinite authorization had been granted to him, which ultimately and in the end would have turned out to the disadvantage of the Company. 402 403 4 May 4 May Insertion of and decision on the findings. to fetch than that mineral currently commands in Bengal, from which therefore no benefit is to be expected, apart from the fact that this depends entirely on the arbitrary pleasure of the Raja of Arracan, who, as Mr. Syler himself seems to assume, would likely not fail to increase his demands in proportion to his finding that there was speculation in that article, which is also the reason that gentleman gives for the unlimited authority which he requests, although it may well be established that the principal motive is to indemnify himself thereby for his incurred losses; that on this account the granting of such indefinite power for the purchase of the copper is far too perilous even to consider, and on the whole it ultimately appears best to abandon entirely this project proposed by the said Syler. Which having been fully agreed to by the meeting, it was judged better, however painful it may be to have to give up almost all hope of recovering anything further from that considerable cargo, not to accept this proposal than, through an enterprise which promises harm rather than advantage, to expose the Company to even greater losses, and consequently, upon the aforementioned proposition, it was approved and resolved to reject now entirely the proposal made by the said Mr. Syler, and to release him, at his persistent request, from the Contract previously entered into with him, which had already to be regarded as lapsed when, by his letter of 10 March last past, inserted in the resolution of the 25th of that month, he stated that all further efforts in that respect could no longer be of any use, and he abandoned the undertaking as impracticable. Proposal of the Noble Lord Director to also honor a certain untimely bill of exchange drawn from Ceylon. producing the engrossed deed of the surety posted for his service in the sum of fl. 8000 by the Cassimbazar Chief, the Honorable Cornelis van Citters Aarnoudsz, and the Junior Merchant and Secretary of this assembly, Fredrik Wieman, that document, after resumption, was returned to his hands to be preserved along with the others in the large safe, whereof it is likewise understood a note shall be kept. A Drummer being lacking in the Garrison, it is resolved on the proposal of the Noble Lord Director to take into the Company's service as such the youth Jan Willem Gaije of Patna, aged 17 years, and to grant him the wage of Eleven Guilders per month under a contract of five years, commencing the 20th of April last, since which time he has already served. Subsequently, the Noble Lord Director communicated that these past days there had been presented for acceptance a draft issued by the Ceylon Government under the 11th of March past upon this Directorship for a parcel of Rice delivered there to the Company by the English Cargo Dakemedij and amounting to Surat rupees 2285 1/0, which draft His Honor noted would indeed be difficult to pay on account of the small supply of money, which permits no other disbursement than the usual monthly ones for board, wages, and other highly necessary household expenses, while all further orders on the treasury must remain unpaid, and that the credit of the company, which otherwise here in Bengal has already sunk to a deplorable low, would suffer too much among the foreigners if one refused to accept and settle the same, all the more when taking into consideration the cause from which this debt, namely a delivery of Rice, springs; for which reasons 414 415 4 May 4 May to request the Gentlemen of Ceylon to refrain from further drafts on the upcoming occasion. Resolution in conformity therewith. A certain letter written to the English, in which copies of some declarations are requested, inserted. and the aforesaid Honorable proposed to accept the thought draft and to pay it on the due date, but on the upcoming occasion to inform the Gentlemen in Ceylon of the inconvenience which such drafts cause this Directorship here, because our own necessity does not permit discharging them and the credit is so slight that even at an interest of 15 to 15 percent no cash can be obtained, and moreover on that account to request that in the future they refrain from all further drawings, even if the sums were ever so small, as otherwise, however painful this must be, we will be obliged to protest them; with which the assembly having agreed, it has been approved and resolved to accept the thought draft in the manner aforesaid and to have it paid on the due date. 418 419 4 May 4 May To Edward Hay Esqr, Secretary to the Government In obedience to the commands of the Governor General in Council communicated to me in your letter of the 12th instant, directing me to obtain, for the Director and Council of Chinsurah, authenticated copies of the affidavits given lately by some of the Dutch Company's servants who came to Calcutta to give evidence relative to the surrender of Chinsurah in the year 1781, provided the forms of the court would admit of my doing so, I made application to the honorable the judges of the Supreme Court to whom the commission, for taking such evidence, issued from the High Court of Admiralty, to know whether such request of the Director and Council of Chinsurah could be complied with; and, in reply, I have to request you would inform His Lordship that the judges are of opinion that, as it is the practice of the High Court of Admiralty in England that all depositions of witnesses should be kept secret until the evidence on both sides is finally closed, they do not think themselves at liberty to deviate from that practice here and consequently cannot authorize the delivery of the copies required. A letter was received during the meeting from the servants at the office named in the margin, dated the 1st instant, whereby they give notice that due to the fierce north-west winds, first the topmast and thereafter the flagpole itself cracked and was blown down, so that both timbers have become unusable, and as the servants cannot obtain any of that kind there, they must make do with a bamboo for the present, requesting to be provided with what is necessary for the repair of the said mast, both in wood and rigging. Therefore, since due to the misfortune that befell the Belvliet last year one is deprived of the naval stores that could serve for this, and the erected bamboo can suffice provisionally, it is resolved to keep the disposition on this letter in advice until the arrival of the ships.

423 4 May Detail of the disasters that befell the vessel Spaarne, dispatched here in April but recently returned. requested to wait until the arrival of the ships, in order to provide both of them with the necessary items if the supplies then permit. After concluding the matters described in today's separate resolution, the letter received on the 14th of this month and already circulated among the members from Sea Captain Hendrik Anthony Stoele, commanding the vessel Spaarne recently dispatched to the capital, was reread. The vessel reached the open sea on the 18th of the previous month and then, according to the report of the pilot who brought it out, had a favorable opportunity to continue the voyage. In this letter, he, the Captain, gives the unpleasant report Wednesday, 26 May Anno 1790.
