596 597. 26 October 25 October Decision to obtain the opinion on the subject of some Calcutta merchants, to mark them and to sell the same as such in satisfaction of his private claim, which was well understood would not stand in law, yet taking that course also not appearing advisable, since litigating before the English court is so expensive that it is to be feared one might possibly have to pay more in expenses than the chank shells are worth; thus, before proceeding to any final resolution in this matter, it was deemed best to take the opinion of some of the principal houses of Calcutta on it, and consequently it was approved and agreed to present the matter in all its circumstances to those gentlemen and to request them to consider it and give their opinion on the following points, namely: Whether the freight money agreed to with Capt. Elliot must be paid in full, or only a part thereof in proportion to the quantity of chank shells that one is to receive here; Whether Mr. Allardice has the power to detain the chank shells for his private claim on Capt. Elliot, and whether he can claim to receive the freight money without proper qualification from the same; Whether it is fair, if the agreed freight of st: 3500:: is paid, that he additionally still claims the remaining 5 to 600 Rupees for freight from Madras, warehouse rent, and finally; What Their Honors judge to be the best and most suitable means to arbitrate and settle this dispute amicably and thus without taking the legal path; as well as to send the aforementioned Junior Merchant Blume, 598 599 26 October 26 October insertion of a decision on a aforementioned, who has been informed of everything concerning this and attended the deliberations held hereon, thither in order to give those gentlemen clarification and instruction on all that might further be necessary, and also to pose such further and additional questions as he shall judge serviceable to the matter. 600 651 26 October 26 October Tuesday 1790, absent the members Levien and Heijning. An indication prepared by the Honorable Visitor General J. M. Neun concerning the apparent balances in the Bengal trade books of the year 1787/8 having been examined, along with the marginal decisions of the Honorable High Indian Government on the latter, and on both the written considerations of the Honorable Head Administrator, it was resolved ordinary to act with regard thereto in such manner as is noted alongside each item and may be seen in the documents themselves, which are inserted here. Invoice of account concerning that which, by order of the Honorable, High and Mighty Lord Hendrik van Stockum, First Councillor and Director General of the Dutch East Indies, was caused to be counted and charged to Bengal, consigned to the Honorable, Valiant Lord Mr. Isaac Titsingh, Extraordinary Councillor of the Dutch East Indies and Director, together with the Council there. Pursuant to Their High Noble Honorings' esteemed resolution dated 11 May 1790, this Directorate was charged with the following, in order to have the Equipage Master in Bengal, Pieter Levien, reimburse the purchase cost on account of the excess charged in the expense account of the ship Straalen, namely: For a cable rope of 8 inches, used in taking in and stepping the mast of the ship Straalen, which cannot have been so worn out as to be entirely useless, but could still have been used at Batavia in the Castle at the end of February 1790 as a buoy rope. For two iron hawsers for lashings to the masts against the shifting of the pack said; this could have been done with old tackle falls, since these could not be so worn out in one voyage as to be entirely unusable. Sundry canvas charged in the lump, which cannot be verified: 50:10:—. 1½ bolt of white Holland duck canvas for making the voyage, which is not provided here: 18:11:8. 1 barrel of tar, which was supplied to that vessel in excess, two having been charged. 45 measures of forge coal charged in excess, it being considered that 30 measures were sufficient: 31:7:—. For the postage of letters sent on date 15 May of this year per the packet boat the Expeditie to this Directorate, amounting according to the statement of the postmaster to rixdollars 15:45, or ducatoons at 3:6 each: 38:11:—. It has been approved and agreed, after resumption, to write off the item for stolen goods at Pegu of ƒ35342:5:— and to enter it within the lines in the Directorate Journal for memorial. To the Right Honorable and Venerable Lord Mr. Isaac Tilsingh, Extraordinary Councilor of Netherlands India and Director over the Company's Interests in Bengal, together with the Members of the Political Council. In response to the accompanying marginal note from the resolutions of the Government of Bengal under date 29 January of the year 1787/8, the undersigned informs that, according to the accompanying order, the stolen goods at Pegu should be settled to the debit of the Bengal office and recorded within the lines in the Directorate Journal for memorial at ƒ35342:5:—, while allowing the current account of these stolen goods at Pegu to remain on the Bengal trade books. Marginal Note of the Apparent Balances as they were found in the Books of the Year 1787/8, with indication of the necessary redress. Debits and Compensations: ƒ1463:6. 632 633 26 October 26 October conduct pursued by the Patna Resident regarding the saltpeter In approval of the conduct pursued by the Patna Resident that as soon as the received silver was minted, the required cash was to be provided upon receipt, or without awaiting the outcome of that promise, which on that account being considered an unnecessary precociousness and haste, serving only to make the Company bear interest that was very easily avoidable; wherefore also by letter of the 11th of this month, when orders were sent to him, Baumgardt, for the receipt of the aforementioned sr: 18000:—: from the English Treasury, this negotiation was disapproved, and thus the needlessly wasted interest left to his account; so it has been resolved and understood to record all this as such herewith. By the said letter of 27 September, the said Resident having further informed that upon receipt of the order thereto, he had addressed the English Resident directly for ten thousand maunds of saltpeter and had obtained an assignment for it upon the various English factories, thus also for a part or 5000 maunds at Mouw; but that the saltpeter there differed very much in quality from that of other places, and its receipt, besides being exposed to infinitely more costs and danger due to the remoteness, he had demonstrated to that gentleman by a letter that the Calcutta government had already many years ago permitted that no more saltpeter for the Dutch Company should be delivered at Mouw; with the result that the established orders in that regard have been changed, and 6500 maunds were to be received at Chupra and 3500 at Singhia; Resident so it has been resolved and understood to approve the conduct pursued herein by him, the Resident, and herewith to insert the copy correspondence transmitted by him on this subject with the said English Resident. 634 635 26 October Edward Ephraim Pote Resident on the part of the Honble English East India Company To J. 640 641 26 October. 26 October. A certain account made at Patna for the shipment of saltpeter from Patna to this place having been presented, it was approved and understood to pass the same as well. Alongside the frequently mentioned Patna letter of the 2nd of this month, an invoice of account amounting to ƒ 82: 19:- was also received for the cost of 19 pieces of Lachorias that were brought short by the Chamber of Delft from the cargo of the ship Het Huis te Krooswijk in the year 1779, and according to the resolution of this table of 8 August 1786 were charged to Patna to be reimbursed there by whoever is liable. But upon representations made here that those goods were not delivered and dispatched there, but here, and that the reimbursement therefore belongs here, that office was relieved thereof at the session of 17 October 1786. And by disposition on the report concerning the charges and reimbursements for the year 1788/9 dated 2 March of this year, it being ordered to charge that amount back here, which has now actually been done, it subsequently appears, upon examining the papers brought into the meeting concerning this matter, that the bale of Lachorias marked No. 474 dispatched from here with Het Huis te Krooswijk in the year 1778 was charged to the Chamber of Delft by invoice of that ship dated 14 November 1778 with 100 pieces of the third sort, whereas according to the unpacking book from the Dallaan it only contained 81 pieces of the third sort. And that on account of that erroneous billing, which subsequently was not redressed as is otherwise always done upon discovering any committed mistake, the reimbursement ought to be borne by the drawer of the said invoice, being the recently deceased Senior Merchant and Head Administrator Anthony Boogaardt, it was approved and resolved to have that small sum paid into the Treasury by his heirs. In conclusion, it was understood to note that according to a further Patna letter of the 10th of this month, the saltpeter to a quantity of 10000 maunds was already dispatched from there the day before in 17 vessels under the convoy of the Daroga Goseratsingh and the necessary peons, to whom 30 Sicca rupees were provided for expenses during the journey, to be accounted for here. Today being the appointed day for holding the advertised public sale, the members were convoked by the Honorable Director to the council chamber prior to the start thereof, in order to deliberate at what prices the merchandise, and in particular the Japan copper, which is at present the principal article and to which the greatest value attaches, should be knocked down, since necessity requires selling the same, if not entirely then at least partially, for cash in order to provide for the need thereof. For His Honor declared that the bar silver recently received from the main settlement could absolutely not be employed for anything other than satisfying the requisition of the recently received Indian Demand for 1791, and that consequently from the proceeds of the merchandise there had to be found what else was needed, consisting: 644 645 9 November. 9 November. Firstly, in a sum of around Sicca rupees 10000, which the goods requested in the aforementioned Demand exceed the silver brought in, and thus need to be supplemented in order to fulfill the entire Demand. Secondly, in an amount of approximately ƒ 7: 80000:—, being what the warrants issued on the treasury and remaining unpaid as of the ultimate of August last sum up to, the holders of which—who for the greater part are the respective Administrators, and who, for the continuation of the service, have successively had to negotiate the necessities in their administrations at up to 12 and even 15 percent interest—daily complain to His Honor about this and demonstrate that they are ruining themselves by this and can keep it going no longer if they receive no payment to relieve themselves of that oppressive interest. And Thirdly, in what is required to cover the expenses for the shipment of the aforementioned Indian goods, the necessities for the ships and vessels, and the further unavoidable household expenditures at least until August next, which, added to what is required for Cossimbazar and Patna, will also constitute a considerable sum; for the satisfaction of all of which there is no more in stock than Sicca rupees 6603: 15: 12/35, as appears by the statement made of the balance of the small treasury as of the ultimate of the last preceding month, which was inserted here as follows: Right Honorable Sir, Mr. Isaac Titsingh. This is, for the present, the state of those matters, which the Director and Council aforesaid request Your Honor to consider and to provide Your Honor's opinion thereon: whether the freight money agreed upon with Capt. Elliot must be paid in full, or rather only a part thereof in proportion to the quantity of chank shells that one is to receive here; whether Mr. Allardice has the authority to withhold the chank shells for his private claim against Capt. Elliot, and whether, without proper authorization from the same, he can demand and receive the freight money; whether it is equitable, if the agreed freight of 3500 rupees is paid, that he additionally demands the remaining 5 to 600 rupees for freight from Madras, warehouse rent, etc.; and finally, what Your Honor judges to be the best and most suitable means to settle and resolve this dispute amicably, and thus without entering into legal proceedings. The aforesaid Director and Council will be most grateful to Your Honor for this trouble and courtesy, and have instructed Mr. Blume, the bearer of this, who has acted in this matter thus far, to provide Your Honor with all further clarifications and information that might be necessary, as well as to put forward such other and further questions as he shall deem expedient to the matter. 664 665 25 November Case 25 November On the 9th of February last, Captain John Elliot, commander of the snow Crofts, entered into an agreement or charterparty with the Government of Ceylon to receive on board his vessel on freight, in the port of Tuticorin, 300,000 chank shells, the freight of which would be paid to him in bills on the government at Chinsurah; a translation of which agreement or charterparty is annexed hereto, marked A. Captain Elliot accordingly received the chanks and undertook the voyage to Bengal therewith; on the [illegible] day of May last he arrived in Madras Roads, and having come into great distress through springing a leak, he called his crew and officers to a council of war, wherein it was proposed, since they expected that the vessel could not remain above water many hours more, as they already had four or five feet of water in the hold, to transship the chanks on board another ship then in the roads for the best benefit of the concerned parties. This having thus been resolved, and Captain Elliot having persuaded Captain Newton, commander of the Pesiton, then in the roads, to transport the chank shells on board his ship on freight to Bengal, he immediately began transshipping the chank shells on board Captain Newton's ship. But before he could transship more than a third of the quantity, his ship, the Crofts, in that condition in which it then was, was driven from the roads and was irreparably wrecked close to Coringa, with all the chank shells that were still on board.
