158. 158. Monday the 18th of October, 1790. — Monday the 18th of October 1790. — is; yet alongside that strict recommendation, the severity thereof has generally been notably mitigated, as it is fully agreed at the end thereof that the rigor of that law ought to take effect only in the armies in the field and in places besieged by the enemy, consequently only in times of open war; apart from and besides the fact that, in the most recent articles of war drawn up in the Netherlands by Their High Mightinesses for the Honorable Company on the 4th of September 1742, in the 33rd paragraph toward the end, no specific punishment is stipulated against such military personnel who run away to other places or to others, nota bene not being enemies. Which last-mentioned articles of war and recent law of the Sovereign were once again, and further with that same indefiniteness regarding this punishment, renewed with some minor changes by Resolution of Their High Noblenesses on the 14th of October 1747. In conformity therewith, and serving as a further explanation of that indefiniteness, Article 18 of the military orders adopted in the assembly of Their High Noblenesses on the 27th of December 1753 was also framed, against which aforementioned military absconders or deserters from one garrison to another or elsewhere—that is to say, what should be well observed according to the clear interpretation of the aforementioned most recent articles of war, to others not being enemies—are denounced to the punishment of body or life according to the circumstances of time and matters, just as in the aforementioned 12th clause adduced by the military ordinance of the 25th of July 1628. It being sufficiently evident from what has just been advanced that the death penalty cannot lightly be applied for the committed desertion alone, one might nevertheless object that, since the same was aggravated by scaling or descending the city walls, it must absolutely take place, because even among the Romans the walls of a fortress were held as sacred and the scaling thereof was punished with death, as one finds described in the Corpus Juris, Book 2, Chapter 1, No. 10, Institutes; of which opinion Petrus Pappus also appears to be in his Corpus Juris Militaris, because in his general collection of the Articles of War at Article 46 one finds it noted thus: that the soldier or commander who shall go out of the camp, city, or fort, or come in by another way than through the gates and ordinary roads, shall be hanged or strangled; which punishment one must presume to be very applicable to such military men to whom that law is read out and made known monthly with the articles of war; but since no mention is made thereof in our articles of war, however necessary it may be, one might assert with good reason that, while the aforesaid deserters can and may claim complete ignorance in this matter, they ought to be released with an arbitrary punishment, especially because one must by no means punish the crime for the sake of the past offense, since that can impossibly be corrected or made uncommitted, but rather so that the perpetrator may not sin against anyone, nor the others follow his example in committing offenses; wherefore, salvo tamen meliori, it would be most useful and salutary that, provisionally regarding the scaling of the city walls, 160 161. Special regard being had to the Deserter Johannes Medenbach, who during the interrogation claimed to have committed a murder in Leeuwarden and therefore to be weary of his life, it being taken into consideration that he probably an order or law be devised whereby a specific punishment be imposed on those who in the future make themselves guilty of a similar crime, all of which could be read out monthly to the military personnel with the articles of war, until such time as it should please Their High Noblenesses, the representative sovereign, to make further disposition in this regard, or to amplify the current articles of war therewith. 162 163. Monday, 18 October 1790. — Monday, 18 October 1740. — To have the committed desertion punished by running the gauntlet, and afterwards handed over to the Fiscal for investigation. Observation on the military articles of war. Climbing over the city ramparts. Punished of old by death. To have read aloud. Shall in the future be punished capitally. Resolution to establish a statutory law. Desertion over the walls and moats of the city beginning to become quite common. Pretended, in the expectation that he would therefore be sent to the Netherlands and thus escape the punishment for desertion, and that at least upon this confession no justice can be done, as the corpus delicti is not evident, but that the prisoner, whether it be true that he committed the murder or not, ought to be punished for the desertion, without prejudice to and reserving the investigation into the reported murder; thus, it was approved and agreed by a unanimous vote to have the prisoner, like the others, punished for the committed desertion by running the gauntlet, and subsequently to place him in the hands of the Fiscal for the investigation of the homicide with which he has accused himself. On this occasion, it was taken into consideration that, according to the latest military articles of war, Section 18, which is read out here every month, deserters shall, according to findings, be punished capitally, and that this crime of desertion becomes considerably greater when it is accompanied by climbing over the city ramparts, so much so that such deserters were of old put to death with the rope at the gallows or the garrote, that deserting from this fortress over its walls and moats has for some time begun to become quite common, and provision must therefore be made against it through severe punishments, but that in the aforementioned articles of war this case is not explicitly stated and thus the punishment for it is not defined. Whereupon, having deliberated, following the proposal made to that end by the Governor, in accordance with the required advice of the Honorable Fiscal of this Government, it was approved and agreed by a unanimous vote to enact, as is enacted hereby, that such deserters who henceforth climb over the city ramparts, under which the outworks are explicitly included, upon apprehension, shall not be punished with the military punishment of running the gauntlet customary here, but shall be punished capitally and to that end be handed over to Justice; and it is likewise approved and agreed that this extract shall be read out every month alongside the articles of war to all companies, both European and native, the artillerymen included therein, so that no one may plead ignorance thereof, while it is further agreed to request the approval or further disposition of the High Indian Government hereon. Upon a submitted report from the Honorable Chief Administrator Van Spall regarding the stamped papers produced and sold from the first of March to the end of August of this year, it was resolved to insert the same below. The undersigned overseer of the armory has the honor very humbly to report to Your Right Honorable High Esteem that besides the 1308 muskets contracted out to him for repair, more unserviceable muskets have been discovered in the armory, of which 897 more muskets have been repaired by him up to the last day of August past and delivered to the commissioners, wherefore the undersigned respectfully requests that a separate payment may be made to him for those further repaired muskets as well as for those still to be repaired, because he also had to hire private craftsmen for that purpose, as was done for the abovementioned 1308 pieces. Monday the 18th of October, 1790: — Monday the 18th of October 1790: Summary of the report of the tree counter The orphan masters request that a bond amounting to twenty-five thousand rupees be canceled contained in the Extract Resolution of what was dealt with and resolved in the Council of the Indies, under date of the 23rd of July 1736, the undersigned having been appointed as commissioners to see the accounting, vouchers, and balance of his administration rendered by the aforementioned Secretary, they have found upon the examination carried out that as of the end of February of this year no cash remained held by the aforementioned Secretary. After which, since the first of March until the end of August last, there was successively received on account of the Lord's Dues from sold Houses and Grounds one thousand one hundred and fifteen rupees; he has furthermore shown us a receipt from the Honorable Cashier Mr. Jan Willem Hendrik van Rossum, of the end of August aforesaid, showing that the aforementioned 1115 rupees have been properly paid into the Company's small cash treasury, so that the receipts from the first of March of this year to the end of August last agree with the expenditures and as of the last-mentioned date no cash remains held by him.
