307 308 21 June 21 June cession of this meeting to obtain an in that Article with that Nation. - which would accrue entirely to the Company reasons for which a favorable change in this matter might be expected. - The Lord Director, on the subject of the French, without being privileged by better or stronger equal status, with a humble request to be pleased to consider favorably what benefit it would bring to the Company and private individuals if they could be so fortunate as to hope for the powerful intercession and influence of this meeting, as they emphatically implore it, so that, if it cannot be obtained according to the spirit and meaning of the Company's privileges to allow all private individuals to carry on a permitted trade, and especially in coast salt, they may at least in this article enjoy parity with the French, because our right to this in any case weighs just as heavily, according to the wording, as theirs; transmitting, in support of what has been set forth above and to show what benefits would thereby accrue to the Company at the factory of Jagernaikpoer alone, an extract of a letter from the officials there under date of 11 April last, in which it was stated that the lease of the salt, which currently yields the Company no more than 250 pagodas per year, would very likely grow to 1000 pagodas per year through the free export of that article. - Remarks of the Honorable All of which having then been attentively considered, and it being understood with the Honorable Lord Director that, however much the Ministers' remarks concerning the arbitrary duty imposed on coast salt by the Government of this Country—which was subsequently changed into a formal prohibition against the import of that article—are fully grounded, and however much it must also be acknowledged that, although this article does not constitute a branch of trade for the Company, it could nevertheless be of considerable benefit to the inhabitants of the mutual colonies, there nevertheless appears to be no possibility of bringing about a favorable change in this matter here in Bengal; that the Lord Administrator Eilbracht must be convinced of this, as having been present in this meeting when, in the month of April 1780, the enormous duty of 30 rupees on the import of 100 maunds of salt was issued, and subsequently, in January 1786, the final prohibition against it was promulgated, and thus cannot be ignorant that, having deemed it expedient at those times to accept what was imparted in that regard for information, it was left at that; that His Honor also cannot be ignorant of the vigilance since displayed by the English Government to maintain this monopoly introduced by them and not to tolerate any infractions thereof; that, as further evidence thereof, what recently occurred upon the return of the sloop Patna may serve as a further demonstration, whose quartermaster had imported some salt that had been given to him by the Junior Merchant Eilbracht as ballast and as a present for services rendered, yet was not permitted to sail up with it unmolested without this affair, however insignificant, being treated as a national matter, as the correspondence held on the subject with the English Government, inserted in the separate Resolution of 15 March last, demonstrates in detail; that, with regard to the Ministers' remark concerning the privilege which the French enjoy over our Nation with respect to the salt trade in this Country, and the argument that their ancient privileges, in comparison with ours, by no means give them any greater right to it, one can only lament with the Ministers the hardship that is therein contained for us, noting, however, that this privilege was obtained by them only through vigorous efforts made thereto by their superiors in France at the conclusion of the latest peace with the Crown of England, it being very expressly stipulated in the Treaty that the French Nation should have the liberty to import a certain quantity of coast salt, which was subsequently fixed at 200,000 maunds. Resolution on the subject: It was therefore resolved, upon the proposal of the aforesaid Honorable and Worshipful gentleman, to reply to the Coromandel Ministers with these various points, and to send them, in confirmation of what has been alleged above, an extract from our resolution of 10 January 1786, in which the regulation cited above is inserted, as well as a copy of the correspondence held with the English upon the arrival of the sloop Patna, both to demonstrate that there is no prospect for this meeting, by addressing the Calcutta Ministry, to expect a favorable 309 310 21 June 21 June the recent incident with the sloop Patna. -

21st June 21st June and to thank the ministers for the forwarded letter packets. Contents of the Ceylon letters the Surat advices to Europe and Batavia received complimented on the prospect of peace with the Candian Court the requisition of necessities shall, as far as possible, be fulfilled. to flatter oneself with a favorable outcome, on the contrary, that after all that had occurred, one would expose oneself to an immediate refusal, since the same would appeal to their inability to consent to this branch of trade without the prior consent of their superiors in Europe; with the further remark that it does not appear improbable to this meeting that the Ministers here might succeed satisfactorily in this regard by a direct application to the Honorable and Highly Esteemed Gentlemen Directors, so that an object of that importance might be brought about in Europe through their highly wise arrangements. The other Paleacat letter, or the one of the 15th of the said month of May, containing no points for reply other than merely serving to accompany two letter packets, namely one from Ceylon and one from Surat, along with the ministers' copy of advices to the Honorable High Indian Government under the date of 21st October of the past year, it was agreed to acknowledge the receipt thereof and to express thanks for their dispatch. Regarding the aforementioned Ceylon letters dated 6th and 15th April last, the first of which only serves to accompany the requisition of necessities for that Government dated 23rd December 1790, while the other is directed to the communication of the good outcome which the ministers' efforts toward maintaining peace with the Candian Court would likely have, it was agreed to reply that their requisition, which has already been commissioned by order of the Honorable Director, will be fulfilled as soon as possible as far as silk, silk fabrics, and linens are concerned, since, as far as the gunnies are concerned, one will have to excuse them this time for the reason that it is not possible from here to find suitable shipping opportunities for their transport; and regarding the joyful news contained in the second letter of 15th April, to express the satisfaction of this meeting concerning it while conveying its compliments of congratulation in that respect. The letter from Surat mentioned herebefore being solely directed to accompany copies of the advices dispatched by the Ministers in the latest season to the High Honorable the High Indian Government, it was agreed to acknowledge its receipt; while at the same time, in compliance with the order of the said High Honorable Gentlemen to keep the correspondence with the ministers in the West ever lively, and to that end to write to them at least four times a year, it was resolved to let a letter also go out on this occasion to the ministers on the Malabar coast, although at present there are no matters to transact with that Government nor any of their letters to answer. These matters having been settled, the aforementioned Honorable Director produced a letter recently received by His Honor from a certain English gentleman residing at Sjoppra named Fitz Roy, in which he gives a description of the ruinous state in which the Company's buildings there are found, offering to enter into negotiations with His Honor for their sale, for the reason that he, being engaged in erecting some buildings, judged that he could make use of the old bricks that could be retrieved from the ruins, as the letter itself shows at large:

Sir, Although I do not have the honor of being personally known to you, yet the knowledge I have of your character lessens the reluctance which I otherwise should feel in taking the liberty of addressing you privately on the present subject. When you please to take this into consideration, I trust that you will excuse me for troubling you with this letter. As I understand that the Dutch Factory at this place is to be sold by public auction, and as I am busy erecting houses and outbuildings, I shall consider myself fortunate to be able to purchase it and enter into a private negotiation for it, since I shall have no opportunity to be present at the public auction. I shall esteem myself very much obliged to you if you would please sell it to me in such condition as it is now in, and at the same time inform me of the price that must be paid for it, so that, in case the terms are acceptable, I may order my agents to pay the money to you. I have lived in it for two years, and during that time made such repairs as its condition permitted, everything being very ruinous; and I dare assure you that had I not inhabited the house, it would long since have suffered the same fate as the Singhia Factory. About a year and a half ago, in spite of all my efforts to remain in it, I was obliged to abandon it, as the heavy rains and white ants, which had eaten through all the beams, caused everything around me to fall down. I assure you I do not say this to diminish the value of that property, but merely to show you the truth; for it will not be difficult for you to verify the accuracy of my reports through your gentlemen at Patna, who can give you information about it. 32. 1 322 29th July The Factory of Sjoppra, consisting; Firstly of a very dilapidated stone building, being an upper and lower house of two galleries and eight rooms on the first floor and ten rooms, two galleries, and two verandas on the second floor; furthermore stables, a kitchen, and some other small outbuildings, alongside 16 warehouses. All built on a piece of land measuring 2 Bigers and 4 kattas and enclosed within a ring wall. The Carganna which lies next to it, on which saltpetre was previously distilled, which piece of land measures 15 kattas. Secondly, A garden which lies opposite the Gate and the road of the Lodge, in which there is a dilapidated garden house, an avenue of 101 trees, some fruit trees, and a tank or pond; all enclosed partly by a stone wall and partly by an earthen wall; this garden measures 5½ Bigers. Thirdly, The Village of Douletgendjs which lies around the Lodge and further outwards, containing 72 Bigas and 11 Kattas. All these lands, amounting together to 81 Biggas, for which 237:-.- guilders is paid annually to the government for ground rent, for which the owner holds the Privilege to collect the ground rents of 564 houses standing on Dourlet gendij amounting to circa 600 rupees without more, have been bought by Poraankissen Sukkerbettie for the aforementioned 1620 rupees, and the purchase took place in the following manner. 29th July The Factory of Singia, Consisting Firstly of a stone building of two storeys, containing both upstairs and downstairs 2 galleries, 2 rooms, and a veranda, furthermore a pantry, kitchen, peons' quarters, and two warehouses; Secondly of the terrain belonging thereto measuring circa 13 bigas on which stands a pavilion and many fruit and other trees and which is provided with two ponds. Thirdly of A piece of land that lies close to the same, measuring 1 Biga and 2 kattas, which is planted with various trees, though over which a public road runs; so that these two grounds together measure 14 Bigas and 2 kattas, of which must be paid to three zemindars 568 rupees and 9 annas annually for ground rent. Fourthly; of a piece of land situated half a mile outside Singia, named Loggie na Baag, measuring 2½ Bigeis, which is free of burdens. All these grounds, which yield the owner circa 60 rupees annually, have been bought by the Bookkeeper and ordinary commissioner in the Trade Warehouses Hendrik Albrecht Dolle for 100 guilders. The factory of Fettua, consisting solely of a stone Warehouse 56 cobidos long, 11 wide, and 10 high, and occupying with the land belonging thereto about 1 Biga and two kattas, for which no ground rent is paid, while its income, or what the inhabitants of some small shops standing on the ground yield, amounts to ten annas per month. Bought by Laal Beherrie for 227 rupees. From all of which it is understood to keep this note, taking into consideration that the small amount of 1947:-:- guilders which all those possessions have yielded together corresponds all too well with the apprehension raised by the Honourable Director at the recent session, and cannot be considered otherwise than as a natural consequence of the deplorable condition in which this Country finds itself through the general decline of commerce; while thereunto also contributes not a little the Monopoly concerning saltpetre introduced by the English, through which these factories became completely useless and must be considered as encumbrances, the relief from which always brings advantage, however small the amount is that accrues to the Company for them. After this, the Honourable Director presented a report and annex handed to His Honour by the merchant, fiscal, and village master Gerardus Kraijenhoff concerning that which was demanded of him by resolution of the 21st of March last concerning the expenses incurred by him charged to the accounts of Condemnation and Confiscation, item the Company's Villages; after resumption of which it is understood, also in accordance with the aforesaid resolution, to deliver the same to the commissioners for the revision of the Memoir of Menage, on which the decision for now is deferred.

Insertion of the report of the examination of the Hooghly cash accounts and to defer the decision thereon until such time as their considerations regarding it have been received. Furthermore, two returns were summarized of the bar silver brought in the past year by the ship the Agatha and this spring with the bark the Voorzigtigheid, from which it is established that the first-mentioned lot consisting of 1220 bars, in the Calcutta currency, after deduction of the incidental charges mentioned therein, has yielded fo: 20540:2:14 or ƒ 256800:4:—. being an advance of Soto 5300:8:24. or ƒ 6625:14:— or 2 1/25 percent on the calculated cost of ƒ 26 the mq: ff:; while the other quantity, amounting to 700 bars, after deduction as before, has yielded S. s. 118174:10:22 or ƒ 147718:7:—. constituting an advance of fb: 3312:7:9. or ƒ 4140:11:8. or 2 2/5 percent on the calculated cost of ƒ 26. the mq: ff:; of all of which it is understood that this record shall be kept. The Honorable Extraordinary Councillor of the Dutch Indies and departing Director, Mr. Isaac Titsingh The Honorable Cornelis van Citters Aurnoutsz., Senior Merchant and elected Deputy Director The Senior Merchant Johan Wilhelm Salomon van Haugwitz, Chief Administrator and First Officer in the Cloth Hall The Naval Captain Pieter Levien, Equipment Master The Merchants Adrianus Gerardus Kraijenhoff, Fiscal and Village Master Lodewijk Reaels De Bas, Warehouse Master; item The Junior Merchant Johannes Cornelis Heijning, Pensionary and Invoice Clerk Provisional Trade Bookkeeper Dis, Present Before commencing the public auction to be held today, the members having been convened in the assembly hall for deliberation on various points related thereto, the Honorable Director initially made known that this public auction had principally been announced in the hope that through it a considerable portion of the Japan bar copper still on hand could be disposed of, which for some time appeared to come into demand; indeed, that repeated applications had been made to His Honor by three natives, holders of Company bonds of which they wished to rid themselves, for a quantity of roughly 458 Maon of that metal at 41 Sicca rupees the Maon, or the price for which the same was sold at the most recent public auction of the 19th of March last, on condition that in case the same should fetch more at a subsequent public auction, this excess amount would be made good by those buyers to the Honorable Company; that His Honor regarded this condition as advantageous in every respect for the Company, because thereby was saved the very oppressive interest which continues to accrue on the bonds and ceases on the day of delivery, while the Company moreover enjoys the chance, upon the rise of the price, also to obtain more for its goods without being exposed to any danger of loss in case of a lesser return, had therefore accepted that proposal and given orders for delivery, in the confidence that this transaction, for the cited reasons, cannot be regarded as contrary to the positive orders of the Gentlemen Masters not to make any private sales; that His Honor, for those reasons, then also proposed to let the delivery of the Japan copper take place against bonds and to keep the same at the price which had been set for it by private sale, being the aforementioned 41 rupees the Maon, or otherwise not to let the same go and to await the opportunity to dispose of it successively in small parcels in the manner as has already taken place; for which there will possibly be opportunity at this time, since the merchants who are accustomed to sail up and down during the high water season sometimes come to ask for it, when it is not always possible to announce public auctions on the spur of the moment and which is also seldom convenient for those people; His Honor being fully convinced that, however much one is obliged to adhere strictly to the orders on that subject, a deviation like this, with the conviction that the Master's interest is thereby truly advanced, cannot be misinterpreted, and one as faithful servants may reasonably expect from one's superiors that this transaction can be attributed to nothing other than a true desire to promote the Company's interest: Thus it was approved and resolved to continue with the aforementioned private sale, in so far as the copper should not fetch the determined 41 rupees at public auction. 333 334 18th of August 18th of August Resolution regarding the proposal of His Honor; propositions regarding the deliberation about the same. The reports of the annual inventory under ultimo Aug. as before from Blume regarding the outcome of the commission assigned to him concerning the Chank shells to be taken, it was agreed on the proposition of the well-mentioned Noble Lord Director to make appropriate use of the first-mentioned license, and accordingly to dispose of the unwanted goods, in so far as they will fetch the purchase cost; insertion of the report of the commission and, as regards the latter, to increase the quantity of three Maon of Nagulen, which is usually sold with one Maon of cloves, to four Maons; furthermore, because of the pressing need for money to cover the daily expenses in the household, to sell the most wanted goods, such as the Cloves, the Lead, White lead, Verdigris, and yellow ochre for Cash, and the others, namely the Nagulen, broadcloths, and velvets, for bonds on auction. This being dealt with, the Extract received alongside the aforesaid letter from the Minutes of the resolutions in the Council of India on 16th Novbr: 1790 was read, whereby the previously abolished order to have the Reports of the General inventory under Ultimo Aug. sworn by the Express commissioners is renewed, and it was agreed to be obligated to obey it, thus introducing it immediately, and to have the usual Annual ordinances for the aforesaid purpose drawn up accordingly. Furthermore, a report and annexes handed to the Noble Lord Director by the junior merchant Blume was read, in which he finally gives an account of what was done regarding the Commission assigned to him concerning the so unfortunate shipment of Chank shells sent hither by the Ceylon Government, as that document, which is inserted here with its annexes, further shows. John Elliot, on freight from Tutucorin to this place, consigned to Your Right Honorable and Stern Sir, but which was shipwrecked on the voyage along the Coast of Coromandel around Coringa in May 1790. The above-mentioned report also accompanied a memorandum in which the matter and the occurrences concerning these shank shells were analyzed, and furthermore it was most humbly mentioned therein in what manner the insurers, who refused payment, might be brought to it, and that the undersigned to that end would endeavor to obtain statements from the crew members, but failing that, then to take the advice of a jurist on the state of affairs as an outline thereof was also submitted with the above-mentioned report. And Your Right Honorable and Stern Sir having been pleased to favor the same with his approval, the undersigned subsequently did everything possible to seek out and find the said Capt. Elliot, his officers, and also the ship's crew in order to obtain statements from them, but all was in vain, and none of them all could be found, indeed not even able to learn where they had gone, except that Capt. Elliot had departed for Bombay. The undersigned thereupon had recourse to the second, namely to send the state of affairs, of which a sketch was also submitted with the above-mentioned report under the date of 4th January, to Calcutta to Mr. Charles Cockerell, Senior Merchant in the English Company's service and Postmaster General, as well as principal partner in the house under the firm of Messrs. Cockerell, Trail & Co. at Calcutta, with the request to take the advice of the advocate thereon; the letter in English accompanies this under Appendix No. 1, and here follows the translation thereof. Chinsura, 9th April 1791. To the Right Honorable Mr. Cockerell Mr. Titsingh has received a power of attorney from Ceylon, together with an authentic copy of the Madras insurance policy on the snow the Crofts, Capt. John Elliot, etc. It is an arbitration policy, and whereas the Madras Insurance Company, under pretext of a deviation from the policy, have refused payment, His Honor wishes that the matter may be decided by arbitrators. Mr. Titsingh intends to request you to be so good as to charge your correspondents or agents at Madras therewith, and will issue to you such powers of attorney as you shall deem necessary thereto. Now, whereas Mr. Titsingh has been pleased to charge me with preparing all the papers necessary thereto, I consider it not unserviceable to take the advice of a jurist in advance thereon, and I have to that end drawn up the state of affairs, and I send the same herewith, along with four appendices belonging thereto, namely: A. is the contract concluded between the Ceylon Government and Capt. I must make an apology to Mr. Titsingh that I have not answered your letter of the 9th of this month sooner; the statement of the case appears to me to be very clear, however I shall speak to Mr. Johnson this evening on this subject, as he is by far the best attorney in Calcutta although not the most active. I do not believe that the case, as you have drawn it up, requires any further improvement; however, if Mr. Johnson should think it might be necessary, he will do it. And when Mr. Davies's advice has been taken, that will be entirely sufficient. In order to appoint arbitrators, it will first be necessary that I make an inquiry into who the members of the Insurance Co. at Madras are before I appoint anyone. And Mr. Johnson will draw up a proper power of attorney to be signed by Mr. Titsingh, and Mr. Davies's opinion will then be of very great use and assistance to the arbitrators. A few days thereafter, at the end of April, another letter was received from Mr. Charles Cockerell, accompanied by the counsel's opinion on the state of affairs, and principally on the three questions posed at the end thereof, see Appendix No. 3, and the translation thereof is as follows. Herewith I finally have the pleasure to enclose the statement of the case with the opinion thereon, and I wish that I could add a favorable one. Mr. Titsingh, as well as you yourself, will only too quickly perceive the contrary, and truly, after such an opinion regarding what the laws concern, I would not wish to advise that you incur any further expenses. Mr. Davies is very clear and very rarely errs in what concerns the laws. But if Mr. Titsingh, notwithstanding this, should nevertheless think fit to prosecute the insurers at Madras, I shall prepare the papers that you would desire to have. I have therefore retained your papers for so long until your final decision should become known. Extract of a letter from Mr. Charles Cockerell dated Calcutta the 28th of April 1791, to E. Elliot and entirely contrary to his written agreement or contract is not to all intents and purposes such a barratry of the commander within the true meaning of the policy, as will lie against the insurers? The answer of the lawyer is: Capt. Elliot being the owner as well as the commander of the snow Crofts, the deviation, though contrary to the terms of his agreements, 1. Can Capt. Elliot's conduct, namely touching upon the coast to receive and discharge other freight, be considered as a deviation from the voyage so as to affect and annul the insurance made by Mr. Mekern on the part of the Dutch Company? The answer of the lawyer is: The touching on the coast to receive and discharge other freight was undoubtedly a deviation from the voyage insured, and released the insurers from any subsequent risk. Aside and through inquiries among seafaring men, I had indeed heard that the snow Crofts had been very leaky and had already called at Trincomalee and at Negapatnam and also at Pondicherry to refit, but whence to obtain the evidence thereof: the persons from whom the same had to be obtained were nowhere to be found; Capt. Elliot had gone to Bombay, and his own private affairs, so it was said, compelled him to avoid Bengal, and of the officers, much less of the crew, absolutely no one was to be found, Your Honour's esteemed letter enclosing the opinion of the Advocate Mr. Davies on the two questions, I have communicated to Mr. Titsingh. The motives I had for drawing up those two questions were because I believed that to be the shortest way to make the arbitration turn out in our favour, especially since according to my understanding it was one of the two; namely: either no deviation from the policy; or else a trespass by the Captain against his written contract, and therefore fully falling under the offence of barratry, that word being a derivation of the word Barretor, to bribe, to corrupt, to deceive someone by making contracts etc. And when this word barratry was introduced and used in assurances on ships, and on goods, and also on goods belonging to a third party which have been laden therein on freight as is currently the case here, the barratry of the master, whether he be owner of the ship or nay, not even where they had ended up; thus nothing else remained than to have recourse to the various insurance offices in Calcutta and to inquire what insurances might have been taken out with them on the said snow Crofts, Capt. John Elliot; the more so since it was said that Capt. Elliot had insured his snow the Crofts, as well as that a Mr. Kennedy had taken out insurance on goods laden in the said snow: the undersigned then proceeded along that path to seek out all possible evidence, in order therewith to substantiate what had been reported, namely: That the snow Crofts, on her voyage from Tuticorin to Bengal, had been compelled by maritime distress to put into the Coast. However, believing that the opinion of the Advocate and his interpretation of the word Barratry was all too narrow, I wrote to Mr. Charles Cockerell concerning this, and also informed His Honour that I would draw up another statement of the case and wherein the evidence would be submitted that the snow Crofts had been obliged by maritime distress to call at the Coast; the letter itself lies under Appendix No. 5 and the translation thereof 7. 343 384 18th August 18th house Chinsurah cannot absolutely be against any other person than against the owner of such goods who has had the same insured by his policy against such barratry of the master. However, the opinion of the counsel gives to the meaning of the word barratry, by saying this word as it was understood under English law, only an overly narrow scope because he makes the same applicable solely and exclusively to the owner of the hull or the ship, but not to the owner of the goods, and which owners of the goods are in all respects the real owners against whom the master has committed the offense of barratry, and this all the more so since there is not a single authentic law to be found whereby the real meaning of the word barratry or barrator has been so terribly mutilated as Mr. Davies pleases to do. But for the present I think it best for us to leave all this, as well as the law, legal scholars, and all, to rest for now; but we shall draw our resources from other sources to make the arbitration succeed well, namely: The ship put into the Coast out of necessity because it had severe leakage, having struck a reef or bank around Ceylon and run aground, as well as through lack of drinking water, and also through lack of crew to be able to keep the pumps going, etc. And all this was the actual case. Your Honour will possibly say, why did you not directly take this course? And to this I must reply: That, although the snow in question was already wrecked in May 1790, I was nevertheless only recently charged with preparing the papers which are required for holding the arbitration and the recovery of the insurance, and when I could neither find Captain Elliot, much less his officers, and even less the crew or the Moors, to obtain from them the proper proofs and declarations of what I had heard, namely: that the said snow had actually been in such a deplorable state, and that was why I drew up the statement of the case and formed the two questions from it as Your Honour will come to see from a short account, which is to precede the course of events as I shall now draw it up, accompanied by various proofs and declarations which I shall request from the insurance offices in Calcutta, since I am informed that insurances were effected at the insurance offices of Messrs. 347 346 18th August 10th August to settle by arbitration; and such having now arisen for the reason that your Honour has declared to the Honourable Mr. Nathaniel Kindersley at Fort St. George that your Honour held yourself discharged from the obligations under which your Honour lies by your insurance policy, under the pretext of a deviation from the insurance which the said Mr. N. Kindersley took at your office on the 15th of March 1790 on the snow Crofts, Captain John Elliot, from Tuticorin to Bengal in the name of the Honourable Mr. Martinus Mekeren, Chief at Tuticorin, being again on behalf of his Honour's principal, the Honourable and Right Worshipful Mr. Willem Jacob van de Graaff, Governor of Ceylon, and the said snow Crofts now being totally wrecked on the Coromandel Coast near Coringa in May 1790. To embrace this occasion, as early as possible, to inform your Honour that within a short time the proper papers and evidence will be produced before your Honour's office and to convince your Honour of the contrary of your erroneous pretext. With high esteem I have the honour to be. Chinsurah the 4th of May 1791. I sent this letter to Mr. Charles Cockerell with the request, if he found it suitable, to forward it to Madras, and his Honour has answered thereto that he has forwarded the letter to Madras accordingly, etc., see Appendix No. 7, and of which the translation is as follows. I saw in your paper addressed to the Insurance Society at Madras nothing but what is highly expedient, and therefore I have also forwarded it under my cover to Madras. Extract of a letter from Mr. Charles Cockerell dated Calcutta the 10th of May 1791 to C. Blume at Chinsurah, etc., etc. signed C. Blume All my efforts made to obtain a list of the gentlemen belonging to the Madras Insurance Society have hitherto been in vain. You will do better to appoint or confirm Mr. Kindersley as agent in order to nominate arbitrators in that matter. Since then the undersigned has made every effort to obtain the copies of evidence from the insurance offices at Calcutta and has also succeeded therein so far that the following have been obtained, namely: 1. From the insurance office of Messrs. Perreau & Palling, where Mr. David Kennedy had insured his goods shipped in the snow Crofts, I received the copies of the papers and evidence which the said D. Kennedy had submitted to recover his insurance. From this evidence it appears, and principally from a report dated Madras the 5th of May 1790 by commissioned captains, or captains expressly requested for that purpose, to visit and examine the snow Crofts lying in the roads of Madras, and whereby among other things it is established that the same ran aground between Galle and Colombo on a rock or bank and they had to heave off again with an anchor and cable, and that the leakage was caused thereby, as all this together with several other circumstances serving this subject can be seen at large in the report itself, the same lying among the appendices of the Statement of Case sub Letter H, which now accompanies this in its entirety. 2. From the insurance office of Messrs. 348 18th August 18th August chief mate and second mate of the said snow Crofts, executed on the Coast at Injeram to be subsequently submitted to the arbitrators, is enclosed herewith. In addition, it is proved as far as possible and supported by depositions that the snow Crofts called at the Coast purely out of distress at sea, and therefore the underwriters are obliged to pay the damages suffered, though, as I presume, after deduction of the net proceeds of the parcel of Sandarac which was salvaged and received here after much effort and expense, from which also must again be deducted the second insurance premium paid by Mr. Kindersley at Madras on the ship of Capt: Newton bound for Bengal, and by which the salvaged Sandarac was brought hither, the premium paid thereon being, as I believe, about 150 Pagodas. In the case stated, it is also further demonstrated at the end in a memorandum that according to the customs and the laws of insurance, specifically in the seventh article of the thirty-six articles of the ordinances on insurance regulated at Amsterdam and which have been adopted by the English in their Lex Mercatoria, the master calling at the Coast on his own initiative is without prejudice to the third party who shipped freight therewith to Bengal as the ultimate destined port of his voyage, even though it is not specially mentioned in the policy of this freight shipper that the ship would also call at the Coast as an intermediate place lying along the way. The 7th Article states: The insurance shall be null and void whenever the insured causes the ship to call at a different place than he specified in the policy; but if the master does so without the order of the insured, whether he /:the master:/ does so of his own choice or out of necessity, it shall then cause no hindrance or prejudice to the insurance. It is indeed not necessary to make use of this here, because the ship actually called at the Coast due to distress at sea; nevertheless, it can do no harm to allege the same, if only to show that in such a case the underwriters still remained liable to make good the damages suffered. Furthermore, the undersigned humbly requests regarding this to be permitted to refer further to the case stated itself, in which this is elucidated with a couple more examples. If what is set forth here has the fortune of Your Honour's favourable approval, [illegible] after the ship was stranded, and the same lies among the annexes to the case stated under letter A9, testifying that the ship ultimately could not be kept above water due to the heavy leakage, etc. 3. While engaged in all this, there arrived at Calcutta Mr. D: Kennedy from Bombay, being the same person who had insured his goods at the counting-house of Messrs. Perreau & Palling, and who had himself even gone along with the snow Crofts in November 1789 to the west of India; and requesting His Honour to be willing to give testimony of the truth of what was known to him concerning the poor condition in which the said snow had been, etc., His Honour gave me a sworn statement attesting that they were forced to put into Trincomalee and also subsequently into Nagapattinam and Pondicherry, not only because of heavy leakage, but also due to the poor condition of the water casks and the resulting lack of drinking water, furthermore also due to the weakness of the crew and the continuous working of the pumps, both to obtain drinking water and also crew members to be able to keep the pumps going. The sworn deposition itself lies among the annexes to the case stated under letter H. This is all that I have been able to obtain in the way of proofs and depositions; and since no statements could be obtained from Capt: Elliot himself due to his absence, I hope that these will be adequate and sufficient to cause the arbitration to turn out as desired. Concerning Captain John Elliot, he has played but a poor and unpardonable role; it was his duty to provide all possible assistance instead of absenting himself, and a deposition from him would have been even more satisfactory and better than all the others. It is said that he is to come hither from Bombay in a couple of months. However, his own circumstances, as it is said, are very encumbered, and thus he will always keep himself in hiding as much as possible. The drawn-up account has been accounted for in the treasury. The Director has made efforts to settle that matter completely. to meet with approval, nothing more remains than to allow the arbitration to proceed, and if Mr. N. Kindersley, who since, as I understand, has been appointed Collector of Arcot, still resided in Madras, it would apparently be best to leave the further handling of it to that gentleman, as having arranged the insurance; but which can now take place through the mediation of others, and if it pleases Your Honorable Worship, through the frequently mentioned Mr. Charles Cockerell in Calcutta and his authorized agents in Madras; provided, however, that Mr. N. Kindersley be informed thereof, with the request to be so good, if it should in any way suit His Honor, as to take the matter upon himself, but if not, to lend a helping hand as much as possible. To facilitate matters for the arbitrators in Madras to whom the decision of this matter is to be entrusted, the sales account for the salvaged lot of chanks has been appended to the statement of the case under letter L No. 7, which, after deduction of the paid 3500 Sicca rupees, together with the further expenses incurred thereon, renders a net sum of Star Pagodas 1935 7/8. This account has been drawn up in this manner because the proceeds of these sea shells must again benefit the underwriters when they are condemned to the payment of the insured sum of 9741 Star Pagodas. Finally, as an opportunity presented itself in the latter part of the past month of June to sell the aforementioned lot of 77814 pieces of chanks and convert them into money, this is also accompanied by the account of that sale, closing with a net amount of Sicca rupees 11137.0.0. Furthermore requesting permission to transfer this amount into the Honorable Company's treasury; whereby I most humbly consider this whole affair, as far as it concerns Bengal here, to be concluded. Upon a petition received alongside a letter from the merchant and second-in-command at Cassimbazar dated the 18th of July last, from the soldier Christoffel Hendriks stationed there, containing a request that, in view of his advancing age, which already exceeds 62 years, and the bodily infirmity resulting therefrom, he might, in consideration of 37 years of service, be favored with a retirement pension, it was resolved to grant the same and thus, according to orders, to reduce his last pay, being 14 guilders per month, to 7.0.0 guilders. After these matters had been concluded, the Honorable Director, together with all the members in a body, proceeded to the Company's trade warehouses to attend the auction, in which respect it was resolved to note that the following merchandise was put up for auction, but withdrawn as not having been able to fetch sufficient prices; namely: The Japanese bar copper on bonds at Sicca rupees 40.0.0 per maund. One maund of nutmegs with four maunds of cloves at Sicca rupees 312.0.0 for cash.
