30 31 8 Febr: 8th Feb.r Insertion of a certain report and annexes by Blume from Ceylon submitted to this place regarding chank shells sent hither. In compliance with the request made by the Ceylon ministers mentioned in the resolution of 31st Decbr. last, the junior merchant Johan Carel Lodewyk Blume has given his opinion regarding the insurance made on the chank shells sent hither, and the means to be employed to oblige the insurers to honor the same, presented in a report and annexes mentioned therein, reading as follows: To the Right Honorable, Highly Esteemed, and Rigorous Sir, Mr. Izaac Titsingh, Extraordinary Councilor of the Dutch Indies, as well as Governor and Director of Bengal, &c., &c. Right Honorable, Highly Esteemed, and Rigorous Sir, In most dutiful obedience to Your Honor's order to report on the Ceylon Extract of Resolution handed to me, dated Colombo the 12th 9b: 1790, I have the honor herewith to present a memorandum setting forth the matters concerning the chank shells which were dispatched from Ceylon to Bengal with the English snow the Crofts, Captain Elliot, in March 1790, but perished on the voyage; and in what manner, according to my humble opinion, that case should be handled in order to obtain payment from the insurers at Madras, which they refuse under the pretext that the ship deviated from its voyage specified in the policy. To best facilitate this, it will be necessary, if possible, to obtain the declarations of the ship's crew of whom I speak in the memorandum, or, if that cannot be done, to submit the attached case position to a knowledgeable advocate, one or the other of which I shall immediately attempt to carry out. Upon the outcome thereof, I will do my best, either through Mr. Kendersley in Madras, who effected the insurance, or, if he should not be present there, as I have reason to presuppose, by means of correspondence of one or another commercial house in Calcutta with a similar one in Madras, to submit the matter for decision into the hands of arbitrators, as is expressly noted in the policy must take place in case a dispute between parties should arise. As I had the honor to say, I shall immediately begin by gathering the declarations or taking the advice of the advocate; but I request that Your Honor, pursuant to what was written by the gentlemen in Ceylon, may be pleased to authorize me to mediate the dispute with the insurers through arbitration, regarding which, however, in order to remove all objections regarding that authorization, it would, in my humble opinion, be best to wait until the arrival of the deed of Mr. van Meekeren mentioned in the letter of those gentlemen of 12 Novbr: 1790, which may be expected daily. 32 8th of February 33 8th of February Therein are the following main points, which must be employed to constrain the insurers to pay, and which they refuse on the grounds, as they say, that the ship deviated from its destined voyage and called at Pondicherry. The insurance policy reads as follows: 1. Lost or not lost, at and from Tuticorin to the port of delivery in Bengal River, with liberty to proceed to Colombo to receive letters on board, etc., etc. 2. And it shall be lawful for the said snow in this voyage to proceed and sail to and touch and stay at any ports and places whatever for necessary refreshments or repairs without prejudice to this insurance; for as much as concerns the assured, the same is and shall be rated and valued by agreement at nine thousand seven hundred and forty-one Star Pagodas. 3. Touching the adventures and perils which we the assurers are contented to bear and to take upon us in this voyage, they are of the seas, men-of-war, fire, enemies, pirates, thieves, jettisons, letters of mart and counter-mart, surprises, takings at sea, arrests, restraints, and detainments of all kings, princes, and people of what nation, condition, or quality soever, barratry of the master and mariners, and of all other perils, losses, and misfortunes that have or shall come to the hurt, detriment, or damage of the said goods, or any part thereof, etc. 4. And it is hereby further agreed that if any difference or dispute shall arise between the assured and us the assurers, it shall be referred to arbitration, and the assured shall name one or two proper persons for arbiters, and we the assurers on the other part shall do the like; and that such two or four persons so chosen, not agreeing on an accord, shall call in a third or fifth person as umpire, etc., etc. Below was written: dated Fort St. George, the 15th day of March 1790. Lower down was written: This insurance is declared to be on Chank. It is on the first point that the insurers rely in refusing payment, namely: "The policy runs directly from Tuticorin to the place of discharge in the river of Bengal, with license only to call at Colombo for the taking on of papers. 34 8th Feb: 35 8th Feb: crew, that the ship was very leaky and called at Pondicherry to discharge some cargo and lighten herself, and also for other necessities such as water and firewood, that place B The Honourable Company at Colombo had not chartered the entire ship, but only as much as was necessary to store the chanks. C The ship also had much more other cargo from others on board, which had to be delivered here and there along the coast, as was subsequently discovered. The insurance was taken out by Mr. Mekern, Chief at Tuticorin, in his name but on behalf of the Company; and Mr. Mekern provided to his correspondent at Madras, Mr. Kindersley, such places as the Captain had specified and made known in his contract concluded on 4 April at Colombo, namely: from Tuticorin, where the chanks were loaded, to Colombo, where it was to collect the papers, and then to the place of discharge, the River of Bengal. And Mr. Kindersley at Madras had the policy issued accordingly, being in accordance with the statement of the Captain of the ship, and this statement was the guideline according to which the policy was made. And now, subsequently, the Captain calls at Pondicherry; and if this calling at Pondicherry can be called an actual deviation from the voyage, then it is a barratry of the Captain by having gone outside the route of his specified destination, and who has misled or deceived or committed barratry against the freighter who dispatched his goods aboard the Captain's ship. The advice given by the advocate at Madras upon Mr. Mekern's draft of the state of affairs does not, as I believe, cause any harm to the essential facts of the case. Nor does the second insurance taken out at Madras on the parcel of chanks transshipped into the ship of Capt: Neuston cause any impediment. John Elliot, sole owner and Commander of the snow Crofts, being at Ceylon in Feb: 1790, entered into a written contract or agreement with the Governor of Colombo, the Honourable William Jacob van de Graaf Esqr., dated Colombo the 9th Feb: 1790, on account of the Honourable the Dutch East India Company, for a quantity of three lakh of chank and to carry them upon freight to Bengal and to be delivered to the Honourable Isaac Titsingh Esqr., Governor at Chinsurah, under the contract to sail from Colombo to Tuticorin and to load in his snow the Crofts at Tuticorin the freight of three lakh chank on board, and signed bills of lading for the same. Accordingly, Capt: Elliot sailed from Colombo to Tuticorin and took the goods on board, loading the freight of three lakh chank on board and signed bills of lading for the same, dated the 4th of March 1790. At the same time, the Governor of Colombo sent orders to the Chief of Tuticorin, Martinus Mekern Esqr., to get the said chank insured at Madras, and the written contract of Capt: Elliot was sent to the said Chief Mr. Mekern to serve as his guide to get the insurance made by; and by Art: 2 of the said contract, Capt: Elliot has ascertained and prescribed the route of his voyage with these words: from Tuticorin to return to Colombo to receive further instruction and to proceed from thence to Bengal. Case And the case to take the opinion of the English legal counsel at Calcutta thereon follows herewith in English. Yet, if declarations from any of the crew can be obtained—and to which I shall apply every effort—that the snow Crofts actually touched at the Coromandel Coast for necessities and for water and firewood, such will greatly facilitate the matter. No lawsuit can take place here at present, because the clause of arbitrators is expressly stated in the policy, which method of deciding the dispute is also quite appropriate for the parties and also less costly. 2 January 1791. - signed: J: C: L: Blume. Kendersly Esqr. the insurance made out in the name of the said Martines Mekern Esqr. and the risk on the chank is thereby valued at, see Blue Star Pagodas 9741, at and from Tutucoryn to the River of Bengall with license to touch at Kolumbo to take letters on board; there are the words of the policy, and the policy contains further the clause that if differences do arise between parties it shall be referred to arbitration, and is dated Fort St. George the 14th March 1790, or ten days after Capt. Guillot had granted his bills of lading at the port of Tutucoryn and proceeded shortly after on his voyage to Bengall, touched at Kolumbo for the letters, and from thence to the River of Bengall. Capt. Elliot proceeding to Bengall has touched afterwards on the Coast of Coromandel in April, particularly so as is said for wood and water, also it is said to trade and to discharge and receive freight, and the vessel called at Pondicherry; upon which the insurers at Madras, hearing that the said snow Crofts has touched at Pondicherry, declared the risk undertaken on the chank void under pretense of a deviation from the policy. And the said Chief of Tutucoryn, Martenus Mekern Esqr., got by his agents at Madras 5. Shortly after, the said vessel arrived at Madras roads, and being very leaky, the said Capt. Elliot endeavoured to take out the chank and put them on board of Capt. Newton's ship, and which succeeded for a part only, because in the mean time that they were employed to take out the chank and bring them over into Capt. Newton's ship, a violent gale commenced, and by which the snow Crofts was driven from her anchors out of Madras roads to sea with the greatest part of the chank remaining on board in her, and the vessel and cargo was shortly after totally lost near Coringa on her way to Bengall. could not know that Capt. Elliot afterwards would touch on the Coast of Coromandel contrary to what he had declared and engaged by his written contract from Tutucoryn to Bengall with license to touch at Kolumbo to receive papers on board. 1st Query: Can this Capt. Elliot's so doing, viz. to touch upon the coast and discharge other freights, be considered as a deviation from his voyage so as to affect and annul the insurance made by Mr. Mekern on the part of the Dutch Company? Note: Considering now that the Dutch Company were partial freighters only and, see contract sub February 1790 being at Ceylon, made a written agreement. Proposal: John Elliot, sole owner and commander of the snow Crofts, with the Governor of Colombo, the Honorable Willem Jacob van de Graaf, dated Colombo the 9th of February 1790, to sail from Colombo to Tutucoryn and to load in his snow the Crofts, for the account of the Honorable Dutch East India Company, a quantity of three lakh chanks, and to transport the same on freight to Bengal. And with license to call and to touch at the Coast, Mr. Mekern would otherwise have ordered the insurance to be made accordingly, just as he has done now upon the words as they now stand by the contract. This may be so. But then it was too late, as the insurance was long made at Madras and there was no more time to alter it. But when Capt. Elliot made the contract of the 9th of April, why did he not put to article 2nd these words? Pro Memoria: It is reported that Capt. Elliot has said at Madras that when he touched at Colombo for the papers, he told them of his intention of touching upon the Coast. 2nd Query: Whether, by such a deviation solely done by Capt. Elliot and entirely contrary to his written agreement and contract, the Dutch Company is not to all intents and purposes subjected to such a barratry of the commander within the true meaning of the policy as will lie against the insurers? charge transport 4. 38 8th February 39 8th February Bill of Lading marked Letter B. Note Titsingh, Governor of Chinsurah. 2. In consequence thereof, Captain Elliot sailed from Colombo to Tuticorin, see Invoice and Bill of Lading, where he took on board the cargo of three lakh of chank shells, issuing Bills of Lading for the same under date of 4th March 1790. 3. The Governor of Colombo sent at the same time an order to the Chief of Tuticorin, Mr. Martinus Mekern, to have the said chank shells insured at Madras, while the written contract of Captain Elliot was sent to the aforementioned Chief, Mr. Mekern, for his guidance, in order to effect the insurance in accordance therewith, Captain Elliot having in the second article of that contract determined and prescribed the route of his voyage in these words: To return from Tuticorin to Colombo to receive further instructions and from there to proceed directly to Bengal. And the said Chief of Tuticorin, Mr. Martinus see Policy marked Mekern, had the insurance effected through his agent at Madras, Mr. N. E. Kindersley, in the name of the said Martinus Mekern, the risk of the chank shells being therein valued at Star Pagodas 9741. to be transported from Tuticorin to the River of Bengal, with permission to touch at Colombo to receive letters, these being the words of the to be delivered to the Honorable Mr. Isaac Policy. Furthermore, there is contained in that policy the clause that if any dispute should arise between the parties, the same shall be referred to arbitrators, and the same is dated Fort St. George the 14th March 1790, or 10 days after Captain Elliot had signed his Bills of Lading in the port of Tuticorin. Shortly thereafter he began the voyage to Bengal, touched at Colombo to receive letters, in order to steer from there to the River of Bengal. 4. In making the voyage to Bengal, Captain Elliot subsequently in April touched at the Coast of Coromandel, to obtain, as it is said, firewood and water; it is also said that this was done to trade and to discharge and take in freight goods; the vessel also touched at Pondicherry, whereupon the insurers at Madras, learning that the said snow the Crofts had touched at Pondicherry, declared themselves released from the risk undertaken regarding these chank shells, under pretext that there had been a deviation from the terms of the policy. 5. Shortly thereafter the said vessel arrived in the Madras Roads; as the same was very leaky, the said Captain Elliot attempted to lighten the chank shells from it and to transship the same on board the ship of Captain Newton; in this he succeeded only partially, because in the meantime, while they were engaged in discharging the chank shells and transferring them on board Captain Newton's ship, a strong wind arose, whereby the snow the Crofts was driven from its anchors and carried from the Madras Roads out to sea, with the greatest part of the chank shells on board, that vessel being shortly thereafter on that voyage to Bengal completely lost with its cargo close to Coringa. First question: Can this action of Capt: Elliot, namely to call at the coast and unload other freight goods, be considered as a deviation from his voyage in so far as this may cause prejudice to, or void, the insurance effected by Mr. Mette for and on behalf of the Dutch Company? Second question: Is, through such a deviation made solely by Capt: Elliot and entirely contrary to his written agreement and contract, the Dutch Company, according to the content and meaning of the policy, not entitled to claim compensation from the underwriters on account of this misconduct of the master? Pro memoria The rumour goes that Capt: Elliot is said to have stated at Madras that when he called at Colombo for the papers, he had spoken of his intention to call at the coast. This may be true, yet it was too late, since the insurance had already been effected long before at Madras and no time remained to alter the same; but when Capt: Elliot made the contract on the 9th of April, why did he not at that time have these words inserted in the second blank space: "and with permission to call at the coast" then Mr. Mekern could have given orders to have the insurance effected accordingly, as has now been done according to the words as they were made known in the contract. Further report of Blume concerning the quantity of chanks. Decision to let Blume settle this matter. Regarding the size of the gauges, due to the lack of the sample gauges sent from Tutucorin, which were lost with the wreck of the snow the Croft, Capt: Elliot, in which this salvaged parcel of chanks was originally laden at Tutucorin, I have had some iron gauges made here of the following dimensions: The first gauge is in diameter 3½ inches and in circumference 11 inches. The second gauge is in diameter 3 inches and in circumference 9 7/16 inches. The third gauge is in diameter 2¾ inches and in circumference 8 3/16 inches. The fourth gauge is in diameter 2½ inches and in circumference 7 3/16 inches. Hoping by this determination of the size to enable the Tutucorin administration to determine into which sort this salvaged parcel actually falls, by comparing the same with the sample gauges in Their Honours' possession. Furthermore, I have informed the merchants in chanks both here and at Calcutta that such a parcel of chanks of the aforementioned sorting is for sale, as well as given notice thereof to Katwa as one of the principal markets for these sea shells; several Dalals or brokers have also successively come to inspect the parcel, without however having made an offer for it up to now. The market at Calcutta and throughout Bengal is glutted by the heavy annual supply of chanks coming from the Bay of Pundi via Nagapattinam, Nagore, and Madras hither; however, these Tutucorin chanks being of a much better sort, I do not doubt that they will find buyers in preference. Furthermore, the samples accompany this, namely: 2 pieces of the 1st sort 1 piece of the 2nd sort 1 piece of the 3rd sort 1 piece of the 4th sort 2 pieces of the 5th sort On the 3rd of this month, there were received here via Pulicat, alongside accompanying notes of 9 & 24 September last, two letter packets from Ceylon dated 5 and 11 August prior, serving to convey various letters from Europe for this Directorate, which had arrived on that island with the ships the Gouverneur Generaal Mossel and the Unie. Examination and finding of the interior office goods. packets brought to this Directorate which, upon opening, were found to contain, apart from private letters: A missive from the Most Noble and Honorable Gentlemen Seventeen dated Amsterdam, the 3rd of December 1789. A ditto from the Most Noble and Honorable Gentlemen of the Secret Committee in The Hague dated 2nd of October 1789, accompanied by the separate and secret signals mentioned therein, and All the appendices specified on the register found therewith dated Amsterdam, the 22nd of December 1789, all in duplicate. It is thus understood that a record shall also be kept of the receipt of those letters and papers. Whereas, due to the departure from this Directorate of the junior merchant Casparus Leonardus Eilbracht, the office of Translator in the Persian language has become vacant, which the Honorable Director, considering the small amount of correspondence currently maintained with the prince or other grandees of the country, judged best to leave unfilled in order to save the monthly bonus of fb: 50:—:— paid for it. 62 8th February: The drawing of a bill of exchange for delivered saltpetre approved. The receipt of the chintz required from Patna for the Indies noted. Insertion of a certain extract resolution of the Right Honorable Gentlemen Seventeen, transmitted by the Patna Resident Baumgardt, whereby he is permitted to depart. In a subsequent letter from the Resident of the said factory dated the 5th of the previous month, it was communicated that he, in satisfaction of the 10000 maunds of saltpetre received from the English, has granted upon this meeting a bill of exchange amounting to f 32931.22; thus it was understood to approve this, as a consequence of the authorization granted for that purpose, and to note that the chintz sent from there hither for the Indies according to the letter of 7th January has been duly received here. The Resident Jan Pieter Baumgardt, transmitting along with a further letter of the 27th of the said month of January an extract authenticated on a proper stamp by the First Sworn Clerk in Amsterdam, J: J: Fernij, from the resolutions of the Right Honorable Gentlemen Seventeen of the 7th May of the past year, whereby he was permitted, if he so chooses, retaining rank and salary while awaiting employment, to depart for Cabo de Goede Hoop, the said extract reading as follows: Read was the petition of Jeron Gijsberto Decker and Jan Casper Hartsinck, in the name and on behalf of the Junior Merchant and Resident at Patna in Bengal, J: P: Baumgardt, making known: That the said Baumgardt, owing to the decline of trade in Bengal and especially at the factory of Patna, is rendered entirely unable not only to be of any service to the Company there, but also to support himself; and requesting that, since the said Baumgardt is a native of the Cape of Good Hope and has for a long time been married to a Cape woman, and his wife's parents still reside at that corner of the world, he may be granted permission in his capacity as junior merchant, while awaiting employment, to depart for his birthplace the Cape of Good Hope, as his finances and a numerous family no longer permit him to continue in the capacity of Resident at Patna, which post not only brings him no livelihood, but on the contrary causes great expenses; The petitioners requesting that, if this request should be granted, the notification to the Indies might nevertheless be made in such a manner that it may be at the choice of the said Baumgardt to make use of it or not, and this for such reasons as have been further alleged in the petition; Whereupon, deliberation having taken place, it was approved to grant the petitioners in their respective capacities their request, and consequently to permit the aforesaid Baumgardt to depart for Cabo de Goede Hoop on the proposed terms, and to cause the notification regarding this to be made in accordance with the desire of the petitioners. Regarding the Expense Entries, in our opinion the changes to be mentioned hereafter could take place and, subject to the approval of Your Right Honourable and Worshipful Court, be implemented, it being considered more appropriate to consent to the alterations proposed here, so that these expenses are charged to the accounts to which they belong rather than those to which they have been brought up to now. Namely: To the Ordinary Rations account should be credited the amount for the drinks which were provided as rations to the seafarers stationed here, which until now had been charged to the chaloups bringing them hither; To Merchandise Expenses, such monies as are paid to the Calcutta gazetteers for announcing the Company auctions, which until now the Ordinary Expenses account has borne; To the Hospital account, the laundry provided for the use of the invalids stationed here on shore; To Condemnation and Confiscation, that which was spent on recovering deserters from Calcutta, as was done in the previous year and charged to Extra-Ordinary Expenses. Regarding the difference in the Cash account under Ureman: This difference appears in both debit and credit to bring forth the true balance of the same of f 13711:10:8 as of the last day of August of the past year, arising from double-booking the transportation charges stated in the text for dispensary goods for three separate vessels, amounting to f 327:10:8—once upon entering the expense accounts and again upon paying the warrants drawn up for them, since they were entered under Shipping Expenses instead of under the name of the vessel for whose benefit the goods were provided. Furthermore, f 125:—:8 paid for board and refreshments for the crew on the bark De Voorzigtigheid was forgotten to be included in the expense account and therefore also not credited to the Cash; both matters can be rectified by debiting the Cash for the first-mentioned sum and crediting it for the last-mentioned, to the benefit and debit of Shipping Expenses, whereupon the said ledger account will balance. Likewise, what appears regarding Radanaat and Pietember Moekersja: they are recorded as debtors for f 1140:1:—, but upon investigation the contrary appears, for Radanaat in the year 1788 delivered sundry goods to the value of f 699, and Pietember for f 441:1:—, for which they were each separately credited, but in company or under the above-mentioned name they were debited for f 1234:13:— on behalf of Radanaat Sercaar for f 690:9:—, Pietember Moekersja for f 421:1:8, and Goaatsjent Moekersja for f 123:2:8. These three persons have already been credited upon the taking in of the deliveries as the actual suppliers, and now, as stated, once again, thus doubly so. 80 Note of the outcome of the resolution held today. Wednesday the 23rd of February 1791. In the morning, absent the Master of the Equipage Levien and Merchant Krayenhoff due to occupation. The public auction announced for today having been held in the presence of the Noble Lord Director and the members present, it was accordingly agreed to record the outcome thereof herewith. Of the nutmegs, with the addition of 3 maon of cloves to each maon thereof, only 782 lb or 11½ maon of 68 lb each were sold, as no further buyers came forward, having fetched from fo: 351 to fo: 340:-: the maon. Of the mace, with the addition of an equal quantity of cloves, the entire lot in stock consisting of 816 lb or 12 maon of 68 lb each was sold and fetched from fo: 674:-: to fo: 640:-: the maon. On the Japanese copper, which was put up for bonds at 37 rupees the maon of 76 lb, no bid was made at all. The arrack api fetched from fo: 101:- to fo: 115:- the leaguer, and the entire stock of 16 leaguers was sold. Furthermore, nothing was turned over except a few trifles.
