Thursday the 24th of February 1735. In the morning, Present the Honorable Pieter Hacker, President, and all the members, except the Independent Fiscal Mr. Jan Jacob Serrurier, the Colonel Mr. Robert Jacob Gordon, and the Merchant and Vendue Master Mr. Olof Marthini Bergh, due to both other engagements and indisposition, with the co-optation of the two Burgher Councillors, the Honorable Johannes Smuts and Jan Coenraad Gie. The Honorable Tobias Christiaan Rönnenkamp, acting ex officio as plaintiff in criminal matters in place of the Independent Fiscal Mr. Jan Jacob Serrurier due to his indisposition, orally appearing for this purpose, submitted all the documents serving the case, along with the issued, published, and everywhere posted edictal summonses, on the one hand; Against the burgher Daniel Verwey, summoned in person, on the other hand; To hear the claim of intendit served against him, on account of his far-reaching impertinence, obstinacy, and insolence committed against Justice, as well as the affront and insult thereby inflicted upon this Council; requesting that, due to the non-appearance of the defendant, he may be banished by definitive sentence as a defaulter and absconder forever from these lands and the jurisdiction thereof, on pain that if he should at any time fall into the hands of Justice, he shall then be punished according to his deserts, with condemnation in the costs. The Council, having attentively heard and considered the intendit presented orally by the plaintiff ex officio, as well as the conclusion taken on and against the defaulter and absconder Daniel Verwey, and having also paid attention to the documents produced in court alongside it, as well as the contumacy of the defendant, and furthermore to everything relevant to the matter that could move their Honors; administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, banishes the defaulter and absconder Daniel Verwey forever from this government and the jurisdiction thereof, on pain that whenever he might come to fall into the hands of Justice here, he shall then be punished according to his deserts, with condemnation of the summoned defaulter and absconder in all the costs incurred in this matter. Underneath stood: Agrees. 521 Whereas the burgher Daniel Verwey, having been summoned by the former Burgher Lieutenant Hendrik Oostwald Eksteen to bear witness to the truth at the plaintiff's expense in the lawsuit initiated by him before our Council on and against the burgher Jacobus Arnoldus van Reenen, and thus to answer such interrogatories as would be presented to him in the presence of the honorable commissioners of this Council, did not shrink, instead of appearing in court according to his duty, rather to ride out into the country, and thus allow default to occur; but moreover, when the said Verwey, on account of his non-appearance, was condemned by default both at the request of the plaintiff and according to the manner of proceeding to answer the aforementioned interrogatories, saw fit to answer the court messenger, when the latter made the aforementioned condemnation known to him, Verwey, upon his return: "It is an old custom that when someone is summoned to bear witness to the truth and does not appear, judgment is requested by the opposing party; however, I shall [illegible]

not appear; for nowadays a person must be afraid to come down there near the jail, because people are arrested there in a violent manner and thrown into jail; the repeatedly mentioned Verwij having moreover, when the court messenger had summoned him the following day to appear the day after that, or on Friday the 12th of November last, before Their Honors the Commissioners from our Council at half past ten o'clock in the morning in order to comply with the aforementioned sentence and to answer interrogatories, given as an answer to the court messenger: I shall not appear, and besides that I intend to ride out to the country this afternoon. just as the aforementioned Verwij then also did not appear before Their Honors. That upon the report made by Their Honors the Commissioners of the aforementioned impertinent, disrespectful, and obstinate conduct, tending in every way to the contempt of this Council as the lawful judge of the aforementioned Daniel Verwij, it was approved in Judicio to place that matter in the hands of the Honorable Independent Fiscal Mr. Jan Jacob Serrurier, in order to do and act in that regard as he should find proper; the well-mentioned Lord Fiscal thereupon having caused the repeatedly mentioned Daniel Verwij to be summoned by the court messenger to appear before him; but the said Verwij, instead of appearing, having made it known: That if he knew that the Lord Fiscal wished to speak to him about private matters, he would come; but in case he had to speak to him about other matters, the Lord Fiscal should just have him summoned. Thereupon it was approved and resolved to have the repeatedly mentioned Verwij summoned by the court messenger, both in the name of the Lord President and of this Council of Justice, to appear before the Council chamber on Thursday the 2nd of the last month of December; yet the same, having previously answered: 'Tis well! I may perhaps speak to you further. did not hesitate on the same day, in a sealed letter sent to the court messenger at half past eight in the evening, to write verbatim: I have further considered the summons of the Honorable Lord President and the Honorable Council of Justice, and consequently declare that for scrupulous reasons I cannot appear, as long as the Honorable Council does not give me manifest security that I shall not be troubled upon a simple presentation of the officer with a bodily apprehension, according to the evidence which I have in my possession, over and above that the contents or purport of the summons are unknown to me, which I nevertheless ought to know, as well as whether I must appear in person or send an attorney. That however much the repeatedly mentioned Verwij had thereby also made himself subject to the utmost indignation of this Council, nevertheless, in order to know whether the aforementioned Verwij, possibly misled by evil inducements, had reconsidered and thus might have appeared before the Council chamber in obedience to that summons, the court messenger was first asked whether the frequently mentioned Verwij was present; to which the messenger, however, answered no. Wherefore the Council, in consideration of the great and very far-reaching impertinence, obstinacy, and insolence of the aforementioned Verwij, as well as the disrespect, insult, and scorn thereby inflicted upon this Council, and which, if not checked as the nature of the matter requires and if the willful and stubborn offenders were not punished according to their deserts on that account, would not only be offensive to the good inhabitants, but all good order and due obedience would be broken and trampled underfoot, and thus the absolute ruin of this in every way flourishing Colony would be caused thereby; so the Council of Justice has granted a decree to the well-mentioned Lord Fiscal in order, by virtue thereof, to summon the repeatedly mentioned Daniel Verwij in person before our Council; yet the aforementioned Verwij, although that citation was served pursuant to the decree granted for that purpose and expressly cited therein, having seen fit, after having obtained a copy thereof, to answer: I shall read over the copy of the citation attentively and give you a further answer, and the day after that to answer to that citation in writing and arrogantly: I do not accept the citation and protest against the costs, since I see from the citation that I am summoned criminally by the officer, and the specification of the asserted criminal act has been omitted therefrom, which I nevertheless ought to know in order to propose an exception thereupon regarding the incompetence of that criminal summons. So the Council, on the appointed day, because of the non-appearance of the repeatedly mentioned Daniel Verwij, granted default to the Lord Independent Fiscal, and for the benefit thereof prise de corps or bodily arrest of the aforementioned Daniel Verwij.

524 However, since the same Verwij, despite all applied effort and search, could not be found, but has made himself a fugitive, he was, at the request of the Independent Fiscal, by three edictal summonses successively and finally on the 10th of February last for the fourth time ex super abundanti, loco et more solito, summoned by the ringing of the public bell to appear in person before our Council within a certain fixed day in order to answer for and purge himself of his above-mentioned offenses, without him having appeared however, and thus having shown great contempt as well as having slighted in the highest degree the respect and awe of Justice; wherefore the Independent Fiscal subsequently served a Statement of Default and thereupon made his conclusion as in accordance with the law. Thus the Council of Justice, having attentively considered both the aforementioned Statement of Default and noted the continuation of the default and hiding of the defendant, as well as everything that was pertinent to the case and could move their Honors, Administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, have banished the defaulting and absconding Daniel Verwij, as their Honors hereby banish him in perpetuity from this country and the jurisdiction thereof, upon penalty that if he should fall into the hands of Justice at any time, he shall then be punished according to his deserts, with condemnation in all the costs incurred in this trial. for which purpose they were together; that the petitioner, having for that end by preference made use of his European servants, who had appeared to him most suitable for achieving that aim, had not only most earnestly enjoined them that they should properly perform their duty and, as far as possible, combine all moderation and modesty with the appropriate vigilance, but had also inquired several times as to how far the said servants had sought to fulfill their duty, and had learned to his satisfaction that with all modesty, in these and similar circumstances, they had properly performed their difficult task; that although the petitioner, after having received such a report concerning the conduct of those judicial officers, had with reason thought he might expect that at least none of the burghers, for whose accommodation those judicial officers were on duty, would cause them any molestation or injury, he had nevertheless, to his utmost surprise, learned that a certain burgher named Bartholomeus Goedhard had seen fit, on Wednesday the 13th of October last in the afternoon, just at the moment when the burghery was gathering to begin their exercises, and thus in the sight of a large part thereof, regarding the judicial officer Dirk van de Aa, who in the course of his duty had separated two small boys—one being the son of the burgher Engelbertus Felix and the other of the burgher Hendrik Eelers—who were fighting with each other and thus giving rise to a breach of the public peace, and for that purpose had pulled one by the hair of the other, to first give him a blow to the chest on that account, and having drawn his sidearm, to place that drawn weapon against his chest and to address the judicial officer: "Scoundrel, what are you doing? You are only appointed for black boys, but not for free men or children of free men, and if you lay a hand on them again, I will run you through like this," words and deeds which, spoken and used in such a case, so clearly bear the marks of burgher rebellion and insolence that the petitioner, subject to correction, believes he would be doing something unnecessary if he were to occupy the precious attention of Your Honorable Worships for a moment with any argument concerning them; wherefore the petitioner, leaving this matter, will take the liberty further to submit to Your Honorable Worships that the burgher Jan Beerends, on the 18th of the same month in the forenoon, on the field where the burghery was conducting its exercise and he, Beerends, was also present for that purpose, did not hesitate to beat and mistreat the soldier in the service of the Honorable Company, Reynier Spree, in an outrageous manner, without, as appears from the unanimous testimony of several eyewitnesses—whose given depositions the petitioner ratione officii takes the liberty to exhibit herewith—any harm having been done to him by the said soldier; and as if this were not enough, immediately thereafter again did not hesitate, in the presence of the Provost Marshal Jacob Ernst, who was in conversation concerning what had occurred with the burgher Jan Christiaan Hillegeest who was also present there, to threaten the said Hillegeest that he would treat him just as he had the soldier Spree, if he even thought that he was speaking about him or taking the side of the soldier Spree. That just as such violent conduct, both of the first-named Bartholomeus Goedhard and of the last-named Jan Beerends, notoriously involves a willful and violent assault upon a servant of justice in the execution of his duty and a publicly committed act of violence, accompanied by such circumstances which, along with their far-reaching consequences, will by no means have escaped the penetrating insight of Your Honorable Worships, and since the respect due to justice and the general security are therefore of the utmost importance, requiring that prompt and rigorous provision be made against such excesses and outrageous acts of violence, the petitioner ratione officii has also been brought under that unavoidable necessity to institute the appropriate proceedings to that end against Monday, the 6th of November, 1784. For the Honourable Company, ƒ 530 To the Right Honourable President and Council of Justice of the Castle of Good Hope Honourable and Respected Sir, The undersigned provisional Fiscal, Mr Jan Jacob Serrurier, respectfully shows that on the last session of court he had presented to this Honourable Council such a memorial as he now, together with the relevant documents, takes the liberty of exhibiting herewith, containing a request to obtain ex officio, with respect to the persons of Bartholomeus Goedhard and Jan Beerends, such provision of justice as he, in order to properly uphold the rights of the High Authorities and in accordance with the letter of the Criminal Ordinance, conscientiously believed to be appropriate; that although the petitioner ex officio had flattered himself that, since it was fully established that both aforementioned persons had made themselves guilty of crimes which, according to the laws and placards of the country, brought them into the condition of being criminally prosecuted and apprehended, the Honourable Council would also have granted the petitioner ex officio such provision of justice as was in accordance therewith; the same nevertheless deemed it appropriate to grant the petitioner ex officio no other orders than those by virtue of which he was qualified to take the aforementioned offenders into civil arrest; that although the petitioner found himself significantly embarrassed by such an order, not knowing in what manner to execute such a civil arrest which originated from a proven crime, he nevertheless executed the same as best as possible, so that through longer delay no example of impunity for that publicly committed crime should exist; but since the petitioner ex officio maintains that he has no other action against the aforementioned persons than that which arises from a committed and proven crime, and is therefore per se criminal; and that the petitioner, for the continuation of his criminal action pursuant to the XVth article of the Criminal Ordinance, finds himself compelled to hold them in solitary confinement without any access, to which he is otherwise entirely unauthorized regarding a civil prisoner; the petitioner ex officio has deemed it most advisable to turn again to this Honourable Council, with the request, as respectful as it is earnest, that it may please the same to review the aforementioned memorial exhibited in Council on the 4th of this month, along with the proofs relating thereto and the order issued thereon, and now deciding de novo, to cause the requested provision of justice to be expedited to the petitioner; or at least and in any event, if the Honourable Council should deem fit to make no change in the aforementioned resolution, to declare to the petitioner in what manner he may and can act in this case (being entirely outside of and contrary to the Criminal Ordinance) for the maintenance of the right of the High Authorities upon the authority of the Council, and thereby be secured against all liability on that account. In the morning, present the Honorable Pieter Hacker, President, and all the members, except the merchant Mr. Oloff Martheni Bergh on business, having co-opted both burger councillors, the Honorable Johannes Hendrik Munnik and Johannes Karnspek. Thursday, 18 November 1784. The following request was presented by the detained burgher Johan George Beerends. Which having been read, and having heard thereupon the Fiscal pro tempore Mr. Jan Jacob Serrurier, his honor declared that, although the crime of the prisoner consists of committing excesses and public violence, the case is nevertheless well-disposed to admit the prisoner to submission, and that he, the Fiscal pro tempore, was also prepared to make his demand immediately, or otherwise that, upon production of the depositions, this Council might impose upon the said Beerends such arbitrary punishments as shall be deemed proper according to their discretion. Whereupon, after deliberation, the following interlocutory order was found proper to be issued: The Council admits the petitioner to submission, and leaves it to the Honorable Fiscal to make immediately such demand as he shall deem proper. Whereafter the said Fiscal orally made the following demand at the roll. And these say: That the crime of the prisoner and defendant, as appears from the produced depositions, having consisted of committing excesses and public violence, whereby the public peace was disturbed, especially at a time such as when this was committed by the prisoner and defendant; The Plaintiff ratione officii, making his demand, concluded that the defendant Jan Beerends should by sentence of this Council be condemned to pray in hoc Iudicio with open doors on his knees for forgiveness from God and Justice, as well as to a fine of twenty-five rixdollars to be applied according to the discretion of this Council, with condemnation in the costs. The Honorable Independent Fiscal Master Jan Jacob Serrurier, by virtue of his office Plaintiff in a Criminal Case on the one part, against and opposing the burgher Bartholomeus Goedhard, prisoner and defendant in the same case on the other part. The Plaintiff by virtue of his office presents his claim with and alongside its annexes, all according to the inventory, and concludes as at the end thereof. The defendant, answering, states that he does not know of having done any wrong and thus having deserved punishment. The Plaintiff replies, stating that from both interrogatories answered by the defendant it appears superabundantly what his committed act consists of, referring himself therefore to the defendant's own confession, and requests justice based upon that and upon the annexes submitted therewith. The defendant persists as above, saying he only said so in order to be released. Parties renounce further submissions. Claim. Article 1: And the Plaintiff by virtue of his office stated 2. that from the attached confession of the prisoner and defendant it is fully evident 3. that the prisoner and defendant during the last held burgher exercises 4. having been present on Wednesday the 13 October at half past two in the afternoon on or near the square 5. on which the burghers assembled to perform their aforementioned exercises, 6. had then observed that two small boys 7. on the public street were engaged in a scuffle with each other, 8. and 550 Article 8: and that one of the servants of justice, whom the prisoner and defendant had always seen present both at the assembly ground and the execution ground of the burghers, 9. and who was known to the prisoner and defendant to be stationed to prevent disorders and wrongdoing, 10. and who, he also knew, was not to be subjected to any violence or harassment by anyone, 11. had separated them from each other and with the stick he held in his hands had dealt some blows. 12. That the prisoner and defendant for that reason went to the aforementioned court servant 13. and pushed him in the chest, or, as the prisoner and defendant chooses to express it, merely pushed him gently in the chest, 14. furthermore drew his sword from the scabbard, 15. and placed that drawn sword upon the chest of that court servant, without, as the prisoner and defendant alleges, having had the intention to do harm with it. 16. As this will fully appear to Your Honors partly from article 11 of the prisoner and defendant's first interrogation and partly from article 8 of his second interrogation, 17. however much the prisoner and defendant elsewhere completely denies this again 18. and, contrary to the attached declarations, seems to want to make the drawing of his sword appear only as a consequence of the drawing of the saber by the said court servant, Article 19: notwithstanding the words that were furthermore addressed by the prisoner and defendant to that court servant, 20. namely: "Karel, you must not touch the body of a burgher's child," 21. rather seem to demonstrate that it was from the side of the prisoner and defendant, and not of the court servant, 22. that occasion and cause were given for what happened between him and the court servant, 23. in which, even assuming that all that was done by the prisoner and defendant towards that court servant arose solely from the fact that he, the prisoner and defendant, believed that the court servant had overstepped his bounds, the prisoner and defendant had no right whatsoever to interfere, 24. much less to push or threaten that court servant on that account; 25. he, the prisoner and defendant, therefore acted entirely unauthorizedly and unlawfully, 26. and thereby, as the Plaintiff by virtue of his office under correction believes, has indeed made himself punishable, 27. as appears not only from the clear letter of the Criminal Ordinance, 28. but also according to the unanimous opinion of all doctors of law who have commented on the matter of public violence.

Articles drawn up and submitted to the Honorable Commissioners from the Honorable Worshipful Council of Justice of this government, in order that, upon the requisition of the provisional Fiscal, Mr. Jan Jacob Serrurier, the person of Bartholomeus Goedhart, presently the Lord's prisoner, be heard thereon; his answers to be given are to be properly recorded in the margin hereof. Article 1. The prisoner's name, age, birthplace, and status. Says: Bartholomeus Goedhart of Cape of Good Hope, aged 23 years, and a citizen. Article 2. Whether the prisoner was not also present as a citizen at the most recently held citizen military exercises. Says: Yes. Article 3. Whether the prisoner did not see that some officers of justice were always present at the place where the citizens first assembled and also where the citizenry performed their exercises. Says: Yes. Whether the prisoner did not go up to that officer of justice and give him a blow to the chest, says indeed to have gone up to that officer and only pushed him gently to the chest, while saying: you must not beat the children, but only separate them from each other. Echten and Johannes Karnspeck Appeared before us, the undersigned commissioners from the Honorable Worshipful Council of Justice of this government, the burgher Hendrik Lambertus Warneck of competent age, who, upon the requisition of the provisional Fiscal, Mr. Jan Jacob Serrurier, declared it to be true: That the deponent, as he believes on the second day that the burghery was assembled in front of the burgher guardhouse for the purpose of continuing their weapons exercises, having also assembled there for that purpose in the afternoon between three and four o'clock, noticed that two children, one belonging to the burgher Engelbertus Iselif and the other to the burgher Ehlers, were fighting, whereupon one of the officers of Justice seized one of those children by the hair and threw it violently against the ground, and further struck that same child in a hard manner, first with his hand and afterward with his cane; upon which the currently detained Conforms W. V. D. Riet appointed Clerk burgher 562 burgher Bartholomeus Goedhart, having intervened and pushed the officer away while saying in substance: "Why are you beating those children? They are burgher children; you must drive away slaves and drunk people," the officer first raised his cane and threatened the aforementioned Goedhart as if he wished to strike him, but afterward dropped his cane and drew his sabre halfway out of the scabbard, with gestures as if he intended to stab or wound the aforementioned Goedhart; that thereupon the aforementioned Goedhart drew his sword and said: "Do not come too close to me," without any further indication of wishing to do any harm to that officer. Declaring nothing more, the deponent gives as reasons for his knowledge as stated in the text, being prepared to confirm the same under oath. No. 3 On the 17th of December 1785 we left the Texel roads with a north wind, and on the 18th of the same, in the evening at 10 o'clock, passed the Heads; that same night it fell calm. Nevertheless we drifted upwards with the fleet, and found ourselves on the 19th of the same, in the evening at 6 o'clock, at a depth of 30 fathoms with Beachy Head north of us; the wind turning southerly, we tacked towards the French coast, when we judged we were far enough from the English coast, we tacked again to the west, kept going thus and passed Portland on the evening of the 20th; that very night the wind turned north-east, we steered our course again and cleared the Channel on the 21st at 12 o'clock at night. - The circumstances remaining favorable, we saw the islands of Porto Santo and Madeira on the 31st of the same. On the 1st of January 1786 in the morning at [illegible] o'clock the wind shifted to the south with drizzle, the gale increased so rapidly that by 9 o'clock in the morning we were already under reefed lower sails, in the evening at 6 o'clock we wore to the west, the gale abated somewhat, then set the main-topsail with 3 reefs; the ship labored frightfully on account of the cross-boiling seas from the south, south-west and north-west; in the night the wind burst out again, such that we had to take in the mainsail and main-topsail, lay under the reefed foresail, main staysail, mizzen staysail and hauled-up spanker; the frightfulness of that night was indescribable; the sky was nothing but fire from the unceasing lightning, the claps of thunder followed each other so closely that one could not distinguish them, and in these terrible circumstances we were forced to carry the aforesaid sails in order to steer the ship, which threatened to work apart, and the wind was also so unsettled that one could carry no sail, as one moment it was a flying storm and the next completely calm; the sea anchor had no effect to keep the ship head to sea, which in the calm spells always fell off, and rolled with the gunwales under water. - On the 2nd of January in the morning around 8 o'clock, 6 shrouds of the main rigging to windward snapped at once, whereupon the mainmast immediately fell, in spite of preventers, side tackles and a spare pair of shrouds; could save nothing of the spars, yet we got rid of the same quickly, because the leeward rigging remained hanging in the cable and could easily be cut away; the mizzen gear caused the greatest hindrance, since the mizzen topmast had fallen through the mizzen sail; while we were busy, a heavy sea came over; a sailor was washed overboard by it and could not be saved, and I was thrown against the hencoop, received a severe wound to the head, yet this coop was the reason that I remained on board, since I washed against it, and then had time to grasp the gratings; the coop subsequently washed overboard to leeward; the waist was full of water, which already ran between decks through the partners of the mainmast; pumped with all pumps; in short, the ship rose, but would no longer heave to; I took the decision to bear away before the wind and sea, which succeeded; for as soon as the mizzen was brailed and the rudder was brought hard to windward, the ship fell off.

At noon we were at latitude 32 degrees 21 minutes, longitude 1 degree 33 minutes. In the afternoon at 3 o'clock the mizzenmast broke. This cost the lives of 5 of our best sailors, who fell overboard with the same, as we were just at that time busy taking down the crossjack yard. The tossing to and fro of the foremast was indescribable. Over all the shrouds I had bolts passed around the masthead; two pairs of spare shrouds on the foremast, together with the heavy tackle, then held it fast. The sea rose ever stronger; to break the force of the seas I had two heavy cables payed out astern, and found this had the desired effect. During the night the gale subsided; we put lashings around the stern through the gunports. On the 3rd of the same, in the forenoon, we stepped a spar on the stump of the mizzenmast and at the same time resolved to set up a rig as best we could and to make for the island of Santo Tiago, to put the damaged rig in order there, which had suffered greatly. On the 4th of the same, the rudder broke; we put in the spare one, wind south-south-west, good weather and abating sea. On the 6th we worked with all diligence on setting up our rig, wind and weather as before. On the 7th of the same we discovered that both the trestletrees and cheeks of the foremast were broken. The Captain shall receive in payment for the amount of the loading, a sum of Six thousand Spanish dollars, above the said valuation, in paper currency or silver specie, according to the rate and valuation which it has here; and the remainder shall be paid by this government in bills of exchange or assignations on the Honorable Company payable in the Netherlands, at six months sight. And besides, for as much common ground wheat, or unbolted flour, as shall be brought in the above-mentioned manner, six Dutch stivers more shall be paid per 100 pounds for grinding money, but nothing more, whether it be for freight, average, or by whatever denomination it might be. The Honorable Company shall deliver to the Captain Carpenter, against payment in the Company's treasury here, eight or ten leagers of old ordinary Cape wines, to be taken along by him for a trial; and shall leave him the liberty, upon his return, according to the profits to be made on those wines, to take again a quantity thereof in payment or on account of what shall remain of the cost of the cargo of wheat and flour, and to receive in such case so much less in bills. 581 has arrived, that although it was judged unnecessary to have the ship unloaded and careened, he nevertheless, with many reasons, raised objections to continuing the voyage to Europe in that condition, at least alone; that for this reason the petitioner addressed himself directly to the Company's ship of his nation also staying here, named Mars, commanded by Captain Diederich Bagge, in order to obtain from it the necessary assistance for the further voyage and to continue the same in company of that vessel, but that unfortunately that ship, having already made a voyage of two years, is itself in a very poor condition, and entirely unable to render the required assistance to the petitioner's vessel in time of need, being in the first place devoid of suitable boats that, in case of an unexpected disaster at sea, could serve to rescue the crew, as well as of anchors, ropes, and other necessities of that nature, which could enable him, in view of the approaching winter season, to await here in the roads the readiness for voyage of the vessel under the petitioner's command, without there being any opportunity to be supplied with one thing or another at present by this Government, and with the aforementioned vessel Mars therefore making all possible haste to depart from here itself, and it being impossible to linger any longer until the ship of the petitioner will be brought into even some condition to sail along.
