And the Governor, upon the reports that the Major of the Regiment had successively delivered to him regarding the aforesaid sessions held concerning that case, having always pointed out to him the fairness and the lawfulness that accompanied the said difficulties of the judges, had therefore also expected that Colonel de Meuron, being informed thereof, would not have hesitated, but on the contrary would have set to work such inquiries as were useful to clear away everything that could hinder the judges in sentencing; but that, on the contrary, it was noticed by the said Governor that the Colonel

596. Colonel de Meuron had thought fit, shortly before the day on which he, with the prior knowledge of the Governor, had intended to convene a court-martial, to cause fourteen of his officers to be arrested, these being those who at the previous court-martial had constituted the majority in the decision to provide the judges with the necessary information regarding the excuse brought forward by the soldier Robert before passing sentence on him; and that said Colonel de Meuron had thus attempted, by the exclusion of those fourteen officers, to allow the court-martial to proceed. That as soon as he, the Governor, had been informed of this utterly impermissible conduct, he inquired of Captain de Bonstetten, who as the senior captain of the Regiment was present at the time, and having obtained a confirming answer from him, had then deemed it necessary, for that reason, to suspend the court-martial, the more so because he, the Governor, came to learn that the aforementioned quartermaster Luchan had subsequently given a declaration before the Council of Commissioners 597. concerning that matter, which was entirely contradictory to what he had deposed in pleno Judicio, as has already been stated before. In consequence whereof he, the Governor, through the Major of the Regiment, had caused a written order to be dispatched to Colonel de Meuron to suspend the convened court-martial until the required information should have been taken and the proceedings fully and formally prepared. That, however, pursuant to the above-cited written order of the Governor, the court-martial which had already been convened concerning the proceedings against the soldier Robert had not proceeded. That, however, instead of removing the embarrassment of the judges and admitting the arrested officers to the court-martial, as being obligated and qualified thereto, the oft-mentioned Colonel de Meuron had thought fit to address a missive to him, the Governor, wherein he gave notice that he began 598. by obeying according to his duty, as he would always do, yet was compelled to protest against it. That according to the Carolina, and what had been attended by him, the Colonel, in the Swiss Regiments under which he had served, he believed he could maintain with good foundation that the proceedings against the soldier Robert had been instituted in the requisite form, but that the subaltern officers of whom the court-martial was composed had not observed their duty by refusing to pass sentence against the criminal who was placed on trial before them; that by causing the quartermaster Luchin to appear before them and demanding a deposition from him, they had committed an act of authority conflicting with his, the Colonel's, authority, since the law had granted solely to him, the Colonel, the power to give orders for taking information, and to the chief judge of the Regiment to take the same pursuant to that order; that these officers, moreover, had undertaken to commit another act 599. of authority against the sovereignty of the High Court-Martial in rejecting a sentence pronounced by the same. That for these reasons he, the Colonel, came to protest in the most solemn manner against those whom this might concern regarding the infringement made upon the laws of the Nation by which all tribunals of the Swiss Regiments must be governed. That he, the Colonel, had to notify the undersigned Governor that by the first opportunity all the documents and proceedings relative to those matters would be transmitted by him to Your Right Honourable Excellencies, in order to make inquiry concerning the same with the Swiss Regiments, and to transmit them to the Magistrate of the City of Neuchâtel, by whom the power to administer justice in his regiment had been given to him, the Colonel, to whom he was accountable in that regard, and who alone was competent to decide whether he, the Colonel, was right or wrong; and that he, the Colonel, 600. would at the same time request Your Right Honourable Excellencies to forward the answer thereto to the undersigned Governor. That as the oft-mentioned soldier Robert was convicted of desertion and theft, for which according to their and our laws he could at least not escape the punishment of the strappado, he, the Colonel, would therefore leave that soldier in detention until Your Right Honourable Excellencies should have put the undersigned Governor in a position to know in what manner sentence regarding the future fate of that soldier ought to be passed. That the undersigned Governor, having judged the points appearing in the aforementioned missive and the protest of Colonel de Meuron to be of such a nature that they demanded serious consideration, therefore communicated all of this in our meeting specially convened for that purpose on 2 February past, after having previously given notice to Colonel de Meuron by missive that since the above-inserted

601. served Protest of him, the Colonel, was found to contain certain points of a very delicate nature, he, the Governor, was consequently about to bring the said document before our Council, in order that it might be deliberated upon and such resolution taken thereon as should be deemed necessary. Wherefore, having fully conformed with the orders given hitherto by the undersigned Governor, and this matter having been seriously deliberated and observed by us in the first place: that the declaration of Colonel de Meuron made in his aforementioned Missive, that he would obey the order received from the Governor to suspend the court-martial, was diametrically opposed to what followed at the end of his missive, namely that he, the Colonel, would keep the soldier Robert in custody until Your Right Honorable Worships should have enabled the undersigned Governor to know in what manner to decide the fate of that soldier, since from the aforesaid order of the Governor 602. it could not be inferred that his intention had been to cause any delay in the proper administration of justice, but on the contrary, that in order to keep the said administration of justice in order and according to the prescription of the laws, the judges should be fully and properly instructed concerning the excuse put forward by the accused. That furthermore it had by no means been asserted on the part of the Governor—as Colonel de Meuron seemed to wish to presuppose—as if the court-martial had not commenced according to order, but rather that in the progress and the inquiries matters had not proceeded to the satisfaction of the judges, and the trial was thus afflicted with major defects. That the officers had likewise not refused to pass judgment on the criminal, but that the same supreme power which commands the judgment of criminals to the judge also commands the same judges by the established laws and ordinances to weigh the crime well and to pay heed to all circumstances that accompany it, in order 603. that if anything should occur therein that must serve for mitigation or aggravation, to take such into regard when passing sentence; and the said officers having thus raised difficulties about proceeding to sentence before the trial had been properly instructed, they had also acted according to the duty prescribed to the judges by the same ordinances, just as the observation hereof in relation to the matter of desertion is found specially noted in the Caroline Ordinance in force with the aforesaid Swiss Regiment, Paris edition of the year 1734, at Article 108, page 171, reading: "dans les informations que l'on prend contre un soldat accusé de desertion il y a quatre principaux chefs a examiner 1: les Causes de sa desertion, scavoir ceque la porté a cette action sil na pas recu la Solde exactement &ca" That as regarded the right to which Colonel de Meuron appealed, as if it pertained to him alone to order an inquiry and to the supreme judge to accept it, one had also not attempted to take away anything from either of them regarding that, 604. insofar as the inquiry was conducted properly in every respect and satisfied the requirements of the law. That with the Protestation which he, the Colonel, had caused to follow thereupon, and the notice provided of his intention to send to Your Right Honorable Worships the trial proceedings and all the documents relating to this case, as well as with the keeping in custody of the soldier Robert until Your Right Honorable Worships should have learned the motives thereof, neither was any service rendered to Justice, nor would the intention of Your Right Honorable Worships be answered. And whereas on the contrary both good order in the aforesaid Swiss Regiment and the general welfare were in the highest degree concerned that Criminal Justice should proceed, and crimes be properly punished. It was therefore resolved by us to order the said Colonel de Meuron, as he was then also commanded upon delivery of an Extract of our resolution, 605. without the least further delay to reconvene the court-martial, with the combination of the abovementioned fourteen officers excluded therefrom in an illegal manner, for the trial of the repeatedly mentioned soldier Robert, and thereby to have the aforesaid court-martial fully instructed regarding all the points about which it, or rather the objecting majority, came to desire information, in order that by them, as becomes all well-disposed judges, a judgment might be delivered with complete peace of mind, founded upon law and equity, and by no means depending upon an informal and untenable manner of proceeding. We had the honor by our humble letter of 8 February last to give your Right Honorable High Mightinesses provisional notice that since the departure from here of Colonel de Meuron, the proceedings against the soldier Robert in question having been determined, his punishment, on account of some additional circumstances, has been mitigated to the extent that he was condemned by sentence of the council of war to remain banished on Robben Island for the period of five years. Regarding the resolution taken by us at that time, to have the present provisioning ship Trompenburg, on its return from here to Batavia, call at the island of Mauritius in order to take on board the coffee beans that were unladen from the ship de Morgenster and remained there, then subsequently having been taken into consideration by us that the aforementioned provisioning ship Trompenburg and the outbound ship de Zeenimph, which had been laden for this Government, would both be ready at virtually the same time to depart from here to Batavia, and that it would better correspond with the Honorable Company's interest to have the ship de Zeenimph, instead of Trompenburg (which, by its rank and size, upon an early arrival in the Indies can serve for better employment for the Honorable Company), call at Isle de France to collect the aforementioned coffee beans: We have therefore deemed it best, and accordingly in our meeting of the 28th of the past month of February taken a further resolution, because the ship de Zeenimph has retained sufficient space to be able to take on the aforementioned coffee beans, to have that vessel call at Mauritius in order to convey the same to Batavia at the disposal of the Lords of the High Indian Government:—. In conformity with which latter resolution, the said ship de Zeenimph now lying ready to undertake the voyage from here, its officers having been ordered by an instruction to request of the French ministry at Mauritius all help and assistance that shall come to be needed for this expedition, and for which reason requests have been made by us via missive to the Lord Governor there, of which missive as well as the instruction handed to the officers of the ship Zeenimph we take the liberty to present to your Right Honorable High Mightinesses authentic copies herewith, so we hope that this our disposition may obtain your Right Honorable High Mightinesses' honored approval. That whereas the said ship de Negotie, pursuant to instructions of the Noble Lords Directors of the Presidial Chamber of Amsterdam, dated 4 October of the aforementioned year, was dispatched to this Government in order to return from here thereafter laden with products, it was considered by us thereupon whether the intended use could indeed be made of that vessel for that purpose. Then regarding which on the one hand it was considered that owing to the great lack of grain (of which notice was already given in our aforementioned missive of 8 February) there is nothing of that product to send, while the wines, which could be exported in sufficient abundance, although on the one hand the time happened to be too short to have them brought up from the country, and on the other hand, even if enough time were still remaining, one would be destitute of the necessary cooperage for that purpose; as regarding which there was a great scarcity of the same for employment in the wine harvest now again at hand. if anything might appear therein that should serve to mitigate or aggravate the punishment, to take such into account when passing sentence; and the aforementioned officers, having thus raised difficulties about rendering a verdict before and until the trial had been properly investigated, also acted according to the duty prescribed to the judges by the same ordinances, just as the observance thereof, particularly with relation to the matter of desertion, is found noted in the Caroline Ordinance in force with the aforesaid Swiss Regiment, Paris edition of the year 1734, at article 108, page 171, reading: "In the inquiries made against a soldier accused of desertion, there are four principal heads to examine, namely the causes of his desertion, to know what drove him to this act, whether he did not receive his pay accurately, etc." That as regards the right to which the Lord Colonel de Meuron appeals, as if it belongs to him alone to order an inquiry, and to the superior judge to accept it, no one has sought to deprive either of them of anything in that regard, so far as the inquiry was conducted properly in every respect and satisfies the requirements of the law. That with the protest which the Lord Colonel allows to follow thereupon and the accompanying notice of his intention to transmit to the Lords Majors the administration of justice and all documents relating to this case, no more than by keeping the soldier Robert in custody until the disposition of the aforementioned Lords Majors should be learned, neither has any service been rendered to justice, nor would the intention of the same, our Lords and Masters, be answered. And since, on the contrary, both good order in the aforesaid regiment and the general welfare are in the highest degree concerned that criminal justice take its course and that crimes be properly punished, it is therefore understood to order the aforementioned Lord Colonel de Meuron, as he is hereby ordered upon delivery of an extract hereof, without the slightest further delay, to convene anew the court-martial, recombining the aforementioned fourteen officers illegally excluded therefrom, for the trial of the repeatedly mentioned soldier Robert, and there fully to instruct the same court-martial regarding all the points about which it, or rather the objecting majority, should come to desire information, to the end that, as befits all well-disposed judges, a verdict may be rendered by them with complete peace of conscience, resting upon law and equity, and by no means depending upon an informal and unsustainable manner of proceeding. Having been informed that the Lord Colonel de Meuron will proceed to hold a court-martial to the exclusion of fourteen officers who are under arrest for having made it a point of conscience, in a session of a previous court-martial, to judge and pronounce upon a proceeding which in their opinion was not drawn up in proper form on the subject of the soldier Robert, accused of desertion; who is said to have complained in his declarations of having paid for a second musket, the first having already been paid for although defective; as well as that the quartermaster Luchain had made depositions on the subject of this in the full previous court-martial, and afterwards in private before commissioners subsequently appointed; and as according to my information these depositions are absolutely contradictory, they cannot therefore be admissible, neither in the one nor in the other case, and for that reason were rejected by the majority of the said past court-martial; these gentlemen therefore believed they had to suspend their judgment until complete information was obtained. According to the Carolina and what I have seen practiced in the Swiss Regiments in which I have had the honor to serve, I believe I have grounds to maintain that the proceedings are sufficiently prepared; that the Gentlemen Junior Officers who compose the court-martial failed in their duty by refusing to pass sentence against a criminal who was delivered to them for this purpose by sovereign sentence; that they committed an act of authority infringing upon mine, by causing the quartermaster Luisin to appear before them to give testimony, seeing that the law attributes to me alone the power to order inquiries and to the Grand Judge that of receiving them according to my orders; that they committed another act of authority infringing upon that of the Superior Council, by disapproving its sovereign sentence. For these reasons, I solemnly protest against whomever it may concern regarding the infraction, in my view, committed against the Laws of the Nation according to which the Tribunals of all Swiss Regiments must be governed. Having therewith wished you God's blessing and a safe and prosperous voyage, we remain, Below was written: Your good friends. Was signed: C. J. van de Graaff, P. Hacker, A. van Schoor, J. L. le Sueur, O. P. de Wet. In the margin: In the Castle of Good Hope, the 14th of March 1786. To His Excellency the Count of Souillac, General in the service of His Most Christian Majesty, and Governor General of all his Establishments in the East Indies, etc. etc. etc. Sir, Allow us to have the honor of reminding you of what happened in the year 1782 with regard to a ship belonging to the Noble Dutch Company. It was in that year that, at the request of His Excellency Lieutenant General de Bussy, our Government sent the ship the Morgenster to transport provisions from here to Isle de France for the King's squadron in the Indies. After that expedition, we were informed by a letter from you dated 25 September of the same year 1782 that the said vessel the Morgenster had arrived there; as well as by a letter from General de Bussy addressed to Monsieur de Plettenberg, former Governor of this Colony, 628. dated 17 December of the same year, stating that the said vessel the Morgenster had been employed to transport troops to India. But in neither of these two letters did we have the honor of being informed of what had become of the coffee with which the said vessel the Morgenster had been loaded. It was therefore only upon the return of this vessel from Ceylon in the year 1784 that we learned from the commander of the said vessel, J. Bergs, that by order of the French Government this coffee was unloaded and had remained at Isle de France, of which unloading the said commander J. Bergs provided an official report here. It was then assumed that the French ministers would kindly take care that this coffee be sent by some opportunity either to Batavia or to Holland. And as the vessel the Morgenster did not call here on its way from Ceylon, and as we were not informed by the commander of the said ship regarding this coffee until after the vessel 't Huis te Spijk had departed from here in the year 1784 to transport French troops to Isle de France, we could not, as would otherwise have been done, give orders for the said coffee to be transported here on that vessel. We were therefore always in uncertainty regarding this coffee, until Monsieur the Intendant de Chevreau, who on his return to France passed through here in the month of December last, gave us very certain information that the coffee unloaded from the vessel the Morgenster, amounting to 150,000 pounds, is indeed still at Isle de France and has been placed in the King's storehouses. Upon this information, this Government has presently resolved that the vessel the Zeenimph, on its voyage from here to Batavia, shall call at Isle de France to load the coffee in question and transport it to Batavia. At the same time, we have given orders to the officers of this ship by an instruction, a copy of which is enclosed, to ask the French Government of Isle de France for all the assistance they may need to execute this expedition; which aid we are persuaded your Government will not refuse them. On the 21st and 30th of January last, having successively arrived here, the Batavia and Ceylon return ships de Hoop and Huijsduijnen, both laid on for return to your Honors' Chamber, the ship Huijsduijnen, as appears from the enclosed authentic copy of the report by the commissioned seamen, had to be provided here with a search mast; which both ships de Hoop and Huijsduijnen now lying ready to sail to further the voyage to the Netherlands, we take the liberty to forward to your Honors via the last-mentioned ship Huijsduijnen, enclosed herein, the copy of our general letter dated today, likewise addressed to the Illustrious College of the Noble Lords Seventeen, with its annexes, as well as a list of the persons who are to depart from here for the Netherlands with the aforementioned ship Huijsduijnen, among whom are: the former presiding member in the Council of Justice of the Castle of Batavia, Mr. Gijsbertus Maas, and his wife Anna Nelen, together with two serfs named Damon of Batavia and Poedak of Mandhar, the passage and board for the same having already been paid at the Indian capital; Catharina Schook, widow of the late Advocate Fiscal Mr. Jan Cornelis Luijken, together with her three children named Aletta Catharina, Gijsbert Pieter Adriaan, and Jan Coenraad Cornelis, and one female slave, Anna of Bugis, and this free of passage and board; which aforementioned persons arrived here from Batavia on the provision ship Trompenburg, with recommendations from the Lords of the High Indian Government to assist them as much as possible in the further continuation of their voyage to the fatherland, and to provide for them a suitable and convenient passage on one of the Company's return ships. And furthermore, at his request, it has been permitted to the repatriating former Chief of the Japanese trade and former assumed member of the Council of Justice at Batavia, Jan Hendrik Haringa, returning from Ceylon with the aforementioned ship Huijsduijnen, to take along with him from here to the Netherlands a female slave named Rosetta of Sambouwa, for whom the requisite passage and board for the outward and return voyage from and to Batavia has been paid here into the Company's treasury. The long invoice of the lading of that ship having been received from Ceylon with the aforementioned ship Huijsduijnen, to be forwarded to the fatherland by the first shipping opportunity, we did not, however, deem it safe to dispatch the same in advance from here with one of the foreign private ships, and thus by the French ship L'Elisabeth Sophie, which recently departed from here; wherefore the aforementioned invoice, sealed separately according to custom, has been handed over for delivery to the captain of the bearer of this, the ship Huijsduijnen, Lourens Cornelissen. 647. Arrival of the ships Vreedenburg and Straalen. What reports concerning the ships Nepthunus, Vreede en Vrijheid and Draak have arrived here. Return of the provision ship Trompenburg. Meanwhile, on the 30th of the aforementioned past month of April, the Company's outbound ships Vreedenburg, with 6 deceased and 35 sick, and Straalen, with 6 deceased and 2 sick, safely arrived here, the aforementioned vessel Straalen having stayed at the island of St. Iago from the 27th of January until the 2nd of February. And since it has been reported to us by the officers of the said two ships that the ship the Nephtunis, of which mention was made in our respectful letter of the 19th of April mentioned above, had already departed from the island of St. Iago for Batavia on the 8th of that month, and that the flute ship Vreede en Vrijheid on the 20th of that month, as well as the ship the Draak, were both hailed in good condition off the coast here, these vessels, as well as the ship Oud Haarlem which is still behind, are accordingly expected here daily with longing. Also on the 28th of the aforementioned month of April, completely unexpectedly, there arrived back here in the roads 648. With the reasons why its officers had to decide to return hither. the provision ship Trompenburg, returning from Batavia, whose officers reported that since a few days after the departure from these roads it was discovered that the foremast of that vessel, above the middle of the parrel rib of the aftermast partner, was heavily cracked, and thus in such a place where, by applying cheeks or wooldings, insufficient strength could be imparted to the said mast to continue the voyage with the required speed and peace of mind, and that in addition the said vessel was still being driven to the west of this bay by the daily persisting stiff southeasterly winds, the officers had therefore taken the resolution in the ship's council on the 13th of that month to return hither; as Your Right Honourable Worships may, if it pleases you, observe in further detail from the ship's resolution, an authentic copy of which we have the honour to present alongside this. 649. Which ships are still expected from Ceylon and China. And we further take the liberty dutifully to inform Your Right Honourable Worships hereby that we were informed by the Galle Ministers in their letter of the 10th of February past: that for the subsequent dispatch from Ceylon for the Netherlands the ships Sparenrijk and Stavenisse were designated, the first for the presiding Chamber of Amsterdam, and the other for the Chamber of Middelburg, but since the first-mentioned ship Sparenrijk, having already departed from Malabar for Ceylon in the beginning of the month of January with a cargo of pepper, had not yet arrived there, that change in the destination of the ship Stavenisse was accordingly made by the Ceylon Government, that this vessel was designated for the presiding Chamber of Amsterdam, and the ship 'T Slot ter Hoge for Zeeland. Thus the arrival of the aforementioned vessel 'T Slot ter Hoge as well as that of the 650. Dispatch of the six return ships mentioned alongside. Wines that were shipped in the same here. ship D'Afrikaan, which is still expected from China, is daily awaited here with great longing. The bearers of this letter, the return ships Voorschooten, Barbestein, Stavenisse, Hinlopen, Pollux, and Constantia, having been properly supplied with everything necessary for the further voyage, have thus been enabled, weather and wind permitting, to depart from here for the Netherlands on the 4th of this month of May, where we hope and wish that they may arrive safely and prosperously. The following wines were shipped here in the above-mentioned ships Stavenisse, Hinlopen, and Barbestein: 651. Not more than the above-mentioned 20 aams of Constantia wine could be obtained. In Stavenisse: 10 leagers of ordinary Cape wine. In Hinlopen: 6 aams of red and 6 aams of white Constantia wines. In Barbestein: 4 aams of red and 4 aams of white Constantia wines.
