and the reasons why people have become increasingly sparing in releasing Company servants, requesting the Gentlemen Majores not to grant such people permission, along with the reasons for that request; that this, never allowing the cause to end through which the expansion of this colony came to arise, and a complete conviction of the disadvantage residing therein, has also caused the Government here to become increasingly sparing in emancipating the Company's servants into Free Burghers, to which one therefore does not proceed except in the case of extreme necessity; that just as one can inform Your Right Honorables with certainty that among the burghery there is no shortage of persons of the trade and profession for whose practice the aforementioned petitioners claim to wish to establish themselves here, we must respectfully request Your Right Honorables to take into consideration how, by granting the request of the aforementioned persons, very much encouragement and occasion would be given to those of the Company's craftsmen, commoners, or military personnel who, although inclined to remain here, nevertheless always much prefer the burgher state over the service of the Honorable Company, to request their discharge to Europe upon the expiration of their contracted time, against all efforts and measures arranged for their continuation in the Service, whenever they cannot obtain such, in order to come and trouble Your Right Honorables with incessant requests of that nature; that one must finally add to this that it has repeatedly been observed how people who have come over to this place with permission from Your Right Honorables wish to be distinguished from those who obtain burghership here from the Company's service; whereas, with respect to the latter, upon the issuance of the Freedom Letters, the power and authority have from old times been expressly reserved to the Government to take them back into service at any time for their former rank and wage and send them away from here, whenever needed or should their conduct not be proper, with submission of the same furthermore to all such ordinances as have already been drafted or might in the future yet be established regarding the matter of free persons. Likewise was resumed the highly esteemed missive from Their High Nobles, the High Indian Government, dated 24 July of this year, brought by the recently arrived chartered private ships Dordrecht and d'Eensgezindheyd, pursuant to which the also chartered ship Eyk en Woude has been designated by Their High Nobles to come over hither laden with necessities for this government, in order, after unloading, to be further dispatched directly to the Fatherland with a cargo of Cape return goods. It being taken into consideration that regarding the wheat, which article should constitute the principal part of that cargo, due to the persistent drought and destruction by caterpillars, the expectation at present is so poor that in some places one seems barely able to expect the necessary bread and seed for the farmer himself; and that, since there has been no opportunity to purchase Bourbon coffee beans, and likewise since falck, for several years, has risen to such an excessive dearness that instead of being able to yield any profit, a loss would certainly be incurred upon it, there consequently only remains to satisfy the requisition for wine; but of which the Right Honorable Gentlemen Directors of the Chamber Amsterdam, in their honored missive of 24 June 1784, were pleased to request only a quantity of 51 leggers of various sorts, which would also make up only a very small part of the aforementioned cargo; whereby neither the objective of Their High Nobles nor the interest of the Honorable Company would be answered, as it is not fitting that that vessel, being so underladen, should return further to the Fatherland; it is therefore resolved, since the freight charges for the aforementioned vessel have indeed been stipulated, and the profits, however small, falling upon the wines can serve to support those expenses, to send along with it to the Fatherland as much of the extra sorts of wines as can be obtained; to which end, so that the aforementioned vessel upon its appearance will not need to be detained long, the Honorable Merchant and Cellarmaster Mr. Jacobus Johannes Le Sueur has been authorized to purchase in good time on the Company's behalf, according to the quality of the wines, up to the maximum price of 100 Rixdollars for the leggers of red muscatel or Pontac, and the other lesser sorts proportioned thereafter, all that will still be obtainable from the wine farmers; just as also, since ox hides were formerly transported from here to Europe with profit by foreign nations, authorization has been granted to the Lord Chief Administrator to purchase of them, provided

deliberation concerning the further destination of the alongside mentioned ships Josephus the Second, the Factor, and Rhijnoord, provided it can be obtained at a reasonable price, to purchase a good quantity for the further lading of the aforementioned bottom. With respect to the three private vessels chartered on the Company's behalf that arrived from the Fatherland, the Josephus the Second, the Factor, and Rhijnoord, it appears from their charter parties, according to which it was ordered that one shall have to conduct oneself here, that the aforementioned vessels, after being discharged here, shall have to undertake the voyage to the Patria with a return cargo, or, in case this government might judge such to be more in accordance with the Company's interests, be sent on further to Batavia or Ceylon. Which conditions one must firmly trust to have been determined thus alternatively under the assumption that here, for the loading of the aforementioned vessels, or one of them, some of the goods discharged from the return ships of the years 1780 and 1781, or sufficient other Cape return goods, might have been on hand; but such lacking, one would be able to make the same ships sail on from here further to Batavia or Ceylon for that purpose. Since for the fully loading of the aforementioned expected bottom Eijk en Woude for the Patria an absolute impossibility is already perceived, on which grounds it was deemed necessary, so as not to send the aforementioned three vessels back to the Fatherland in ballast contrary to the Company's interests, to let the same continue their voyage further to the Indies. of which the first two mentioned shall be dispatched to Batavia, and the Factor to Ceylon. Then, taking further into consideration that, as appears from the abovementioned letter of the High Indian Government, due to a lack of return cargo for all the chartered ships present there, the aforementioned bottom Eyk en Woude obtained the said destination hither, for which reason one must also be apprehensive that by letting all three of the aforementioned ships proceed further to Batavia, some inconvenience would be brought upon Their High Nobilities regarding the interest of the Honorable Company. Whereby on the other hand one also remains in uncertainty whether, with such an unforeseen and late appearance at Ceylon, sufficient return cargo would be found on hand for the same. It has therefore been deemed best and resolved to have the ship the Factor continue its voyage thither for that purpose, as of the three abovementioned it carries the smallest tonnage and is moreover best suited to sail for that island still in time and also to be able to return from there with a cargo before the end of the monsoon, and consequently to have both the specie and the further lading of that bottom for the capital of the Indies transferred at once into the ship Josephus the Second. Which latter, together with the bottom Rhijnoord, after its unloading, shall be dispatched in accordance with their charter parties to the aforementioned capital Batavia. And in fulfillment of what is stipulated in the charter party of the said bottom Rhijnoord, so far as it pertains thereto, an extract of this shall be handed to the master of that vessel. While it is further understood that the copper doits brought by the same ship Rhijnoort per invoice for this government, since the same coins can be of no use or service here, shall be sent on with that bottom to Batavia. to request the Gentlemen Majors to send no more doits to this Government in future. Resolution for the delivery of the alongside mentioned permitted chest to the Honorable Messrs. Lesueur and van Echten. The Honorable Messrs. Van Schoor and Lesueur commissioned for the contracting out of the hauling of building materials for the Honorable Company. And for the same reason it is resolved to request most submissively from the High and Mighty Lords Masters, on the very next occasion, that in the future no more doits may be sent to this place. Upon the request made by petition by the Honorable Merchants Mr. Jacobus Johannes Le Sueur and Johannes van Echten, as general attorneys of the former chief surgeon of the Castle of Batavia and visitor of the roadstead the Honorable Fredrik Schouman, it was further approved to cause to be delivered to them a chest, among other permitted goods discharged and salvaged here from the ship 't Meeuwtje, marked CB, belonging to the chief cooper Cornelis Bredie assigned to the aforementioned small vessel and filled with goods for his account by the attorneys of the said Honorable Schouman, the Messrs. Boerrigter and Sons at Amsterdam, as well as to agree that that chest be forwarded with one of the present Company ships to the frequently mentioned Honorable Schouman, provided that the Honorable petitioners provide proper surety for restitution and indemnification on behalf of those who might be found to have any further lawful claim upon the said chest and the goods packed therein. Pursuant to the resolution of the 11th of October last, and in accordance with the notices posted for that purpose, the contracting out of the hauling of the necessary building materials for the Honorable Company to whoever will come to offer such at the lowest price being to take place on the 15th of this month, it is agreed to request and commission for this purpose the Honorable Merchants Adriaan van Schoor and Mr. Jacobus Johannes Le Sueur, as their honors are hereby commissioned to that end. Right Honourable Sir, Report of the Commissioners concerning the ship 't Huys te Spyk. Pursuant to the resolution taken in the session of 9 September last by the Honourable Equipage Master Justinus Van Gennep, together with the Captains Jan Siereveld and Christiaan van Veerden, as well as the Master of the hooker Katwyk aan Rhyn, Daniel Haas, having been expressly commissioned to examine the ship 't Huijs te Spijk further and most accurately, assisted by the Master Shipwright of the Company's Yard here and the Chief Carpenter of the aforementioned hooker Katwyk aan Rhijn, they have submitted regarding this the following report: To the Right Honourable Sir Cornelis Jacob van de Graaff, Governor of the Cape of Good Hope and its dependencies, etc. etc. etc., together with the Honourable Council of Policy. Right Honourable Sir and Honourable Sirs! Whereas the ship 't Huys te Spyk—which, pursuant to your Right Honourable and Honourable Sirs' resolution of 12 January of this year, had been designated with a cargo of wines and other goods for Batavia, and consequently also undertook the voyage from False Bay to the said Indian capital on the 12th of the recently passed month of August—returned back here to the roads on the 6th of this month of September, and by its Master Sijbrand Waarland there was delivered to the Honourable Governor the resolution taken on the 20th of the said month of August by the collective officers of that vessel to turn the bow back again to this place on account of the heavy leakage and other defects discovered on the said ship; Your Right Honourable and Honourable Sirs, by your resolution of the 9th of this month of September, expressly commissioned the undersigned Equipage Master, together with the co-signed Captains Jan Siereveld and Christiaan van Veerden, and Master Daniel Haas, to examine and investigate the aforementioned ship 't Huys te Spyk most accurately in the presence of the Master Shipwright of the Company's Yard here, Mijndert van Dijk, and the Chief Carpenter of the hooker Katwyk aan Rhijn: 1. Whether the defects specified in the aforementioned resolution of the ship's officers were truly found on that vessel. 2. Whether the same defects are so severe, and thus of such a nature, that disaster was reasonably feared because of them, and the collective officers were thus under the necessity of taking a resolution to return back hither with that vessel. 3. The causes by which these defects could have arisen so suddenly. 4. Whether, these being present, any means of repair can be employed in order to have that ship safely resume the voyage again with the cargo contained therein, or how else it should be dealt with for the greatest benefit of the Honourable Company. As well as subsequently to render an accurate statement and report in writing of their findings. An extract of which resolution taken by your Right Honourable and Honourable Sirs having been handed to the undersigned, the undersigned, in order to dutifully fulfill what was required of them, proceeded on board the said vessel and accurately surveyed and examined its present condition in the best possible manner, wherefore they take the liberty of serving the following report regarding this: That concerning the first point, it appeared from the friction on the beams, both forward and aft of the mainmast, but indeed principally in the forepart of the ship, that the same, and especially principally those which were laid on new at Mauritius during the rebuilding, must have worked in and out very heavily with the motion of the ship, since most knees and futtocks throughout the entire hold have separated by a considerable distance, and in most of them the bolts have worked loose. That further the ship is broken near the tack-cleats, and further aft up to the gangway, and the wales have already parted from one another in more than one place, spread, started, or cracked. From all of which it is most clearly evident that in the report or the ship's resolution of the officers of the aforementioned ship 't Huys te Spyk, the condition and defects of that ship were not exaggerated thereby, as the principal of these were not even yet known to them at that time. That regarding the second point, the aforementioned defects are of such a nature that if the ship had been overtaken by a storm accompanied by high seas—as often happens when passing the South—it would probably have been in great peril, and it was greatly to be feared that the ship would have had to burst apart and subsequently sink, whereby the officers were compelled, for the preservation of ship and sails, to make for the nearest port.

That, concerning the third point, similar defects usually tend to be discovered very suddenly and all at once on old, worn-out, and weak ships, such as 't Huys te Spyk, particularly when they are overcome by strong or high seas; to which is added that the upper part of that ship, due to the repairs done to it at Mauritius, had been considerably stiffened, and the lower part, since nothing was perceived on it, had remained in its previous state; it seems that those two parts, now during the violent motion which the ship made, wanted to separate from each other, because the bolts driven through the knees, giving off rust due to water leakage, had thus acquired play, which defect, not having been discovered before the ship came into violent motion, naturally would also daily increase and worsen in proportion to those more violent movements. Which, not having been easily investigated and detected during the previous inspection made of the aforesaid ship 't Huys te Spyk, was nevertheless always to be feared upon encountering bad weather and high seas. That the stated defects on the aforementioned ship 't Huys te Spijk can not only by no means be repaired under this government in such a manner that the ship will be able to resume its journey with peace of mind, but that the undersigned dare to add with all certainty that the ship, whether in the Indies or in Europe, can no longer be repaired. However, to decide how, under these conditions of that ship, it ought to be dealt with to the greatest benefit of the Honourable Company, and whether it would be more profitable for this ship to be sold publicly to the highest bidder, or rather, as has always been customary before, to be decommissioned and broken up, in order to subsequently employ the still serviceable timber for certain necessities, both on the batteries and otherwise, for the benefit of the Honourable Company, and the unusable parts for firewood for the Country's boats and the Equipment Yard, the undersigned declare that they do not possess enough knowledge or insight for this, wherefore they take the liberty of leaving it to your Highly Honourable and Venerable Lords to dispose of this according to their wise judgment as they shall find most consistent with the interest and benefit of the Honourable Company. The undersigned Master of Equipment must, however, submissively state here that since, during the latest war, the firewood on Paarden Island and along the East Shore of this bay—where previously the required amount thereof for the Equipment Yard and the permanent vessels could be rowed and brought over with rafts—has now mostly been removed, the shortage of firewood at present has increased so much that if this is not provided for by some other means, one will soon be brought into the situation of having to cart the necessary and indispensable fuels for use by the Equipment Yard and vessels, as is done for all other posts, at considerable expense to the Honourable Company, either with its own wagons or by private individuals. Believing herewith to have complied with your Highly Honourable and Venerable Lords' very revered Order, the undersigned let this serve as a humble report. La Bonne Resolution, chartered at Batavia to carry from there a return cargo for the account of the Dutch East India Company and consigned to the same at the Rotterdam Chamber: That he, Captain Lundgren, on the voyage from Batavia aforesaid hither, due to heavy weather, sustained a considerable leak to his ship, which to properly repair he finds himself entirely unable to do without previously discharging his cargo here. That he, Captain, further, upon his arrival at this place, had to experience to his sorrow how, notwithstanding all efforts and diligence exerted to prevent the said leak from causing any harm to the cargo, the same nevertheless caused severe damage to his saltpetre, pepper, and coffee on board. Yet that he, as his aforesaid cargo belongs, as said, to the Dutch East India Company, did not wish to fail, nay deemed it his duty, to represent these matters to your Noble Gestrenge and Honorable Esteemed Authorities, the more so because he does not judge himself authorized to undertake on his own authority and risk the discharge of his vessel and further management of its cargo. Which also causes him to turn with humble request to your Noble Gestrenge and Honorable Esteemed Authorities, so that it may please the same to grant him, the petitioner, the necessary assistance in discharging his cargo, as well as causing the same to be stored in some ship or in one of the warehouses of the East India Company here, and preserved there for their account, until such time as he, after proper repairs have been carried out, shall be able to take it in again, and with peace of mind then continue his voyage. And that your Noble Gestrenge and Honorable Esteemed Authorities likewise may please be so kind as to send a commission on board the petitioner's ship on behalf of this government, before the requested discharge takes place, in order to inspect accurately the condition of the aforesaid cargo and damaged goods, so that he, by means of these measures having appeared to him, the petitioner, as highly necessary precautions, may be able upon his arrival in Europe to properly protect himself in all respects regarding the aforementioned cargo. Upon request made by Colonel Gordon, as president of the Burgher Military Council, on behalf of the same military council, that the scribes of the burghery officiating with that body, Christiaan Anthony Loogen and Johannes Adrianus Vermaak, might be appointed as Secretaries, with the rank of Burgher Ensign, so as to succeed always as such after the youngest of that quality, the same was conceded, they accordingly to be sworn in as Secretaries; as it was also deemed proper, upon the proposal of said Colonel Gordon, to place the present Messenger of the burghery, Jurgen Marthinus Prins, as well as his successors in the future, under the oath of that office. To the scribes of the burghery henceforth granted the title of secretary and rank of burgher ensigns, and the same, as well as the burgher messenger, to be taken under oath. The Governor gave further to know how, on the occasion that His Honour had recently been present to attend the ordinary burgher exercise at Stellenbosch, by the Captain of the company of burgher infantry at Stellenbosch, converted into a company of cavalry, upon the proposal of the Governor and on the good testimony given by Colonel Gordon regarding the competence and shown diligence in the service of the Honorable Company of the Foreman at the Armory, Johan Fredrik Heydenreich, as well as on His Honour's further attested necessity for the promotion of the same Heydenreich and the appointment of a foreman at said Armory, the said Heydenreich is accordingly advanced to Master of the same Armory, with the pay of 50 guilders per month, and in his place appointed again as Foreman there with 30 guilders per month, the sword cutler Christiaan Godlieb Soon. the Company of Infantry there, Daniel Jacobus de Kok and the other officers of that corps, it was made known that most of their privates, as well as they the officers, had greater opportunity to perform the exercises on horseback instead of on foot, just as moreover each of them found himself obliged to keep a riding horse ready in order to be able to proceed Cape-ward as quickly as possible in the event of a general call-up, for which reason the mentioned Captain and other officers had requested that the same Company of Infantry might be converted into a Company of Cavalry: and that his Honour, having taken the opinion hereon of the officers and members of the Council of War who were present thereat, they had testified that this could take place in a very convenient manner, the more so since, as the Cavalry for the most part comes to do the exercises on foot, those of the Infantry who might be absolutely unable to provide themselves with the necessary riding horses could nevertheless present themselves at the usual time to perform the exercises on foot. Which alterations being judged to serve to the better benefit and service of the mentioned Company in case of the defense of this place. It is therefore, on the proposal of the well-mentioned Governor, agreed to grant the aforementioned request, and consequently to convert the mentioned Company of Infantry into a fifth Company of Cavalry of Stellenbosch and Drakenstein, as which it shall also in the future be regarded and perform service. Because complaints were lodged with the Lord Governor by the Captain of the present ship Alblasserdam, Ary van Valkenburg, and the Lieutenant Engineer Francois Luson stationed on that vessel, against one another on account of some differences that arose between them on the voyage hither, which complaints, however, the well-mentioned Lord Governor testified, upon close examination, to have found to have originated more from disharmony than from anything essential, it is therefore, partly to prevent further discrepancies, and partly on account of the indisposition of the mentioned Lieutenant Luson, permitted to him, at his request made, to remain here, with suspension of salary, together with his wife and two children, to await a further opportunity for transport. After which was read an incoming letter from the Landdrost and Heemraden of Swellendam of the following content: To the Right Honourable, the Valiant Lord Cornelis Jacob van de Graaff, Governor of the Cape of Good Hope, with the jurisdiction thereof, etc., etc., etc., together with the Honourable Council of Policy there. which Board will be ordered to collect the outstanding head-money and other monies, first and foremost. Letter from the Landdrost and Burgher Military Council at Swellendam to the Servants. Since the arrears of the Colony's Treasury reported therein appear to be caused chiefly by a lack of diligence in the timely employment of the means clearly provided by the practical and local laws to compel delinquent debtors to satisfy their arrears, for which purpose that Board already possesses sufficient authority; on which account it was also found entirely improper to request that the delinquents be summoned to satisfy their arrears by a proclamation of this Government. It is therefore understood to order the said Board by letter to first have notices posted, whereby such persons are earnestly warned to come and satisfy their outstanding head-money and other monies within a certain reasonable time to be prefixed by the said Board, or that, in default thereof, proceedings will be instituted against the delinquents according to law; and that also, after the expiration of that time, the same proceedings must be put into effect against those who have then remained in default. Likewise, consideration was also given to a letter received from the Landdrost and Burgher Military Council of the said Colony of Swellendam, reading: To the Right Honorable, Highly Esteemed Sir, Cornelis Jacob van de Graaff, Governor of the Cape of Good Hope, with the jurisdiction thereof, etc. etc. etc., together with the Honorable Council of Policy there. Right Honorable, Highly Esteemed Sir, Honorable Gentlemen! Since the Burgher Cavalry Captain Mr. Jacobus Johannes Botha some time ago behaved very improperly at a public auction and insulted, in the most infamous manner and in the most obscene terms—of which some documents already exist and others are still being collected—an entire family who are regarded by everyone here as very orderly and respectable people; the first undersigned privately requested the said Mr. Botha in a friendly manner not to appear in front of the front rank during these exercise days, so that no disorders might occur, which were to be feared because most of the officers showed themselves unwilling to serve with him, Mr. Botha. To which request he not deferring, the first undersigned had the senior officers present convened, and sent the Secretary in the name of the Board to the repeatedly mentioned Mr. Botha, in order to request him once again in the most friendly manner to be pleased to absent himself under one pretext or another, in order to prevent unpleasantness. As he still refused to do this, the first undersigned resolved to convene an extraordinary military meeting the following day, excluding the aggrieved persons Messrs. George Fredrik Rautenbach and Pieter Hendrik Ferreira, with the inclusion of the sergeants present; in which all the members unanimously testified that, as officers of honor, they could not serve with the repeatedly mentioned Mr. Botha. Wherefore it was resolved, in order not to bring matters to the utmost disorder, to dispatch two military officers, together with the Secretary, to the repeatedly mentioned Mr. Botha, and to serve upon him and hand over a copy of the resolution adopted, which we have the honor to transmit herewith to Your Right Honorable and Highly Esteemed and Honorable Council. Which being requested, the said deputies reported having received the answer that he, Mr. Botha, would appear in front of the front rank. Whereupon the Lord Governor was pleased to add that His Honor, regarding what was presented in the same missive, had already been informed by the Ritmeester Botha himself, who had testified to feeling a heartfelt regret over what he had done wrong on the occasion when, by an immoderate use of drink, he had been heated; with readiness to give sufficient reparation and make apologies to the insulted persons before the aforesaid Council of War, His Honor in the meantime, for such an amicable settlement of the parties, in order to prevent further consequences, had already sent the necessary instructions to the aforementioned Landdrost Onkruyt: And it was therefore, on the proposal of the aforementioned Lord Governor, approved to await the outcome thereof by a further missive from the aforesaid Landdrost and Council of War. Upon the petition presented by the attorneys of Captain Lambertus Aernault Halfman, who repatriated last year on the ship 't Slot ter Hoge, it was approved to permit that his slave boy named Fortuyn of Bengal, in consideration of the zeal shown by him in discovering the horrible murder conspired on the aforementioned vessel by the Easterners, whereby that execrable plan was fortunately prevented and hindered, be released from slavery into freedom, and to excuse the same Halfman from the payment of the sum of money determined since then for the benefit of the Poor Relief upon the freeing of slaves; it is also granted in the same regard to the aforementioned slave, according to his request, without payment of passage or board money, to be allowed to sail over to Batavia on the present ship Alblasserdam. Appointment of two ordinary Commissioners. The ordinary Commissioners Johannes Adolph Kuuhl and Gotthold Holtzapfel, the former by old age and bodily infirmities, and the other often hindered by illness from proceeding with the required vigilance in their functions, whereby it sometimes happens that the operations for the unloading and loading of ships, or other matters in which their presence is required, must suffer very much delay, it is, on the proposal of the Lord Governor, out of consideration of the old age and long services of the former, together with the hardships and fatigues suffered by the latter during his various voyages made to Madagascar, Mosambique, and Zanguebar, and the slave trade conducted there to great profit of the Honorable Company, approved to appoint to their assistance as ordinary Commissioners, with the quality and wage at ƒ 30:- per month, the Assistants Hendrik Oostwald Eksteen Hendriksz. and David Kuuhl, with the understanding, however, that upon the vacating of the posts of the aforesaid Kuuhl and Holtzapfel the number of those officials shall be restored, as before, to two. Permission to the said free black to depart for Batavia. And to the Free Black Kitjil of Boegies, upon his request made by petition, permission was granted to proceed to Batavia with his wife and a slave boy on the ship Alblasserdam, and this on account of his poverty, without payment of passage or board money. Appointment of van Echten as Warehouse Master, and of the Pay Transfer Clerk Matthiesen as Pay Bookkeeper. to bring the auction moneys to payment as determined by the old Batavian statutes, on the grounds that at sales, both persons from the country and those residing at the Cape buying the goods, it was often impossible to obtain payments from the former without unpleasant legal proceedings and prejudicing the public auctions, except after the lapse of several months. That therefore, for the preservation of the credit of sales at this place, as well as not to be under the obligation, in order to enable oneself to make payment, continually to constrain immediately by judicial means those who are somewhat tardy in paying for the purchased goods, he took the liberty of bringing to the attention of this council how, for a long time already, at the capital of the Indies itself, the determination of the time for paying out the auction moneys had been set at four months; requesting, therefore, that it might please this council also to fix for the future such a suitable time for the same payment as should be deemed proper; and thereupon it was resolved to set for the payment of the auction moneys a term of at most three months for the auctions held at the Cape and in its environs, and of four months for the sales taking place in the countryside and in the outer districts. It being furthermore approved, instead of the repeatedly mentioned C. de Wet, as he is no longer able to attend to the administration of the Trade Warehouse alongside his present office, to appoint as Warehouse Master the Junior Merchant and Pay Bookkeeper, as well as Curator ad lites, Salomon van Echten, and to let succeed to the last-mentioned post, with the rank of Junior Merchant, the Bookkeeper and Pay Transfer Clerk Clement Matthiesen Junior. On the proposal of the Governor, on behalf of the Company, some wines will be offered as a gift to the Knight de Peynier, and the time will be determined for how long it should continue. They had entered into an agreement with the said De Vos for the said prices. Whereupon, noting the greatly increased dearness of horses and their maintenance, along with what further is required for the necessary expenditure thereto, and seeing that these prices have been more or less adjusted accordingly, it has been resolved to approve the said agreement, to take effect for the period of one year starting on 1 December next; but keeping reserved to this Council, after the end of that year, to continue that contracting out on the same agreement for a following year: and this insofar as one will still require that cartage by the bringing in and using of more wagons or carts of the Honorable Company itself. The Governor having proposed to this assembly whether it would be entirely fitting to give a distinguished token of deep acknowledgment and gratitude to the Knight de Peynier, Chef d'Escadre of His Most Christian Majesty, on the occasion that the said Knight de Peynier, with a squadron returning to Europe from the Indies under his orders, is currently anchored in the roadstead of this government, on behalf of this government, to that famous General, in particular for his zeal and willingness demonstrated in the late war, as well as his careful vigilance and highly commendable dispositions made for the defense of the important post of False Bay, where the said Knight de Peynier lay at anchor with a squadron of warships destined for the co-defense of the Dutch possessions in the Indies under his supreme command, at a point in time when the Governor of this Colony had received report that a hostile fleet commanded by the English commander Bikkerton, sent out to undertake an attack on these coasts, had already approached the vicinity thereof, as well as likewise on account of his assistance so cordially offered by the military force of the fleet, if the enemy had at that time undertaken a hostile attack on this Colony from the other side, as also no less on account of the most weighty services and benefits that the oft-mentioned distinguished General in the course of time has rendered in the Indies for the Honorable Company's interests in general for the protection and preservation of its further establishments. The members of the Council, being completely convinced of the weighty services rendered by the said General de Peynier, and being no less sensible thereof, have gladly conformed to this proposition of the Governor: And it is agreed, since one cannot devise anything else at this remote corner that could be more agreeable to His Honor, than in the first place to give through this to the said Chef d'Escadre de Peynier an open token of grateful acknowledgment: And furthermore along with this, on behalf of the Honorable East India Company of the United Netherlands, to kindly offer to his very person, as some of the best products of this country, twelve half-aams of red and white Constantia wines, with four aams of steen wine; In the hope that this small token of the Council's high esteem will not be unpleasing, and will be thus considered and graciously accepted by the General de Peynier. Furthermore, a submitted petition was read, signed by twenty-nine inhabitants of the Swellendam District, concerning the pontoon money, tending to request that, since they make no use of the pontoon, yet are obliged to pay for it annually, it might therefore please this Council to make arrangements whereby the same petitioners are exempted from the said payment. And thereupon it was approved, before deciding on that petition, to place a copy of the same into the hands of the Landdrost and Heemraden of Swellendam, in order to serve this Council with their report and considerations regarding it. On this occasion, taking into consideration how Burgher Councillors, for as long as they hold a session in the Court of Justice, have always enjoyed the rank alongside the members of that council, yet until now, when their term of service has expired, they have been placed in a lower rank that is by no means compatible with that function, it is, on the proposal of the Governor, understood to grant former Burgher Councillors henceforth the rank immediately following the former members of the said Court of Justice. Furthermore, it having been approved to appoint the Confidential Secretary to the Governor, Jan Fredrik Kirsten, to the post of Pay-Ledger Clerk, which remained vacant at the last previous meeting, and that with the rank of Junior Merchant, at his current salary, the Assistant Carel Mappa, stationed at the Political Secretariat, is in his stead appointed once again as Confidential Secretary to the said Governor, with a salary as Bookkeeper of 30 florins per month, and the equivalent rank of Junior Merchant. Likewise, in replacement of the recently deceased Captain of the Fourth Company of Burgher Infantry, Jan de Waal Arendsz., the First Lieutenant of the Second Company of the same Infantry, Johannes van Littert, has been promoted, and in place of the latter, the Lieutenant and Adjutant Hendrik Andreas Feuter is appointed as effective First Lieutenant in the said Second Company of Infantry. even executed by a will dated 2: June 1749, having been appointed executrix of the same aforesaid testamentary disposition and heir to all of his left estate, she, the petitioner, because of the notoriously widespread business affairs of her said deceased husband, and particularly with respect to the office of Vendue Master held by him, had not been in a position to judge with certainty the state of his estate, nor to declare whether she would accept the estate; the petitioner therefore immediately after the death of her said husband executed a notarial deed and thereby declared that by arranging for and seeing to the burial of her husband, as well as what further might necessarily be required, she had not intended to perform the least hereditary act, and at the same time had expressly chosen and reserved for herself the jus deliberandi. That the petitioner subsequently addressed herself to the honorable Council of Justice of this government, and requested and obtained from the said council the approval and extension of the aforesaid deed for the period of one year, in order during that interim to be able to inquire everywhere and have investigation made into her late husband's outstanding affairs, and thus inform herself thereof as much as possible; as well as, after the entire estate shall have been inventoried by an official clerk and witnesses, to be permitted to sell as soon as possible at public auction all such goods as she, the petitioner, might in any way deem to be a burden and encumbrance to the estate, or to be subject to damage and decay. That, however, the said Council of Justice, having on that occasion seen fit to order the petitioner to pay the vendue monies that have already fallen due, and will yet fall due, successively within the forthcoming six months, the petitioner finds herself unable to comply with this judicial order: on the one hand, due to the considerable amount of the vendue promissory notes still remaining unpaid in the hands of the auction messengers, to collect which, seeing that a substantial sum thereof must be paid by the residents living far and wide in the outer districts, apparently more than the prescribed time will elapse; and on the other hand, because the petitioner, intending to turn the largest part of the estate effects into money shortly at public auction, must also await the proper time to receive the proceeds thereof; whereas on the contrary, for a large part of the vendue monies, the time of payment has already expired. That the petitioner, however, considering that the said order of the said Council of Justice is surely aimed at the common interest of those who claim the payment of their vendue monies, rests assured in the trust that it will favorably please your Right Noble, Honorable, and Respected Sirs, being likewise fully persuaded hereof, to support her to that end in a suitable manner from the Company's treasury. Then, partly because the circumstances of some of the petitioners, due to the remote distance, do not well permit them to attend the aforementioned ordinary monthly meetings, while on the other hand it had also frequently happened that the aforementioned Council of War, because no parties had appeared, had met in vain; the petitioners, having deliberated at length on the said subject today, deemed it best and most suitable to devise a provisional arrangement regarding this, namely that the same be held four times a year, and that on the first Tuesdays of the months of March, June, September, and December. That the petitioners at the same time cannot fail to bring to the attention of Your Right Honorable and Honorable Sirs how many of the persons liable for duty, by virtue of the small fine of 18 Rds., absent themselves from exercise, service, and muster, as well as several who, having already been registered for five to six years, had not yet taken their Burgher or marksman's oath, which, with respectful reverence, ought to be remedied in good time. The request regarding the time for holding military meetings and the increased total fine for those who neglect their burgher exercises or fail to register themselves having been granted; The contents thereof having been considered and the first part granted for the reasons adduced, yet so far that the military officers shall always hold themselves obligated, whenever by extraordinary occurrences the convocation of the said military council might be deemed necessary, to proceed promptly to the assembly; Further with relation to the second part, it was testified by the Governor how at the last exercise at Stellenbosch the number of those who had not yet taken the burgher oath and had been obliged to appear there without fail for that purpose had far exceeded those by whom the oath had at that time been taken, and that the former consisted chiefly of people who inhabit the far-distant fields and who for a large part had already been registered among the burghery for several years; and since it is consequently deemed necessary, with relation to such persons, in the hope that it will not be necessary to resort to more severe measures, to increase the otherwise stipulated monetary fine, that part of the request is also granted, yet in the confidence that the mitigation of the same monetary fine shall be observed by the said military council in case persons or circumstances should come to require it. Furthermore, it was communicated to the assembly by the Governor that His Honour had been informed by the Intendant of Mauritius, Mr. Chevreau, who passed by here a few days ago, that on the said island on behalf of the Dutch East India Company there still happened to be a quantity of 3 to 400000 lb of coffee beans, which, when the ship De Morgenster was dispatched from here with French troops to that island in the year 1782 and the administration there had found it necessary to unload that vessel to load necessities for the French squadron acting at that time in the Indies against the common enemy and to dispatch it further to the island of Ceylon, were at that time unloaded from that ship and stored in the Company's warehouses on the aforementioned island; and regarding which interest the aforementioned Governor submitted for consideration what measures ought to be taken to have the said coffee beans fetched from there at the least expense to the Company for dispatch to the Fatherland, whither they were destined with the said vessel. Yet since the said Mr. Intendant Chevreau had also testified being unable to give any assurance whether the same coffee beans remained well preserved in whole or in part; just as it also appears from the report kept at the Trade Office concerning the inspection of the same made on board the aforementioned ship De Morgenster at Mauritius, that the bales which had been taken and opened there at random, both from the middle and at the sides of the hold, having drawn much of the accompanying moisture, the entire cargo thereby appeared on the whole to be of a bad quality, caused by the long stay thereof in that ship. And since by expressly dispatching a vessel thither to fetch the repeatedly mentioned coffee beans, for the same reasons it would be greatly risked that, if the spoilage had increased, a vain voyage would be made by such a vessel; It was therefore judged best to leave the final decision on that subject suspended, until an opportunity might arise in one way or another to have the same coffee beans fetched by one of the Company's ships in passing that island. It being likewise laid open to the assembly by the Governor that, since the resolution was taken by this Council to establish a Drostdy in the Camdeboo, no person had presented himself who was inclined thereto and upon whom the choice for that office could have fallen; His Honour, on the occasion that he recently found himself at Stellenbosch to attend the burgher exercise, having met there the burgher Maurits Herman Otto Woeke, concerning whom a request had already been made in the year 1783 by the inhabitants of the far-distant lands to the then Governor that he might be appointed Landdrost there; and regarding which same Woeke the aforementioned Governor had obtained favorable testimonies in every respect, as well as having become very satisfied with the appearance of this person himself, His Honour had then made a proposal to him whether he would be inclined to occupy the said Landdrost office.

That it having thereupon been brought forward on behalf of the said Woeke that, since he was settled in the village of Stellenbosch and found himself burdened with a large family, this matter demanded serious consideration for him and his family before breaking up his prosperity and choosing such a remote place for his residence, His Honour had then recommended him to reflect upon this. That a few days ago, the aforesaid Woeke had presented himself to His Honour and declared that he found himself prepared to accept the aforesaid office of Landdrost, if he might be favoured therewith, in a calm confidence that there would be added thereto a suitable means of subsistence for him. That His Honour, since daily complaints were coming in regarding the irregularities that were rapidly increasing in the said Veld districts, as well as regarding the no longer tolerable violence and nuisance of the Bushmen Hottentots, and that therefore, considering that the establishment of the Drostdy and Magistracy there could brook no further delay, came to nominate the aforesaid person of Maurits Herman Otto Woeke as Landdrost of that district. And whereas the Members of the Council, along with the Governor, fully persuaded of this necessity, recognized the said Woeke as a man possessing the qualities required for that office in such a remote place, the same is therefore, subject to the approval of the High and Mighty Lords and Masters, appointed thereto, with the rank of Junior Merchant and a salary of f 30:– per month. Regarding the further additions that are necessary for the aforesaid Magistracy and Drostdy, as well as the income of the said Landdrost, it was deemed best to suspend the resolution until such time as the said Woeke, who will be ordered to proceed thither as soon as possible, shall have returned from there and reported regarding his findings as well as what will be necessary for him; just as it is likewise understood that the provision for regulating his subsistence remains suspended for that duration. While further, in order to separate the said Colony from the Drakenstein and Swellendam districts, under which it has resorted, the boundaries will likewise be further determined, in the meantime conferring upon it the name of Graaff-Reinet. After which was read the request presented by the Junior Merchant and former Shopkeeper here, Barend Hendrik van Rheede van Oudshoorn, containing a request that, together with his wife and little son, he may be permitted to repatriate from here to the Netherlands on the chartered ship Dordrecht presently at hand, and that, since the opportunity of the Company's own ships is still lacking and it is still very uncertain when the same might appear here, the said return voyage may be granted on that vessel, retaining his rank and salary. A report and account of the entire matter and occurrence between the Captain of the regiment of Swiss of Meuron garrisoned here, Charles Louis Sergeant, and the undersigned. 2. A declaration given by R. J. Van der Riet, assistant in the service of the Honorable Company. 3. An unsigned letter, written by the said Captain Sergeant to the undersigned, and which is acknowledged by him to be his, pursuant to the attached deed of the sworn clerk at the Political Secretariat, G. G. Diemel, dated 8 December a. c. No. 4. A letter written to the undersigned by the said Sergeant, without date. 5. A copy of the reply to the last-mentioned letter by the undersigned. 6. A letter from Captain Sergeant to the Assistant R. I. V. d. Riet. 7. A copy of the reply on behalf of the aforementioned van Riet to the last-cited letter. 8. An insinuation made by the court messenger Anthon Jacob Jurgensen, in the name and on behalf of the undersigned, to Captain Sergeant, dated 9 December a. c. 9. The reply of Captain Sergeant to the insinuation made to him, dated as above. From which Your Right Honorable, if it please you, will be able to perceive how the Captain in the Swiss Regiment of Meuron serving here, C. L. Sergeant, has been able to bring himself to charge him with matters and deeds of which not the slightest semblance or hint, let alone the foul deed itself, ever occurred to him, and thereby in a very extreme manner greatly to slander and harm his good name and reputation. In order not to trouble Your Right Honorable's attention unnecessarily, the undersigned will not enter into detail regarding the motives that surely spurred the said Captain Sergeant to such a reckless act, but would much rather make bold, as he is about to depart for Europe with his family and to that end has early obtained his discharge from his post from Your Right Honorable and the Honorable Council here, to implore Your Right Honorable with the greatest humility that it may most favorably please Your Right Honorable to place the cited papers in the hands and care of such a person as Your Right Honorable, according to your highest enlightened judgment, shall see fit and deem proper, in order to examine the accusations contained therein strictly and in full legal satisfaction, in the speediest and briefest manner, as well as to procure for him such striking satisfaction and render him such proper justice as the gravity of the matters and his innocence require, to the end that he may not be hindered nor frustrated in his intention to depart from here. And whereas, after review of the said documents, it has become evident that the said Captain Sergeant has indeed not shrunk from burdening the said Junior Merchant van Reede with an accusation from which, if the same were well-founded or according to truth, a criminal action could arise against him, as well as from insulting a young daughter of the same family in the most disgraceful manner; in order to protect the latter against the adverse assumptions that might arise among incautious or slanderous people, and to preserve her honor and good name, as well as that of the family, in the best possible manner, it has been judged that all delay ought to be avoided; and on the other hand, so that, if the accusation should be groundless, the frequently mentioned van Reede should not thereby be frustrated of the opportunity that now presents itself to him to undertake the intended voyage with his household, it was resolved, after deliberation held, that prior to deciding upon the first-mentioned request of the said Junior Merchant van Reede, copies of the aforesaid petition and its annexes shall be placed in the hands of the Pro Interim Fiscal, in order that, in view of the impending departure of the aforesaid ship Dordrecht, he may investigate in the speediest practicable manner whether any ground appears in the said documents from which any action could be instituted by the Fiscal Office against the said Junior Merchant van Reede, so that, in such case, the presence of his person here would
