As well as resolved, to effect the said augmentation of one hundred men, together with the non-commissioned officers to be promoted thereto, in the Artillery Corps successively from the convalescents in the hospital. On which occasion also, on the proposal of the Governor, the Extra-Ordinary Lieutenant Engineer Pieter Cloete, in view of the imminent expiration of his contracted term, and having performed the service satisfactorily, likewise subject to the approval of the Lords Majors, is promoted to Lieutenant Engineer at f 50 per month, after whom the aforesaid Lieutenant Thiebault shall follow. Subsequently being read the Representation submitted by the Pro Interim Fiscal Gabriel Peter, regarding the investigation requested of the late Independent Fiscal Mr. Jan Jacob Serrurier, and set to work by him, the Pro Interim Fiscal, into whether and to what extent the wrecking of the Honorable Company's vessel Bredenrode was caused by any misconduct or neglect of duty by the ship's officers; in which Representation was only inserted an oral statement of the remarks and opinions that the Nautical Experts commissioned thereto, being the Equipage Master Justinus van Gennep, together with Sea Captain Jan Siereveld, and, due to the intervening departure of Sea Captain Christoffel Beem, the co-opted Sea Captain Hendrik Swart, as well as the Skipper Christiaan van Veerden, had provided on that subject, and upon whose rendered opinion, regarding the conducted behavior stated by the ship's officers under sworn deposition, the same Pro Interim Fiscal bases that which he declares in fine of that Representation in favor of the same ship's officers; it is found by the same insertion of the oral statement of the Nautical Commissioners not to satisfy the intention of the commissioning resolution, but understood that they, or due to the departure of Sea Captains Beem and Swart, the three above-mentioned present Commissioners, Van Gennep, Siereveld, and van Veerden, shall properly submit their remarks and opinions in writing to the Pro Interim Fiscal, after the execution of which he, the Pro Interim Fiscal, shall also further proceed ex officio in that matter to whatever he shall think and deem proper. And whereas from time to time, in a clandestine manner from foreign nations' ships, some persons have remained behind here who, without having obtained the necessary permission for that purpose, reside either within the Cape or further inland, or roam about here and there; in order to properly provide against this, it has also had to be resolved to enact that all those with whom any person who has remained behind here in the aforesaid manner might happen to stay, shall henceforth be obliged to report this to the Political Secretariat, so that it may be made known there; for which those who fall under the Cape district shall be allowed a period of three weeks, calculated from the day that the same shall have been notified to the public, on penalty that whoever shall be found to have been negligent in this shall incur a fine of One hundred Rixdollars for the officer. Likewise, on the same penalty, all inhabitants shall henceforth be obliged, whenever any person, after the departure of a ship or ships, whether of our own Nation or of foreigners, remains behind here and comes to stay with them, to bring this immediately to the knowledge of the Noble Governor; and whenever such remaining persons should proceed inland, to apprehend them as deserters and deliver them to the nearest Drostdy, or here. While also, in order to prevent the license which the foreign nations have for some time taken upon themselves, according to their own discretion, even without the least notification, to ride outside the Cape, it has further been understood to give orders to the Patrol Guard that all foreigners, without distinction of state or condition, who would wish to proceed outside the Cape without having obtained permission thereto from the Noble Governor, shall there be further, the farmers, by notices, to the payment of arrears on their loan places statement of all foreigners remaining behind here shall henceforth be made at the Political Secretariat the said Fiscal shall ex officio proceed to investigate further in that matter Further, it has been taken into consideration how, notwithstanding the flourishing state of the majority of the inhabitants engaged in cattle breeding, one comes to find that many of them still fail to properly pay the Honorable Company the recognition fee for their loan places, and that many of them are even several years in arrears with it: and it has therefore been approved, by renewal of the Publication issued on the date of 10 June 1782, to further urge the same defaulting inhabitants to the payment thereof, and to have them spurred on by the respective Officers of Justice. how further shall be acted regarding such persons no foreigners being allowed to proceed outside the Cape without consent of the Governor.

and the Order concerning those who stay the night on land to detain them or have them returned to the Cape, those with whom any strangers come to lodge shall therefore be instructed to warn the same that they shall not leave the Cape, except by previously obtained permission from the Noble Lord Governor, which permission must be in writing in case that stranger would wish to proceed further than an hour's walk outside the Cape; and if those at whose house such a stranger departing from the Cape comes to lodge are found not to have informed them of this Order, or in case the stranger, contrary to the instruction, goes out into the country and those with whom he lodged, or from where he shall depart, do not in good time notify the Patrol Guard of the same, with an indication of the person or persons who are to pass by there, they shall for each person each time incur a fine of fifty Rixdollars. Furthermore, as it is also being neglected, or falling more and more out of observance, the established order that all Residents with whom any Persons from Foreign Nations' ships come ashore to stay the night are obliged before Sunset to give notice thereof to the Officer of the main guard, with a note on which the name and quality, as well as the number of Persons lodging with them, are stated; it has therefore also been resolved, by renewal of the same established Order, to warn everyone henceforth to strictly comply therewith, on pain of a fine of Ten Rixdollars each time for every person who shall not have been reported in the manner aforesaid. And whereas, notwithstanding the Reward of One thousand Rixdollars established on 3 September 1782 by this government for those who shall discover the counterfeiters and forgers of the circulating Parchment and Paper money in such a manner that they can be convicted of the villainy, it is to our particular annoyance experienced that daily again some of the same and other counterfeit coins appear in circulation, from which one must conclude that there are still scoundrels who continue in this foul practice, which is altogether destructive to the Colony; therefore, by amplification of the aforementioned previously issued Publication, over and above the aforementioned granted Reward of One thousand Rixdollars, with concealment of the informer's name if so desired, there shall also be promised exemption from punishment, if the person who makes the discovery or report should be a repentant Accomplice or accessory to the making of those counterfeit coins. Furthermore, considering the upcoming Leasing of the public Revenues, and the changes that ought to be introduced into the lease Conditions to remove the disputes that arose in the past Year between the Lessee of the Cape malt beer and that of the Cape wines; it is, upon the considerations taken in this regard by the Honorable Merchants van Schoor and le Sueur, members who worked towards settling those disputes, agreed only to add to the lease conditions of the Cape beer that those who, upon paying the excise for the lessee, make their living by retailing the beers for the brewer, shall have no liberty to hold any drinking gatherings, much less to keep music or so-called entertainment houses; but that it shall only be permitted to the Lessee to retail and tap the beers from the Cape brewery by the glass, displaying a sign or trade board, in three to four houses to be specified by him, with the keeping of billiards or shuffleboards in the same manner as is granted to any other Lessees or Tapsters, without however being allowed to sell any other drinks in those houses than Cape malt beer, except with the consent of the General Lessee of the Cape wines. Since the measures taken up to now have not been found to suffice for the prevention of the Desertion of the common folk, both from the garrison and from the arriving Ships, it has also been resolved, upon the arrival of ships in the roadstead here, to place a guard in the Rogge Bay in order to prevent any Shallops from arriving there and also to keep close supervision over the Persons who depart from there with the Fishermen's dinghies, for which purpose a small guardhouse will be built of masonry at that bay; just as it has also been deemed fit for the same purpose to have a barrier constructed on the Pier, to be closed at sunset until sunrise the next day, so that during that intervening time, all access to the vessels that are obliged to arrive only there being cut off, the Barrier shall for that duration not be opened except in case of necessity, with prior knowledge and by order of the Lord Governor; so that also by this means

It having also, upon the proposal of the Secunde Pieter Hacker, been approved, shortly to dispose further by public auction of so much of the extraordinary merchandise brought from the Netherlands as can be done to the greatest profit for the Honorable Company, and also, on account of the spoilage to which many items are subject, with the least damage in respect thereof. And the Cornet of the Swellendam country militia, Christiaan Andreas Storm, upon his request made by petition, on the grounds that he intends to settle his residence at the Cape, is discharged from that function. Lastly, it having been resolved that the one hundred soldiers and twelve dragoons, with their non-commissioned officers, serving to garrison the bays on the South coast, on account of the fact that no necessary and proper shelter can be prepared for their service so quickly, upon the proposal of the Colonel and Commander Gordon, provisionally against the inconveniences of rain and cold, each shall be provided with a good cavalry cloak, the cost thereof shall accordingly be paid out of the Company's treasury. Whereupon the same Fiscal pro interim also submitted his further report and declaration of contents, as follows: The undersigned, Captain at Sea and Equipment Master Justinus van Gennep, together with fellow Captains Ian Siereveld and Christ.n van veerden, having been requested by the esteemed resolution dated the 5th of this month of August taken in the Honorable and Worshipful Political Council, to submit further in writing to the Fiscal pro interim Gabriel Exter their remarks and opinions, whether and to what extent it might have appeared to them from the sworn account given and executed by the saved skipper Hendrik Mulder and the mates of the wrecked China return ship Brederode, that the wrecking of that vessel might have been caused by any misconduct or dereliction of duty by those ship's officers; so the undersigned, in dutiful compliance with that order, have carefully examined the said account of the ship's officers, from which it appears that on 3 May past, being the day before the wrecking of that vessel, at sunset, the course was such that, according to the bearing taken at that time, they found themselves N.W. by W. half W., five and a half, but by estimation fully 6½ miles off the shore from the southernmost point of Caab Anguilhas, at a depth of 50 fathoms, foul ground; that the wind at that time being E. and southerly, after that bearing they had steered W. by S. along the coast; that, however, in the night at half past nine o'clock they suddenly sighted the land again, which was presumed to have been the south point of Caab Anguilhas, to the N.W. by W., and having approached the same by estimation to within 2 to 2½ miles, they had remarked from this that the ship in that time, since sunset, had altered 3½ miles in the course W. by S., and thus had been set very strongly to the north; that upon this, having attempted with all sail to make headway to the south again, and thus being unable to see any more land at around the 4th glass, the ship nevertheless struck at around the 5th glass, without however, notwithstanding all precautions by posting lookouts, any surf or breaking of the sea having been observed beforehand; that Although it now indeed appears from what has just been cited that the course after the bearing at sunset was kept somewhat too close to the shore, it is nevertheless certain that if they were not mistaken in that bearing, the same still ran well over 1½ miles clear outside the southernmost reef lying there, and thus in such case beyond all danger or unforeseen accidents for the ship. Therefore the undersigned, taking all the circumstances together, unanimously maintain that either the ship must have been set closer to the shore during the night than could be estimated due to the strong leeway caused by the currents, or that if one wishes to follow the stated bearing, then the southernmost reef of Caab Anquilhas, or the rock there upon which the ship Brederode struck and was wrecked, must lie more easterly and southerly than is indicated on the chart, to which concurring matters the undersigned also believe that the wrecking of the aforementioned ship Brederode can be attributed. Permission granted to Lieut. Andringa to repatriate together with his wife. Proposed by the Colonel Gordon regarding the soldiers from this garrison when they had to be placed in the hospital as impotent. and Hendrik van Roijen, to send to the Netherlands without earning wages, at the disposal of the Lords Masters: the three first-named having been granted, upon their request made to that end, permission to travel thither on the Prussian private ship les quatre Freres, currently present and chartered on the Company's behalf; and upon the notification of their indigent condition, a sum of Forty Rix-dollars was granted to each from the Company's Treasury for travel subsistence. Also granted to the Lieut. of the hooker ship Catwyk aan Rhyn, Watse Fibius van Andringa, upon his request made by petition to that end, to repatriate without pay together with his wife married here, Geertruyda Margaretha Westpalm, on the aforementioned ship les quatre Freres: likewise to the burgher Engelbert Felix, upon a similar request, to allow his little son Abraham Jacobus Felix to depart with the same ship to the Fatherland, provided they shall regulate themselves according to the conditions of charter entered into by the Hon. Company with the owners of that ship. The Heer Colonel Gordon thereupon indicated that he had long experienced how the soldiers of this Garrison, when afflicted by disease and thus transferred to the hospital for cure, were also for the most part, through similar accommodation, nursing, and treatment among and with those arriving from the ships, infected with the epidemic diseases that such shipboard personnel brought to the hospital, whereby many of them, for whom otherwise no or little danger was to be feared from their original illnesses, were fatally afflicted and dragged to the grave; Wherefore a Surgeon Major and Two Surgeons have been appointed to the same garrison. Commander Haas placed as such on the hooker Catwyk aan rhyn. that he, the Colonel, considering it therefore most necessary that appropriate arrangements be made to prevent such detrimental contagion, requested the attention of this assembly hereto: which having been considered, it was resolved to cause all the sick from this garrison to be separated henceforth from those brought in with the ships; and since this separation cannot take place without causing great hindrance to the treatment of the sick from the ships, if the same Surgeons should also be required to attend the separated patients of the garrison, besides the fact that at least Two surgeons are most urgently required for the respective military garrisons in the widely distant eastern bays, there has also been appointed to that end as Surgeon Major of the garrison, and taken into service, the Doctor of Medicine Hendrik le Sueur, at a wage of 60 guilders per month, as well as under-surgeons to the same garrison and thus to the department of the said Surgeon Major, to assist at the mentioned military garrisons, Carel Lodewyk Spindelin and Christiaan Zweintholt. several families have left their places, and have retreated beyond the Great Fish River into the land of the Caffres: that to these robberies must principally be attributed that, however much it had been hoped that with the end of the war the high cost of slaughter cattle would also be seen to decrease, the price thereof, on the contrary, remains just as high. — That although it may well be true that many households in those fields are within a short time thereby to be brought into pitiful circumstances, the only means of salvation and to prevent such in the meantime is this: that by the inhabitants in those fields the established regular commandos be continually maintained, to turn out continuously against the said marauding Hottentots and pursue them; yet that, such having been found to be more and more neglected, partly through the partiality which the Field Wardens themselves display in commanding the inhabitants, and partly through lack of authority properly to discipline the negligent, attempts have indeed been made provisionally to remedy this with the appointment of Field Commandants over those regions, and the addition of the rank of burgher lieutenants and ensigns to the same; but that it has been experienced that these likewise neither refrain from partiality, nor possess or can exercise the power to judge the unwilling according to their deserts, as they are situated too far from the Stellenbosch or Swellendam drosdies, under which those fields fall; that thus, in order to be able to expect an end to these complaints at last, and to prevent the remaining inhabitants from the aforesaid fields from betaking themselves more and more to the land of the Caffres, and thus depriving the Honorable Company of the considerable income from the recognition moneys which their loan places yield, as well as to avoid coming with certainty into the situation where the Caffres, driving those inhabitants from there, anew begin hostilities with this populous yet peaceful nation, which were conducted against them in a cruel manner and have only recently come to an end — and above all to prevent that, sooner or later, one or another naval power with which our republic might enter into war, casting its eye upon Delagoa Bay, might readily entice the inhabitants, destitute of regular government, into its interests, thereby suddenly finding a flourishing colony established for itself, and thus both rob the Honorable Company of its revenues and cut off from there the now indispensable supply of slaughter cattle to this place; all these reasons taken together make it utterly necessary that in the Camdeboo, as being the best situation for it, a magistracy be established in exactly the same manner as at Stellenbosch and Swellendam, which also, upon the reiterated petitions made by those inhabitants themselves, with ample reasons and request for authorization added on behalf of this government, was proposed to the High Governing Lords Masters; yet since Their High Honors, pursuant to the highly esteemed dispatch of 10 November 1780, did not so much reject that proposal, as rather suspend for the time being the decision upon the same on account of the then existing perspectives on the affairs of this government, so that one must firmly trust that the consideration of the further emerging circumstances would now bring the decision of Her Right Honorable High Mightinesses to a favorable maturity, to allow the establishment of so important a drosdy to proceed and to grant authorization thereto. In which case it would nevertheless prove difficult, upon receiving of the same, directly to find a person possessing the requisite qualities to fill the office of drost and to stabilize the magistracy in so widely distant a region; so that the one and the other would meanwhile require much time, for which the circumstances of affairs are no longer suited; it has therefore, after ripe deliberation on all this, been resolved: at the first suitable opportunity, and when an appropriate candidate for the service of landdrost shall present himself, to effect the establishment of the said drosdy and magistracy in the Camdeboo, in such manner as was proposed by humble letters of 1 March 1779 to the Lords Majors, subject to Their High Honors' approval, and to give dutiful notification hereof to Their High Honors at the earliest opportunity; meanwhile the landdrost of Stellenbosch and Drakenstein shall be written to and ordered provisionally to take such measures as may possibly be done for the help and assistance of the inhabitants being pursued by the Bushmen Hottentots. — To the Secretary of this Council, De Wet, transmission of a petition to obtain the rank and salary of Merchant granted. — Permission having been requested for the fellow member of this meeting, and serving as Secretary of the same, Junior Merchant and Warehouse Master Oloff Godlieb de Wet, to present his petition from here to the Lords Majors under favorable recommendation, for the most humble request to be appointed and favored with the rank and salary of Merchant, such has been granted to the same.

Grant of a loan place in freehold to the son of the postholder Brand. to be allowed an increase in wages to ƒ60. per month, and also that, whereas the dwelling adjacent to the Company's equipment yard, which had been assigned to the Master of the Shipwrights in the year 1779 to convert the land to another use, having been vacated, since that time the said master has received monthly 6 Rixdollars for house rent from the Company, for which amount, however, considering the high price to which the rent of houses has climbed higher and higher since then, one cannot obtain a suitable dwelling for accommodation, the monthly house rent money might also be increased; the requested improvement in wages was granted to the same, and in addition a monthly house rent of 12 Rixdollars was allocated, to be enjoyed for as long as the dwelling for the Master of the Shipwrights shall not have been restored. Furthermore, the Watchmaster with the Dragoon Bodyguard of the Governor, Johan Coenraad Steijn, in consideration of the continuous readiness that is required in his service on horseback, and that he consequently comes to need more in clothing and otherwise than a Sergeant among the Infantry, and also on account of his giving good satisfaction, was, upon his made request, in view of the approaching expiration of his bound term, increased in wages to ƒ30. per month. After which, in consideration of the fact that the Junior Merchant and Postholder in False Bay, Christoffel Brand, during the recently concluded war, not only, whenever French Royal ships were present there, lodged and defrayed the expenses of the respective squadron commanders, captains, and other officers at his private expense, but also frequently, for the convenience of the same ships, with much zeal rendered all necessary services and assistance, and still continually, whenever upon the arrival of the Company's ships in the said Bay some necessities are promptly required for the same, and the Company's wagons and draft animals are not at hand, causes such to be transported thither from here by his own, with the undergoing of much detriment, without having received the least compensation for either up to now; on the occasion that today, by his son Johannes Henricus Brand, a petition was presented to be allowed to hold in freehold a certain cattle farm named De Klijne Riviervalley, situated under the district of Stellenbosch; on the proposal of the Noble Governor, the requested place was given in freehold to the same Johannes Henricus Brand for nothing, as a gratuity for the said services performed by his father. Resolution of the ship's council of the ship 't Huijs te Spijk, containing the reasons why they were forced to turn back. G. de Wet, as member and secretary. Friday the 9th of September 1785, in the forenoon, all present except the Merchant and Secretary, the Honorable Oloff Marthini Bergh. The ship 't Huys te Spyk, which had departed from False Bay on the 12th of the recently past month of August in order to head for Batavia with a cargo of wines and other goods pursuant to the resolution of the 12th of January of this year, having returned back here on the 6th of this month, the Lord Governor brought to the meeting for consideration the resolution taken in this regard on the 20th of the same month of August by all the officers of that vessel, and handed over to His Honour by the commander Sijbrand Waarland, reading as follows: Resolution taken in the ship's council on the Honorable Company's ship 't Huys te Spyk: Whereas on the 18th of August 1785, sailing at the south latitude of 37 degrees and longitude of 40 degrees, the mate Kamp came to report to me that the ship was making such a terrible movement in the hold, I immediately went with the chief carpenter to inspect the same, and found that the beams in the middle, both before and abaft the main hatchway, were moving back and forth more than a foot, which was a most frightful sight, as well as the ceiling, which was opening and closing continuously with the rolling, which was very little, because we had fair weather; we were running before the foresail at the time for the reason that we could not strain the ship, as there was a heavy leak on both sides of the stem, and we had to pump continuously with the forward pump and one aft; on the 19th ditto in the morning, went into the hold again and saw the movement was even stronger; at the time we were sailing under the foresail and the topsails with three reefs; in the afternoon at five o'clock the wind shifted to the southwest to south-southwest and south, a light breeze; we then set the sails athwart, which caused the ship to roll heavily; on the morning of the 20th ditto, while engaged in setting up the main shrouds, the chief carpenter came to ask me to go into the hold with him, which we immediately did; being there, the aforesaid said to me: it is calm and good weather now, now you see how it works loose, what would come of it if we were to sail before a stiff breeze, or had to heave to altogether, I swear to you that it cannot hold out; going on deck, I immediately sent down all the officers, both the quarterdeck and the deck officers; the aforesaid confirmed the same and made reports to me thereof, as follows: that the ship would inevitably break in the middle at the first heavy weather, while the bolts passing through the knees in the hold were all loose, and that the bolts between decks passing through the new riders or crossbeams were also working loose; thus I have summoned the undersigned to me and convened a ship's council, and presented these reports to them, all of whom unanimously maintained that if we should encounter heavy weather, which was inevitably to be expected, the ship was not capable of holding out. Respectfully gives to know the undersigned, to whom the command as Captain on the Company's ship 't Huys te Spyk is entrusted: That I departed on the 17th of May from the Cape roadstead, bound for Baay Falso, where on Tuesday the 24th of the same month at 11 o'clock in the evening, I was forced by contrary winds to come to anchor near the Company's garden there; the following day, the wind being north-west, I attempted by tacking to sail into Simons Bay, which however failed, as I was obliged to anchor again at the aforementioned place, while the main topsail tore and partly blew away, and the mainsail, mizzen topsail, mizzen, jib, and storm sails all tore out of the seams due to the badness and rottenness of the seams and the distress or age of the sails. With the evening, the wind increasing strongly from the north-west, being forced to drop the stream anchor, and thus remaining lying there, I weighed the aforementioned anchors this morning at 3 o'clock, and found the palm close to the shank of the bower anchor to be broken off, and the fore runner of the bower cable completely pulled apart. Otherwise the ship was tight and sound, and behaved well in all respects. Wherewith I have the honor, after having commended myself to your Most Honorable's favor and protection, with the utmost submission to sign in the capacity of, as below: Most Honorable Sir, your Most Honorable's very humble servant, was signed, Andries Christiaan Stuur. The ship 't Huijs te Spijk lying in Simons Bay, the 27th of May 1785. The report at the first resolution being not only in conflict with that, but also with the other reports regarding that vessel, of the commissioners appointed for the further examination of that ship, and in no way agreeing either with the report made by Captain Christiaan van Veerden, who also commanded the same ship, upon his return from the island of Mauritius, nor with the report submitted by the Honorable Equipage Master Justinus van Gennep and other nautical experts, dated the 8th of January of this year, upon the demanded examination of the aforementioned report and other attached requirements; as this latter report explicitly conveys that when the repairs specified in that report were carried out on the said ship, according to the opinion of their commissioners, the same could, with complete confidence, take in a cargo of wine and transport it to the Indies, where that vessel could still be employed for several years in the inland shipping and trade for the Honorable Company. Whereupon it was unanimously resolved to explicitly commission the Equipage Master Justinus van Gennep, together with Captains Jan Siereveld and Christiaan van Veerden, as well as the Commander of the hooker Catwyk aan Rhyn, Daniel Haas, as they are hereby commissioned, to examine and investigate most accurately the aforementioned ship het Huys te Spyk, assisted by the Master Shipwright of the Company's shipyard here, Meindert van Eijk, and the Chief Carpenter of the said hooker Catwijk aan Rhijn: Whether there are truly found on that vessel the defects that were stated in the aforementioned Resolution of the ship's officers; Whether the said defects are so vehement, and thus of such a nature, that the stated disaster was reasonably feared because of them, and the collective officers were thus forced into the necessity of taking a decision to return with that vessel hither; The causes whereby the said defects could have arisen so suddenly; Whether, these defects being present, any means of repair were employed in order to make that ship resume its voyage safely with its cargo, or how otherwise, to the greatest benefit of the Honorable Company, it should be dealt with. Whereof an accurate statement and report in writing shall subsequently be made by the Commissioners; while, in order to be better able to examine and investigate all of this, copies of the above-mentioned report made on the 8th of January of this year and of the report of the said Captain van Veerden shall be handed over to them. Appearance in the Hout Bay of a French brigantine. It was subsequently communicated to the Meeting on behalf of the Governor that, information having arrived on the 2nd of this month from the citizen Bierman living in Hout Bay regarding the arrival on the same day of the private French brigantine vessel the Mosambug, which due to a lack of water and illness among the crew had found itself forced to come to anchor in the said bay, His Honor had, upon that news, permitted that the necessary water for that vessel might be taken there, in order that, if it needed anything further, it might come with it to this roadstead or choose Baay Fals; but that His Honor had obtained further information that arrangements had been made to provision the vessel in that bay in such a manner that the voyage could be continued further from there. of slaves was required, so that since many farmers are still lacking the same for the continuation of grain farming, the distribution of that imported number here, because various sorts of farmers will come to provide themselves therewith, and the same thus partly being transported far away, the remainder on the places yielding grain or other produce, through the strict rationing of food for the slaves against the benefit that agriculture would thereby receive, will constitute no object of any importance in consumption in general: but that the importation of the same could be ruinous for the Colony, in case the sale to private individuals were permitted, and thereby, in the still all too prevalent scarcity of cash money, a considerable sum were again exported out of the country, as, notwithstanding all possible precautions, is experienced to happen on such occasions in a clandestine manner; and that thus, both to prevent such harmful export of cash money and to gain some advantage for the Honorable Company, as has with good success been undertaken repeatedly, in this case no better and more favorable expedient remains than to purchase the aforesaid slaves on the Company's behalf; on which account, upon the proposition of the Lord Governor, this having been unanimously resolved upon, the aforesaid cargo of slaves, except 65 of the same, who upon inspection were found to be sick, emaciated, or wasted away, was purchased on the Company's behalf from the aforementioned Captain Iustimano at 110 Spanish dollars each, the Spanish dollar calculated at 54 stuivers, making therefore for the remaining 194 slaves a sum of ƒ 57618. Dutch currency, to be liquidated with drafts on the Honorable Company payable after six months' sight; it being at the same time approved to realize the same purchased slaves again to the highest bidder by public auction on Tuesday the 8th of the coming month of November; and to that end to have the necessary notices posted everywhere, both here at the Cape and in the outer districts, whereby the buyers, for settlement, will be allowed a term of three to five months. After which was resumed the report submitted by the Landdrost and Heemraden of Stellenbosch and Drakenstein in compliance with the resolution of this Council dated 17 June last, concerning the grievances that the farmer Andries Bernardus du Toit set forth in his petition presented on that day, reading: To the Right Honorable Sir Cornelis Jacob van de Graaff, Governor of the Cape of Good Hope and the dependencies thereof, etc. etc. etc., together with the Honorable Council of Policy. In dutiful compliance with the most esteemed order of Your Right Honorable and Honorable Sirs contained in a certain Extract Resolution dated 17 June 1785, placed in the hands of the Landdrost and Heemraden here, together with a copy of a petition submitted to Your Right Honorable and Honorable Sirs by the burgher Andries Bernardus du Toit, in order to serve as a report thereon as to what the true facts are concerning the grievances that are set down in the aforementioned petition, the undersigned have the honor, and take herewith the liberty to remark beforehand, to be exceedingly surprised at how the same du Toit has dared to bring to the table of Your Right Honorable and Honorable Sirs such a writing, not only contrary to the truth in the matter in dispute between him du Toit and van der Merwe, but the scribe must even have been misinformed about the matter when he mentions what further occurred between him du Toit in relation to this Board and the Secretary, since nothing that leans toward the truth is contained therein; however, the aforementioned burgher du Toit will undoubtedly have anticipated that such an extreme, insolent conduct, as he had already made himself guilty of with respect to this Board, could have no other consequences than that this Board would be forced to carry out the threats with which he was repeatedly and fruitlessly threatened, as can be seen from the Extract LL; but in order not to be too prolix, the undersigned will endeavor to lay open the matter in question as briefly as possible to Your Right Honorable and Honorable Sirs, and state: That by the burgher David van der Merwe Roelofsz., on 28 December 1775, the burgher Guilliam du Toit, father of the aforesaid Andries Bernardus du Toit, was summoned before the undersigned Board, against whom by the aforementioned van der Merwe, on the same day, it was concluded to leave uncultivated such a piece of land as is situated next to his, van der Merwe's, place, over which the water, for use there, had run for well over ten years.

On the other hand, it was principally maintained by the said du Toit that the land over which van der Merwe desired the water happened to belong to that farm which had been owned in property and plowed by his parents, so that he, as the owner thereof, also wished to make use of it in that manner, without being obliged to have to tolerate a watercourse through the same. Whereupon it was confirmed by van der Merwes that his farm was laid out relying upon that water, and had thus been bought by him, and that he could therefore not renounce that right, the more so since his, van der Merwes, vineyard was properly laid out relying upon that water, and if now being deprived of it, he would thereby come to suffer considerable damage. But while the efforts made toward a settlement were fruitless, the undersigned thereupon decreed a commission on the 24e Febr: 1776, in order to conduct an ocular inspection regarding the matter in question. That the Landdrosd and acting Heemraden carried out their commission and, having proceeded to the contentious place, it became evident to them that not only did the set corner beacon of that land stand opposite the house and the buildings of the aforesaid van der Merwe, and thus tended to cause no small inconvenience to his freedom there, but also that he could not do without the conveyance of that water (which, according to the situation of that land, cannot be brought in any other way than across the same, and the vineyard laid out upon it) without his considerable detriment. Meanwhile, the parties came to an amicable agreement, and on the basis of which agreement it was then also adjudicated by the undersigned Board under date 4 March 1776, as such appears detailed more broadly from the copy of the judgment and copy of the report annexed hereto. Since which time the parties always tolerated each other in peace and quiet (as far as the undersigned are aware) and also fully adhered to the aforementioned judgment, until his son, the burgher Andries Bernardus du Toit mentioned in the heading of this document, having become the possessor of his father's aforementioned farm, acted directly contrary to the aforesaid agreement made between his said father and van der Merwe not long after the purchase, by digging a ditch whereby he considerably prejudiced van der Merwe. Which caused van der Merwe to be compelled, in the meeting of the 17 June 1784, to lodge his grievances in this regard with this Board and to request maintenance. Whereupon the Landdrosd and Heemraden thought fit to order him, du Toit, by letter, that he should immediately fill in the ditch in question and refrain from acting or proceeding in the slightest against the aforementioned convention and the points determined thereby. Then subsequently, instead of complying therewith, a letter dated 21 June 1784, likewise annexed hereto under letter C, was sent by the aforementioned du Toit to the Secretary (who had been ordered ex officio to examine the agreement), wherein he had clearly demonstrated his disobedience in that respect in a completely improper manner. Whereupon this Board, upon the complaints made anew by the aforementioned van der Merwe, in the meeting of the 6e Septbr: following, after the said du Toit had been summoned again and more than once by the Messenger, but under frivolous pretexts sought to evade the proper obedience to his competent judges, finally thought fit and understood to qualify the Secretary to summon the aforementioned du Toit to maintain and strictly comply with the aforementioned treaty that was made and the decision pronounced hereon under date 4 March 1776. Then the said du Toit, who was then summoned for the 4 Octbr., not having appeared, this Board, at the request of the plaintiff, granted the first default and second citation, whereas he, du Toit, nevertheless thought fit, on the 8 Novbr. following, for which day he had been cited, to send a certain burgher Broodrijk, who appeared by virtue of a general power of attorney granted to him by him, du Toit. Which proxy was rejected, for the reason that the Instruction of the Landdrosd and Heemraaden explicitly dictates that here the plan, without the form of a trial, is not otherwise than to hear the people in person along with the witnesses and proofs of the parties, etc., and such has only sometimes been permitted to people who have reached an advanced age, or were prevented by illness from being able to appear. While he, du Toit, having been summoned again for the 6e: Decbr. in order to purge his first and second default, had also not appeared, the plaintiff was granted the third default and fourth citation, and to have him summoned ex super abundanti for the following meeting. R, against which, strongly protesting, he put forward that he had not known of such a sentence, which in this matter he was condemned to comply with, whereupon it was resolved to place a copy thereof into his hands, so that he might conduct himself strictly in accordance with it. Whereas the undersigned had then flattered themselves that the matter would have come to an end, the contrary nevertheless appeared in the following meeting of 7 March of this year, when a request was made anew by Van der Merwe to be maintained, since he had been told personally by du Toit that he was not inclined to comply with the said sentence, whereupon it was resolved on the part of the Board, for the sake of thoroughness, to write to him once again that if he failed to obey, they would be compelled to propose him as an unwilling citizen to the high government of this Country. When in the subsequent meeting of 4 April, upon the notification of the said Van der Merwe, who had personally handed the letter to the said du Toit, it appeared that he, du Toit, had not yet complied therewith, this Board furthermore thought fit, before proceeding to the extreme measure with which he had recently been threatened by letter, to commission two Heemraden in order to make an ocular inspection as to whether the grievances brought in here from time to time might indeed be found to conform to the matter in question. In the meantime, the said du Toit, having apparently become afraid that this would be carried into effect, and that he would thus likely come to undergo the consequences of the threat made to him, turned by petition to your Right Honorable, Rigorous and Worshipful Sirs, and therein stated a multitude of grievances, which have been extensively refuted above and corroborated by the appended copies, besides the fact that the same grievances cannot by the thousandth inference even be transferred to the charge of the conduct of the undersigned, but rather to the threat made to the said du Toit by the undersigned on account of his disobedient behavior, and to which they were compelled for the maintenance of their Board. The undersigned, under the wiser judgment of your Right Honorable, Rigorous and Worshipful Sirs, believe that even if one would wish to assume that any single grievance with foundation has been alleged in the said petition for the said Andries Bernardus du Toit, the same could be found nowhere else than in the bad faith with which his father Guilliam du Toit acted with him, which, however, entirely as yet has not been sufficiently proven by him, and in no way concerns the office of the undersigned. That the undersigned then finally, according to their oath and duty, to the best of their knowledge and understanding, maintain that they have acted in the questionable matters of the father of the said du Toit and the aforementioned Van der Merwe, as well as in the disputes between the said Van der Merwe and the last-mentioned du Toit, and have decided the same, they also expect from the equity of your Right Honorable, Rigorous and Worshipful Sirs that your Right Honorable, Rigorous and Worshipful Sirs will act regarding this matter in such manner as they, for the maintenance of the Board of the undersigned, by virtue of their high authority and for the preservation of the subordination, of which so little is still remaining, of a part of willful and disobedient inhabitants, shall find and judge proper. observe well, to that end frequently inspecting their weapons, powder, and lead, so that the same may always be found in good condition; they shall, with respect to discipline, have to conduct themselves according to such orders as shall be handed to them in due time. There shall at least twice a week, or, if possible, daily, from the heights where such can best be observed, be reconnaissance and watch kept on what is going on in the adjacent inlets or along the coasts, in order to send report hither concerning whatever might happen there, as the importance of the matter requires, as speedily as possible or via the ordinary manner. Also, a careful lookout must be kept for the ships that pass along or in sight of the coast, in order to state in the report, as often as opportunity arises, on what date such ship or ships passed there, and what was sighted or distinguished concerning them. If one of the Hon. Company's ships should come to anchor in the bay, it shall be permitted that the commander of that ship, for the service of the same and the crew, provides himself with such conveniences as can indeed be enjoyed according to circumstances, with the rendering of all possible assistance by the garrison. And the commanding officer shall immediately inquire very closely into the reasons that existed for putting in there with that ship, further also into the condition of the ship and the crew, from where and when it sailed, whither destined, what encounters it had on the voyage, and whether it has also heard of other ships, and can share any news; of all of which, and likewise how long the ship is expected to remain there, together with the message that the commander of the ship himself will have to send hither, report must be made by the same through an express messenger, in all haste, to the undersigned Governor. The exact same information shall also be taken, and report thereof made with the same speed, whenever any ship of foreign nations enters the bay there, with a statement, if it is a ship or frigate of war, of the number of pieces of cannon and the men. To the commanding officer it is very earnestly recommended and ordered not to permit any foreign nations whatsoever to refresh themselves there, except in great necessity, and in any case then to watch with redoubled attention and prevent any of them from venturing further from the beach than where the guardhouse is placed, just as, in order to prevent such, a sentry must always be posted where they might come ashore with the vessel in the presumed necessity to take in refreshments or water. In order the better to prevent the inland advance of those foreigners, in case such a ship finds itself in the circumstances of being unable to put to sea except after obtaining some refreshments, the commanding officer shall in person himself take inventory of what they will need thereof to be able to proceed further to False Bay or Table Bay, the quantity of which must also be proportioned solely to that end; and whereof the commanding officer of the post shall subsequently have communication given to the nearest inhabitants by a dragoon, so that, if they are willing to make delivery of the same, they may come down, both to negotiate thereon in his presence, and to make the delivery on the seashore. If it should happen that any people from ships of foreign nations should attempt by force to go further inland than the limit established hereinbefore, such must be resisted and prevented by force. When more than one ship comes sailing into the bay, the officer aforesaid shall hastily dispatch oral report thereof hither, stating the number of the ships and the flag they display; and when they subsequently anchor, at the first appearance on land, all the information must also be gathered concerning those ships that has been specified hereinbefore, in order likewise to send further report of everything hither with the utmost speed, wherein also that which has been ordered hereinbefore regarding the ships of foreign nations must be observed most strictly. might occur, the commanding officer, upon the first news that such a ship is apparently to remain there for more than eight days, or that assistance is required there, may proceed thither with twenty men of his garrison in order, together with the men stationed there, to stand guard and observe our orders set forth above; for which purpose he shall hasten ahead to the post in Outeniqualand, in order to prepare the wagons and whatever else shall be necessary there for the further transport of the men who in the meantime shall have to march thither; and in such case this post in Mosselbaai shall in the meantime be left in the care of the sergeant of the garrison, giving him such orders as shall be required. 12. To these garrisons shall be added some dragoons, who must serve above all to convey all reports from there hither that require any dispatch, to the drostdy of Swellendam; and the dragoon who is dispatched for that purpose must be provided with two riding horses in order, as often as shall be necessary, to change horses until Swellendam, where he must hand over his report for us to the landdrost, and in his absence to the secretary, who shall take care to have the same sent on hither with equal dispatch. 13. The corporal shall have to take care that no insolence or irregularities are committed by the garrison personnel, keeping them, to that end, under good and strict discipline. 2. When any ship or ships of our own nation happen to appear in Saldanhabaai, the corporal shall immediately row aboard and inquire after the name of each ship and commander, handing to the commander a copy of the questions to be answered by him; after the receipt of which the corporal shall send a man best qualified for it, with the papers received, hither as quickly as possible, in order to be delivered to the Governor. 3. Of all the Company's goods located there, an exact list must be made by the corporal, so that he may not only account for them whenever demanded, but also, upon a change of post-holder, hand them over to his successor upon signature of the list, and deliver a duplicate thereof to the trade office.

Meanwhile, it must be permitted that for such a ship of our nation, every convenience be provided as circumstances allow, to which end the Corporal, with the post personnel, shall render all possible assistance. 4. Upon the appearance there of ships of foreign nations, the Corporal shall not go on board, but shall cause the flag to be hoisted to indicate where they must come ashore, whereupon must be recorded the name of the ship and the Captain, the number of crew members and pieces of cannon, from where and when sailed, whither destined, for what reasons the ship has put in there, how long it intends to remain in the bay, whether it has met any ships, 5. and what news it can share, as well as whether any infectious disease prevails or has prevailed upon it, in order likewise to send a report here by an Express with all haste. 6. And ships of foreign nations between whom and the State no breach of peace has occurred may indeed be permitted to enjoy the refreshments there that they shall require in order to reach Tafelbaay or Baay Fals, but under no circumstances may any of their people proceed inland. 7. In order then to supply such refreshments to the said ships of Foreign Nations, the Corporal shall record what they might need to steer for the aforementioned Tafelbaay or Baay Fals, whereof the quantity may also only be proportioned thereto, and this must be made known to the nearest resident inhabitants, in order that, if they are inclined to make deliveries thereof, they may come down to negotiate the matter as well as to make the delivery in the presence of him, the Corporal. 8. No foreign ship, nor even one of our own nation, shall be permitted to take on any quantity of wheat or flour there and thus export it, but this must be prevented by all possible means. 9. Upon the departure of the ship that has tarried there, the Corporal, as soon as the ship has left the Bay and reached the Open Sea, must notify the Governor thereof by an Express. 10. Desertion having to be prevented there by the Corporal, those who fall under suspicion in that regard shall be arrested and sent here. 11. If any infectious disease has prevailed upon any ship, whether of our own nation or of foreign nations, or if anyone on the same might still happen to suffer therefrom, all care and attention must be applied to prevent communication therewith; to that end, the Corporal must each time go in person alongside the vessel to transfer the water or the refreshments, thus preventing anyone from the boat stepping on board, or any goods being taken from the ship. 12. The Corporal is ordered to have the salt pans repaired and to maintain them well, in order thus to be able to make salt in due season, and also to prevent the inhabitants from letting their livestock run into them, on pain of losing the said livestock. 13. It must also be prevented that anyone goes to the Islands of the Bay to shoot or club seals or birds, of which the Corporal shall also inform the commanders of the ships. 14. When the vessel arrives there on the Company's behalf for the transport of the crew for the rendering of train-oil and other operations, the Corporal shall show all necessary assistance to it with his personnel and boat. 15. In the event that, upon the occurrence of a breach of peace between the State and any other powers, any enemy ships should arrive in Saldanhabay, pursuant to the prevailing placard of 29 May 1782, in order to cut off from them the means to advance here or further inland, the Corporal and every man must withdraw inland from there with all large and small livestock, and at the same time destroy or burn all provisions found at the post that cannot be taken along, so that the Enemy can make use of nothing of either sort. Supply of the requested gunpowder and flints for the annual drill of the respective country militia. Granting of a piece of land in ownership to the farmers Willem Lategaan and Petrus Stephanus du Toit. The undertaker Van der Schijf dismissed from that office and two other undertakers appointed. Granted in ownership to the farmer Willem Lategaan, a piece of arable land situated near his old land and farm, named Het Doolhof, behind the Groene Berg, under the district of Drakenstijn, measuring 4 morgen and 300 square roods, which had been held by him on leasehold, provided that, according to his offer, in addition to the recognition imposed thereon of half a Rixdollar per year per morgen, the sum of One hundred Rixdollars is paid by him to the Honourable Company as an acknowledgment for that piece of arable land; and to the burgher Petrus Stephanus du Toit, a piece of land as a building plot, also situated under the district of Drakenstijn, in Dal Josaphat, measuring 4 morgen and 9 square roods. The Lord Governor further made known that the church council here had complained to His Honour about the extreme negligence displayed by the undertaker of the dead, Dirk van der Schijf, in remitting the church dues received by him from deceased persons whose funerals he had conducted, as well as about his disrespectful conduct toward the said church council; and that the burgher councillors had also made known that the said Van der Schijf daily engaged in such excesses of drinking that he caused much offence in the exercise of the said function. Whereupon, having deliberated, it was approved to dismiss him, Van der Schijf, from his post as undertaker, and both in his place and in consideration that, owing to the increased number of inhabitants, the present number of undertakers is insufficient, to appoint once again as undertakers the burghers Hermanus Leeve and Joel Herhold. Petition of the burgher Jacobus Johannes Vos.
