Tuesday the 29th of March 1785 in the forenoon present the Honorable, Valiant sirs Mr. Joachim van Plettenberg, Extraordinary Councillor of Netherlands India, as well as Admiral and Commander-in-Chief over this year's return fleet, and Cornelis Jacob van de Graaff, Governor and Director of this place, together with all the Members. Proposal of Mr. van Plettenberg, as admiral and commander-in-chief of the return fleet, concerning the muster of the return ships. Whereupon Governor van de Graaff proposes to let those ships depart under convoy of the State's Squadron. The aforementioned Noble Lord van Plettenberg pleased to propose that on each of the three Batavian return ships 't Loo, Roosenburg and Meerenberg, at the aforementioned capital, a certain number of Chinese had again been placed, concerning whom it was known to this Council to be the intention of the High and Noble Gentlemen of the Supreme Government of India that they should make the voyage from here onward to the Fatherland, but that no small difficulties arose in this regard, since these people could not do without their usual food of rice, and that, owing to the delay of the victualing ship Zeeduyn, there was presently no stock of this grain left in the Company's warehouses, to which was added that one could not issue rice to the aforementioned Chinese alone without causing much displeasure and murmuring among our European crews on the aforesaid ships, wherefore, to remove the same, some rice ought to be given to them as well; it is therefore, in consideration of the urgent necessity residing herein, resolved to authorize the Second, Pieter Hacker, to have purchased from private individuals, for the aforementioned purpose, the quantity of [illegible] thousand pounds of rice. After which said Mr. van Plettenberg also made known that the said Frigate Yacht Rust, besides the aforementioned Batavian return vessels, as well as the ships arrived from China, the Gouverneur Generaal de Klerk and the Draak, would be in a condition to undertake the voyage to the Fatherland under his Honor's flag on the 4th of next coming month of April, requesting of Governor van de Graaff that said hulls might accordingly be mustered on next Friday the 1st of that month, whereupon it was taken into consideration by the latter Honor to Mr. van Plettenberg how matters presently stood, that the State's Frigate of War the Waakzaamheid was currently located here, which was also due to depart from here on or about the 15th of said month of April, and whether therefore the critical circumstances of times and affairs in Europe would not most urgently require that the departure of those ships be postponed, in order to proceed on the voyage under convoy of the aforesaid frigate. The Captain of that frigate to be requested for the said convoy. Mr. van Plettenberg declares his intention to depart for the Netherlands with the small Frigate ship Jagtrust. Upon which Mr. van Plettenberg considered that, as well on account of the approaching winter season and the resulting anxiety for the ships in this roadstead, as for other reasons, it was advisable that they undertake the voyage to the Fatherland as soon as possible, wherefore Governor van de Graaff submitted the matter for deliberation to the Council, and having been discussed by them, it was deemed advisable and consequently resolved to confer by letter with Mr. Willink, Captain of the aforesaid frigate the Waakzaamheyd, about the necessity of convoying the aforesaid valuable return ships all the way to the Netherlands, in order to secure them as much as possible against all hostile encounters that might befall them, and to that end to propose to his Honor that he advance his intended departure to the 7th or at the latest the 8th of the forthcoming month of April, and to offer him to contribute everything that would indeed be required to put the frigate under his command into a state to do so. After which the well-mentioned Noble Lord van Plettenberg made known that his Honor, having awaited until now the arrival of the Batavian return ships still missing, Overduyn, de Harmonie, Hoorn and Breedenhoff, in order to embark upon the first-mentioned, as having been destined by the High and Noble Gentlemen for his transportation, but the circumstances of times and affairs not permitting the departure of the ships present to be postponed any longer, his Honor had therefore taken the resolution to make the voyage with the small Frigate ship Jagtrust.

and the said frigate thus having to sail home with the flag for the presiding Chamber Middelburg, according to custom to be brought before the presiding Chamber, the said frigate should accordingly arrive home for Zeeland, and thus both on account of the refitting to be done to the same, and because the pepper laden therein belonged to the Chamber Amsterdam, that vessel would then have to steer from Zeeland to Amsterdam; wherefore it was resolved to give the required notice thereof to the Noble Directors at the said Chamber Zeeland, with the request that the aforementioned frigate, for one and the other reason, might be sent with its present cargo to Amsterdam, to which Chamber the invoice of the pepper, and whatever else has been unladen in the aforementioned vessel, will be forwarded. The said Gentlemen Directors of that chamber will have to be requested to send that vessel with its cargo to Amsterdam. Appointment of the Junior Merchant de Salis as secretary of the return fleet. The Noble Lord van Plettenberg declared the reasons why he has chosen to go on board without any ceremony, as noted in the margin, which was accepted by this Council. While the said Lord van Plettenberg further made known that, pursuant to the authorization granted to His Honor as Admiral and Chief of the return fleet by the Most Noble Lords of the High Indian Government, he had appointed as Secretary of the aforesaid fleet the Junior Merchant Rudolphus Anthonius de Salis, who is repatriating on suspended salary aboard the ship Meerenberg, whose salary it is accordingly resolved to let run again from this date. And the aforementioned Noble Lord Governor van Plettenberg further pleased to make known that, whereas according to that which has always been customary and observed at the departure of a Governor from this Government, not only the Honorable Company's militia, alongside the burghers both on foot and on horseback, but now also the Swiss Regiment van Meuron presently lying here in garrison would have to be under arms, this scruple had occurred to His Honor, that there happen to be presently here various foreign officers of distinction, to whom an opportunity would thereby be given to take an ocular inspection of our strength, which he, Lord van Plettenberg, in the present state of times and affairs, thought ought not to happen, and therefore had judged it best to desist from the aforesaid customary honors, the more so since His Honor, on account of an indisposition of which the effects had not yet entirely ceased, would rather proceed to his aforesaid transport vessel with the least possible fuss, without any consequence being drawn from this to the prejudice of his successors in due time: of which one and all it was resolved to keep proper note hereby. While upon His Honor's request made that, in case his appointed proxies, being the appointed Junior Merchant and Storekeeper Oloff Godlieb de Wet and the Clerk Hendrik Fehrsen serving at the Orphan Chamber, might find it advisable, instead of the sum of ten thousand Rds brought by His Honor into the Company's treasury here, to provide sufficient security to the satisfaction of this Council, the aforesaid sum might then be delivered to them; it was resolved to accept the said security in the aforesaid case, and to allow the said amount of ten thousand Rds to be refunded to the aforesaid proxies of His Honor. All which matters concerning the return vessels about to depart in general, and the Lord Former Governor in particular, having been dealt with in the aforesaid manner, His Honor declared that, since his presence was urgently required elsewhere regarding other pressing matters, he accordingly had to excuse himself this time from attending the further proceedings of this Meeting, and thereupon stood up, and the matters still to be dealt with being taken in hand by the present Lord Governor, His Honor communicated: That successively on the 4th and 12th of February last, there appeared here the French private ships La Thémise and Le Berger, coming from Zuiloa and Querimbo on the coast of Africa, the first with a cargo of slaves in sort, and the last-mentioned of: that His Honor, having been informed that the aforesaid slaves all happened to consist of the best sort traded at the aforesaid coast, had considered whether, in case one could obtain the same at a moderate price, and thus with the prospect of obtaining a good profit here for the Honorable Company, to confer further with this Council, in the same manner as was practiced and carried out with good success in the year 1782, to purchase the aforesaid slaves for the Honorable Company, and immediately sell them again by public auction to the highest bidder: that he, the Lord Governor, having thereupon caused the captain of the said ship La Thérèse, Monsieur Berthome, who is also supercargo over both ships, to be interviewed on the aforesaid matter, the same had declared to him that he could part with the aforesaid slaves at no lower price than 157 Rds per head on average, and was otherwise determined to take them to Saint-Domingue, whither both of the aforesaid ships

with the reasons alleged by his Honour for that purpose. were destined to be taken along, where he was assured of being able to sell them with considerably more profit: that the aforesaid price of 157 Rds. was indeed rixdollars higher than that for which they were purchased in the aforesaid year 1782, but that regarding this it was again taken into consideration that slaves in general are currently in great demand, and thus could be disposed of with a good profit; that regarding these there was still this advantage, that they were all clothed, and thus in the approaching winter season one would at first need to incur little expense to clothe them, and the said Captain, moreover, had also offered, in case an agreement was reached with him regarding the purchase of the said slaves, to also relinquish to the Honourable Company at a reasonable price all such provisions as he was still provided with to transport them to St. Domingo: that furthermore, besides the well-founded prospect of obtaining a considerable advantage for the Honourable Company in this manner, there was also this advantage enclosed therein, that in case it was deemed fit to retain a party of the aforesaid slaves for the Honourable Company itself, these would cost very little on account of the profitable sale of the others; and regarding which retention it was particularly taken into consideration that through the good outcome of the slave trade, which was recently conducted by Captain du Miny with the frigate De Meermin at Mozambique, the great shortage of slaves, in which one has resided for a long time, has indeed been somewhat supplemented, yet not such that with the aforesaid frigate De Meermin some more voyages would not have to be made for the trading of those serviceable people, merely to be able to keep the necessary work going in all departments, not to mention that the labour on the fortifications and other public Company works, which must now be done by hired slaves at excessive costs to the Honourable Company, could be done by its own; and regarding which expedition necessarily to be resumed with the above-mentioned frigate De Meermin, it was also taken into consideration that, in the event of the non-appearance of the previously cited return ships, the same would inevitably have to be employed to search for those vessels and to render all necessary assistance to them, so it would thus depend on the condition in which the said ships would happen to find themselves, whether the aforesaid frigate De Meermin, after having found them in one or another bay or harbour, would indeed be able to undertake the voyage from there to the coast of Africa for the trading of slaves, and consequently that trade would again have to suffer a notable interruption— Decision to purchase those slaves, and in turn to sell some of them by public auction. On all of which, having been seriously deliberated following the propositions made by the Governor, it was unanimously resolved to purchase the aforesaid slaves from the said Monsieur Berthome, consisting of adult male slaves half-grown ditto adult female slaves half-grown ditto for the sum of Rixdollars apiece, on average, for the Honourable Company, and immediately to sell again a number of them by public auction to the highest bidder, while retaining the remainder for the Honourable Company to be employed here in the most necessary work; and that furthermore, in consideration of the necessity of keeping these latter at first on their accustomed food and gradually accustoming them to that of this country, there shall also be purchased from the said Captain such quantity of rice, as well as legumes harvested on the African coast, as he has left over from the provisions purchased for the aforesaid slaves, as well as to take over from the said Captain a large copper cook's kettle, which, being fitted with an iron stove and made expressly for the slave trade, is thus judged considerably better than those which have been used until now on the ships employed for the aforementioned trade. A bill of exchange on the Fatherland shall be granted from the purchase money to the supercargo. The Secunde Hacker and the Merchant Le Sueur qualified to dispose of the goods from the Fatherland to private individuals. Letter from Colonel d'Hugonet to the Noble Lord Governor. ...to negotiate with the persons who will be inclined to purchase the aforementioned goods, both regarding the prices for which they could be sold in the most advantageous manner for the Honorable Company, and regarding the payment terms that should be granted to the buyers for the greater benefit of this sale, so that subsequently such a decision may be taken by this Council as will be found to be in the best interest of the Honorable Company. Next, the Lord Governor presented a letter received yesterday by His Honour from the aforementioned Colonel d'Hugonet, which read as follows: Sir, Lord Governor! Having business only with the Governors of the settlements where I find myself, I claim to be subordinate only to them. I also know perfectly well what I owe them and I will never depart from it; my obligations toward them consist only in executing their orders to march everywhere the presence of the Regiment will be necessary to defend the possessions of the Noble Company. I must conform to the laws and customs of the country where I reside, which I wish to observe as scrupulously as possible; but what I am obliged to execute with equal regularity are the orders of Monsieur the Prince de Luxembourg. He gave me one against the Sieur de Valmont, which has already been served twice to the one who commanded the Regiment before me. If it has not been executed, that in no way diminishes the wrongs of the one against whom it was issued; it proves nothing other than that the one who did not conform to it was unworthy of commanding. The Prince had recognized this so well that he had ordered me to dismiss him himself, which must leave no doubt that all he did cannot be approved. As he is no more, I am rid of this unpleasant commission; but the Sieur de Valmont being present here, I am authorized to prevent him from wearing the uniform, since the intention of the Prince is that he no longer count among his officer corps, and to ask you to send him away, either to India or to Europe, after having kindly ordered the Captain of the ship where he will be placed not to allow him to disembark until Monsieur the Prince de Luxembourg has communicated the decision he wishes to make regarding him. In order for you, Lord Governor, to legitimately oppose the request that I have already had the honour to make to you on this subject, you must have the goodness to prove to me that Monsieur the Prince de Luxembourg cannot dismiss an officer who has placed himself in such a position, and I think it will be entirely impossible for you to achieve this end, since the Gentlemen of the Chamber of the Seventeen grant him military justice in his regiment, and this military justice consists of punishing the officer and the soldier according to the requirement of the case. Now, he who commands can relinquish his authority only in a civil or criminal case; the Sieur de Valmont being in neither case, he is entirely subject to the discipline of the one who appointed him. That is my view, as well as that of the Prince, of which I am sure; if you do not believe his powers to be so extensive, show it to me, I beg you, in a writing that may convince him that, if I have not fulfilled his intentions, it was not through my fault. It will then be up to him to maintain his rights and send at the head of his corps (should he happen to lose his case), instead of a military officer, a councillor from some parliament who can answer to all the legal proceedings that officers or soldiers might wish to bring against him; for I do not feel enlightened enough to dispute against so many individuals. From the moment subordinates are permitted to contest the punishments inflicted upon them, farewell to subordination, and a Commander becomes a cipher at the head of his Corps. I am persuaded of this truth, Lord Governor, that if the Company offered me a salary of one hundred thousand Ecus to submit to such humiliations, I would refuse them. The discipline of a Corps must concern solely the one who commands it, and his orders of every kind must be executed, with the right reserved for those who are aggrieved to assert their claims; but until they are fully recognized, a Commander must not be disapproved of, because that is to demean him and to encourage the cabals that occur all too often in many Corps. Monsieur the Prince therefore, in my opinion, having no account to render except to the Gentlemen of the Seventeen with whom he contracted, no one other than them can disapprove of his conduct, should he place himself in such a position, which is very far from being the case. In the forenoon, present: the Honourable, Most Noble Governor Cornelis Jacob van de Graaff and all the Members; the Honourable Councillor Extraordinary of the Indies, and Admiral and Chief of the Return Fleet Mr. Joachim van Plettenberg, not present. The Captain of the ship 't Huys te Spyk currently still present here, Christiaan van Veerden, having been discharged from said service at his request submitted by petition pursuant to the resolution of 18 January past, it was approved to assign the command of that vessel, as Commander, to the Chief Mate of the frigate ship de Meermin permanently stationed here, Jan Andries Stuur; while the naval Lieutenant Christiaan de Serff has been placed on the said ship 't Huys te Spyk to perform the duty of Chief Mate. Furthermore, permission was granted to the former captain of the hooker ship Catwyk aan Rhyn lying in the roads, Clement Bijndorp, at his further request, to depart for the Netherlands on the transport ship le jeune Stanislaus. Permission was also granted to the undermentioned persons, at their request submitted by petition, to take with them from here to the Netherlands the following slaves, namely: To the Senior Merchant of the Castle at Batavia returning home on the return ship Roosenburg, the Honourable Gerhardus van Grol, a slave boy named Fortuyn, and a female slave named Diana. To the Merchant and former First Administrator in the grain warehouse at Batavia aforesaid, the Honourable Ary Huysers, returning home on the ship Meerenberg, an emancipated slave boy, Oro of Bugis. To the Junior Merchant Rudolphus Anthony de Salis, sailing home on the same ship Meerenberg, an emancipated female slave named Tjindanna. For whom, however, the designated transport and board money must first be paid here into the Company's Treasury, to wit: for the slave boy of the aforementioned Gerhardus van Grol and the free boy Oro, only the transport money from here to the Netherlands and back again, but for the female slave of the aforementioned Gerhardus van Grol and that of the Junior Merchant Salis, the transport and board monies for the outward and return journey from Batavia to the Netherlands. Likewise, permission was granted to the former burgher councillor Johannes Karnspek to send his son named Oloff Christoph, and to the burgher Willem Hoppe also a son named Jan Hendrik, to the Netherlands for the purpose of receiving a good education, on the China return ship de Draak lying in the roads, for whom the designated transport and board money, in order to be lodged and entertained in the cabin, must first be paid into the Company's Treasury here. will undertake the voyage to the Fatherland of this month, the Dutch private ship Den Onzekeren being about to sail, having given notice to van Plettenberg, his Honour had declared hereupon that his intention was to proceed to his transport vessel Jagt Rust on coming Monday the 4th of this month, and to have the Admiral's flag hoisted from the same, and after having issued the necessary orders concerning the ships, to repair on board again on Sunday the 9th of this month, furthermore, pursuant to what had been recorded by Resolution of the latest Meeting of the 29th of March last, to put off from land without any ceremony, in order thus to undertake the voyage to the Fatherland on the appointed time of Monday the 10th, weather and wind permitting, awaiting God's Blessing. Whereupon the Lord Governor had agreed with the said Lord Admiral van Plettenberg to have the repeatedly mentioned return vessels that are about to depart mustered on Wednesday the 6th of this month, and to have the dispatches for the said keels brought in readiness so that they can be delivered to the commanders of the ships on the aforesaid 9th of this month. After which the well-mentioned Lord Governor was also pleased to communicate that, since the Dutch private ship Den Onzekeren, sailing for the account of the Honourable Company, was also in this roadstead, and his Honour had been informed that the same would also be in a state of departure by the aforesaid 10th of this month, he, the Lord Governor, had presented to the master of that vessel, Jacob Johan Staalkop, the necessity, in view of the present critical circumstances, of likewise sailing under convoy of the previously mentioned State frigate De Waakzaamheid. That the said master Staalkop had initially raised some objection to this, principally on the grounds that his vessel, being an uncommonly fast-sailing ship, could, if departing alone, reach the Fatherland a good month earlier than if it had to sail with the squadron, and having requested to deliberate for that purpose on what he should observe here in the best interest of his principals, he had subsequently declared, after having carefully weighed everything contained herein for and against, that he was resolved to undertake the voyage with the squadron under convoy of the repeatedly mentioned State frigate. Wherefore it was resolved to give the requisite notice of this both to Captain Willink and to the Lord Admiral van Plettenberg, leaving it, however, to the aforesaid master Staalkop, in case one might obtain reports on the voyage upon which full reliance could be placed that affairs in Europe had since changed for the better, and he should then deem that the interest of his owners required him to pursue the further voyage alone with his vessel, to apply to the Lord Admiral in that regard, in order that the matter may be dealt with according to the circumstances. Petition of the French Commissioner Percheron, whereof notice shall be given to Captain Willink and the Lord Admiral van Plettenberg, it being left to Master Staalkop to act in that regard according to the circumstances. Next was read the following petition, presented to the Lord Governor by the Commissioner of His Most Christian Majesty's Navy, Monsieur Percheron: Monsieur, The Commissioner of the Navy of His Most Christian Majesty has the honour to represent to you that he had placed in store last year various provisions and goods, which had been requested of him for the service of the Squadron of Monsieur de Suffren, which was to make its return to Europe. Two of his vessels were lost before arriving at the Cape, one passed by without putting in, which makes a year that has left the Commissioner overstocked with a portion of flour that he could not use at the Cape, and which he proposed to transfer to the Isle de France for the King's service, when he was informed that a wheat shortage was threatened, which could make the 100 thousand weight of flour that he had in store useful to the Colony. His first care was to offer it to Monsieur Governor de Plettenberg, and to promise him not to dispose of it in any manner until the subsistence of the Cape was assured. Things have changed for the better, the harvest has been abundant, and the Colony has not needed this service. The Commissioner of the Navy is therefore grounded in believing that you will be so good, Monsieur, as to authorize him to transfer this flour to the Isle de France, where it can be useful for the King's service. Thereafter, it was reported by the Honorable members of this assembly, Adriaan van Schoor and Mr. Jacobus Johannes Le Sueur, that pursuant to what was demanded of them by resolution of 15 March, they had attempted to persuade the skipper of the ship de Vreede, Thijs Keetel, to sail on further to Batavia with his aforementioned vessel under certain conditions to be further agreed upon with him, but that they had encountered these obstacles therein: that in the charter party concluded by the owners of that vessel with the Honorable Company, it is specifically stipulated that once it has been discharged of its cargo for this place, it would again be laden with other goods. having been appointed members of this Council, the Honorable Adriaan van Schoor and Mr. Jacobus Johannes Le Sueur, from which it appears that in the said trade books not only all entries of expenses and other write-offs agree with the warrants granted in respect thereof, but that also no write-offs were made outside of these; likewise that the pay books, kept according to the orders of the Honorable Company, show the payments to the servants properly disbursed, and the taxes thereon written off in the trade books in such manner as is specifically shown in the report thereof; and lastly that the estate accounts of the deceased servants of the Company whose inheritances were administered and sold by the Pay Bookkeeper as curator ad litem, were also properly examined and found that the entry and calculation therein was made according to the Indian standard coin here; and that the auction books agree with the original records of the held auctions, and these in turn with the inventories; as well as that the death accounts of the deceased persons, for the net proceeds of their estates with a deduction of 6 7/8 percent for exchange loss pursuant to the honored missive of the Honorable Grand Estimable Lords Majores in the Fatherland dated 3 April 1778, each having been credited for his share; that amount furthermore in the sum of 1066 ducatoons 30 stuivers, or 3839:2.- rix-dollars, together with another 79 ducatoons 42 stuivers, or 286:10 guilders on account of the aforementioned exchange loss, was paid into the Company's treasury here by the repeatedly mentioned curator ad litem on the last day of August last, and properly accounted for in the trade books, so that in that regard everything has been acted in conformity with the renewed and amplified orders of the Honorable Grand Estimable Lords of the High Indian Government; it is therefore agreed that the frequently mentioned trade and pay books, according to custom, both to the Fatherland and Batavia, and the aforementioned reports regarding the examination thereof shall furthermore be supplied to the Lords of the High Indian Government. Whereupon the Governor made known that, whereas the return ships De Harmonie and Overduijn, which had already departed from Batavia in the latter part of October and the beginning of the month of November of last year, together with the ship Zeeduijn, laden with goods and provisions for this Government, have not yet appeared here nor been sighted elsewhere along these coasts, the only and best thing one could still hope regarding them would be that, through suffered disasters or the poor condition of their crews, being unable to keep the sea any longer, they were compelled to seek shelter in the first available port, and thus may have arrived either at Rio de la Goa or in the Bay of St. Augustine on Madagascar, just as occurred in the year 1757 with the Bengal return ship De Naarstigheid, and in the years 1772 and 1778 with the ships Welgelegen and De Venus, and that the aforesaid ships now missing might likewise find themselves in one of the aforesaid bays, without being in a position to send any report of their condition either hither or elsewhere, so that inevitable necessity therefore required that, the sooner the better, the necessary measures for tracing those keels and for bringing them all help and assistance should be undertaken and put into execution; wherefore His Honour submitted for consideration how one ought now to act in this regard. to employ 't Huys te Spijk or the hoeker Catwyk aan Rhijn, as it would furthermore be a desirable matter if one of those keels could be used for this expedition; that although according to the report submitted under date 11 January of this year by the Honorable Equipagemaster van Gennep, together with the commissioned sea and ship carpenters, it was found that in the said ship 't Huys te Spijk, on account of the bad condition of its orlop and upper decks, no other goods could be loaded than such to which no damage could be caused by water, this difficulty nevertheless would not prevent sending the crew with the same, and loading therein the provisions and materials for the aforementioned ships to be sought, and conversely, in the event that one or more of those keels, and in particular the said provision ship Zeeduyn unexpectedly with the assistance to be rendered to the same, should not be in a state to undertake the voyage hither, to take over and bring hither as many goods from its cargo as to which no spoilage could be caused by water, and in any case the timbers from the aforementioned ship Zeeduyn. It was therefore judged best, before disposing finally hereon, to take the advice of the Equipagemaster and two sea captains, and that thereover first the aforementioned Equipagemaster van Gennep, together with the Sea Captains Jan Siereveld and Cristoffel Beem, shall be commissioned to confer with one another whether and what useful employment could be made in this of the aforementioned ship 't Huys te Spijk and the hoeker Catwijk aan Rhijn, or how this expedition should otherwise take place to the greatest service of the Honorable Company, and regarding which they, in relation to the previously mentioned frigate de Meermin, must also keep in view the intention of this council to let the same proceed from Delagoa Bay or Madagascar further to Mozambique for the trading of slaves, after the circumstances of the matters in which the aforementioned remaining ships or one of them should find themselves, just and in the same manner as took place at the dispatch of the frigate yacht Jagt Rust in the aforementioned year 1779 to track down the ship de Venus; whereupon it has also been thought fit that at these meetings to be held by the aforementioned commission, the Sea Captain of the frequently mentioned frigate de Meermin, Francois Duminy, and the Commander of the ship 't Huys te Spyk, Andries Christiaan Stuur, shall also have to assist. Who also will have to indicate in what manner that expedition can take place to the greatest service of the Honorable Company. Request of Colonel de Meuron to be provided with the military laws in force at the Honorable Company. After which the well-esteemed Lord Governor was pleased to communicate that it had been made known to him, the Lord Governor, by the Count de Meuron, Colonel of the Swiss regiment of that name lying here in garrison: That, since by the 22nd article of the capitulation concluded between the Right Honorable Gentlemen P. E. van de Perre and Fredrik Willem Boers, as Deputies of the Dutch East India Company, and him, Lord de Meuron, it was stipulated that the regiment should have its own sovereign justice, like all other Swiss troops serving with foreign powers, conforming themselves to the laws of the Honorable Company, his Honor had therefore repeatedly insisted with the repatriated former Governor van Plettenberg to be provided with the aforementioned laws of the Honorable Company, in so far as they were of application to his aforementioned regiment, in order to be able to act accordingly in occurring cases. That the said Lord van Plettenberg had also undertaken hereupon to cause the aforementioned laws in force here to be delivered to him, Colonel de Meuron, as soon as the manifold occupations would in any way allow having the same put in order and translated into the French language, but that the well-esteemed Lord van Plettenberg, probably having had no time for this due to the continuously prevailing heavy occupations, had departed without providing him, Colonel de Meuron, with the aforementioned laws of the Honorable Company. Wherefore he, Colonel, had found himself obliged to urge him, the Lord Governor, in this regard, especially since already for a long time 100 soldiers of his regiment had been detained on account of desertion, who for lack of the aforementioned elucidation requested by his Honor had not been brought to trial. that by the same the criminal code of Emperor Charles the Fifth, commonly called the Carolina, was always precisely and to the letter followed, and which he, Colonel de Meuron, affirmed that the Swiss Cantons gave to their regiments serving with all foreign powers, to be followed in the administration of justice; having carefully considered the matter, and upon deliberation that, by the aforementioned Carolina, the death penalty was imposed upon desertion; that this death penalty has not only been mitigated by the currently applicable military laws established by Their High Mightinesses to such an extent that it no longer takes place except in extreme cases, but that in particular the crime of desertion, according to the enactments by Their High Honours, the lords of the High Government of the Indies, as the lawful representatives of the Sovereign, pursuant to the report submitted to Their High Honours by the Honourable Court of Justice of the Castle of Batavia under date of 16 June 1762, must be judged upon the information obtained; he had therefore deemed it necessary to bring the matter to the cognition of this Council, and to propose to the same to write to the aforementioned Mr. de Meuron, by a missive to be directed to his Honour by the Governor, to adhere for the present in the administration of justice to the aforementioned Carolina, except in the matter of desertion, in which regard the articles of war serving for the military garrison here should be followed, and that the same articles, which the Governor for this purpose had caused to be translated into the French language, shall be delivered to the repeatedly mentioned Colonel de Meuron after they have first been initialed by the Governor, sealed with the Company's seal, and countersigned by the secretary by order of his Honour and this Council, thus obtaining the required legality. Whereupon, after deliberation, it was unanimously agreed to conform to the aforementioned proposal of the Governor, and to conclude the matter in that manner. Request of Gabriel Von Moller to depart from here for Ceylon on one of the Company's ships, which was declined for the reasons mentioned alongside. A request having now been made on behalf of Gabriel Von Moller, to whom permission was granted by the repatriated Governor Plettenberg to stay in this place for some time, to be allowed to embark on one of the ships lying in the roadstead and bound for Ceylon, either the Huysduijnen or the Sparenrijk, in order to subsequently find an opportunity to reach Madras; it was considered that both of those ships are already occupied by so many passengers that there is no opportunity to let him, Moller, cross with them, but that it appeared especially rather strange that there were recently several opportunities to reach Madras either directly or via Tranquebar with some of the English and Danish ships that passed by here, and that he did not make use of those occasions; therefore, it was deemed best to decline the aforementioned request. Thereafter, the Governor made it known that his Honour had been informed that the Chevalier de Valmont, mentioned in the resolution of 29 March last, Captain in the Legion of Luxemburg garrisoned in Ceylon, seems to intend to establish himself here, whereas the passport granted to him only contains permission for the period of eighteen months to conduct his affairs in France; and it was solely on this basis that, he being regarded as a passenger, the wish made in his regard by Colonel d'Hugonet, currently present here, was not acceded to; it was therefore deemed best, and consequently resolved, that the said Chevalier de Valmont shall be notified to proceed with his intended voyage to France on one of the first departing ships. Further disposing of the vacant officer positions among the Cape burgher infantry due to the death of Lieutenant Jan Hendrik Ekkert and Second Lieutenant Johannes Henricus Verlee; it was approved to let Hendrik Oostwald Eksteen, Pieter's son, who was discharged from that service at his request in the year 1780, re-enter as such into the said burghery in place of the first-mentioned Lieutenant Ekkert, and to rank him after the senior... Furthermore, in place of the repatriated Bookkeeper Abraham Chiron, Bookkeeper Petrus Johannes Fruter, assigned to the Trade Office, has been appointed Bookkeeper at the Honorable Company's Equipment Warehouses. Likewise, on account of the death of the Master Gardener at the Company's garden at the Rondebosje, Frans Joseph Olwegen, the Reader and Schoolmaster of the Stellenbosch congregation, Gillis de Korte, has been appointed Master Gardener there in his stead, and that at his own request, being more inclined thereto, with an increase in salary to 30 guilders per month under a new three-year contract. Finally, the clerk at the Honorable Company's artisans' quarters, Hendrik Zeel, has upon his petition submitted to that effect been granted permission, due to the expiration of his term of service, while retaining his rank and wages, to repatriate from here, and also to take with him his wife and young daughter, while he, in consideration of his impoverished condition and inability to pay the customary passage and board money for his wife and child, has been excused therefrom. By four of the officers belonging to the Regiment of Luxembourg currently in garrison at Ceylon and in the service and pay of the Honorable Company, who, having obtained their discharge there, arrived here with the hooker ship Katwijk aan Rhijn, but at the request and representation of the Knight d'Hugonet, Colonel Commandant of the said regiment, are to return with him to Ceylon, being Lieutenant Champenoy as well as the Second Lieutenants de Rosiere, Sousslot and Pissot, the following petition was handed to the Honorable Governor: General, The impossibility in which we find ourselves of meeting the expenses of a stay of nearly four months, which has not only absorbed the little we had received, but which has furthermore put us in the necessary position of contracting indispensable debts, induces us, General, to make our situation known to you, and to beg you to be so good as to place it before the Council. We would need two months of salary and emoluments. We hope, General, that you will be pleased to have regard to our request, which, even if it were not authorized by our re-entry and the service we perform in the Regiment of Luxembourg, is sufficiently motivated by the urgent need in which we find ourselves. Our gratitude will always equal the eagerness with which we shall seize the occasions where we will be able to prove our zeal for the service of the noble Company. Report of the Equippage Master and nautical experts, on the resolution of the 19th of this month, concerning the expedition to search for the Company's overdue return ships. simple titles, of Monsieur General, had to be clearly understood, was directed to the Colonel Commandant d'Hugonet himself, and if he, the Colonel, thought that any regard should be paid to the request of his four officers, such could and should then have been presented by him to this Government in an entirely fitting manner. And that, whereas the said Colonel d'Hugonet, on other occasions, and especially in a letter written recently to the Noble Lord Governor, had clearly demonstrated his opinion as if he had nothing to do with this Government. prevent employing the said ship 'T Huys te spyk for the search of the aforementioned remaining three ships, and for loading onto the same the provisions and materials required for those three ships, and subsequently, in case one or more of the same, especially the provision ship Zeeduyn, unexpectedly, with the assistance to be brought to it, might not be in a condition to undertake the voyage hither, then to take over from its cargo as many goods as cannot suffer spoilage by water, and in all cases the timber, from the aforementioned ship Zeeduyn, and bring them hither. — but that your Right Honorable, Valiant, and Worshipful Sirs had deemed it best, before and prior to finally deciding thereon, to commission the undersigned Master of the Equippage van Gennep and the Captains Ziereveld and Beem, to confer with one another whether and what useful service could be made in this matter of the aforementioned ship 'Thuijs te Spijk and the hooker Catwyk aan Rhyn, or how otherwise this expedition ought to take place to the greatest service of the Honorable Company, and regarding which, in relation to the aforementioned frigate de Meermin, it should be kept in view to be the intention of your Right Honorable, Valiant, and Worshipful Sirs, after the circumstances of the matters in which the aforesaid remaining ships or one of them might find themselves, just and in the same manner as took place regarding the dispatch of the frigate jagt Rust in the year 1779 for the search of the ship de Venus, to let it proceed from Rio de la Goa or Madagascar further for the trading of slaves to Mozambique; and That finally, in conclusion of all this, the undersigned have been requested, with respect to their opinion according to which manner the aforesaid expedition ought to be directed for the greatest service of the Honorable Company, to furnish a report as soon as possible, in order that such a resolution might then be taken by your Right Honorable, Valiant, and Worshipful Sirs as you should find to be proper. Thus the undersigned, in order to fulfill dutifully, as much as lies in their power, the commission assigned to them and what was thereby ordered, in a meeting in which, pursuant to the order, the naval captain of the aforementioned frigate de Meermin Francois du Menij, and the master of the hooker Catwyk aan Rhyn Christiaan Andreas Htuur were also present and assisted, have deliberated with one another on the means which seemed to them to be the most possible and suitable for achieving the intended objective. — Wherefore the undersigned have the honor to submit their opinion on this most humbly to your Right Honorable, Valiant, and Worshipful Sirs and to state thereby: that regarding the reflection occurring to your Right Honorable, Valiant, and Worshipful Sirs whether or not the ship Thuys te Spyk or the hooker Catwyk aan Rhyn could be employed for the expedition of searching for the Company's remaining three ships Overduijn, de Harmonie, and Zeeduyn, the undersigned must take the liberty to remark thereon: that the ship 'T Huys te Spyk, it is true, according to the report made thereof by the specially commissioned officers, could still be employed for the transport to the Indies of such a cargo as to which no leakage or soaking can cause any damage, and for which purpose that vessel is therefore also already destined for the conveyance of wines to Batavia; that it makes, however, an all too certain and very great difference whether a ship of such condition as 't huys te spyk—which, over and above the stated defects in its between and upper decks, is already old and very far sailed out—be employed for a direct voyage from here to Batavia, and thus along a fairway where it is exposed to no apparent disasters at sea beyond those which are outside the reach of human foresight; or whether such a vessel be dispatched on a cruising voyage for the search of the ships along the coasts, especially those which must be navigated for that purpose, and which in themselves are always, but indeed particularly in this season of the year, highly dangerous; that for such an expedition there is absolutely and necessarily required a good, light, and strong vessel that is capable of withstanding the perils of the sea; that thus the ship 't huys te Spijk, in the situation in which it presently is, cannot serve for any such voyage, since it is in such a state that upon any few mishaps which it will inevitably encounter on such cruises, it may fall into the circumstance of having to retire to one or another best available port, without being able to put to sea again from there, whereby then the principal objective of that expedition would be entirely frustrated, and one might thereby still see oneself brought into the necessity of sending out once again a new other ship or vessel from here for the search of the missing three ships, as well as of the ship 't huys te spyk itself. — While the undersigned, under favorable interpretation, must further note the necessity that the more mentioned ship het Huys te spijk, with this very closely approaching winter monsoon, ought to be dispatched direct from here to Batavia the sooner the better; that regarding the hooker ship Catwijk aan Rhyn, whose present condition is solely and best known to the undersigned Master of the Equippage, he, Master of the Equippage, therefore according to the reports received thereof from the officers appointed thereon, takes the liberty to inform your Right Honorable, Valiant, and Worshipful Sirs: that the said hooker Catwijk aan Rhyn also already happens to be in a very weak condition; that the entire sternpost of that vessel is nearly worked loose, and the two lowest pintles

But in the event that it might happen that said Captain Duminy on the aforementioned east coast of Madagascar might have found the frequently mentioned missing ships or one of the same, and indeed in such a state that, regardless of the assistance received from them, they would not be able to go to sea again, he, having provided the distressed ship with the necessary assistance to await further assistance from here, must also return hither as quickly as possible to inform us of his discovery.
