without knowing the date thereof, having discovered that during the night before, six ducks and eight chickens had been stolen from the deponent, without the deponent knowing at that time who the perpetrator thereof was. That subsequently on the Sunday thereafter, 13 chickens having again been stolen from the deponent, he, the deponent, on the following Monday morning, when he missed the same, went around to search for his stolen chickens; that he then saw the same being carried by two boys belonging to the burgher councillor, the Honorable Jan Coenraad Gie; that the deponent stopped those chickens and went to the Honorable Gie to inquire where he had obtained the same, having been informed by the said Honorable Gie that he had bought those chickens that morning from an outside boy and had also paid for them. The deponent finally attesting that he could discover no signs of breaking and entering, and only on the second or last occasion had found the door of the backyard open, as well as having later heard by rumor that these thefts were allegedly committed by the boys of the former burgher councillor, Mr. Johannes Karnspek. Declaring nothing more, the deponent gives as reasons for his knowledge as stated in the text, declaring this to be the truth. Underneath stood: Thus done and recollected at the Cape of Good Hope on 28 October 1785 before the Honorable Salomon van Echten and Johannes Smuts, members from the Honorable Court of Justice aforesaid, who, together with the deponent and me, the sworn clerk, have also duly signed the minute hereof. That furthermore a few days thereafter, without knowing the exact day, the aforesaid boys came again to the deponent, bringing with them eleven chickens, which were also bought by the deponent. That finally on 3 September, the oft-mentioned boys came again to the deponent, bringing with them ten turkeys, four Muscovy ducks, and some geese, without knowing the number, which were also offered for sale by them in the aforesaid manner to the deponent; but since the deponent was not yet present, those boys were told by a certain Maria Hester van Coppen, residing with the deponent, to come back to collect their money, keeping the poultry, because on the previous occasion persons had already presented themselves and declared that the same chickens and ducks belonged to them and had been stolen from them; since those boys did not return, the deponent went to the requisitioning party and gave him notice thereof. The deponent finally attesting that when the said boys had come to him, the deponent, for the second time, they had pretended to belong to a certain Dreyer.

Appeared before us, the undersigned commissioners from the Honorable Court of Justice of this government, the slave Alexander of the Coast, bondman of the Burgher Councillor Mr. Johannes Karnspek, who to the adjacent interrogatories has given such answers as are noted down beside each of them. Articles drawn up and delivered to the gentlemen commissioners from the Honorable Court of Justice of the Castle of Good Hope, in order to be heard at the requisition of the interim Fiscal Gabriel Exter: Alexander of Malabar, bondman of the former Burgher Councillor Mr. Karnspek, presently the Lord's prisoner, whose answers to be given shall be duly noted in the margin hereof. Article 1: The prisoner's name, age, birthplace, and whose bondman he is. States Alexander, from the Coromandel Coast, aged about twenty-five years, and belonging to the former Burgher Councillor Mr. Johannes Carnspek. Article 2: How long he has been in the service of his said master, and what his daily activities are. Answers: right around thirteen years having lived with his master, and having been rented out to the Honorable Company. Article 3: Whether he was at home or absent therefrom on the night between the 2nd and 3rd of this month. Says: yes, around the stroke of nine o'clock. Article 4: When and in whose company he went out from home, and where to. Says: around 8 o'clock in the evening. Says the three of them, namely the prisoner himself went out together with his fellow slaves Willem and Lamour, and they then went to the house next to Baartman to eat. Article 5: Whether they were not also behind the Castle that night, and what time they arrived there. Says that around the stroke of two o'clock he went to the pathmaker's cottage with the intention of stealing the livestock there, while he, the prisoner, stayed sleeping behind the Castle with the other prisoners Willem and Lamour until that late. the Honorable Worshipful Council aforesaid, who together with the mentioned and me, the sworn Clerk, also have duly signed the minutes hereof, lower, which I witness, was signed R. I. V. D. Riet, sworn Clerk. Aesoo Alexander of the Coast, aged approximately twenty-five years, La Moer of Baly, aged approximately twenty years, and Willem of Macasser, according to estimate aged thirty years, all three slaves of the former Burgher Councillor, the Honorable Johannes Carnspek, currently prisoners, have freely confessed, and it has evidently appeared to the Honorable Worshipful Council of Justice of this Government from the further documents added to the trial: That, as appears, four months ago, the three prisoners, after mutual agreement, having managed to get quietly out of their master's house between eight and nine o'clock in the evening, proceeded behind the Castle, where having stayed until after midnight, they then went to the house of the pathmaker standing not far from there, in order to steal from the warehouse situated thereby the poultry locked up inside it; to carry out which premeditated theft so much more easily, the third mentioned, Willem, on the advice of the second mentioned, Lamoer, had taken along a chisel from their master's house. That the mentioned having arrived there, having broken open the door of the warehouse with the aforesaid chisel, though accusing each other of committing that break-in; after which the mentioned entered that warehouse and stole therefrom thirteen turkeys, seven geese, and some Muscovy ducks, without being able to determine the exact number thereof; which poultry having first been carried by them on sticks to the garden situated there, they slaughtered a turkey there, which the third mentioned, Willem, having taken along to the house of their master, was subsequently eaten by them together; the first and second mentioned having furthermore taken the poultry towards the Cape and early in the morning brought and sold it at the house of the Burgher Councillor, the Honorable Jan Coenraad Gie, saying that they were slaves of the farmer Walters and that their master's wagon had broken down behind the Castle. That because the aforesaid Honorable Gie had not yet been at hand, the two first mentioned had been appointed to come back and collect the money for the sold poultry; but the committed theft having meanwhile been discovered and become notorious, and the prisoners having received knowledge thereof, the culprits decided not to go collect the money. That the two first mentioned, Alexander and La Moer, a few days before having also brought for sale to the mentioned Honorable Gie eleven chickens, which were stolen from the free black Joseph of Boegies, it was discovered upon investigation that that theft, as well as at the pathmaker's house, the former was committed by the two first mentioned alone, and the latter by all three of the mentioned, in such manner that the prisoners fell into the hands of Justice. But whereas such thefts in a country where Justice is maintained are by no means tolerated, but must be punished according to the findings of affairs as an example to other such swift thieves; So it is that the Honorable Worshipful Council of Justice, having read and considered with attention the written Criminal Demand and Conclusion of the Fiscal Pro Interim, Sieur Gabriel Eiter, together with having regard to all that pertained to the case and could move their Honorable Worships, doing justice in the name and on behalf of the High and Mighty Lords States-General of the United Netherlands, have condemned, as their Honorable Worships condemn them hereby, all three of the mentioned Alexander, Lamoer, and Willem, to be brought to the place where one is accustomed to execute criminal sentences, there delivered to the executioner, and tied to a stake one after the other, to be severely scourged on the bare backs, furthermore the two first mentioned, Alexander and La Moer, each for the period of three years being clapped in the chain, then all three to be sent home to their master, provided paying the costs and expenses of Justice; the Council denying the otherwise or further made demand of the Officer. to have the aforementioned Tima fetched to the jail, who then immediately confessed not only to having perpetrated that act with her fellow slave Silia, but also to having practiced this deed together on several journeys and repeatedly; that this Silia having furthermore likewise been taken into custody, they, the witness and defendant, as appears from their answers given before the Gentlemen Commissioners from this Honorable Venerable Court to the interrogatories put to them, uncompelled and unanimously admitted and declared that since the death of their mistress, she, Fina, having also come to sleep in the room with the children, she and Silia, who usually slept there, took it into their heads to profit from the opportunity to steal money from their master, having observed that the same master kept the key to the desk in his trouser pocket, and ordinarily hung these on the chair standing in front of the bed; that they thus, when their master used to rise early in the morning to call up the slaves and to show himself by giving the necessary orders, took the key out of the trousers, opened the desk with it, and took away money at their pleasure, so that they did this together on several occasions, without being able to determine how much they took each time; yet according to the declaration of Silia, Article 6, their theft on the first occasion consisted of 10 pieces of paper money, on the 2nd of 12, and on the 3rd of 8 pieces of the same currency; with which the confession of the slave Tima also agrees, see Article 14, that she had placed as much into the hands of the soldier Bernhard for her share, amounting to the sum of 350 Dollars; Silia having furthermore on another occasion, when her companion slept in the attic, stolen 4 pieces alone, and handed over two pieces thereof to her said companion; that the prisoner and defendant, not having found it advisable to keep so much money in their own custody, after having used a portion thereof for the purchase of chintz, linen, and some other goods, and certainly hoping to be able to procure more for their further necessities in due course, the first-mentioned Tima gave her share, as stated, for safekeeping to the soldier Jacob Bernhard, stationed under the Battalion keeping garrison here, and Silia entrusted hers, still consisting of 20 guilders 100, to her mother, a slave of the Burgher Hoppe, living with the soldier Johan Christiaan Pruysman, both of which persons, far from denying such, fully acknowledged the receipt thereof, all of which will further appear from the documents obtained before the Gentlemen Commissioners and the full confession of the prisoner and defendant; and that the witness and defendant have thus made themselves guilty of the great crime of committed domestic theft in a very extreme and most punishable manner; it remains only for the Officer Prosecutor briefly to consider what punishment the prisoner and defendant have thereby merited. Whereof the same will take the liberty to bring into consideration that although it is a general rule that the easier and greater the opportunity to steal, with all the heavier punishment the thefts must be prevented and countered, and therefore domestic thieves, when committed by servants and being of value and importance, are generally punished with death even for the first offense, the same theft being placed by some alongside that which occurs in times of fire; the Officer Prosecutor, under higher correction, believes this rule is not so rigid as to always adhere to it, but, moved by circumstances and the nature of the matters, as in all cases, the ordinary determination can also be departed from. It is true that the prisoner and defendant have repeatedly stolen and made away with a considerable sum of money; that this sum, together with 94 Rixdollars which were still found from the last theft in their chests, amounts to circa 550 Rixdollars, besides what they spent on goods, clothes, and treats; that they committed these thefts with premeditation and intent, against the mind and will of their master to benefit themselves; that they did it out of an inclination to steal, while they could not bring the slightest complaint against their master, see Article 32 of L. That the relator, having already during the lifetime of his recently deceased wife noticed that from time to time some money was purloined both from his trouser pocket, which trousers usually hung at night by the post at the foot of his bedstead, as well as from the desk, without the relator being able to accuse anyone of taking that money, it finally happened after the decease of his aforesaid wife, namely on Friday the 9th of this current month of September, that his servant named Donee handed over to him the previous evening some money to the amount of something under three hundred Rijksdaalders, and the relator locked this money in his desk, and also put the key into his trouser pocket, and hung those trousers according to custom on the post of the bedstead when he went to sleep. Before the undersigned commissioners from the Honorable Council of Justice and at the requisition of the substitute serving the fiscal's office, Gabriel Exter, by the burgher Jan Jacob Meijer, of competent age, reading as follows: That the relator, having the custom of rising early in the morning and waking his slaves, consequently seeing to some things in the house, when he had returned again from outside took the key out of the trouser pocket hanging by the bedstead, opened the desk, and having at the same time to pay out some money, immediately recounted the remainder and found that it was far below the sum that the servant had handed over to him, the relator; whereupon the relator, having asked the servant whether he might perhaps have miscounted since the money did not tally, the servant maintained that he had not; that the relator's female slaves Tima and Silca, having then been ironing in the front room, looked very embarrassed when the relator spoke about this; so that the relator, having conceived great suspicion, quietly ordered his brother who lives with him to take care that those maids could not go up to the attic, nor to their chests, nor outside the door to speak with anyone, while the relator went to the provost marshal and requested to have his slave Sina fetched from the house to the jail; who, having immediately sent the deputy provost, the relator told the provost that he should take care that the maid could not reach with her hands into the pocket to throw anything away, the relator having remained with the provost that whole time. That since the said female slave refused to confess anything more in his presence, even though he had told her that she should just say where the other money had gone, the relator went away from the provost's room, whereupon the aforesaid Sima confessed to the provost that the soldier, a shoemaker named Jacob, had the other money in custody; whereupon the provost, having gone with the aforesaid Tima to the residence of the soldier Jacob, the provost obtained from that soldier three hundred and fifty-five Rijksdaalders in paper currency, which that soldier said he had received from the female slave Sima; the provost also having found, both in the chest and in the pocket of that female slave Sima, three diamond rings, which as well as the aforesaid money are in the custody of the provost. Article 3. What her usual and daily duties were. States: to look after the children of the said Meijer, and further to knit, sew, and cut fabric. Article 4. Where she, the Prisoner, had her ordinary daily sleeping place; whether she slept there alone, or others with her, and who they were. States: previously always to have slept upstairs in the house, and during the illness of her deceased mistress in the front room, and after the death of her said mistress in the room with the children. Said the maid Silvia with the prisoner's small child. Article 5. Whether she, the Prisoner, did not on several occasions get up at night and steal money from her master; how often this happened. States: never to have gotten up at night, but to have done so in the morning, while her master frequently went outside early to urinate; which opportunity was then taken by her, the Prisoner, and the said Silvia. States further: that she, the Prisoner, stole three times with the said Silvia, and once, while she, the Prisoner, slept upstairs, it was done by Silvia alone. Article 6. Whether she did not do this in the company of her fellow slave Silvia. States: Yes, that she always stole together with Silvia, while she opened the desk and Silvia took the money out of it. Article 7. Which of them gave the first incentive thereto, to rob her master. States: that the maid Silvia always gave the incentive for it, and committed those thefts to buy both of them free; indeed, Silvia had already said so to her, the Prisoner, before the death of her late mistress. Article 8. Whether they did not for this purpose take the key to the desk from their master's trouser pocket and open it; and which of them did so. That he, prisoner and defendant, consequently received the money stolen by her and brought to him on three separate occasions, which, having occurred within the short time of about 10 days and amounting to a sum of 350 Rixdollars, ought reasonably to have brought the prisoner and defendant to other and better thoughts, yet had no other consequence for him than causing him to say to the female slave: take care that nothing comes of it. That the second prisoner and defendant, Anna van Bengalen, being the mother of the other female slave, named Silia, who was complicit in the thefts, belonging to the burgher Meijer, not only previously took from this daughter of hers a silver box and some other boxes, regarding which she did not know how she had come by them, but also allowed herself to be provided by the same, in 5 pieces of paper currency, with the sum of 100 Rixdollars, money of which a child of 12 years cannot possess herself other than in an illegitimate manner. That she, prisoner and defendant, furthermore handed this money over to the soldier Joh: Christiaan Pruijsman, who resided and kept house with her, who, upon the statement of the female slave Anna that the money belonged to her daughter Silia, replied: "that beast, however did she come by it," took the same into his custody, and concealed it in the chest. That all this, appearing in greater detail from the inquests obtained before commissioner gentlemen from this Council and the prisoners' and defendants' own free and conforming confessions, the Officer as Prosecutor, for the sake of brevity, will take the liberty to refer thereto, further noting that pursuant to the decree most favorably granted by Your Honorable Worships upon the respectful request made by the Officer as Prosecutor by virtue of the aforementioned circumstances, the same had both soldiers, Bernhard and Kruijpman, apprehended, and the last-mentioned Johan Christiaan Pruijsman having in the meantime passed away on the 29th of the past month of October, thus the further action against him here ceases. It will then only remain for the Officer as Prosecutor to examine with respect to the prisoners and defendants mentioned in the heading in what proportionate manner they ought to be punished in conformity with the laws, whereby the Officer as Prosecutor, subject to correction, believes he must consider that the prisoners and defendants, by having received and hidden money stolen by the aforementioned female slave, will have to be regarded as receivers of stolen goods and be subject to the ordinary punishment for the same, which, if they had knowledge that it was stolen, and thus knowingly and willingly concealed it, would be the same, or according to the doctrine of most authorities and rules of ordinary practice, slightly less than the punishment of the thieves themselves. And although it is not positively established that the prisoners and defendants are in this case and had knowledge thereof, such being directly denied by both the receivers and the thief, it having been pretended by the latter that they had earned the money in question, which would contribute not a little to their excuse, yet they must certainly have doubted and presumed that this money was not earned in a legitimate manner, which they indicate indirectly sufficiently enough, because the prisoner and defendant Bernhart, according to the confession of the female slave Sima, Article 16, said to her: "I will hide it, but take care that nothing comes of it," and the soldier Kruijpman expressed himself to the second prisoner and defendant according to No. 13 of her deposition regarding Silia: "the little beast, where did she get that," declaring her further in his responses under No. 41 to be a scoundrel. And what can be more natural than to conclude at first glance that a slave girl within the short time of fourteen days cannot earn 350 Rixdollars, besides what she will still have needed for her own use, the first defendant and prisoner having moreover known of the prohibition of her master that he was not allowed to have any interaction with this female slave, whose character will otherwise also have been well known to him, prisoner and defendant, from of old; just as the possibility regarding the earnings of the slave Silia as a child of 12 years can even less take place, so that these excuses can be regarded as nothing other than very empty and untenable pretexts, and the prisoners and defendants, on the contrary, themselves seem to have been well pleased with it, because the first of them, Bernhard, was promised shirts for his trouble, and the second, the female slave Anna, or her cohabitant, could make use of it, which he also did up to some 60 Rixdollars. Wherefore the Officer as Prosecutor, under Your Honorable Worships' better judgment, believes that the prisoners and defendants, according to the discretion of the judge in the matter, ought reasonably to be punished with an arbitrary punishment, by reason of which and other reasons and arguments, to be further deduced in due time if necessary, the Officer as Prosecutor, making his demand, concluded that by definitive sentence of Your Honorable Worships the aforementioned prisoners and defendants shall be condemned: the first of them, Jacob Bernhard, to remain banished to Robben Island for the period of three consecutive years; and the second prisoner and defendant, Anna van Bengalen, to be scourged by the kaffirs and sold, in such manner that she shall never again be allowed to return within the districts of this place, with condemnation in the costs and expenses of justice, or to such other penalties and punishments as Your Honorable Worships, according to the measure of their misdeeds, shall find in accordance with justice.

That it has appeared to the said petitioner, subject to Your Honors' better judgment, that both soldiers, Bernhard and Druijsman, are to be deemed punishable for having allowed the said female slaves entry to their quarters without the knowledge and will of their master and for maintaining a connection that goes against good order and the laws, but furthermore, by receiving, hiding, and concealing the aforesaid stolen monies, they are to be considered as fences and therefore as accomplices to the theft committed by these girls. That the said petitioner, since all kinds of disorders seem to be gaining the upper hand, and especially robbing and stealing seem to be becoming the fashion, believes, subject to correction, that these must be opposed with all possible rigor and appropriate means, and thus considers himself bound by virtue of his office to institute the necessary criminal proceedings against the aforesaid soldiers.
