118 129 the acting Honorable Gabriel Exter made known to the Council that his Honor, together with the secretary of this Council the Honorable Cornelis van Aerssen, in the absence of the sworn clerk who, pursuant to a resolution of the Honorable Worshipful Council of Justice, had been commissioned together with and alongside the Fiscal, had proceeded to the Westhoek beach of Baay Fals and there conducted a proper inspection of such goods as had been pillaged from the French private ship La Rozette, which had run aground there, and concealed by some detained persons. Therefore, his Honor delivered a pertinent list of those goods, and his Honor further requested to be informed by this Council how and in what manner he should conduct himself in this matter, all the more since the discovered goods were already found to be wet, and which, if taken under sequestration, would be exposed to spoilage. Deliberation having been held thereon, the following resolution was passed: The Council authorizes the secretary to hand over all those goods according to the inventory, as well as the goods that had already been discovered on the prisoners upon their capture, under proper receipt and record to the agent of His Most Christian Majesty, Mr. Percheron, so that his Honor may deal with them in such manner as he shall see fit. After which there appeared in the council the Landdrost of Stellenbosch and Drakensteyn, Mr. Hendrik Lodewyk Bletterman, who made known that the person of the burgher Erasmus Smith, who, pursuant to a resolution of the Honorable Worshipful Council of Justice sub poena confessi et convicti, was released from his detention and ordered to remain resident in the village or district of Stellenbosch and not to go elsewhere without the prior knowledge of him, the Landdrost, had not only intended to leave there, but also daily indulged to an excessive degree in drink; requesting therefore that the Honorable Worshipful Council might be pleased to decide whether the said Smit should not be permitted to take up residence here at the Cape or elsewhere, or otherwise to decide on this matter as their Honors might see fit. Deliberation having been held thereon, the following order was made: The Council persists in their resolution taken on 10 August of this year, and accordingly orders that the burgher Erasmus Smith must continue to remain on his purchased estate situated near Stellenbosch, in order to prevent all difficulties; therefore, by a letter on behalf of the Council, it will be very earnestly written to him, Smith, to moderate himself from drink in the future and to conduct himself properly. That the petitioner's husband having been condemned by Your Honourable Worships on the date of 10 August last, on account of a certain unfortunate step, besides a composition with the officer, to have to remain for six weeks on water and bread; the petitioner is also convinced in her conscience that her aforementioned husband, realizing with what grace Your Honourable Worships nevertheless wished to regard his unforeseen misstep, would also have patiently awaited the time that was determined for him by Your Honourable Worships; and that, however bitter that detention fell upon him, he nevertheless with deep remorse and heartfelt sorrow would have undergone in completeness that which Your Honourable Worships had decided concerning him; but since the petitioner's husband on account of indisposition finds himself at present in such a condition that he, by a longer stay in the aforesaid detention, would undoubtedly have to sacrifice his health or complete recovery without delay; thus the petitioner takes the liberty of turning to Your Honourable Worships with humble supplication that it may favourably please Your Honourable Worships to diminish the prefixed time of six weeks, and to release her aforementioned unfortunate husband from his painful detention, since he has now already been locked up in custody for four weeks and, in satisfaction of Your Honourable Worships' decision, would only have to remain there for two weeks; the petitioner being able to assure Your Honourable Worships on his behalf that he, always in gratitude and acknowledgment for that which Your Honourable Worships have been pleased to arrange in his favour, will attempt, as much as in him lies, to ensure that he lives in rest and peace with everyone, and never causes Your Honourable Worships the slightest displeasure concerning his conduct and life. And Mr. William Ferdinand van Reede van Oudshoorn requested his vote to be recorded in the following manner, that His Honor was of the opinion to adjudicate the demand of the Honorable Prosecutor regarding the first five prisoners as the verdict dictates, but regarding the sixth or last prisoner to be of the opinion that he, having been exposed to public view with a noose around his neck under the gallows, tied to a post, severely scourged with rods on the bare back, would subsequently be riveted into chains to labor therein for the period of ten consecutive years at Robben Island at the Honorable Company's public works without wages, and after the expiration of that period to remain banished forever from this country and its jurisdiction. Bletterman, Landdrost of Stellenbosch and Drakenstein. That on Thursday the 14th of the recently passed month of September, the burgher Carel Fredrik Paret having arrived at Stellenbosch, related at that time to the substitute Christiaan Godhelp Rudolphy: that he, Paret, on Monday the 4th aforesaid in the afternoon, having gone to the Berg River, which has its course about one hundred paces from his house, in order to fish with an angling rod, found not far from there one of his female slaves named Diana, who had gone to fetch water with a bucket for the household, whom he, Paret, is said to have ordered to scoop the water out of the boat, but that she refused this and mumbled under her breath, without him however having understood it. That he, Paret, having given the same female slave a couple of slaps for her unwillingness, she thereupon dealt him a push to the chest, from which he, stumbling, came to fall into the water. That he, Paret, having become angry and heated over this, picked up a piece of wood the thickness of an arm and dealt her a blow so that she fell to the ground. That it being immediately discovered by him, Paret, himself that this careless blow had caused her a fracture to the back of the head, that wound was bound up by him, and she came to die that evening from the received wound, without him, Paret, having been able to have the same girl inspected, wherefore he, Paret, had also had the body buried the Wednesday following. Yet that the nature of the crime in itself as well as the execution of the sentence to be pronounced in respect thereof requiring that the petitioner ought to secure the person of the aforesaid Paret, the situation of this colony in general, and of the residence of the aforesaid Paret, and that consequently there being two sufficient proofs at hand of both the perpetrator and the deed, the petitioner under respectful correction also deems that the same manslaughter thus committed by the aforesaid Paret ought to be punished in the most rigorous manner. That the petitioner, in order not to expose the account given by him, Paret, to the substitute Rudolphi to any wrong interpretation, nor that he could afterward retract his own account, had him, Paret, informed by the same Rudolphi to pass a record thereof at the secretariat, just as he then also did, as well as that the burgher David Beyer, living with him, on the 18th thereafter also passed a declaration concerning this, in conformity with the contents of the record granted by the aforesaid Paret, only with this difference: that he, Beyer, having ridden to the field-cornet Jan Blignault, P. son, to request him to inspect the dead body, having been able to reach neither him nor the burgher Jan Blignault the Younger, the aforementioned Paret had become forced to bury the body on the aforementioned Wednesday; just as your Honours will be able to perceive in further detail from both documents annexed hereto. That in particular as well as the circumstances of the case however making such a decree almost unexecutable, the petitioner considered it most suitable to have to request from your Honours that the aforesaid Paret might be summoned in person. The prosecutor ex officio, before making his claim, requests that the defendant in person may be ordered to answer such interrogatories as the said prosecutor ex officio shall put to him, the defendant, in the presence of the Commissioner Members of this court. The defendant requests by petition that this case may be declared civil and composable. The prosecutor ex officio leaves this to the court's judgment. 162 163 The Fiscal served the following representation: To the Honorable President and the further Honorable Council of Justice of this government. Honorable Sirs: Gabriel Exter, the interim Fiscal, shows with due respect: That the Honorable Governor and the Honorable Council of Policy, by resolution of the 1st of this month of November, having been pleased to place into the hands of the petitioner such persons who, although not fully convicted, nevertheless lie under strong suspicion of having taken part in the conspiracy of certain eleven criminals—who, on account of an intended undertaking to make themselves master of the Honorable Company's chartered private ship de Jonge Frank (presently lying here again on its departure) and its cargo by killing the officers and the other crew members, were executed on the spot by the said officers—and have been brought over here; Meanwhile, upon investigation, both from certain circumstances and from the depositions submitted to this end, it has appeared to the petitioner in his official capacity that the Commander of the soldiers on board that vessel, Casimier Lemper, not only seems by his conduct to have given much cause and occasion for the mutiny committed on the aforementioned vessel, or the insolent demanding and withholding of the instructions and more rations than otherwise, but that he, Lemper, also had prior knowledge of the daring undertaking that followed thereupon, without having made the slightest disclosure thereof to the Captain, nor, in performance of his indispensable duty, having suppressed and opposed the beginnings thereof among his soldiers. The petitioner in his official capacity therefore sees himself placed under the unavoidable necessity of having to act ex officio against the said Commander Lemper. However, since the authorization of this Honorable Council is required to institute the necessary proceedings in a criminal case, the petitioner has deemed it most advisable to turn to your Honors with the respectful request that it may please your Honors to grant the petitioner their decree whereby he is qualified to hear the person of the said Casimier Lemper before commissioner gentlemen upon such articles as shall be put to him by the petitioner in his official capacity, with authorization to the said commissioner gentlemen to have the said Lemper apprehended as the circumstances may warrant; or that your Honors may be pleased to make such other disposition as your Honors shall judge proper.
