396 Butchers Willem van Reenen, all contracted butchers in this matter. Giving to know, with the required respect and proper submission in the humblest manner, how they, petitioners, as is already known, have undertaken for five consecutive years to deliver fresh meat, live cattle, ox hides, and so forth, to the Honourable Company's passing ships, Hospital, Slave Lodge, etc., to which lease the petitioners could only be encouraged by having the freedom—to the exclusion of the private burgher butcheries—to be permitted to deliver the required fresh and salted meat, live cattle, hides, and whatever pertains to the butcheries, which must constitute the petitioners' sole source of subsistence, and without which they are never capable of undertaking for the Honourable Company for the mediocre or rather low stipulated price, save at a heavy loss for the petitioners; which also for more than eighty years past has taken place as a free branch for the contractors among the Honourable Company's butchers. That also, since the time the butchering for the Honourable Company was undertaken by the petitioners, few foreign ships have arrived here, whereby the petitioners have had no market at all for the extra amount of their slaughtered cattle and the surplus tail fat and skins which could not be retailed to the Honourable Company except to foreign passing ships; they have been forced to dry the hides, to salt the fat and preserve it in casks, this having frequently been exposed to decay and been thrown away, to the loss of the petitioners, all the more because it could not be retailed among the inhabitants, and they have been left with these articles. 397 To which has also been added that your Right Honourable and Honourable Worships have disposed to prevent the export of hard fat, tail fat, and tallow. Furthermore, it is to be noted here that the petitioners with the repatriated honourable Secunde Pieter Hacker, when the price of the raw kidney fat was at twenty Rixdollars per 100 lb, but through the aforementioned ban on export the aforementioned tail fat having considerably fallen in prices, except that the petitioners have been permitted to deliver the kidney fat that was sent to the Indies by the Honourable Company melted down for 12 Rixdollars. Thus, the petitioners have suffered considerable loss through one thing and another. To which has also been added that cattle since their undertaking have considerably risen in prices, so that the purchase price is about fifty percent higher, although the Company has always been accommodated with raw hides, both for passing ships of the Honourable Company and the Honourable Company's stable, at the accepted price; nay, what is more, they have enjoyed drawing them for candles for the Garrison here and the Hospital in False Bay, which the petitioners, pursuant to their undertaking, were in no way obliged to do either for the Garrison or the hospital; yet, having taken everything into consideration, they have delivered them. The petitioners finding themselves so aggrieved by one thing and another, they defer; at the same time also that one of the petitioners had a delivery a few weeks ago of dried ox hides to a foreign ship lying here in the roads, which, however, until delivery was prevented and detained by the Fiscal pro interim, they defer, 398 are forced to take their refuge in the fatherly protection of your Right Honourable Sir the Governor and Honourable Worships, and trust that the submitted grievances of the petitioners will have such influence on the hearts of your Right Honourable and Honourable Worships, that it may please you to maintain the petitioners in their reasonable grievances—while the petitioners are well aware that neither with the Honourable Company nor with the inhabitants here does any shortage of the aforementioned articles belonging to the butchery exist, and no one, whoever he may be, can bring any testimony that, having sent to the petitioners for one thing or another, could not be accommodated—so that, in accordance with their undertaking and the stipulations made therein, they may and shall be permitted freely to trade their surplus of such articles as the butchery of the Honourable Company will come to produce, unhindered, to the ships of their own as well as of foreign nations passing and arriving here in the roads, provided that all private slaughterhouses remain excluded therefrom. However, should your Right Honourable and Honourable Worships unexpectedly not be able to dispose favorably upon the request of the petitioners, the petitioners will then be compelled and obliged, in order to prevent their ruin, by further request to your Right Honourable and Honourable Worships, to relieve them of their undertaking made with the Honourable Company; or else to devise such other means as your Right Honourable and Honourable Worships, after your highly wise deliberations, shall find necessary and proper for the maintenance of the petitioners. 399 shall be placed, of which likewise a copy shall be given to the said Commissioners. The Honorable Head Administrator qualified for the purchase of some gunpowder from Mr. Schuler. for myself as well as for my partner W:m van Reenen, in the margin, Cape of Good Hope, the 5th of November 1703, it was, after deliberation, judged that besides the considerations raised in that regard, granting the request made by the petitioners might furthermore also present difficulties with respect to other privileged butchers in particular, or all the inhabitants in general, and therefore it was approved first to demand the report and considerations of the Commissioners from the Council of Justice, as well as whether and to what extent, without prejudice or injury to the other inhabitants, that request could be granted; for which purpose a copy of the said petition, along with an extract of these, shall be placed into the hands of the aforementioned Commissioners. Mr. Schuler, as the owner of the French packet boat d'Auguste present here, having offered to sell the government a quantity of 8000 lb of gunpowder at 12 stuijvers per pound, it was unanimously approved, upon the proposal of the Governor on account of the scarce supply of it that is currently still on hand, to qualify the Head Administrator Johannes Isaac Rhenius to purchase the said quantity on behalf of the Company at the said price, if it is found upon examination to be of good quality, with the exception however of anything among it that might be spoiled, in order that, if the High and Mighty Lords Majores should be of the opinion that this should not have been entered 400 into, or if later an ample and sufficient supply should arrive, to permit the aforementioned gunpowder to be sold again in moderate portions and with a good profit for the Honorable Company to the inhabitants in the country, to serve to relieve the shortage regarding this that prevails among them. There was delivered by the Secunde, Johannes Isaac Rhenius, as President of the Council of Justice, the following memorial and two annexed enclosures, reading: To the Right Honorable and Respected Sir, Cornelis Jacob van de Graaf, Governor and Director of the Cape of Good Hope and its dependencies, together with the Honorable Political Council of this government. Right Honorable and Respected Sir and Honorable Sirs! The undersigned President and Members of the Council of Justice here take the liberty to represent with all respect: That on the occasion of the sentence recently pronounced here against the former burgher Jan Smit of Dilburg, it was at that time also discussed among the memorialists how his estate ought to be handled, which, upon the granting of the bodily apprehension of the said Smit, was immediately, according to the custom here, noted down and sealed by commissioners from the Council in the presence of the Fiscal pro interim; and whether the memorialists consequently were authorized and obliged to undertake the settlement of the estate of the said Smit. That on this point the opinions of the memorialists varied greatly; while the first signatory, as President, put forward that not only from all ancient times, as evidenced by the so numerous examples available at the Secretariat of Justice, but even in the very recent case of Valentijn van Papoer, who was banished to Robben Island and who, just as the presently sentenced Smit, left behind a wife here, it always, and without anyone's contradiction, seems to have been a constant custom that the property of those persons who had undergone a corporal punishment, whether of banishment or otherwise, was undertaken for settlement by the memorialists after a proper inventory, and furthermore was administered by their sequester in the presence of two members from their assembly; indeed, that even the High Government of the Indies, in an extract of a resolution dated the 6th of March 1753, annexed hereto under letter A, had indicated indirectly the firm assumption under which Their High Honors labored, that always and in all cases the property of delinquents prosecuted before this court was noted down and undertaken for settlement by the memorialists; and in this regard, the passage in the said missive must primarily be taken into consideration: "notwithstanding

seeing that it was consistent with equity that the judge who has disposition over a criminal prisoner should likewise be entitled to the disposition over his seized assets, wherein their High Honours seemed to declare this their stance in plain words; That furthermore, according to the sentiment of the president, this custom has been observed without any interruption up to the present date, notwithstanding that in the year 1778 the confiscation of property was abolished, without it appearing, however, that with this abolition the courts of justice were deprived of the liquidation and administration of the property of their delinquents, and thus it seemed to be established therefrom that this has remained on the old footing, since in this country no alteration whatsoever in that regard has taken place; in proof of which the president cited the cases of Jan Hendrik Pirman, of Jan Willem Ruhl, of Hermanus Bos, and Jan Jurgen Meijer, of Valentijn van Dapoer, all of whom existed after the abolition of confiscation, without it appearing, however, that those estates were accepted on grounds of insolvency, as there were even funds remaining in those of Pirman, Ruhl, and Meijer; while the president was furthermore of the opinion that an ancient custom, having been changed into a law by length of time, could not be so easily altered or entirely abolished, so long as no notable incongruities were discovered therein, which, after all, could not be said to reside in this custom, considering that the liquidation of the estate by a body such as that of the Council of Justice here, in the present case, seemed much more fitting than that such an estate should be entrusted into the hands of private persons, to which the president also added that a judicial liquidation, as it had always taken place here, proved to be much less costly for an estate than if it were administered by private individuals, and consequently was of the opinion that the estate of Smit ought absolutely to be accepted by the petitioners; That against this, the majority opinion was that, notwithstanding the aforementioned Smit was confined to Robben Island by the aforementioned sentence and, in addition, declared infamous, one could nevertheless not deprive him of the power to appoint the same private proxies for the administration of his estate, and that notwithstanding this, the petitioners for the present acquiesced in and agreed to the recording of the property of the said Smit, although they called into serious question whether this recording of property of a community estate between Smit and his wife, whereby according to their stance that community was encumbered, and the free disposition and administration of their property was taken away from those persons, ought properly to take place, and that on this foundation: That by the ordinance on the matter of Criminal Justice in the Netherlands of the year 1570, it is established in article 30: that after due inquiry, the delinquent being taken into custody or summoned to appear in person, as the matter may be disposed to be and according to the quality of the accused, at the same time the property shall be noted, recorded, and taken in hand, in case confiscation is imposed, whether according to the tenor of the edicts or otherwise by common law, etc.; That likewise the subsequent ordinance concerning the general style of proceeding in criminal cases of that same year 1570, after having prescribed in several preceding articles when and in which cases a criminal apprehension can and ought to take place, finally dictates clearly in article 5: that whenever the crime or the misdeed shall be such that, according to the written laws and customs of the places or our aforementioned ordinance, confiscation of property attaches to or ensues from it, we ordain that upon apprehension of persons or decree of apprehension and bodily seizure (which decree must also contain an order of seizure and noting of property), the officer and the magistrates shall immediately and at the same time carry out the aforementioned noting and seizure of property; That since it now clearly appeared from the cited articles of the ordinances that the noting of property is strictly and thus clearly determined in such cases where the misdeed entails confiscation of property, without there appearing in the preceding nor in the following articles the slightest thing from which it could be concluded that in all occurring cases, without any exception or limitation, the noting of the delinquent's property would have to accompany bodily apprehension; And that no other law or ordinance, neither general nor local, was found that prescribes to the judge whether, upon a bodily apprehension, the noting and seizure of the delinquent's property must absolutely take place.

that this law is lacking and the aforesaid Ordinance could and should therefore solely serve as a rule and guideline in similar criminal trials and decrees of bodily apprehension, from which it thus appeared most clearly to be the intention of the legislator that no recording of the goods of a delinquent can take place unless the crime is of such a nature that one can proceed to the confiscation of goods, and that therefore by notorious consequence, if no confiscation of goods existed, the recording thereof also cannot follow; that this having been firmly established, and the placard of their High Mightinesses of 10 August 1748 having been accepted therewith, introduced in all lands and places of their jurisdiction, whereby the confiscation of goods in all crimes, both great and small, none excepted, is abolished, passed, and that the majority therefore was not inclined, while the minority had also joined the side of the president, the proceedings were further annulled, from which grounds the majority then maintained that the recording of the goods of persons against whom bodily apprehension has been granted, without any exception and unlimited, as in this case of Smit, was solely based on an introduced and accepted custom locally which seemed justified only by habit without the authority of a law, the more so because the examples thereof show that in some cases the recording of goods had occurred and in similar cases again not, as in the case of Carel Buitendag and Daniel Vermei. That, all these considerations still having been brought forward, the majority nevertheless continued to refer to the steps they had taken; wherefore the President further proposed to the memorialists how in the year 1762, likewise between the Council of Justice and the Orphan Chamber, a dispute having arisen over the estate of a certain Michiel Swaan, the same was deferred for decision to the Honorable, Highly Esteemed Governor and Honorable Political Council, at which time that estate was also left to the Council of Justice for settlement without the same nevertheless having been found to be insolvent, and among other things it was resolved thereon on the 12th of October 1782, "that in order to prevent all disputes that upon the recurrence of similar cases might occur again; it is understood that whenever henceforth someone comes to decease who, by the commission of any criminal offence, has made his person subject to the court, his estate shall then also be administered by the Council of Justice," from which resolution the President believed he could not only demonstrate that differences of this nature ought to be decided by the government, but also argue that, it having thus been enacted that the estate of someone who had merely made himself suspect to the court, without there being mention of prior incarceration, much less condemnation, must be accepted by the Council of Justice; with so much the more reason the estate of Smit van Dilburg now in question ought to be administered by the memorialists, since among other things there is still actually found in the same a sum of One Thousand guilders, of which he fraudulently took possession from the late honorable Captain Jan de Waal and out of which this latter action against him arose; but nevertheless, in order to follow in every part the customary procedure, he submitted to the memorialists for consideration whether it would not be best to submit this matter now again to Your Honorable, Highly Esteemed Council for the purpose of a decision, to which the memorialists unanimously assented. That notwithstanding the rebuilding and repair done there and stated in that report, after having left the same harbor again, the heavy leak newly discovered on the ship as well as the continuous storms and contrary winds on the Reef of Agulhas in the worst season of the year, to which was added scurvy among the crew, scarcity of provisions, and the resulting despondency of the people, were concurrent reasons and circumstances by which the said officers found themselves once again compelled to put into the bay of Rio de la Goa. However, having declared that he had no right to enter into a further agreement from here, but only considered it his obligation to obey the orders of this government, in so far as his vessel should be made use of for a return cargo in the service of the Honorable Company as charterer thereof, and the determination of the freight charges was then to be left to a further agreement between the Company and his said principals. Whereupon, taking all this into consideration, it being further judged that, whatever further agreement between the Company and the owners regarding the freight charges might succeed, in any case no further claim could be made on that account than for the entire outbound and homeward voyage to and from Batavia (although it is to be trusted that the owners of the aforementioned ship De Vreede will yield in this matter to the satisfaction of the Most Noble, Highly Esteemed Gentlemen Directors), and that it would also then be even more in accordance with the Company's interest to see that cargo home a year earlier, rather than to be deprived of it so much longer and meanwhile have to fear or expect various damages and spoilage thereof. Thus it was judged unavoidably necessary, and therefore unanimously resolved, to designate the repeatedly mentioned chartered ship De Vreede, as being of sufficient size for this purpose, to take in the entire cargo of the abovementioned ship De Paarl and to let the same return therewith for the Chamber of Amsterdam, whither that cargo is destined according to the invoices. Whereby it was approved to have the quantity of Bourbon coffee beans purchased here from the French ship Le Auguste laden at the same time into that vessel. As it was also agreed to demand from the officers of the said vessel De Paarl an extensive written report and account of everything that occurred and was performed by them, both in relation to the ship and to the cargo, on their journey hither from Ceylon, with the addition of the accounts of the expenses incurred and sales made or use made of the spoiled part of the cargo on the island of Mauritius and Rio de la Goa, in order that, after the said report shall have been sworn by them before commissioners from the Council of Justice, a copy of the same may be sent to the High Commanding Gentlemen Masters, or that such further decisions may be made in that interest as circumstances shall come to require. By Mr. Jacobus Johannes Le Sueur, as president of the Orphan Chamber, having been made known how it had occurred repeatedly at the said chamber that, in the transfer of real estate, such real estate had remained under the encumbrance that had been placed upon it by the previous debtors, without one being able to know for certain whether the successors in the possession thereof had knowledge of this, or, as was most probable, had relied on the trust that the seller and conveyor of that property had seen to discharging the same from the mortgage established upon it; with the request that, in order to prevent the troublesome lawsuits which could arise from this to the great detriment of widows and orphans, such regulations might be made as this Council should find appropriate.

Ships arriving here in the Roads, as with the residents sustaining themselves by fishing, according to representations made to their Commissioners, might be permitted that the toll boats, as previously, might have the freedom to arrive in the Roggebaai and alongside the jetty, as well as that one might also, as formerly, be allowed to fish at their own discretion both in the Rogge and in the other small bays near and around the batteries by day and by night. And regarding the first part of that request, it being considered that the arrival and departure of the toll boats, as well as other small craft, from the Roggebaai or otherwise than to and from the jetty was primarily prevented solely out of concern for desertion, for which much opportunity was taken hereby, but that when such happens in sight and within reach of the guard of the jetty itself, desertion with all such craft can be prevented; wherefore it is also understood to permit that the toll boats of the residents, besides from and to the jetty, shall also be allowed to depart and arrive between the said jetty and the outlet of the canal coming down past the Company's slaughterhouse, provided they adhere strictly to this limitation. 126 Tuesday the 11th of December 1781, in the forenoon, all present. From the very respected missive of the Right Honourable Gentlemen Seventeen dated 20 June of this year, received with the ship Leyden, it has appeared that their High Honours have been pleased to disapprove the appointments of Captain van Bonstetten to Major-General, Captain de Lille to Major, and Captain-Lieutenant or presently Captain Bleumer to Town Major, as well as Hendrik Willem Rutz to Clerk of the Magazines. It was thus understood that in dutiful compliance therewith, the said offices shall remain discontinued, and that thereby the emoluments enjoyed by the first three mentioned as such, and the monthly salary of 50 Rds. assigned to the last mentioned in the capacity of Clerk of the Magazines, shall henceforth no longer proceed. In this regard, it was made known by the Honourable Governor that his Honour had too high a sense of his bounden duty of obedience to the will and orders of the High Commanding Lords and Masters for his Honour to have balanced for a single moment to observe this duty also regarding the aforementioned disapproved appointments. Thus, however much his Honour as well as the head of the militia remained convinced within themselves of the necessity of the aforementioned posts for a regular garrison service, while also the lack of a Clerk of the Magazines cannot cause other than the greatest confusion in the artillery establishment, as has previously taken place, no further considerations would nevertheless have occurred to his Honour to take a single step that could have the least appearance of conflicting with the aforementioned duty. However, since partly through an irregularity in the garrison service, and partly through confusion in the artillery and ammunition of war, in a precarious juncture which makes it entirely uncertain whether, through a sudden rupture with which, by the movements of foreign powers from Europe according to the latest news, our republic seems to be threatened, a hostile force could arrive at this place within a few days, his Honour could never justify himself to the High Lords Masters for having failed in a duty which weighed upon his Honour's conscience with no less gravity than that of obedience, namely this: in such precarious circumstances that have arisen after the date of their High Honours' letter, which their said High Honours themselves very easily could not have expected or foreseen at the time, to watch with all possible diligence over the defense of this place; and because nothing can serve more to render the defense establishment here powerless than disorders in the military service and confusion in the artillery and ammunition of war, which would nevertheless swiftly follow if the aforementioned functions were now suddenly to cease again; His Honour had therefore judged it most advisable to let the aforementioned three officers, van Bonstetten, Bleumer, and Rutz, alongside the ordinary service which they as Captains under the garrison, as well as Lieutenant of artillery respectively, had to perform, also continue to function at the same time without any extraordinary compensation, the first as Major-General, the second as Town Major, and the last as Clerk of the Magazines. And since, moreover, from an attached list of necessities enclosed by the said Landdrost with his aforementioned letter, it has been observed that among these is included an increase of the ordinary number of five mounted orderlies to six, and of seven Caffres to twelve, without the Landdrost having stated the reasons for the alleged necessity thereof, whereas on the contrary it must be assumed that now, since the district of the aforementioned Drostdy finds itself much less extensive than previously due to the establishment of the magistracy of Graaff-Reinet, the usual number of mounted orderlies and Caffres there can now suffice much sooner than before, it has been approved for the present not to accede to this increase without further proof of absolute necessity. Nevertheless, the said Landdrost shall be relieved of the orderly reported as unfit in exchange for another; and the said unfit mounted orderly may, under the terms applicable thereto, submit a request to obtain his discharge, or otherwise must await to be dealt with according to the orders of the Hon. And whereas not only complaints have arisen, but it has also been actively experienced upon the renewal of the aforementioned orders, how many people with little scruple, besides the ungodly spending of the day of the Lord, moreover in many kinds of impermissible manners in contempt of the established edicts and ordinances profane and desecrate these and other days consecrated to public worship, so it has been found good, in order to provide against this, to draw together, renew, and amplify the orders and interdictions established against it, and thereby to enact anew: That no one, of these and subsequent residents without distinction, and under whatever pretext it might be, shall be permitted on Sundays or other holy days in public or outdoors to work at any manual or domestic labor, or to have such done by others, nor above all to permit any carpentering, masonry, building, or whatever similar labor it may be, on pain of being caught therein, of forfeiting each time a sum of fifty Rds to be distributed accordingly; Nor shall it be permitted on the said days for any wares to be carried about the streets for sale by slaves or others, which likewise must then be observed regarding foodstuffs for as long as the church service lasts; all this upon confiscation of that which is thus carried about for sale. Subsequently brought again to the table and taken into further consideration the representation submitted by the Council of Justice at the session of the 27th of November last, upon which the decision had remained postponed at that time, it was noted regarding the dispute set forth therein that no law within the jurisdiction of the Generality or of the Company is at present available by virtue of which one can act to deprive someone who holds full ownership of his goods, when he is convicted as a criminal, of such ownership and the exercise thereof; but on the contrary, in the present case, one of the principal reasons that caused the confiscation of goods to be abolished and repealed in the colonies of the Generality by the edict of the year 1778 must serve as a fixed rule of law, namely this: that the wife, children, or nearest kin of the delinquent, although themselves innocent, should not share in the punishment inflicted upon such delinquent. 437 nor that a judicial administration can extend further and deprive the delinquent of the ability to dispose of it according to his pleasure for as long as such a person finds himself capable of doing so, or else that he wishes to authorize another, or that someone can be legally admitted to intervene for him: and the judge, occupying the chief guardianship, does not find himself otherwise obliged upon the absolute decease, or absence, of someone who, through some criminal offense, has subjected his person to the court, and has himself left or established no disposition or care over his property, under the terms of the resolution of this council dated 12 October 1762, or else in case of notorious insolvency, either to exercise supervision and administration himself over the property for the benefit of the one who has right thereto, or else to authorize others for that purpose. That furthermore the alleged grounds and reasons for which the minority of the said Council of Justice judged it necessary that the joint estate of the said Smit and his wife ought to be judicially sold and administered, do not diminish the hardship which, contrary to laws and rights and thus extending further than the sentence of the said Council itself, would be imposed both upon the said Smit and upon his wife, since it can bring no favor to anyone to force upon him an assurance regarding the administration of his property not being impaired, by liquidating or 438 administering his estate against his will and pleasure and afterwards providing him with the proceeds thereof. will be written to the Colonel Commandant of that Regiment that preparations must be made to replace that of Luxemburg, concerning which, by the postscript of the aforementioned letter from the said Gentlemen Directors of the Chamber of Zeeland, order has been given that if, upon the arrival of the aforementioned and other ships at this government, it should be found that the troops of Meuron cannot all be transported with them, the same should nevertheless be sent as quickly as possible to the government of Ceylon with those men who can be accommodated thereon; it has thus been approved, since the ship Josephus de Smeede is now already completely caulked and the means serving that purpose are also being applied to the other two ships, the Drie Gebroeders and the Vrouwe Johanna, to instruct the Colonel Commandant of the aforementioned Regiment of Meuron in writing, under date of 21 June last, to conform to the order issued by the High and Mighty Lords Majores, and consequently to cause the necessary measures and preparations depending on him to be made, in order to embark as soon as possible upon the three aforementioned ships already present here such a portion of the said regiment as can conveniently be conveyed with the same to Ceylon, and then also to follow thither with the expected ship 'T Fortuin with as many men of the same Regiment as the space in that vessel will permit. Furthermore, having read the petition presented by the Captain Lieutenant of the military here, Bernhard van Baalen, tending to obtain permission to depart thither for the purpose of attending to his minor children residing in the mother country and other pressing family affairs, and for that end to be allowed to take passage on the country's warship De Princes Louisa or else on the chartered private ship the Jonge Jacob, as well as furthermore to obtain recommendations to the High and Mighty Lords Majores, so that if the petitioner, after the completion of his affairs, should be inclined to return to this region, the Gentlemen may be most respectfully requested to allow him to return hither in his capacity, if the High and Mighty Lords Masters should be pleased to favor him with the aforementioned capacity in the service of the Honorable Company; it has thus been approved to permit the said Van Baalen to depart for the mother country with suspension of his salary for the aforementioned purpose, but, his passage on the country's warship being entirely illicit, to allow him instead to undertake the said voyage with the ship the Jonge Jacob, provided he conforms to the charter party entered into by the Company with the shipowners of that vessel, and the further request made by him will be favorably submitted to the Lords Masters. Gentlemen, The droughts that have prevailed this year at Isle de Bourbon have entirely ruined our wheat crops, so that we find ourselves in the same circumstances in which you were in 1786, and we are reduced to making the same request to you that you made to us by your letter of 14 May of that year, and to supporting it with the same reasons. We therefore charge Mr. Troublet with confidence to make the request to you for a relief of 600 thousand of wheat, or to favor the attempts he will make with private individuals to procure the same quantity. Likewise observed to take out goods from the ships only in case of extreme necessity. All efforts shall be made so that the recruitment of the military shall answer to the intended purpose. Regarding the table money for the Gentlemen Captains of the country's ships, the highest order shall be dutifully followed. Wednesday the 19th December 1790, in the forenoon, all present. Having taken into consideration the most esteemed letters of the High Indian Government of the 1st October last, received with the chartered ship de Jonge Jacob, it is, upon the notifications made therein under the following main sections, resolved: To reconsider the general report of matters, and letters containing the general report of matters of this Government, in accordance with the desire of Their High Excellencies, besides the arrangement by paragraphs, to also provide them in future with marginals. Concerning ships and vessels, under which matter in the first place appears Their High Excellencies' pleasure, we shall also not fail to employ all efforts so that the recruitment of the military from the outgoing ships, taking place according to the order established by the High Commanding Lords Masters, comes to answer the purpose intended therewith. Their High Excellencies will furthermore be most respectfully thanked, both for the renewal and extension of the edict issued against the conveyance hither of Eastern male slaves, and for the devised order and signals with respect to the return ships within which smallpox might come to prevail on the way here, or if anyone should still be found suffering from this disease. the considerations of this council regarding the lesser collection of grains were found not convincing and well-founded enough, and therefore it was recommended that burgher officers etc. be appointed, which body was constituted in such a manner that one could expect from it an equal promotion of the interests of the burgher inhabitants as well as of the Company's servants, as their obligations also extend thereto: so that the employing of burgher officers or other knowledgeable burghers in such a case might much rather have caused a mistrust of this Government towards that Board to be assumed, for which however no reason had appeared, since even now in retrospect it was found that no better measures than those put into effect could have been devised for relief. And now having deliberated further on this, as well as having considered the above-mentioned authorization of Their High Mightinesses, in order to temporize for the present with the intended commission in the event of meeting the difficulties suggested by Their High Mightinesses, it was taken into consideration on that account: That since one must now be assured of an unusually favorable grain harvest, and that in order to be able to apply the necessary means and measures in time to provide for the Indies, notices have been posted so that, as much as possible before mid-January next, a declaration may be made by the inhabitants of the wheat they are inclined to deliver to the Company. That also the grain farming around Mosselbaaij, according to the information obtained thereof, having been pursued with greater effort, a considerable quantity of wheat may likewise be obtained from there in the coming year. That thus from all this it may be hoped and expected that the dearness of provisions, which has prevailed for some time, both to the oppression of the inhabitants and to the great grievance of the Honorable Company, will finally come to an end. That one also hopes thereby to be placed in a position to lay up a year in store for the Honorable Company in its magazines. Yet, this not precluding it, circumstances will then better show whether the employment of the aforesaid commission will be serviceable and proper. That such a commission would be disadvantageous.

would be disadvantageous to achieve the aforementioned objective, because if, as one must certainly expect, it merely resulted in a demand for an increase in the price, and one were not immediately to proceed to this increase, as this could not occur without the qualification of the High Indian Government, the corn farmers might use this as a pretext to halt delivery to the Honourable Company, or might take occasion from it to make the condition that for the corn being delivered, the price must be paid which one presents being able to demonstrate that it must necessarily be set at that rate, which under the present circumstances of the times can cause trouble if one should deem it proper herein. And that through the present decline of the horned cattle, compared to the height to which the price thereof had risen only recently in the past year, as well as from the measures taken in hand so that the livestock required among other things also predominantly for agriculture may not be slaughtered, to avoid the murmuring which would arise about this among those inhabitants against the government; whereas on the contrary, by granting such, one would have to fear the same from the other inhabitants, who, expecting an end to the high cost of foodstuffs from the present propitious harvest, and being disappointed therein in such a manner, would point to this Government as the cause of this disappointment, as a time that was the least suitable of all to have caused such through the said Commission. It being thought best for the present not to allow the aforementioned Commission to proceed yet. Their High Nobilities shall also be informed in what manner the freight monies for the collection of the wheat from the Mossel Bay have been regulated, it being expected that bringing timber at reasonable prices from Plettenberg Bay hither will in the future increasingly alleviate the heavy costs for agriculture that have increased for some years, just as, these means being brought thereto, the inhabitants will have no further reasons to pursue an increase in the price of the wheat, since from the agreement with the inhabitants it has appeared that the cultivation of grain, in the worst dearness of the requisites needed thereto, was undertaken and continued there, with the satisfaction of 12 rixdollars for the 10 mudden of wheat, when such may remain over to them at the regulation of the annual price by Commissioners from the Council of Justice after deduction of the tenth for the duties and another tenth for the freight and risk of the sea. Wherefore for all these reasons, and for which it is also unanimously thought best for the present not to let the aforementioned Commission have any progress, but to leave the same postponed until a change of times and circumstances can make one hope and expect a better success therefrom. Regarding the freight monies which have been regulated with the inhabitants there for the collection of the wheat from Mossel Bay, their High Nobilities will be most submissively informed that the Sea Captain and former Equipment Master Francois Duminy, together with the burgher Lieutenant Johannes Gijsbert van Reenen and the shopkeeper Egbertus Bergh, having been commissioned to enter, among other things, with the inhabitants around the said Mossel Bay, on the basis of the proposals made by them for this purpose, into a final agreement to deliver their harvestable grains to the Honourable Company in the aforesaid Bay, in order to be collected from there by ships or vessels at the suitable times of the year, under deduction of a tenth for the Company's duty and another equal tenth for the freight and risk of the sea, yet so that whenever the price that should be regulated annually thereto according to the order of the Lords Majors by Commissioners from the Council of Justice, through such deduction should yield less than 18 rixdollars for the 10 mudden, that deduction should then take place no further than to leave this aforementioned price; and which condition the said inhabitants having accepted, consequently the agreement with them has been brought about on this footing and has received its full conclusion.
