Appeared before us, the undersigned commissioners from the Honorable Court of Justice of this Government aforesaid, soldier Coenraad Benge, who, having this his preceding interrogation read out to him word for word, clearly and distinctly, declared to persist and abide thereby, desiring that nothing more be added to or taken from it. Thus Coenraad Ringe of Bremen, aged 25 years, soldier under the battalion stationed at this Castle, currently the lord's prisoner, has voluntarily confessed, and it has become evident to the Honorable Court of Justice of this Government: That the prisoner, after having previously made acquaintance with some English sailors, went on Sunday 5 August of this year with several of the same, whom he, the prisoner, had met in the street, to the inn The Blue Anchor, and having drunk a bottle of wine there, which was paid for by the said prisoner himself, upon the asking of the aforesaid sailors whether he, the prisoner, did not fancy going along, consented thereto, so that he, the prisoner, went with one of those sailors to the yard of the aforesaid inn and exchanged the uniform he was wearing for a sailor's garment, with the intention, having thus disguised himself, to be able to escape more easily to the English ship lying in the roads, in which the prisoner had also succeeded so far until, in passing by on the jetty, he was recognized by the sergeant of the guard and taken into custody.

However, whereas such willful and intentional desertion in a Land where law and justice are properly maintained cannot in any way be tolerated, but on the contrary ought to be punished as an example and deterrent to other disloyal subjects, so it is that the Honorable Council of Justice aforesaid, serving on this day, having emphatically read and considered the written criminal claim and conclusion made and taken by and on behalf of the Fiscal pro interim, the Honorable Gabriel Exter, on and against the prisoner, as well as having attended to all that served the matter and could move Their Honors, administering justice in the Name and on behalf of the High and Mighty Lords States General of the United Netherlands, condemns the defendant Coenraad Ringe, as Their Honors condemn him by these presents, to be taken to the place where criminal sentences are customarily executed here, there being delivered to the executioner, bound to a post, with a board, severely scourged on the bare back, to be confined for the period of ten consecutive years to Robben Island in order to work there on the Honorable Company's public works, with condemnation in all the costs and expenses of justice. 20 to which the woman had replied by saying, I would gladly engage in it, but I cannot bring myself to it, and also I am afraid for the child, 21 that on another occasion, when the defendant noticed that his wife suspected him, he said to her, 22 if you disclose that I am having relations with the wife of Adam Beneke, then I shall treat you in such a way that the heathens will take an example from you, and then I will see to it that I get away, 23 while he, the defendant, further forced his wife to take an oath of secrecy, 24 that subsequently, on a certain day when the defendant came home from Graaff-Reinet, 25 in the broad daylight he went into the room of the frequently mentioned Rijneke, while the defendant placed his wife by the door on watch, with this material addition: 26 that she should take care that no one entered the room, and especially not the wife of his brother-in-law Lombaard, who was also present at that place, 27 that, according to the declaration of the citizen Johs Holtshausen, the wife of the aforementioned Reneke, having recounted all the foregoing to him in like manner, 28 had further added thereto 29 that the defendant on a certain day had told her in substance: 30 I cannot bear that Adam, denoting thereby her husband, goes to lie with you; I could easily get up from my bed and stab him to death in his sleep, 31 and other statements besides, as more fully appears from the aforementioned deposition as well as from that of the citizen Pieter Lombaard annexed hereto. 32 And to the contents of which the plaintiff takes the liberty to refer. 33 That the undersigned, as soon as he had obtained the necessary disclosures regarding this from the original officer, 34 did not hesitate for a moment, based both on the aforementioned evidence in hand 35 and on the grounds of the extrajudicial confession made by the defendant, 36 to request from Your Honors a decree of personal summons. 37 And upon the personal appearance regarding the matter of criminal justice and the general style of proceeding in criminal cases, he requested and obtained 38 provisional incarceration and interlocutory deposition, 39 in order to examine the defendant on such interrogatories as should be presented to him by the plaintiff before the commissioners from this Honorable Court. 40 That the defendant, having been heard on those articles, fully confessed to having repeatedly committed the crime of adultery with the aforementioned wife of Rijneke during the subsisting marriage of both parties. 41 In which confession he completely persisted upon re-examination, 42 denying, however, that he had ever intended to do away with his wife in one way or another, 43 which, taken for a moment, may be the truth, 44 yet in this investigation of the matter the officer is necessarily required 45 to weigh and consider both the denial and the confession 46 with and against the available evidence, 47 as well as to what extent that denial can be reconciled with the touchstone of probability and plausibility, 48 in order to discover along that guiding thread 49 whether that denial could be of any avail to him, the defendant. 50 In the first articles it clearly appears that the defendant did not dare to play the denier, 51 as he well knew that all that was asked was abundantly known to the world and thus could not only brook no denial, but moreover he could furthermore be accused of falsehood. 52 While on the further accusations, he, well knowing that confessing thereto would constitute the gravest crime and punishment, 53 it thus seems very probable that the defendant, through these premeditated answers, 54 has endeavored to direct matters so as to make the witnesses suspect of subornation and thus render them reproachable. 55 But as to how far this can stand the test of truth, 56 the plaintiff takes the liberty to lay before Your Honors that from 57 the 27th interrogatory answered by the defendant, 58 wherein he says that the wife of Beneke allegedly said in substance: 59 Cobus, I wish that your wife and Adam were dead, then we could marry, 60 to which he, the defendant, is said to have answered:

in cold blood; they have a longer life than we do, since it is indeed clearly evident from all the circumstances that the defendant is a man entirely abandoned to his passions, 61 and it is therefore more likely that the defendant, in accordance with the deposition of his brother-in-law Holtshausen and according to the confession of the wife of Reneke, said upon this: 62 You can surely kill her, 63 from which an absolute intent can be inferred; 64 however much the Prosecutor now considers himself capable of having the defendant's negative stance in this matter operate to the disadvantage of the defendant and consequently toward an aggravation of the punishment, by means of artificial proofs drawn from the aforementioned declarations, 65 along with the accompanying evidentiary indications, as well as by further proofs, 66 he will nevertheless rather leave those singular proofs as they are, 67 and in the conclusion to be taken in this matter simply adhere to the most certain matter, namely the crime confessed by the defendant; 68 in order to do so, there must be examined: 69 Firstly, what kind of proofs are required by law in the present case; 70 and then in the second place, on what grounds justice can be demanded in this matter. 71 According to the teachings of Carpzovius, Part 2, Chapter 106, Paragraphs 22, 23, and 24, there is required by law for the confirmation and conviction of a committed crime, in general, the testimony of two witnesses; 72 and in Paragraph 3 of that same chapter, that the proofs must be as clear as the day shines in the heavens; 73 while in Paragraph 14 it is taught that in crimes of difficult proof, such as among others adultery, an assumed and presumptive proof is sufficient alongside the confession; 74 that this is what is at issue here, since the crime committed by the defendant has been proven by the confession; 75 thus the Prosecutor also believes that the produced proofs, if not entirely sufficient, at least provide a significant piece of evidence to demand justice according to the letter of the laws. 76 While the Prosecutor will proceed further to the consideration: 1. to what degree the defendant's misdeed is to be classified according to law; 2. whether for that same crime the completion of the full crime is required; 3. whether the malicious intent along with other accompanying circumstances is necessary for it; 78 that the crime of adultery is a heinous and grave misdeed, and thus merits severe punishment, is taught, as well as in its various degrees, by the aforementioned Carpzovius, Chapters 45, 46, and 47, and likewise the Dutch Legal Dictionary, under the title Adultery and Dissolution of Marriage; 79 while by the aforementioned Carpzovius in his Chapter 114, Paragraph 40, as well as by Moorman on Crimes and Their Punishments, Book 2, Chapter 13, Paragraphs 15 and 8, the execution of that scandalous crime is required. 80 And whether such can be established in the present case, the confession indicates in the clearest manner; 81 thus the third point thereby falls away entirely; 82 and that which concerns the circumstances that accompanied the act, and almost had as a consequence 83 what the accusation of the defendant's wife dictates, 84 whereby the life of that woman was almost sacrificed to the lewd and evil lusts of the defendant; 85 while with respect to the defendant no excuse can be brought forward other than merely that which he alleged at the close of his interrogation. 86 And furthermore in the second place, that if the defendant had remained steadfast in his denial, one could equitably not have concluded to any oppressive punishment, 87 since the proofs, according to the aforementioned Dutch Legal Dictionary, are not complete, and much is still lacking to meet those requirements. 88 However, now that the defendant has confessed completely, 89 the Prosecutor believes, under correction, that all those requirements, if not completely, have at least been partially fulfilled; 90 and since now according to the letter of the statutory law of the Dutch Indies, which is most strictly prescribed to us here for observance, under the title of Various Crimes, and specifically that of Adultery in Paragraph 38, without the least exception, and to which no further or other interpretation can be given

Concerning the defendant's name, birthplace, age, and capacity: says Jacobus Steyn of this, born at [illegible]hoek, aged over 30 years. What the defendant's capacity is and where: says burgher sergeant under the district Graaffe Reinet, and to have cohabited at the residence of Adam Ryneke. Whether the prisoner also knows the burgher Adam Reneke and his wife Maria Magdalena Pieterse: says yes. Whether, when the said Reneke was at the Cape, the defendant did not then sleep on one bed every night with the aforesaid Maria Magdalena Pieterse: says yes. Since when the prisoner has had intercourse with the wife of the aforesaid Rijneke: says nearly one year. How many times he has known her: says at a guess, five times. Whether the prisoner is not legally married to Susanna Elisabeth Holtshausen: says while he, the prisoner, has been married to his wife, the aforesaid Susanna Elisabeth Holtshausen. Appeared before me, Johan Jacob Fredrik Wagener, Secretary of the Colony of Graaff-Reinet, in the presence of the after-named witnesses, the citizen Pieter Lombaart, who, at the requisition of the Landdrost of the aforesaid Colony, the gentleman Morits Herman Otto Woeke, declared it to be true: That about a year ago now, the wife of the citizen Jacobus Stijn, by name Susanna Elisabeth Holtshausen, had revealed in confidence to the appearer that her husband, the aforesaid Jacobus Stijn, had been heard saying to Maria Magdalena Pieterse, wife of the citizen Adam Johannes Ryneke: If you love me, you would do what I told you; and that the very same Maria Magdalena Pieterse had answered thereto: You want it so quickly too; I want to go to it, but I cannot get around to it, I am just afraid for the child. That on a certain day the appearer, having been at the place where the aforementioned Jacobus Stein and Adam Johannes Rijneke both reside, had seen, through lifting a mat that hung in front of the chamber door, that the frequently mentioned Stijn had put his left arm around the neck of Maria Magdalena Pieterse, wife of Adam Ryneke, and had thrust his right arm under her skirt. That the appearer thereupon had grabbed the aforesaid Rijneke, who sat in the front room, by the nose and pulled him toward the chamber, but that the same Rijneke had not wanted to get up. has confessed that he, the petitioner, allegedly committed carnal conversation with the aforesaid wife of Reineke. The petitioner, however, at that time, having given those same answers ex carriere, overcome by anguish and fear, was by no means mindful of that which he ought to have advanced toward his notorious innocence. And whereas it has already pleased Your Honours to release the petitioner from his detention on bail, as was presumed on account of the weak evidence in this matter and the negative of the aforesaid wife of Reineke, the petitioner now finds himself in a suitable position to present to Your Honours such circumstances upon which the petitioner can safely trust that Your Honours, according to your well-known equity, will be pleased to give favourable consideration to the petitioner, who finds himself in the most unhappy state. The petitioner hereby takes the liberty respectfully to submit to Your Honours' consideration that, according to the opinion of the most renowned Doctors of Law who have dealt with the so delicate matter of adultery, for the imposition of the punishment merited according to the laws, there was required not only full proof from irreproachable witnesses, but also the confession of the person of whom adultery is alleged, and that these requisites being absent, the judge is maintained not to be fully convinced of the fact. If one now puts the case in question to the test of this well-known legal doctrine, one will soon discover that regarding the evidence or witnesses in this matter, much is lacking compared to the indisputable depositions which in the subject case are required to proceed in a matter of adultery, considering that in the entire proceedings not a single attestation is to be found wherein it is said that one saw the petitioner commit lewdness with the aforesaid female person. On the contrary, the evidence produced on the part of the officer consists solely in a declaration of the petitioner's wife, which in law is just as reproachable as the declarations of those who claim to have heard the commission of the aforesaid act from the mouth of the petitioner's wife. The petitioner, as has been said hereinbefore, did indeed admit before the commissioners that he believed he had mingled with the aforesaid female person. But he begs Your Honours to be pleased to take into consideration that his wife has already for some days suffered from an ailment whereby the cohabitation of marital duties was absolutely prevented, which had for the petitioner that disastrous consequence that the petitioner, who is still very young and in whom one can with such difficulty resist the urge of nature peculiar to every mortal, having fallen into the utmost melancholy, took a wrong recourse and now and then indulged excessively in drink. In which circumstance the petitioner certainly could not conceal his desire, set on fire and flame, for the aforesaid female person; so that the petitioner, thus having believed that in those moments when he was intoxicated by the drink he might possibly have satisfied his animal lusts with the aforesaid female person, consequently, in order to proceed in all things without reserve, made the aforesaid confession before the commissioners. Which confession he now solemnly declares by no means to have been made out of a certain consciousness of the act, but solely out of anguish and fear, and in the belief that he had possibly come to that act in his aforementioned drunkenness. the confession of the citizen Jacobus Stijn, one would notoriously have to fall into the notion that in the defendant no malice can be presumed, but rather one would have to say of her that she was the most innocent person in the world. But the Officer Claimant trusts that when one weighs the evidence with impartiality against the answers given by the defendant to the question articles put to her, one will soon discover that she, the defendant, has acted in all respects with intent, both in committing and carrying out, as well as in stubbornly denying her ill will, considering she not only completely denied her extrajudicial confessions, but also sought to cast suspicion on the offended wife of the above-mentioned Stijn, while the Commission was in session, by making malicious accusations amidst uttering several exclamations. Since it is now certain, according to the legal doctrine of the renowned Carpzovius in his 106th chapter, likewise Moorman on crimes and their punishments, part 1, sections 9, 13 and 14, where it is taught that in crimes of commission more attention must be paid to the evil intent than to the outcome; the denial of a convicted criminal can therefore be of no avail to such a person. Thus the Officer Claimant maintains that the defendant, both through the extrajudicial confessions as well as through confession made to various persons here after the interrogation was held, to be produced if necessary, is amply convicted of adultery and breach of marriage with malice, without the Officer Claimant being able to find anything sustainable for the excuse of the defendant with relation to the deed and the ill will derived therefrom. But on the contrary, in pursuance of his indispensable duty according to the doctrine of the aforementioned Carpzovius, chapter 96, he considers himself obliged to ensure that through well-founded charges and punishments demanded thereupon, such scandalous misdeeds are prevented, as through impunity and the prevalence of that crime, as an inevitable consequence thereof, nearly all laws founded on good order and consecrated would be trampled underfoot. Thus the Officer Claimant will consider it of inevitable necessity to examine to what punishment the defendant has made herself subject. The statutes of the Netherlands Indies under the title of fornication and adultery for the most part agree with the written laws pertaining thereto, such as Carpzovius, chapter 47, sections 27 and 28; Moorman, book 2, chapter 13, section 6; the Ordinance on the subject of criminal justice in the Netherlands; Simon van Leeuwen, Roman-Dutch Law, book 4, part 37, section 8. However, on the other hand, he is of the opinion that although the crime was committed by the defendant, because of the lack of complete proof, conclusion cannot be made to the full letter of the law, both for that reason and also because there are no proper places here to detain female persons, and also for those reasons it is best, in determining the punishment, to depart in part from the letter of the law. that on Monday the 15th of the recently passed month of October, it was reported to the petitioner that on the previous evening a slave named October, belonging to Johan Coenraad Snel, who is assigned to the Honourable Company's stables and serving as overseer on Paarden Eyland, had passed away a few hours later as a result of blows inflicted by his mentioned master; and the petitioner ex officio having made the necessary investigations and inquiries into the matter, it will appear to your Honours from the obtained depositions and post-mortem examination report annexed hereto, that the said Snel unlawfully first gave his aforementioned boy several loose blows with a sjambok, then tied him to a ladder and continued with blows, taking turns with a sailor, his nephew, until the slave's loins and buttocks were completely bloody and bruised, from which he subsequently died, though in the opinion of the chief surgeon he might perhaps have been saved with knowledgeable assistance. That also according to the testimony of the sailor Hans Christiaan Kous, the slave gave occasion for this treatment because, having entered the house unexpectedly, he had grabbed his master by the legs and thrown him to the ground, then sat upon him and held him fast until he was pulled off by the deponent and the aforesaid sailor, and his master was thus freed from him; which, however, still seems to be subject to some contradiction and doubt, while in the deposition of the slave of the Manhafte Lieutenant van de Graaff it is testified that the master had brought the boy into the dwelling house by the arm, and in any case this would not excuse the act itself; so that the petitioner, for the suppression of such crimes and excesses which are very prevalent, and for their lawful punishment, considers himself obligated by his office to obtain still further information and to institute an action in due form against the aforesaid Jacob Snel.
