which, having been granted to the Officer Plaintiff, was also duly carried into execution by him. Article 33. That the defendant, however, did not let the matter rest with his aforesaid crime, but aggravated the same with a second one, seeing that during the same interrogation he so far forgot himself that he did not hesitate, in an exceeding manner, to calumniate in their office both the Gentlemen Commissioners who had officiated at the re-examination of his statement on 21 October 1786 and the sworn Clerk before whom he had previously made the same. 34. Inasmuch as he, the defendant, did not shrink from frankly advancing before the Commission that assisted at his interrogation: 35. First, that the statement, instead of at the Office in accordance with the order and in the presence of the witnesses, had, on the contrary, been signed by him at his house over a glass of wine, without a clerk or witnesses; 36. Furthermore: that the same had been revoked by him, the defendant, upon re-examination, but that the Gentlemen Commissioners officiating at that time had been unwilling to accept this revocation of his, but had hastily rushed and as it were forced him just to sign and to leave his statement unaltered; 37. Finally, after he, the defendant, had been convinced of the malice and mendacity of this assertion, both by Mr. Smuts, who had attended the previous Commission, and by the sworn Clerk, further, that the statement had been read out to him incomprehensibly during the re-examination; 38. Furthermore, again, that he, the defendant, had never intended to take the oath upon it; 39. And more such self-contradictory insults and trifling, yet at the same time impertinent excuses; 40. All of which your Honours will be able to perceive in further detail from the annexed pieces and documents. Article 41. Wherefore the Officer Plaintiff takes the liberty to refer particularly thereto regarding the circumstances of the defendant's acts, 42. And to proceed to the further determination of those crimes and their punishment. 43. Regarding which the Officer Plaintiff then, subject to correction, believes he must establish: 44. That the defendant, noticing that the receipt which the said Van Koppen had received from him, the defendant, was missing, and that the same therefore, also on account of the long duration of time, did not seem very conscious that the questionable 1000f had revera been delivered into his hands for further disbursement to the defendant, embraced that occasion to commit a forgery which, if his scheme succeeded, could yield him a profit of 1000f; 46. That the entire action was initiated and carried out according to the defendant's instigation, cause, and instruction; 47. Yea, that to substantiate and establish the foundation thereof, he moreover added a quasi-legal statement serving the matter and distinctly containing all private and other circumstances; 48. And thus presented himself as a false witness, in order, contrary to all principles of honour and faith, as shamelessly as audaciously, with intent, deceit, and premeditation, to obscure the truth; 49. Yea, in his deliberate wickedness went so far, 50. That he did not shrink from accusing both the Gentlemen Commissioners and a sworn clerk of his own falsehood; 51. To sacrifice, were it possible, their public character, the mutual trust in secretarial instruments so necessary in a well-ordered society, which for the most part constitute the foundation of judicial certainties, to the effects of his wicked intentions; consequently a judicial Commission, the representatives of documents 0 .

to insult this illustrious College, and in them, both this splendid tribunal as well as the one in whose name law and Justice are administered by the same, in such an extravagant manner, whereby the said defendant has made himself guilty of an absolute Crimen Laesae Majestatis. Article 52. And all this solely with the aim, against all impressions of a pure conscience, at the cost of the property and blood of his fellow man, to advance his own gain and greed. 53. And that the said defendant, through these most strongly qualifying circumstances, has also in all respects made himself guilty of the Crimen falsi and subject to its lawful punishment, appears in L: 27: § 1. However much the defendant now also seems to wish to pretend that he gave no occasion nor inducement for the aforementioned action, 55. it shall nevertheless appear fully from the responses of van koppen and the statement of the attorney concurring therewith, 56. furthermore no less from the doubtful answers of the defendant and especially from the unequivocal responses to article 18, 57. that the defendant started the entire matter and, so to speak, supplied the materials to carry out the entire work. 58. And this all the more as he, the defendant, was the only person who could promise himself any advantage therefrom. 59. Whereas the defendant, furthermore, cannot produce the slightest proof that the payment was made by him to de Waal. 60. Article 71. For what the defendant denies in one place, he admits in another, or says it may be, we can indeed forget something. 72. And finally he requests of the Council, see extract of the minutes of the 6th of this month, an excuse for his outrageous behavior. 73. Whereby he himself revokes that which he advanced concerning the statement at his interrogation, and thus not only demonstrates in the clearest manner that his allegations regarding the conduct of the commissioner gentlemen as well as the behavior of the sworn clerk are fabricated and untrue, but also very naturally reveals that he proceeded to do so in the hope of possibly saving himself from his crime. 74. Which, accompanied by so much cunning and intent, can never manifest a matter done out of innocence or in good faith, 75. But rather demonstrates that it was perpetrated premeditatedly and with evil intent and malice. 76. The minute of the 5th of this month, in confrontation with the statements of the 20th and 21st of October 1786 annexed hereto, will furthermore provide the best proof of the defendant's character. 77. From which it appears that the defendant was even prepared to commit perjury. 78. All of which circumstances help to accumulate and aggravate the crime of the defendant. 79. Since he, the defendant, has not only made himself guilty of the crime of forgery in the absolute sense, but at the same time has also attempted to accuse the commissioner gentlemen, and this proceeding solely from his committed forgery, in their sacred discharge of office, of partiality, bad faith, and despotism regarding the re-reading and swearing of statements. Article 80. Which will make the defendant undergo the above-mentioned punishment all the more justly and equitably, since, if one were graciously to regard the conduct of the defendant toward the commissioner gentlemen merely, instead of a false accusation, as a verbal injury, he, the defendant, has already merited corporal punishment by that alone, for, as Kersteman's Dutch Legal Dictionary, volume 1, page 203, column 2, says among a multitude of other authors: finally, all verbal injuries toward respectable bodies, nobles, and other privileged persons, etcetera, in the preservation of whose honor and good name the common good is concerned, are not atoned for with an honorable and profitable reparation, but are punished far more severely, corporeally or with banishment, etcetera. 81. How much more then, Honorable and Worshipful Gentlemen, if his conduct toward the commissioner gentlemen is considered as, what it in fact is, a false accusation made against their honors in their office, must the defendant be judged to incur an exemplary punishment. 82. While furthermore, regarding the crime of forgery, it is decreed by Emperor Charles V in the placard of 30 June 1545 that all forgers, having knowingly and with intent, will, and deceit committed the crime of falsities to the detriment of another, shall henceforth be punished with the cord, etcetera. 83. Yet this decree was thereafter altered by later legislators and legal scholars, and an arbitrary punishment was introduced in its stead, 84. Pursuant to which such criminals, according to the nature or the magnitude of the forgery and the accompanying mitigating or aggravating circumstances, were usually subjected to having a hand or fingers chopped off, or being scourged and branded, or banished. 85. As can be seen in Voet, Book 48, title 10, number 8, Huber, Modern Jurisprudence, Book VI, Chapter V, Section 1, and all the jurists who have commented on this subject with well-founded reasons. 86. Although one might now, Honorable and Worshipful Gentlemen, somewhat observe in favor of the defendant, 87. That however premeditated and concocted the offense of the defendant was devised, the same was nevertheless not carried out into full effect. 88. And one might wish to apply here the doctrine of those moderate doctors of law who indeed sometimes take the will for the deed, but yet never wish it to be punished always as the deed itself. 89. Thus the officer demanding of justice nevertheless believes with reason that the aggravating circumstances of the crimes of the defendant militate so greatly against him that one, especially when keeping the public welfare in view, can never embrace such a legal doctrine to the benefit of the defendant with any semblance of reason. 90. The less so, because he, the defendant, was by no means deterred from perjury in time through repentance or sorrow, but by the discovery of his roguery by the judge. 91. Wherefore, the punishment to be demanded being imposed to the full upon the defendant, the special consideration of Your Honorable Worships in his regard ought nevertheless always to apply. Wherefore, and for other reasons and arguments to be further reduced in due time and place if necessary, the officer demanding of justice, making his demand, concluded that the defendant Jan Smit of Dilburg, by the definitive sentence of Your Honorable Worships, shall Submitted with due reverence by the undersigned interim fiscal. That having been handed the sentence pronounced on the 5th of April of this year in the case of the citizen Iacbs Michiel van koppen, plaintiff against Petronella Elisabetha Weijdenaar, defendant, pursuant to which Your Honorable Worships were pleased also to decree that, having taken into consideration the contradiction residing in the statement given by the citizen I: Smit van dilleburg at the request of the plaintiff in this matter against the handwriting of the said Smit van dilburg exhibited by the defendant, the council thereby places this case into the hands of the Fiscal Office for the purpose of an investigation; and the petitioner, in compliance with this highly esteemed resolution, having carefully examined the documents dealt with and communicated in this trial, believes, under correction, to perceive and to be able to establish: That the objective of the trial in question was to commit a forgery, and to enrich oneself with ƒ1000 to the detriment of another. That with respect to the plaintiff van koppen, it is particularly charged against him that he 1. against better knowledge and conscience instituted an action against a person against whom he could have no direct action, he having paid the money in question to smit van dillenburg and acquired his receipt, seeing that he should therefore first have addressed him about it, and legitimate himself in that regard. 2. And 3. He, van koppen, also required this smit van dillenburg to declare all of this. That Smit van dillenburg is predominantly burdened in this affair: 1. That he received money for another and did not duly hand it over. 2. That he, Smit van dillenburg, after having withheld this money for his own use for a long time, seeks to appropriate it to the detriment of another and thereby enrich himself even further. 3. That he intentionally and with premeditation, adding year and day and other circumstances to that end and to give a semblance of truth, declared and testified the contrary and the greatest untruths, confirmed his statement by oath, and still persisted in it upon re-examination before the Gentlemen Commissioners from this Honorable Council. That the case, taken in and of itself, such conduct being capable of leading to the greatest and most disadvantageous consequences both in private and in public, and both the one and the other of the aforementioned persons, van koppen and Smit van dillenburg, have made themselves absolutely guilty against the Legem Corneliam de Falsis. It was made known by the Honorable President that he had convened this meeting upon the express request of Mr. Mappa and Smuts, together with the sworn clerk of this Council; who, having been occupied yesterday in hearing the burgher Joh.s Smit of Dillenburg on interrogatories at the requisition of the Fiscal pro interim, the Honorable Gabriel Exter, were insulted in a very far-reaching manner by the said Smit of Dillenburg, as appears from the minutes held thereof before the Commissioners, and therefore requested a striking satisfaction for this injury inflicted upon them in their capacity as representing the entire body of the Council; whereupon, the aforesaid Fiscal pro interim and Smit of Dillenburg having been brought inside, the first-named, upon exhibiting a statement by the assistant Jacobus Veroueil and the interrogatories of the said Smit of Dillenburg, along with those of the burgher Jacobus Michiel van Koppen, requested bodily apprehension of the last-named Smit of Dillenburg, who, against this, in very submissive terms asked the Council for forgiveness and declared that he was sorry for what had occurred, and would henceforth refrain from such outrages; so the Council, having taken into consideration the insolent conduct of the burgher Joh.s Smit of Dillenburg toward the Commissioners of this court held yesterday, wishing to accuse their Honors as if they had acted in bad faith in their office, in addition having noted the mendacious inculpation used by him, Smit, against the sworn clerk of this Council, thought fit to provisionally place the said Smit of Dillenburg under civil arrest, and to order the officer to institute such an action against him as shall be deemed advisable, and likewise, during his detention, to prosecute the action already initiated against him, Smit. Partly because he is exceptionally well-spoken, and also because the first prisoner seems to be the most crafty in his answers, whereas the Hottentot Kees was very simple and very poorly spoken; and on the other hand because he, Willem, as all the prisoners unanimously declare, fired first, and thus served as a ringleader to encourage the others to follow suit; he, as well as the Hottentots Kees and Dragonder executed before the first-mentioned, made use among themselves of a weapon whose effect could never depend upon their caution; and it is still uncertain which of them fired the fatal shot, which is declared by the prisoners and defendants to have been the shot of the Hottentot Kees, but in this case must be regarded merely as an excuse. For which and other reasons and means to be further deduced in due time, the Plaintiff, making demand, concluded that the prisoners and defendants mentioned in the heading hereof may, by definitive sentence of your Honorable Worships, be condemned to be taken to the place where criminal sentences are customarily executed, there to be handed over to the executioner, the first prisoner having his right hand cut off while lying on a cross, as well as his head, and then his head placed on a stake opposite the dead body; further, the second prisoner, Spogter, to be punished with the rope at the gallows until death follows; subsequently, the dead bodies of both prisoners dragged to the outside place of execution, that of the 1st prisoner placed on a wheel and that of the 2nd prisoner hanged again on the gallows, and thus to remain there until consumed by the elements and the fowls of the air; with condemnation in the costs and expenses of justice, or to such other end as your Honorable Worships shall deem proper. For which and other reasons and arguments, to be deduced further in due time if necessary, the Prosecutor, making his demand, concluded that the prisoner and defendant named in the heading of this document shall be brought to the place where criminal sentences are customarily executed here, and there, being delivered to the executioner, to be exposed with a rope around his neck under the gallows, further to be tied to a post and severely scourged with rods on his bare back, and thereupon to be branded, subsequently to be confined on Robben Eijland in order to labor there at the Honorable Company's public works, with condemnation in all the costs and expenses of justice, or to such penalties and punishments as Your Honors shall deem appropriate. Thus recollected at the Cape of Good Hope, the 20th of September 1787. Was signed Magdalena Keyser. Below: In my presence, signed R. J. van der Riet, sworn clerk. now voluntarily confessed by the honorable Company's prisoner and as has clearly appeared to the Honorable Worshipful Council of Justice of this government from the documents furnished in this trial: That the prisoner in the month of August of this year, having been ordered by his mistress's son, Jacobus Mouton, who, being at her residence situated at the Vierentwintig Rivieren, was managing his mother's affairs, to proceed to the garden in order to help the other slaves busy there to dig out potatoes; the prisoner, being then eating, instead of obeying that order, remained quietly sitting at his ease until the said Mouton ordered the prisoner the same for the second time. That then the prisoner, upon receiving two sjambok lashes on his shoulders, came running at the aforesaid Mouton with a knife he had in his hands; the said Mouton, retreating backwards, received a light wound on one of his fingers, without the prisoner, however, according to his confession, having had the intention to injure his mistress's son. That finally the said Mouton, having been relieved by his aforesaid mother through the pushing back of the prisoner, wrested the knife from him, subsequently tied him up, and surrendered him as such to the field cornet, from where the prisoner was subsequently delivered into the hands of Justice. Now, whereas such deliberate oppositions of a slave against his master can in no way be tolerated in a country where law and justice are properly maintained, but on the contrary ought to be punished as an example to other such evil-doers. Thus it is that the Honorable Worshipful Council of Justice aforesaid, serving on this day, having read and considered with attention the written Criminal Claim and Conclusion made and taken by and on behalf of the Merchant and Landdrost of Stellenbosch and Drakenstein, the gentleman H. L. Blekterman in his official capacity, upon and against the prisoner, as well as having attended to all that was relevant to the matter and could move Their Honorable Worships; administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, condemned the prisoner Baatjoe of Sambouwa to be taken to the place where criminal sentences are customary to be executed here, there delivered to the executioner, tied to a post, severely scourged with rods on the bare back, and further to be confined on Robben Island, there to labor for the term of his life on the Honorable Company's public works, with condemnation in all the costs and expenses of Justice. Appeared before us, the undersigned commissioners from the Honorable Worshipful Council of Justice, the slave Perkeman of Batavia, who, after these his preceding interrogation articles were read out to him clearly and distinctly word for word, declared that he persisted therein, desiring that nothing more shall be added thereto or taken therefrom. Declaring nothing more, the appearer gives as reasons of knowledge as in the text, being prepared to confirm the same further.
