110 141. Saturday the 14th of July 1787. And since this cannot happen without your Honors authorizing the undersigned remonstrant by decree for this purpose, he takes the liberty of turning to you with the respectful request that it may please your Honors to authorize the undersigned remonstrant to have the said Leendert Gijsendorp taken into custody. Underneath was written: Which doing, was signed G. Exter. In the margin: exhibited in Judicio the 5th of July 1787. Which was held for advice by circular reading. Finally, the Honorable President proposed, as it often occurred at present that the interim fiscal acted very arbitrarily in collecting inquiries in criminal cases and therein did not at all follow the practice and custom established here from all ancient times, whether it would therefore not be well to authorize the commissioner gentlemen, while they were attending such sessions, to examine beforehand whether the officer of this council was authorized for such proceedings, and if not, to suspend these commissions and not allow them to proceed; which was unanimously agreed to. At the Cape of Good Hope, the day and year as above. Below: In my presence, signed C. van Aerssen, Secretary. The interim fiscal, the Honorable Gabriel Exter, exhibited the following remonstrance: To the Honorable President and Council of Justice of the Castle of Good Hope. Honorable Sirs, With due respect, the undersigned remonstrant shows: Thursday the 26th of July 1787. In the morning, present: the Honorable Johannes Isaack Rhenius, President, and all the members. Cape of Good Hope, the day and year as above. Below: In my presence, signed C. van Aerssen, Secretary. By order of the Honorable President, it was circulated by me, the Secretary, to the respective members for consideration as to how the corpse of the detainee Hendrik de Plooy, who died very suddenly last night, ought to be treated. It was approved to have it taken to the outer place of execution and there and then hanged by one leg from the gallows. Saturday etc. — 172. 113 Signed: interim fiscal. That on Sunday the 1st of the current month of July, the servants of justice Fredrik Hendrik Hesler and Johannes Christoffel Tenninger, having received orders according to their shift to patrol this main settlement during that day in order to counter and prevent all disorders, both of the slaves and otherwise; and while carrying this out in the afternoon during divine service, after having chased away a group of boys who were busy shooting with blank powder and beating on drums around the Lutheran church, they returned; and having arrived at the Boerenplein upon hearing the noise again, they discovered not only that this disturbance was caused by a conspiratorial group of boys, but were also spoken to by a young son of the burgher Hendrik Ellers, stating that the boys were making such a noise that he, on account of his sick father, had told them several times to be quiet or to move along, to which they paid no heed, and his mother had therefore requested to chase the numerous slaves away; the said servants, having felt all the more obliged to break up and disperse this group of conspiratorial boys with a few cane strokes. That the servants, having done this, were stopped by the burgher Johannes Joachim Theron and were not only addressed by him with extreme and injurious abusive words, such as "Rope-makers, you beasts, you belong under the gallows," but were also threatened with picked-up stones and a thick cane that they would be beaten; that they were of the devil, and if they were honest fellows, he, Theron, would nevertheless give them a beating, and if they did not get beaten, he would beat or shoot them to death upon their return; as shall further appear to your Honors from the accompanying declarations of the said servants and the corresponding deposition of the aforesaid young son of the burgher Ellers. That such an enterprise undertaken against the public peace and security, and in the highest degree insulting and scorning justice, must surely be counted among those that ought to be strictly punished according to the Lex Julia de vi publica; for which reason the undersigned remonstrant, subject to correction, believes he must proceed ex officio against the aforesaid Johannes Joachim Theron in regular legal order, and to that end summon him in person. However, since your Honors' authorization is required for this, the undersigned remonstrant takes the liberty of turning to your Honors, requesting a decree by virtue of which the undersigned remonstrant may be authorized to summon the aforementioned Johannes Joachim Theron to appear in person before your Honors on a certain appointed day, in order to hear such claim and conclusion, or requests or requests.

114 115 to request as the pro interim Fiscal shall be advised to do and take on the appointed day against the said Theron; [below stood] Which doing, was signed G: Ester in the margin Exhibited the 26 July 1787. Which having been read, the summons in person upon the citizen Joh:s Zacharias Theron requested therein was granted, there furthermore being served by the said pro interim Fiscal another petition reading as follows: To the Honorable, Most Respectable Lord President and Court of Justice of the Castle of Good Hope Honorable, Most Respectable Lord and Gentlemen Shows with due respect the undersigned pro interim Fiscal. That the petitioner having had delivered into his hands the sentence pronounced on the 5 April of this year between the citizen Jacobus Michiel van Koppen, plaintiff, upon and against Petronella Elisabeth Wijdenaer, defendant, pursuant to which Your Honors have been pleased also to decree that, having taken into consideration the contradiction which resides in the declaration given by the citizen Joh:s Smit van Dillenburg at the requisition of the plaintiff in this matter with the handwriting of the said Smit van Dillenburg exhibited by the defendant, the Court consequently places this matter into the hands of the Fiscal's Office for the purpose of investigation; and the petitioner, in satisfaction of this most esteemed resolution, having closely examined the documents handled and communicated in this trial, the same, subject to correction, believes to perceive and to be able to establish: That the objective of the trial in question has been to commit a falsum and to enrich oneself with f 1000 to the detriment of another; That with respect to the plaintiff van Koppen, the same is particularly charged with having, against his better knowledge and conscience, instituted an action against a person against whom he could have no direct action, he having paid the questionable money to Smit van Dillenburg and taken to himself the latter's receipt, whom he therefore should first have addressed for that reason, and the same should have legitimized himself on that account; 2. that the said van Koppen seeks to base this action of his on all kinds of deceitful and far-fetched circumstances, such as that he had paid off the money to the late Joh:s van de Waal personally, and that the said de Waal had requested him, van Koppen, just to hand over the money while he, de Waal, was surety and had a settlement of accounts with Mr. Berg, and that Smit van Dillenburg had counted out this money upon request, and 3. he, van Koppen, also required that Smit van Dillenburg to declare all this. That Smit van Dillenburg is primarily incriminated in this affair: 1. that he received money for another and did not properly hand it over. 2. that he, Smit van Dillenburg, after having withheld this money for a long time for his own use to the detriment of another, seeks to appropriate the same and to enrich himself even more thereby. 3. that he deliberately and with malice aforethought, by adding year and day and other circumstances to that end, and in order to give an appearance of truth, declares and confesses the contrary and the greatest untruths,

116 117. declared that he would maintain his statement under oath, and as furthermore appeared before the commissioners from this Honorable Worshipful Court upon re-examination, that the matter, taken in and of itself, such a deed could tend to the greatest and most harmful consequences, both in private and in public, and that both the one and the other of the aforementioned persons, van Koppen and Smit of Dillenburg, have absolutely made themselves guilty of the Lex Cornelia de Falsis. And although the guilt of the plaintiff van Koppen is greatly diminished by the fact that he revealed the extortion and did not allow it to take effect, of which the deponent Smit made himself guilty, the first-mentioned nevertheless does not seem to be capable of being acquitted of all evil intent and dolus malus and of all guilt. Wherefore the officer, respectfully submitting to Your Honorable Worships' better judgment, considers that he must proceed ex officio against the one as well as the other of those persons, and cause them to be summoned in person. Since, however, Your Honorable Worships' authorization is required for this, the officer takes the liberty of addressing himself to the same, respectfully requesting Your Honorable Worships' decree by which the officer may be qualified to summon the repeatedly mentioned Jacobus Michiel van Koppen and Johannes Smit of Dillenburg to appear in person before this Honorable Worshipful Court at a certain fixed date, in order to hear such criminal claim and conclusion, or request or requests, as the officer shall be advised on the day of the hearing. Below was written: Doing this etc. etc. was signed J. Exter; in the margin: exhibited the 26 July 1787. After which reading the requested summons in person was granted against the burghers Jacobus Michiel van Coppen and Johannes Smit of Dillenburg. After which, by the aforementioned interim Fiscal, it was shown with due respect by the undersigned sworn Clerk, as qualified ex officio by the High Government of this country for the observation of the affairs of the Landdrost of Stellenbosch: That in the month of October of the past year it was brought to the knowledge of the petitioner by the elder of the Roodezand church, Jacobus Hugo the elder: That his slave woman Sara, having become anxious on a certain night in the month of August prior to that, through the remedies administered from the following day, one, and so forth up to nine [illegible], it was verbally made known that a certain male slave had been left behind by the sailor Vincent Claas, who was confined on the ship De Meermin and had recently deserted from the said vessel, and according to the saying of the said Claas, belonged to the child taken along with him, whose mother is still at the Cape, with the request, since the estate of the said Claas had been accepted by this Council for administration, to know what was deemed best to do with this slave. Thus it was approved to hand him over to her, the mother of the child who is the owner thereof, with the understanding, however, that she shall not alienate the said slave until it is known whether the moneys yielded from the estate of the aforesaid Claas will be sufficient for the payment of the creditors, in order otherwise to be able to seek recourse against the aforesaid slave. Lastly, the sworn Clerk Jan Ryno Johannes van der Riet, as qualified for the observation of the affairs of the Landdrost of Stellenbosch and Drakenstein, produced the following petition: To the Right Honorable Worshipful Lord Johannes Isaack Rhenius, President, together with the other Honorable Gentlemen Members of the Honorable Worshipful Council of Justice. That the same Demas, having been caught some time thereafter and brought home, he, Hugo, had immediately demanded of him why he had run away and what he had administered to the aforesaid Sara; it was answered and confessed by him that he had already for a long time solicited the same Sara to converse with her carnally, but that he had each time been turned away by her; that he subsequently had understood from the slave Maart, belonging to the former Heemraad of Stellenbosch Johannes Albertus Meijburg, that whenever one wished to make a girl fall in love with oneself, one had to administer to her the hair from the private parts and chest; the said Maart was also said to have prepared the balls of hair and delivered them into his hands, and that he, Demas, having seized the opportunity, had managed to administer those balls of hair to the same Sara, both with the soup and the water; while he, Demas, however, had assured that he had never had any intention to deprive the same Sara of life thereby, but indeed to make her fall in love with him, just as the said Sara had also related to him, Hugo, of having been frequently accosted by Demas to live with him as wife, which, however, had been refused by her. That the aforesaid Demas was subsequently sent up here according to law and directly, having fallen ill thereupon, was first heard in the month of March of this year before the Commissioner Gentlemen from this Honorable Council, confessing the same in conformity with the foregoing, denying only that he would subsequently have threatened Sara according to what was deposed by her. That the Officer, submitting under correction of judgment that nothing more may be charged against a criminal than what becomes apparent from the confession itself or from sufficient and legally proven evidence, consequently no more can be demanded than the law dictates; and since then on that foundation nothing else can be [illegible] to the aforesaid Demas to get her, but that, on the contrary, the means employed by him would only have served to compel the said Sara to stay with him, just as Your Honors may, if so pleased, observe these matters in greater detail both from these accompanying declarations and from the answered interrogatories of the said Demas. 120 121 charged that he, having been unable through all friendly attempts and solicitation to persuade the fellow slave Sara to return his love, the natural instinct for her carried him so far that, whether at the suggestion of this or that person or of his own accord, he managed to administer such a potion to her with which he thought he would achieve his purpose, the consequence thereof however having been so unfortunate for him that the said Sara might well have lost her life thereby. And in order not to occupy the attention of Your Honours uselessly with a multitude of citations from legal scholars, the repeatedly mentioned petitioner will only take the liberty to say that indeed the greatest part of the legal scholars who have written upon the crime of poisoning and its punishment require that it clearly appear: 1. that the poison was truly administered, 2. that death followed upon it, and 3. that the administered poison was malicious and harmful. And howsoever much one is assured of the first in the present case, the second however did not follow, and the third, no matter how clearly the consequences have shown it and the harm thereby caused to the aforementioned Sara, cannot however be proved with sufficient certainty really to belong among those substances which are poisonous per se; besides which there still belongs to that first point the proof that the aforesaid Demas and Sara lived in hatred and discord, or that he would have had to expect some gain or advantage from her death. And this is the reason why the potion administered by the aforesaid Demas to the said Sara can never be made applicable to the aforesaid laws whereby someone has made himself guilty of the statutory punishment for the crime of poisoning, but rather has reference to the giver of a love potion who harbours no deceit to kill someone and consequently is not liable for manslaughter, wherefore he should also by no means be punished with death, but with banishment; thus the repeatedly mentioned petitioner flatters himself that he might have sufficed with demanding such a punishment. That however, regarding the application of such a punishment, it ought with respectful reverence to be taken into consideration here that the same Demas is a heathen brought up in the thickest darkness of ignorance, and consequently, the drive of simple nature having urged him toward gratification, it cannot be imputed to him that the means to achieve his purpose turned out so disastrously; and on the other hand that he has already been placed in closed custody since the month of January of this year, thus the punishment to be demanded or served has hereby been sufficiently satisfied, the more so because the same Demas, for about six weeks now, at the request of the repeatedly mentioned petitioner, has been placed on Robben Island until further orders. 124 125 pair of buckles which are in hand as a part of the corpus delicti, or whether the Officer, the petitioner, should wait with the proceeding of his claim until such time as a corpus delicti had been discovered; and if one should proceed to the last part of his proposal, that a commission might then be appointed to track down the stolen goods. It then pleased your Honours to keep that request in advisement; however, upon a petition made by the Officer, the petitioner, at a further meeting, it was approved by your Honours to stay the claim in the principal case until such time as the stolen goods should be discovered, appointing to that end a commission of the Landdrost and Heemraden of Zwellendam, who were then also duly written to by order of your Honours pursuant to the resolution taken. Yet since the remote distance of that drostdy and the difficulty of carrying such a resolution into execution during this rainy season has brought the Officer, the petitioner, into the reasonable fear that some months may elapse before and until one could be informed of the outcome of that commission, and a prolonged detention would be the cause of not only [harm to] the health, but also the death being caused of all the accomplices, whereby the execution that necessarily ought to be applied to such a crime would be rendered illusory, as experience has already shown in the person of Hendrik de Plooij, as the principal accomplice of that of Mijntje de Plooij, the first of whom is already dead and the latter happens to be very gravely ill. Reasons why the Officer, the petitioner, takes the liberty of turning to your Honours, humbly requesting that all this may be taken into serious consideration by your Honours, and to instruct the Officer, the petitioner, with such orders as shall be found appropriate according to the nature of the matter; declaring the Officer, the petitioner, to be prepared, if such were judged necessary by your Honours, to make the pending claim orally. Furthermore, deliberation having been held concerning the conduct maintained in this matter by the burgher Jacob van Reenen as being entirely contrary to good order in justice, frustrating the proper punishment of crimes, and moreover withdrawing the vagabond evildoers belonging under their jurisdictions, the council has placed this matter into the hands of the Landdrost of Zwellendam in order to institute such action against the said van Reenen as shall be deemed advisable. In the forenoon, present the Honorable Worshipful Mr. Joh,s Isaack Rhenius, President, and all the members except Messrs. van Echten and Madorp, the former due to indisposition and the latter due to other occupations. The former Clerk of this Council, as authorized to attend ex officio to the affairs of the Landdrost of Stellenbosch, the Landdrost of Stellenbosch and Drakenstein, Mr. Hendrik Lodewijk Bletterman, in his official capacity, plaintiff on the one part, makes his demand with the presentation of the sentence pronounced against the defendant, the Commandant of the Swellendam invalids, Jacob van Reenen Junior, defendant, in order to prove to the satisfaction of the law that the appeal lodged by him against a certain sentence pronounced by the aforementioned Judicial Council on the Roll in the case of Mr. Rijneveld, in his official capacity, entered upon and against him, defendant, in the matter of giving advice, has been prosecuted in Batavia before the Honorable Worshipful Council of Justice, and in default thereof, pursuant to the highly revered order of the Superior Gentlemen dated 15 June 1718, to hear requested the declaration of desertion of the aforesaid appeal with costs. The defendant produces a letter written to him by Messrs. Schults and de Jong in Batavia, whereby he shows that the same serves in answer to a letter written by him, defendant, to these gentlemen to appoint their Honors for the prosecution of his appeal, but that the power of attorney was not accepted by the aforementioned gentlemen for reasons stated therein. The plaintiff in his official capacity says that the defendant has had time enough to appoint other agents, and that the former Landdrost, Mr. Ryneveld, during his lifetime also authorized the gentleman Advocate Fiscal in Batavia to defend this case. The defendant says that after receiving the aforementioned letter he again requested the aforementioned Messrs. Schults and de Jong to be willing to serve him, but that he has not yet received an answer thereto, of which letter sent by him the minute lies with the attorney, which he, being so required, can produce immediately. The Council holds this case in advice until the next court day and orders the defendant to deliver further proof at that time that he has properly prosecuted his appeal in Batavia. After which, the Pro Interim Fiscal, the Honorable Gabriel Exter, served the following statement: To the Right Honorable Worshipful Mr. President and Council of Justice of this Government. 134 135 cumulating probable evidence and arguments the defendant must be held essentially guilty, and for that reason, in order to receive the punishment established for such crimes, one should proceed to a sharper examination, the Officer Plaintiff nevertheless, subject to correction, believes he must principally consider that according to the general rules and conception of criminal procedures, torture is as perilous as it is violent a means to bring the accused to confession, which must be applied with the greatest circumspection and not otherwise than when the proofs happen to be so clear and decisive that on the basis thereof, without the prisoner's confession, a formal claim against him might be made in the ordinary trial and he might consequently be condemned; which qualification or similar direct proofs in casu subtracto are entirely lacking. For notwithstanding that the boy is said to have been standing under the door at 4 o'clock, the defendant also went home at a quarter past 4 o'clock when the deponent Van Lutsenburg came out, and according to his testimony nothing was broken open, and that the defendant denies the weightier circumstances that principally incriminate him, shifting to other times, places, or saying he did not reflect upon it for the reason that he was a little drunk, while he did remember minor and indifferent things, these and other circumstances, which together with the nature of the boy's amazement produce very strong indications against the defendant and declare him very probably guilty in re, cannot and may not, however, be regarded and held as such proofs that are sufficient to make a formal claim in the ordinary trial and proceed to condemnation, and that the same, taken directly and strictly, do not yet constitute even half proof; experience having taught that torture is not an infallible means to bring out the truth, and indeed often through a concurrence of probable proofs that can and may be regarded as convincing circumstances, people have been tortured and brought to confession for deeds that were never committed by them. The Officer, Plaintiff, entering, makes the following request, submitting three sworn declarations, in criminal cases on the one part, against the burgher Jacobus Stein, Defendant in person on the other part, to hear such criminal claim and conclusion, or such request or requests as the Officer, Plaintiff, shall make and take against him, the Defendant, to answer thereto, and further to proceed according to law. The Officer, Plaintiff, before making the claim, requests that the Defendant shall be provisionally incarcerated in person, so that when this case shall have been determined by Your Honourable Worships by definitive sentence, any sentence to be pronounced therein may not be rendered illusory by the absence of the Defendant, and all the more so since the Officer, Plaintiff, maintains that it has been proven more than sufficiently that the Defendant has made himself guilty of the crime of adultery, upon which, according to the letter of the statutory laws of the Netherlands Indies, corporal punishment is stipulated, which cannot be executed otherwise than upon the Defendant in person; and further that the Defendant in person may be ordered to answer to such interrogatories as shall be put to him by the Officer, Plaintiff, before the gentlemen commissioners from this Honourable Council. 144 145 The plaintiff ex officio believes that it is evident from the depositions given by irreproachable witnesses that the defendants have made themselves guilty of an infringement upon civil liberties and violated the rights of the sovereign authority by using the name of the one who represents the sovereign in the countryside, upon which, according to the letter of the law, corporal punishment is established, which thus cannot be executed otherwise than upon the persons of the defendants. The plaintiff ex officio before making his claim requests that the defendants in person shall provisionally be incarcerated so that, when this case is terminated in a final judgment by your Honours, the sentence to be rendered therein will not be made illusory through the absence of the defendants, and all the more so since he requests that they be obliged to remain here in their lodgings without being allowed to venture outside the Castle, under penalty of confession and conviction, so that when this case shall be terminated by a final judgment, the punishment to follow upon it may be the more easily executed upon them. For the aforesaid case, on the other side, the acting plaintiff for replication and the defendant for duplication, persisting in what they have brought forward, renounce further productions. The Council keeps this matter under advisement for circular reading. Subsequently, pursuant to the disposition of the last court day, the Commandant of the burgher invalids at Swellendam, Jacob van Reenen, presented a draft letter written by him in the beginning of this year to his authorized agents at Batavia, the Messrs. Schultz and Jongh, from which it appeared to some extent that he had requested his authorized agents anew to pursue the principal matter; wherefore the Council, after having first heard the authorized agents of the Landdrost of Stellenbosch, took the following resolution: The Council stays the principal matter until the arrival of the forthcoming return fleet of the year 1788, when the defendant can and must exhibit further evidence regarding the prosecution or non-prosecution of his lodged appeal. With due respect shows the undersigned Landdrost of Swellendam, Constant van Nuld Onkruydt, that by the extract resolution handed to the remonstrant, he was enjoined by this Honorable Council to institute ex officio such action against the burgher Jacob van Reenen as he would find proper, and this on account of the fact that the said van Reenen did not hesitate on his own authority to cause the locks of Dirk to be undone, which Dirk, having been apprehended by the Field Warrant Officer Jacobus Conradus Rademeyer for burglary and theft, was sent from house to house to Swellendam to receive his well-deserved punishment, and for that purpose had been brought to the farm of him, van Reenen, Right Honorable Sir and Gentlemen. To the Right Honorable, Highly Esteemed Sir Johannes Isaack Rhenius, President, and the Honorable Council of Justice of this Government, after which the following remonstrance was exhibited by the Landdrost at Swellendam, the Honorable Constant van Nuld Onkruydt. 150 151 to have them undone on his own authority, with the substantial statement: "You are as good a burgher man as any other and you can go freely wherever you want," adding: "how dare they lock you up? There are the letters, take them to Swellendam yourself, and otherwise, if Jan Scholtz, being the person against whom the aforementioned Dirk committed the theft, wants you there, he can take you there himself." Thus, after preliminary examination of the evidence pertaining to this case, it appeared to the acting remonstrant, subject to respectful correction, that the said van Reenen, by this unbounded manner of acting, has frustrated justice and, in the strictest sense, made himself guilty of a crimen majestatis. That these proceedings, to be initiated by the acting remonstrant against the said van Reenen in conformity with the Instructions on the manner of proceedings in the foremost courts of justice, must absolutely begin with bodily apprehension or at least a summons in person; the acting remonstrant, however, is incompetent to do either without Your Honors' decree. It was made known to the assembled members by the Honorable President that His Honor had expressly called this meeting at the request of the burgher Cornet at Zwellendam, Douwe Gerbrand Stein, who had been with His Honor this morning to present a petition regarding his brother Jacobus Stein, who was placed into detention the day before yesterday, and that His Honor had ordered this man before the council chamber to make his request, and having entered, the following memorial was exhibited by him. 158 159 Your Right Honourable Worships' very humble servant, the burgher Jacobus Stein, makes known, that, having been prosecuted by and on behalf of the Landdrost of the Colony of Graaff-Reinet before this Noble and Honourable Court of Justice in a case of alleged adultery committed with the smith's wife of the Burgher Johannes Adam Raneke, the petitioner, pursuant to Your Right Honourable Worships' interlocutory disposition, was also heard before the Commissioners from this Noble and Honourable Court, and answered to such articles as were presented to him on behalf of the aforesaid Landdrost. That however much the petitioner did confess at the said interrogation that he, the petitioner, had committed carnal conversation with the aforesaid wife of Reineke, the petitioner nevertheless at that time, having given those same answers while in custody, overcome by anguish and fear, was by no means mindful of that which he ought to have advanced in proof of his notorious innocence. And since it has already pleased Your Right Honourable Worships to release the petitioner from his detention on bail, as he believes, on account of the weak evidence in this matter and the denial of the aforesaid wife of Reineke, the petitioner now sees himself afforded the opportunity to submit to Your Right Honourable Worships such circumstances upon which the petitioner can safely trust that Your Right Honourable Worships, according to your well-known equity, will wish to take a favourable reflection concerning the petitioner, who finds himself in the most unfortunate situation. The petitioner therefore takes the liberty respectfully to submit for Your Right Honourable Worships' consideration that according to the opinion of the most renowned Doctors who have written upon the subject of adultery, for the imposition of the punishment stipulated by law, there is required not only full proof by irreproachable witnesses, but also the confession both of the adulterer and of the person with whom he is said to have committed the adultery; and that if one of these requisites is lacking, the Judge is held not to be fully convinced of the fact. If one now puts the case in question to the test of this well-known legal doctrine, one will soon discover that, with regard to the evidence or witnesses in this matter, there is a very great difference from those irrefutable dispositions which are required in the subject case for proceeding in matters of Adultery, since in the entire trial not a single deposition is to be found wherein it is stated that anyone saw the petitioner commit unchastity with the aforesaid female person; on the contrary, the evidence produced on the part of the Officer consists solely of a declaration by the wife of the petitioner, which in law is just as reproachable as the declarations of those who state that they heard the commission of the aforesaid fact concerning the petitioner from the mouth of the petitioner's wife. If one examines, Noble and Honourable Lords, the further requisites in the subject case, one will find that, besides the aforesaid deficiency, there is also lacking the full confession of the wife of Reineke, the said woman having candidly declared before the Commissioners that the allegation of having had carnal conversation with the petitioner is untrue. The petitioner, it is true, as has been said before, admitted before the Commissioners that he believed he had had carnal knowledge with the aforesaid female person, yet he prays Your Right Honourable Worships to be pleased to take into consideration that his wife has already suffered for some years from an ailment, whereby the cohabitation of marital duties was rendered hindered, which has had the deplorable consequence for the petitioner, who is still very young and thus in those years in which one can so hardly resist the motions of nature peculiar to every mortal, that, having fallen into the utmost melancholy, he took a wrong recourse and now and then indulged excessively in drink, on which occasions the petitioner certainly could not conceal his desire, set on fire and flame, toward the aforesaid female person; that the petitioner, having thus believed that in those moments when he was intoxicated by drink he might well have satisfied his animal lusts with the aforesaid female person, the therefore

By the burgher Jacob van Rheenen was presented the following petition. To the Right Honorable Mister Iohannes Isaak Rhenius, President, together with the other Honorable Members of the Council of Justice of this Government. Right Honorable Sir and Honorable Sirs! The undersigned, Jacob van Reenen, makes known with the requisite respect and in the most humble manner, how the petitioner has learned that on the 6. 7ber last, by the merchant and Landdrost at Zwellendam, the Mister Constant Jan Nult Onkruidt, a representation was submitted ex officio, whereupon it was granted by the Honorable Independent Fiscal to have the petitioner summoned in person before this Honorable Council of Justice, in order to hear such criminal claim and conclusion, or request or requests, as the Honorable Independent Fiscal shall see fit to make and take against him, the petitioner, and to answer thereto regarding an alleged crime, by advice given to the executed Hottentot Dirk and release. Then, since in the said representation and the summons derived therefrom it is notoriously implied whether the petitioner had committed the alleged crime regarding the said Hottentot in the capture of his crime for which the same was executed, and thus whether the petitioner has sought to help a murderer with word and deed toward his escape out of the hands of the Judge. At which mere thought the petitioner feels a cold shudder in his heart, to be presented as such a person before Your Honors, and nothing would be more abominable to the conscience of the petitioner than to assist a rogue in his evil and to liberate him from his well-deserved punishment through his help and assistance, and thus to be a cause that such a villain would proceed to further evil and heinous deeds; the petitioner trusts to prove to Your Honors the contrary upon the report of the commissioners regarding a murder committed on the Wife of the burgher B: Rotman, in order to seek out and catch the perpetrators of the said heinous deed. And in order to show his innocence in this executed crime, the petitioner will take the liberty to present this annexed declaration to Your Honors, which, being drawn up according to the truth, just as the matter with the said Hottentot transpired, not in his last committed evil deed, but in a previous, much lesser crime, to the reading of which the petitioner respectfully refers for the sake of brevity. The defendant in person, because his circumstances do not permit him to litigate, requests that this matter may be declared civil and composable. The Officer as Plaintiff refers to his claim, and further leaves this matter to the judgment of the Council. The Council, after mature deliberation of the matter, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, condemns the defendant Johannes Joachimus Theron to be placed on water and bread for the period of eight days, with further condemnation in all the costs incurred in this case. The defendant, having heard this sentence pronounced, most humbly requested that it might please the Council to mitigate the same, for the reason that his wife was heavily pregnant, and he was losing a considerable amount in his livelihood, with the further addition that, in case the Council pleased to take a favorable decision on this his petition, he would in the future carefully guard himself against such improper actions.
