172. 173 Whereas she, the petitioner, on the date of 6 September last, in obedience to your Honors, having appeared in person, the Officer as Plaintiff in his official capacity, as she the petitioner trusts, on the appointed day, requested and obtained from your Honors that she, concerning the aforementioned matter, should be heard on interrogatories under oath of credit vel non. In consequence of which she, the petitioner, having been accurately questioned and confronted several times, now out of detention and in the good conscience of her innocence, continues to persist in the negatives. Yet although the aforementioned Jacobus Stein confessed, and his aforementioned wife, as shamelessly as untruthfully, dared to pretend before the Honorable Commissioners of this formidable bench that she had kept watch, this perhaps derives from the fact that they, after living for a long time in a wholly improper manner in discord, weary of their marriage, of which the Plaintiff ex officio could claim no ignorance, both devised means to have the same dissolved by that way. For, Noble and Honorable Sirs, if this allegation could bear the test of truth, then the accuser would surely have been obliged to communicate the alleged offense directly to the petitioner's husband, as the most aggrieved party, which however did not happen, nor could it happen, since the offense did not exist and the petitioner's husband was too well convinced of her good conduct and never had any grounded reasons to hold the petitioner suspect of such crimes or of that which merely resembles it, and therefore she has the presumption of innocence in her favor. And whereas defense is of Natural Law, which cannot nor ought to be refused to anyone, as the laws themselves teach, whoever he may be and in whatever matters it might be, and the defense must especially be permitted, she hopes to obtain from the equity of your Honors the enjoyment of that right, although the Plaintiff in his official capacity, acting in a criminal case according to the custom of these lands, at the same time takes the place of both Actor and defender. In a matter of such weight, in which she the petitioner, if she were to succumb, which she hopes will not happen, would have to become infamous, which would not only cause great grief of heart to her and her entire family, but would even wound her to the soul and serve as an everlasting shame to her posterity. She, the petitioner, could not acquiesce therein without most respectfully reminding your Honors that according to the ordinance on the manner of proceeding in criminal matters, dated 9 July 1770, article 46, it was enacted: That in all stages of trials, until, take note, the execution of the sentence, all that which shall appear for the exoneration of the accused shall be received. To which end she, the petitioner, will respectfully have your Honors observe that the crime of adultery, according to the general foundation of the Doctors, must appear clearly and evidently to have been committed, either through credible witnesses testifying not from hearsay but from having seen and known it well, or by the event, or by any other means of proof admissible in law. And at least full proof or complete evidence is required, namely in people of conduct suspect in this regard, which in this respect is solidly proved by the criminalist Julius Clarus, Sententiarum, book 5, final question, paragraph adultery, number 2, with which also agrees the lord

174 175 of Mascardus De Probationibus, Conclusion 64, number 13, stating there among other things: Adulterium non probari confessione adulterae vel adulteri, consequently the rules of prudence suggest that a simple confession, much less one extorted through fear instilled by imprisonment, caused by the weakness of the female sex, without being supported by valid evidence, proves nothing to the detriment of anyone. So that the confession made by the said Stein, as well as that brought forward by his wife, as unnatural as it is untruthful, cannot be admitted as valid evidence in law, since the first-named is vacillating and varying in his confession, as appeared from his petition exhibited in Council on the 23rd of September last, alleging that he had been intoxicated, and the wife of the said Stein betrays herself sufficiently by charging the petitioner with the calumny that she had intended to poison her, and solely for having ruined her marriage; and against all which accusations and calumnies of the said wife, who can already with good reason be convicted of falsehoods, the petitioner, deposing more for her innocence, would protest. Wherefore the petitioner, doing that which ought to have been done by her in the first instance, turns with the utmost respect to Your Honors with a very humble and submissive request, that it may please Your Honors provisionally to exempt the petitioner from personal appearance and to admit her to act by an attorney, in order to prove the petitioner's innocence by ordinary means, and to recover the proper evidence for that purpose, and to grant the petitioner a copy of the claim and of all such documents with which the Officer, plaintiff in his official capacity, would wish to take legal action against the petitioner. Far be it from the petitioner to seek to claim that her said husband has not made himself guilty of the alleged crime in whole or in part, as due to her absence at the time, it is unknown to her how the matter of which her husband is accused took place. Yet being well aware that crimes ought to be punished, but the oppressive circumstances in which the petitioner finds herself, and being aware of the noble feeling dwelling in the hearts of Your Honors, she takes the liberty to turn to Your Honors, because already on the said Thursday evening among her slaves, as they find themselves without a master, an uprising occurred and the petitioner's work with molding bricks and carting clay must stand completely still for her, which must cause enormous damage and loss, to which is now further added that her said husband has a corpulent body and very oppressed chest, whereby the Right Honorable petitioner

In the forenoon Extraordinary Meeting, present the Honorable Johannes Isaak Rhenius, President, and all the Members, excepting Mr. van Echten on account of indisposition. On the occasion that the Council was assembled today to review and sign the sentences of the soldiers Coenraad Ringe, Jan Rudolph Muller and Levenus de Baar, pronounced at the recent session upon the prosecution of the Landdrost of Stellenbosch, the burgher Andries Willem van Zaak being summoned into the Council to hear pronounced the verdict rendered in the case between the said Landdrost and the burghers Coenraad Hendrik Feit, Hendrik Albert Feit, Jan Jurgen [illegible] and the burgher Jan Hendrik Steenkamp, he was asked why he had not appeared upon the first summons of the Secretary; whereupon he having answered that, while on his way hither, his horse had fallen with him and hurt him, the said verdict was subsequently read to him. After which, by the sworn Clerk, Mr. Rijno Johannes van der Riet, qualified to represent the affairs of the Landdrost of Zwellendam, upon the exhibition of 3 declarations, a personal summons was requested against the burgher Pieter Johannes du Plessis, as well as a citation by missive under the Council's great seal against the burgher Jacobus du Plessis to testify in this case; all of which was granted to the plaintiff in official capacity, yet he is presently enjoined to obtain further evidence to substantiate this case. After which a request was presented by the Widow of Nicolaas Vlok, the burgher Hendrik Vlok, and the former burgher Adjutant David Malan, of the following content: To the Honorable Johannes Isaak Rhenius, President, together with the Gentlemen Members of the Honorable Court of Justice of this Government. Honorable Sir and Honorable Gentlemen! Show with deep-felt respect Christina Maartorp, widow of the late former burgher Captain at Stellenbosch, Nicolaas Vlok, together with the former burgher Adjutant David Malan: That the petitioners to their heartfelt regret have been informed that the fellow burgher Christiaan Vlok, son of the first, brother of the second, and brother-in-law of the third petitioner, has not shrunk from violating the arrest laid by Your Honors upon a wagon belonging to him, Vlok, which has had the consequence that he has been summoned by the Landdrost of Stellenbosch and Drakensteijn to hear the claim in that regard; and upon which summons having been made he is said to have answered again that he would not appear, even if they wanted to drag him to the gallows; a conduct which the petitioners cannot deny to be wholly contrary to the duties of an honest burgher, while they nevertheless also trust Your Honors will of yourselves deduce from such conduct that it does not correspond with the deed of a person possessing sound mind and judgment, as appears from the [illegible] given by him to the petitioners.

184 185 given answer of not knowing that he had ever made himself guilty of either the one or the other, and which the petitioners can attribute to nothing other than the miserable and, for the petitioners, painful condition in which he finds himself, being so afflicted with epilepsy that the third petitioner, who took him in, out of consideration thereof and the destitute state into which he has fallen through it, taking him into his care, now by no means dares to trust him to go anywhere alone out of the house, so that the petitioners presume the slightest notification of a punishment to be imposed upon him would cause his death, the punishment also, under correction, in consideration of the condition in which he finds himself, the petitioners trust will be pardonable. Wherefore the petitioners take the liberty to turn to Your Honorable Worships, humbly requesting that it may be of your favorable pleasure graciously to forgive the acts committed by their aforesaid son, brother, and brother-in-law Christiaan Vlok on the aforementioned grounds, and to cause the Landdrost of Stellenbosch and Drakenstein to cease all further proceedings, so that the petitioners together, and the first petitioner in particular in her very advanced age, may remain freed from all further lawful grief. Lastly, having been brought to the table the proceedings instituted by the Landdrost of Graaff-Reinet, the gentleman Morits Herman Otto Woeke, in his official capacity, against the burgher Jacobus Stein, Jacobusz, as well as against Maria Magdalena Pietersen, wife of the fellow burgher Adam Johannes Reineke, in the case of adultery committed with each other; these very intricate documents were dealt with and taken into close consideration with all possible accuracy and attentiveness, That although it is true that the aforesaid Stein, in his interrogatory answered before the Commissioners, not only fully confessed the crime of adultery with the aforementioned Maria Magdalena Pietersen, but also at the confirmation completely persisted therein, yet through the obstinate denial of the said Maria Magdalena Pieterse the corpus delicti is lacking in this matter, one can therefore not proceed to the punishments established by the laws for the crime of adultery, nor, out of consideration of the circumstances in which she, Maria Magdalena Pietersen, finds herself, as she was delivered of twins during these proceedings, can the said Maria Magdalena Pieterse be troubled with further investigations concerning this case, in view of the harm which those innocent infants might suffer from one or another disturbance caused thereby; but as nevertheless in the last-held meeting the husband of the aforesaid Maria Magdalena Pietersen, the aforementioned burgher Adam Johannes Reineke, appeared in court with a request on behalf of his aforementioned wife that this matter might be concluded, without the confession of that woman having further appeared; the Council has ripely weighed all these motives and reasons, and judged that in this case, the punishment to be inflicted could not be deferred to anything other than the discretion of the judge, and consequently pronounced the following sentence in this case. That the petitioner therefore on that ground could very easily await the remedies of the procedures initiated against the petitioner; but since the petitioner lives far inland, and the continuation of such procedures could cause him much delay in his business, the petitioner therefore requests that Your Honorable Worships please declare this case civil and composable. Which having been read, the Prosecutor ex officio in his capacity said, submitting three affidavits, that since in deciding a case a judge considers the intent on the part of the defendant, there seems to have been no animus to kill the Hottentot, as is most clearly evident from this evidence, he consequently left this case to the Council's judgment. The Council, having read the defendant's petition and having heard the officer thereupon, declares this case civil and composable, before the Commissioners. After which, by the acting Fiscal, the following report was presented. To the Honorable the President and Council of Justice of the Castle of Good Hope. Honorable Sir and Gentlemen! The undersigned acting Fiscal respectfully shows that on Monday the 15th of the recently passed month of October, it was reported to the petitioner that on the previous evening, a slave belonging to Jacob Snel, who is stationed at the Honorable Company's stables and serving as an overseer on Paarden Eiland, named October, had died a few hours thereafter from blows inflicted by his said master; and the petitioner ex officio having made the necessary searches and investigation regarding this matter, from the collected affidavits and autopsy report annexed hereto, it will appear to Your Honorable Worships that the said Snel indeed first gave his aforementioned boy some light blows with a sjambok, subsequently tied him to a ladder, and continued with blows, taking turns with a sailor, his nephew, until the tendons and buttocks of the slave were completely bloody and bruised, from which he then came to die, though in the opinion of the chief surgeon he might perhaps have been saved with skilled help: That also, according to the testimony of the sailor Hans Christ Kons, the slave had given cause for that treatment because, having unexpectedly entered the house, he had grabbed his master by the legs and thrown him to the ground, then sat on him and held him fast until he was pulled off by the deponent and the aforesaid sailor, and his master was thus freed from him; which however seems subject to some contradictions and doubts, while in the declaration of the slave of the former Lieutenant van de Graaff, it is testified that the master had brought the boy into the front room by the arm, and also in any case the deed itself could not excuse the acting would be able to excuse, so that the petitioner, for the prevention of such very prevalent crimes and excesses and their lawful punishment, feels obligated by his office to gather further information and to institute an action of inquiry against the aforesaid Jacob Snel. Shows with due respect the Landdrost of Stellenbosch and Drakenstein, Hendrik Lodewijk Bletterman: That on the 19th of May of the past year 1786, the Right Honorable Lord Governor having sent to the petitioner a letter addressed to His Right Honorable by the then veldwagtmiddelman in the Hantam, Adriaan van Zijl, and dated 13 April prior, containing a request to be permitted to go shoot elephants and to take some volunteers along; His Right Honorable had told the bearer of that letter that he could not permit such, as His Right Honorable considered that the marauding Bushmen would thereby be given more opportunity to cause damage to the residents there, and also did not know whether he, van Zijl, would have to go out with the planned commandos; the petitioner thus expected of him, van Zijl, not to act contrary to the order of the said Lord Governor, the more so because he shortly before had proposed to the Council of War at Stellenbosch the necessity of a commando to be made against the marauding Bushmen, and to that end had also demanded of the residents living there carts, horses, and provisions to collect powder and lead, and had also received the carts and horses, and did not employ them to that end, and was only on the 6th of June thereafter, upon his request made and reasons adduced in that regard, dismissed from his post. 204 205 And once to the Expositor, the Expositor having expressed to him, van Zijl, his astonishment that he had undertaken the journey against the order of the aforementioned Lord Governor, he had undertaken that he would properly account for himself to his Right Honourable and Respected Sir, with a renewed declaration that he had shot no elephants. That subsequently the burgher Sebertian Valentyn van Rheenen, dated 11 January of this year, having lodged a complaint with the Expositor that the aforesaid van Zijl, having brought a great number of cattle out of the Great Namaqualand, had moved with them near his place there and had the grass cut down before his cattle, requesting that him, van Zijl, be prohibited, and that he should henceforth carefully refrain from doing so, whilst various residents, in the month of February and thereafter, informed the Expositor indirectly that the rumour went that the same van Zijl had brought two hundred and eighty head of cattle, both great and small, into the Hantam, and that he, van Zijl, for his completed journey, had commanded the Baster Hottentots living there and being in the service of the Christians, without any of these reports being capable of being confirmed by any proof, the Expositor since spared no effort to obtain any sufficient proof of the true course of the matter, as he finally in the beginning of the month of August was assured which person brought the letter to the Right Honourable and Respected Lord Governor and what answer he received, as well as that the same had brought back a small soldier's chest with beads and knives received at the Cape from the burgher Stadeler to the same van Zijl, that the Expositor, on these received reports, having written on dates 13 August and 26 September last to the present Field Cornet in the Hantam Willem Adriaan Nel to send up the Hottentots and Baster Hottentots who had been taken along on that journey by the aforesaid van Zijl; there came to the Expositor on the 7th of the past month of October the Hottentot Piet Eiland, as well as the Baster Hottentots Paul and Gerrit, saying that one of the Baster Hottentots had been kept back by the aforesaid Field Cornet Nel, as he also appeared to be a very close relative of the aforesaid van Zijl, and they had also not been sent up by him, Nel, but had already long been intending and had only waited for the opportunity to come make their complaint concerning the repeatedly mentioned van Zijl, whilst out of fear of the Dutch people some of the Hottentots who had been along on the journey had already returned back to the Namaqualand, they gave the following account. had resolved to make all the foregoing known to the Gentlemen, as they were afraid to remain among the Dutch people any longer. As the documents annexed hereto, marked in dorso from No. A to K inclusive, dictate in further detail, and all of which the petitioner respectfully requests that, after Your Honourable Worships shall have ruled thereon, they may be returned to him, the petitioner, in order to be surrendered in justification of his action ex officio. That the petitioner ex officio, under respectful correction, believes that the acts of violence committed by the aforesaid former field-sergeant, Adriaan van Zijl, together with his sons, the burghers Petrus and Johannes van Zijl, as well as the burgher Jan Wiese in general, and that of van Zijl in particular, are of such a nature that they are not only contrary to the natural freedom which the Hottentots, all and especially those who lived in peace with the colonists here, have in common with other free peoples, but also, and primarily, contrary to the repeated orders issued in that regard and the placards promulgated thereon by the government of the country; and that the said acts of violence and the killing of so many innocents are therefore utterly impermissible and punishable in the highest degree, while both the inevitable consequences thereof and an infringement upon the said freedom were found, shortly after the establishment of this colony, to be very ruinous and often irreparably harmful, so that on that account the High Governing Lords Major explicitly wrote to the government here, and whereby the government, by various placards, most strictly prohibited and forbade everyone from committing any violence or molestation against any of the Hottentot nation, by whatever name called, upon penalty that those who make themselves guilty thereof shall be punished as disturbers of the public peace and violators of law and freedom. And it is on the grounds of those laws established against the aforesaid acts of violence that the petitioner, under correction, believes that the nature of the crimes committed by the aforesaid van Zijl together with his two sons and the aforesaid Jan Wiese, both in itself and for the execution of the sentence to be rendered in that respect, requires that the petitioner ought to secure the persons of the aforesaid individuals, and consequently finds himself under the necessity of requesting the necessary authorization from Your Honourable Worships. 222 225 ex officio against Johannes Smit van Dilburg, acting in a criminal case, a decree of bodily apprehension has been granted by this council against the said Smit, and this having been followed by the notation and sealing of the goods of the said Smit. It has been called into great doubt by me whether that notation of the goods of a joint estate between Smit and his wife, whereby that community of property was encumbered and those persons were deprived of the free disposition and administration of their goods, ought properly to have taken place, and that on this foundation: 1. That by the ordinance on the matter of criminal justice in the Netherlands of the year 1870, at the 30th article, it is established that after proper information, the delinquent being imprisoned or summoned to appear in person, according to how that matter shall be disposed, and according to the quality of the accused, those goods shall simultaneously be noted, recorded, and placed into our hands, note bene, in case confiscation, whether according to the tenor of the placarts or otherwise by common law, takes place, etc. 2. That likewise the subsequent ordinance concerning the general style of proceeding in criminal cases of that same year 1570, after having prescribed in several preceding articles when and in which cases a criminal apprehension can and ought to take place, finally in the 5th article dictates in clear words that whenever the crime or the offense shall be such that according to written laws, customs of the places, or our aforesaid ordinance, confiscation of goods occurs or attaches, we order that with the apprehension of persons or decree of apprehension and seizure of the body, which decree must also contain an order of seizure and notation of goods, the officer and the magistrates shall immediately and simultaneously make the aforesaid notation and seizure of goods. 3. That since it clearly appears from the cited articles of the ordinance that the notation of goods is strictly and distinctly determined only in such cases where the crime carries with it the confiscation of goods, without anything in the slightest appearing either in the preceding or in the following articles from which it would follow that in all occurring cases, without any exception or limitation, the notation of the delinquent's goods ought to accompany the bodily apprehension. 4. That neither is any other law or ordinance found, general or local, which prescribes to the judge that upon a bodily apprehension, notation and seizure of the delinquent's goods must absolutely take place. 5. That this law being absent, and the aforesaid ordinances therefore only being able and also having to serve as a rule and guide in similar criminal proceedings and decrees of bodily apprehension, it clearly appears from this that the intention of the legislator is that no notation of goods of a delinquent can take place unless the crime is of such a nature that proceedings can be taken toward the confiscation of those goods, and that thus attached, notorious, and.

226 227 November 1787. follow. 6. that this being firmly established, and it being furthermore accepted that the edict of their High Mightinesses of 10 August 1778 was introduced in all lands and places under their jurisdiction, by which the confiscation of goods for all offenses, large and small, none excluded, has been abolished, quashed, and annulled. thus follows from this my contention that the attachment of the goods of persons against whom bodily apprehension has been granted, without any exception and indefinitely, as in the aforesaid case of Johannes Smid, is solely based on an introduced and accepted custom here in this place, which seems to be legitimized only by custom without the authority of a law, the more so as the precedents thereof demonstrate that in some cases the attachment of goods has taken place and in similar cases again it has not. However, resting for this time and assenting to the attachment carried out on the goods of the often-mentioned Johannes Smit, but only in order to remove doubt in similar matters for the future, it is my opinion that this council ought to address itself to the government here, presenting the case to the same and requesting advice and a resolution thereon, so that in the future it may serve as a certain fixed rule and guideline in the execution of Justice. was signed J: M: Horak in margin: the 22 [illegible] the attachment thereof then also cannot notorious consequence no confiscation of goods Which having been read, Mr. Horak desired that the same should be inserted verbatim into the Minutes, while the majority conformed to this sentiment of Mr. Horak, notwithstanding that Mr. Smuts expressed his utmost astonishment that Mr. Horak, along with all the members, having consented in the previous meeting to the attachment carried out on the goods of the mentioned Smid, nevertheless now again seemed to reject that attachment, or at least to call it into question without deciding the main issue, namely the lawful acceptance of this estate as being a consequence thereof; and the minority, having joined the side of the Honorable President, was fully of the sentiment that the estate of the aforesaid Smit ought to be accepted by this council without any hesitation, liquidated, and subsequently divided between him, Smit, and his wife, adducing as reasons for this position that not only the precedents thereof so abundantly available at the secretary of Justice, but even the still so very recent case of Valentijn van Dappoer, relegated to Robben Island (who, just like the now sentenced Smit, had left behind a wife here in this place), demonstrated most clearly that it seems to have always been, and undisputed by anyone, a constant precedent that the goods of those persons who had undergone a corporal punishment, under which banishment is included, were accepted by the Council of Justice.
