No. 16. 159 To the Honorable and Respected Lord President and Council of Justice of the Castle of Good Hope. Honorable and Respected Lord and Lords. Pursuant to the highly venerated orders of their Excellencies, the Gentlemen Seventeen, per missive dated 21 June of the past year sent to the government of Cabo de Goede Hoop, requiring the considerations of the Fiscal at the time regarding the petition addressed by Daniel Verweij to Their High Mightinesses; and the undersigned having recently received verbal orders to this effect from his Honorable Respected Lord President of this Council, with communication of the original documents, and having examined the same, he now has the honor to observe with due reverence: that it is indeed true that the said proceedings took their origin from the non-appearance of the petitioner, he having been summoned to give truthful testimony in an assault case, but that the same must be attributed not so much to the improper execution of the sentence given by the Council of Justice, as to the deliberate malice and obstinate disobedience of the petitioner. Everyone, being required to do so in a competent manner, is obliged to give testimony; but the petitioner, having been legally summoned and condemned by the court to give such testimony, not only refuses it to the court messenger, but also adds the impertinent and punishable expressions to it, which are set forth more fully in the report of the messenger. The court messenger is authorized, as there is notoriously a great difference in practice between superior and inferior courts, which must be learned by practice; otherwise the notification of the judgment and the appointment before commissioned members from the Council, done according to custom and practice, cannot be recognized as anything other than legal, leaving the petitioner not the slightest excuse. He indeed advances that the matter ought to have been handled in another manner, and that after the rendered judgment the Council should not have interfered in it, but should have let the plaintiff Eksteen proceed by civil detention after the summons and renewal had been made—but who can help it if that Eksteen or his attorney did not know the manner of proceeding as well as the petitioner, who perhaps from the mouth of his advocate in Holland can now reason about the case. However weighty this point seems to be for the petitioner, he nevertheless does not give it as the reasons for his non-appearance and his failure to present himself, but rather a very well-founded fear; the petitioner explicitly saying in the aforementioned answer to the messenger: I will not appear, 160 for nowadays one must be afraid to come near the prison there, while people there are seized in a violent manner and put in the prison; and declaring this in his petition as his excuse, yet with the greatest untruth, as the fear which one naturally had to have with regard to the Independent Fiscal and his conduct, maintained but a short time ago with regard to free burghers at the Cape, whom had been held in apprehension over worthless matters, considering both of them had made themselves guilty of serious crimes, which with regard to them clearly appears from the proceedings, so that the pretext of the petitioner is nothing but a feigned allegation; on which account he remains completely silent about the judicial decree of apprehension, just as he also deceives himself regarding the Independent Fiscal, for the Fiscal was still provisional. The undersigned trusts that, without needing to add a further explanation, the language of the petitioner, which the undersigned, subject to correction, considers to be true defamation, will be recognized, and his malice will be completely visible from it as well as from his other conduct, and that it will no less certainly be concluded therefrom that the petitioner, even if proceedings had been taken according to the aforesaid manner of summons or in any other possible way, in contempt and vilification of his lawful and competent judge, and to defy him, did not want to appear, and as the future has shown, would let himself be found neither willingly nor by force. All this being stated beforehand, the undersigned considers no less that the judge was obliged to act here

to supply and come to the aid, both to be able to give and do justice in the main case, and also to make himself respected, and to that end, being able and permitted to act with the same, just as placing the matter in the hands of the provisional fiscal Mr P. I. Serrurier, who was better able to handle it, in order to do and act against the petitioner as he shall find proper. That this feared fiscal did not immediately make it his business to bring the petitioner to his duty by suitable means according to legal form, and to cause him to be corrected, is, according to the petitioner's assertions, very surprising; all the more so, because pursuant to the two pieces annexed hereto and other circumstances, the fiscal must have known that person to be very suspect and as a man who merited very little indulgence, and who ought indeed to be treated severely as an example, for it will be subject to very little doubt that he did his utmost to help bring about disorder and commotion among the inhabitants, just as one has already been able to observe a great fermentation among a part of them. But here matters were handled quite differently, and this will be the best proof of the falsity of the petitioner's allegations, and of the patience and indulgence of this council and of the fiscal. Here they still took the amicable path and preferred to try and employ all other means before proceeding to such measures, to which, however much they were approved and indicated by the laws, one might nevertheless give a semblance of violence or injustice. Which means were then also chosen by the Lord President and approved by the entire council; and the undersigned believes, subject to correction, that this conduct of the fiscal and the Council of Justice, adapted to the circumstances of the times, is fully to be praised, and ought to have been acknowledged by the petitioner with gratitude. Which, not being done by him, however, must necessarily increase his shame, wherefore the excuses produced by him do not merit the slightest reflection, and the natural consequence of his insolent conduct had to be a decree of summons in person, which produces the second grievance of the petitioner, asserting that according to his proposition, because of the nullity of the same, all proceedings and the sentence rendered thereon must be considered null and void. Secondly, the undersigned does not deny that, according to the prescribed manner of proceeding and the general doctrine of the jurisconsults, the specification of the fact or case is counted among the requirements of a legal summons, and must also [illegible] the summons itself not. Yet it is in no way this summons upon which the judgment was given against the petitioner, and therefore it can just as little involve a nullity thereof. The said summons is rather, like the preceding interlocutory orders, also to be regarded as a means that was employed, and finally had to be used, in order to make the petitioner comply with the first summons to give testimony of the truth, and the immediate consequence thereof upon his non-appearance was nothing other than a provisional order of bodily apprehension. The sentence rendered against the petitioner was preceded by three edictal citations and a fourth citation ex superabundanti, at none of which this petitioner appeared; and not finding this in accordance, the same was the immediate consequence, and no defect being able to be found in this edictal citation, the undersigned believes, subject to higher correction, that the sentence rendered thereon will be no less sustainable. Furthermore, the aforementioned edictal citations containing not only the cause thereof, but a detailed account and the entire matter, not the slightest excuse remains to the petitioner, as he was thereby given the freedom and the way was opened to appear, to defend, and to purge himself. The petitioner being in good faith, his defense would certainly have been heard, but acting in bad faith, and convinced thereof in his own conscience, being unable to bring his pride to desist from his intention of evading justice and treating it with contempt, he rather chose to let himself be lawfully banished in order to live in Europe at the expense of others and to complain of nullity. In dutiful compliance with the order given by the extract resolution of Your Right Honorable and Worshipful Honors of the 11th of December last, concerning the report demanded by the Right Honorable the Lords Majors regarding the course of events and the true state of affairs on account of which the citizen Daniel Verwey fled from here and subsequently addressed their High Mightinesses the Lords States General of the United Netherlands, the Council of Justice of this government has the honor to report in that regard: To the Right Honorable Cornelis Jacob van de Graaff, Governor of Cape of Good Hope and the dependencies thereof, etc., together with the Honorable and Worshipful Council of Policy of this Government. Right Honorable Sir, Honorable and Worshipful Sirs! That when the present Citizen Captain Hendrik Oostwald Eksteen had lawfully sold a piece of land situated right next to Constantia to the citizen Jacobus Arnoldus van Reenen for the sum of thirty thousand guilders, and subsequently, a dispute and lawsuit having arisen before our court between them concerning this purchase and sale, the same was pleaded in the ordinary manner, said Eksteen, during the course of those proceedings, had Daniel Verwey, who has since fled from here, summoned in order to give testimony to the truth in that case, and thus to answer such articles as would be presented to him on behalf of the plaintiff, copies of which were handed to him upon the serving of the citation. That, the citation having been duly served by the court messenger on the 1st of November 1784, the said Verwey had answered thereto, "I shall appear!", without, however, having appeared on the day appointed, being the 4th of that month; but, as was understood, he had seen fit, instead of performing his duty in that respect, on the contrary to go out into the countryside; so that the plaintiff, according to the style of procedure in cases of giving testimony to the truth, had requested default and condemnation for the profit thereof; which having been granted to him, the court messenger consequently went on the 10th thereafter to the dwelling house of the said Verwey, to inquire whether he had returned to the Cape, and then to ask the members of the Council who, as commissioners, were to be present at the interrogation, when they would be available for that purpose; the aforesaid Verwey was found by him at home, but as some people were with him, the messenger called him alone into another room and brought to his notice the aforesaid pronounced judgment, whereupon it was substantially said by the often-mentioned Verwey: "It is an old custom that when someone is summoned to give testimony to the truth and does not appear, judgment is requested by the opposing party; nevertheless, I shall not appear, for nowadays a person must be afraid to go down there near the jail, because people are apprehended there in a violent manner and put in the pillory." That the court messenger, having said to the oft-mentioned Verwey, "I shall ask the Honorable Commissioners when they will sit, and give you notice thereof," the said Verwey thereupon replied: "Yes, that is good, and then I will give you a message in return." The court messenger, having thereupon received an order from the commissioners to summon the often-mentioned Verwey to appear on the 12th of the month of November, notified the said Verwey thereof, he being present, in accordance with the custom of old prevailing here.

That the commissioners, having attended on the appointed day and specified hour, the citizen Jan Smit Jurriansz:, who had also been ordered to appear to bear witness to the truth, did appear, yet not the mentioned Daniel Verweij; wherefore the commissioned members, having reported to the Council on the 18th of that month concerning the insolent and impertinent conduct of the repeatedly mentioned Verweij; it was then, because this tended to the great disrespect and contempt of Justice, deemed proper to place the return given by the court messenger regarding his services into the hands of the then Independent Fiscal Mr. Jan Jacob Serrurier, to the end of repairing the authority and respect of Justice, and the injury thereby done to the Council, to act and proceed in such manner as they should deem appropriate. That the mentioned Lord Fiscal, taking the most lenient path, having caused the aforesaid Verweij to be informed by the court messenger on the 25th of November that he might come to him the following morning; yet the mentioned Verweij was not at home, so the court messenger two days thereafter again repaired to the dwelling of the mentioned Verweij and, finding him at home on that occasion, in the name of the Lord Fiscal appointed him to come to his Honor on Monday the 29th of that month, the repeatedly mentioned Verweij had thereupon said: if I knew that the Lord Fiscal had to speak to me about private matters, I would come; but if the Lord Fiscal wishes to speak to me about other affairs, his Honor must just have me summoned. Of which answer the repeatedly mentioned Lord Fiscal gave notice to the Honorable Worshipful Lord President, and by his Honor a report thereof was made in Council on Thursday the 2nd of December, together with the fact that his Honor, with the approval of the joint Members, had caused the aforesaid Verweij to be appointed to appear before the Council, but that the same Verweij, after having first answered: it is well, I may perhaps speak with you further, had nevertheless on that same day at half past eight o'clock in the evening sent an autograph note written to the court messenger, reading verbatim as follows: Court messenger A. Jurgens I have further considered the appointment of the Honorable Worshipful Lord President and the Honorable Worshipful Council of Justice, and consequently declared, for scrupulous reasons, unable to appear so long as the Honorable Worshipful Council gives me no manifest security that I shall not be troubled on a simple submission of the officer with a bodily apprehension, according to the proofs that I have in my custody, over and besides that the content or the object of the appointment is unknown to me, and which I nevertheless ought to know, as well as whether I must appear in person, or may send an authorized agent. That notwithstanding all the aforesaid gentle treatment and amicable ways that had been chosen by the Council to persuade the aforesaid to his duty as it were, and whether the same Verweij, perhaps misled by bad influence, might have thought better of it and appeared, it being asked whether the mentioned Verweij was present before the council chamber! upon receiving the answer of No: the opinion of the Lord Independent Fiscal was then requested, who thereupon requested a decree by virtue of which he could have the mentioned Verweij summoned in person in order to hear such claim and conclusion or request or requests as he on the day of the hearing should deem necessary to make and take against him; to answer thereto, and further to proceed according to law; which having been granted to the Lord Fiscal, he by virtue of that decree had caused the aforesaid Verweij to be cited to appear before us on Thursday the 16th of the month of December, to which the mentioned Verweij, upon receiving the copy of the citation, had answered: I shall read through the copy of the citation attentively and give you a further answer; just as he then also on the 8th of December at about 8 o'clock in the morning had sent an autograph note to the court messenger of the following verbatim content: This serving as a verbal answer. I do not accept the citation and protest against the costs, because I see from the citation that I have been summoned criminally by the officer, and the description of the alleged criminal act is omitted therein, which I nevertheless ought to know in order to be able to answer thereto or to propose an exception to the incompetence of this summons in criminal matters. List of such to appear in our council at an appointed time and to purge and account for himself regarding his perpetrated impertinences, obstinacies, and brutalities toward his lawful judge, which edictal citations, on account of his non-appearance every 14 days, have been published to the point of superabundance. That the aforementioned Daniel verweij, not having appeared after the fourth citation by edict, the Lord Fiscal, submitting the muniments held in his hands, orally served an intendit, and therewith took conclusion according to custom, upon which the repeatedly mentioned verweij, as defaulting and in hiding, was by sentence banished forever from this government and the jurisdiction thereof; on penalty that, whenever falling into the hands of justice here, he shall then be punished according to his deserts, with condemnation of the same in all the costs incurred in this lawsuit. This elaborate narrative, Right Honorable and Most Respected Sirs, drawn both from the documents and the criminal rolls, contains the essential cause, circumstances, and the entire course of the matter against the frequently mentioned Daniel verweij, converted by his own impertinent actions from a civil into a criminal matter, considering that, had he, upon the summons issued by the Burgher Captain Hendrik Oostwald Eksteen, being a matter of burghers against burghers, appeared according to his answer given upon summons, just as the burgher Jan Smit Jurriansz who was summoned alongside him had appeared, everything would have reached its settlement and conclusion, notwithstanding that it appears from the proceedings exchanged between the mentioned Eksteen and van Reënen that the mentioned verweij not only unlawfully interfered in that matter, and thus hesitated to give testimony to the truth, but rather thought fit to conduct himself in a brutal manner in that matter. The Council of Justice is therefore very much astonished that the mentioned verweij, although he is convinced in his conscience of the deliberately committed evil and punishable steps, to the disrespect and injury of his lawful judge, nevertheless dared to use the arrogance, and to address their High Mightinesses the Lords States General of the United Netherlands with a complaint contrary to the truth, and thereby sinisterly posited that the Messenger of Justice had come to inform him, in the name of the plaintiff Eksteen, that he had to appear before commissioners to answer interrogatories, whereas the same was indeed done in the name of the commissioned Members of Justice, who as such had to officiate at the interrogation, and thus according to the ancient practice of proceeding introduced in this government, where this custom, because of the vast extent of this colony in which the inhabitants live so widely scattered and far inland, is the only way the mentioned messenger can do the same without ruin to the inhabitants; as has also always been followed by every one of the good inhabitants, as well as previously by the mentioned verweij himself. What the repeatedly mentioned verweij now further pretends, regarding the citation that the Lord Fiscal had served upon him, accompanying this in copy under Letter D, namely that the same had not contained the cause for which he was summoned, in that respect the council must state that the same has been a constant custom here for many years, and was always in practice even by the two very legally learned Lords Independent Fiscals, the Lords Mr. Joachim van Plettenberg and Willem Cornelis Boers; therefore this pretext alleged by the aforementioned verweij was certainly solely brought forward by him to give an appearance to his deliberate ill will; considering that, according to our preceding narrative, it was more than well enough known to him why he was summoned by the Fiscal, who, like us, attempted to handle the matter in the gentlest manner; thus thereby all ignorance must vanish; and of that same alloy is his feigned fear; therewith he also completely exposes his entire malicious nature, referring in that respect to two insolent inhabitants who, for committed acts of violence, the one because he attacked and mistreated with blows, without the slightest reason, a soldier stationed at this Castle on the public road, and the other because he attacked a European servant of justice, who had been placed on duty at the burgher exercise to prevent all irregularities, and hindered him in the execution of his orders; for which extreme offenses the Fiscal, after production of evidence, having requested and obtained apprehension from us, those two persons were then also punished according to the findings of the case. And therefore, as much as weather and wind permitted, had brought fresh air on board by means of the ventilator and the windsail, and furthermore, in a word, performed everything that they in good conscience could have thought would be of the greatest benefit to the crew. All of which, however, had not had that desired effect of checking the disease raging among the ship's crew during the voyage, which mostly consisted of persistent low fevers that subsequently turned into putrid fevers, the chief cause of which, according to the declaration of the surgeon, must be attributed to their long voyage and the rough weather; whereby the number of dead had risen to 72. The surgeon finally declaring that he had received from the captain not only everything he demanded for the restoration of the sick without any reservation, but even, for the benefit of the sick, had the free disposal of the provisions and refreshments brought by the captain for himself. Having in our said letter of 15 August made our dutiful report to Your Noble High Mightinesses regarding the damaged condition in which the ship Java entered False Bay on 1 June, and the resolution we were forced to make to have that vessel, after the expiration of the customary laying time in False Bay, sail to this roadstead, we cannot omit informing Your Noble High Mightinesses that said keel left its anchorage on 8 September, and reached this roadstead on the 15th following. to offer an authentic copy of a missive written under date of 12 August to us by Captain François Duminij and Shopkeeper Egbertus Bergh, commissioned to load the Meermin to Plettenbergs Bay; from which Your Right Honorable Nobilities, if it pleases you, will be able to perceive how, by a special dispensation of Providence, on the 13th of that month, the chartered ship de Maria, which departed on 2 April of this year from Gale with orders to sail past the Cape, came to anchor outside the aforementioned bay; that upon distress shots having been fired, the Commission had resolved to render the necessary assistance at a distance of 3 to 4 miles at sea, in which they were so far fortunate that this vessel on the 16th following happily made port inside the aforementioned bay, but in the most lamentable condition, as of the 40 Maria hands who formed its crew upon its departure from Gale, 21 men had died during the disastrous voyage, and the remainder were so severely afflicted by scurvy that only the skipper, one sailor, and three boys found themselves in a state to perform any duty; that of the ship all the body seams above water had opened up, and the pumps, with the water standing 6 feet high in the hold, had become foul, while all the standing and running rigging was so distressed that the masts with the slightest wind ran the risk of falling overboard, whereby the skipper Pier Leskes had already had to take the decision to run the ship aground at the first rough weather or loss of anchor cable; that since this had happily been prevented by the relief brought in that pressing emergency, they had only contemplated means to further secure that vessel and its precious cargo, and to enable it to prosecute its voyage to this capital; that to that end they had placed on the Maria a lieutenant, an assistant surgeon, and 20 commoners, all belonging to the crew of the Meermin; that they had ceded to the Maria the heavy anchor and cable provided by us to the ship the Johanna Jacoba for its expedition to the Mosselbaaij and taken over there by the Meermin, all on condition that such compensation for the rendered assistance shall have to be made by the owners as we should find proper; that the aforementioned crew would be employed to caulk the hull without any loss of time, to repair the rigging, and furthermore to bring everything into such order that that vessel could undertake the voyage to this roadstead with confidence, which according to the opinion both of the commissioners and of the skipper, could have taken place on the 5th of the past month of September: However much we considered ourselves fortunate upon the receipt of those tidings, that our expedition to that bay had given occasion to the preservation of a precious return for the Noble Company, and to the rescue of a number of wretches who, without the rendered help, would have become a prey to the waves, so much were we also struck by the reports that soon followed these agreeable tidings; contained in a missive addressed to us under date of 26 August by the aforementioned Commissioners Duminij and Bergh, and one by the Skipper Pier Leskes, together with a report made by the Commander of the Meermin, Arij Sijn, upon his arrival here, all these accompanying in authentic copy; from which Your Right Honorable Nobilities, to our bitter regret, will perceive that a storm that arose from the southeast on 25 August in Plettenbergs Bay caused the leak to increase so much through the motion of the ship that that vessel could by no possibility be kept above water, and would certainly have sunk at its anchors had not the skipper and the second mate taken the resolute decision to run the aforementioned ship the Maria aground the next day, where that vessel, notwithstanding all applied effort and zeal, is now completely smashed to pieces, and with the crew nothing else was saved than: 233 packages of linens in sort 6038 pieces of linens ditto 7 bales of coarse cotton yarns 100 cinnamon 5 cases of gum myrrh 1 pipe of coconut oil 2 wagonloads of sappanwood 10 empty whole leagers 15 ditto half ditto, and 10 ditto half ankers all according to this notice accompanying in authentic copy, handed over to us by the Commissioners Duminy and Bergh, from which Your Right Honorable Nobilities may please to see how the mentioned goods are conditioned. one shall make such arrangements and measures as shall be deemed most serviceable, not only for the preservation of the goods already salvaged, but also for the further rescue and recovery of that portion of the cargo of that vessel which may still with any possibility be retrieved from the beach and from the wreck; furthermore, after those arrangements and estimates shall have been established, to proceed punctually in accordance with them, both in the washing, storing in the warehouse, and guarding of those goods, carefully preserving the already salvaged cargo from further damage, and in this doing and performing everything that shall be found to pertain in any way to the greatest benefit and advantage of the Honorable Company. And whereas the Master Pier Seskes, by the aforementioned letter, made a request to us to have the wreck of that ship, together with such equipment goods as could still be salvaged from it, sold by public auction in Plettenberg Bay, we have further qualified the aforesaid appointed Commissioners, whenever the said Master might come to require it, whether on account of the owners of the aforesaid keel, or for that of the underwriters, or such persons as the Master shall indicate, to sell publicly the wreck and whatever further belonging to that vessel shall be pointed out by the Master, with orders to the Auctioneer of this Government to transmit the auction roll thereof, and to give us notice of all their dealings and actions in their aforementioned capacity as often as the opportunity shall present itself. And whereas we have seen from the notice sent to us by the repeatedly mentioned Master Seskes that some goods had been brought by him which could not be sold in Plettenberg Bay with much peace of mind, we have ordered the Commissioners there, on our behalf, to instruct that the cannons, swivel guns, and boats not be sold by auction, but upon his arrival here be ceded to the Honorable Company by appraisal, and have at the same time determined for them up to what prices they may purchase for the account of the Honorable Company at the auction to be held the salvaged pumps, sails, and grapnel. We have also qualified the undersigned Head Administrator, Cellar Master, and Dispenser to devise such means as they would deem best able to enable the newly appointed Commissioners to execute this commission to the greatest benefit of the Honorable Company. And their Honors having submitted to us a Memorandum of Considerations thereupon, of which we take the liberty to offer Your Right Worships an authentic copy, and the matters dealt with therein having been found to agree with the dear interests entrusted to us, we have placed a copy thereof into the hands of the repeatedly mentioned Commissioners, in order that the arrangements made therein might serve for their guidance. However, as the aforementioned Naval Captain Francois Duminij and Winkelman Bergh, having returned a few days ago from Plettenberg Bay, submitted to our Meeting a Memorandum of remarks concerning what was to be done by the Commissioners sent in their stead with regard to the handling of the salvaged goods, we take the liberty to supply Your Right Worships with an authentic copy thereof, having dispatched a similar one to the Commissioners to Plettenberg Bay with orders that it serve for their guidance, and granted them such qualification as is stated at the end of the same Memorandum, and appended thereto a list of the bales, cases, etc., of the goods loaded by the Ceylon Government into the Maria, indicating which are consigned to the Amsterdam Chamber and which to the Middelburg Chamber; in order to be able to keep as pertinent a record as possible of how much of the salvaged goods belongs to each of those Chambers, whereof we shall dutifully report to Your Right Worships in due time, hoping that our actions in this matter may be crowned with the approval of Your Right Worships. Upon the arrival of the said Commissioners Duminij and Bergh, they delivered to the Political Secretariat eleven packets and letters addressed by the Ceylon Government both to Your Right Worships and to the Right Honorable Lords Directors of the respective Chambers per the ship the Maria, and handed over to them in Plettenberg Bay by the Master of that vessel. We have deemed it necessary to make respectful use of this opportunity, in our aforementioned writing, to supply the aforesaid packets and letters to Your Right Worships, and have formed a separate packet and register thereof. One of the letters having been delivered by the Master entirely damaged, this will apparently be due to the confusion that prevailed during the stranding of his vessel, and the urge to secure the Honorable Company's papers.

202 Letter of August 15. Having dutifully reported to Your Right Honorable Worships the harm caused to the Honorable Company by the egregious malversation and theft of the former First Sworn Clerk at the Political Secretariat, Johannes Martinus Horack, and the Assistant Luisz Mollerström, we now take the liberty to inform Your Right Honorable Worships: that both have been summoned for the fourth time, ex superabundantia, by the ringing of the bell by the Court of Justice, without appearing before the said Court, nor has it been possible to discover where they reside or whither they have fled. Meanwhile, the Court of Justice has sold the goods and effects of the said Horack and Mullerström consecutively on September 2 and 3 and October 1 by public execution, in order to recover the damages of the Honorable Company from the proceeds thereof; we shall not fail, as soon 203 as the documents belonging to that matter come into our possession, to provide Your Right Honorable Worships with a detailed report of the same. The farming out of the Public Revenues having taken place, as usual, on the 30th of the said month of August, it gives us particular pleasure to be able to report to Your Right Honorable Worships that the same yielded ƒ 216,800 Indian valuation, and thus ƒ 23,000 more than the past year; assuring Your Right Honorable Worships that we shall leave nothing untried that might in these times, so worrisome for the Honorable Company, in any way serve to increase the Public Revenues. The Gentlemen of the Supreme Indian Government having informed us by their esteemed letter of March 3 that Their Right Honorable Great Worships 204 had permitted Military Captain Le Clercq to sail from Batavia hither, the said Le Clercq also arrived here with the Chinese return ship Voorschoten, and shortly after his arrival presented to us a petition, an authentic copy of which we take the liberty to present to Your Right Honorable Worships, requesting to be employed here in his aforesaid capacity among the Honorable Company's militia; but, finding ourselves qualified by no orders thereto, we rejected that request, as well as the one that followed, contained in a similar petition and enclosed herewith in like form, for the purpose of obtaining copies or extracts of some letters concerning him, both addressed to us by the aforementioned Gentlemen of the Supreme Indian Government, and written in private by His High Noble Honor the Governor General, and the Gentleman Governor of Ceylon to the undersigned Governor, 205 as we consider that no one is entitled to demand copies or extracts from a Governor of a correspondence existing between the Supreme Ruler of the Netherlands Indies and him, just as little as a Governor is bound to grant them, or, as Captain Le Clercq seems to believe, can be compelled thereto by the body of the government; we have only granted him leave to depart for Europe, and shall, whenever the opportunity arises, grant him the requested written permission; hoping that our actions regarding the said Le Clercq may meet with Your Right Honorable Worships' approval. The repeatedly mentioned Gentlemen of the Supreme Indian Government were also pleased to inform us by their aforementioned missive of the dispatch of the General Report of Affairs for the Presidial Chamber Amsterdam and the two Chambers of the Northern Quarter, via the Chinese return ships Barbesteyn and Voorschoten, which have arrived here, with orders 206 to unload the chests in which it is contained from those vessels and to transship those chests onto a ship bound for the Presidial Chamber Amsterdam, or another ship entering the Texel; we shall dutifully execute this at the first opportunity. We also consider it our duty to bring to the knowledge of Your Right Honorable Worships that on the 16th of this current month the following five French Royal ships appeared in False Bay, namely: The frigate La Nimphe, commanded by the Monsieur de Pournoue, Rear Admiral; The store-ship La Trompeuse, commanded by the Monsieur Marquis de Grasle; 207 The store-ship Le Marsouin, commanded by the Monsieur de La Tullaije; The store-ship L'Etoile, commanded by the Monsieur Toucaud; The frigate La Penelope, commanded by the Knight de Braze; The last of which was wrecked in an extraordinary manner by its commanders near the Honorable Company's post Muizenburg, and being already partly shattered there, the crew, however, was for the greatest part saved through the assistance provided. 216 To the Right Honorable Sir Cornelis Jacob van de Graaff Governor and Director of the Cape of Good Hope and its dependencies etc. etc. etc. We deem it our duty, under dispatch of an express, to inform Your Right Honorable that the flute ship the Maria, coming from Ceylon, which departed on the 2nd of April of this year under the command of Captain Pieter Seskes van Galen, with orders to sail past the Cape, by a singular disposition of Providence, just while we find ourselves here and in a position to be of use and assistance to it, first on the 13th instant opposite the Robbenberg, and subsequently, with the help that we caused to reach it upon discovering the distress signals at a distance of between 3 and 4 miles out at sea, safely came to anchor in this bay yesterday. During the disastrous voyage of this vessel, out of its crew consisting of 40 hands, 21 persons have died, and the remaining crew are suffering from scurvy to such an extent Right Honorable Sir. No. 6. that No. 21. 217 that only one sailor, three boys, and the skipper are able to do any duty, while the following defects also occur on the vessel: that all the upper seams above water have opened up and the pumps, by which the water stands up to 6 feet high in the hold, have become choked, while all the standing and running rigging is so ruined that the masts ran the danger of falling overboard with the slightest wind, whereby the resolution had even already been taken to run the ship aground at the first foul weather or loss of anchors; in order to offer all possible assistance to the aforesaid vessel in this pressing distress and to enable it to undertake the voyage to the Cape roadstead with peace of mind, subject to the approval of Your Right Honorable and our further principals, we first transferred onto it as many craftsmen and sailors from the Meermin as could conveniently be spared, since that vessel is now fully laden and preparing to depart from here again within a few days, as well as the men assigned to the line who had been doing duty here ashore, with the intention, after the hull is caulked, the rigging repaired, and everything further put in order, at the request of the skipper and because of the interest that the Company has in the preservation of this vessel, whose cargo according to his statement is estimated at more than seven tons of gold, to leave on board 1 under-surgeon, 1 carpenter, and 25 privates with Lieutenant Tredoux, as well as to cede and deliver to him the heavy anchor and cable that had been added to the hooker the Johanna Jacoba for its expedition to Mossel Bay and had been taken over there by the Meermin, on condition that, both for this and for all further conveniences and assistance to which the Company is not obligated but which might be rendered to him given the circumstances, there shall be paid as much as the government shall see fit to charge to the account. That when the pieces have been taken over according to their sorting pursuant to the inventory, one should subsequently continue to further rinse what has not yet been rinsed, and store it dry with the previous goods; which should likewise be done with whatever may subsequently still be washed onto the beach by the sea, being permitted to spend on slave hire and for hauling the packages as well as washing out the linens that money for which Messrs. Duminy and Bergh have agreed, unless one could negotiate a more modest price for the benefit of the Company. 2nd. Since the colored linens, if only dried, 224 run a very great risk of rotting again when packed in that manner, the undersigned judge that they should likewise be washed just like the white linen, all the more because once having lain in seawater, it never becomes dry. 3rd. It will be expedient that the linen is again placed in the sun to dry for a couple of hours before it is folded and packed, as experience has repeatedly taught that if this is not done or if the slightest moisture is present, the packed linen soon rots. 4th. Care must be taken that the goods are accurately sorted, packed like with like, in order to prevent all confusion in this regard. 5th. The damaged salvaged linen should be used for linen packaging, and this must first be rinsed in fresh water, just like the good linen, before it is used for the aforesaid purpose. 6th. After the packages are subsequently bound with rope or line, the outermost packaging must be made of the gunny in which the linen washed ashore; by placing the old marks on the inside, one can then mark the numbers of the packages, the quantity, and the sorting of the goods on the clean or outer side. 7th. If among the washed linens there should be some that are unknown to the gentlemen, a small piece of linen must then be taken from each bale, and this, having been marked the same as the package, must be filed with the invoice. 8th. Since it is not apparent that one will have as much gunny on hand in proportion to the quantity of linen needed for packaging, the shortage could very easily be supplied from the sails of the wrecked ship, which, if not running too high in price, could be purchased for that purpose for the Company; and this could likewise be observed with regard to the old untarred cordage for binding the packages. 9th. The new sailcloth and the line are only provided to be used in case of great necessity, and if they are not used, or if a portion thereof remains, they must be brought back to the Cape, as well as that portion of sail yarn, etc., that remains. 225 10th. Every care must be taken that, once the packages are put in order, they suffer no leakage in the warehouses; to prevent which, an accurate inspection must be held during rainy weather. 11th. The nails and other carpenter's tools are also provided in case they are needed, if the warehouses standing there in Plettenbergs Bay should not be large enough to store all the goods therein, in order to erect a wooden shed with them for the storage of the remaining goods. 12th. Every precaution must be taken that the goods are not stolen, and it is therefore most essential that they are brought under lock and key as soon as possible, or surrendered to the military guard if this cannot be done quickly enough. 13th. On every occasion, notice must be given to the Governor and Council as to how far one has progressed with this commission, not leaving the bay except with the prior knowledge of the government. Having made the aforesaid remarks, the undersigned further leave it to the commissioners to do whatever they deem further necessary in accordance with the Company's interests; and upon their return, that amount which they were obliged to spend during the journey will be reimbursed to them from the Company's treasury.

at four o'clock, in order to prevent that which was brought out of the warehouse for drying, being placed back inside while still damp, as would otherwise have to be the case, and thus the time and labor having been spent uselessly. 4: On the occasion of this re-drying, not only to sort the linens into their varieties, but also to separate the damaged from the good, and to stack the one as well as the other lightly upon each other again just as they are now found, and to let them lie in this manner until Your Honorable and Right Worshipful Sirs shall have finally disposed of the use which shall be made of them. 5: In the event that Your Honorable and Right Worshipful Sirs resolve to have the entire quantity of the aforesaid linens packed and transferred hither, and orders to that effect are received, to follow literally in this matter all that has been prescribed for their observance in Articles 5, 6, 7, 8, and 9 of the above-mentioned Instruction, observing only that the outer packaging of the packs or bales be made preferably from the gunny that had served for that purpose, and that the binding likewise be done with the same coir rope that had been used for it, which, just like the gunny, letting through less moisture than the sailcloth, and the coir rope not causing as much staining as the domestic ropework, the packed linen thus conditioned will be best preserved against all damage. 6: But if it is resolved to dispose of a batch of those linens in Plettenbergs Baaij, since it is apparent that these, consisting mostly of such sortings as are very much in demand among the country folk, will yield much money there, then first and preferably to pack the finest, best, and undamaged portion; and when this has been done, should it be found that there still remains more than the quantity determined for sale by Your Honorable and Right Worshipful Sirs, subsequently also the coarser and damaged ones, making in both cases the packs no larger than of 30 pieces each, since the shipping of everything that must be kept from getting wet is accompanied by very many difficulties in Plettenbergs Baaij, because one is at present still poorly provided there with all necessities, which difficulties would become considerably greater if one wished to continue the previous contents of the aforesaid bales, as their volume would then cause that one could not get them embarked from shore into the flat-bottomed vessel, and from there further into the shallops and boats, except with the utmost difficulty. The inspection of the linen warehouse ordered in Article 10 to be performed with all accuracy during rainy weather, not only when the packing has taken place and the packs have been put in order, but also now immediately, as the stacked loose linen, meriting quite as much attention as the packs could do, must thus also be watched with just as much care, and upon discovery of any leakage, both by changing the place of the linen and by employing other suitable means, to prevent the damage in time. 8: For the security of the warehouse, only to continue those measures which the undersigned themselves have devised and put into effect; the doors have already been put under lock, and a part of the necessary military guard was present and in activity long before their departure from yonder. 9: To make no unnecessary expenses, but to observe the greatest economy in everything, as the unavoidable expenditure and costs will already press sufficiently upon the Company, and consequently not to proceed with the construction of sheds or other buildings, as that part of the timber warehouse which has been partitioned off for the storage of the linens is not only sufficient for that, but even large enough to contain all that has already been saved of other articles or shall yet come to light and must be sheltered under cover; while for the lodging of the military guard, which, with the reinforcement that departed from here, besides the officer, consists merely of a sergeant and 8 privates, there is provisionally sufficient the small wooden board house standing by the aforesaid warehouse, which had belonged to the burgher Tarling, which the undersigned have purchased for the aforesaid use on account of the Honorable Company for a small sum of 30 Rixdollars; wherefore, according to the opinion of the undersigned, the authorization granted to the commissioners in Article 11 of the Instruction ought then also to be revoked. Goets Clercq. 237 No. 13 To the Gentlemen the Governor General and Councilors forming the Council of Government of the Cape of Good Hope Mr. the Governor and Gentlemen The Sieur Le Clerc, Captain Commandant of Infantry in the service of the Noble Company in its national troops and commissioned by the Sovereign Chamber of the Seventeen, has the honor to represent to you that he traveled here from Batavia to resume active duty in his service, having obtained this from the High Government of this headquarters of the Noble Company's establishments, and that he sees with the greatest surprise and grief that he is threatened not only with not obtaining it here, but even with being deprived of the salary and emoluments attached to his post; he says more: of the means of existence of which the Noble Company is very far from wishing to deprive any of its servants, and that because the High Government of Batavia supposedly omitted some words in its letters to better express its intentions. The Sr. Le Clerc therefore beseeches you, Mr. the Governor and Gentlemen, to be pleased to allow him to enter into his military duties; he is all the more eager to solicit you for this as rumors of an impending rupture are being heard, and he would lament all his life having been prevented by his superiors themselves from displaying his zeal for the service of the Noble Company and sharing the glory of his comrades. Whatever resolution you may be pleased to take in this regard, Mr. the Governor and Gentlemen, the petitioner flatters himself that you will grant him to draw the pay attached to his rank, since the letters from Batavia must contain that the Sr. Le Clerc traveled to the Cape of Good Hope without salary, and not to be there without salary, which is entirely different, for he is not unaware that the Company's regulations provide that an officer who desires to change posts may obtain it, but that he is suspended from his salary until his arrival at the destination granted to him; may it please you to observe, moreover, that the sole character of Captain of the petitioner makes him guarantor of what he will draw, so that consequently the Noble Company will never be able to risk a loss of it, and that far removed as the Sr. Le Clerc currently is from Holland, from Batavia, and from his family, the Noble Company will certainly approve that the Council of the Cape has prevented the embarrassment in which this officer would find himself, through no fault of his own, but by a mere oversight of the Government of Batavia, if he were to experience a refusal here.
