to serve as a report on this matter, the undersigned, in dutiful fulfillment of the aforementioned request made of him, has the honor to state that, since he could not know from his own experience, given the short time he has been placed in this administration, what wheat would be needed for a full year, and having therefore been obliged to take recourse to the books of the past year, he discovered from them that of the 30799 Muddens purchased from the farmers, 17892 muddens were consumed for the General expenditure of the Honorable Company at this place and for the provisioning of its ships present in Table Bay and False Bay, as well as for those of the State's warships calling here, while the remaining part was sent to the Indies; and since from that specified number of 17892 muddens, 2004 Muddens were provided as rations to various posts instead of rice, it is most likely that this practice must be continued annually, as the provision ship normally sent hither from Batavia is by no means capable of delivering all the rice for this Government that is required for the burdens here that have increased from time to time; and the consumption being therefore to be estimated at not much less than 18000 muddens, it consequently follows that, if one wishes to have a year's supply in reserve, another 18000 muddens will necessarily be required for that purpose; which 36000 muddens, added to the approximately 16000 Muddens that will be needed for dispatch to India, when according to old custom the demand from Batavia is calculated at 750 Lasten or 13875 Muddens and that of Ceilon at 1850 Muddens, together making 15725 Muddens, it naturally follows that the Company's Magazines must be replenished with 51 to 52000 Muddens of wheat, both for own use and for shipment to the aforementioned establishments, before one can count on having a year's supply in reserve for this Government, excluding the Indies. However desirable it might be, particularly in view of the daily increasing personnel and the troops currently present, that one could reach that quantity determined above as soon as possible, in order that the Company, in the event of a bad corn harvest, which God forbid, might not again be exposed to paying exorbitant and unheard-of prices, to which it was subjected not long ago, the undersigned nevertheless doubts whether that specified stock can be reached all at once, since in an abundant harvest, of the 80000 Muddens more or less gathered by the farmers and transported towards the Cape, around 35000 Muddens are sold both to the privileged bakers for the continuation of their trade and to other private inhabitants for their own domestic consumption; which difficulty, however, does not prevent that, if not in one, then in two good years, one could arrive at that specified quantity of 51 to 52000 Muddens, which the undersigned, subject to respectful correction, also believes would best serve the Company's interest, as having to purchase it all at once would encounter very great difficulties in buying it for the fixed price of twenty-four rixdollars after deduction of the legal tithe. The undersigned, flattering himself to have concluded herewith all that was required of him concerning the quantity of wheat and how large that stock ought to be for an upcoming year, will now proceed, having determined the space currently available, to further report to Your Right Honorable and Worshipful Sirs what storage space would be lacking and further needed for the surplus that he will be obliged to purchase upon obtaining authorization from Your Right Honorable and Worshipful Sirs. Regarding then the first point, namely the space that is currently available, the undersigned has the honor, although this is sufficiently known to Your Right Honorable and Worshipful Sirs, to bring to your knowledge once again that it consists of three storehouses of three stories each, built in the time of the Right Honorable Governor Rijk Tulbagh of blessed memory, which internally measure 142½ feet in length and 16 1/3 feet in width, the upper floors being a few inches wider due to the setbacks of the walls, and a loft of the double storehouse standing beside the dwelling house of the Lutheran Minister, which previously belonged to the burgher surgeon Johannes Jacobus van den Bergh and was purchased from the same.

the same was purchased for the service of the Honorable Company, the length of which amounts to 201¾ and breadth to 41½ feet, in which three warehouses, according to the calculation made, the quantity of 20000 muds, and on the aforementioned loft 7000 muds, thus in all of the same together 27000 muds of grain can be stored. That although in the mentioned warehouses no more can be stored at the same time than the already determined number of 27000 muds, because one must preserve it carefully, both against spoiling and weevils and other harmful insects, which in this hot climate merits no small attention, the undersigned nevertheless does not find himself hindered from receiving therein all the grain that one is obliged to store for a whole year for this Government as well as for shipment to Batavia and Ceylon, amounting to circa 34000 muds together, since the collection does not take place at one and the same time, but successively during several months, there being in the meantime opportunity to be able to ship that which is demanded from India, which means then brings about that sufficient necessary space remains for that portion which serves to be retained for the service of this Government for the current year. With respect now to the second point, namely the storage place which would be required for the 18000 muds that one would wish to have in stock for a year, the same cannot be determined at much less than another three warehouses, each of three stories high, just as currently stand on the seashore for the storage of wheat, which may however be a few feet shorter, as in the previously mentioned three warehouses 20000 muds can be stored and in those to be constructed only 18000 muds need to be laid away, while the construction of the same would best take place either on the grounds of the so-called old silk spinning mill, or on that portion of the unbuilt field that runs adjacent to the newly made canal passing by the Lutheran church, since those places being the most suitable, the warehouses there would not be so exposed to fire in case of an enemy attack as a large part of those currently on hand, which happen to be close to the sea. And as for the watching over and working of a quantity of 18000 muds of grain more than ordinary, proportionally assistants will also be required, the undersigned has simultaneously examined what personnel he would indeed need for this, and it has appeared to him that if one wishes to keep preserving that stock against decay just as one is accustomed to do with the ordinary on hand, the undersigned dispenser must then necessarily, in addition to the people he actually has at his disposal to that end, be provided with: a European butler and twelve slaves; as the first-mentioned serves to function as supervisor and the last-named ought to be kept for the working of that grain. Herewith trusting to have complied with the honored intention of your Right Honorable and Honorable, the undersigned for the rest submits this for humble report. was signed W. the warehouses and buildings purchased from the burgher Johannes Jacobus van den Bergh, and situated in the upper part of this village, have been employed for the quartering of the artillerymen and the storage of a part of the artillery; and a warehouse and loft bought from the late Engineer Cloete was placed at the disposal of the Lord Dispenser, while the warehouses formerly belonging to the widow of the late skipper of the Honorable Company, Hendrik Schreuder, and rented from her for the housing of the French auxiliary troops, and subsequently bought by the aforementioned van den Bergh, and when he no longer wished to lease these buildings to serve for the housing of soldiers, they were sold again by him to the Honorable Company, have served, first for the quartering of the Legion of Luxemburg, and subsequently of the regiment of Meuron, until, when the aforementioned van den Bergh, having bought the dwelling house and the warehouses standing behind it from the repatriated Lord Dispenser, Mr. van Schoor, and he, as requiring them for his own use, came to reclaim those warehouses and the lofts above them, all of which had been rented from the aforementioned Mr. van Schoor for the storage of the Honorable Company's wines as well as grains, and one of the completed wings of the hospital could be occupied by the regiment of Meuron, those buildings were used instead of the aforementioned warehouses of Mr. van Schoor for the storage of wine and grains, for which purpose they still serve at present, while the second undersigned, taking the liberty to refer to what the first-signed Gentleman has advanced, for the sake of brevity will only add that the aforementioned warehouse bought from the late Lieutenant-Engineer Cloete, and which building, besides another loft which one was obliged to rent, serves for the storage of the rye, barley and flour, had to take the place of the so-called Silk Mill, which building had to be employed for the partial housing of the sick, your Right Honorable and Worshipful Honors will be able to see from the accompanying specific statement of the warehouses and lofts used by the undersigned for the storage of all that belongs to their administration, that they are scarcely sufficient for the daily turnover. To this must also be noted that if the outward-bound ships, from which it is customary to discharge a certain number of water leggers for use, happen to arrive somewhat late, namely after the end of the harvest, as happens frequently, and there is thus no longer an opportunity to deliver those leggers to the wine farmers for wine-making, one is not a little hindered thereby due to the lack of necessary storage space, as one cannot possibly dare to expose that cooperage to the air in this climate without spoilage, and it will then also be evident that if, in accordance with the respected authorization of the High and Mighty Lords Masters, one proceeds to purchase the surplus of the farmer for the account of the Honorable Company to send the same in the meantime to the motherland, the proper storage places for those wines cannot be at hand. A Gaes E: Clercq 484 I, the undersigned Chief Surgeon of the Honorable Company's ship Het Slot ter Hooge, under the command of Captain at Sea Jan Sierevelt, certify hereby that the said Captain, during the entire voyage from Europe to this place, has found himself in a weak state of health, and has principally suffered from an illness originating from phlegmatic humors and sharpness of the humors, and especially that these phlegmatic humors had settled on the orifice of the stomach and the lungs, whereby his Honor daily, suddenly, several times, and indeed principally in the mornings and toward the evenings, was attacked by such a tendency to vomit that his Honor, even in the middle of commanding, was often forced to put down the speaking trumpet and call the Captain-Lieutenant from the forecastle to take up the command, and was then often for more than half a quarter of an hour so constricted in the throat by the phlegm that he could scarcely breathe; furthermore, that his Honor was troubled with fevers practically most of the time of the voyage, and often so severely that I repeatedly advised his Honor to keep to his cabin, and that indeed principally when, about 4 weeks ago, he was troubled with a severe throat inflammation, just as he also, from before 485 our departure from Europe until about 4 to 5 weeks before our arrival here, had an ulceration on the large knuckle of the big toe on the left foot, which could by no means be brought to cleansing or good suppuration, whereby his Honor was inconvenienced to such a degree that near and between the Canary Islands he had to jump on 2 crutches; all of which clearly demonstrates a sharpness, phlegmatic congestion, and corruption of the humors, which, notwithstanding that I on the voyage tried various laxative remedies and salts and other appropriate resolvent and restorative remedies, could not succeed, as the impaired appetite up to this hour still demonstrates, which according to my thoughts arises from nothing other than a phlegmatic congestion of the stomach; so that it does not seem advisable to me, the undersigned, that his Honor continue the voyage from here to the Indies before his physical constitution and humors have improved, which according to my thoughts must be effected not only by medications, but by a dietary and appropriate regimen of life, and especially since the fatigues at sea must absolutely and utterly ruin such constitutions; but since his Honor applies himself to his post to such an extent that, notwithstanding all the said circumstances and my advice to keep to his cabin, I have not been able to induce him to do so, but both by night and by day, at the least occurrence, he has presented himself on deck and at his post. Right Honorable Sir, Honorable Sirs: It has pleased Your Right Honor and Honorable Sirs to deliver to the undersigned, also a member of this assembly in his capacity as cellar master, an extract from the most respected letter of the Right Honorable the Directors commissioned to the Assembly of the Seventeen under date of 8 January of this year, and at the same time, by extract resolution of the 10th of June last, to demand from him, as having declared in the assembly that he was unable through want of the necessary cooperage to prepare those wines which were to serve for the lading of the frigate De Negotie, such an accurate report as might enable this government to render to the said Right Honorable Gentlemen such an account as they have pleased to require regarding the non-loading of the aforementioned chartered frigate De Negotie with local products, especially grain and wine, with the addition of the necessary explanations on the points contained in the aforementioned revered letter. The undersigned shall, first of all, in dutiful compliance with the most respected requisition of the sovereign Masters, submit his humble opinion to Your Right Honor and Honorable Sirs, stating that during the discussions of this council concerning the dispatch of the aforementioned frigate De Negotie, the lack of the leagers required for that purpose was indeed raised as a substantial difficulty in sending that vessel to the fatherland with a cargo of wine; but Your Right Honor and Honorable Sirs will be pleased to recall that on that occasion, as a difficulty of no less importance, he submitted for the consideration of Your Right Honor and Honorable Sirs whether it would accord both with the interests of the Honorable Company and the true lasting interest of the colonists if the surplus wines were sent off just as they were brought in by the winegrowers and scarcely racked off into clean casks, without having matured for some time in the Honorable Company's warehouses according to their kinds. Seeing that such young and raw wines, with the exception only of the so-called Jewish Cannen and maiden wines, will, in the humble opinion of the undersigned, never find favor in taste, and the Cape wines, once brought into discredit in this manner, could never, or at least not for a long time, be restored to esteem, and the colonists, however much they might rejoice over a temporary advantage, as well as the Company itself, might perhaps be deprived forever of a branch of trade that could otherwise become of some consideration. The undersigned also takes the liberty to refer to his memorial submitted on 11 October 1786, accompanying this as copy under letter A, in which he believes he has demonstrated clearly enough what difficulties, according to his modest views, presented themselves to carrying out with desired success, for the present, the project of relieving the colonist of his surplus products with regard to wines, pointing out at the same time the means to effect this in time. Your Right Honor and Honorable Sirs themselves had to be all the more cautious in carrying out this shipment in that manner, because it was still uncertain what kinds of Cape wines could be sent to the fatherland with any prospect of profit, and especially whether the wines might be forwarded just as they were brought in by the winegrowers whenever an opportunity for shipment presented itself. It is certainly for that reason that Your Right Honor and Honorable Sirs, per the also chartered fluyt ship De Vreede in the year 1785, sent over a small cargo of wines, which might serve as a sample in case it should please their Right Honors to pay regard thereto and to convey to this government their respected orders on that subject, without this having had any further consequence. It is true that the Right Honorable the Directors at the presiding Chamber of Zeeland, pursuant to the resolution of the sovereign Lords Seventeen, among other arrangements relating to the affairs of this government, by letter of 28 July 1785, were pleased to grant this government the authorization so favorable to this colony, and to order that all such local products, including also wines, which the colonists might still have left over after the Company was provided for its ordinary consumption, and beyond what they might have been able to sell to passing foreign nations, should be received and stored on certain conditions for the account of the Honorable Company, in order to be sent to the fatherland when opportunity offered. But may it be permitted to the undersigned to doubt whether their Right Honors are well informed of our local situation, and that they are therefore certainly unaware of how poorly provided we are here with the necessary storage spaces for so large a quantity.

49 great handling, indeed that, as appears sufficiently from the report submitted under today's date at this table by the undersigned concerning the employment of the warehouses, the warehouses at hand for storing wines and other drinks are scarcely sufficient even for the ordinary handling. The further, so necessary carpentry work on the hospital, already too long in progress and whose completion was with reason so very much desired, and the no less necessity of carrying out the projected plans for the better fortification of this so important possession of the Company, have certainly been causes that have prevented Your Right Honourable and Worshipful Sirs from proceeding for the time being with the construction of more warehouses, both for storing wines and grains, for which must also still be awaited the revered approval of the High and Mighty Lords Superiors upon the proposals presented to Your Right Honourable and Worshipful Sirs in the year 1786 by the dispenser and the undersigned for the construction of a building that would be most suitable for the use of both. And however much Your Right Honours have sought to remedy somewhat the defect that generally prevailed regarding the necessary space in this government, through the purchase of some suitable buildings offered at that time by private individuals, this nevertheless did not answer the purpose in all respects, for one was obliged to surrender three warehouses rented from the repatriated dispenser Van Schoor, whose lower part served for the storage of wines while the lofts were at the disposal of the dispenser, to the buyer of those buildings, the wine merchant Van den Berg, so that the undersigned gained little more room by clearing the building that had served for the storage of the De Meuron regiment and its gear; and since this government, through the purchase of the above-mentioned buildings, seems to have experienced in no small measure the displeasure of the Lords Masters, its hands have certainly been tied from making use of such an expedient when opportunity arises. Much less could Your Right Honourable and Worshipful Sirs have the joyful presentiment that precisely at the time when the aforesaid ship De Negotie could have arrived in the fatherland, Cape wine, which, except for Constantia wine, had been able to make little headway, would have been such a huge return. One need only consult the sales lists of the Honourable Company; from these it will sufficiently appear that the Honourable Company has rarely enjoyed great profits on our common wines, and likewise the demands from the fatherland have never been so large that one could have deduced from them the popularity of our wines. It is true that the Madeira purchase sent per the aforesaid ship De Vreede yielded a considerable excess profit, but the undersigned, out of personal passion, had had that wine stored in large casks for some years, and this example can justify that of the undersigned, namely that one may indeed entertain some hope of carrying on a profitable trade in Cape wines, but that one must be provided with a good supply of mature wines, which can be obtained in no other way than through the means proposed by the undersigned in the above-mentioned writing. Now, Your Right Honourable and Worshipful Sirs having to elucidate upon the contents of the honoured order contained in section 28 of the cited revered dispatch of the Lords Masters, may it please Your Right Honourable and Worshipful Sirs to cast an eye upon the extract appended hereto under Litt. B from the cellar books regarding the remainder of the leggers as they were found since the years 1789/90 until the year 1785, from which it will appear most clearly to Your Right Honourable and Worshipful Sirs that, far from that caskage having been so abundant in the year 1785, to which the highest-mentioned Lords Masters please to restrict themselves, and all that intervening time, precisely in the said year 1785 and the preceding ones the remainder of the leggers was considerably less than for the greater part in the other noted years, although the intake of wines far surpassed that which occurred in the previously noted years, when it was nevertheless judged most necessary to have a ample supply of caskage at hand for the handling. number of 1939 Leggers was even barely sufficient for the usual operations, much less that it could have been used for any other purpose, and even to such an extent that one had to retain for some time the leggers of the wine growers in which they had delivered a portion of the wines due from them. Furthermore, Your Honors have been pleased to remark upon the remaining quantities of the lesser sorts of casks, such as half-leggers, whole and half-aams, the unworked staves of different calibers, as well as the remainder of the pipe staves; certainly under the assumption that the former were used as well for the storage of the wines as the leggers, and that the shortage can be replenished by making new casks, and that one thus ought always to be in a sufficient stock of cooperage; yet Your Honors are sufficiently aware that the whole-aam staves are primarily requested and used for the conveyance of the Constantia Wines, and never for the storage of any other wines; while that which is discarded from them as not serviceable for that use is employed for other services and especially for the storage of Butter for the Indies, and that the half-leggers are only used both for the daily necessities in this government for passing ships and for the storage of tallow, as well as, in the absence of aams, for the storage of butter. The undersigned, who also willingly on his part wished to put into operation all such means which he thought might be in any way advantageous to this new trade, did recently cause a small portion of the wines sent to the fatherland to be racked into smaller casks, in order to test whether certain enthusiasts, since it does not suit everyone to buy wines in larger casks for their own use, might not be more encouraged if some wines were delivered in smaller casks. As regards now the use of the legger staves and staves, the undersigned will only repeat what has already been noted in the often cited writing, namely that already for a considerable time a greater number of leggers than was ever previously customary here has been made in the cooperage, in order as much as possible to remedy the shortage of those casks, and with which, as far as the increasing daily work in the enlarged operations in this government somehow permits, one will continue. But it will be an impossibility in this manner to supply the requirement of such casks for the entire operation, wherefore he must take the liberty of repeating to Your Honors the necessity to reverently persist in demanding the fulfillment from the Fatherland of the requisitions made from here. 494 favourable and beneficial intentions of the Lords Masters with regard to the better sale of the country's surplus products, having been pleased to require of the fellow member of this meeting, in his capacity as cellar master, his considerations and reflections concerning the means that might serve to put into effect as soon as possible that intended disposition, also with respect to one of the most substantial branches of produce of this country, namely the wine, the same shall now, in dutiful compliance with that requisition, have the honour to represent to Your Right Honourable and Honourable Sirs that, in the course of his reflections, no small difficulties have occurred to him, which, although not an absolute impediment, will nevertheless cause no small delay to the actual execution thereof, submitting the same most humbly to the enlightened view of Your Right Honourable and Honourable Sirs. Since, prior to the direct execution of the plan ordered by the Lords Masters—namely, that in cases of abundance and lesser export of the products abroad, that which the farmer shall have left over after the usual delivery to the Honourable Company shall be taken on the Company's account according to the prices set by the Commissioners of the Court of Justice and approved by this government—one must above all be mindful of properly storing such wines and making them fit for further shipment, the great scarcity of the required casks will, in the first place, be no small obstacle to getting this underway so speedily. Since the fatal war, and since the Honourable Company was subsequently compelled to make use mostly of chartered vessels for the transportation of the cargoes projected for the Indies and this government, one has here for the greatest part remained deprived of the annual supply of empty leggers, and has fallen noticeably behind thereby, because the usual provision thereof has nonetheless continued, both to our own ships and for the transport of the wines for the Indian establishments, as well as to the outgoing and returning ships of the State. And in order somewhat to replace this, Your Right Honourable and Honourable Sirs, upon the humble proposal of the undersigned, were pleased to request the Lords Masters to be so kind as to provide this government with 300 new leggers over and above the usual number of leggers that one was accustomed to take from the outgoing ships; which, however, was only partially fulfilled by the Chamber of Zeeland, the Right Honourable and Most Respected Lords Directors of the Chamber of Amsterdam having been pleased to write to us and communicate the impossibility of satisfying this request on account of the lack of ship space, thereby authorizing us, in order to remedy this shortage, to make use of the pipe-staves sent out, and to have the required leggers coopered. And although Your Right Honourable and Honourable Sirs, in order to enable the undersigned to comply with that order, were graciously pleased to grant him an increase of four coopers, and in this just-ended financial year a greater number of leggers was actually readied than was ever customary, one has nevertheless, through the daily growing work for the various departments in this government, not been able to meet the objective in all respects, so that one is currently still burdened with a number of over 300 leggers that are almost entirely unserviceable and are kept in service only because of the prevailing shortage. The lack of necessary storage places for those wines will, in the second place, also have to be taken into consideration, as the storehouses currently at hand are barely sufficient for storing the wines needed for the usual reserve; especially if, as Your Right Honourable and Honourable Sirs have rightly been pleased to note the necessity thereof, the annual storage of wines is henceforth taken so amply that, in the event of a crop failure or scarcity of that liquid caused by other accidents, the Honourable Company may not once again fall into the disadvantageous circumstance of having to raise the usual prices set on wine and brandy, to its actual burden. And since it will above all depend on ensuring that, when sending wines to the fatherland, one is mindful of their good quality and soundness, if one does not wish this entirely favourable project to produce a contrary effect, the slovenly practices of some vineyard owners could also be no small obstacle; for it is otherwise much to be feared that, if ever anything should be found wanting in that regard or if any well-founded complaints arise, this source of sale of that substantial product will be stopped forever, whereas it could otherwise be an ever-flourishing branch of prosperity for this colony. But since the necessary provision herein cannot be made so easily, it will therefore only be desirable that each of them, while not neglecting his own interest and advantage, shall be more and more encouraged henceforth also to observe greater cleanliness in the handling and preparing of his wines, so as

504 Having attentively considered in what manner, at the least expense, taking into account all local circumstances, the pure intention of the High Commanding Lords Majors in this regard could be fulfilled, we believe that: 1st: Two to three spacious rooms should be appropriated, of which one would be used as a lecture room to give public lessons in mathematics, in so far as it is necessary for the engineers and artillery; the other to give the pupils who apply themselves to these military sciences the necessary instruction in the theory and fundamentals of the different branches of their profession, and particularly in the necessary, yet different manners of drawing, such as in fortification drawing and that which relates thereto, in civil architecture, artillery and mechanics, in the drawing of situations and that which belongs to the formation of military maps; and the third room would serve to place some instruments and a small military library, and to store the papers and drawings of any importance. 2nd: If the High Noble Administration should be pleased to approve it, one could employ for this military institution the military library granted to the Württemberg Regiment garrisoned here for the same purpose by their aforesaid Noble Great Worships, as well as the mathematical instruments belonging thereto; in which case the books and instruments still lacking, which would need to be supplemented by the Noble East India Company upon our further proposal, will not constitute an object of importance. 3rd: As regards the teachers required in this military training school, drawing will 505 now be employed, Captain, pursuant to their very, in the highest of the same, on an extra salary of 25 Rds per month, primarily, one will need a capable mathematician to be able to give public lessons in mathematics, to whom one will need to attach an assistant tutor. Provisional regulations and orders according to which, in the military school at the Cape of Good Hope, instruction in the military sciences shall be given to the cadets of this garrison, under the supreme authority of the Chief of Artillery, Colonel Gilquin, and under the immediate orders and direction of the Lieutenant and ordinary Engineer Thiebault, by the Sub-Lieutenant of Artillery Gunkel; according to which the aforementioned cadets shall have to conduct themselves. The sciences that shall be taught by Mr. Gunkel to the cadets of this garrison consist of the following: 1st, Arithmetic; 2nd, Algebra or the art of equations; and 3rd, Geometry, all according to the method of Heinstra. The time or hours to be used for this were deemed most suitable in the morning from 9 to 10 o'clock for the art of equations, and from Agrees: J. Goets, First Clerk. To the Right Honourable Sir Cornelis Jacob van de Graaff Governor of the Cape of Good Hope and its dependencies &c. &c. together with the Honourable Political Council here Ch. Kahlewein In dutiful compliance with your Right Honourable and Honourable esteemed resolution of 24 June last regarding the request presented to the Right Honourable Supreme Gentlemen, the Lords Superiors, by Hendrik Hermanus Bos, who absconded from here, and the reasons alleged therein which induced the said Bos to leave this place and flee to the Fatherland, the Council of Justice has the honour to state that when, in the year 1780, complaints were brought to the Landdrost of the Swellendam District, the late Daniel Rijneveld, by some slaves belonging to the farmer residing under that district named Anthonij Kaldijer, against him, their master, concerning the great ill-treatment inflicted upon them from time to time by him, with the request that they might be released from the hands of that man, the said Landdrost had allowed those ill-treated slaves to remain at liberty at the Landdrost's residence and had summoned their master to appear before him in order to speak with him about those complaints; that the said Kaldijer, having arrived at the Landdrost's residence, upon seeing that the slaves had not been put in the jail, but in order not to be idle had done some work with the people of him, the Landdrost, that man, who is of a hasty temper, seemed somewhat resentful about this, although it had been done to save expenses and not to torment those ill-treated slaves even more by locking them up; that the aforementioned Kaldijer subsequently having come Capewards, according to the assertion of the said Hendrik Hermanus Bos, will have spoken with him about that matter and asked him for advice, so that the said Bos, when he found himself outside the Council Chamber on Thursday 24 September 1780 during the meeting, in the hearing of several persons present there, speaking about the affair of Kaldijer to the burgher Jeremias Auret, who is a relative of the aforementioned Landdrost, essentially asked him what he would do in such a case if he were Landdrost; the said Auret having essentially replied thereto, I would perhaps do just the same, whereupon the often mentioned Bos replied, then you would be, God forgive me, God damn me, just as much of a rogue as the Landdrost is; upon which saying the said Auret reacted, do you tell me that to tell him again, meaning thereby the Landdrost; whereupon the said Bos answered, just tell it to him, for that is what my principal Kaldijer told him as well, which last statement by the said Bos was completely devoid of truth; that, the aforementioned Landdrost Rijneveld having learned of all the foregoing, finding himself thereby greatly insulted in his office and quality, therefore addressed himself to us by request and, adding legally sufficient proofs, requested maintenance of justice; that matter being then placed by us into the hands of the then Independent Fiscal, Mr. Willem Cornelis Boers, in order to act and proceed therein as he should deem proper; that the said Mr. Boers, having caused the aforementioned Bos to be summoned before our court to hear such claim and conclusion as the Honourable Plaintiff should come to make and take upon and against him, to answer thereto, and further to proceed as according to law; on the appointed day, the defendant was granted copy and a term of four weeks to serve with an answer; that the said Bos did so, and the case thus being concluded through terms, after renunciation of the parties, was adjudicated by us and the said Bos was condemned, after previous tolling of the bells, in the full court of justice, with open doors in public, to beg forgiveness of God and Justice, as well as to a fine of Fifty silver Ducats for the benefit of the Diaconate of this place, and into the incurred costs of the suit; that the aforementioned Bos, having appealed from that judgment on 2 April 1782 to the Honourable Council of Justice of the Castle of Batavia, the procedural documents, properly evangelized, were sent to the said Council in Batavia that same month with one of the Honourable Company's ships and among its papers; but whereas the said Bos, who was obliged pursuant to the highly respected order of the Lords Superiors of 15 July 1718 to show proof within the period of one year that he had prosecuted his appeal at Batavia, remained in default thereof, and produced in his excuse nothing but some futile pretexts, which however, since two years had already elapsed by then, could effect nothing; the then Fiscal pro interim, Mr. Jacob Serrurier, had the said Bos summoned to show proof regarding the prosecution of that appeal or otherwise to hear default requested; and in default thereof, the often mentioned appeal was declared deserted; that the said Fiscal pro interim, having thereupon caused the said Bos to be cited for 22 April 1784 to comply with the sentence passed here in the year 1782, the said Bos feigned to be ill and thus did not appear, yet promised to appear on the following court day and to comply with the judgment; without him however having appeared on the new summons made for 6 May, but having made himself fugitive, so that at the request of the said Fiscal pro interim, he was summoned, to superabundance, by edict to appear.

513 summoned, and because of non-appearance, subsequently condemned by published sentence and thereby banished forever from this Government, on pain that if at any time he should happen to fall into the hands of Justice, he will then be punished according to his deserts. That the wife of the aforementioned Bos, named Maria Magdalena Roode, after the departure of her aforementioned husband, being constantly harassed by his creditors to obtain their arrears from her, she consequently finding that more debts presented themselves than she was able to pay, therefore addressed the Council of Justice by petition, and requested that the Council would be pleased to judicially accept her estate as being insolvent, to sell and settle it ad opus jus habentium; which having been done, after satisfaction of the preferential debts, the concurrent creditors obtained no more than 17½ per cent; furthermore, the parents of that wife took her and her children in with them. That the repeatedly mentioned wife of the aforesaid Bos, now a considerable time ago, came again to address the Council of Justice, requesting to be permitted to be divorced from her aforementioned husband, and this for reasons that she was reliably informed of the bad and luxurious lifestyle of her husband in the Fatherland, as well as that the same, although well knowing that she had nothing, had nevertheless repeatedly drawn bills of exchange on her, and thus brought her into many difficulties; which request, however, because she could not prove that assertion, was denied to her. And herewith believing to have complied with the honored intention of your Right Honorable and Honorable Worships, the Council of Justice takes the liberty to remain in all respect, underneath stood, Right Honorable Sir and Honorable Worships, lower, Your Right Honorable and Honorable Worships' very humble servants, was signed, J. Whereas, the Fiscal pro interim Master Jan Jacob Serrurier made known to us on the 6th of May of this year that the burgher Hendrik Hermanus Bos, concerning and by reason of having made himself guilty of far-reaching insults towards the junior merchant and then Landdrost of the Colony of Swellendam, Sieur Daniel van Rijneveld, having on that account been sued ex officio before our court of justice by the repatriated Independent Fiscal, Master Willem Cornelis Boers, the same, after that case was fully heard, was condemned by judgment of the date 11 March 1782, after the preceding ringing of the bell, in pleno Judicio in public, with open doors and on bended knees, to beg forgiveness of God and Justice, as well as to a fine of fifty silver ducatoons, for the benefit of the Diaconate Poor of this place, and in the costs of the suit. That the aforesaid Bos appealed from that judgment to the Honorable Worshipful Council of Justice at Batavia, the same, however, has by no means prosecuted his interposed appeal, 515 appeal, so that the same was declared deserted at Batavia, and that subsequently, execution having been decreed here on the 8th of April last, the same Bos, however, in fulfillment of his promise of submission made to the Judicial Commission, did not appear in Court, but remained in default and in hiding, wherefore the repeatedly mentioned Bos, at the request of the aforementioned Fiscal pro interim, was successively, after proper ringing of the bell, by three edictal summonses, and subsequently on the 29th of July last, for the fourth time ex superabundantia, loco et more solito, summoned to appear in our Council, to answer for his absence and to satisfy the aforesaid judgment, without the same having appeared, however, thus having greatly disparaged as well as held the respect and authority of Justice in the highest contempt, so that the aforementioned Fiscal pro interim subsequently served his statement of claim, and therewith concluded according to law. Seeing that such conduct in a country where Justice is properly administered can by no means remain unpunished, it is that the Honorable Worshipful Council of Justice, having carefully considered the statement of claim of the repeatedly mentioned Fiscal pro interim and the conclusion taken therein against the aforementioned Hendrik Hermanus Bosch, further having regard to the contumacy of the defaulter and absconder, as well as to everything that was relevant to the case and could move their Honorable Worships, administering Justice in the name and on behalf of the High and Mighty Lords States-General of the United Netherlands, have banished the defaulter and absconder Hendrik Hermanus Bosch, as their Honorable Worships by these presents do banish the same forever from this country and the jurisdiction thereof, without ever being permitted to return therein, on pain of heavier punishment, with condemnation in the costs. underneath stood. Right Honorable, Valiant Sir and Honorable Sirs: With all due respect show your Right Honorable, Valiant and Honorable Sirs' very humble and obedient servants, Ailt Arend Tobiaszoon and Pieter Malet Junior, having been assigned as Captain and Captain Lieutenant on the stranded provisions ship Avenhorn, how they, petitioners, in consequence of the honored resolution of your Right Honorable, Valiant and Honorable Sirs of [illegible], have been charged on their pay accounts, the first with a sum of ƒ4659:13: and the second with a sum of ƒ2329:16:8, being the amount of what the petitioners have delivered short beyond the ordinary ullage on the cargo of the said ship Avenhorn, and at the same time credited on the said account, the first with ƒ652:12 and the second with ƒ326:6: for the amount of what they have delivered in excess on some items: That they, petitioners, if they had been able and permitted to complete their return voyage to Batavia, upon their arrival there would not have failed humbly to submit to the High Indian Government the reasons whereby the aforesaid shortages were caused, and to demonstrate how little the same are to be attributed to the unfaithfulness or neglect of duty of the petitioners, with a respectful request that it might please your High Honors favorably to release the pay accounts of the petitioners from the charge made thereon. However, the first petitioner having to abandon the idea of demonstrating their innocence to the High Indian Government regarding the said shortages because of the loss of the vessel entrusted to him, which was so grievous to him, and the second petitioner because of the poor state of his health and, upon his representation, the most favorably granted permission from your Right Honorable, Valiant and Honorable Sirs to be allowed to remain here in his birthplace and with his family for his recovery; and having rather, for the maintenance of their good reputation and the redress of the damages suffered by them, to consider means to return to the homeland under your Right Honorable, Valiant and Honorable Sirs' favorable permission, and there to render to the High Honorable Directors of the Company that accounting which they can by no means avoid, and to plead again for their highest trust; they, petitioners, take the liberty to turn to your Right Honorable, Valiant and Honorable Sirs, with the most humble request that it may please your Right Honorable, Valiant and Honorable Sirs to cast a compassionate eye upon the sorrowful circumstances in which the petitioners find themselves both through the loss of their ship and through the poor state of their health, to grant them permission, upon an upcoming opportunity, to depart from here for the Netherlands, and to allow that the accounting annexed hereto, addressed to their High Honors, the Lords of the High Indian Government, may be supplied under the papers of the Honorable Company to their High Honors, with a favorable recommendation from your Right Honorable, Valiant and Honorable Sirs to cast a favorable eye upon the innocence in which the petitioners find themselves with regard to the said shortages, as they believe will fully appear from the aforesaid detailed accounting to their High Honors as well as to your Right Honorable, Valiant and Honorable Sirs. with a sum of ƒ978:18 for certain goods delivered by them in excess of what the cargo invoice entailed. That they, the petitioners, did not fail to respectfully present to the well-esteemed, honorable political council their accounting concerning these shortages, but that the council, on account of the revered orders issued on that matter by Your Right Honorable Worships, chose to keep that charge in force, nevertheless with liberty granted to the petitioners to submit their grievances in this matter with due respect to Your Right Honorable Worships upon arrival in Batavia. That they, the petitioners, had flattered themselves with the prospect of making this presentation to Your Right Honorable Worships, and thereby demonstrating how little the aforementioned shortages are to be attributed to the bad faith or dereliction of duty of the petitioners; but that, due to the shipwreck of the vessel entrusted to them—an event as oppressive as it is grievous to them—and the accounting they are bound to give thereof to their Lords and Masters, they must rather devise means to return to the Netherlands than to Batavia. That they, the petitioners, knowing that the government here would never give them permission to do so unless the sums charged to their pay accounts were paid by them into the Honorable Company's treasury, and their inability becoming an insurmountable obstacle in this regard, decided to petition the well-esteemed government today, by a request annexed hereto, to permit them on an upcoming opportunity to depart for the fatherland, with a humble plea to submit this their accounting to Your Right Honorable Worships among the Company's papers, and an offer, if the revered decision of Your Right Honorable Worships should not arrive before the departure of the petitioners from here, then to provide sufficient guarantors as security to the Honorable Company for that which they might remain indebted to it, which guarantors they dare flatter themselves they will certainly find among some well-to-do residents, who, moved by the disasters that have befallen the petitioners since their departure from the capital of the Indies until their stranding in this roadstead, and in full confidence in the widely praised fairness and compassion of Your Right Honorable Worships, will not hesitate to intercede for the petitioners. That the aforementioned shortages on the cargo entrusted to the petitioners consisted of: 46223 lb of rice 3450 kannen of arrack 117 bundles of rattan 273 lb of pepper 980 pieces of teak planks 3 mill planks of 3 inches 1 mill plank of 12 inches 200 pieces of laths and that which on the contrary was credited to them: 346 lb of powdered sugar 99 lb of wax candles 794 pieces of teak staves 3 mill planks of 2 inches 2 mill planks of 1½ inches 3 mill planks of 3 inches With regard to the excessive shortage of the rice, the petitioners cannot refrain from most humbly submitting to Your Right Honorable Worships that the same ought not to be considered as having arisen on the 150 koyangs unloaded in this government, but rather on the 400 koyangs loaded into the ship Avenhorn on the Java Coast at the Joana office in the month of August of the past year for the capital of Your Right Honorable Worships, and of which they unloaded 250 koyangs in Batavia; that, finding no rice in stock at Joana, they had to wait there with the aforesaid vessel for the collection of the new rice, which, coming fresh from the native population, was loaded; that undeniably the young rice in all ships must undergo great heating and consequently also considerable shrinkage; that this took place particularly on board the ship Avenhorn during the voyage from Joana to Batavia, and especially from that capital to this remote corner; that through this heating and the period of 8 months that the rice was on board, the straw bags, which were already in poor condition, were for the most part suffocated and decayed, and virtually all the rice was spilled into the hold and unloaded from there, causing far more spillage than usual. Concerning the 3450 kannen of arrack also delivered short by the petitioners, they take the liberty to bring to the attention of Your Right Honorable Worships that this is solely and entirely to be attributed to the poor condition of the leagers, the staves of many having burst, and the hoops of others having broken, and this leakage being caused thereby; of the truth of this explanation the Honorable Government of this colony was also pleased to be convinced, and permitted the petitioners, upon shipping out in the Avenhorn, some of the broken and leaked-empty leagers, in order, as it were, to lend a helping hand to the petitioners in obtaining the means for their defense. Then, with respect to the 980 teak planks delivered short, the petitioners consider themselves obliged humbly to submit to Your Right Honorable Worships that in their place they delivered 794 teak staves, and thus only 86 planks too few; and they dare assure Your Right Honorable Worships that they were ignorant of the difference existing between those two kinds of wood, and that they received on board the staves delivered here as teak planks. Yet considering that without great adversity one could make the voyage from there to here in six to eight weeks, being assured of being fully able to recover here, so after a month's stay in Rio de Janeiro the incapacitated were re-embarked, although they were by far not yet recovered, but this was only done because the ship Vreedenburg was repaired there, and not needing to remain by it any longer of necessity, the voyage to this place was undertaken, as being the first place of my destination, to give notice of both the ships that had already stayed behind for so long. And although through good care and fresh provisions taken along on the voyage, the crew was kept in that state without worsening much; yet their humors are so corrupted that, in my judgment, subject to correction, it would be entirely ill-advised to undertake the voyage to Batavia with people in that condition, before they have had time enough to refresh themselves and their bodies are cleansed, the more so as it is in a season wherein one mostly meets with light westerly winds and, on the contrary, many easterly winds, which gives the prospect of a prolonged voyage. For which reasons the undersigned is compelled to turn to Your Right Honorable and Honorable, humbly requesting that you please exercise some consideration in this matter, in view of the poor 535 state of the crew, of whom two days ago another twenty were sent to the hospital and thirty to forty are still found on board who still have the effects of scurvy in their limbs, the undersigned requesting to be allowed to remain lying here for this current month of January, and to that end to postpone the day of the muster. Held council, resolved to have all the crew pass the muster in order thus to assess their exact condition; found, besides 70 who were lying flat in their bunks, another 132 hands in the ship who had the scurvy in their limbs, some more, others less; added to 15 dead, this made a number of 217 hands, which, subtracted from the crew of 348 hands, amounts to about two thirds, among whom were officers from the quarterdeck and almost all the petty officers.
