is evident; whereas, on the other hand, it nowhere appears that your Right Honorable Worships had any reservations about promoting the petitioner to Junior Merchant, following the example of his predecessors, who always held that rank. From which what was just cited clearly appears to show: that the quality of Junior Merchant is by no means attached to the post of Confidential Secretary; the petitioner maintains therefore that, whereas already in the year 1765, pursuant to the regulations drafted regarding the advancements of the Honorable Company's Servants, having at that time completed his two terms of indenture, he was appointed Bookkeeper in the Dispensary at ƒ30 per month, the Honorable Mr. van Oudtshoorn can consequently in no way equal the petitioner in rank, since His Honor arrived here only 8 years later, namely in the year 1773, as a Bookkeeper, and that only at a salary of ƒ24 monthly, so that the Honorable Mr. van Oudtshoorn only barely held rank above an Assistant of the Second Class, who upon entering into a second contract comes to enjoy the wage of ƒ24 per month, and thus remained a Bookkeeper until finally, at the same time as the petitioner as stated above, he obtained the quality of Junior Merchant. The petitioner could cite even further grounds in demonstration of his contention, but as he flatters himself that what is set down herein is sufficient to prove that he is in all respects a much more senior servant than the Honorable Mr. van Oudtshoorn, and, be it said with the utmost respect, therefore ought also in the present case to have been advanced before His Honor; he therefore takes, in order not to hinder and fatigue your Right Honorable Worships' weighty occupations and attention with superfluous repetitions, most humbly the liberty to turn by this means to your Right Honorable Worships with the humble prayer that, in consideration of the petitioner having served the Company not only eighteen years longer, and that in rather more responsible and difficult posts than the frequently mentioned Honorable Mr. van Oudtshoorn, with all zeal, loyalty, sacrifice of his health, and the least self-interest, but that he also without interruption, both as a subordinate and as a qualified servant, has always held seniority above the Honorable Mr. van Oudtshoorn, it may therefore graciously please your Right Honorable Worships to favor the petitioner, who finds himself burdened with a wife and eight children, with the aforesaid office of Dispenser, together with a seat in the Council of Policy, and the attached title and rank of Titular Senior Merchant, with the addition of the salary and emoluments of Effective Merchant: which great benefit the petitioner, by continuing always to discharge the service of the Honorable Company with untiring zeal and diligence, will endeavor to render himself worthy of. That subsequently, in the year 1785, the petitioner was fortunate enough in this government to be promoted to Bookkeeper; and as such was employed on the expedition and trade with the ships the Zeermin and the Meeuwtje, conducted and carried out in that year. That, having returned from this expedition, the petitioner again resumed his duties at the Trade Office until the 8th of July of the past year 1788, when he was provisionally appointed as First Sworn Clerk at the Political Secretariat, with the rank appertaining thereto of junior merchant, though at his earned salary. Reasons for which the petitioner humbly takes the liberty to turn to Your Right Noble and Right Honourable Sirs, with humble petition that it may please the same, following the example of his predecessors, to favour him with the capacity and salary of Junior Merchant, which beneficence he will strive to render himself worthy of, through zealous, faithful conduct in all that may further be entrusted to him, for the benefit of a Company to whose service he has devoted himself completely from his youth onwards. 884 Cape of Good Hope the 20th May 1789 with the intention of applying himself to jurisprudence, upon which in the year 1787 at the University of Leiden he was invested with the doctoral dignity, subsequently having returned hither in the year 1788 under Your Right Honorable High Mightinesses' favorable permission as a passenger aboard the Dutch private ship the Jonge Jacob, and having arrived here safely in the month of February of this year. in order dutifully to communicate to Your Honorable High Mightinesses by our humble postscript of the 4th of this month the safe arrival of the Company's packet boat the Maria Louise, having sailed from Batavia on the 5th of March, out of the Sunda Strait on the 10th, and having come to anchor here on the 3rd of this month. With Your Honorable High Mightinesses' most venerated letter of 16 May of the past year, we received a petition presented by Noel du Bose to Your Honorable High Mightinesses on behalf of his son Philippus du Bose, and we shall now, in compliance with the honored order of Your Honorable High Mightinesses concerning the last-mentioned du Bose, respectfully set down the following. That the undersigned Governor, after receiving Your Honorable High Mightinesses' aforementioned honored letter, having come to discover that Philippus du Bose was on one of the return ships, gave notice thereof at our meeting, communicating that when proceedings had been initiated by the Fiscal pro interim Gabriel Exter against the person of Marinus Simon van Cruijzelbergen in the case of strong suspicion of being the author of certain counterfeit paper currency circulating here at that time, he, du Bose, had also been involved in that affair, and on that occasion in his interrogation before commissioned members from the Council of Justice had confessed to having spread the infamous and utterly defamatory tale as if His Honour had brought himself to make the Sea Captain Francois Duminij, shortly before appointed Equipage Master, pay a considerable sum of money for obtaining the said post; that however much the said du Bose had also been convinced at that time of having spread this calumny without any foundation, and had therefore also begged for forgiveness on account of his rash and mendacious expressions, His Honour, however, when the affair of Cruijzelbergen had been brought before the Council of Justice to the point where the said Council requested to settle it politically, had thought it best, out of a special consideration for his young years, not to prosecute the said du Bose further for it, but also at the same time to tolerate him no longer at this place, and as such had caused him to depart from here with the first suitable opportunity in his capacity as sailor; that His Honour at that time also, in the firm trust that everyone who knew His Honour's moral character would hold himself fully persuaded of the untruth of that slanderous fiction, regarded this matter as settled, and could not imagine that it could still have any detrimental consequences for His Honour's honor and reputation; that His Honour, however, some time afterwards had to suffer the mortification of discovering from a dispatch of the High Noble and Right Honorable Lord Mr. Willem Arnold Alting, Governor-General of the Netherlands Indies, that the said du Bose and Cruijzelbergen upon their arrival at Batavia had persisted in the aforementioned punishable inculpation, notwithstanding that the first-mentioned had already made an apology for it before commissioned members from the Council of Justice here; that His Honour hereupon had let no moment be lost in having the strictest interrogatories relative to that affair drawn up and then handing them over to the Commissioner present at this Government, the Noble and Right Honorable Lord Adriaan Boesses, with the request that the then Equipage Master François Duminij, expressly summoned for that purpose before the Council Chamber, might be called in and interrogated upon the same before the entire meeting under solemn oaths, which was then also immediately put into effect and the act drawn up thereof was furthermore sent in copy at His Honour's request to the High Indian Government and entered by the same through us: that by virtue of the innocence of the undersigned Governor clearly apparent at that time, and thus also of the notorious falsehood of the aforementioned imputation, it might please the High Indian Government to recognize the sensitivity of that matter and to have whoever should be found to be the concocter thereof punished according to desert for his calumny committed therein against the character of a Governor of this Colony; but that His Honour, to his exceeding astonishment and regret, had to find among the enclosures of Your Honorable High Mightinesses' aforementioned most honored letter the petition presented to Your Honorable High Mightinesses by Noël du Bose, father of Philippus du Bose, in which he complains bitterly of the terrible ill-treatment inflicted upon his son at this Government, under a foul assertion as if that statement by him, Philippus du Bose, had been the moving cause for which he had been imputed to be an accomplice

be guilty of the counterfeiting and altering of paper money; that although His Honour could well demonstrate the falsity thereof from the answered interrogatories of him, Philippus du Bose, from which it most clearly appears that this confession of that so outrageous calumny with respect to him, the Lord Governor, was on the contrary a consequence of the vehement suspicion that lay upon him, Philippus du Bose, nevertheless, through this so lascivious accusation of the old du Bose and the stubborn perseverance of his aforementioned son, he considered himself to have been so defamed and insulted before the eyes of the whole world that His Honour declared he could no longer dwell upon this, but on the contrary, for the preservation of his honour and good name, dearer to him than life, he must therefore pursue this matter to the utmost without any further consideration for the young years or thoughtless passion of him, Philippus du Bose, who on account of his extreme malice no longer merited any management whatsoever; the more so since His Honour was of the opinion that every inhabitant of this colony, from the highest to the lowest, must be exceedingly concerned to know whether someone to whom the High and Mighty Lords and Masters had not hesitated to entrust a post of so much importance as the Government of the Cape of Good Hope were corruptible or not; that His Honour now hoped to prove the latter to the whole world, and therefore had immediately placed the person of Philippus du Bose into the hands of the Pro Interim Fiscal Gabriel Exter, in order to initiate such proceedings against him before the Council of Justice as the gravity of this matter, which had become so serious through the aforementioned petition of the old du Bose, should come to require; that the said Pro Interim Fiscal had then also caused him, Philippus du Bose, to be placed in civil detention; since the Pro Interim Fiscal, for the substantiation of this matter, would indispensably need to have sight of the petition of Noël du Bose, as well as of all such documents as related to the aforementioned case of Cruijzelbergen and du Bose that were deposited at the secretariat, His Honour requested that copies of these various items be placed in the hands of the repeatedly mentioned Pro Interim Fiscal, in order to be able to make the necessary use thereof in due course. Whereupon we all unanimously declared that, however much it pained us and our souls that His Honour, who had never given us any reasons for such suspicions, but on the contrary in all cases the most striking proofs of His Honour's noble disinterestedness, now found himself in the harsh and unpleasant necessity of having to make use of those papers, which for a man of honour and probity could not be anything other than repugnant, we nevertheless judged nothing more equitable than that copies of the aforementioned papers be handed over to the repeatedly mentioned Pro Interim Fiscal, for the delivery of which the secretary of our Assembly was accordingly authorized. Meanwhile, the undersigned Independent Fiscal Johan Nicolaas Steven van Lijnden having arrived in this Government, to whom, among other documents concerning the fiscal office, the abovementioned copy of the petition and further documents were handed over, and Your Right Honourable Worships may, if it please you, observe from the representation accompanying this in authentic copy that he deemed it appropriate, before initiating any proceedings against Philippus du Bose, however much sufficient ground therefor was at hand, to present to us such weighty considerations as are set down in detail in that representation, with the further proposal to us whether we, in order to avoid all adverse reflections, both with respect to the Council of Justice, as if they, according to the tenor of his father's petition, would have been capable of the utmost cruelties in the case of Philippus du Bose, and with regard to the undersigned Governor, as if His Honour from a motive of vengefulness had abused the authority entrusted to him, might not proceed to grant the repeatedly mentioned reckless petitioner full measure in every respect, and to condescend to his request made to Your Right Honourable Worships, namely to send his son Philippus du Bose to the fatherland. Which representation having been maturely deliberated upon by us, we have resolved to send the said Philippus du Bose to the Fatherland by one of the return ships, and pursuant to this our resolution have placed him aboard the bearer of this letter, and we take the liberty of presenting herewith to Your Right Honourable Worships the authentic copies of all such documents as have been kept at both the Political Secretariat and that of Justice relative to the case in question, from which we hope and trust that to Your Right Honourable Worships the falsity of the insulting accusations posited in the petition of Noël du Bose, and the vile and base nature of his son, will appear as clear as day, against whom the undersigned Governor has deemed, upon the aforementioned proposal of the undersigned Independent Fiscal, not to push any further prosecutions, as being a person with whom His Honour could never be placed on a par before any court of law; above all we hope, from the fatherly and noble care of Your Right Honourable Worships, that Your Worships will protect the eminent character with which you have been pleased to invest the undersigned Governor, as well as the trust that Your Right Honourable Worships have for him, for the body of the government as a whole, and

The undersigned, understanding that it will be unnecessary to enter into a formal debate of the facts so mistakenly and falsely narrated in the above-mentioned petition, for which the submitted documents will amply suffice, will merely briefly remark that it is beyond all doubt that the aforesaid Philippus du Bose could never escape a conviction before any impartial judge, whereby full satisfaction would be procured for Your Honorable Sir, since he in his responses to the interrogatories presented to him, at article 20, fully confessed to being guilty of the atrocious insult charged against him; and it is clearly evident from the circumstances that he, Philippus du Bose, notwithstanding the expression of remorse in the said responses at article 22 and the generosity of Your Honorable Sir, has nevertheless continued to harbor a malicious intent to injure the chief ruler of this place, and has intentionally persisted with his maliciously conceived and falsely fabricated calumnies. Yet the undersigned has observed from the mentioned petition of Noël du Bosc that in it they have not only tried to give the lords masters the impression that your Right Honourable was guilty of acts of violence, and that he, Philippus du Bosc, was entirely innocent and thus unjustly subjected to the prosecutions, but also that they intended to make the integrity of justice not only here locally but even in the entire East Indies appear under a very ambiguous aspect. 928 found it appropriate in this regard to ask the joint honorable members, who were present at the time when the case of the repeatedly mentioned Kruijzelbergen was taken into consideration and politically settled, both without special consideration and because of the obscurities appearing therein, whether, when a statement appeared in the documents of that trial alleging that His Honour had defiled himself by receiving an important sum of money from the Equipage Master here, Francois Duminij, for or on account of his appointment to that office, His Honour had brought this to the attention of their Honours and asked for their sentiment and advice as to whether he ought not to clear himself of such a base treatment, and if so, the manner in which this could best be carried out in accordance with His Honour's character. Which question having been unanimously acknowledged by the said members, they testified that, since people were only too well convinced of a mindset of the well-mentioned Lord Governor completely contrary and alien to such acts, and each member had also maintained that a calumny born of a false supposition, as that imputation entailed, could not be capable of raising a detrimental opinion against His Honour, much less of making a clearance against it necessary; they consequently believed that it was best to treat this with indignation and contempt with a good intention, and had also advised this all the more because the said imputation consisted solely of a statement by the person who had involved himself in the case of the said Kruijzelbergen and made himself also suspect, Philippus du Bos, who upon his examination had altered that statement and made known that he had heard this without naming the person who was said to have told him such, and whereby the said Bos, who had shown the zeal with which he engaged himself for the interests of Captain Sierveld, had become suspect of having been himself the original inventor of that statement; so that, for lack of proof to the contrary, about which one could not doubt the calumny inflicted by that false statement on a chief commander of this place, a punishment ought to incumbent upon him, from which the well-mentioned Lord Governor himself, however, sought to excuse the said Bos on account of his youth, as well as his ill-considered and ill-applied zeal, so that one believed that for those reasons the oath of purge, which was then about to be taken by the aforementioned Equipage Master, would be sufficient against it. And thereupon it was declared by the well-mentioned Lord Governor that His Honour had thought, in order to prevent all wrong impressions to his detriment—which, as His Honour observed with regret, notwithstanding the presented arguments of the honorable members, the aforementioned statement was capable of raising and leaving behind—he now found it necessary to clear himself against such a vile imputation: however much it also struck the Lord Governor from the bottom of his soul to find himself compelled, without regard to his character which must be compromised thereby, against the statement of a person regarding whom, notwithstanding his low and bad conduct, all means of excuse had been employed. That His Honour had therefore caused the strictest questionnaires relating to that case to be drawn up, which he handed over to the Right Honourable Lord Commissioner, with the request that the aforementioned Equipage Master Duminij, who had been expressly summoned before the council chamber for that purpose, might be called in and interrogated upon the same under solemn oath before the entire assembly. 935 that the arrestee should remain at the Castle in the military prison with the provost, had addressed the Right Honorable Sir Governor to request the necessary orders for this purpose; but that the Officer of Justice, considering that the prison is intended solely for military personnel in cases of minor offenses, and not suited for keeping several persons separately and without access, and being already occupied by three persons, would not satisfy the intention and purpose of the aforementioned respected resolution, deemed it most advisable to have the arrestee taken to the ordinary prison. Which was also carried into execution by the Officer of Justice in such a manner that, after having the aforementioned van Cruijselberg escorted by some soldiers to the aforementioned prison with the permission obtained for this purpose from the Right Honorable Sir Governor, he had him specially placed in such a room where civilly arrested persons used to remain detained, as requested regarding his remaining in civil arrest, provided that no one has access to him, the Officer of Justice being bound by advice to bring this highly honored resolution into execution.
