864 865 suffered or held with respect to free burghers at the Cape, whom they had kept in apprehension for nothing and made out that both had made themselves guilty of gross offenses, which with respect to them is abundantly clear from the proceedings, so that the petitioner's assertion is nothing but a feigned allegation, on which account he remains completely silent regarding the judicial decree of apprehension, just as he acted regarding the Independent Fiscal, because the Fiscal was still provisional. The undersigned trusts that, without needing to add any further replication, the language of the petitioner, which the undersigned subject to correction considers to be true slander, will be recognized, his malice thereby, from his further conduct, being fully visible. All this having been presupposed, the undersigned considers no less that the judge was obliged to assist and come to the aid here, both to be able to administer and do justice in the case in question, and also to make himself respected, and to that end, being unable and not allowed to act himself, could not have acted better than to place the case into the hands of the provisional Fiscal, Mr. Jan Jacob Serrurier. And from that it can no less with certainty be gathered that the petitioner, even if he had been proceeded against in the aforementioned manner of summons and/or in any other possible way, in contempt and disparagement of his lawful and competent judge, and to defy him, would not have wished to appear, and as the future has taught, allowed himself to be found neither willingly nor by force. To act against the petitioner as shall be found proper. 866 That this feared Fiscal did not immediately set to work to bring the petitioner to his duty and have him corrected through legal means in proper legal form, is, following the assertion of the petitioner, very much to be wondered at, all the more so because to the Fiscal that person, pursuant to both pieces annexed hereto and other circumstances, must have been very suspect and known as a man who deserved very little leniency, and well deserved to be severely punished as an example, for it will be subject to very little doubt that he did his best to bring about disorder and unrest among the inhabitants, just as a great fermentation could already be observed among a portion of them. But it was handled quite differently here, and this will be the best proof of the falsity of the petitioner's allegations and the patience and forbearance of this Council and of the Fiscal. Here they still took the ways of amity, preferring to try and employ all other means before proceeding to such measures, to which, however much they were approved by the laws, one might nonetheless have given an appearance of severity or injustice. Which means were then also chosen by the President and approved by the entire Council; and the undersigned considers, subject to correction, that this manner of acting by the Fiscal and the Council of Justice, adjusted according to the circumstances of the times, is completely to be praised, and ought to be acknowledged with gratitude by the petitioner. Which, however, not happening from him, 867 86 must necessarily increase his guilt, wherefore the excuses produced by him do not merit the least reflection, and the natural consequence of his insolent conduct had to be a decree of personal summons, which presents the second grievance of the petitioner, claiming according to his position that because of the nullity thereof all proceedings and the judgment rendered thereon must be considered completely null. 2. The undersigned does not deny that, according to the aforementioned manner of proceeding and the general doctrine of authors, the designation of the fact or case must be counted among the requisites of a legal summons, and the summons itself not being among the documents, assuming that this requisite was missing here, it is nevertheless no less clear that this regulation differs among higher and lower courts, and citations are not accustomed to occur in a completely identical manner. The undersigned, upon consulting the rolls, noticed that this omission, especially in criminal cases, has been a custom for a long time, and the same was followed even by men skilled in the law, Mr. Joachim van Plettenberg and Mr. Willem Cornelis Boers, so that one only made use of the general terms of summons or attack in a criminal case; and the undersigned supposes that one adopted and observed this manner so that, given the great vastness of this country, by making the fact fully known no opportunity would be given to stay away or to abscond. 869

870 Neither is it in any way this summons upon which the sentence against the petitioner was rendered, and thus it can just as little involve a nullity thereof. The said summons is far more, like the preceding appointments, also to be regarded as a means that was used, and ultimately had to be applied, to make the petitioner comply with the first summons to bear witness to the truth, and the immediate consequence thereof upon his non-appearance was nothing other than a provisional writ of arrest, the sentence against the petitioner having been preceded by three edictal citations and a fourth citation ex superabundantia, upon none of which this petitioner having appeared, in accordance with the intent thereof, it was the immediate consequence; and since no defect can be found in this edictal citation, the undersigned believes, subject to higher correction, that the sentence pronounced thereupon will be no less valid; furthermore, the aforementioned edictal citation containing not only the cause thereof, but a detailed account of the entire matter, the petitioner is left without the slightest excuse, as he was granted the freedom and the ways were opened for him to appear, to defend and to purge himself, and the petitioner, being in bona fide, would certainly have found a hearing for his defense; but acting in dolo malo and convinced thereof in his own conscience, being unable to bring his pride to desist from his intention to decline and make contempt of Justice, he preferred rather to let himself be banished according to law, in order to live in Europe at the expense of others and to complain about nullity. Rijneveld, sworn Clerk. Whereupon it was resolved to circulate the said letter of representation among the honorable members for perusal, and to postpone the disposition thereon until such time. Subsequently, deliberations having been held upon the contents of a certain petition presented by the master of the Company shipwrights, Mijndert van Eijk, reading as follows: To the Right Honorable, Highly Esteemed Sir, Cornelis Jacob van de Graaff, Governor and Director of the Cape of Good Hope and its dependencies, etc., etc., etc., together with the Honorable Council of Policy of this government. Right Honorable, Highly Esteemed Sir, Honorable and Esteemed Sirs. The undersigned, master of the shipwrights, Mijndert van Eijk, shows with the required respect and most humbly: That since time immemorial, and indeed as the petitioner believes, at or from the beginning 873 874 of this settlement and colony, his predecessors were provided with a house and free lodging by the Honorable Company close to and on the beach until and including the year 1780, when a new town hall was built by Your Honors where the residence of the late master carpenter previously stood, and that it was then torn down; but according to the plan then drawn up by Your Honors, a new residence for the master carpenter was to be built next to the residence of the boatswain of the shipyard at the Lines; but which plan, as the petitioner believes, having been abandoned due to the subsequent outbreak of the war, so that up to now no further progress has been made therein, the then acting 875 master carpenter Philippus van den Bergh, finding himself aggrieved thereby, was granted monthly compensation by Your Honors for the loss of his free residence in rixdollars. The said van den Bergh having requested and obtained his discharge, the petitioner was favored with his vacant post in the year 1782, and just as his former predecessor, was granted monthly compensation of 6 rixdollars for house rent. And since the rents of the houses have increased excessively year after year on account of the numerous inhabitants, so that instead of 6 to 8 rixdollars, one must pay 20 rixdollars and more in rent in a month for one and the same house, 876 the petitioner, finding himself aggrieved thereby, addressed this honorable council by petition with the request, seeing that for a sum of 6 rixdollars he could not rent a room, much less a house, to live in with his family, to be supported in this regard by Your Honors, as Your Honors, according to your resolution taken thereon, were pleased to grant the petitioner, instead of rixdollars, 12 rixdollars per month. That notwithstanding this favorable improvement, the petitioner can show that during his appointment until today, he has had to contribute out of pocket a sum of more than 1000 rixdollars, although he has only made do with very mean dwellings, which were previously inhabited for many years by Chinese, which the petitioner leaves to the wise judgment of Your Honors. To this is now added that the petitioner has had the misfortune that in the past year, a fire broke out in an adjacent house rented by the petitioner, whereby, although he was spared from that disaster, he suffered an enormous damage due to the confusion in saving his furniture, both through the breakage and the loss thereof, which without overestimation amounts to more than 4000 guilders. 878 879 With the aforementioned [illegible] of 6 rixdollars being withdrawn again, and since the petitioner's family now consists of a wife and five children, for whose shelter the petitioner nevertheless needs a small house in which he, calculated at the very least, must spend 24 rixdollars monthly on rent, and thus must contribute 216 annually; moreover, as all living costs are exceptionally expensive, the petitioner is unable to subsist on his allocated salary; for which reasons the petitioner, in this urgent distress of his, turns to Your Honorable Worships with a humble request that it may please Your Honorable Worships to consider the petitioner's condition with Your Honorable Worships' customary, fatherly attention, and to grant the petitioner, according to old custom, a house for his free lodging. Which, having been taken into consideration, that the reduction of house rent mentioned therein is solely in dutiful execution of the highly revered orders of the High Commanding Lords Masters, yet on account of the laudable conduct and faithful rendering of service by the petitioner, coupled with his straitened circumstances, it was resolved to transmit this petition in its entirety to the Highest Superiors with a humble request to decide favorably upon it. In ownership to be allowed to have a certain piece of land adjacent to his place, and that on the basis of the permission detailed at length by him therein granted to the Honorable Company for a wagon road over his land during the late war, this petition was placed in the hands of the Lord Colonel Gilquin, as Director of Fortifications, in order to report whether the grant of that piece of land could also result in any prejudice or hindrance to the fortifications situated in its vicinity; pursuant to which, on a report from the aforementioned Lord Gilquin, the following report on the matter requested by petition was served today: To the Right Honorable, Valiant Lord Cornelis Jacob van de Graaff, Governor and Director of the Cape of Good Hope, and the Honorable, Worshipful Council of Policy. In obedient fulfillment of Your Right Honorable, Valiant and Honorable Worships' resolution dated 3 June 1788, by which it pleased Your Right Honorable, Valiant and Honorable Worships to place in the hands of the undersigned a certain petition of the citizen Lieutenant Christiaan Pieter Brand, in order to report whether the grant of the piece of land which the said Brand comes to request, whether now or in time, could also result in any prejudice or hindrance to the fortifications situated in its vicinity, and in case nothing of the kind should in any way stand against the grant of that land, whether it would not nevertheless be necessary to stipulate that the wagon road already made, or any other of the same nature through the freehold land of the said Brand, must always be left for free use in the service of the Honorable Company. 881 882 883 Thus, in order to properly comply with the above requirement, I have examined the said petition of the citizen Lieutenant Brand with the requisite attention, and found that he bases as a foundation a certain compliance which he supposedly showed towards the Honorable Company by permitting them during the war to transport the sods for making batteries from the Knokke watch up to the garden of the mate J. A. Munnik out of the valleys of the petitioner's place and along a wagon road over his land; as also that a piece of land was promised to the petitioner by the then Lord Governor van Plettenberg; further, that the petitioner until now had supposedly waited in vain for a compensation for damages which nevertheless had been promised to him on behalf of the Noble Lord Governor by the Engineer Wierts [illegible]; on which premises the petitioner founds his entitlement to request a certain piece of land surveyed by the land surveyor Jan Willem Wernich with the approval of the Right Honorable, Valiant Lord Governor, etc. Now, as far as the petitioner's voluntary permission is concerned, namely during the war permitting the Honorable Company to transport sods for the construction of batteries in his valleys and across his land, in order to be able to elucidate accurately to Your Right Honorable, Valiant and Honorable Worships to what extent the petitioner has made himself deserving with the Honorable Company thereby, I have inquired with the Engineer Wierts, under whose supervision the greater part of the batteries was made.

Regarding the promises made by the Noble Lord Governor van Plettenberg to the petitioner, I cannot report, since in that respect I remain in the most complete ignorance. But regarding the citation of the Engineer Schultze, who among other things was alleged to have promised compensation to the petitioner in the name of the Governor van Plettenberg, this is found to be stated erroneously and contrary to the truth in the above-mentioned petition, as I heard the aforesaid Engineer Schultze declare in the presence of Lieutenant Brand that, far from him ever having made any promises regarding this in the name of the Noble Lord Governor van Plettenberg, he was never charged with such a commission by His Honour. In order further, with the required local knowledge, to be able to inform Your Right Honourable, Valiant and Respected Honours whether the requested piece of land could now or in the future serve to cause any detriment or hindrance to the fortifications situated in its vicinity, and in case not, whether the grant thereof ought not to be accompanied by some conditions, I proceeded to the terrain and took ocular inspection of the piece of land in question, situated to the east of the house now inhabited by him, and have been able to perceive nothing that for the present could appear as detrimental or hindering to the existing fortifications by the granting and use thereof, it being situated far enough from the existing fortifications as not to cause any impediment thereto. As regards the future, however, and whether the grant of the said piece of land might in time also be subject to any inconveniences to the detriment of the Noble Company, on this article it is impossible for me to report satisfactorily, and in order also to set the minds of Your Right Honourable, Valiant and Respected Honours at rest in this respect, I shall respectfully take the liberty to propose the following compromise, to which the invalidity of the reasons adduced by the petitioner naturally gives rise: Namely, one could permit the petitioner, until further notice, to make use of the requested piece of land by planting or sowing it, with the express prohibition against erecting any building whatsoever upon it, so that the Noble Company, whenever it might at any time find it necessary, could always deal with it as its interests may require, without having any obligation of indemnification to the user. By this, the political and philanthropic system of Your Right Honourable, Valiant and Respected Honours, namely to draw all possible fruit and benefit for society in general from the idle-lying and uncultivated lands, could at the same time be satisfied, and in this case for the future all occasion or pretext would be excluded for displaying such ungrateful and arrogant pretensions as to consider it a reward-worthy favour to the Noble Company when one consents to allow it to use a passage or roadway over lands granted by it free of charge. Whereupon concerning the condition of the stranded ship Avenhoorn, by the interim Equipage Master Jan Arnold Voltelen together with the sea captains Christiaan van Veerden and Jan Kraaij, as well as the master shipwright Mijndert van Eijk, was exhibited the following report. To the Right Honorable Sir Cornelis Jacob van de Graaff, Governor and Director of the Cape of Good Hope and its dependencies etc., together with the Honorable Council. In the report by the undersigned dated 21 May of the current year having informed Your Right Honorable and Honorable Sirs that the stranded ship Avenhoorn at that time was buried fore and aft 3 feet in the sand, as well as that the water on the starboard side under the main chain-wales etc. and also on port in several places was forced out of the ship through the sheathing, the fore-part of the ship at the fokkestag over port, and the aft-part of the ship at the main chain-wales over starboard, and both forward and aft over the said sides of the ship had hogged and found the hold full of water, as well as the improbability of ever being able to work that keel off the beach, since we could then already with reason maintain that the keel was fractured; whereupon we, so far as practicable and possible, stopped the places visible to us where the water ran out, subsequently pumped an entire day with 4 pumps, which, although they at first became foul from the sand that was in that bottom, were raised and placed in the hold, yielding a reasonable quantity of water, yet we found not the slightest benefit or reduction, as it did not run out with the ebb, but ran in again with the flood, so that we could state with certainty that lower down in the ship, invisible to our sight, there must be other holes in the ship, to which we have thus by no means been able to gain access. 892 This keel, now as far as possible and almost entirely unloaded (apart from the ballast, some unmanageable items and more than 20000 lb of iron that lies below and is difficult to fish out), was inspected anew as accurately as possible by the undersigned, and found that by the stormy weather of 28, 29 and 30 May and the 5, 6 and 7 June it has been so battered and broken apart that now, upon inspection at flood tide, the water in it rises up to 12 feet high above the ballast, and falls again with the ebb as low as that bottom sits level with the water in the sand, which makes a rising and falling of four to 5 feet in the ship; from this it appears most clearly that that bottom must be fractured and burst in some places, the more so because we have recently likewise tried to pump it dry, but without it having any effect. Furthermore, we found the upper hull worked apart, dislocated, and on both sides forced forward over port and aft over starboard far more twisted than at our first inspection, and thus entirely out of its frame; 893 895 all of which gives even stronger evidence to our previous opinion, so that we can with reason assure Your Right Honorable and Honorable Sirs (that even had we the requisite machinery for it) it is impossible to haul that bottom off the beach except in pieces and fragments. In compliance with your Honorable, Valiant and Respected worships' venerated orders contained in an Extract Resolution taken in the Council of Policy on Tuesday the 20th of May last, whereby the undersigned Pro Interim Fiscal was ordered to make a proper and accurate investigation regarding the provision ship Avenhorn, which was torn from its anchors and driven onto the beach in the night between the 16th and 17th of the aforementioned month, whether and in how far the aforesaid accident arose through any carelessness or neglect of the ship's officers or anyone of the crew, and whether the said officers could and should have observed any care for the preservation of ship and cargo which might have been neglected in this matter, together with whether the same officers had indeed applied their diligence to have the ship in readiness to depart from this roadstead before the determined time of mid-May; it having also been approved to expressly commission the Captain at Sea and Pro Interim Equipage Master, the valiant Jan Arnold Voltelen, to be present at the said investigation to be conducted by the undersigned, together with such other maritime experts as shall still be at hand or are about to arrive here in the meantime and can properly assist in this matter, and therein to supply the remarks, considerations, or advice serving the case: the undersigned, according to his indispensable duty, could not fail to undertake and conduct the said investigation first, pursuant to the instructions of your Honorable, Valiant, and Respected Sirs, and to that end also to obtain the considerations or advice of the aforesaid pro interim Equipage Master, assisted by the Captains at Sea, the valiant Christiaan van Veerden, Paulus Kroon, and Axel Land, and now has the honor to put forward: That, notwithstanding regarding the stranding of the frequently mentioned ship some circumstances seemed to present themselves which at first sight gave suspicion of less diligence and attentiveness, yet upon examination the contrary and otherwise was found, as the annexed documents further demonstrate, and the ship's officers of that wrecked vessel can, according to the advice of the maritime experts, be fully acquitted. The same declaring unanimously that by the said officers, both before and during the stranding, all precautions were taken and everything was done and applied that could be required according to the circumstances of the time, sustaining that the stranding of the ship could be attributed to nothing other than the terribly tempestuous sea. That the aforesaid pro interim Equipage Master also declares that, no less, the loading of the ship was in no way delayed, but on the contrary all speed and progress was made to be ready for departure from here by mid-May, adding thereto that even had it been ready before that time, it could still not have left the roadstead on account of a lack of serviceable wind. That the undersigned, furthermore, trusting that the reasons given by the Captain in his account will legitimize him regarding his absence on board, as he was in no way intentioned to remain ashore, which will also hold true for the First Lieutenant, who, with more other naval officers, was forced by the heavy weather and sea to spend the night on land; and according to the unanimous statements of the officers, everyone of the crew, both great and small, having applied their best ability to do what could serve for the preservation of ship and crew, the undersigned believes, under higher correction, according to the result of the aforesaid advice and the further accurate examination, no signs of carelessness, and still less of neglect of duty,

On the proposition of the Governor to employ the chartered ship Rhijnoord, which has arrived in False Bay from the Fatherland, to carry the cargo of the ship Java to the Fatherland, as a committee was appointed for that purpose: The private ship Rhijnoord chartered by the Honourable Company having arrived here in False Bay from the Fatherland, which according to the charter party of that vessel falls under the condition of being able to be sent back to the Fatherland by this Government with a return cargo, the Honourable Governor was pleased to submit to the consideration of the Council whether the highest interest of the Honourable Company required that use be made of that ship in order to transfer and send to the Fatherland with it the cargo of the Ceylon return ship Java, also lying at anchor in False Bay, so that said cargo might still be conveyed in time to be disposed of by the High Governing Lords Masters, according as the interest of the Company should require. Tuesday the 11th of July 1788, all present upon roll-call. Which point having been maturely deliberated, it appeared questionable to this Council whether some difficulties or hindrances might stand in the way concerning this matter, whereof one ought to be informed prior to proceeding to a decision thereon; it has therefore been approved and agreed expressly to commission Captain at Sea and Pro Interim Equipment Master here Jan Arnold Voltelen, and also the Captains at Sea Christiaan van Veerden, Nicolaas Acker, Jan Craay, and Gerhardus Masson, in order to consider together all the circumstances that must concur in this matter and to report whether such a plan will be practicable or not, and in the latter case to state the reasons and causes which prevent it, or if they would prefer to abandon it for the Masters' service; and for the better execution of this commission, the charter party of the said ship Rhijnoord shall also be placed in the hands of the aforesaid commissioners for their guidance. Having proceeded thereafter with the confrontation of the books in which all the places granted on loan are registered against the aforesaid cash books, it has become apparent to us, after both the one and the other were likewise searched through and reviewed with the utmost precision, that the cited ordinance books, not only by the repeatedly mentioned 934 935 First Clerk Horak, but also by the sworn Clerk George Gerard Diemel, and several other ordinary clerks presently serving at the Political Secretariat, or formerly stationed there, contain very many annotations recorded and signed by them, according to which the persons noted therein are supposed to have paid to the Honorable Company, taken altogether, both on account of renewals and of overdue recognition monies, a considerable amount of rixdollars 20650, of which, however, according to the records kept of the daily receipts in the Treasury, nothing has been received there. Meanwhile, your Right Honorable, Highly Esteemed, and Honorable, Respected Sirs will be able to observe (if pleased to do so) from the compilation of the specific list Letter B, likewise submitted herewith—which is drawn up in the same manner as the aforementioned, with quotation of the names of the farmers who are supposed to have rendered the payment of the recognitions of the cattle places held on loan, and how those places are named—by which clerks the above-mentioned annotations (of which, however, some were found to be unsigned) were made, and for how many months of renewals and arrears, as well as up to what sums each of them signed for the same. 936 937 shall appear and demonstrate to what extent Texl. has made himself culpable and liable in this regard, whether with or without intent or not. The undersigned must further submit, with regard to the notes of the loan places whose arrears have been settled with delivered slaughter or draught oxen at the Company's outposts, that the receipts which should be granted in that regard by the respective postholders of the said posts are largely missing at the Political Secretariat, and that there are also some arrears, both in money and livestock, without proper notices of how many months have been paid in the one and the other; we have therefore found ourselves obliged to halt the investigation in that regard, and to suspend it until one shall have obtained from the cited postholders the general lists of all the livestock that has successively been delivered to their subordinate posts for the aforementioned purpose since the last ten years passed, in order that those lists subsequently, having been confronted with the aforesaid notes, may enable us to make a further report of our findings to your Highly Esteemed, Valiant, and Honorable Worships. Meanwhile, although we have taken all possible trouble to investigate in what manner the frequently mentioned First Clerk Horak may have arranged or practiced defrauding the Honorable Company in its rights and revenues in such a far-reaching, completely impermissible, and unheard-of manner, and attempting to enrich himself in such a shameful way along that path, we have nonetheless been unable to trace anything certain in that regard, except that there has come into our hands 938 939 a warrant, annexed hereto under Lit. C, which was signed by the Noble Governor and granted to the Master Sailmaker Cornelis Mol for the payment of the Lord's right, in the amount of 87 Rixdollars and 24 stivers, on account of a house and erf which was purchased from the burgher Christiaan Iffland for ƒ 10,500 and of which he also received transfer; the said Mol has attested to us that he handed over the aforesaid amount to the said Horak to deliver the same into the treasury, which, according to List Lit. A, did not occur. Yet, on the other hand, we have obtained some further light regarding the loan-money indirectly kept by the frequently mentioned First Clerk Horak for himself, as it has appeared to us from two receipts issued under his own signature, annexed hereto under Lit. D and E, that he has come to receipt from the farmers Douwe Gerbrandsteijn and Marthinus Els, the former for six years and the latter for twelve years and three months, recognitie monies that they were in arrears on their abandoned cattle places named therein; which receipts, as they were not granted by a Gentleman Cashier, are consequently by no means acceptable or valid, so that there also remains not the least doubt whether he has made himself guilty of more other such malversations. We furthermore add, however, under Lit. F, G, and H, a private declaration to the fellow farmer Johannes Liebenberg, according to which he handed over to the said Horak, in satisfaction of his arrears, a sum of 340 941 162 Rixdollars; likewise an autograph note or account from him, Horak, of such 376 Rixdollars as the Messenger of Policy Claas Jacob Claassen handed over to him for the account of Oltman Ahlers, on account of what is aforesaid; and finally a small note written by Horak himself, whereby he seems to have noted for memory that he received from Lucas van Vuren for three years of arrears 72 Rixdollars, and from Evert Potgieter for a cattle place taken on warrant 24 Rixdollars. Yet all of which aforesaid posts, just like those which, extracted in great number from the warrant books, have all together been listed on List Lit. B, have equally little been paid into the treasury of the Honorable Company. farmers have rented out to others their places obtained on ordinance, which can be considered as nothing other than an evil practice by which people undoubtedly know how to profit, this will for these reasons need to be countered by writing to and ordering the respective officers to prevent such illicit trade entirely. There have also come to our attention some write-offs of recognition moneys on various overdue loan places, which were made by order of the Honourable Lord Governor for particular reasons, either when the people were thrown out of their prosperity by the depredations of the marauding Bushmen Hottentots or by other causes, or fell into poverty; and since very easily gross abuses could arise from this, it would therefore, in order to prevent them, be very necessary that such write-offs henceforth no longer take place without the frequently mentioned Lord Governor having been pleased first to consent thereto in writing, under his signature, and with the inclusion of the motives that may have moved his Honour thereto. And as in the ordinance books many unsigned notes have been found, both of renewals and of paid arrears, and we, upon making inquiry into the reasons thereof, were informed that many a time the country people, upon inquiring at the office how much they are in arrears to the Honourable Company on account of their loan places, also have the ordinance drawn up without bringing the moneys for it into the Company's treasury, while in the trust that the arrears will be properly paid into the Company's treasury the note thereof is made in the books, in order to sign it upon the presentation of the receipts of the Lord Cashier; it will thus be necessary that a copy of the list of such places which, although a record was kept of them, were nevertheless not paid, be placed in the hands of the respective officers, in order to investigate how matters stand with them and the reasons why such farmers have concealed the ordinances without properly satisfying the arrears; while, in order to prevent such and other abuses and to be able to detect who is to blame for this, two or three of the most senior clerks serving at the secretariat ought to be employed to record the renewal of the ordinances granted on that account, and that the same clerks, in turns of three months to three months, shall not only have to sign for it in the books, but also, before delivering that ordinance, present it to one of the sworn clerks to be able to see whether the same has been receipted as paid by the Lord Cashier. And while it has caused the undersigned no slight trouble in this their investigation, and they have very often had to search at random when collating their notes with the cash books, as it has repeatedly happened that the payment on the loan places was recorded in the notes in the ordinance books some months earlier or later, even up to two years, such clerks to whom the keeping of the ordinance books is entrusted ought to be ordered to take care that the notes in those books constantly agree with those found on the ordinance receipt of the Cashier. And further concerning the payment of arrears, or relinquishments of places, the notes thereof ought to be made by the first or sworn clerks, only after prior examination of the receipt to see whether the sums of money are correctly calculated, and not by the ordinary clerks, just as one and the other was always customary in former times; it being furthermore necessary that, when the aforementioned ordinances and receipts shall have been registered and signed in the books in that manner, instead of letting them remain at the secretariat, as has also been practiced there against orders for some years, they must be returned directly to the holders, with the recommendation and order to present them at the earliest opportunity or without delay to the respective officers under whom they resort; while furthermore specific lists ought to be placed in the hands of the same officers from the secretariat, both of loan places that have been abandoned on condition that the arrears adhering thereto must be satisfied from time to time, as well as of those that are more or less in arrears, in order to be able properly to collect those arrears, which has also fallen out of usage. No, Right Honorable Sir and Worshipful Gentlemen, with reference to this so fatal event, they submit themselves to the favorable disposition of your Right Honorable and Worshipful Honors, which they request and await. The petitioners merely most humbly implore your Right Honorable and Worshipful Honors to be pleased to take into consideration what disastrous consequences an error and wrong course of action of the first petitioner have already dragged in their wake. And upon the submitted report of the committee of experts appointed at the session of the 8th of this month to examine the requisition for ship supplies submitted by Captain Jan Kraaff of the Ceylon return ship Jana, currently lying in False Bay, for the furtherance of his voyage from the said bay to this place, it was approved to conform thereto. Lastly, deliberation was held by Colonel Gilquin regarding the contents of the report submitted by the Colonel Director of Fortifications here, Philippus Hermanus Gilquin, on the written request placed in his hands for that purpose by Colonel van Hügel, commanding the Württemberg regiment garrisoned here, dated 5 June of this year, made concerning the field forge of the said regiment, which report reads as follows: Right Honourable Sir, Honourable Sirs. It appears much rather from the literal sense thereof, that the Honourable Company has wished to discharge itself by means of a buyout, by allocating for this purpose and for the neatness of the men to each Captain Commander of an Infantry Company 45 guilders and to the Captains of the three remaining Companies 55 guilders in Dutch currency, which, if the rix-dollars are calculated according to the terms of the Capitulation at 64 stuivers, will amount for the entire regiment to an annual sum of 1968½ rix-dollars. The Eleventh article of the Capitulation states immediately after the determination of the monthly pay of the Infantry: For the maintenance and prompt repair of arms, as well as for daily cleanliness, the noble Company grants to the: 8 Captain Commanders of the Infantry Companies, to each per month ƒ45, which makes per year ƒ4320:- Likewise to the Captain Commander of the Grenadier Company „ 55 _ „ 660:- Likewise to the Captain Commander of the Chasseur Company „ 55: — „ 660:- For the maintenance and prompt repair of muskets and sabres, as well as for daily cleanliness, there is granted to the Captain Commander of the Artillery Company: „ 55 — „ 660:- Total sum: ƒ6300:- Which, as just stated, yields an annual sum of 1968¾ rix-dollars, which would have to serve two different purposes, namely for the mending or repair of the firearms and the daily neatness of the regiment. By neatness is probably understood hair powder, grease, and shoe polish. If one now examines with some accuracy whether it is at all possible, by means of this fixed annual sum, to satisfy both these objects, one will find that for the neatness and the repair of the weapons of each man, scarcely more than 1 rix-dollar annually could be disbursed, and that this sum in Europe, where the materials required for this are not nearly as expensive as in these distant places, would not even be sufficient. Therefore, under humble correction, we believe that it will be utterly impossible for the Captains of the Württemberg regiment to satisfy the aforesaid purposes by means of that fixed sum, so that it is very apparently to be foreseen that, if the Honourable Company, according to the literal sense of the Capitulation, considered that it could not take the repair of the weapons of the infantry upon its account, and demanded any disbursements from the Captains beyond exact supervision in that regard, very well-founded grievances and claims would arise from this; all the more because the High Contracting Parties express themselves thus in the 19th article of the Capitulation: The officers, non-commissioned officers, and soldiers shall participate at the Cape of Good Hope and in the Indies in all the advantages of the other troops of the Company, etc. Since the weapons of the other troops of this garrison are now repaired at the expense of the Honourable Company, it seems that the Captains of the Württemberg regiment also have a claim to the same privilege, and that, pending the decision of the High and Mighty Lords Majors, one might provisionally assume that their intention was, by granting the aforesaid modest sum, to encourage and oblige the Captains to provide properly at their own expense for the neatness of the men under their command, and to maintain an exact supervision over the repair of the weapons; since it is more than presumptive that the High and Mighty Lords Majors, far from wishing to burden the Captains of this regiment with an unbearable load, aimed to examine them and enable them, in an advantageous manner, to strictly fulfill their duties. Having detailed this questionable point somewhat, and it having appeared therefrom that a further decision of the Lords and Masters was required in order to determine with certainty at whose expense these repairs ought to occur, I shall endeavor to meet the intention of your Right Noble, Honorable, and Respected Sirs by proposing the manner according to which I believe that the repairs of the weapons for the said regiment could provisionally be provided for here by the Honourable East India Company with the greatest economy. The scarcity of the necessary military buildings in this government not permitting the allocation of a suitable workshop, both for the artillery and the infantry of the Württemberg regiment, we believe that the small blacksmith shop standing behind the central section of the new hospital—and destined before the last war for forging and fitting the ironwork for this building currently under construction, though used from the beginning of the war until this date for making and repairing the necessary ironwork for the equipment of the artillery—

984 985 artillery of this government, could be ceded to the regiment of Wartemberg in about a month, or as soon as possible, in order to repair the infantry weapons there, in so far as the cramped nature of the premises will permit; the master gunsmith of Wurtemburg being able, if your Right Honourable Worships should approve this arrangement, to receive all the instruments and materials required for that work from the master administrators themselves, or else from the master of the Honourable Company's said armoury, upon a proper receipt also signed by his commanding officer and certified by the Lord Colonel Commandant of the Company's troops, under whose direction the ordinary armoury for the infantry of this government falls. And since there is no doubt regarding the payment for the repairs to the artillery of Wurtemberg, I could take it upon myself, so long as no separate workshop for the artillery is available for that regiment, to have all the repairs that might be required for it executed in the ordinary artillery workshops of this government, under the supervision of the officer appointed for that purpose, according to the specifications of the Captain of the Company's artillery of Wurtemberg. The craftsmen required for both tasks could be taken from among the most capable workers of the said regiment, and since the Honourable Company, pursuant to the cited 17th article of the capitulation, grants to the craftsmen of the artillery of Wurtemberg, over and above their ordinary wages, a pay equal to half the income of the permanent workers of the place where the regiment is garrisoned, the same payment could, pending their High Mightinesses' approval, be granted to the workers for the repairs of the weapons of the infantry, on the express condition that all the costs incurred herein shall be reimbursed to the Honourable Company by the regiment of Wartemberg, in case the Honourable Company should unexpectedly disapprove thereof. The undersigned believes, under respectful correction, that these arrangements would provisionally be the most convenient and least expensive for the Honourable Company, and that he has thereby complied with the contents of your Right Honourable Worships' highly respected resolution of the 5th of this month, with which I have the honour to call myself, with due respect, Underneath stood: Right Honourable Worshipful Sirs.
