396 391 granting the petitioner permission to finish the aforementioned buildings, they have nevertheless seen fit to stipulate expressly that these same buildings, no less than the piece of land situated on the other side of his house, may never be separated or split from the same house, and thus may not be sold, rented out, or alienated separately, but on the contrary shall always remain with and belong to each other. That the petitioner, meanwhile, far from being able—as he had hoped by erecting the aforementioned buildings—now to demolish them again without his ruin in order thus to be in a position to sell the plots according to the tenor of their deed of grant, since the change of times has also caused a considerable decline in the arrival of ships in the said bay, so that the petitioner has found himself utterly deprived of all the advantages intended thereby; the petitioner, on the contrary, must now to his insupportable detriment experience that the interest on the debts which he incurred for the construction of the aforementioned buildings, which having been erected in the most expensive time cost him very dearly, weigh so heavily upon him and his family that without any relief and solution in this respect, the ruin of this same family of his will inevitably be caused thereby. That in order to prevent this, the only thing remaining for the petitioner is to reduce his overhead and also to pay off a portion of those debts, which however cannot be done except by selling the aforementioned buildings, so that the petitioner finds himself compelled to take refuge in your Right Honourable and Honourable Sirs, as from whom he may most certainly expect and trust that as long as it is in their power and ability to prevent and avert the detriment and ruin of a family, they will also gladly be inclined to do so. 394 395 Satisfaction taken in the exchange of two soldiers for two others from the Württemberg regiment. The Lord Governor having made known what services his Honour had obtained from the Extraordinary Engineer Barbier in the preparation of plans and three maps for dispatch to the high commanding Lords Majores. Proposal of the said Lord Governor to place the same in the vacancy of the deceased Engineer Pieter Cloete, subject to the favorable approval of the high commanding Lords Majores, as Lieutenant Engineer with the associated wage of f 50 per month. It having also been understood upon the proposal of the Lord Governor that the instruments of the deceased Engineer Cloete should be purchased on the Company's account for the service of the cadet school as well as the garrison. The Lord Head Administrator Rhenius makes known the low stock of rice in the Company's pantry. And that the bombardier and mechanicus Diege be granted payment in proper proportion for the extraordinary services shown in making various templates and models for the artillery. The exchange of two soldiers, namely Jan Michael van Stampen and George Christiaan Gants, for two others from the Württemberg regiment, namely Marthinus Henricus Becker and Johan George Rader, provided that for the first mentioned there shall be paid into the Company's treasury whatever they might owe on their accounts, and the last mentioned shall engage themselves in the service of the Honorable Company at least for the time that the two transferring soldiers were still bound to remain. The Lord Governor was further pleased to make known to the council that his Honour, in response to the very esteemed mandates of the high commanding Lords Majores, having had to cause some plans and charts to be prepared, some of which have already been dispatched to their Honours and others are still being worked upon, his Honour was served and assisted in these operations to such great satisfaction by the Extraordinary Engineer Dominicus Michaels Barbier, that his Honour could not fail to be mindful to reward this officer reasonably. That although through the support which his Honour had contributed to the said Barbier from his private means in his straitened circumstances, some temporary solace had been provided to him, and that officer out of gratitude therefor had found himself spurred on again to a zealous assistance of his Honour, the competence and untiring diligence of the same nevertheless shone forth so greatly that, if no essential reward were bestowed upon him on that account, it would provide no emulation in others, and might also easily cause the keen zeal in that officer himself to flag. 410 411 While provisionally, for the purpose of filling the place of the repeatedly mentioned Horak on the Council of Justice, after the said office had been promoted, Willem Stephanus van Ryneveld, upon the proposal of Rhenius as a member, having been appointed the sworn clerk of the Judicial Secretariat, to examine accurately the conveyances of immovable properties, as well as the order books of the loan places, against the cash books of the Honorable Company, all entries of the Lord's rights and loan moneys which have been neglected to be paid to the Honorable Company, in so far as the said rights ought to have been paid, and loan moneys on the places incorrectly marked by him, Horak, as cleared, being of the Council, which nevertheless are not found accounted for in the Company's cash; as well as to bring together all such entries into a general list or account, and subsequently to deliver that list or account to this Council. And since the aforesaid stamped and further prepared cardboard is now to be issued from the Company's treasury in place of the former old currencies, it has been resolved to notify this by publication and at the same time to state the characteristics by which the aforesaid cardboard is to be distinguished, in order to be esteemed by everyone as good and valid according to the value set upon it. The aforementioned Governor having thereafter also made known to the assembly that when, a year ago now, through the bursting of a 24-pound cannon at the Amsterdam battery, on which occasion some men pitifully lost their lives and others were very dangerously wounded, the necessity had been perceived—for which a military commission had been appointed—of having all the cannon at the disposal of this government about which any doubt still existed, subjected to such tests before employing them to garrison the various posts as His Honour had deemed necessary, and which also, after deliberation by the entire corps of artillery officers headed by Colonel Gilquin, were found to be the most prudent; and that, after having had these tests carried out, several more pieces of cannon from the same foundry and another from which the burst piece had originated having also burst or been found entirely unserviceable, only the remaining serviceable and approved cannon were subsequently distributed and placed among the various posts in accordance with the plan drawn up regarding this under His Honour's direction by a special military commission appointed for that purpose, composed of several officers of the artillery, with which the head of the militia, Colonel Gordon, as well as the said corps of artillery officers together with their chief, the aforesaid Colonel Gilquin, had also concurred; which aforesaid plan, together with the observations pertaining thereto, the said Governor was pleased to produce to the assembly. Colonel Gilquin presents a written memorial regarding the promotion of officers and an improvement in the artillery. Gilquin had been urged to insist in writing to His Honour to propose to this Council a promotion of officers in the often-mentioned Corps, and further such other improvements among the same and in the engineers as the written memorial of the often-mentioned Gilquin contained, reading: To the Right Honourable, High and Well-Born Sir Cornelis Jacob van de Graaff, Governor and Director of the Cape of Good Hope and its dependencies, etc., etc., etc. Right Honourable, High and Well-Born Sir, Whereas by the resolution of the High Commanding Lords Majores dated 28 July 1785 we are authorised to increase the artillery here in so far as shall be judged strictly necessary by Your Right Honourable Sir, and Your Right Honourable Sir's views regarding the currently existing necessity thereof are fully known to me; while pursuant to the secret considerations communicated to me by Your Right Honourable Sir, we find ourselves in the most urgent circumstances to employ all our powers so as to be able as soon as possible properly to serve the factory artillery of this Colony, so that on all occurring occasions one could and might promise oneself some better prospect and desired effect thereof; and it having fully appeared from the recently submitted report of the Military Commission of 26 February how insufficient the present number of officers as well as of ordinary artillerymen was found to be for manning the various posts that are garnished with artillery; I have therefore, in order not to be charged with any neglect of duty in these critical circumstances, and in accordance with the intention of the High Commanding Lords Majores, to make use of the available persons to the greatest benefit of the service of the Honourable East India Company, while there still seems to be time to qualify them for artillery service, judged it unavoidably necessary to propose to Your Right Honourable Sir to increase the ordinary artillerymen of this garrison, who currently number 300 men, to the number of 390 men, and out of the two companies provisionally to form three, whereupon each company would consist of 130 ordinary artillerymen, whereby after deduction of the sick and incapable one could always count on at least 100 healthy duty-serving men per company. M. a piece of waste land granted in ownership. having prevailed on the said vessel, in order to prevent the further contagion thereof, the wise arrangement has been made by Your Right Honorable and Honorable Sirs that none of its crew members shall be granted permission to come ashore, but that the said ship, after discharging, is apparently to return to Batavia, and the petitioner also finding himself in the same case, if he were forced to follow the aforementioned ship Avenhorn again, would have to experience very great hardship, for the reason that he, the petitioner, during his absence at Batavia and since that time, has been suffering with a sickly body, whereby he has been rendered incapable of properly attending to his said post, for which reason the petitioner turns to Your Right Honorable and Honorable Sirs, with a very humble plea that it may please Your Honors' most favorable pleasure to permit him, the petitioner, for the recovery of his health, provisionally to remain for some time, with suspended pay, either on Robben Island or on the brigantine vessel the Helena Louisa purchased by the Honorable Company, and this until such time as Your Right Honorable Sirs may be pleased to dispose concerning him, the petitioner, as Your Honors shall deem best and most advisable to be proper. Against which it was understood that the request likewise made by petition by the fellow former burgher councillor Jacobus van Rheenen the elder, tending to have in ownership or hereditary lease four pieces of land adjoining his three farms, together measuring twenty-four morgen, four hundred thirty-five square roods, and seventy-four ditto feet, shall be held under advisement until there shall be an opportunity to cause a further inspection and investigation to be made concerning the situation and extent of that land. On behalf of the burghers Godfried Fredrik Koch and Jan Jacob Jarling here, the fellow burghers Sebastiaan Valentijn van Rheenen and Abraham de Haan having been given as sureties for the executing of such suretyship as under which they, by resolution of the 4th of March last, are permitted to enjoy payment of half of the agreed sums of money for the construction of the storehouse and the timber shed in the Mossel and Plettenberg Bays, it was understood to take satisfaction in the said persons for this suretyship. Whereas, according to the resolution adopted in the session of the 14th of March last, among the reasons that moved this Government to purchase the small vessel the Helena Louisa for the Honorable Company in the said bay, the necessity thereof was also noted in order to be enabled to employ the frigate De Meermin for this year still to collect a cargo of timber from Plettenberg Bay, by which, however, the difficulty of transporting the grains from Mossel Bay to this place has not yet been removed, and for which one had continually hoped that some opportunity or other would present itself, of which one nevertheless finds oneself destitute to this day, so that, if the outbound ship Avenhorn were also to be loaded here with wheat and other grains, the necessary supplies would thereby be reduced without having any means to replenish the same with that which is at Mossel Bay; and which grains in Mossel Bay, to the great disadvantage of the Honorable Company, would meanwhile have to be left to spoil, since no use can be made of them there at that time. Wherefore, having now taken into consideration the manner in which to extricate oneself from this predicament to the greatest service of the Company, after mature deliberation it has been thought fit and resolved to dispatch the said ship Avenhorn to the aforesaid bay in order to collect those grains in the aforementioned bay instead of the wheat and other grains that one would still have to send from here with the same to Batavia, and therewith to let it proceed directly on its voyage to the said capital of the Indies. Whereupon, taking into consideration that the aforesaid Artois, for greater security in having his funds ready for remittance, had his former authorized agents place the same into the Company's treasury, and that the funds were received and accepted on that footing, so that without the express desire of the same Artois they ought not to be released from the said treasury again without having adequate assurance that the same can be immediately returned therein at all times, it is therefore understood to approve the request now made by the aforesaid present authorized agents of the said Artois, provided that besides the offered indemnity they shall likewise, to the satisfaction of this Council, provide security that the aforementioned monies, in so far as they currently remain in the Company's treasury and shall be handed over to them, will be restored to the same treasury immediately upon the first requisition.
