Then, whereas they, by letter of the 11th and 12th of October last, have primarily, preliminarily, and amply reported in what manner they had conducted themselves in the handling of the linens, as well as regarding the selling of the wreck, the casks, and otherwise, and the purchasing of the goods according to your Right Honorable and respected orders contained in the missives of the 1st and 8th of October of the past year, paired with their considerations regarding the instructions given to them by the honorable committee members, they took the liberty to refer to the contents thereof, and shall now have the honor to present to your Right Honorable and respected worships an exact list of the linens, aloe, cinnamon, cotton, and other goods brought thither to the said bay under the supervision and accountability of the military ensign Jan Aloé, consisting of: 22,215 pieces of linens in 502 bales and 90 packages, and gum myrrh, aloe, red earth, not on the invoice of the ship De Maria, cinnamon, cases, cotton yarn, coconut oil, 80 bundles of sappanwood linen. While the purchased goods, fully specified on the annexed list, have been handed over to the supervisor Fredrik Meeding as having custody of the other equipment goods. Whereas, due to the washing, the usual characteristics, such as sizings, foldings, and otherwise, the names of some sorts of linens were doubtful to the undersigned, they, in order to commit no errors in this regard—the more so since from the invoices sent to them they could discern nothing, as being only an extract by way of a brief invoice, in which neither length nor breadth nor any other mark was known for each sort of which a certain number was on hand—took out one whole piece and brought them by wagon, to the number of 52 pieces, to the headquarters, which they showed to the bookkeeper of the trade warehouse, Arend de Waal, as being an expert, whereby they are now enabled to state the various packed sorts of linens; just as they also, from those sorts of which only very few were salvaged, cut off small swatches as samples, which the said De Waal was nevertheless unable to identify, for which reason they have been recorded under the name of miscellaneous linens on the annexed lists; all the linens together being packed in 232 gunny and 270 canvas bales. Contrary to expectation, the gunny, which had been sought out with great care from all sides, having reached nowhere near as far as had been imagined in the beginning, and of the purchased old sailcloth, after the linens were packed, which could only be accomplished with very great effort—although the local inhabitants assisted the undersigned, when they also began to experience a lack of this material toward the end, according to their means with sailcloth under promise of restitution—nothing more remained, so that nothing was left to pack the cinnamon and cotton in sailcloth or gunny; and noticing that such could be stored well, suitably, and less expensively in cases, they purchased from the inhabitants over there a lot of 1-inch planks—since those in the warehouse were too thick to be employed for such chests—for the making of cases for the storage of these two items. Then, for lack of a proper scale, one could not determine how many pounds each case contains, and had to be content with specifying the number of the cases. The cinnamon, having lost very much of its value and acquired a salty taste, which also occurred with the cotton, because the flat roof of the warehouse, after a long and continuous rain of more than three weeks, became soaked through, began to leak so suddenly and violently that all means that could possibly be applied to stop the leaking were in vain; the dampness having penetrated the cotton caused the salty particles to dissolve, and it became anew as wet as if it had just been pulled from the sea, so that they were forced to have the same washed, which then also resulted in that which the undersigned feared with reason, as they had the honor to mention in their respectful letter of the 19th of December of the past year. As regards the aloe and myrrh, which gums suffered very much from the seawater, for which reason also the old cases were too bad to be used for making new ones, they had cases made from 1¼-inch yellowwood planks taken from the Company's timber stock. The bales as well as the cases are all marked: Company's Ship Maria, Plettenberg Bay; the bales marked from No. 1 to 542, and inscribed with as many pieces as each of them contains; and in case your Right Honorable and respected worships should be pleased to decide to send the linens from there directly to Europe, the undersigned could, at your supreme pleasure, furnish the military ensign Jan Aloé with a list, according to which the same could then be labeled, which, however, will not be necessary if they are brought to the headquarters, since the marking can then be done here. Among the same packages are found those filled with torn pieces and rags of both white and blue linens, which cannot endure the voyage to Europe, as well as some heavily stained and mildewed ones, clearly made known on the annexed invoice. The cases from No. 1 to 24, and inscribed with their contents, except the case of red earth, which the undersigned could not identify and merely marked No. 6. Although the undersigned applied every effort to make the warehouse roof watertight, just as the burgher Prabling, contractor of that building, had laid an entirely new plastering upon the same shortly before the rain, the roof fortunately became waterproof only when the linens were already packed.

measures taken to transport to the place were, on account of the continuous rain, so leaky that, in order to preserve the linens, one was compelled, over the bales and cases stacked pyramid-fashion, to erect a wooden shed of about [illegible] feet, using for that purpose 1.¼-inch boards from the Company's stores, without the woodwork, being bound together only with spun yarn, running any risk of suffering damage, whereto one was all the more compelled because the flat roof, leaking equally heavily everywhere, rendered the restacking of the bales in case of leakage impossible and would have been without avail, whereas they now lie secured from the wet, every care having been taken in the erection of the wooden shed to make it water- tight, as was also seen during rainy weather, that it answered its purpose: shortly before the departure of the undersigned from there, it was reported by the burgher Thomas Ignatius Ferreira that on the beach of the Tzitzykammar, about eight days beyond Plettenbergsbaaij, some cooperage that had belonged to the cargo of the Maria had washed ashore; offering at the same time to take over the same for the sum of 50 rixdollars, whereto the undersigned did not agree, but instructed him to have the cooperage appraised by two impartial persons, and thus pay that amount to the satisfaction of the Right Honorable Lord Governor into the Company's treasury, whereupon he would be permitted to take the same for himself. Report regarding the stranding of the private return ship Drietal Handelaars, which occurred in the night between the 16th and 17th of this month near the so-called Zwarteklip, as well as the arrangements that said Resident immediately put into effect for the assistance of this ill-fated vessel, and that in consultation with the Gentlemen Captain Rrickenius and Lieutenant Claris, commanding the Country's ships De Beschermer and De Pyl presently lying in the bay, which gentlemen also, according to the contents of a very obliging missive addressed by the first-named to the Lord Governor, did not fail to apply from their Honors' side everything that lay in their power to support said Resident with all zeal in these his efforts; while at the same time said Governor made known that His Honor, immediately upon receiving this distressing news, had given all such orders as His Honor had deemed proper in that sad juncture, and to that end, without any loss of time, had caused the beach to be guarded by a military watch and had dispatched the Master Attendant thither to investigate there and effect everything that could still be accomplished for the preservation of ship and cargo; but that he, the Lord Governor, yesterday evening had received a missive from the said Master Attendant which, although provisional, nevertheless contained nothing favorable regarding ship and cargo, as the ship at the arrival of the Master Attendant already had fifteen feet of water at the pumps and the false keel was already broken, wherefore there being no further hope of getting that ship off the beach again, they have thus had to resolve to have the cargo discharged and transported to this place as soon as possible by commissioners to be dispatched thither, while further regarding this striking accident and the causes thereof, they will cause such a legal inquiry to be made as must and can take place in accordance with the nature of the matters and the contents of the Charter-party of that vessel. 382 82 37 383 which shall be Representation of the Lord Head Administrator Books written off and burned From which list it appearing that the aforesaid detached currency pieces consist of a sum of 376007:– rixdollars, it was understood, after this amount shall have been written off in the Honorable Company's books, to destroy and burn the paper currency pieces in this respect, and to expressly commission thereto the Lord Secunde Johannes Isaak Rhenius along with the commissioners over the small cash box. By the just-mentioned Lord Head Administrator of Trade having furthermore been exhibited an ample representation containing the reasons why they had not thus far been able to get ready with the preparation of the trade work that annually is customary to be sent from here both to the Commanding Lords Majors and to the High Indian Government, as well as a proposal to be able to carry out that work in the future with greater speed and regularity, that representation, upon its resumption, was found to be of the following tenor: To the Right Honorable, Valiant Lord Cornelis Jacob van de Graaff Governor and Director of the Cape of Good Hope and its dependencies, etc. etc., along with the Honorable Council of Policy. In dutiful fulfillment of this respected order, the undersigned has the honor to report that the aforesaid persons, during the time they were maintained here in the hospital, earned no wages, in conformity with the Company's troops here; subsequently having recovered, their wages were disbursed to them monthly, by order of the Right Honorable and Valiant Sir the Governor, on account of their destitute condition, during the time they successively performed service on the Line, as Your Right Honorable and Valiant Sir and Honorable Sirs will be pleased to observe from the annexed copy of the receipt of Beaumont and Boussel, the first having departed for Europe per the Stavernisse and the second per the Diamant as unfit, and dutiful notice of their final payment having been given to the High Governing Lords Major, as appears from this annexed extract pay memorandum; nothing having been paid to Johan Louis Le Frank because he was only outside the hospital for a few days, and two months having been enjoyed by Adriaan Bonselier, for as long as he performed service on the Line, which two last-mentioned subsequently deserted, without having earned or made good anything with the Honorable Company. Because nothing was made known here at the office to the then Pay Bookkeeper Salomon van Echten regarding any regimental debts, no deduction could be made thereon at the aforementioned payment, but their earned monthly wages were fully paid out to them when they were employed in the service of the Honorable Company. If therefore the Duke of Luxembourg suffers any disadvantage hereby, this cannot be attributed to any dereliction of duty or negligence of the pay officials here, but solely to the fact that upon their remaining behind here, no mention was made of any debt by Colonel d'Hugonet, who commanded the detachment, or by his quartermaster, neither regarding the four persons mentioned above, nor of others who remained here from the ship 't Lam and likewise successively deserted, of whom the respectful subscriber sent a name list to the gentlemen of the Colony's government under date of 18 July 1786, in conformity with what was requested in their letter under date of 20 January 1786, indicating where the aforementioned persons further ended up, of which the undersigned also has the honor to append this copy. And subsequently was read a petition presented by the Secretary of the Council of Justice, Christiaan Ludolph Neethling, reading as follows: To the Right Honourable, Right Valiant Sir, Cornelis Jacob van de Graaff, Governor of the Cape of Good Hope and the dependencies thereof, together with the Right Honourable, Worshipful Political Council of this government. Right Honourable, Right Valiant Sir, Right Honourable, Worshipful Sirs! With due respect, your Right Honourable, Right Valiant and Worshipful humble servant, the serving Secretary of the Honourable Council of Justice of this government, Christiaan Ludolph Neethling, makes known that the petitioner, having entered into the service of the Honourable Company in the year 1700, has since that time here in the government in various capacities in writing, as he trusts to the satisfaction of his Lords and Masters, with proper vigilance performed his duty. Muller jes van Carman previously to the uncommon pleasure of this government, had distinguished himself so much whereas the same at present, however much inclined to fulfill in all respects the duties to which the master's service bound him, very often by the oppressive burden of his high advanced years, was unable to fulfill them as required, whereby the work of justice in this government necessarily had to undergo a notable delay, since the sworn clerk of justice often had to be present at commissions in the outer districts, and one thus, in matters that could not be postponed until his return, found oneself not a little embarrassed in the administration of justice, just as had recently occurred during the passing of a certain report of one Godfried Fredrik Sort, at the requisition of the Fiscal office, when the Secretary, although present at that commission, yet on account of infirmity being unable to read, had to let his function be performed by the adjunct fiscal, while furthermore the case had occurred that a judicial inquest of a person who had hanged himself, had to take place without the assistance of the Secretary or sworn clerk of justice, and thus no proper record could be kept of it; all of which, together with several other reasons introduced by the aforementioned two gentlemen, has convinced the Council of the unavoidable necessity that the aforesaid request of the petitioner be granted without any delay; wherefore, having regard to the capabilities 41 p: 415 of the actual second clerk at the judicial secretariat, namely the bookkeeper Willem Stephanus van Ryneveld, it has been resolved to appoint the same, subject to the favorable approval of the high commanding Lords Masters, as adjunct Secretary of the Council of Justice, with the rank of junior merchant, while one will further look for a capable person to replace him in his post of sworn clerk, and thereby strive, as much as possible, to prevent the disadvantageous consequences which would naturally arise for the general welfare here from an obstruction in the course of justice. Vaillant, Verhuell, and Graevestein were duly received according to orders with the customary honors. 417 Declaration regarding the outbreak of fire on board the ship Doggersbank, whereby the ship's authorities were forced to throw overboard the gunpowder mentioned alongside And on this occasion, the Independent Fiscal, Mr. Johan Nicolaas Steven van Lijnden, while submitting a declaration made by the officers and petty officers of the outbound China ship Doggersbank lying here in False Bay at the requisition of the Captain of that vessel, reported that on board that ship on the 17th of March last a fire had broken out in the Gunner's Room, caused by the breaking of a case of vitriol oil belonging to the chief surgeon Eldert van Santen, which generated an enormous smoke and heat throughout; such that the officers of the aforementioned vessel, in order to prevent all further misfortune and not to risk the ship and cargo with so many souls to the terrible effect of the gunpowder, had decided to throw overboard the said gunpowder, both for ship's use and for transit to this government laden in that hold, whereby a quantity of 9656 lb of powder, among which was 5000 lb for this government, was lost. And whereas the highly respected orders of the High and Mighty Lords Masters, recently received, oblige this government to use all possible dispatch with the departure of outbound ships destined for the west of the Indies, and particularly for China, the aforesaid Independent Fiscal declared that he was thereby unable to initiate anything with regard to this case, which is so detrimental to the Honorable Company, since the inquiries which His Honor would have to make for that purpose would notoriously require a longer stay of that vessel at this corner, and it might thereby perhaps miss the voyage to China; 418 The said declaration shall now, for the reasons mentioned alongside, be sent to Batavia. Discovery of the burgher Hendrik Hermanus Bosch, banished from here. wherefore His Honor requested that the said declaration might be forwarded to the Lords of the High Government of the Indies, in order that their Most Honorable and Right Worshipfuls, upon the arrival of that vessel in Batavia, might cause such an inquiry into this matter to be made there by the Fiscal's Office as they might deem proper; in which proposal of the said Lord Fiscal it was agreed to condescend. Communication from the Gentleman written to his Honour separately. Deliberation over this instruction. Deliberation having been entered into, the Lord Governor was pleased to make known to the Council that His Honour had found himself honored these days with a missive from the High Indian Government addressed privately to His Honour concerning the aforesaid Junior Merchant van Rossum, wherein Their High Honours were pleased to instruct him, the Lord Governor, that whereas the said van Rossum had departed from Batavia on the said vessel without Their High Honours' special permission, and notwithstanding that the skipper of the above-mentioned wrecked ship 't Drietal Handelaars had been ordered not to take him along, he, the Lord Governor, was qualified not only to conduct an exact inquiry into the manner in which the said van Rossum had departed from Batavia on that vessel, and whether its skipper had taken him on board on the order of anyone other than Their High Honours, but also, if such an order had been given, to obtain copies thereof, and, transmitting the same, to give the necessary notice of the result of that inquiry as soon as possible, both to the Right Honourable Grand Respected Gentlemen Directors at the Amsterdam Chamber and to Their High Honours; for which communication the well-mentioned Lord Governor having been thanked, it was taken into consideration in that regard that this instruction only comprised an inquiry into the manner in which the said van Rossum, without the special consent of Their High Honours, had dared to emancipate himself to undertake the voyage to the Netherlands on the frequently mentioned ship 't Drietal Handelaars, without Their High Honours giving this Government any order or qualification to detain the person of the aforesaid van Rossum here, much less to send him back to Batavia; to which was added that, if the vexatious accident that befell that vessel here had not existed, the said van Rossum would not have needed to address himself to this government to obtain permission to continue his voyage on another vessel; all of which having been taken into close consideration, it was judged by the majority that one was in no way authorized to halt the undertaken voyage of the frequently mentioned van Rossum on the grounds of the aforesaid instruction, wherefore it was resolved to grant the petitioner his made request, and thus to grant him passage on the chartered ship Paternisse, provided he shall be obliged to behave according to the charter party of that vessel; while the Lord Governor declared that he would execute the charge entrusted to His Honour punctually and without delay, and would dutifully report thereon to Their High Honours. Permission granted to the said van Rossum to depart on the ship Paternisse. Request of some officers of the regiment of Luxembourg. Whereupon the following petition was exhibited by the officers of the regiment of Luxembourg remaining behind here, de Finiels, Tonnon, and Du Platel: To the Gentlemen, the President and Councillors of the High Regency of the Cape of Good Hope. Gentlemen, Your deliberation of 30 January of this year, in pronouncing upon the treatment we are to enjoy at the Cape, based its decision on the customs established in this Colony. To be reduced to less than half of their pay is an affair too important for military men who have only this means of subsisting outside their homeland, not to desire to be informed of the customs which condemn them so harshly. Consequently, we have the honour to beg you to be so good as to cause to be delivered a copy of the Instructions and orders of the Company which served to instruct your deliberation of 30 January 1789, as well as the schedule of the pay granted in this Colony to Captains of the Garrison having Companies, and to the Lieutenants and Sub-Lieutenants employed in the service of the place. In this expectation we have the honour to be very respectfully, Gentlemen, Your humble and very obedient servants, Signed: de Finiels, Captain Commandant, Tonnon, and du Platel. 434 / 435 Petition of Captain de Maurras was handed over. Further proceeding to deliberation concerning the following petition submitted by Captain Jean Andrée de Maurras, reading: To His Excellency, His Excellency Mr. van de Graaff, Governor of the Cape and its dependencies, and to the Gentlemen of the Council. Mr. Governor, Gentlemen, Jean André de Maurras, Captain in the service of the Noble Dutch East India Company, has the honour to represent to you that he has been in the service of the Republic since 17 November 1784; discharged on 15 April 1786, he was granted an annual pension by the Republic of 350 florins per year. His age and zeal compelled him to ask to continue in service, which was granted to him upon making the sacrifice of his pension. The Noble Company stationed him at the Cape for the recruits depot of the Regiment of Luxembourg until further orders. Today, this regiment is disbanded. Mr. Maurras was never included on the roll of the Regiment, being directly in the service of the Noble Company and under the orders of the Noble Regency of the Cape. Guided by this idea, guided by his very profound respect for Your Excellency as well as for the Gentlemen of the Council, I believed I must inform you of my situation, which would be most cruel if regard were not given to the orders sent from Europe concerning me, after having neglected nothing to make myself capable of serving the Noble Company usefully. 436 / 437 concerning whom a favourable report will be written to the Lords Majors I am forty-seven years old; if I am left without employment after having sacrificed for the service a modest pension which was everything to me, I see myself without resources, unhappy for the rest of my days. Your Excellency and Gentlemen of the Council know my ardent zeal for the Republic, my very profound respect, my particular veneration for the virtues of His Serene Highness, my Lord the Prince of Orange. It would be with the keenest regret that I would see myself forced to leave his service, but if I am compelled thereto, one cannot reproach me with being ungrateful, and with not having done everything that depended on me to be grateful; it is the Prince who made me an officer in 1784 and to whom I owe my status and my existence. namely, that notwithstanding repeated public notices by Your Honorable and Esteemed Board, and most recently by that of the 10th of October 1776; wherein it was ordered to everyone to appear in person before the Independent Fiscal and the respective Landdrosts who, together with the appointed commissioners, shall sit for the recording of the yearly census and the registration of the annual returns at the usual times, both here at the Cape and at Stellenbosch and Swellendam, in order that, whenever it shall be deemed necessary by the aforesaid officers, they may immediately require the declarants to swear an oath that the census return has been made in good faith; and that no written notes of declaration shall be accepted any longer, save only from those who shall have demonstrated in a satisfactory manner the reasons why they were unable to appear in person; all upon pain of arbitrary punishment for those who shall fail to have complied herewith properly; nevertheless, a multitude of inhabitants think fit to disobey this entirely, by not only failing to appear in person, but even omitting to send any such note in their stead, much less providing or disclosing to the commission sitting for that purpose even the slightest, let alone valid, reasons for their non-appearance; although there has been no failure to exhort and warn the public thereof annually in the customary manner and place; thus not shrinking from openly flouting these entirely clear and explicit orders of their lawful government, and causing the said commission to wait for them in vain for days on end; that the number of these recalcitrant inhabitants grows larger from year to year, and has now, during the last session held in the past month of May, increased so remarkably that, if provision were not made against it, it is to be feared that this already highly defective census return would soon come to naught altogether; therefore the undersigned, whose duty it is to keep a watchful eye on the execution of the edicts and ordinances of this government, believed he could no longer remain idle in this matter, but on the contrary must cause the transgressors to be punished for this willful neglect of theirs.
