298 299 Serious deliberation over this dispatch regarding the conduct of the Caffers. such a military detachment might result, excused himself and requested not to be held responsible for it; as he, the Landdrost, moreover questioned whether the part of the inhabitants would be able to await the arrival of the aforementioned soldiers, and whether they would not be forced to resist with force the insolence of the Caffer Captain named Langa and his subordinate men, while he, the Landdrost, otherwise declared his opinion that war with this nation was indeed inevitable. All of which having been seriously considered, it was resolved to express displeasure to the aforementioned Landdrost and Council regarding the premature dispositions made by him in a matter of such great importance; and since it was deemed of the utmost necessity to employ without any delay such effective means against so threatening a danger, which could bring about such sorrowful consequences, whereby one might still quell or prevent it in time, it was further resolved to dispatch immediately thither the aforementioned Bookkeeper Johan Jacob Fredrik Wagener, discharged from his office as Secretary of this Colony, together with Honoratus Maynier, provisionally appointed as Secretary in his place, who are commissioned to conduct an investigation, and to expressly instruct them and order the Landdrost to act in communication both with them and with the respective Boards of Heemraden and Military Officers in carrying out the orders of the Council and in further devising all such measures for which they shall be qualified, without taking any further steps in this matter outside the aforementioned obtained consent of the government. The said Landdrost shall beforehand be most strictly admonished, with respect to a nation whose peaceful nature is universally known, not to immediately repel force with force in the present case, but on the contrary to take the gentlest path as the safest; while, leaving aside the impossibility in the present juncture of affairs of detaching any part of the military, however small, from our weak garrison and sending them so far away, even if the matter should require forceful means to be employed, the enormous costs for the transport and the maintenance of the men there would still not allow such an undertaking except in the very direst necessity; however much one may also be convinced that, given the wide extent of the area where the Caffers reside, very little, if any, benefit could be derived from them. But since one must meanwhile assume that the continued wandering of some Caffers on this side of the Great Fish River must have its origin in the notion that they remain entitled to some claim on this or that stretch of land within our boundaries, and in that case it is best to remove those supposed claims completely and forever in the most friendly manner, there shall also be sent with the said commissioners to the aforementioned Landdrost some copper and trinkets most esteemed and valued by that nation, with orders to make use thereof in order to, as it were, buy off the said claims of that nation from the various Captains residing on this side along the Great Fish River through amicable negotiation, in the most solemn manner that time and opportunity shall best afford, and at the same time to stipulate that they move as soon as possible to the other side outside our boundaries, and remain there forever. 207 Order to settle the arisen disputes amicably. Request of various inhabitants of Graaffe Reinet to be relieved from the utmost necessity that would compel such undertaking, however much one might be persuaded that from the same, considering the vast extent occupied by the Kaffirs, if not entirely none, at least very little fruit could be drawn, since one must meanwhile assume that the continued roaming of some Kaffirs on this side of the Great Fish River must itself originate from the notion as if they were still entitled to some claim upon this or that tract of land within our boundaries, and it being best in that case to clear away those purported claims in the friendliest manner entirely and forever out of the world, there shall be sent with the said commissioners to the aforementioned Landdrost at the same time an amount of copper and trinkets most esteemed and valued by that nation, with orders to make use thereof so as to buy off, as it were, the said claims of that nation from the various captains who stay on this side along the Great Fish River, by amicable negotiation, in the most solemn manner that time and opportunity allow, giving them the hand, and at the same time stipulate that they shall move as soon as possible to the other side beyond our boundaries, and keep themselves there forever. Furthermore, there having been read a dispatch from the Landdrost and Heemraden of Graaf Reinet aforesaid directed to this government, whereby they came to support the requests contained in certain two identical petitions presented by some inhabitants of that colony to be exempt both from the ordinary payment and from the arrears of recognition money attached to their loan places and owed to the Honorable Company, which petitions having been considered, it was approved, before deciding upon the same, to write to the Landdrost and Heemraden to provide this Council with a specific list of such persons and inhabitants under their district who have been most harmed by the depredations of the Bushmen or otherwise, and have besides fallen into such an indigent state that they are utterly unable to pay those dues, in order to pay such regard thereto as circumstances shall come to require. as this matter, having become so serious, would require, just as the same pro Interim Fiscal then also had him, Philippus du Bose, placed under civil arrest; and whereas the substantiation of that case indispensably required inspection of the aforementioned petition of Noel du Bose as well as of all such documents relating to the aforesaid case as were kept at the secretariat; your Right Honourable and Venerable Honours further thought fit to place a copy of all this into the hands of the aforesaid pro interim Fiscal, in order to be able to make the necessary use thereof in due course. The undersigned, having arrived here as independent Fiscal of this government, and having received into his hands, among other documents concerning the Fiscal office, the abovementioned copy of the petition and further documents, has after mature deliberation thought it proper, before initiating any proceedings against the aforesaid Philippus du Bose, however much he otherwise trusts to have sufficient grounds at hand for doing so, nevertheless first to set forth to your Right Honourable and Venerable Honours the considerations which have occurred to the undersigned during the investigation of that case, and which he believes to be of such a nature that they merit the special attention of your Right Honourable and Venerable Honours. The undersigned, understanding that it will be unnecessary to enter into a formal debate of the facts narrated so erroneously and untruthfully in the abovementioned petition, for which the submitted documents will amply suffice, will only initially remark that it is beyond all doubt that the aforesaid Philippus du Bose could never escape a conviction before any impartial judge whereby complete satisfaction would be procured for your Right Honourable; since in his responses to the interrogatories presented to him, art: 20, he fully confessed to being guilty of the atrocious insult charged against him; and it clearly appears from the circumstances that he, Philippus du Bose, notwithstanding the show of remorse in the said responses ad art: 22, and the generosity of your Right Honourable, nevertheless has constantly continued to harbor a malicious intent to injure the supreme commander of this place, and has intentionally continued to proceed with his maliciously devised and falsely fabricated calumnies. It would therefore not be difficult for the undersigned to obtain for your Right Honourable, by legal process, a satisfaction proportionate to the injury, the atrocity of which is always measured by the honour and esteem of the insulted person, and which in this case would certainly entail nothing but pernicious consequences for the insulter. Yet the undersigned has observed from the mentioned petition of Noel du Bose that therein they have not only tried to give the Lords Masters the impression as if your Right Honourable had been guilty of arbitrariness, and he, Philippus du Bose, had been completely innocent and thus wrongfully subjected to prosecution; but also that they have sought to present the integrity of the judge, not only here locally but even in the whole of the East Indies, in a very equivocal light: Accusations, Right Honourable Sir and Venerable Sirs, which, as soon as one only examines fugitivo oculo the papers relating to this matter and the manner of proceeding observed therein, not only all fall away of themselves, but also cannot in any way escape the highest indignation of the Lords Majors regarding such; while it has surprised the undersigned to the utmost how anyone has dared to undertake to interrupt Their High Mightinesses' weighty business therewith. These are the reasons, Right Honourable Sirs, Honourable and Venerable Sirs, which have moved the undersigned, before commencing any proceedings against Philippus du Bosc pursuant to your Honours' esteemed Resolution of the 16th of January last, to address Your Right Honourable Sir and Honourable and Venerable Sirs beforehand, and to submit for your respectful consideration whether—in order to avoid all detrimental reflections, both concerning the Council of Justice, as if it had been capable of the utmost cruelties in the case of Philippus du Bosc, and regarding Your Right Honourable Sir, as if out of a principle of vindictiveness a misuse had been made of the authority entrusted to Your Right Honourable Sir—whether, the undersigned says, for these and further considerations legitimately arising therefrom, it might not please Your Right Honourable Sir and Honourable and Venerable Sirs, in order to give this reckless petitioner full measure, to condescend in this matter to the request made by Noel du Bosc in the Fatherland, namely to send the person of Philippus du Bosc back to the Fatherland aboard one of the first return ships, and at the same time to forward to the Noble Masters all such documents relating to the matter in question as are deposited at the Secretariat of both Policy and Justice; with an urgent request further to the said Noble Masters that this matter may be placed by them into the hands of—as Noel du Bosc expresses it—impartial judges, so that, Philippus du Bosc being found guilty after mature examination, such punishment may be enjoined as the Noble Masters shall in their wisdom deem capable of procuring for Your Right Honourable Sir that satisfaction which shall be found most appropriate for preserving the distinguished character which Your Right Honourable Sir has the honour to hold, and in the maintenance of which, be it said with respect, both the Noble Masters and every one of the inhabitants of this Colony are most highly interested. pursuant to which two undertakers have been appointed, restored to burgher freedom, and request of Mr. Johannes Andreas Fuiter. Since the burghers of this place George Diederik Geere and Jacobus Kriger have recently moved to take up residence in the Colony of Graaff-Reinet and have thus changed their domicile, whereby their positions as undertakers for funerals here have become vacant, the Commissioners therefore take the liberty of proposing to Your Honorable, Valiant, and Esteemed Sirs, in their place as undertakers, fellow burghers David Hendrik Mellet and Johannes Ernestus Weesbergh. Likewise, the Commissioners further take the liberty, with respect to the person of Christiaan Liedeman, who on the date of 23 February of the year 1787, on account of his dissolute behavior, was at their request enlisted as a sailor in the service of the Honorable Company and as such was placed on the permanent frigate ship De Meermin, to bring to the knowledge of Your Honorable, Valiant, and Esteemed Sirs that the Commissioners, having carefully observed his conduct since that time, have not only received good testimony regarding his improvement, but also that he has promised to behave in the future in such a manner that no complaints will ever again be made against him; wherefore the Commissioners respectfully request Your Honorable, Valiant, and Esteemed Sirs to discharge the aforementioned Liedeman from the service of the Honorable Company, and, with the striking off of his earned wages, to favor him with his former burgher freedom. And since the Secretary of this Council, Mr. Cornelis van Aerssen, in his capacity as vendue master, requested permission to add to that memorial such considerations and interests as he thought proper to supply to this Council for the preservation of the prerogatives attached to his said office, it was resolved to accede to that request and in the meantime to circulate the aforementioned memorial among the respective members of the council. to be performed to report and give a true and faithful account of all defects and shortages that are unloaded from the ship cargoes or otherwise in my presence; and further in everything that may be entrusted to me, to behave as befits an upright and faithful servant, without allowing myself to be swayed therefrom by any gain, profit, hate, or favor of anyone whomsoever it might be. That the petitioner, having thus remained at this corner of the earth, trusts to be able to find a steady livelihood here, the more so because the opportunity presents itself for him to establish himself here in a good manner through marriage with a respectable widow. For all which reasons the petitioner takes the liberty to address Your Right Honorable and Honorable Gentlemen with fitting respect, with the humble prayer that it may please your highest pleasure to favorably grant him the burgher freedom of this place or along some other way to let him reside here in a steady and peaceful manner; it will ever be the petitioner's only aim, through virtuous conduct and the strict fulfillment of his duties, to make himself worthy of that favor of Your Right Honorable and Honorable Gentlemen. Placed for examination in the hands of Mr. Le Sueur and the Commissioners from the Council of Justice. Are, or have been, occupied and troubled by the miller of the Honorable Company's corn mill, who constantly takes the water coming down from the Platteklip, even at the very time that the water was granted to the petitioners according to the extract from the resolution of Your Honorable Worships dated 3 April 1787. That the said miller previously even permitted and agreed to allow the petitioners to use the said water in the afternoon, but now, as it appears, cannot be persuaded, all the more because the largest part of the Cape digs for that water, and thus the petitioners can count on making use of it for no more than a couple of hours in the morning, because the water that comes from the Platteklip is dammed up and held back by the numerous washers, so that regularly at eight or nine o'clock in the morning there is no more water running, and through that cause the vegetables in the gardens must at last wither and burn up, besides having the inconvenience that they are sometimes so severely battered by the wind, which, continuing thus, presents the petitioners with certain ruin and destruction. Wherefore the petitioners, to prevent the same, turn with all humility to Your Honorable Worships with the most humble prayers to grant the petitioners to have a stream of water every other day in the evening from 5 to [illegible] o'clock, to be used for watering water, the petitioners binding themselves, in case their prayer be approved by Your Honorable Worships, to send a couple of slaves to the Platteklip every evening to break open the dams made by the washers, whereby the Honorable Company's mill will also receive more water. It was thought fit to place a copy of the same into the hands of the member of this Council, the Honorable Mr. Jacobus Johannes Le Sueur, together with Commissioners from the Council of Justice, in order to examine and report what there is to this matter, and whether and how far any further or other arrangement could be made therein, as was established by resolution of this table of 3 April 1787. Whereupon I am soliciting Your Honorable Worships' very favorable decision. Underneath stood: The other gardeners being unable to offer the least opposition or hindrance regarding the prayer of the petitioners, because no gardens are interested in the aforesaid water other than the petitioners themselves, as Your Honorable Worships can see in the resolution mentioned herebefore. Objections of the Orphan Chamber regarding the sentence pronounced concerning the estate of Martinus Melk are set aside. Memorial of the Head Administrator, with which action shall be taken as noted in the margin. Having been presented to this Council by the Board of Orphan Masters here, and taken into round-reading by the Honorable Members, a certain extensive representation containing the objections detailed at large therein against such decree as was taken by the Council of Justice here under date of 22 December last, with respect to a certain private testamentary disposition drawn up by the late burgher Martinus Melk and his wife Anna Elisabeth Kriel, and exhibited by the aforesaid Orphan Chamber to the aforementioned Council of Justice for the purpose of examination. So it is, considering not only that this matter itself has been finally disposed of by the aforementioned Council of Justice, but also that in the meantime, moreover, on this same subject, a lawsuit having been instituted before the often-mentioned Council by and on behalf of the aforesaid Anna Elisabeth Kriel, widow of Martinus Melk, against her co-executors Jan Andries Horak and Jan David Beyers, which being concluded, she, the Widow Melk, as the losing party, has instituted an appeal against the sentence pronounced therein to the Honorable and Worshipful Council of Justice at Batavia, judged that no obstacles or hindrances can or may be placed in the way of justice in this matter, and therefore approved and resolved to take no decision on the aforementioned representation of the Orphan Chamber, but to cause the same to be filed at the Secretariat. Further, having been produced in the Council by the Head Administrator, Johannes Isaak Rhenius, with a request to obtain a disposition thereon, the following Memorial of the undermentioned shortages of arrack and olive oil, beer, saltworks, iron, etc., both broken short and less by gauging, as well as the slaves deceased by natural death in the recently passed months of September, October, November, and December of the past year, as well as January and February of this year, and the cattle during the said time both perished and lost to wild beasts, all apparent according to declarations, namely: From the ship De Dapperheid: Received 2 pairs of knitted yarn stockings in 1 case where 350 pairs more were found. The departure of Captain van Halm being imminent, the ship 't Fortuyn was requested; notification by the Fiscal concerning two deserted sailors; journal of the Equipagemeester, which will be sent to the Netherlands and Batavia. From which account it appeared that the stamps sold in the same six months amounted to a sum of 3437 3/8 rixdollars, it was resolved, this amount having been brought into the Company's treasury according to custom, to enter it into the trade books. After which, the Governor having communicated to the Council that Captain at Sea van Halm, commanding the naval frigate the Ceres lying here at the roadstead, in response to the request made amicably by the Governor to take upon himself the further convoy of the private transport ship of the Luxembourg troops, 't Fortuyn van Dort, had declared that he would be ready to sail around the 8th of this month; and since the said vessel will also be in a condition at that time to undertake the further voyage, it was agreed to request the said Lord van Halm by letter to convoy that ship as far as into the port of Lorient. After which, it was made known to this Council by the Independent Fiscal, Master Johan Nicolaas Steven van Lynden, that the persons Jan Hilgersom of Delft and Hendrik Zwart of Leeuwarden, both sailors in the service of the Honourable Company, the first-named having come out with the ship Beverwyk and the second with the Africaan, had abandoned their assigned posts and had boarded the private ship the Vlugge Trekvogel in a clandestine manner, without the knowledge of the captain as they claimed, with which vessel they had also arrived here from the Indies; but that, having both come ashore here, they had deserted again and had gone into the mountains, where they were apprehended about fourteen days ago and taken into custody. And because the captain with his vessel, the Vlugge Trekvogel, had already departed from here previously, and thus no further investigation could be conducted here regarding the desertion of these two persons, the Independent Fiscal had deemed it best to request this Council to remand the said persons of Jan Hilgersom and Hendrik Zwart to the disposal of the High Indian Government in Batavia as the locus delicti. It was thus resolved to conform to the proposal of the said Fiscal in this regard, and therefore to place these two persons on one of the first ships lying ready to depart from here for Batavia. Lastly, Captain at Sea and Equipagemeester here, Cornelis Cornelisz., having produced a daily journal of all that has been carried out concerning the Company's chartered and the State's ships at this roadstead since January until the 1st of this month of April, together with an accurate record of weather and wind, it was approved to send copies of this report both to the High and Mighty Lords Masters and to the High Indian Government aforesaid. Secretary van Aerssen for the delivery of the request of the Burgher Council of this city, which must be made by the unanimous College of [illegible] on the petition of de La Goupilliere. As is fully known to Your Right Honourable, Right Respected Worships, no judgments are rendered in the Council of Justice at Batavia except upon original documents. Below: Which doing, etc. Lower: By order and on behalf of the aforesaid Orphan Masters. Was signed: I. C. Bonnenkamp, Secretary. In margin: From the Orphan Chamber at the Cape of Good Hope, 21 April 1789. Authorization of the Secretary to return the original will. Which having been read, and having considered the motives alleged therein, it was decided to authorize the Secretary of this Council to return the original will mentioned therein to the petitioners. Furthermore, having been read a petition from the Burgher Council here, containing complaints about the bad conduct of the burgher Christiaan Hendrik Wilken, and requesting that he be taken into the Company's service on that account and sent to Batavia, it was resolved to grant as an apostille thereon that the disposition thereof is postponed until this request shall have been made by the unanimous College of Commissioners from the Council of Justice. Whereupon by the former officer of the Regiment de Meuron, de La Goupilliere, was presented the following petition: To His Excellency Monsieur van de Graaff, Governor of the Cape of Good Hope, and to the Gentlemen Councillors of the Government. Monsieur the Governor and Gentlemen: The Sieur Chevalier de La Goupilliere, as an officer of the Regiment de Meuron, having obtained with your consent in the month of November eighty-five a leave of six months to travel to Ceylon where he was to be employed; he went thither, and he was detained there by the Government to serve in the capacity of Captain Engineer, which prevented him from rejoining his corps. He informed his chief thereof by the first opportunity, and asked him for an extension of leave to enable him to continue the works which were aimed at the good of the service of the Noble Company; which was refused to him, but granted by this government upon the request made to it by the government of Ceylon. This consideration, his services, and the regularity of his conduct not having protected him at all from the loss of his post to which another was appointed for not having rejoined in time, he found himself, for lack of livelihood in the Indies, in the necessity of returning to Europe, and proceeded for this purpose to this Colony with an order from the government of Colombo, which granted him passage on the private vessel The Joseph the Second. Having disembarked with the consent of His Excellency Monsieur the Governor, he has the honour to request of him, as well as of the Gentlemen Councillors of the government, a passage on one of the Company's ships departing shortly for Europe, in order that he may proceed to his destination. The petitioner asks, and begs His Excellency Monsieur the Governor, as well as the Gentlemen Councillors of the government, to be pleased to take into consideration the loss of his position, of which he was only deprived by rendering himself commendable to the Noble Company; and the expenses into which he was drawn as an officer.

And upon the request made by petition by Louis Jacques Boigne, who recently landed here as a passenger from Mauritius with the French ship Le Notaire de Narbonne, it is permitted that he may cross to the Netherlands with one of the Company ships lying here in the roadstead or one of the chartered ships, provided that in the first case he shall be bound to pay beforehand into the Company's treasury here a sum of one hundred and eighty rixdollars for transport and board, and in the latter case to conform to the charter party of such private vessel in which he shall undertake the voyage. Subsequently having deliberated upon a petition submitted by the Lieutenant of the Regiment of Luxembourg remaining here, Migot de la Combé, the same upon resumption was found to be of the following content: According to the order just given by the Chief of the Regiment of Luxembourg to the undersigned to assemble the soldiers left in the hospitals of Ceylon to lead them to Europe, he believes himself authorized to beseech you to be pleased to approve the leave of six months with which he will be furnished for this purpose, and to have his salaries and emoluments paid to him from this day until the end of July, the period at which he foresees the arrival of the vessel transporting the remainder of the regiment to Lorient. He has all the more right to this act of justice, Monsieur the Governor and Gentlemen, as being obliged to take passage on a private vessel at his own expense, the sum resulting from this request will only be a slight compensation for the expenses that this mission, intended for the good of the service, will cause him. Leaving, however, the request of the petitioner, in view of his straitened circumstances, to be exempted from the payment of the customary transport and board money, to the esteemed decision of the Honorable Gentlemen Masters, to deduct the same, if they please, from the month-wages and bonus due to the petitioner. Further, upon the request submitted by petition by the assistant surgeon of the said ship De Gouverneur Valk, Wilhelmus Arnoldus Swart, and the boatswain's mate on that vessel, Gysbertus van Wieringen, stating that since they, the petitioners, were deprived of the opportunity on Ceylon to have their permitted sea chests branded, and therefore requesting to obtain the necessary permission here for that purpose, it was resolved to grant the petitioners' request. It was approved and agreed, considering that no other opportunity is presently at hand, and that the season during which the aforementioned bay is navigable would meanwhile pass, to concur with this proposal of the Governor, and therefore to order to unload from it these recognition goods that are loaded in the said vessel for Batavia, and to store them here until they can continue their voyage to Batavia. But since the said Plettenberg Bay cannot be called at before the month of June, while in the meantime it is by no means advisable to let the aforementioned vessel remain in these roads until its suitable departure thither, it was also resolved to have that vessel undertake the voyage to False Bay upon the expiration of the usual laytime in these roads, in order to await there such further orders and instructions as shall be dispatched to its officers on behalf of this government. On this occasion, it was also approved to ship on the said ship the Jonge Frank to the aforementioned False Bay all such provisions and ship's necessities as will be needed there.
