541 and ordinary write-off the ship de Jonge Frank bound for Batavia letter from Burgher Councillors for which capital one shall, besides the said products, ship therein were sold or supplied by them during the last financial year, and considering that those who have less do not exceed the regulation, it is approved to have them written off in the aforementioned trade books under the orders for the respective administrations. Below stood: Thus resolved and decreed In the Castle of Good Hope, the date aforesaid. Tuesday the 18th of August 1789 in the forenoon, all present, except Mr. Gordon, The ship de Jonge Franck having safely returned from its voyage to Plettenberg Bay, bringing the goods from the ship the Maria, wrecked in that bay, as well as a consignment of native timber, it was resolved to unload that vessel as soon as possible, and after its discharge, to reship into it all the recognition goods unloaded from it at this Government, as well as, Show with all due reverence the undersigned Burgher Councillors of this City; Right Honourable Sir and Worshipful Gentlemen! To the Right Honourable Sir Cornelis Jacob van de Graaff Governor and Director of the Cape of Good Hope, and the Dependencies thereof, etc. etc. etc. together with the Worshipful Council of Policy of this Government. Subsequently was resumed a document from the Burgher Councillors of this City, reading: 70 to 80 leagers of wine 10000 lb of butter 10000 lb of tallow and as much ivory as will be on hand, all this both in satisfaction of the latest requisition and in anticipation of the expected requisition, in order thereby to have that ship proceed on its destination to Batavia. 70 to 80 How they 540. 542 543 how they, in the meeting of Commissioners from the Council of Justice held on the 13th of the past month of June, have seen produced an extract from the resolution taken by Your Right Honourables and Worships dated 21 April 1789, containing the apostil on the petition which was presented to Your Right Honourables and Worships by the undersigned Burgher Councillors concerning the Burgher Christiaan Hendrik Wilken, in which apostil it is stated that the disposition on the aforementioned petition is deferred until this request shall have been made by the joint College of Commissioners from the Council of Justice; And since Your Right Honourables and Worships have not only repeatedly been pleased to dispose upon such petitions from Burgher Councillors, even after the College of Commissioners had already been established; but it also, in the opinion of the undersigned, is not the intention of our Lords and Masters to grant any greater right to the said Commissioners than the regulations made by their High Mightinesses in the letter of 28 July 1785 so seriously and clearly dictate, the undersigned Burgher Councillors therefore take the liberty hereby to bring to the knowledge of Your Right Honourables and Worships; that, reserving all respect due to Your Right Honourables and Worships, they will on the first occasion bring their grievances regarding this to the table of the Lords Majors, without which prior knowledge of Your Right Honourables and Worships the undersigned maintain they cannot properly proceed thereto, hoping the undersigned will obtain upon the said address a favourable and thus salutary decision for this country and its inhabitants; below stood: Doing which, was signed: Joh:s Smuts, C: G: Maasdorp, G: H: Meijer, J:n C: Gie, J: De Wet; And whereas that document can be regarded as nothing other than a mere notification of a very presumptuous 544 545 which shall be shelved at the Secretariat petition of the Commander Daniel Haas presumptuous act of the signatories, it was decided that no other use can be made of it than to shelve the same at the Secretariat. After which was read a petition submitted to this Council by the former Commander Daniel Haas, of the following content: To the Right Honourable Sir Cornelis Jacob van de Graaff Governor of the Cape of Good Hope and the Dependencies thereof, etc. etc. etc. together with the Worshipful Council of Policy. Right Honourable Sir and Worshipful Gentlemen; With the greatest respect, Your Right Honourables' and Worships' humble servant Daniel Haas shows: How he, petitioner, has already served the Honourable Company at sea in various ranks since the beginning of the year 1766, of which the last seventeen years have been in the capacity of commander on the vessels stationed permanently here, he, petitioner, having in that space of time, as cannot be unknown to Your Right Honourables and Worships, had to undertake several very fatiguing and dangerous voyages, whereby his health has been impaired not a little, while he, petitioner, with all this, currently suffers from such a weakening of his eyesight that he finds himself entirely incapable of being of any further service at sea to the Honourable Company; for which reasons he takes the courage to turn to Your Right Honourables and Worships with a humble plea, on account of his cited bodily infirmities, to discharge him from the service of the Honourable Company and to favour him with the burgher right of this place; and that it may further please the same to grant the petitioner upon his discharge such rank as Your Right Honourables and Worships shall find proportionate to the post wherewith he has been so favourably clothed by the same, and in the discharge of which he respectfully trusts Your Right Honourable

Honorable, Valiant, and Esteemed Sirs, having constantly given all reasons for satisfaction; below was written Which doing etcetera; signed Daniel Haas. Thus it is, in consideration of the man's long years of service and blameless conduct, approved to discharge him from the service of the Honorable Company and to place him in burger freedom, and in order to have him occupy a rank of a nature corresponding to that of which he was deemed worthy in service, understood to grant him the rank of Captain-Lieutenant of the Burger Militia. Thereafter was resumed a petition of Hendrik Cloete Junior, Lieutenant of the Burger Cavalry, and found to be of the following content: To the Right Honorable and Valiant Sir, Cornelis Jacob van de Graaff, Governor and Director of the Cape of Good Hope and its dependencies etcetera etcetera etcetera, together with the Esteemed Council of Policy of this Government; Right Honorable and Valiant Sir! Esteemed Sirs. Shows with all due respect, Your Right Honorable and Valiant's and Esteemed's very obedient and humble servant Hendrik Cloete Junior, Lieutenant of the Stellenbosch Burger Cavalry. That when on the night between the 16th and 17th of October of the past year, the French King's frigate la Penelope ran aground in False Bay and this fatal news was brought to the estate Constantia, he, together with his father, directly proceeded to the beach, and made all their bounden efforts to help save the crew members on board, and to offer them all assistance, support, and refreshment that their weak faculties and the condition of the place would somewhat allow; 549 That the petitioner was fortunate enough, through the assistance rendered, not only to tear diverse persons from the raging waves, but also to deliver them from certain death, which they would have had to suffer due to lack of food and warmth on a desolate beach; That among these was found a child named Francois Maturaillon, native of Brest, 7 years of age, who had been engaged aboard that vessel as a cabin boy; That the petitioner, together with his family, upon rescuing that true object of pity, lamented his unhappy fate, and proposed, whenever there should be opportunity for it, to extract him from his pitiable condition, and to form him into a useful member of society; That the petitioner, with that prospect, went to the Chevalier Juget de Bras, Captain of the said wrecked ship, and proposed to him whether, if the petitioner might obtain the highly favorable permission thereto from Your Right Honorable and Valiant and Esteemed Sirs, he would be inclined to leave that unfortunate child at this remote corner under the supervision of the petitioner; That the said Chevalier granted the petitioner leave to request permission thereto from Your Right Honorable and Valiant and Esteemed Sirs, under the assurance that the parents of that child were in the most deplorable poverty, and had thereby seen themselves forced to let him seek his livelihood at so young an age; That the petitioner has thus since 550 551 who besides the said child may keep under his supervision. the month of October kept that unfortunate child with him, and alongside his own children not only provided him with the necessities, but also had such lessons and instruction given to him, through which it may be hoped that his adult years can serve for the welfare of country, people, and himself; That the frequently mentioned child not only completely fulfilled the good expectations that had been conceived of him, but also through his gratitude, obedience, and teachability demonstrated that he could wish for nothing better than to be allowed to grow up under the fatherly supervision of the petitioner; Reasons why the petitioner turns with all respect to Your Right Honorable and Valiant and Esteemed Sirs, humbly requesting that you may kindly be pleased favorably to permit him to keep that child with him for the aforementioned purposes, he being prepared, in order to prevent that he might become a burden to church or society, to bind himself by a secretarial act that as long as he, the petitioner, lives, that child or man shall at no time appeal to the diaconate for any maintenance, as well as whenever the same child might be claimed by his parents, then to have him transported freely and without any encumbrance of costs to wherever those parents might desire; below was written: Which doing, etc. was signed: Hendrik Cloete Junior. Whereupon it was understood and resolved, by virtue of the praiseworthy intention of the petitioner, to grant him his request; and to leave the unfortunate child mentioned in that petition under his supervision on such conditions as he himself has proposed, and in particular that when that child shall have reached his years of majority, he, in accordance with the rights of adults, shall no longer depend upon the petitioner.

552 aat 553 Petition of Jan Smit Jurriaansz: Whereupon was read the petition submitted by the burgher Jan Smit Jurriaansz, reading: To the Right Honorable, Highly Esteemed Sir, Cornelis Jacob van de Graaff, Governor and Director of Cabo de Goede Hoop and its dependencies, etc., etc., etc., together with the Honorable Council of Policy. Right Honorable, Highly Esteemed Sir, Honorable Gentlemen. With due respect, Your Right Honorable, Highly Esteemed and Honorable Lordships' very obedient servant, Jan Smit Jurriaansz, makes known that he, petitioner, in the year 1770 bought a certain house and plot of land for the benefit of his then-minor son Andries Smit, in the confidence that he, petitioner, would always retain an incontrovertible right to the ownership of the same; but that he, petitioner, after the demise of his aforementioned son, found himself entangled in very unpleasant legal proceedings regarding the possession of this house and plot, which were terminated by the Honorable Council of Justice of this Government to the detriment of the petitioner; that the petitioner, having requested and obtained an appeal from the decree of the said Council to the Right Honorable Council of Justice of the Castle Batavia, was able to triumph there and, according to the final sentence, accompanying this in authentic copy, must be restored to the possession of the said house and plot purchased by him for the benefit of his minor son; That the petitioner on the 14th of May of this year addressed himself to the Honorable Council of Justice of this Government and demanded that the aforementioned final sentence be complied with, and that thereupon by the said Council, as appears from the extract from the civil court roll, it was approved to enjoin the Orphan Chamber of this town, on account of the intestate demise of the petitioner's said son and his wife, as the party summoned in this matter, to make transfer and conveyance of the house and plot in question to the petitioner according to local custom; That the petitioner, in order to obtain the same, went to the political secretariat 554 555 who for the reasons mentioned aside is exempted from the payment of the Lord's dues for the house in question. but learned from the First Sworn Clerk that the latter found difficulty in making the requested transfer to him, except after the Lord's dues, the 40th penny, should have been paid into the Honorable Company's treasury by the petitioner, as he believed that no other interpretation could be given to the words used in the court roll than to make the transfer on such a basis as is customary from the seller to the buyer, and that for such a transfer it is required that what has been sold has been properly paid for by the seller and the dues have been paid to the Lord or the Honorable Company by the buyer; That the petitioner, however, believes that the transfer which the Orphan Chamber is bound to make to him cannot strictly fall under the usual terms, such that he should thereby be obliged to pay the Lord his dues again and, as it were, twice for one and the same property that has not changed owners; For which reasons the petitioner turns to Your Right Honorable, Highly Esteemed and Honorable Lordships, humbly requesting that it may please the same to qualify the First Sworn Clerk to make the transfer in question to him without paying any dues into the Honorable Company's treasury, as it will appear to Your Right Honorable, Highly Esteemed and Honorable Lordships from the accompanying certificate of the Cashier that the 40th penny was properly paid by him in the year 1770. And having deliberated upon this, it was approved and understood to exempt him from the payment of the Lord's dues for the house that the Orphan Chamber of this town must transfer to him, in accordance with the final sentence of the Honorable Council of Justice of the Castle Batavia, namely because by that sentence he is recognized as the lawful owner of the house in question, for which upon the previous purchase he paid the usual Lord's dues into the Company's treasury, and since there is no change of ownership here, it is also not equitable that the Lord or the Honorable Company be paid its dues twice for one and the same property.

There also having been read a petition of the dragoon placed under reduced pay, Christiaan Veldbron, regarding a piece of house erf, of the following contents: To the Right Honorable, the Noble Sir, Cornelis Jacob van de Graaff, Governor and Director of the Cape of Good Hope and its dependencies, &c. &c., together with the Honorable Council of Policy. Right Honorable Sir, Honorable Gentlemen, With the greatest respect, your Right Honorable and Honorable Sirs' most obedient servant, the dragoon under reduced pay in the Night Watch of Your Right Honorable, Christiaan Veldbron, makes known how, with the prior knowledge of the aforementioned Lord Governor, he had measured a certain piece of house erf situated on the other side of the so-called Boeren Plein, measuring 61 square roods, 108 square feet, according to the chart thereof prepared by the land surveyor and submitted to Your Right Honorable and Honorable Sirs. Wherefore the petitioner, with due respect, requests Your Right Honorable and Honorable Sirs to be pleased to grant him that erf in ownership for the construction of such buildings as he shall find advisable to place upon it, and at such price as Your Right Honorable and Honorable Sirs shall think fit to determine. Complaint of the Landdrost and Heemraden of Stellenbosch regarding the burgher Bernardus de Vaal. it is resolved to let the same serve for the transport of a sergeant and 35 privates in order to boil the necessary train-oil on the aforementioned island, while the Chief Administrator is hereby authorized to have the necessary provisions, beverages, and supplies issued to the men as customary. Right Honorable Sir, Honorable Gentlemen, With due respect, the undersigned Landdrost and Heemraden of Stellenbosch and Drakenstein represent: That in the month of April of the past year 1786, a dispute having arisen between the burgher Pieter Cilliers, Jansz., and the former deacon Sr. Daniel Rossouw, Pietersz., concerning a certain watercourse coming out of a kloof between the farms of the aforementioned Rossouw and the widow of Gabriel Rossouw, situated on this side of the Groenberg, a commission in the presence of the first-signed Landdrost was then appointed at the request of the parties, in order to conduct an ocular inspection thereof and to have the farm of the aforementioned Rossouw surveyed by one of the sworn land surveyors. That the petitioners, in their meeting of the 12th of June thereafter, having heard the report submitted in that regard by the commissioned Heemraden, and having declared by interlocutory judgment that the aforementioned Daniel Rossouw may dam up and use the water in question from Monday morning at six o'clock until Thursday morning at the same hour, and the aforementioned Cilliers 560 561 may dam up and use the same from Thursday morning at six o'clock until Monday morning likewise at the same hour; nevertheless so that during the time that the aforementioned Rossouw comes to dam up and use the water, he shall be obliged to allow as much drinking water to run down to the aforementioned Cilliers as shall be practicable for him; and that furthermore the aforementioned Rossouw must clear and keep clean the watercourse up to the dam above the vineyard planted by him, and Cilliers from there up to his farm, with compensation of costs; a certain resident of this Colony, Bernardus de Vaal, as the authorized agent of the aforementioned Rossouw, found himself aggrieved by this sentence and appealed therefrom to the Honorable Court of Justice of this Government. That furthermore, by honored letter from the aforementioned Honorable Court of Justice dated 12 February 1787, the petitioners having been notified that, before definitively concluding the contentious case between Rossouw and Cilliers pending on appeal before the aforementioned Court, Their Honors had resolved to commission two members of their bench in order, together with the Landdrost and the Heemraden who had already served for that purpose, to conduct an ocular inspection of the watercourse in question, the said Heemraden, in the presence of the first-signed Landdrost, pursuant to these honored instructions, also appeared there at the appointed time, whereupon inspection of everything was taken by the aforementioned gentlemen commissioners from the Court of Justice. Harmen Ruurds, master of the private ship Berkshooven, having requested and obtained permission by resolution of this Council of the 24th of last month to hire as many experienced sailors as he had lost during the voyage from Batavia hither or was forced by illness to leave behind at this corner of the world, having made known today that among the convalescents at the Hospital there were none who had completed their time, and these being men from the passed return ships from whom he could hire the sufficient experienced sailors he lacked, requesting that he be granted such a number from those who are stationed at the Equipage Yard; in which it was necessary to acquiesce, and pursuant to the charter party thereupon, on express order, to transfer nine sailors, who, although they have not fully served out their contracted time, were willing to undertake the voyage home only on condition and assurance that they would enjoy their full premium, of which thus, pursuant to the orders, one half shall be borne by the Honorable Company and the other half by the owners of that vessel. A request having been made by the Captain of the ship de Jonge Frank to have two months' wages in advance issued on account to the seafaring crew stationed on that vessel, in order to enable them thereby to provide themselves with various necessities for the voyage from here to Batavia, and this solely in consideration of the difficult journey made with that ship to Plettenberg Bay, with the further request that the soldiers on board that vessel for Batavia might likewise enjoy two months' wages; so the first part of that request was unanimously granted, but with regard to the latter, taking into consideration that the soldiers stationed on that vessel were engaged by the Honorable Company under the condition that their monthly wages would only commence upon their arrival in the Indies, whereby they would thus remain barred from making any claim to the receipt of moneys here; but at the same time, on the other hand, having considered the clear inconsistency that would exist in the unequal treatment of different servants stationed together on one ship, who by order of this Council have seen the necessity of having to make a journey whereby their arrival at the place of their destination has been delayed for months and the necessities provided to them by the Honorable Company for the outward voyage have been consumed; and thus by the majority of the Council, consisting of the Honorable Governor and Messrs. And it has further been resolved to cause the twenty-seven chests with hand rattans salvaged from the stranded ship Het Drietal Handelaars to be unloaded into the ship Berkshooven for the account of its owners, consigning the same to the Chamber of Delft, taking into account what has been used here for the repair of those chests. Vaillant, Captain at Sea in the service of the state, to be assisted on the part of this Government with a third mate, 8 sailors, and one soldier, to complete the crew of the state's frigate Zephir and the sloop the Havik; and it having been approved and resolved, in accordance with the command of the High and Mighty Lords Masters to afford all possible assistance to the Military Commission of which the said Mr. Vaillant is head, to transfer the said crew members to the aforementioned ships on loan with suspension of pay, in order to serve on the same for as long as the aforementioned Mr. Vaillant shall judge them to be needed. But because the aforementioned crew members are in arrears on account of their assigned remittances, the pay accountant shall, by extract of this resolution, be ordered and authorized to hand over the closed accounts of those crew members to the repeatedly mentioned Mr. Vaillant, and His Honor shall at the same time be requested to retain as much of the monthly wages which those persons will earn from the Admiralty as can conveniently be done, and to have the amounts thereof paid into the Company's treasury, whether here or in the Indies, in order to indemnify the holders of the remittances. A request having also been made to this Council by Mr. Staringh, Commander of the state's squadron in the Indies, to be assisted with some seafaring men, it has likewise been resolved to place on the ships under His Honor's command such sailors as they shall come to require, and this with suspension of pay by way of loan until Batavia, where a request will have to be made to the High Indian Government for the prolongation of that loan or for the final discharge of those men.

Furthermore, the soldier Fredrik Eugenius Nerger was, upon his request submitted for that purpose by petition, and considering that his contracted term was to expire within a few months, discharged from the service of the Honorable Company and permitted to transfer into the Country's service. And it was finally resolved to lighten from the cargo of the present ship de Draak as much smithing coal as is most urgently needed so as not to bring the Company's works, and especially the smithy of the Artillery, to a standstill. Extraordinary meeting, all present except Colonel Gordon. It was made known by the Noble Governor that His Honor had purposely convened the meeting to present to it that in the Company's dispensary, according to the written statement of the Dispenser, Mr. van Reede van Oudtshoorn, there was no more than 1778 mudden of wheat found, and the rice was nearly exhausted, having been issued both for the ordinary rations and to passing ships. That this scarcity of wheat was to be attributed to the small quantity delivered to the Company's magazines in the spring, wherefore private individuals and bakers directly after the harvest paid more than the price for which wheat is customarily received for the Honorable Company. That this high price, far from falling in the present season, which is also suitable for the carting of grains, had risen to such an extent that in these days for a load of wheat, which the Honorable Company receives for 24 Rds, 42 Rds was paid by the bakers. That one therefore by no means dared to flatter oneself that any wheat would be delivered by the farmers to the Honorable Company without their being compelled thereto by measures that ought only to be employed in the utmost necessity. That His Honor, however, based on the information gathered, was assured that one had no bread shortage to fear at this place, 582 583 of remainder, of both of which articles the supply is not sufficient. Having deliberated, it was resolved to issue half of the ordinary ration in bread and in money. because the bakers, through the proper maintenance of the prohibition placed on the export of flour, find themselves as it were overburdened with bolted flour, for the sale of which they can by no means find an opportunity, and moreover their lofts are provided with an adequate supply of wheat; that the scarcity, and that of the small supply of rice, notwithstanding that everything has been purchased for the benefit of the Honorable Company that could be obtained, owes its origin to the extraordinary provisions that had to be made, both to the ships de Eensgezindheid and de Jufvrouwe Johanna, and to various outward-bound ships, which instead of nine months were provisioned for only four months. That, if the aforesaid supply of 1778 mudden were issued as usual, it could not last longer than until the 8th of November, and one would thus fall short for more than a month and a half, unless such provisional measures were timely taken and implemented by this Council whereby one could provide the garrison of this place until the new harvest on the usual footing with the indispensable bread that must be issued to them on the Company's behalf. Concerning which proposal of the Noble Governor it was deliberated with due attention, and thereby especially taken into consideration that although the supply of wheat that is on hand on the Company's behalf will not be sufficient to issue the ordinary ration of bread to those who are to be fed by it here, one may nevertheless be reassured that the supply stored with the private bakers will be sufficient to partially feed the garrison as well, besides the inhabitants. And therefore it was resolved, from today onward, to fix the weekly ration of bread of 7½ lb per head at half, or at 3¾ lb, and provisionally to issue the other half of that ration in money to the respective commanders of the corps garrisoned here, the chief surgeon of the Honorable Company's Hospital, the overseer of the Slave Lodge, and other persons charged with the housekeeping of the Honorable Company's servants, and to have paid therefor weekly from the Company's treasury 3½ stuivers per head, for which the missing portion of the usual ration can probably be obtained from the burgher bakers, as the only way, without losing sight of the precious interests entrusted to this Council, to prevent all reasons for discontent among the agricultural inhabitants, which would naturally arise from applying drastic measures to obtain supplies, until one, through a firm assurance of the ample grain harvest expected on good grounds, will be enabled to take resolutions that will forever remove out of the way that

Subsequently, the Dispenser was authorized, in consultation and communication with the Chief Administrator, to purchase for the account of the Honorable Company as much rice as His Honor will be able to obtain, and which will be indispensable for the distribution of the ordinary rations. Hereafter, by the gentlemen Mr. Jacobus Johannes le Sueur and William Ferdinand van Reede van Oudshoorn was submitted the report on the findings of the closed Trade books of 1787/8, and it was resolved to send those books, together with that report, per the ship present, de Draak, to Batavia, and by the next opportunity to the Fatherland. Discharge of Christiaan Ludolph Neethling as Secretary of Justice and appointment in his place of Willem Stephanus van Ryneveld Which petition having been deliberated upon, it was understood that said Neethling could indeed be discharged from the service of the Honorable Company, but by no means under the conditions requested by him, because this Council cannot claim the authority by any orders to allow him to retain his salary and emoluments, and it was thus resolved, for the aforementioned reasons, to hold that petition under advisement, and to cause the aforesaid Neethling to be asked whether, upon obtaining his discharge, he would be willing to desist from that part of his request, under the assurance that on behalf of this Council a request will be made to the High Governing Lords Masters at the first opportunity to grant him the requested favor, which he has made himself not unworthy of through unbroken zeal in the service of the Company, through sincere fidelity, and through virtuous conduct. Honorable Company Dismissed. finds himself, on account of the heavy fatigues caused both by carrying out the numerous commissions and the passing of deeds for various persons, annexed to the said office, unable henceforth properly and to the satisfaction of Your Honorable Severe and Most Esteemed, as the petitioner flatters himself to have done up to now, to perform the same, and yet the petitioner's circumstances are precisely such that the petitioner cannot entirely make a living outside the service of the Honorable Company, and thus would have to spend the remainder of his days in want and distress, the petitioner therefore takes the liberty humbly to address himself to Your Honorable Severe and Most Esteemed with most humble request. And after accurate examination of the prices determined thereby for the sale, it was approved and understood to approve that calculation and to give notice to the inhabitants by public publication of the prices for which those timber wares shall be sold, and for the greater convenience of those who shall happen to need the same, the overseer of the Timber Magazine was qualified to proceed with that sale against cash payment, and to render monthly proper account thereof to the Master Chief Administrator in order to have the proceeds thereof paid into the Company's Treasury upon written warrant of the Noble Lord Governor. To the Right Honourable, Right Noble Sir Cornelis Jacob van de Graaff, Governor and Director of Cabo de Goede Hoop and its Dependencies, etc. etc., together with the Honourable Council of Policy. Right Honourable, Right Noble Sir and Honourable Gentlemen. Your Right Noble Honour and Honourable Council having thought fit, by your resolution of 30 December 1788, expressly to commission the undersigned members of this Council to draft such an Instruction as should serve for the guidance of the Board of Commissioners from the Council of Justice, which, pursuant to the directive issued by the Most Honourable Lords Majores dated 28 July 1785, was established and put into operation here; the undersigned could have taken as its foundation all such specific matters as Their Most Honourable Lordships were pleased specially to assign, which could be entrusted to that Board, adding merely that which must serve as a guideline in regulating the meetings, managing daily affairs, the method of payment, as well as administering and rendering proper accounts regarding the receipt and expenditure of these funds; had it not been for what has now repeatedly, and indeed even recently, been experienced in the assembly of Your Right Noble Honour and Honourable Council, namely how the Burgher Councillors, separating themselves from the said Board of Commissioners, on their own and alone, have repeatedly presented petitions to Your Right Noble Honour and Honourable Council for the removal of ill-behaved burghers, and thereby show that they operate under the notion that outside the matters concerning the aforementioned Board of Commissioners, something or other—and especially with regard to the burghery on its own—was left to them, or ought to remain left to them, with which they as Burgher Councillors alone had to deal; however much they, the Burgher Councillors themselves, from the very beginning of the establishment of that Board, were convinced of the contrary, and presented such a petition for the enlistment and dispatch to the Indies of the burgher Jacobus Hahl on account of his improper conduct, together with the other members of the Board, after prior deliberation of the matter on 19 July 1781; had not, the undersigned say, the conviction arisen among them from this, that it was necessary, in case there were matters that still in themselves ought to remain with the Burgher Councillors in a separate relation from the Board of Commissioners, to determine by the instruction which those ought to be; but in the contrary case, and if to the Commissioners are now fully left all duties that relate both to the burghery and to the Company's servants considered as the combined inhabitants of this corner of the world, then all such erroneous ideas that may be harboured or conceived in that regard ought to be cut off by that same Instruction; which the undersigned have deemed indisputably necessary, prior to executing that work, to examine and consider well the reason and purpose for which the said Board was established, in order that, knowing this, they may determine with certainty what its function must entail, and which matters therefore ought or ought not to be assigned and demanded of the same. An examination of this has led the undersigned to find that the cause and occasion for the aforementioned appointment of a Commission of Company servants and Burgher Councillors from the Council of Justice were certain points appearing among the complaints submitted by some Cape burghers in the year 1779 to the Most Honourable Lord Masters, and especially the 9th, 10th, and 11th Articles that were further requested therein, as generally tending not only towards the appointment of a greater number of Burgher Councillors than had previously existed, and conferring a greater authority upon them, but also that the Council of Justice might consist of an equal number of Burgher Councillors and members from the Company's servants. Concerning which points in particular, when Their Most Honourable Lordships were pleased in the year 1783 to write to this Government in general what decision had been taken upon the substance of the Memorial containing the said complaints and points, Their Lordships reserved the right to determine their deliberations further. Whereupon subsequently, in the year 1785, a disposition was made by Their Most Honourable Lordships among other matters that had arisen from the further complaints of Jacobus van Reenen and associates, and by Their Lordships' aforementioned, much venerated letters this Government was written to, from which it appears that these our High Authorities, in the points contained in the above-cited Articles, have desired and ordered such a redress as must render the proposals made on another footing in the same Articles null and void; indeed, the same directives not only entail a complete reform of the Council of Justice so that an equal number of Burgher Councillors and other members from the Company's servants now have permanent seats therein, but also a specific arrangement pursuant to which to the Commissioners from that Council—likewise having to consist of an equal number of members, both from the side of the burghers and from the Company's servants—have been assigned precisely and specifically such matters as Governor van Plettenberg, in his report and Memorial supplied to the Most Honourable Lord Masters regarding the complaint of the aforementioned Cape burghers, had stated that to Burgher Councillors in the supposition

From this the undersigned believe they must conclude that, whereas it has pleased our Lords Masters, instead of granting a larger number of Burgher Councillors as was requested and proposed in the memorial of Jacobus van Reenen and associates, on the contrary to cause Commissioners from the Council of Justice to be chosen from an equal number of the Company's servants and of the Burgher members, and instead of deferring the matters which were specified by Governor van Plettenberg for the department of Burgher Councillors separately to those same Burgher Councillors, on the contrary to place those matters under the administration and direction of the often-mentioned Commissioners, Their supreme intention and meaning also expressly implies that Burgher Councillors consequently, both with relation to what their duty entails outside the Council of Justice as well as within that Council, shall no longer be permitted to function separately, but must always proceed jointly with the members on behalf of the Company in a unanimous promotion of that which concerns the residents: as who, just like the said Colleges of Justice and Commissioners from the same, are also intermingled among one another and consist of the Company's servants and Burghers, this being also the best and surest means to prevent between these two classes of inhabitants that estrangement from which so many unpleasant disputes have been seen to arise, which by the High Sovereign Lords Masters themselves have been found to be of such weight that They have had to take no little trouble therewith to avert through suitable dispositions, 640 641 of which the above-cited is not the least, as well the pernicious consequences thereof for this Colony from it, as to remove and prevent further estrangements and differences for the future. Then, Right Honorable Valiant Sir and Honorable Respected Lords! however much the undersigned for themselves on these adduced grounds are of opinion, under correction, to have to consider the aforementioned College of Commissioners in the aspect just given, they nevertheless believe that this, in the charge that has been entrusted to them, may by no means serve as a basis to proceed thereupon on behalf of their constituents, in so far as Your Right Honorable Valiant and Honorable Respected might entertain any other understanding in this regard, but that, in order not to cause any contradiction between the execution of the commission and its purpose to arise, it is entirely proper and necessary first to learn from Your Right Honorable Valiant and Honorable Respected their meaning and intention concerning this: and it is also for that same reason, and unto such an end and purpose, that the undersigned take the liberty hereby very humbly to request, that it may please Your Right Honorable Valiant and Honorable Respected to determine whether the undersigned, in formulating the above-mentioned Instruction, will have to proceed in such manner that to the said Commissioners in general and without any exception shall be assigned that which concerns both the Burghery and the Company's servants in their capacity as joint inhabitants of this place, and thus as members of one society, save for the particular privileges which have been granted by the High Sovereign Lords Masters to the former, or whether Burgher Councillors shall still have to be considered in any separate capacity, and whether consequently any matters concerning the Burghery shall have to be left to them for separate treatment. Subsequently it pleased the Honorable Governor to communicate to the Council that the Reverend Ministers of this capital had requested His Honor's approval, Firstly, to have the Song of Prayer sung during public worship in the forenoon after the prayer.
