We, the undersigned signalmen, very humbly request, in case of an unexpected rupture, after having fired the signals, to be informed how to conduct ourselves, as our instructions indeed dictate to go everywhere. But, with favourable interpretation, we find ourselves burdened in the same instruction, since it is therein only stipulated that elderly people shall remain outside, to ride from one place to the other in order to prevent any insolence being committed or anything disadvantageous being undertaken by the slaves present there. 664 665 of this Government entrusted to Your Right Honourable, having received an Extract of such Considerations as have been submitted by the Right Honourable Gentlemen Military Commissioners, containing the question whether it would not be necessary to grant the National Troops here a court-martial, and to assign an Auditor thereto, with the request to serve Your Right Honourable regarding that point with his Considerations and advice, whether and to what extent the desired objective therein could be achieved with a wished-for success, Has the honour, in order to comply therewith as far as is in his power, to respectfully submit to Your Right Honourable: That over and above the reasons for discontent which must arise among the Military when one Corps is granted its own Court-Martial by Capitulation and the other is not, as rightly alleged by the Gentlemen Commissioners, It has appeared to the undersigned that the greater expanse of this continually growing Colony, and therewith the major increase of the Garrison, has also brought about a greater workload and labour in all departments, in which that of the Justice system has also richly participated, to which no small relief would thus be brought by the establishment of such a proposed Court-Martial; That it is an indisputable truth that the military art requires its own particular laws, and thus the Military, in matters of duty, must be judged according to other laws than Political Persons; That it is also not to be demanded of the Political Judge to know all those laws thoroughly, and he may consequently be considered incapable of properly adapting the punishments to be imposed in military offences according to their merits, nor of estimating according to its true value the advantage or disadvantage that must arise for the military establishment from such a case; That the Military themselves have always considered it a privilege to be allowed to have their own judges, and they have placed a sort of Ambition in that; And while it is now certain that those men, if they are to observe their duty properly, at all times have their lives at the disposal of their Sovereign, brave dangers and face death undaunted, must be governed and spurred on primarily by Honour and Ambition, the sole and principal, indeed most Infallible motive of Heroes, one must also as much as possible seek to accommodate them therein, and endeavour to incite them; which point the undersigned flatters himself could also partly be achieved through this; That military discipline and so necessary subordination, without which no Militia can exist, but which is as the Basis upon which the entire military art is founded, and whereby the peace and safety in a Garrison provided with Troops is preserved, would through that avenue be not a little strengthened and secured. Which the sad experience during these Troubles in some places in the Republic, now happily passed by God's Goodness, has fully confirmed, when people sought as much as possible to curtail and encroach upon the military Jurisdiction by all kinds of means and ways, to draw the soldiers away from their Competent Judge, to make them renounce the duty of Oaths, and to make them forget the due obedience to their lawful commanders.

666 667 For all of which reasons, the undersigned would be of the opinion that the formation of such a Council of War may be considered not only useful and advantageous to the Company, but in the present circumstance in which this remote corner finds itself, as most necessary; it being furthermore self-evident that if there is to be a Council of War, there must also be a person who acts ex officio before it and presents the cases according to the style and practice of the militia. With which the undersigned trusts to have settled the question An, that is, whether such a Council of War can and should exist here. It will now further depend on the question Quomodo, that is, to define the proceedings both of that Council of War itself and of the Auditor to be added thereto. Concerning which the undersigned is of the opinion that one should proceed with all circumspection, in order to prevent as much as possible, for now and in the future, all disputes, misunderstandings, and conflicts of jurisdiction that could arise therefrom due to uncertainty or obscurity. To satisfy the motives for establishing that Council of War, as adduced both by the Commissioners and by the undersigned and cited above, it will, in his opinion, suffice if the Council of War is given the faculty to judge purely military offenses. Which is in every way consistent with the Capitulation of the Regiment of Wurtemberg, Article 22, stating: "The Regiment shall have its Council of War for purely military offenses, it being understood that death penalties may not be executed except after the approval of the Government; and in all other cases the Regiment shall conform to the laws and customs of the Company." From which are indeed well distinguished the common or communia delicta which can also be committed by persons who are not military personnel, such as manslaughter, adultery, rape, counterfeiting of currency, arson, violence, falsehood, public disturbance, and housebreaking, theft, and whatever else resembles these. This court-martial therefore being to pass judgment only on purely military offenses, all the other offenses and contraventions against the enacted laws, placarts, and ordinances would remain, as of old, under the jurisdiction of the ordinary daily judge, and consequently the military persons in other, both civil and criminal matters, would be apprehensible, suable, justiciable, and executable before the civil judge, just as this was already established in the year 1651 on 25 March by Resolution of the common allies, after the Lords States of Gelderland and Utrecht on 30 January current year, and those of Overyssel on 7 February, had already made a proposition regarding it in that general assembly. Now, as regards further the manner in which such a Military Council ought to be constituted, the place where, the times at which it must convene, as well as the determination of the costs of the parties, the remuneration of the Lord Members and Auditor, their rank, number, presidency, manner of consultation, etc. etc., the undersigned, believing this not to be of his department, need not express himself further on the matter. Concerning the Auditor, the undersigned is of the opinion that there ought to be chosen for this purpose a known person of good name and reputation, sober and capable, possessing at least a superficial knowledge of Roman Law, furthermore somewhat experienced in military science, and fully experienced in military laws and private military domestic affairs. That the Auditor should be permitted to act solely and exclusively in pure military offenses and the matters already enumerated hereinbefore. That of all other matters and offenses coming before him, concerning the military or also the citizens, he ought to give notice to the Independent Fiscal, with the surrender of the delinquents and pieces of evidence that he might have on hand, and duly assist him in every way for the advancement of justice. That he should not be permitted to execute or perform any judicial or notarial deeds of whatever name, whether powers of attorney, bonds or acknowledgments of debt, antenuptial conditions or contracts, testamentary or codicillary dispositions, conveyances, donations, cessions, transactions, lease or tenancy bills, deeds of purchase, nor any further similar acts, much less inventories or public sale notices, whether of deceased or still living persons; nor gather or have collected any testimonies or affidavits, except only in pure military offenses, and that only from military persons. All the foregoing nevertheless with this understanding, that in case either the Fiscal office or the parties, for the convenience and relief of the Gentlemen Commissioners and the Secretary of the Honorable Council of Justice, or indeed for other reasons, might prefer to have their required testimonies and statements of military persons gathered by the Auditor and before Commissioners of War, they shall be permitted to do so, etc., and he, the Auditor, shall be obliged, when so required, duly to perform this; whereupon at the same time the Council of Justice ought to be enjoined to accept the same, and to do justice thereon in judging. Finally, in order to avoid and cut short as much as possible all cavils, disputes, and conflicts of jurisdiction, in occurring cases that were subject to any doubt as to whether the same might indeed be found under the class of purely military offenses, the Auditor, or indeed others interested therein, ought to request the decision regarding this from the Noble and Honorable Council of Policy. In order, in case of a challenge or duel between military persons, which as previously stated shall be judged by the Court Martial, to join himself with the Auditor before the same. Fourthly. Likewise, it should be left to his discretion, whenever he receives any reports from the Auditor concerning other light and minor offenses and transgressions that are not purely military, to be able to hand over and surrender the same to the Auditor for handling, and thus to the jurisdiction of the Court Martial. Fifthly. And finally, just as in criminal cases conducted by the respective Landdrosts, the executions of the pronounced sentences must take place in the presence of the Independent Fiscal, so too here the executions of the sentences of the Court Martial, after having first been approved more solito by the Lord Governor, which involve a death penalty, or that a military man could no longer remain a military man, for example dismissal with infamy, or whenever the delinquent were handed over to the executioner or Caffers to undergo corporal or capital punishment, and which therefore entailed a branding or public disgrace, should in like manner be carried out in his presence. The proposal having been maturely considered and taken into consideration how the instruction from the Lords Majors, contained in the dispatch from the Presidial Chamber of Amsterdam dated 5 February of this year, indeed fully dictated a qualification to immediately put into execution the alterations and improvements that shall appear necessary in the household of military affairs, which is repeated in the Sixth Article of the Instruction for the Lords Military Commissioners, and which might indeed be granted to the Heads of the respective possessions, while that same Instruction also grants to the Commission the faculty to introduce such alterations and improvements to the military establishment as the greater knowledge available in Europe suggests; and since that proposal was presented by the well-mentioned Lords Military Commissioners, as appears from a dispatch produced by the Lord Governor, as indispensable for the maintenance of military subordination, and against which in a Colony such as this no reasonable objections could be raised, and therefore the failure to immediately effectuate it was also left by their Honors to the accountability of this Council, from which therefore most clearly manifested not only the authority but also the obligation for the Governor and Council thereto, it was, after deliberation held, approved by unanimity of votes and resolved to add to the national troops here a Council of War, together with a military auditor, on the footing as the same is determined and proposed in the aforementioned advice of the Lord Independent Fiscal. This Council flattering itself with the glad prospect that by this adopted Resolution the interests of this Noble Company may be noticeably benefited, insofar as thereby the desires, manifested for a long time, of a considerable number of people who place the greatest value and pride in having their own separate judges, will be satisfied, and they will thereby be more and more encouraged, upon the expiration of their term, to enter into new engagements and dedicate their best years to the service of the Honorable Company. 682 683 and has gone inland, without having given the slightest order regarding his affairs, notwithstanding the fact that a voluntary sale had already been fixed by the posting of notices on his aforesaid farm for the 18th of the same month. That the Landdrost of the Colonies of Stellenbosch and Drakenstein, Hendrik Lodewyk Bletterman, having given notice of this to the petitioners upon the complaints lodged with him in this regard by the wife of the said Malan, the petitioners thereupon considered it their duty and judged it unavoidably necessary, since, as has been said before, not the slightest instruction concerning his estate or the auction to be held had been left behind by the said Malan, to therefore have the aforesaid sale suspended and provisionally to have the joint estate of the said Malan and his wife Elisabeth Malan inventoried by commissioned members from their assembly, in the presence of the said Landdrost, and placed under proper sequestration. That the aforesaid Landdrost, having thereupon obtained such evidence as was useful for the substantiation of this case, produced the same in the assembly of the petitioners, and requested, as he also obtained, a decree of personal summons against the aforesaid David Malan, and that by edict and the tolling of the bell for a period of four weeks, in order to purge and answer for his malicious desertion, the theft of a slave woman, and committed adultery. That in the meantime the wife of the aforesaid Malan, on 4 September of the said year 1788, submitted a petition to the petitioners requesting that, while the creditors of her said husband had unanimously agreed and consented to allow their capital to remain in the estate under sufficient securities, and the aforesaid notation of her goods made by the petitioners greatly hindered her in the proper administration of the estate, her estate might be released therefrom and she be permitted to deal with the aforesaid joint estate in such manner as she should deem most advantageous for herself and her children, at the same time submitting a private deed whereby the burghers David Malan the Elder, Stephanus Malan, Jacob Malan, and Johannes Andreas Grundeling declared that they intervened as sureties for the entire estate upon the lifting of the sequestration. Malan, the Elder, Stephanus Malan, Jacob Malan, and Johannes Andreas Grundeling, to administer, together with and alongside the wife of the said David Malan, Davidszoon, the joint estate until the conclusion of this matter; with the stipulation, however, that they should first provide sufficient security, both for the proper administration of the estate and that nothing thereof should be alienated or estranged; with the added authorization to sell the country's produce to the greatest advantage of the estate, provided proper account is kept of everything. That meanwhile, the said Landdrost having proceeded according to style and practice against and on account of the defaulting and absconding David Malan, Davidszoon, the wife of the aforementioned Malan subsequently addressed herself further by petition to the memorialists on 11 December (after the Honorable Independent Prosecutor had already been granted on 27 November of the past year, 1788, because of the non-appearance of the defendant, the third default, and for the benefit thereof a fourth edictal citation ex superabundanti, to serve within six weeks to see the statement of claim served), and, submitting a private power of attorney dated Visch Rivier, 5 November 1788, signed by her husband, made request that, pursuant to and according to the contents of the said private power of attorney, the necessary qualification might be granted to her and the former bookkeeper Hermanus Augustinus Vermaak to sell and settle the estate. However, since the memorialists observed from this the extreme obstinacy and continuation of the said David Malan, Davidszoon, namely, to keep himself still a fugitive and in hiding, regardless of the successive edictal summonses issued to come purge and justify himself before his judge, indeed notwithstanding that according to the own statement of the wife of him, Malan, due notice of the very first issued summons had been given to her husband by an express messenger, the memorialists consequently could in no way grant to the said private power of attorney, sent by the aforesaid Malan to his wife, that legality and authenticity which is required of a power of attorney by virtue of which someone can act in the name of his constituent; since, besides the well-founded reflections that arise with regard to the credibility of the aforesaid power of attorney itself, the laws teach that a power of attorney made privately need be believed by no one, and one can in no way act with the same in court or outside it, so that the memorialists could pay no regard to the said private power of attorney, which is legally altogether inadmissible and suspect, but on the contrary deemed it necessary to place the aforesaid petition with the submitted power of attorney into the hands of the officer, in order to make such use thereof in the trial as he should find appropriate. That the aforementioned Malan did not appear on the appointed day upon the last summons, which was still issued as a precaution with a term of six weeks, but kept himself fugitive, whereupon the abovementioned Landdrost on 8 January last submitted to the Council his statement of claim, with the verification thereof, and concluded therewith that the said defaulting and absconding person shall be stripped of his capacity as Cornet of the Burgher Cavalry at Stellenbosch, and furthermore banished forever from this country and the jurisdiction thereof, on pain of being punished more severely and corporally should he happen to fall into the hands of Justice. That furthermore, after the aforesaid lawsuit between the said Landdrost and the fugitive Cornet David Malan, Davidszoon, was brought to a state for judgment, the aforementioned wife of the same Malan addressed herself to the memorialists on the 19th of the past month of February, together with and alongside three of the administrators appointed over her estate pursuant to the resolution of 4 September, namely David Malan the Elder, Stephanus and Jacob Malan, and with the submission of the mutual will drawn up by her husband with her on the date of 14 February 1773 before the then Secretary of Stellenbosch and Drakenstein, Abraham Faure, and certain witnesses, gave to know by petition: that she could now consider her said husband David Malan as none other than already deceased, and therefore also presumed, by virtue of the aforesaid testamentary disposition drawn up between them, to be able to accept the estate in the capacity of heir and executrix, with the further request that, lest the abovementioned resolution taken by the memorialists here on 4 September last should obstruct her therein, the memorialists would be pleased to grant her special permission to monetize the estate by public sale, and subsequently, after having brought the same to liquidity, to keep the share of her minor children under her administration, under proper security, in order to properly maintain and educate them until their days of majority. Which petition the memorialists then held under advisement. they believed to be compatible with what was committed by the mentioned Malan: the memorialists on that occasion, also with regard to the estate of the aforementioned Malan, have taken in hand and deliberated upon the contents of the aforementioned petition presented in their meeting on 19 Febr: last by the wife of the same Malan, cum suis, and the testament drawn up between the same Malan and his wife on the date of 14 Febr: 1773 also submitted therewith. Yet that, however indubitably certain it is that the aforementioned Malan, through the crimes he committed and the sentence that followed thereon, ought to be held as civilly dead, it nevertheless appeared to the memorialists, subject to correction, that since no testament takes effect before the testator has died naturally, the wife of the mentioned Malan will therefore also not be able to enjoy the benefits granted to her by the above-mentioned testament until her mentioned husband, David Malan, will have confirmed this last disposition of his with a natural death without making any change therein; all the less because, pursuant to the currently established practice and by virtue of the resolution that Your Right Honorable and Esteemed Honors took on 11 December 1787 upon the representation presented to Your Right Honorable and Esteemed Honors by the Court of Justice here on the date of 27 November of that year concerning the estate of Jan Smit of Delburg, banished by a definitive sentence to Robben Island, such a fugitive or banished person nevertheless retains the right and the capacity to be able to dispose of his property according to his pleasure in a permissible and legal manner. 691 Which redemption could only take place if the fugitive clears himself of the crimes charged against him, or if, not returning, he is punished elsewhere with death, or dies his natural death, whereby his share could thus pass to and be released to his heirs or legal successors. Just as the petitioners also submit that making an arrangement in that manner, following the decision taken by Your Right Honorable and Honorable Esteemed on the date of 12 October 1762 regarding the estate of Michiel Zwaan, who was put to death here, also with respect to the estate left behind by the aforementioned Malan, would by no means run counter to the intention which Your Right Honorable and Honorable Esteemed had manifested in your aforementioned Resolution of 11 December 1787, since that same Resolution mainly dealt with someone who had left no children, and although condemned, was nevertheless present and thus able to dispose of his property; indeed, where Your Right Honorable and Honorable Esteemed in that same Resolution, it is true, were pleased to decree that, since one of the principal reasons which caused Their High Mightinesses by Edict of the year 1778 entirely to abolish and repeal the Confiscation of Property in the Colonies of the Generality was this: so that the wife and children or surviving blood relations of the delinquent, although themselves innocent, should not share in the punishment that is imposed on such a delinquent, for those reasons a delinquent or condemned person shall also be left complete freedom to dispose of his property at his pleasure, yet at the same time also granting to the Judge, as holding the supreme guardianship, the power to administer such estates under incidental circumstances which, otherwise than by reason of crime, make the care of the property necessary in that manner. The case here is that the abovementioned David Malan, as the undersigned thinks he can deduce from the memorial of the Honourable Council of Justice, as a consequence of the malversations committed by him, is to be punished among others with banishment, without the penalty of death being inflicted upon him on that account, in which case the produced will would also acquire its force and all doubt in this aspect would cease; but since he is still alive, although indeed able to be considered civilly dead by his banishment, the undersigned is also fully of the opinion, with the just-mentioned Council of Justice, that one cannot or may not deprive him, Malan, of the means to dispose of his property in due time in a legal manner sustainable in Law, and if necessary to make a request to be relieved of the sentence of Banishment passed against him, in order to be allowed to purge himself before his Competent Judge! 696 697 upon whom the sale of his goods, if he wished to proceed therewith, would then devolve, surely upon no one other than the Public Vendue Master of this Government. Now the undersigned will only most respectfully submit for the consideration of Your Right Honorable and Venerable Worships whether Your Right Honorable and Venerable Worships would not yourselves maintain that the undersigned, and consequently also his successors, would be substantially curtailed in the fees and revenues due to them if such a fugitive, after the Secretary of the Court of Justice or the Orphan Chamber had collected the commission from such sales, were to reappear and choose to dispose of his property. The undersigned trusts that this will cause no hesitation for Your Right Honorable and Venerable Worships, but that Your Right Honorable and Venerable Worships, on the contrary, considering the weight of this reflection, will not hesitate, upon the occurrence of such cases, to issue such orders whereby the Vendue Masters for the time being can never be prejudiced. The undersigned trusts all the more to be able to expect some such provision from the known equity of Your Right Honorable and Venerable Worships, as he takes the liberty here to remind Your Right Honorable and Venerable Worships of the decision taken in the distinguished assembly of Your Right Honorable and Venerable Worships on 11 November 1758 on the grievances brought forward by the then Vendue Master, and since unaltered or annulled by any further Resolution, namely that henceforth no goods, whether real or personal, may be sold by or at the Court of Justice except solely by virtue of obtained Executions, as well as those of Persons who have obtained the benefit of cession and have thereby made a real surrender. This is a clear proof, Right Honorable and Venerable Sirs, that the predecessors of the undersigned have always seen themselves honored with the patronage of Your Right Honorable and Venerable Worships in conserving those privileges attached to their post, and that Your Right Honorable and Venerable Worships even then already seem to have intended that, whenever notable doubts might arise concerning the public sale of these or those goods, the Vendue Masters shall be entitled thereto in the first place. The undersigned therefore believes, on these grounds, to be permitted to implore Your Right Honorable and Venerable Worships that it may be your good pleasure to determine and devise henceforth, as a standard and guideline for the future, that which the undersigned believes can be deduced as a natural consequence from the honored decision of Your Right Honorable and Venerable Worships in the case of Jan Smit of Delburg: that the estates of such persons who have made themselves absent by flight 698 699 and provisional decision how deliberation thereon absent, without having arranged their affairs, and thus find themselves in the situation of still being able at any time to remedy matters according to their pleasure, leaving behind wife and children, may, at the indication of the wife, after the goods have first been properly inventoried at her requisition under the offering of an Oath, be converted into money by the Vendue Masters for the time being, and the moneys proceeding therefrom be handed over and delivered either to the Honorable Court of Justice, or to the Reverend Orphan Chamber of this town, or else to such others as Your Right Honorable and Venerable Worships shall see fit. All documents, which have been circulated among the respective Honorable Members of the Council, and concerning the contents of which ripe deliberation has been held, it has been approved and agreed, in order provisionally to remove all disputes that have so often arisen concerning the administration of fugitives or other criminally prosecuted Persons in this Colony and are always submitted for decision to this Council, how to act in such cases, to determine as a provisional Rule and Guideline: Firstly, that whenever a fugitive or other criminally prosecuted person whose estate has not been declared insolvent happens to leave behind wife and children, or husband and children, then the Mother or Father remaining with those children shall have the power to administer themselves all goods, both movable and immovable, cash, and securities, none excepted, which shall belong to the joint estate, and to sell or alienate them as free, absolute property, provided, however, that beforehand a father or mother who happens to be in that situation shall be bound, as soon as any Criminal proceeding might be instituted by the officer against the fugitive or otherwise guilty party, to have all the goods judicially inventoried and appraised by two men of irreproachable character from among the relatives of the fugitive and prosecuted person, or in default thereof, two other persons of good name and reputation to be appointed to the satisfaction of the Court of Justice, in order to be able to determine from those appraisals what is due to the children for the paternal or maternal portion, over which the said two Persons shall have to act as supervising guardians; all nevertheless [illegible] Under

700 701 the Fiscal concerning the inspection of the streets under the condition that the father or mother, immediately after the completed valuation, shall be obligated to provide sufficient sureties, for the aforementioned proof and for the security of the minors, to the satisfaction of the aforesaid Council of Justice, and this until the children's majority, marriage, or other permitted states. Secondly, that whenever a husband and wife together, or widowers or widows, should happen to flee, or otherwise be prosecuted criminally, leaving behind minor children, then their estates shall be placed into the hands of the Orphan Chamber of this Government, in order to be administered by that Chamber according to the prevailing Instructions, and Thirdly, that whenever someone should happen to flee, or otherwise be prosecuted criminally, and in their estates were found stolen goods, or others that were pawned under unlawful usury, then those estates, in accordance with the resolution of this Council of 12 October 1762, shall have to be accepted and administered by the Council of Justice. And extracts in proper form of this resolution shall be issued both to the Council of Justice and to the Orphan Chamber, to govern themselves accordingly, Honorable and Respected Sirs. Commissioners from the Respected Council of Justice, who in the past month of May also conducted the inspection of the streets and roads here, having made known at the ordinary meeting held on the 3rd of this month that, notwithstanding the fact that the said inspection was performed with all consideration, and none but the most strictly necessary matters were cited, yet certain negligent persons have thus far remained in default, and also, at the same time, an extract in proper form of the first clause of this provision shall be issued to the wife of David Malan, in order to govern herself accordingly, and pursuant thereto, to request with due respect from the Council of Justice the lifting of the sequestration in which the joint estate of her and her cited husband was taken by the same, in order to administer that estate, under the proposed conditions, in such manner as she shall deem fit. Finally, a memorial from the Honorable Independent Fiscal Johan Nicolaas Steven van Lynden was resumed and found to be of the following content: Proposition to the Right Honorable and Respected Sirs, Governor and Council of Policy. 702 703 having remained in default, with contempt for the orders given therein to comply therewith; requesting that this be provided for, and a fixed basis be devised whereby one could have security that the same would be punctually executed in the future. Thus, the undersigned has deemed it necessary, in the first place, to investigate whether any ordinances or Placaats of the Government were available here by which the aforementioned default could be remedied; and found: 1st. That by Resolution of 23 April 1687, it was understood that the Independent Fiscal, in the presence of the Captain of this Garrison and the Burgher Councillor of the time, shall hold an inspection day twice yearly, namely in the middle of May and November, and shall have the inhabitants warned 14 days in advance each time. That year after year the first inspection day shall be held on 15 May & November, the second on the 17th, and the third on the 19th following thereafter, in the manner aforesaid; 2nd. That by notice of 3 November 1739, all the inhabitants were ordered to improve and prepare, as well as subsequently maintain, the streets and roads before their doors, in such manner as shall be indicated to them by Burgher Councillors, and Burgher Councillors are authorized to have the work of the negligent done themselves at the expense of the unwilling. Likewise prohibited to throw refuse into the streets, on the penalty established in the prevailing general Placaat. 3rd. That by the General Placaat dated 11 October 1740 and published on the 25th of the same, Article 57, it is ordered that the inhabitants shall have to remove the dung heaps etc. from their streets, on penalty of 8 Rixdollars for the first, 16 for the second, and 24 for the third time, besides the costs that the Honorable Company shall incur to transport the same. 4th. And lastly, that by notice of 19 February 1771, Burgher Councillors, assisted by the Surveyor, are authorized to have the streets improved, furthermore to order the inhabitants to level the irregular elevations of the streets before their houses at their own expense; likewise to assess them for the costs of the proposed sewers and have them pay; furthermore, the inhabitants were ordered to comply therewith. This being all that was to be found on that subject, and appearing not entirely sufficient to the undersigned to satisfy the objective of the Honorable Commissioners, he has, in the second place, deemed it necessary to submit for the respectful consideration of Your Honors and Worships, whether Your Honors and Worships would not judge it expedient for the future to decree, and to have published, that the inspection of the streets and roads of this place, in the established manner, every year in the month of May, and, if judged necessary, also in the month of November, shall be conducted by the Fiscal and committee members from the Council of Justice or from the College of Commissioners
