That the inhabitants shall strictly have to obey everything that will be ordered of them on that occasion, and those fined shall have to pay the incurred fines immediately, or at least within ten days after the inspection has been conducted. That, for the convenience of the aforementioned Commissioners, fourteen days after the first inspection day, a second inspection shall be carried out by the Fiscal alone, assisted by the Messenger of Justice, in order to see whether what was ordered has been complied with; and in that case the negligent, as well as those who have failed to pay the incurred fines, shall have incurred a double fine, and remain obligated to pay it again within ten days. That another fourteen days later, and thus four weeks after the first inspection day, a third inspection shall again be conducted, just as the first, with the assistance of Commissioners, at which time those who have remained negligent in complying with what was cited, or also in paying out the fines within the prescribed time, shall have incurred a threefold fine in conformity with the cited Article 57 of the General Placcaat, and that which was left undone shall be performed by the Commissioners at the expense of the defaulting party, who shall hand over the accounts of those expenses to the Fiscal, and the same shall be authorized to claim and recover those expenses and unpaid fines by summary execution from the unwilling and negligent inhabitants, without any the least form of trial or further authorization. Furthermore, the undersigned takes the liberty on this occasion to propose to Your Right Honourable and Worshipful whether Your Right Honourable and Worshipful might not deem it necessary, for the ease and convenience of all the inhabitants and foreign passengers here, to also authorize and empower the Gentlemen who will conduct the next inspection to give a name or else to number such streets, roads, and squares of this town which do not yet possess a name, and to provide them on the corners with a wooden plank or board containing such names or numbers, and this at the expense of the Colony's Treasury! Finally, the undersigned finds himself obliged to further submit to Your Right Honourable and Worshipful that, due to the continuous heavy rains in the winter season, the street running past the Justice Council Chamber and Jail down to the beach has been washed out to such an extent that, in his opinion, the most terrible consequences for those buildings are to be expected from it, in case provision is not made for it in the speediest manner and in a solid way: with the request that Your Right Honourable and Worshipful may be pleased to issue the necessary orders that the same be repaired and made at the very earliest, whether on behalf of the Company, or from the Colony's Treasury, as such shall be found to be proper and has formerly been in use. 706/ 707 of this year and is eligible to be satisfied Lieutenant van Kervel to Captain Effective Tuesday the 27 October 1789 in the forenoon, present the Noble Lord Governor, and the Gentlemen van Lynden, Le Sueur and van Rheede van Oudshoorn, absent the Gentlemen Rhenius and de Wet, as being commissioned on behalf of this Council to Zwellendam and the Gentleman Gordon due to indisposition. Resumption of the Missives The respected missive from the Most Noble and Right Honorable Directors of the Amsterdam Chamber, addressed to this Council under date of 15 January of this year, was resumed, together with the petitions presented to the Illustrious assembly of the Seventeen by and on behalf of Colonel de Sandol Roy, to petition for his brother de Sandol Roy, Captain Commandant of the depot of national recruits who are being retained at this Government for the Indies, the rank and pay of Major; and having deliberated on what is appropriate regarding this request, it has been resolved, in consideration of the inclination which the High Commanding Lords Masters have been pleased to manifest towards this promotion, yet have graciously wished to leave at the disposal of this government, to respectfully comply therewith, which ought to take place all the more readily because Captain Sandol Roy is one of the oldest captains of the garrison; and that, because he serves separately, no other officers of other corps can consider themselves prejudiced by his promotion; and therefore the aforementioned Sandol Roy is appointed to Major under a new engagement of ten years with the associated pay and emoluments, which, as well as his engagement, shall be counted to have commenced on 24 May of this year, when the aforementioned venerated letters were received at this Government. Appointment of Captain van Kervel Through the decease of the Military Captains Burgers and Philippus van der Heiden, the reasons having ceased which had still restrained this Council for some time from complying with the request made on behalf of Captain Lieutenant Adrianus Gysbertus van Kervel to the Most Noble and High Honorable Lords Seventeen, for the purpose of obtaining the quality and pay of Captain Effective, and the favorable recommendations which their Most Noble and High Honorable have been pleased to make in that regard by their very respected letters of 16 May anno passato: it is thus resolved to appoint the aforementioned van Kervel, as having become the oldest Captain Lieutenant of the national Battalion, and a Captain's post having become vacant in that Battalion itself, the same Captain Lieutenant to Captain Effective, and that under his running engagement, and at the pay of f 80 per month pertaining to that quality, which as well as his emoluments shall be refunded to him from the day that the aforementioned Captain Burgers came to pass away, which was the 17 April of this year, since which time the aforementioned van Kervel has performed the service as Captain with the aforementioned Battalion; and the Most Noble and High Honorable Lords Masters shall, under respectful notification of both these appointments, be humbly thanked on behalf of this Council for the altogether wise provision which their Most Noble and High Honorable have been pleased to make, not to place the Officers who are sent out by the same for this Government directly with particular corps, but to leave the direction thereof deferred to the Governor and Council. Taken into consideration the steadily daily increasing population of this Government and the augmentation of the garrison serving for the defense of this important establishment, so that one would, in time, with difficulty be able to find the necessary subsistence for this considerable number of people from the products of this mostly so fertile land, unless one should take the necessary precautions against it; wherefore one has entered into deliberation whether or not the cultivation of grain could also be continued in the vicinity of Saldanha Bay with an equal success as in Mossel Bay to a greater degree, and consequently understood to encourage the inhabitants residing there as much as possible to the cultivation of this so essential article of human subsistence, by having them notified by notices that, when they shall have stored and laid up a sufficient quantity of that product, they will be able to deliver those grains to the Honorable Company on the same terms and conditions as takes place concerning the suppliers in Mossel Bay, and one will send Company ships expressly to effect the delivery thereof to the Honorable Company. 710 711 Upon resumption of the most recent resolutions Captain Sandelroy to Major there was submitted by the Honorable Le Sueur the following letter from the Honorable Colonel Gordon or other vessels thither for the fetching thereof, concerning which matter it is understood that the Equipment Master of this government, Cornelis Cornelisz, is to be ordered by extract hereof to report to this Council whether, to that end, use could not simultaneously be made of those ships which are sent to Mossel Bay to fetch the grains harvested there, or whether other vessels could and should be employed for this purpose; and finally, in which places of the aforementioned Saldanha Bay these ships or vessels should anchor and at what times of the year. While today the resolutions of the last held meeting were resumed, wherein, in accordance with the most honored instruction of the High Ruling Lords Masters, Captain de Sandolroy was promoted to Major, it was made known by the member of this Council, the Honorable Mr. Jacobus Johannes Le Sueur, that his Honor had received from the Colonel and head of the militia of this government, the Honorable Robert Jacob Gordon, a letter in which was enclosed a sealed paper, The undersigned requests that this note of his may be placed in the resolution of the 28th of October last, whereby Captain Sandol was appointed Major over the approximately thirty men remaining of the pépinière here. That he, as Head of the Honorable Company's militia, having learned indirectly that Captain Sandol, who was transferred here from the regiment of De Meuron as Captain of a company of the so-called pépinière in the month of February 1788, was promoted on Wednesday the 28th of October to major over the currently approximately thirty men of the pépinière, without any prior knowledge on his part, and with the following reflection: namely that the Honorable Secunde and the Honorable Cashier were then absent on commission to Swellendam; That he considers it his duty not to acquiesce in this, the more so because Captain Sandol was reported by him, the Chief, in the beginning of February last for his improper conduct, contrary to military discipline, displayed in and concerning the payment which letter contained a request to present the enclosed paper to the Council at the next meeting on behalf of the Honorable Gordon, as the said Honorable Le Sueur then also submitted the said paper, which, upon its opening and reading, was found to be of the following content: f. 712 713 resolved reading of a report requested on the date of 29 July last from the Landdrost of the month of February at that time, with the circumstances attending it and the consequences thereof, as is stated in the advice and note on that matter produced in Council; that hereupon a commission of inquiry followed, which, upon their request, entered into a correspondence with him, the head of the militia, until the middle of July last concerning that matter; and now, although it is already in the month of November, he has heard nothing further of it, except now, with the greatest astonishment, the advancement of that Captain to Major; We therefore protest against this as head of the militia, and view it as a harmful example for military discipline, with the request that this may be entered into the minutes and transmitted to the Lords Majors. As it has pleased Your Right Honorable and Worshipful Sirs, by extract resolution dated 29 July of this past year 1788, taken upon a certain petition presented in the aforementioned Council by the burgher Lieutenant Rudolph Johannes Laubscher, whereby a request was made by him to obtain a certain piece of land in quitrent measuring one morgen and fifty square roods, situated in the district of Stellenbosch, adjoining his old land, to place the said petition into the hands of the undersigned, in order to investigate whether the grant of the said piece of land might in any way be prejudicial to his neighbors, and to report as found, the undersigned have the honor, in fulfillment thereof, dutifully to submit: That the undersigned, after resumption of the abovementioned extract resolution in their meeting held on 4 August, unanimously approved and resolved to appoint a commission thither, in order together with the honorable messenger of justice there, to be able to report to Your Right Honorable and Worshipful Sirs with greater foundation regarding this matter after taking an ocular inspection. As, therefore, in accordance with the aforementioned resolution, the heemraden commissioned from our midst in this regard, the honorable Ian de Villiers J. P. son and Samuel Johannes Cats, in the presence of the first-signed Landdrost and assisted by the Secretary, carried out the said commission on 7 August following, and subsequently in the meeting of 1 September following reported in writing that on the aforesaid day they had proceeded from here to the piece of land requested in the petition, where both the aforementioned Laubscher and Mrs. Helena Catharina Malan, widow of the late former Heemraad the honorable Willem Morkel, as owner of the adjacent estate, who had been expressly appointed to be at the said place, were present. After the intention of the commission had been explained to them by the commissioners, they first inspected a certain building constructed there some time ago by the said Laubscher, over which some dispute had recently arisen between them both, which is situated on the slope of a hill between their respective 716 717 dwellings, and which building the said Laubscher requested might be included with the quitrent land mentioned in the aforesaid petition; whereupon it was told to him by the commissioners that he would first have to point out the outermost beacon of his estate, and likewise the said widow Morkel the beacon of her estate that was situated closest to the said building, so that thereby not only the true situation of the requested piece of land would appear, but also to be able to discover whether the granting of the same would also be prejudicial to the aforesaid widow Morkel. Which distance having been paced out by the commissioners, it was found to be approximately 390 paces from the outermost beacon of the estate of the said Laubscher to the aforesaid building, and subsequently from there again to the corner beacon of the estate of the often-mentioned widow Morkel approximately 153 paces, which latter beacon, however, is by no means the outermost beacon of her estate, as the outermost or upper beacon on that side of her estate extends far beyond the land requested in quitrent by the said Laubscher. After the distance on both sides of the aforesaid building had been paced out by the commissioners and the situation of the requested quitrent land had been pointed out to the said widow Morkel, the aforementioned widow Morkel thereupon indicated that since the said piece of land on which the building was constructed was situated much closer to her freehold property than to that of the said Laubscher, she on that ground requested to be the most entitled thereto, as she would be greatly prejudiced by this grant, not only because the possessor of the same could cause her considerable hindrance by keeping cattle and setting up the kraals required for that purpose, the filth of which would repeatedly discharge into her watercourse during heavy rains, but could also prevent her from making the necessary repairs to her dam situated in the so-called Laurens River; whereupon it was replied by the often-mentioned Laubscher that the building standing there would not have been constructed by him if he had known

had been under the impression that it was his freehold land, all the more so since it had already stood for 22 months without the said Widow Morkel or her late husband ever having told him, Laubscher, that it was not his freehold land, and because the costs of its construction had already been incurred by him, he requested that this might not be disputed with him. Whereupon the said Widow Morkel stated that she and her late husband, according to the situation of her place, had indeed presumed immediately that the land of the said Laubscher could by no means extend so close to her land, yet at that time, because of this uncertainty, had not considered herself authorized to bring any complaints in that regard; but a very few days after the building had become inhabited, and ever since continually, due to the nuisance, grief, and annoyance which had been caused to her and her late husband by its occupants continuously polluting her drinking water, she had lodged her lawful and well-founded complaints with the first-signed Landdrost, and as soon as her late husband had been convinced by a certain survey conducted thereupon that the building lay more than two-thirds closer to their property than to that of the said Laubscher, he had also immediately betaken himself to the said Lord Landdrost and requested that, according to the laws of the land, the aforementioned building erected by Laubscher on the Honourable Company's land might be pulled down and demolished. The parties thus having brought forward their respective interests on both sides, there was thereupon presented to the said Widow Morkel what had been accepted by the said Laubscher upon the proposal of the delegates, consisting of this: that the said piece of land and the dwelling would be granted to the said Laubscher, provided that he and the said Widow Morkel together should dig a ditch behind the aforementioned dwelling, in the low ground and thus up around the wood of the said Widow Morkel, in order to be able thereby to divert the water originating from the land of the said Laubscher, and thus to free her watercourse from all dirt and impurity, and that the possessor thereof would not be permitted to keep more cattle there than two riding horses and one span of oxen, provided also that the kraals standing there would have to be broken down and placed higher up; against which she, the Widow Morkel, would be permitted to request in perpetual quitrent from Your Right Honourable and Worshipful Court the piece of land situated on the other side of the aforementioned watercourse up to the so-called Laurens River upwards toward her upper brackish ground. She had thereupon indicated that she was completely satisfied therewith. Which aforementioned report having been reconsidered, notice was given by the first-signed Landdrost in the same meeting that the said Laubscher, three days after the said commission had been executed, had presented himself to his Honour and declared that he desisted from the agreement reached between him and the said Widow Morkel concerning the land in question, producing at the same time a letter dated 26 August, whereby the said Laubscher further requested that, notwithstanding this, postponement might be granted to him until the council after his arrival from Graaff-Reinet, whither he was about to proceed within a few days; the undersigned thereupon unanimously thought proper to await also that short time, in the expectation that the said Laubscher would allow himself to be brought to one or another acceptable offer, or conform again to that previously accepted by him; but the undersigned, to their extreme surprise, have had to experience that the aforementioned Laubscher, who had already returned on 25 November of the past year from his journey made to Graaff-Reinet, has not deigned to report on this matter, nor to declare himself further, either to the first-signed in private or to the Board in the subsequent ordinary meetings of December, January, and February; whereby the undersigned (as well as upon the further complaints received in that regard from the said Widow Morkel that the occupant of the building there has made her drinking water entirely useless) in the meeting of 2 February last were brought under the necessity of admonishing him, Laubscher, by letter in the most earnest manner to take care that within a few days to

Subsequently was presented by the Captain Carsten Jans Bleyk, commanding the chartered ship Rhynoord recently arrived here from Batavia, the following request: Disobedience Letters 1 Right Honorable Sir, Worshipful Sirs. Further, it was approved to now effectively appoint as Secretary of Graaff-Reinet Honoratus Maynier, who was provisionally appointed in the session of the 20th of March last and who gives good satisfaction in this service. While also, to fill the vacant post of Substitute Landdrost there, it was agreed to appoint on probation Corporal Johan Fredrik Schultz of this Castle, who accordingly shall provisionally discharge this duty at his pay and rank of Corporal. And likewise, there was submitted a list of such livestock etc. as have been stolen by the Bushmen Hottentots from the inhabitants belonging to the district of Graaff-Reinet from the 1st of July 1786 until the last of June 1789, as well as how many horses perished from the sickness in that time; which list the aforesaid Landdrost and Heemraden of Graaff-Reinet supplied to this Council, upon the statement required by the said government in the session of the 20th of March last. 7746 74. The letter submitted by the Colonel of Luxembourg, Raymond, was placed in the hands of the Pay-Bookkeeper for the purpose of a report, to refer back to what was required by that resolution. Whereupon, having deliberated on the contents of a letter from the Lieutenant Colonel of the Regiment of Luxembourg, Mr. de Raymond, dated the 9th of November last, reading as follows: Governor, I have the honor to inform you that the health of the men of the Regiment of Luxembourg currently present at the Cape has improved as much as one can hope for from an illness whose complete cure will never occur. I would deem it appropriate, under your good pleasure, to take advantage of the French vessel currently in the roadstead for their return to Europe. It seems to me superfluous to enter into any detail relative to the pay of these men and the advances. The state of distress in which they find themselves and what they have suffered are titles that speak sufficiently in their favor, and your Excellency knows better than anyone that one cannot with justice refuse wages to poor wretches who, after eight years of blameless service, bring home to their fatherland nothing but infirmities. I await your Excellency's orders on this subject, and whatever the result may be, I will comply with it. It was judged most consistent with the interests of the Honorable Company to see whether one could reach an agreement on this matter with the captain of one of those ships; and in case the same would equal the expenses that the Honorable Company would still have to incur in order to deliver these men into a French port pursuant to their capitulation, this opportunity will be seized and a written contract concluded with the captain of such a vessel, for which Mr. Johannes Isaack Rhenius is expressly requested and commissioned. Mr. Secunde Johannes Isaack Rhenius having made known that various country people, when they, according to custom, upon coming up here to the main settlement with wines for the account of private individuals, must declare to the patrol guard how many leagers of wine they have loaded onto their wagons and who must pay the recognition money due thereon, commit manifold frauds by giving false names or names that are entirely unknown, from which it follows that when these notes issued to the patrol guard are handed over to the messengers to demand the payment of those recognition monies from the persons mentioned therein and to collect the same, the messengers are unable to obtain these monies and also cannot proceed hereto by means and ways of law, which on the one hand would involve a great hardship for the said messengers if one were to compel them, in accordance with their signatures, to produce those monies, since it cannot be attributed to their negligence that the same are not collected, and on the other hand would cause a notable curtailment of the lawful rights of the Honorable Company if these hopeless debts were written off in the trade books; thus it was approved and resolved, in order to prevent all fraud by the country people.

And since your Right Honorable Worships still desire to be informed what pressing reasons there were for that construction and of its cost, one shall, with regard to the latter requirement, respectfully referring to the statement given above of the cost of this guardhouse, present as reasons for this construction: That since this guardhouse is nothing other than an ordinary corps de garde for an officer, a non-commissioned officer, and 18 to 20 privates, and arranged in such manner as they are found at almost all the gates of the fortified towns in the Province of Holland, even with this distinction, that these guardhouses still have an attic, whereas the guardhouse in the Roggebaai here has the roof or terrace cover immediately, and thus having no attic at all, it has thereby also been simplified and consequently also become less costly. That the urgent reasons which existed for building the aforesaid corps de garde consist in this: That the Roggebaai being situated precisely in the center of the town, it is the only place there between Battery Amsterdam and the Sea Jetty where one can come ashore with sloops without danger. That both guard posts at Amsterdam and the Sea Jetty are situated much too far away to guard the Roggebaai properly, and to enforce those orders there which have been established in this garrison since one can record having any possession here and being able to have the principal access points guarded to prevent disorders. That also, ever since one has been in a position to possess the principal access points of this town, it has not been permitted in any other places to come ashore with sloops, except only at the Sea Jetty. That thereby has been prevented the substantial desertion that constantly took place as long as anyone could come ashore with sloops, both by night and by day, at any place where they saw fit. 764 765 which caused many irregularities, and consequently, due to the daily desertion, was very detrimental to the Honorable Company; and that, since a battery against an enemy attack on the center was constructed in the Roggebaai and provided with cannon and ammunition of war, it could not be deferred to preserve the country's weapons and occupy that battery by means of a proper guard post. And meanwhile, regarding their remark made at paragraph 39, that it had appeared from our advices as if the commission appointed to inspect that building had been prevented from entering it due to the foul air prevailing therein; concerning which interest their Right Honors in particular desire a detailed report of the management maintained regarding the care of the sick in the aforementioned Hospital, the liberty will be taken, under respectful reference to the previously mentioned reports of the aforementioned Commissioners, to report in all submissiveness the following further elucidation: that this foul air, of which mention is made in our respective report, did not prevail in the building itself, but only in the privy, where the stench was all the greater due to the notable number of patients who at that time suffered from the bloody flux, and which stench was also immediately dispelled by the admirable effect of the vinaigre antipestilentiel, the efficacy of which was tested there with the greatest success. From section 158, putting equity into the equal enjoyment of the emoluments which the work bosses enjoy with the craftsmen, with respectful communication of the precautions put into effect by us concerning the bays. Please explain how this government should conduct itself with respect to the admission of such qualified persons of foreign nations, such as Mr. Tronblot, and in this respect, still adhering to the orders already given on this matter by Their Right Honorable Excellencies in a previous missive, this government trusts that in this it has also complied with Their most esteemed intention, and one will therefore respectfully refer to that which was advised on this matter to Their Right Honorable Excellencies in our humble letter of 31 Jannij 1789. The fishing outside the bays by foreigners, constituting in section 143 of the aforementioned Missive a point for consideration by Their Right Honorable Excellencies concerning the profit obtained outside the bay, and as it appears, bringing more benefits to the said foreigners than could have been expected in the beginning, it was deemed best to investigate whether this fishery could not be undertaken with equally good success by the Honorable Company itself. Consequently, it was understood to order the Naval Captain and Equipage Master of this government, Cornelis Cornelisz, to state exactly whether and to what extent, with the Company's vessels available here at hand, this beneficial objective could be achieved with any fruitful result; what measures ought to be put into effect for that purpose; and in what manner one would dare promise oneself the best success herein. Respectfully replied: It has struck us to perceive Your Right Honorable Highnesses' displeasure at the objection concerning the drafted instruction of the Oath of Purgation, while one will strictly discharge their masters' orders: to the same, as well as their bookkeepers under the restrictions determined thereby, it was permitted to trade in goods belonging to ship's equipment. This concession, their Right Honorable Highnesses consider to be directly contrary to their resolution of 3 December 1783, according to which no Company servants are permitted, directly or indirectly, to conduct any trade in matters belonging to their administration. To this, one shall have the honor to answer in all subservience that, however much one is convinced of the correctness of these remarks of their Right Honorable Highnesses, one believed that by allowing the Equippage Master and his bookkeeper only to trade in goods belonging to ship's equipment, with the absolute exclusion of all other trade, one would thereby once and for all cut off and prevent all disputes and disagreements which had persisted for some years between Company servants and burghers, and had happily ceased at that time, and of which one almost had to consider as one of the principal causes the facility which the Equippage Masters have, by virtue of their office, to be able to trade in preference to all other servants and burghers, and thereby form, as it were, a monopoly of those goods to which everyone who must seek their livelihood in trade would otherwise have equal access.
