might be summoned by writ via missive to appear in our Council on a certain day to be determined, in order to see the aforesaid decree granted to him the Prosecutor executed or carried out; we nevertheless granted thereon to the Prosecutor a decree of summons in person against the aforesaid Adriaan, Andries, and Petrus van Zeijl, together with the burgher Jan Wieser. That, having also been cited pursuant thereto for the 7th of February of the following year 1788, on the day appointed, there appeared before our Council only the aforesaid Adriaan van Zeijl and his son Pieter van Zeil, together with the burgher Jan Wieser, against whom proceedings were then also continued by the said Landdrost in accordance with style and practice; whereas we nevertheless, with respect to the aforesaid Andries van Zeil, granted to the said Landdrost the first default and, for the benefit thereof, a second personal summons. That the said Andries van Zeel, having thereupon been summoned in person anew for the 26th of the month of June of the aforementioned year 1788 and nevertheless having not appeared, the repeatedly cited Landdrost, then on account of the non-appearance of the defendant, requested and also obtained the second default and, for the benefit thereof, a third writ by missive on pain of bodily apprehension. That whereas regarding the service of this summons no report has been received, and the said Andries van Zeijl has not yet presented himself, the aforementioned Landdrost has therefore today further requested of us not only a decree by virtue of which he might be qualified to take the aforesaid Andries van Zeil into apprehension, but that the said van Zeil also, considering that the remote distance of his residence makes this decree more illusive, may be summoned by edict and the tolling of the bell in the customary manner, in order to come clear and answer for his aforementioned committed crimes within a certain specified term. Therefore it is that we, having considered the request made by the said Landdrost by reason of his office, grant the same to him, and consequently summon the aforesaid Andries van Zeil by edictal citation, as we do hereby, to appear in our Council within the next four weeks, in order to come clear and answer regarding the aforesaid outrages committed against the said Hottentots, on pain that, in case of neglect or non-appearance, proceedings shall be taken against him according to law. This having been duly published and posted everywhere under the tolling and ringing of the council chamber bell. The Council grants the Prosecutor the requested first default, and for the benefit thereof, bars the defaulting and absconding defendant from the declinatory exception; further granting the Prosecutor a second writ by edict for four weeks from today. That the defendant and defaulter, who resided with his father, the citizen Adriaan van Zeil, currently banished by sentence of Your Honors, did not shrink 3. From a certain Hottentot girl named Antje, 4. Who resided with the citizen C: van den Hever and from time to time came to visit her father named Ruijter, who lived with the defendant on the same farm, 5. On the occasion of such a visit, because according to the defendant and defaulter's pretense she had been found in the sheepfold at night, 6. Shooting her dead in a barbarous manner with a musket. 7. The more so, as it is certain that someone who at an unseasonable time in the night is found in a place where he has nothing to do, and where there is something to steal, is, if not convicted, at least rightly suspected of intending to steal. 67. Especially when such a person has already committed multiple thefts. 68. Just as the Hottentot woman Antje was considered by most to be a lover of stealing. 69. Far be it, however, from the Officer Plaintiff that he would wish to acquit the defendant and defaulter of all punishment. 70. For besides that it is a mere pretense of the defendant, 71. That he, without knowing her, shot the Hottentot girl dead as she was jumping over the kraal wall. 72. Article 31. and the same is accordingly admitted, to serve as a statement of claim, and to request justice thereupon, as appears from the respective deed thereof. 32. 33. in order to substantiate which statement of claim, it is incumbent upon the Honorable Officer as Plaintiff to demonstrate the two following points. 34. Firstly, that the defendant and defaulter has indeed made himself guilty of shooting dead a Hottentot child, 35. and in the second place, he ought to examine what punishment the defendant has incurred on that account. 36. As regards the first point, Noble Worshipful Gentlemen, 37. the Honorable Officer as Plaintiff refers to the answers given by the banished burghers, Adriaan and Petrus van Zeijl, to the interrogatories put to them by the Plaintiff, 38. namely to the answers given to Articles 66 to 71 inclusive by Adriaan van Zeijl, Article 39. and to Articles 63 to 70 inclusive by Petrus van Zeijl, 40. together with the statements of the Hottentots Ruijter and Andries, 41. which four documents are annexed hereto under letters A, B, C, and D. 42. From these documents, Your Noble Worships will easily perceive 43. that the Hottentot child, named Antje, was truly killed, 44. and that there is great probability that this occurred through the doing of the defendant and defaulter, 45. which probability is not only corroborated, but can also rightly be said to assume the force of solid proof, 46. when one adds thereto: 47. 1st, that the defendant in his letter, annexed hereto under letter E, fully admits having shot that child dead; 48. 2nd, that through the repeated edictal citations, the defendant is convicted of the crime charged against him, or held as having confessed, Article 49. as is asserted not only by very renowned legal scholars, 50. such as Julius Clarus, Antonius Matthaeus, De Criminibus, and others, 51. but is also evident from the Instruction of the Court of Holland, Article 120, 52. wherein it is explicitly established that he who commits four consecutive defaults shall be held pro confesso, 53. so that the defendant and defaulter stands convicted of his committed crime. 54. The second point now remains to be examined, 55. namely, how the defendant ought to be punished for this. 56. That a killer or shooter cannot escape the death penalty is so well known 57. that one may safely refrain from an extensive argument as to the truth thereof. See Matthaeus, De Criminibus, Book 48, Title 5, Chapter 3, at the beginning, and other criminalists. Article 59. From this, however, it by no means follows that the defendant and defaulter can be punished with death, 60. and this by reason of certain circumstances 61. which present themselves to the eye of the judge. 62. Your Noble Worships are requested namely to consider that most of the documents annexed hereto concerning this case agree on this point: 63. that the Hottentot woman Antje was of the very worst behavior, 64. and that she repeatedly made herself guilty of theft. 65. If this is so, Noble Worshipful Gentlemen, then it is also not improbable that she, by her conduct, gave cause for the defendant’s actions, 66. all the more because it is certain that someone who, at an unseasonable time in the night, is found in a place where he has nothing to do and where there is something to steal, is, if not convicted, at least with reason suspected of intending to steal. Article 67. Especially when such a person has already committed several thefts, 68. as the Hottentot woman Antje was regarded by most as one fond of stealing. 69. Far be it, however, from the Honorable Officer as Plaintiff that he would wish to acquit the defendant and defaulter of all punishment. 70.
