166. Suppliants, who can be considered nothing other than private persons, for although they are also members of the Council of Justice, chosen from the body of the burghers, they nevertheless cannot presume to claim that capacity here, since it is only active when they are in function together with and alongside the other Councillors of Justice, as all members of a single body, whether in full council or committed from and by the same to one or another duty; all their power, qualification, and activity ceasing which does not have its origin in the bosom of the said council. From which it must also follow that the title of currently serving Burgher Councillors, which the suppliants so boldly ascribe to themselves in the beginning of the petition, is set down there incorrectly and improperly. And since at the same time a board of commissioners from the Council of Justice has been ordained by the Lords Majors, consisting both of members of the Company's servants and of members of the burghers, to which all matters touching the burghers are likewise assigned, these suppliants can never maintain that a council of Burgher Councillors alone or by itself exists, or that it is fitting for them to hold any meetings among themselves, and from there, as currently serving Burgher Councillors, to draw up any addresses: Which can therefore be considered nothing other than clandestine gatherings and formal cabals, directed against the body to which they belong; and even more so when, as in this case, such addresses are directly contrary to the orders of their legislators, and against the lawful privileges of their chief ruler and of the council of which they are members. That it is the height of absurdity, indeed running directly contrary to the respect and deference owed to a government, to make a request to the same for which it does not possess the slightest power or faculty, or to demand a complete injustice from it. Indeed, 167. Qua Secundum Indeed, Right Honorable Stern Sir and Honorable Respected Sirs, this council has not the slightest power or faculty to invert the so clearly established orders of the Lords Masters and to act directly contrary to them. And it would be utterly unjust to deprive the Lord Governor and the Council of Justice of their rightful authority. Just as it is likewise, both for the Lord Secunde as nominated by the Most Honorable Greatly Respected Lords Seventeen to be permanent president of the Council of Justice, and also for their High Honors themselves, not at all gracious, but on the contrary very injurious, to request of this government that said nomination might take place under the presidency of a member from the midst of this assembly; since this request, if the suppliants had thereby meant the Lord Rhenius, was entirely superfluous and futile. The positions, means, and grounds upon which the suppliants base this request of theirs are: 1st. That they present themselves for that purpose as Burgher Councillors, and NB: in this capacity, as members of the Council of Justice. Whereas, on the contrary, as has already been shown above, they are members of the Council of Justice chosen from the body of the burghers, and consequently can only be called Burgher Councillors in that capacity. 2nd. That the first suppliant, having presented himself to the Lord Governor a few days before the nomination was made, learned at that time that his Right Honorable Sternness, for the post of burgher councillor, had considered the Orphan Master Abraham Flek, who had been elected a few days before, having only been discharged from the Company's service at the end of the year 1784. This first suppliant now taking great care not to state the reason for this visit of his to the Lord Governor before the day of the nomination, he cannot take it amiss that

168 that one having to guess at this, arrives at the supposition that this could have been for no other purpose than to sound out his Right Honourable regarding that appointment, as it were, and if possible to force upon him a councillor according to his liking and according to an agreement with his associates; just as it was then also very natural that the Lord Governor, who apparently will have informed himself about a competent subject, candidly made his inclination known to him, certainly not expecting that ex post, in a petition to the full council, a crime would be imputed to him for that which was spoken in confidence between four eyes: especially since that inclination had fallen upon a person regarding whose civic conduct, as the petitioners are themselves forced to admit, not the slightest fault could be found. Upon a person to whom for a long time already the administration of the poor relief funds, and since a short time the maintenance of justice and the interests of orphans and defenseless widows had been entrusted. Upon a person known to everyone here at the Cape as a man of honour and probity. Upon a person who, for that reason, is also very esteemed and beloved by everyone, and especially also among the Burgher community. Upon a person by no means devoid of natural judgment, and who, having already entered his 33rd year, can no more be considered to be of too young an age for the function of judge than for those of his previous offices. Besides, it is by no means proven that the oldest judges in Africa would always be the wisest, most capable, and most conscientious. And finally, upon a person who, quiet and subordinate to his lawful authorities, seeks to observe their orders in every respect, bears them the proper respect, and has never at any time meddled in any disputes, complaints, nor the submitting of petitions, whether to the government, or to the Directors, and much less to their High Mightinesses. - Just as there is also no law or regulation at hand that would dictate that a Company servant discharged from the service for more than four years, and having returned to the Burgher community, among 169. whom he was born and raised, might not be elected from that same Burgher community to the Council of Justice. Since the five-year burghership, attached by the Lords Masters to the eligibility of a councillor of Justice, is not stated as having to commence from the moment that a born Burgher is discharged from the Company service, and that the previous years, before he entered into the service, might not also be taken into computation, as has also been most convincingly proven from the case of the last signatory H: I: de Wet. — 3rdly That the first petitioner had believed he should not conceal from the Lord Governor that the person of Abraham Fleck could not be agreeable to the Burgher community for the post of Burgher councillor, and this because so many were to be found among the Burgher community of such as, being the most notable in that station, held the esteem and trust among the burgher community on account of their respectable years, sufficient experience and knowledge, together with long years of service, and thus were in a position to be considered first of all for that post, above and before the said Fleck. How the petitioners now dare to venture here, without the slightest shadow of proof, to ascribe such a way of thinking to the burgher community with respect to the person of Abraham Fleck, the undersigned will leave to their responsibility. - They certainly would have done better if, without abusing the name of the Burgher community, they had courageously and straightforwardly admitted that this person was so disagreeable to themselves because his way of thinking did not accord with theirs, and they thus did not have the prospect of finding in him a colleague who would agree with them in holding clandestine meetings, making secret agreements, and submitting improper petitions or requests, as they might well have imagined otherwise, if they had [illegible] a councillor after their own image and likeness.

While for the rest the undersigned will leave it to the judgment of that same Burgher community whether there are indeed so many to be found among them who, for the reasons enumerated, must be taken into consideration so far above and before the often-mentioned Flek; as well as whether these three petitioners themselves, on account of their respectable years, sufficient experience, and knowledge, together with long years of service, do possess so much more confidence than he among that same Burgher community, at least among those who know them properly. Apart from the fact that the confidence of the burgher community alone, however desirable it may otherwise be, is cited very wrongly here and is not at all sufficient; because the making of nominations is not demanded of the Burgher community, but of the Council itself, which, by putting forward such members on it in whom they in good conscience believe they can place their trust, fully satisfy the requirement; and also a so-called Burgher Councillor having to judge over matters of Company servants as well as over those of burghers, thus the confidence of these latter alone is not sufficient for him. 4: That subsequently the petitioners lodge their complaint that during the drawing up of that nomination only three burgher councillors were present against five Company servants, besides the President, saying that consequently the members were ill-proportioned in number against each other; because the burgher councillor Maasdorp, due to bodily infirmity, was unable to contribute his vote to the nomination; because the seat of the burgher councillor Gie was vacant due to his discharge; and also because, instead of the burgher councillor Bletterman who was discharged long ago already, no other person had been appointed, notwithstanding the repeated representations made for that purpose by the petitioners to the Right Honorable and High-born Lord Governor. How ever, in drawing up such a nomination, the number of six burgher councillors can possibly be complete, the undersigned avows not to be able to calculate. Meanwhile, the petitioners very unjustly make out the Lord Governor here to be the cause that the number has not become complete, since the illness of councillor Maasdorp was not caused through His Right Honorable and High-born's doing; another, as long as he was in the land of the living and did not see fit to request his discharge, could not replace him, and the vacant place of Gie was now already about to be filled; while the filling of that of Mr. Bletterman cannot take place without a nomination presented to His Right Honorable and High-born, and consequently that non-completion is rather to be imputed to the Council, and thus also to the petitioners, who have reiterated their representations for it in the wrong place. Indeed, it is entirely unknown to the undersigned that the Lord Governor has ever hindered or prevented proceeding to a nomination, nor that, having had a nomination handed over to him, he would have delayed or omitted the election therefrom. However, it is known to him, which the petitioners conceal here, that during the long vacancy of the post of Independent Fiscal, his seat in the Council of Justice has remained open, and therefore besides the President only five Company servants have sat, while the members chosen from the Burgher community have been complete, which always takes place in matters in which the undersigned must act in his official capacity, in case of completion of the latter. 5th That the petitioners further declare outright that the said Abraham Flek was not nominated by them, but indeed by the President and the five remaining members of the Honorable Company's Servants; so that by the majority of votes, the said Flek appeared on the nomination, and alongside him the former Commissioner of Civil and Marriage Affairs, Hendrik Pieter Warneck. From which saying it appears most clearly that this latter was actually the man whom they intended and wanted to have. That they therefore gave their vote to him, and that certainly some of the Company servants also cast their votes for him, since their three votes alone could not make a majority for this notable, respectable, knowledgeable, experienced Hendrik Pieter Warneck, who has risen so high in esteem and trust on account of his long years of service. For the rest, the undersigned will leave it to the petitioners' own decision whether and to what extent they were authorized, after having sworn with a solemn oath upon their appointment to maintain the secrecy of matters occurring in the Council, to reveal not only the course of the affair itself, but moreover, the individual opinions or castings of votes! Indeed, how scrupulously these petitioners think on the matter of the oath will soon become more apparent. 6th That the petitioners, to their painful regret, have had to experience that the often-mentioned Lord Governor had paid no regard to what the First Petitioner had declared and shown to His Right Honorable and High-born with candor and trust. From this it appears once again how the petitioners have solely been concerned with persuading and forcing the Lord Governor to choose their favorite, and this failing, their painful regret was born therefrom; although the petitioners burst out somewhat all too prematurely in this and some following periods against the Lord Governor with various exclamations, at least regarding the making of the nomination, and before His Right Honorable and High-born had proceeded to the election therefrom. Meanwhile, the Lord Governor has certainly demonstrated his complete impartiality by electing the one who had the most votes, as

That the petitioners, however, have not been able to comprehend through what cause they should have forfeited the confidence of the Governor in a matter of such importance to the Burgher community. The Petitioners must entertain very grand ideas of themselves to dare to claim the confidence of the Governor above all the other Members of the Council; they also make once again much ado about the importance of this matter solely for the burgher community, just as if all Company servants, who in their eyes seem to count for nothing at all, had nothing to do with the Council of Justice, and as if it were all the same to the latter whom they obtained as their Judges from the burgher estate. 8th. That the petitioners consider themselves entirely blameless of having given the Governor any legitimate reason whatsoever for displeasure. The undersigned does not know how far the blamelessness of the petitioners extends in this regard. He also does not know whether the councillors of Justice from the Company servants have given the Governor any legitimate reasons whatsoever for displeasure. But this he knows, that the latter would always have fully appeared to be the case, had His Honorable Excellency passed over the majority of votes in this matter and given audience solely to these blameless petitioners. He also knows that at least the first petitioner has shamefully abused the confidence of the Governor by setting down in his Petition that which was confided to him alone. 9th. That they, the petitioners, on the contrary, have always with the utmost zeal directed the credit and confidence which they enjoy among the Burgher community to that end to which they believe it ought to be directed, namely, thereby to cause the deepest confidence of the same to ascend higher to Your Honorable Excellency and Honorable Worships, and thus always to render fruitful the resolutions and measures taken by the same for the benefit of the Honorable Company, for the welfare of this Colony, and for the peace and security of the Inhabitants of this place, and thus to make the entire Body of the Burgher community cooperate and agree in unison with this; so that, if this government still enjoys any confidence among the burgher community, if the peace and security of this place has thus far been preserved, not to repeat all further salutary effects that have sprouted therefrom for the Honorable Company, it is solely obliged for this to that deepest confidence and to the great power arising therefrom, which the petitioners so boastfully claim to possess over the entire Body of the Burgher community. Here one may well exclaim: Proh quanta potentia rerum! However, the undersigned cannot refrain from having to remark on this that, although in his post he frequently finds occasion to speak with various Burghers, thus far no such deepest confidence in this Triumvirate has come to his notice; just as this at least cannot be apparent to him regarding the third Petitioner from the memorial of complaints of the Cape Burgher community, pressed by dire necessity and presented to the Lords Masters, dated 9 October 1779, article 6. 10th. That the petitioners can much less infer that the blessed change of affairs in the fatherland, through which His Serene Highness has been restored to his eminent Dignities and has returned to the power to restore and preserve the bond of unity in the great Body of the state, could have contributed anything to make the Governor adopt a different conduct toward the Cape Burgher community, etc. etc. The undersigned would indeed like to know how this entire passage, along with that which follows upon it, and which rather resembles an oratorical Declamation, can be applicable here? Now, as regards the much-vaunted peaceful conduct of the Cape Burgher community, as well as the name and praise of respectfulness and obedience toward their authorities showered upon them, and, thank God, the so happily passed times of division, all this the undersigned—since he arrived here only after the blessed restoration of affairs and thus cannot well judge it—will leave to the decision of this council, who, as the petitioners rightly say, must surely know best of all what has occurred here at the Cape, as well as whether and to what extent the affection and respect

176. respect both for the precious person of our Lord Governor-General and for the Lords Masters, and of the petitioners, and of the citizenry so often cited therein, has been manifested through this conduct of theirs." 11th. That the cited Flek also by no means, through any outstanding services—at least not those that have come to the knowledge of the petitioners or the public—has made himself preferable to others of the most distinguished among the citizenry for the post of burgher councillor. What kind of person this Flek is, upon whom the petitioners have vented so much blame, at least so far as is known to the undersigned, he has already stated hereinbefore, and he summons both the petitioners and the entire public to dare to challenge this statement and to prove the contrary. Then, as regards the outstanding services through which he might have made himself preferable to others for that post, nothing else is known to the undersigned about that than what public report has taught him, namely that this same Flek, in the various offices in which he has found himself, both in the Company's service and outside of it, has always conducted himself as an honest and upright man. While those outstanding services of the three petitioners or of their protégés, although appearing here as among the most distinguished of the citizenry, are equally unknown to him. Concerning which latter point the remaining members of the Council during the formation of the nomination in question, as well as the Lord Governor during the making of the election, must have been equally ignorant. 12th. That the petitioners, by what was alleged before, still had hope that perhaps a further step would bring the Right Honourable and Valiant Lord Governor to some other decision, in order to keep in view and preserve the love and the trust of the citizenry in and toward His Right Honourable and Valiant. Who does not discover from this in the clearest light the true 177. true atrabilious disposition of mind of these three sincere petitioners toward their chief master, and their attempts, entirely contrary to their aforementioned protestations, to place him in a false light with that citizenry and if possible to make him hated. The undersigned trusts that this same citizenry possesses too much judgment, notwithstanding their deepest trust in and upon the petitioners, to allow themselves to be persuaded thereto so blindly; and that it will appear just as obscure to them as to him how, with any slightest semblance or possibility, the Lord Governor, by electing the fellow burgher Flek and not immediately obeying the so stoutly and sincerely manifested will and desire of the petitioners, could have lost from view the trust and the love of the citizenry in and toward himself. He firmly maintains that this love and trust is far too well established for it to be wrested from their master, who employs all his efforts in order to give each and every one of them satisfaction in all things, for such trivial reasons or causes. 13th. That the petitioners, after the nomination had taken place, yet before the election, through the third petitioner, again most respectfully urged the Lord Governor that His Right Honourable and Valiant, take note, in order to prevent a great discontent among the citizenry, would please desist from the intention and disposition that there might be to elect the aforementioned Flek from the nominated persons; which was executed by him with persuasive reasons serving that purpose. This was truly a very honourable and faithful step by the petitioners toward their fellow councillors: behind their backs, in an entirely clandestine and caballing manner, by all kinds of persuasive 178. reasons, to want to draw the Lord Governor away from the desire and the longing of the majority and onto their side, notwithstanding that the nomination had taken place in good faith by the entire Council according to their best knowledge and understanding. Meanwhile, it has become apparent from the event that those reasons, however persuasively conceived by the three petitioners, nevertheless cannot have appeared as such to the Lord Governor, and His Right Honourable and Valiant was easily able to refute them; which the petitioners furthermore say occurred under the friendliest terms, from which indeed not the slightest aim is to be perceived to lose from view the love and the trust of the Cape citizenry. 14th. That the petitioners have added hereto that it was indifferent to them, the petitioners, and to the citizenry, who from the large number of those who first came into consideration was nominated and elected to the office of Burgher Councillor. Since now, as has already been cited before, it is solely the task of the Lord Governor to choose one Councillor from a nomination of two burgher persons presented to him, and at that time that nomination was also actually made and delivered, it appears most clearly from this period that the just-mentioned persuasive reasons of the petitioners also tended, in the name of the citizenry, to qualify and persuade the Lord Governor either to disapprove the same entirely, to cast it back to the Council, and to demand a new one from the same, or to bypass it completely and to elect another from the large number of those who ought first to come into consideration. 179 stern Sir and Honorable Worships, clearly demonstrates the petitioners' irreconcilable hatred against this Abr: Flek, and would the Burghery, if it were true that they thought precisely as they did, redound as little to honor as it can do to the petitioners. Since they have thereby sought to inflict a formal insult and blemish upon him before the eyes of the entire public. And thus this conduct savors far more of calumny against his fellow burger than of fulfilling the trust which they so highly boast that all of them had placed in them. 15th That this /: the refutation of their arguments by the Lord Governor in the most friendly terms :/ caused all hope to vanish of obtaining any satisfaction in the essential point. What the essential aim of the Petitioners alone was in this matter is also already noted here above; yet the patience and those very friendly terms wherewith the Lord Governor, who surely will have perceived their sinister conduct, wished to do them the honor nevertheless to hear them and answer their persuasive arguments, could certainly have aroused some satisfaction in these petitioners. 16th That pursuant to the authorization conferred upon His Right Honorable Sternness by the High Governing Lords Masters in the year 1785, the election of the said Flek was proceeded with that very same morning, regarding which the petitioners /: being unable to trace nor fathom the reason and cause hereof :/ must profess to be extremely astonished. The great crime then of the Lord Governor, which has made the petitioners so extremely astonished, consisted in this, that His Right Honorable Sternness preferred that very morning to satisfy the authorization of his Lords Masters, and the desire of the majority of the Council already manifested at that time, rather than the unreasonable and unjust demand of the petitioners. Truly 180 Truly a course of conduct by the Lord Governor which must remain to his accountability, and the reason and cause of which is impossible to trace or fathom; yet whereof an opposite course of conduct precisely should have had to arouse a general astonishment. 17th That this Election, as soon as it became known, also immediately had the consequence which the petitioners had anticipated therefrom, namely a general very great dissatisfaction among the Burghery, of which the petitioners immediately had to perceive distinct proofs. The undersigned can in all truth testify to Your Right Honorable Sternness and Honorable Worships that from the day of the election of the said Abr: Flek until this very hour, not the slightest thing that in any way savors of dissatisfaction among the Burghery has come to his attention from anyone whomsoever. But on the contrary, so far as he has been able to investigate and trace, that choice was completely appreciated and approved by everyone, by Company Servants as well as Burgers alike. He further safely dares leave it to the knowledge of the Lord Governor, of all the Members of this Government, of the full Council of Justice, nay of the entire Colony, whether such distinct proofs of such a general and so very great a dissatisfaction among the Burghery have been evident to them. 18th That the petitioners trust that Your Right Honorable Sternness and Honorable Worships will indeed be willing to believe the testimony of the petitioners hereof /: which they make upon the Oath sworn by each of them upon entering his office :/. The undersigned cannot refrain from expressing here his utmost surprise, indignation, vexation, and at the same time emotion, at this far-reaching, reckless step of this trio of petitioners. Whereas they, who are chosen as Judges to judge over the property, the honor, nay the blood of their fellow man in the presence and in the name of a most holy and omniscient Supreme Being, dare to be so presumptuous as to dare confirm under Oaths, unasked and unrequired, something of which not the least or slightest proof, or even probability, has been adduced by them! Whereas they openly demonstrate thereby to have little understanding of the weight of an Oath. Ought they not to deduce from this a belief in the deepest trust, the credit, and the love and respect which these most notable petitioners, so preferable on account of their outstanding services, possess among the Burgher community, and in the power which, for that reason, they can exert upon the entire Body of the Burgher community! The undersigned will furthermore submit to the conscience of the petitioners for their consideration and accountability: By what paths and means they have sought to prevent those movements, and to quiet and suppress that dissatisfaction; Wherein those movements have consisted, and how far the same have gone; Where and by whom the same were instigated, first begun, and continued; Or whether the petitioners themselves did not rather seek to stir up one person or another, and by persuasive arguments, wherewith they nevertheless appear to be provided, to persuade them to take this matter also to heart, and in so doing rather sought to give rise to a general, very great dissatisfaction and movement; Whether such a person, observing his duty as a quiet and calm burgher, did not decline this proposal with indignation? At least the undersigned must frankly confess that this manner of acting does not have that effect upon him in the pending proceedings which he, in his capacity, is obliged to conduct, and also to leave to these petitioners for decision. 183 20th. That among all peoples from the oldest times onward, it has been in use that whenever they enjoy the permission to allow Representatives on their behalf to accede to certain Bodies, the freedom is then also left to them to nominate the representatives themselves. It has likewise from the oldest times onward been confirmed by experience that the nomination of the people's representatives by the people itself has always proceeded in a very turbulent and tumultuous manner, and that nothing but very ruinous and dangerous consequences have sprung therefrom for the same. Especially whenever there were several candidates who possessed such a power over the spirit of the entire Body of that people, as the petitioners imagine themselves to have. And that such Representatives, possessing so much influence, can be very dangerous subjects for a well-ordered government, indeed for the entire state. Yet it is now not the Lord Governor, but the High and Mighty Lords Masters themselves, who have erred by not granting to the Burgher community the nomination of their Representatives. But who, pray, has made the petitioners believe that they are representatives of the Burgher community! From what can such a thing possibly be deduced! It has already been shown and repeated herefore that they are nothing other than Members of the Council of Justice chosen from the Body of the burgher community; thus no representatives of the same, but Judges as well over matters concerning the Company's servants as over those of Burghers, and that to them, at the same time and conjunctly with the other Councillors from the Company's Servants, all such other matters touching the Burgher community and its economic household, which were formerly conducted by Burgher Councillors alone, constituting a College of Commissioners, have been commended by the Lords Masters, so that by lawful consequence, 184 the college of burgher councillors formerly subsisting, if ever such a lawful body existed, has been wholly extinguished and annihilated, and these Petitioners have not the least greater relation to their so frequently cited Burgher community than to all the Company's servants and Inhabitants of Cabo, and also precisely just as much, and nothing more, than all the other Councillors of Justice. 21st. That the petitioners' request is made on grounds of equity, on behalf of the Burgher community. How strictly the Petitioners' request agrees with equity, both before the Lord Governor and before the Council of Justice, has also already been noted more than once herefore. 185. can maintain, the undersigned cannot guess, but of this he is assured: that his Lords and Masters will not allow themselves to be moved by any reasons that will only hold good for a time and must cease thereafter, and that indeed for the establishment of such positive permanent orders. The consequences which the petitioners maintain would be born from granting this petition of theirs are: 1o. A prospect for the citizenry that in the future, both the nomination and the election of burgher councilors will take place in a manner whereby they may consider themselves assured of seeing persons from their midst chosen as co-judges, in whom they can and must place their trust without hesitation. A conclusion, Right Honorable Sir and Honorable Gentlemen, which might seem somewhat flattering to the former indirectly, but at the same time is in the highest degree arrogant for the petitioners themselves, and offensive, nay slanderous to their Chief Ruler, to the two presiding members following after him, and thus to the three eldest among them, and at the same time to all the Company servants who are members of the College in which the petitioners Quoad Tertium enjoy the honor of having a seat. In addition, it contains yet another misuse of the name of the Cape citizenry, who have possibly never let their thoughts go so far. For if this reasoning held true, all those who have been appointed to draw up those nominations up to now must have nominated persons as judges in whom the citizenry cannot or must not place any trust, and also, from the nomination each time, such an untrustworthy person must have been chosen by the Governor. Then how do the petitioners, who were certainly nominated and elected in the very same manner as still takes place, dare to boast so much of the credit and trust which the citizenry places in them? Can a more offensive, more slanderous, nay falser accusation possibly be devised and vomited out against a Chief Ruler to whom one owes all reverence, awe, and submission; against members of this Government to whom one owes proper respect; and against one's fellow members to whom one owes, at the least, some civil courtesies and regards! And how arrogant is this reasoning not for the petitioners themselves: they, they alone, are the ones who shall choose such councilors from the body of the citizenry in whom the same will not only be able to, but also, mind you, must place their trust without hesitating. Then for the very first time shall the Council of Justice boast of such members in whom the citizenry will be forced to place a complete and blind trust. Fortunate meanwhile for this same citizenry, fortunate for the whole public, that things have not yet come to that pass! 2o. That the concession of this request will also be fully capable of causing the present discontent of the citizenry to cease. Once again, the discontent of the citizenry, forged in the brains of the petitioners, of which not the slightest evidence is at hand, must be brought up here. Even assuming for a moment that such discontent over the election of Abr: Flek exists among the citizenry, who has assured the petitioners, and from what do they prove that the same would thereupon come to cease because of this? And what would then happen in the future, when the Cape citizenry will have to suffer the blow of having to do without these three so experienced, knowledgeable, conscientious, and deserving petitioners as burgher councilors? Or do they possess such far-sightedness, subtle judgment, and delicate taste above their fellow councilors that not only will they nominate such perfect subjects, but these in turn, after them, will nominate others, and thus this perfection will be propagated forever! 3o. And at the same time thereby to cause the aforementioned Flek to be respected in his acquired office of burgher councilor among the citizenry. This conclusion is just as solid as the preceding ones, for indeed, what can the granting of this request add to or take away from the quality of Mr. Flek as a councilor of Justice? How can he, who is in such discredit and mistrust with the citizenry, over whose appointment such a general and very great discontent, over whose election such commotions have arisen, be so immediately respected in his acquired office of burgher councilor because of this? Or could it also be because the petitioners, being able in the future to be always assured of obtaining a fellow member to their liking, from their clique and cabal, with whom they would know how to arrange everything according to their pleasure (and also well realizing that this will never be the case with this man, but they, in all

Smuts, Meijer, and De Wet, without the very least prior knowledge of the Council, nor of His Honorable Respectable, as President, could have resolved to make such an address. His Honor was after all commissioned on behalf of the Council to thank the Governor in their name for the communication made; To pre-warn him that the Council had not the least knowledge of this step taken by the said three members, and respectfully to request that His Right Honorable and Gallant might please take into serious consideration the consequences that the conduct of the aforementioned three members of the Assembly of Justice might entail, and further regarding the President and Members of the Council of Justice aforesaid, to take those satisfactory measures which might not only be remedied on the occasion that the President was addressed regarding the excessive injury inflicted upon them, but also deemed suitable to maintain this assembly in its lawful right, and in the future to free it from such imputations. His Honor did indeed voluntarily take this commission upon himself. Letter B: It is only since a few years that the return ships between the Cape and the Netherlands, according to what is rightly noted in Section 11 of this Chapter, have on some occasions departed from the old established courses, to steer North-West 20 or 30 miles off the coast of the Cape, to run on the same course into the North-East trade wind, subsequently keeping broad-reaching into it, and thus again searching for the westerly and south-westerly winds, with which one can bend the course from the North to the North-East and further behind Ireland and Scotland, which, under whatever pretext of wishing thereby to shorten the way, was followed by some, yet was found to have little success; therefore, all the convened mariners, having been heard on this matter, have unanimously deemed that as yet, according to age-old experience, it is by far the best to follow that route with which one has done well for so long, that is to cut the Line from St. Helena on a North-West course, up to 12 to 13 degrees North latitude, from there North-North-West, the trade wind, which is commonly called the North-East trade wind, yet varying scant and free between North and East, permitting this and always continuing the voyage under full sail up to 30 degrees North latitude, luffing up to the North when the wind serves, in order not to run too close to the Grand Banks of Newfoundland, where at about that latitude one must encounter the westerly or south-westerly winds, in order to be able to steer with them again in due time North-North-East and further, without worrying about a little more or less West, and rather making the bend somewhat larger than getting out of the steady winds by cutting the route short. No 80 As the outer roadstead and Bay of Punto Gale are dangerous to approach without pilots for ship commanders who have no local knowledge there, we have, in order to prevent all kinds of accidents that might happen to arriving ships through a lack of pilots and absence of sufficient knowledge, deemed it necessary, after taking the advice of our Equipage Masters, both at this main office and at Gale aforesaid, and other present Skippers, to prescribe the following rules herewith for the guidance of the commanders of ships and vessels wishing to enter the bay of Punto Gale aforesaid or to come to anchor on the outer roadstead. Instructions for Ship Commanders to be observed upon approaching the Bay or outer roadstead of Punto Gale. The east or good monsoon is counted from mid-October to mid-April, and the west or bad season from mid-April to mid-October. The change ordinarily occurs in April and October, No 448 228. 229. yet this is not too certain, as experience teaches that this change sometimes happens later and also earlier. For ships that must be inside the Bay. Article 1. In the months of May, June, July, and August, being the bad times, in which high seas and stiff westerly winds, indeed sometimes storm squalls from that quarter are to be expected daily, your Honours must bring the flagpole of that fortress east-northeast to east-northeast half north, but especially not more northerly of you, seeking thus to anchor at the following depth, namely at 35, 34, 33, 32 fathoms, being blue sticky ground. The currents run ordinarily in these months with the wind around the east, and also south-southeast; only at spring tide or having had some consecutive days of fair weather, one finds either slack water, or that they run contrary for that time, that is around the west and northwest. Signal for a Pilot. Article 2. The Prince's flag from the mizzen yard and three shots slowly from one side, which must be done as early as possible, or as soon as one is confident of being heard on land, upon which immediately on land from the flagpole the Prince's flag will be shown upside down, as a sign that the signal was well heard and seen, which remains flying in such a manner until the Pilot shall be on board with your Honours; subsequently it is hoisted and displayed upright again in the ordinary manner, so that no more shots need to be fired unnecessarily. But in case your signal is not understood on land, a proof thereof shall be shown by hoisting the Prince's flag upright and hauling it down immediately, which shall be done repeatedly 2 to 3 times; thus your Honours must fire 3 shots anew as above with the heaviest artillery. Your Honours recognise the thonij in which the pilot is by a small Prince's flag that they let fly from it. The pilot having come on board, your Honours must fire 2 shots from one side, while displaying a Prince's pennant at the peak of the mizzen yard. Signal for those who only wish to be spoken to. Article 3. If your Honours only sought to be spoken to or have any papers to deliver, your Honours must let the Prince's jack fly upside down from the foretop, and immediately fire a heavy cannon shot, paying close attention to the counter-signal from land, which is the same as in Article 2; subsequently running somewhat early under small sail when one bearings the flagpole south-southwest or east-southeast, setting your course over the depth of 40, 38, 36 fathoms, ground as above. The speaking thonij is likewise to be known by the display of a small Prince's flag. For Ships in the East Monsoon, what they have to observe. Article 4. In the good or east monsoon one has at night and in the morning a land wind and east land wind, and in the afternoon the sea wind from the west, namely under the shore.
