1139. to receive an invoice, cannot be proceeded with. Eighthly, that the provision of the payment of the rent for the building that currently serves as a hospital for the regiment is provisionally granted to the aforementioned Colonel, until subsequently, upon the departure of the regiment, the placement of its sick into the Company's hospital can take place, in order to attend to and cure them there according to the letter of the capitulation, at the expense of their wages. Ninthly, that, concerning the depot that the aforementioned Colonel wishes to maintain here for the regiment, many difficulties have arisen in that regard, and that one cannot take the depot of the Regiment de Meuron as an example in this matter, because that regiment being garrisoned on Ceylon, the recruits for the same are sent hither with all outward-bound Company ships without distinction as to whether those ships are destined for Batavia or Ceylon, which causes those recruits, who arrive here successively and thus increase to a considerable strength, sometimes to linger at this place for a long time before an opportunity can be found to forward them to Ceylon, in which case the recruits sent out for the Regiment of Wurtemberg will not find themselves, since there is almost always an opportunity to send them on to Batavia; that also in this regard, the reason given by the aforementioned Colonel cannot be taken into consideration, namely that, in view of the warm climate on the island of Java, it would be better for the recruits to be trained here in this country, since the High and Mighty Lords and Masters, holding the view that it is preferable for military personnel destined for the Indies to become accustomed directly to that climate and be trained there, have given orders to this government to abolish entirely here even the national depot, as not answering the intended purpose, and to send it to the Indies; that, however, this government does wish to concede the necessity of making some arrangements for the care of the men remaining here due to illness, and that a sort of depot be established for that purpose, but that the determination concerning the footing of that depot shall be respectfully deferred to the decision of the High Indian Government, where the said Colonel ought to make the necessary representations to that end; it being meanwhile left to the aforementioned 1131. Further being read a note submitted by Colonel von Hügel, commanding the Regiment of Wurtemberg, regarding damaged tents which were sent back by the detachment from the aforementioned regiment that departed with the Orange Battalion to Makassar, with a statement of how much linen will be needed for their repair, it was judged best, in consideration that these tents, being repaired here, might wear out again on the voyage to Batavia, to order the aforementioned Colonel to take the same tents back to Batavia as they are, and to make a request there to the High Government for their necessary repair and the provisions for it. Consequently, the undersigned had ordered the Treasurer of the Regiment to draw up his payroll on this footing, and to request from the Treasury of the Noble Company half of the advance and half of the sum of the settlement in hard cash according to the following calculation. - Major Stakman's Company has due for the settlement . . . . . Rds 9021.— The Treasury of the Regiment was therefore obliged to pay this total sum half in hard cash with 4510 Rixd: and when the Treasurer claimed from the Company's Treasury the restitution of this sum, he received only that of 2470 Rixd. which is only half of the advance. The Treasury of the Regiment was in the position of having to borrow the rest of the sum from private individuals in order to be able to satisfy the soldier. It is henceforth in the impossibility of supplying it and the soldier cannot be satisfied with less than half of his settlement and his advance in ready cash. This is why the undersigned takes the liberty of entreating His Excellency, as well as the Noble Regency, to give the most precise orders to the Treasury of the Company, so that by virtue of his request made in the urgent and important circumstances of the service of the Noble Company, it receives the payroll of the Treasurer of the Regiment on the following footing: 1st Calculation of the advance, of which half paid in hard cash 2nd Such Company has due for its settlement in the Treasury of the Regiment, such sum in the Company's Treasury will convert half into hard cash and will receive the amount in paper money: His Excellency as well as the Noble Regency will deign at the same time to order the restitution of the hard cash which against paper money amounting to 2041 Rixdalers that the Treasury of the Regiment has overpaid to the two embarked Companies, and which it must reimburse to those who got it out of trouble. The undersigned adds to these representations, dictated by necessity and by his zeal for the good of the service and tranquility in the regiment, that in the month of February, the Cashier made the entire payment of the pay amounting to nearly 15000 Rixds. without a sol of hard cash, and mostly in large cardboard notes, which naturally leads, in a distribution to 1900 persons, to the greatest disorders and the most fatal troubles. The undersigned therefore reiterates this request that he had already made several times, that His Excellency as well as the Noble Regency give orders to make the ordinary payments one third in hard cash and to add a proportionate quantity of small cardboard notes. The duty of the undersigned requires at the same time to represent respectfully that with all the difficulties found with respect to the necessary quantity of hard cash, the embarkations of the respective Companies must be delayed, while it is nevertheless important for the prompt execution of the orders of Our Lords and Masters that they be carried out without delay. The undersigned, fearing nothing more than suspicions on the part of His Excellency the Governor and the Noble Regency regarding the intention to accelerate the departure, is obliged to add to this representation the detail of the reasons which, in the event that one refused to give more ready cash, would necessarily delay the embarkation. One cannot, as an essential precaution, give money to the soldiers until one day before their embarkation, to avoid scenes of drunkenness and disorders, which might disturb the peace of the Colony. At the same time, with only 4 Rixdalers, which is half of their advance, in hard cash, the soldier cannot provide for his needs. There would remain to them 16 Rixds. in paper, either from their settlement or from their advances, which they would find impossible to convert into coin without violence and advance, and would find themselves forced either to spend in debauches of wine or other excesses down to the last sol of what they receive, or to take their paper money on board. As the soldier insists on not leaving his settlement for the year 1790 in the Treasury of the Regiment but having it in hand, assignments for Batavia would become impracticable in this regard, and can only be received with respectful gratitude for the sums that will remain after the settlement of 1790 is paid to the entire Regiment in its Treasury. Thursday the 10th of March 1791. Extract Resolution, taken in the Council of Policy, in the Castle of Good Hope. Having received and read a Memorial presented to the Council by Colonel Von Hugel, as Commanding Chief of the Regiment of Wurtemberg, and consequently in the name and on behalf of this Corps, this memorial was found to be of the following content: Having deliberated upon this with all possible attention, this Council has not been able nor allowed to conceal its surprise that in the Memorial exhibited at this Table by Colonel von Hugel on the 15th of February last, not a word is mentioned of the final settlement which is the subject of this latest Memorial, but only of the advance to be made to the Officers, Non-commissioned Officers, and Privates of the Regiment upon departure from here; that also, after the aforementioned Memorial of the 15th of February had been resolved upon, and an Extract thereof had immediately been sent to Colonel von Hugel, he, in a further Memorial submitted on the 22nd of February following, still did not speak of this final settlement, nor make known to the Council his surprise that no decision had been taken upon it, nor in either of the aforementioned two Memorials of the 15th and 22nd of February was a single word mentioned that, as this latest Memorial conveys, the Governor would have agreed to the absolute necessity of making that payment of the final settlement half in cash. That furthermore, as the Cashier de Wet declares, when on the 5th of this current month of March the silver money stipulated pursuant to the aforementioned Resolution of the 15th of February for the half-satisfaction of the aforementioned advances was collected by the Regimental Quartermaster—while in the meantime the two Companies mentioned in this latest Memorial had already embarked on the 28th of February prior thereto—at that time nothing was said by the very same Quartermaster about the final settlement either, much less about the calculation which in this latest Memorial is said to have been drawn up by the Regimental Quartermaster. And as regards that which is further asserted in that same Memorial, that in the past month of February nothing was provided to the Regiment in silver money, but everything in paper currency, and indeed mostly in large paper notes, concerning that the abovementioned Cashier De Wet declares that in the month of January a sum of 3000 Ryxd:s: in cash specie, and specifically in double Stuijvers, was paid to the Regiment from the Company's Treasury, on condition, as the aforementioned Colonel Von Hugel had agreed with the Governor and the Secunde, that the Regiment would also be satisfied therewith for the future; just as the Quartermaster had also testified to him, De Wet, that he was completely content with this; that furthermore, with respect to the large notes of Paper Money about which complaint is made in this latest Memorial, he, De Wet, assured that he had provided as many small notes of money as were in the Treasury, although at that time he was very poorly supplied with that small paper currency. Moreover, the Council is exceedingly surprised at the conduct of this Corps, because this latest Memorial now appears again after the aforementioned two Companies have departed, and after Colonel von Hugel had orally declared to the Council on the 22nd of February last that if the Soldiers were paid the 13 Cape guilders per Month, the Regiment would then march without tergiversation. Upon which declaration of the aforementioned Colonel this Council had also reasonably thought it could expect that the Regiment of Wurtemberg would march quietly and peacefully following the example of all other Regiments, such as of Pondichery, Luxemburg, Meuron, which have all been in the same situation of having to depart with their pay in paper money. However, since this Government is now once again being threatened, as it were, with restless movements and delay in the departure of and by the Regiment of Wurtemberg, since indeed the apprehended fear thereof is asserted in that Memorial, and it is thus placed in the necessity of providing silver money, to which, outside of such pressing and urgent circumstances of affairs that would risk the entire Colony to a most imminent danger, it would by no means consider itself authorized; And it is therefore, in view of this new alarming prospect, approved to allow Colonel von Hugel to bring that amount which remains in the Regimental Treasury from the final settlement of the Soldiers, for one half, into the Company's Treasury, in order to be exchanged there for the same amount in silver money, provided that the aforementioned Colonel, in addition to what is said in this latest submitted Memorial, declares on his word of honor that this amount is the pure and actual half of the final settlement that the Soldiers have due to them from the Regiment; That furthermore, with respect to the provision of one-third silver money in the ordinary payments to the Regiment, notwithstanding that small paper money has already been minted for the payment of the troops, one will, upon this urgent insistence of the said Corps, concede thereto as far as that will be possible, and indeed for the last time, in the firm confidence

It had the kindness to send this note to the Government of Ceylon, which, by the letter of which the undersigned joins a copy to the present Memoir, assures him itself that everything would be completely fulfilled. In consequence of this letter, the undersigned having received only the first part, he still has left to receive 106 pieces of linen for officers, 50 pieces of linen for non-commissioned officers, 410 pieces of linen for the soldiers, and 20 pieces of coarse 4-thread linen for waistcoats, breeches, and gaiters for the soldiers. Which he takes the liberty to claim by the present Memoir; the departure of the Regiment cannot alter anything in this regard; on the contrary, the undersigned is under the necessity of taking more measures, both so that the troop here is provided for, and so that the whole Regiment lacks nothing en route and upon its arrival; which necessitated the sending of many items with each vessel. To: His Excellency the Governor and the Noble Councilors of the Regency of the Cape of Good Hope. Furthermore, the undersigned not leaving the service of the Company, it is very just that he should not be deprived in this epoch, which already causes him so many losses, of the legal assistance which the Capitulation assures him to relieve him of the painful burden of the administration. The undersigned would not have taken the liberty of troubling His Excellency the Governor as well as the Noble Regency with his representations, if Mr. Rhenius, Chief of the Administrations, had not found this step necessary, so that His Excellency and the Regency may give orders so that the rest of the items destined by the Government of Ceylon and dispatched for the Regiment, specified above, which have just arrived with the second division of the vessels, may be incontestably delivered to him. A letter having been written under yesterday's date by Colonel van Hugel, commanding the Regiment of Wurtemberg, to the Governor, with an urgent request that disposition might be made upon a Memoir presented by him to this Council on the 20th of this month, tending to release from the warehouses the linens which were sent hither by the Ceylon Government for the benefit of his Regiment with the latest return ships, all of which reads as follows. Whereupon it was decided by the majority to have the linens specified in that Memoir issued to Colonel van Hugel for the benefit of his Regiment, on the footing determined by the Capitulation, with the exception of the 20 pieces of coarse 4-thread linen, which were not received here. However, regarding this, Mr. de Wet declared himself to be of the opinion that, since provisions of linens had been made to the Regiment of Wurtemberg prior to the arrival of those which the Colonel now claims, one ought therefore to deduct the linens already received by him from the quantity now demanded; and Mr. van Reede van Oudtshoorn stated that since a general petition of all necessities for his Regiment had been made by the aforesaid Colonel van Hugel and the linen demanded thereby was furnished to him, which certainly must have been sufficient for the needs of the aforesaid corps, His Honor could therefore in no way give his consent to the issuance of the linens now demanded. While in the meantime it has been decided to place an Extract of this part of Their Right Honorable Excellencies' Dispatch into the hands of Colonel and Director of Fortifications Gilquin, in order to provide this Council with the elucidations requested therein and also with his considerations and advice as to whether and to what extent it is possible and feasible here, according to the domestic organization of this Government, to execute literally the honored orders of Their Right Honorable Excellencies to carry out no further repairs here henceforth except by permission of the Council of Policy, which permission shall have to be granted in such manner as Their Right Honorable Excellencies further please to prescribe therein, whereupon, in accordance with the forthcoming advice of the aforementioned Mr. Gilquin, one will immediately comply with these orders if no obstacles detrimental to the Company present themselves in the execution thereof, which, in such case, one will take the liberty to represent in all submissiveness to Their Right Honorable Excellencies. Governor and Honorable Respected Council of Policy. — To the Right Honorable and Severe Lord La. B. 1st. That the aforementioned very venerated Letters are not addressed to the Right Honorable and Severe Lord Governor separately, but to His Right Honorable and Severe Honor together with the Council; and that therefore the response should contain not only what the Council judges ought to be brought very reverently to the attention of the Most High Gentlemen Majores on its behalf, but also what serves in that respect on the part of His Right Honorable and Severe Honor. 2nd. That in consideration of the present very grave circumstances of the Company and the necessity upon which the High Commanding Gentlemen Majores insist for the reduction of the expenses of this Government, there should be considered maturely and with all conceivable care everything that will appear—both from the orders which might have been given specifically to the Right Honorable and Severe Lord Governor for the construction of the fortifications and buildings, and from the successive previous communications of the aforementioned Gentlemen Majores as well as of the High Indian Government, and especially the stipulations which the Most Noble Gentlemen 17th made in their communications regarding the Military Commission for India concerning the costs that may be expended on the Fortifications and other Buildings, and the documents left here regarding this by the Gentlemen of that same military Commission—to correspond as closely as possible with their highest intention and objective and must be undertaken in conformity therewith. 3rd. That in everything that has been undertaken and is still being continued up to now with regard to the fortifications and other Buildings, apart from the New Hospital, the Council has had not the slightest knowledge nor granted any consent; but that the same has occurred and still proceeds solely by the order and discretion of the aforementioned Lord Governor alone. 4th. 3 344 than that it is no less true that, were the Members of the Council to be held accountable by their Lords Masters regarding the undertaking and execution of the projected improvements and alterations in the fortifications and buildings, they should then also, in order to truly be able to answer for them, deliberate and decide beforehand how that which has been projected ought to be executed, whether in whole or in part, in accordance with the order and intention of the Lords Masters. 5th That also with relation to the construction of the new Hospital, since the craftsmen and other workers projected for that work have been employed in the construction and improvement of the fortifications, and still continue therein, which has been one of the principal reasons through which one saw oneself placed under the necessity of contracting out the construction of a part of that establishment to private parties, having been compelled thereto, on the one hand, to meet the shortage of shelter both for the sick and for the troops on hand, and on the other hand, by demonstration of the often-mentioned Lord Governor, because, in view of the condition of the fortifications at that time and the urgent necessity to remedy and rectify the defects therein, the aforementioned craftsmen and workers could not yet be removed from the fortifications and put to work on the completion of the Hospital, the undersigned fully trusts that the frequently mentioned Lord Governor will have sufficient reasons at hand to account to the highest-mentioned Lords Masters regarding the employment of the aforementioned craftsmen and workers, who had been projected for the construction of the Hospital, on the fortifications, which at the same time forms the basis for the joint accountability of the Council regarding the partial contracting out of the construction of the Hospital to private parties. Governor had already previously, and repeatedly in Council, made proposals for the reduction of expenses and the increase of revenues, if possible, and that various resolutions had also been taken on this matter, whereby it was also principally resolved to place the point concerning the labor on the fortifications further into the hands of Director Gilquin, so that he might submit his considerations as to whether and in what manner that which had been determined must immediately be done to the fortifications could be carried out with greater economy; that it had also already been resolved to suspend provisionally the contracting out of the missing wing of the New Hospital, and the missing powder magazines, likewise determined according to the precis left to us by Gentlemen Vaillant, Verhuel, and Greevenstein, in order to avoid expenditure, however necessary it might otherwise be, and to await further orders from their Right Honorable Worships thereon; and that while no other buildings are being constructed, that point from the protest or advice of Mr. de Wet is thereby utterly superfluous, and lapses of itself; that with respect to the construction of the further required powder magazines here, he, the Governor, upon closer inspection, now finds himself obliged to bring to the knowledge of the Council that at present there is already no more room to store the gunpowder that will be further brought in for this Government, so that this will have to be provided for by this Council in one way or another; yet that with regard to halting the work on the fortifications currently in progress, he, the undersigned Governor, considers that he would make himself unworthy of the trust with which their Right Honorable Worships have honored him by placing the chief administration of this Government into his hands, if he, under such an extremely critical circumstance, according to the news we have here from Europe, and especially after the news of those circumstances communicated to him by the appointed Governor of Madras, Mr. Charles Oakeley, who left England on 16 June last and landed here on 25 August, could bring himself to yield to the insistence of Mr. de Wet, for what reason and on what grounds Heaven knows, in this matter; Wherefore he, the Governor, ex officio and as a faithful servant of the State and of their Right Honorable Worships, considers himself obliged, for the aforementioned reasons, especially at this juncture, not to bring to any deliberation whether the present labor for the improvement of the fortifications, pursuant to the aforementioned precis or plan of the aforesaid Gentlemen Military Commissioners, shall or shall not be continued, but to decline the surprising proposal of Mr. de Wet in this matter, and to keep it outside the deliberation of the Council. Appeared before me, Johannes Daniel Karnspek, sworn Clerk at the Secretariat of Justice of the Castle of Good Hope, present the hereinafter named witnesses, the Master Mason of the Honourable Company, Anthonij Schoonhuijzen, of competent age, who, at the requisition of the Honourable Secunde and Chief Administrator of this Government, Johannes Izaac Rhenius, declared to be true: That the appearer on a certain day in the year 1786, without being able to give a more precise determination of time, was ordered by the Right Honourable Governor in loco, Cornelis Jacob van de Graaff, to have one hundred pieces of new wheelbarrows made by private individuals for the service of the Honourable Company, wherefore the appearer, in order to comply with that order, had contracted the same out to the burghers Coenraad Luit and Willem Davel, having been unable to negotiate for the price of those wheelbarrows, as they were of a different model than the ordinary sort, less than 12 rijksdaalders apiece for the Honourable Company. That No 37. That although it is true that in the year 1782 some wheelbarrows were manufactured by the burgher Willem van Eijk at 28 schellingen each, this sum was paid only for the wagonmaker's wages, whereas in the aforesaid year 1786, as no suitable wood and iron were at hand, the contractors of the wheelbarrows ordered at that time had to furnish all the materials required for that purpose. That subsequently the said one hundred wheelbarrows were received for the work on the fortifications by Captain Engineer Pieter Wijtings Schub, with orders to distribute them to the places where they were most required, all of which the said Captain Schub testified to in the presence of the Honourable Requiring Party and the Honourable Willem Ferdinand van Reede van Outshoorn, and as was also done in accordance with the order received. That the amount for the one hundred new wheelbarrows, to the sum of twelve hundred rijksdaalders, as appears from the annexed copy of the warrant, having been received from the Honourable Company's treasury both by the appearer and by the clerk of the fortifications, Jan Stuwe, was thereafter paid out by the appearer, as further appears from the annexed receipts, in the following manner, namely: To the burgher Coenraat Luit, for making and ironing, and thus both smith's and wagonmaker's work, as well as the iron and wood required for 50 pieces of new wheelbarrows: 600 rijksdaalders. For ironing 50 pieces of new wheelbarrows of which the wagonmaker's work was made by Willem Davel: 250 rijksdaalders. To the burgher Willem Davel, in the warrant, as appears from the declaration attached hereto, mistakenly called Jan Davel, for wagonmaker's work of 50 pieces of wheelbarrows and the wood supplied for them: 350 rijksdaalders. Total: 1200 rijksdaalders. Declaring nothing more, the appearer gives as reasons for his knowledge as stated in the text, being prepared, if required, to further confirm the foregoing by solemn oath. Appeared before me, Johannes Daniel Karnspek, sworn clerk at the Secretariat of Justice of the Castle of Good Hope, present the after-named witnesses: Captain Lieutenant in the National Artillery and Commissary of the Storehouses Hendrik Willem Rutz, of competent age, who, at the requisition of the Second and Head Administrator of this government, the Honorable and Venerable Johannes Isaac Rhenius, declared it to be true: That the appearer, having been ordered by the Right Honorable Governor van de Graaff to inquire among private blacksmiths which of them would be willing to mount ten 8-pounder gun carriages with iron for the Honorable Company at the lowest price, after having addressed himself to that end to all blacksmiths in this settlement, finally found five who were prepared to perform this work for two hundred rixdollars apiece; provided that for each carriage there would be delivered to them eight hundred twenty-five pounds of iron and one hoed of smithing coal. That a written contract having been formed of this by the same five blacksmiths—annexed hereto in copy—such was approved by the Right Honorable Governor, whereupon the appearer entered into that agreement with the aforesaid blacksmiths on account of the Honorable Company, just as the appearer then also, having received the amount for the aforesaid ten gun carriages in the sum of two thousand rixdollars upon written warrant of the Right Honorable Governor—annexed hereto in copy—properly paid the same to the aforesaid five blacksmiths, as appears from copies of receipts. Declaring nothing more, the appearer gives as reasons for his knowledge as in the text, being prepared to further confirm the foregoing—if required—with a solemn oath. Three identical copies hereof have been granted. Thus done at the aforementioned Secretariat, present the clerks Christiaan Ludolph Neethling and Johan Gottfried Ruperti as witnesses, who have properly signed the original minute of this along with the appearer and me, the named clerk. The undersigned citizens and residents here, practicing the blacksmith trade, accept and bind themselves hereby to mount with iron, for the service of the Honorable Company, such quantity of gun carriages as it might need to carry or bear an 8-pounder cannon piece, provided that for the account of the Honorable Company there be furnished to them the quantity of eight hundred twenty-five pounds of good unworked iron and one hoed of smithing coal for each carriage, and for wages there shall moreover be paid to them in cash without any deduction two hundred rixdollars Indian valuation per carriage piece upon the delivery thereof. 1174. Right Honourable Gentlemen! Eighty-four days after the closing of our mentioned letters, having been prevented from fulfilling Your Right Honourable desires for the reasons stated in the margin, the Governor van de Graaff could finally see fit to bring the remaining points to deliberation on 10 May. On 10 May, the Governor van de Graaff was finally able to see fit to have the Council of Policy convened, and in the same, as well as in the subsequent meeting held on 13 May, to bring the points of Your Right Honourable aforesaid dispatch, which until that time had remained unresolved, to the deliberation of the council, and to assign the reports demanded therein mostly to the respective members of the council. Paragraph 5. It would therefore be our duty, in pursuance of our established plan, with all possible speed, as far as was in our power, in accordance with the honoured desire of Your Right Honourable, to render an ample and detailed report of those resolutions taken in both those meetings, with regard to the execution of the orders which Most the Same have been pleased to prescribe to us for the strictest observance, and at the same time to supply such information and elucidations as were demanded of us in the remaining points then resumed. Paragraph 6. But, since both those resolutions, of which we take the liberty to offer extracts to Your Right Honourable, for the most part contain nothing other than the assignment of commissions to the members of the Council, and the demanding of their advice, considerations, and reports, to serve in answering that part of Your Right Honourable venerated letters of 2 October 1790 which until now could not be answered by us, and that the undersigned, on account of the manifold occupations which they have had without interruption since those meetings until now, have been impossibly able to serve the council with the result of their commissions, and to submit their considerations, advice, and reports to the same; thus we have believed, under Most the Same's favorable interpretation, that it will not be taken amiss by Your Right Honourable that we postpone the answering of the remaining points until all the documents that must serve thereto are properly brought to the table of the Council, of which the principal documents have already been prepared, and the orders which we can execute shall have been dutifully put into execution. We hope all the more that Your Right Honourable will be most graciously pleased with this, because we can assure Your Right Honourable that some of those documents have already served at the meeting, and the remainder are in readiness to serve at the first meeting, and thus the aforesaid respectful answering will dutifully follow at the very first shipping opportunity. Meanwhile, we shall let this serve respectfully to render to Your Right Honourable a true account of the conduct, serving this as a true account of the conduct observed both by Governor Cornelis Jacob van de Graaff and by the Independent Fiscal Johan Nicolaas Steven van Lynden, since the date of our latest humble letters in this Government, the undersigned cellarmaster having been accused by the said Fiscal of having committed malversations in his office. Paragraph 9. In order to arrive at that report in an orderly manner, we find ourselves obliged to bring to the knowledge of Your Right Honourable that the Independent Fiscal van Lynden, unexpectedly, shortly after the receipt of Your Right Honourable venerated letters of 2 October last, caused the undersigned cellarmaster to be summoned before the Council of Justice of this Government, in the case of malversations committed in his office; that the undersigned cellarmaster, having appeared before the Council of Justice, requested and obtained from the same an extension of time, in order properly to serve with an answer to the claim made by the Fiscal; Paragraph 10. the outcome of which will be dutifully brought before the eyes of Your Right Honourable Noblenesses. to mortify the undersigned cellar master, and, if possible, to injure the good reputation which he, through his faithfulness and zeal in the service, and in helping to govern this Government, has managed to acquire both with Your Right Honourable Noblenesses and with the entire public. Aware that malice can never triumph so far, in a land where laws and judges exist, as to crush innocence and dishonour families, he has therefore calmly relied upon his judges, whose decision in this matter he will also not fail to bring before the eyes of Your Right Honourable Noblenesses, when he dares to flatter himself that Your Right Honourable Noblenesses will be pleased to acknowledge, along with him, that malice has been the sole motive that prompted the fiscal to take this step. Paragraph 12. Although deeply affected by this course of action, both as a father of a large family and as a Regent of the Country in which this happened to him, he believed he had nothing further to fear from the Lord Governor, nor from the Independent Fiscal, and that he could give himself up fearlessly to the performance of the duties attached to the offices he has the honour to hold. Yet he soon had to experience that the action brought against him had the principal aim of preventing him from performing his precious duties and hindering him from attending a meeting at which he has had the honour to assist for more than 21 years, and, as he trusts, to the satisfaction of Your Right Honourable Noblenesses and the former Governors of this Colony. Paragraph 13. It was thus on 9 May, at the same time when the messenger was announcing the meeting to the respective Members of the Council for the following morning on behalf of the Lord Governor, that the undersigned cellar master saw coming to his house the deputy secretary of Policy, Carel Mappa, who came on behalf of the Lord Governor to announce to him: Paragraph 14. That the Governor would not summon him, the cellar master, to the ordinary meeting of the Council of Policy which was to be held the next day, on account of the circumstances in which he, the cellar master, personally found himself at that time, but that the Governor would make a proposal about this in the aforementioned Council, in order to take the opinions of the respective members upon it. Paragraph 15. After receiving this message, which was as singular as it was improper, the undersigned cellar master deemed it necessary to give notice thereof both to the undersigned Secunde and to the other members of the Council, which having been brought to their knowledge, the undersigned Secunde and the other members of the Council were exhorted not to enter into any consultations whatsoever with the Lord Governor, since his arbitrary exclusion from the meeting rendered it unconstitutional; and should they unexpectedly have proceeded to do so, to protest against it in the most solemn manner. Paragraph 16. This, Right Honourable Noble Lords, the said undersigned carried out that very same day in a writing, an authentic copy of which we respectfully accompany herewith, which was sent by him to the undersigned Secunde, who sent it for perusal to the undersigned Dispenser, and took it with him to the meeting the following day, 10 May. Paragraph 17. Having appeared at the meeting, the aforementioned writing of the undersigned cellar master was presented to the Lord Governor by the undersigned Secunde, with an urgent request that the same might be read out. Yet, although the undersigned Cashier and Dispenser added their requests to that of the Secunde, this was nevertheless refused by the Lord Governor for the said reasons, as he wished, before the reading of the prayer, to make known the motives that had moved His Honour not to have the cellar master summoned to the meeting, and when the prayer had been read, and thus the meeting had legally begun, to submit to the deliberation of the Council whether, in view of those reasons, the cellar master should continue to be admitted to the meeting as before, or not. Paragraph 18. Whereupon the undersigned Secunde, Cashier, and Dispenser were of the opinion that if a point of deliberation were made of this matter only after the reading of the prayer, an act of exclusion would have already been committed, and that the Lord Governor (who, along with the Independent Fiscal, maintained that no point of deliberation could be legal before the meeting had properly begun) could very well make this notification before the reading of the prayer, as it could be regarded as equally legal, in order to know from it whether, notwithstanding this exclusion or prevention, the meeting could be commenced; since they furthermore believed that no meeting could

Paragraph 20 To which reasons the Governor added that the cellar master had been summoned by the Independent Fiscal before the Council of Justice of this Government to hear demands for double compensation, dismissal from office, and a declaration of incapacity ever to serve Your Right Honourable Excellencies in any capacity; but that thereupon, to his great surprise, the cellar master, instead of answering for himself with all possible dispatch, had on the contrary requested a very extraordinary delay from the Council of Justice. These motives having been communicated, the undersigned secunde was of the opinion that the cellar master could and had to be admitted, and he could find no objection thereto. Paragraph 22 The Independent Fiscal, because he believed he might perhaps be regarded as a party in this matter, and the Cashier, on account of his brotherhood-in-law with the cellar master, having requested to be excused from casting their votes in this regard; the undersigned Dispenser declared that he had no legal knowledge of the action instituted by the Independent Fiscal against the cellar master, and that, even if he had legal knowledge thereof, he nevertheless believed that the cellar master could be admitted to the meeting, since this exclusion could be regarded as nothing other than an actual suspension, and no servant of the Honourable Company, much less a member of the Council, may be suspended as long as he is sub reatu; and that this opinion of his was based on the orders prescribed for observance by Your Right Honourable Excellencies on 15 July 1712, when contrary actions were taken concerning the skipper de Koning. And the majority having opined for the admission of the undersigned cellar master, the Governor made the attached declaration. Paragraph 26. We are not the only ones who have had to taste the bitter fruits of the boundless and unlimited arbitrariness of the Lord Governor van de Graaff; no, High Commanding Lords! aforesaid reasons, thought it necessary to have their protests recorded, and to continue with the protest submitted on 5 May by the undersigned Cashier, against which the Governor made a declaration; whereupon the undersigned Cellar Master, Cashier, and Dispenser, becoming more and more convinced by this that the Governor in this matter as well had no intention of following the positive orders prescribed by his High Authorities, and would not have allowed himself to be persuaded either by persuasions or by anything we might have undertaken to obey dutifully and quietly; so again nothing was left for us but to have protests recorded against this course of action, and to conform once more to the written protest already made by the Cashier de Wet on 5 May, and which the Governor saw fit to have read upon the adjournment of the meeting, and to make a declaration against it; of which we take the liberty to offer Your Excellencies an authentic copy. Paragraph 35. This declaration of the Governor consisting principally in an imputation against the Cashier de Wet, of possessing shameful vices of which he should be ashamed, and of which he has never shown evidence, he thought he could not refrain from requesting a copy of that declaration in order to be able to defend himself against these accusations; but even this was refused him by the Governor, under the pretext that his Honour had not made this declaration to serve for his Honour's accountability, and thus did not deem it necessary to provide a copy thereof, refusing the same on his own authority without asking the opinion of the Council on the matter. Paragraph 36. The protests reserved by the members of the Council, having been prepared by them and brought to the meeting of 13 May, we take the liberty of offering the same to Your Excellencies in authentic copy; and we believe we may hope from Your Excellencies' so often demonstrated equity that when you shall be pleased to inspect the contents thereof, you will not only hold yourselves convinced that our zeal for the service and our due obedience prompted us to make these protests, but will also fully exonerate us from the vile imputations attributed to us more than once without cause by the Governor; especially so hopes the undersigned Cashier, who has taken the liberty to refute in his aforementioned protest the declaration made by the Governor to his detriment. Paragraph 37. It was finally our lot at the meeting of 24 May to obtain a glimmer of hope of seeing these continual discrepancies end once and for all, as the Governor informed us that his Honour intended to depart for the Netherlands with the ship Beverwijk, but that on the same ship there were several passengers who were inconvenient to his Honour, both as to the required space and many other points; his Honour requested us that the said passengers might, by a resolution of the Political Council, be ordered to leave the ship Beverwijk and transfer to the ship St. Laurens to proceed on their journey to the Netherlands. Paragraph 38. The pleasure we felt at hearing that the Governor finally wished to respect the orders of his High Authorities regarding his crossing, and the certain conviction that we, by not consenting to that proposal, would have caused more harm than good, are the reasons why we readily condescended to transfer the passengers from the ship Beverwijk to the St. Laurens. Paragraph 39. But as there was on the ship Beverwijk as passenger Benedict Hartwich Godlieb Baron van Diemar, former Resident of Boelicomba and Bonthain, placed thereon with his family by the High Indian Government, and as he believed that he could not be compelled by us to leave the ship Beverwijk, he submitted to our meeting of 10 June a petition which, pursuant to his request, we take the liberty of offering to Your Excellencies in authentic copy by this first opportunity. The ship Beverwijk having been mustered on the 21st of June, the Governor van de Graaff nevertheless saw fit not to convene the meeting earlier than on the 24th of that month, at which the undersigned Cashier and Dispenser, because they were bedridden, could not be present; and caused to assist therein the assistant secretary Mappa, who had already been dismissed at the meeting of the 10th of that month; notwithstanding the protests made by the undersigned Secunde and Cellarmaster against a conduct so directly contrary to all good order, and which also resulted in the aforementioned Mappa repatriating with the ship Beverwijk, without drafting the resolution of that meeting, only leaving behind the minutes kept by him, and from which it appears that the Governor demanded of the members of the Council their reports on Your Right Honourable Worships' esteemed missive of the 2nd of October last. Paragraph 42 Then, since the undersigned Secunde and Cellarmaster, together with the undersigned Cashier and Dispenser, in accordance with the order contained in that same venerated letter, had submitted their humble reports directly to Your Right Honourable Worships under date of the 9th of May last, and believed they owed no delivery or inspection thereof to the Governor; they therefore declared that they would deliver the minutes of those reports sealed to the Political Secretariat, against which the Governor protested, saying that this was contrary to orders, as these reports had to be delivered to the Governor in order to be laid by him on the table of the Council; 1200 protesting further against sending those reports among the ministerial papers, and further requested how the aforementioned papers should be handled in the future. Paragraph 43 Subsequently, the Governor further requested that when the reports demanded of the members of the Council to serve as the elucidation required by Your Right Honourable Worships should have come in, the same, together with the resolutions to be taken by this Council in the future, should be sent to His Honour, or else to the Advocate of Your Right Honourable Worships' illustrious assembly; to which, although the Independent Fiscal van Lijnden believed that this should be handled according to the Governor's wish, the undersigned Secunde and Cellarmaster refused to consent, as being contrary to the orders established by Your Right Honourable Worships, wherein it is commanded that all ministerial papers must be addressed directly to Your illustrious assembly. 1201 The Governor, caring little it seemed for these orders in this matter, held the members of the Council who refused to comply with his unlawful desire responsible for the harm done thereby to His Honour and for the consequences that might result therefrom to the prejudice of the Honourable Company, without revealing wherein that prejudice might consist. Paragraph 44. Paragraph 45 In the aforementioned meeting, it was also proposed by the Governor, upon further proposition, that since the undersigned Secunde could not preside in the Council of Justice in His Honour's absence, to appoint as a member of the said Council the merchant Mr. Jacob Pieter de Neijs, and this above the members holding a seat therein in the service of the Honourable Company, both on account of the higher status granted to the said De Neijs by Your Right Honourable Worships, and on account of his moderation, knowledge, and understanding. The undersigned Secunde, on account of his brotherhood-in-law with the said De Neijs, being unable to advise in this matter; 1202 the Independent Fiscal deemed this appointment necessary for the public welfare; and as the undersigned Cellarmaster concurred therewith, the said Mr. Jacob Pieter de Neijs was, according to the Governor's proposition, appointed as oldest member of the Council of Justice, in which capacity we respectfully request Your Right Honourable Worships to be pleased most favourably to confirm him, being able to assure Your Right Honourable Worships jointly that he fully deserves the testimony given of him by the Governor on this occasion. We by no means believe, Right Honourable Sirs, that it could have been the intention of Your Right Honourable Excellencies to make the secunde swear allegiance to him, the Lord Governor, and the undersigned secunde therefore also deemed that he could not, or was not permitted to take that oath, and therefore refused it; whereupon the Lord Governor recommended the secunde, upon the oath taken by him as secunde, to assume the authority, provided he adhered to the orders given by Your Right Honourable Excellencies in the aforementioned esteemed missive. §50 This meeting being hereby finished, the Lord Governor left the same, and wished the members present God's blessing, declaring that he would possibly not see them again; this honour was also not to befall any of the undersigned, and His Honour, on the following Sunday the 26th of June 1205. the departure of the aforementioned lord governor on the date mentioned beside §51 the meeting being convened on the following day in order to administer the oath to the undersigned secunde pursuant to the highest command of the same, and the lord fiscal van Lijnden not having appeared therein, must to Colonel Gordon. 26th of June at five o'clock in the morning, went on board the ship Beverwijk, with which His Honour undertook the journey on the 28th of that month at four o'clock in the afternoon. By this departure, pursuant to the revered orders of Your Right Honourable Excellencies, the authority of this Government having fallen into the hands of the undersigned secunde, he immediately had the Council of Policy convened for the following day; but having proceeded to the council chamber together with the undersigned cellar master, cashier, and dispenser, they were not able to find there the Independent Fiscal, Mr. van Lijnden, nor the Colonel and Commander of the Honourable Company's Militia here, Robbert Jacob Gordon, which last-mentioned has been unable to attend the meeting for a considerable time due to persistent indisposition; but whereas this meeting was quite expressly convoked in order, in compliance with 1206 requested of the last-mentioned by missive to be pleased to assist the meeting, which we take the liberty to submit humbly to Your Right Honourable Excellencies; the same having appeared there, requested that before taking a seat a missive might be read out. Your Right Honourable Excellencies' esteemed orders, to administer the oath to the undersigned Commander; and the Council, excluding him, would have consisted of only three of the fellow members, we therefore gave notice thereof by missive to the aforementioned Colonel Gordon, with an invitation, in view of that weakness of the Council, to come and assist the meeting if his health permitted it in any way. The Commander, having thanked the Members of the Council for these congratulations and declarations, added that he remained convinced of the sincere zeal and loyalty with which each of them was inspired, and of which they have displayed so many resolute proofs when required, both in the observance of their posts and in the administration of this Government, as well as of the unfeigned affection that each of them bore toward him. For which reason he would confidently rely upon seeing harmony, which had for so long been banished from our assembly, reappear within it to dwell there permanently, toward which end he declared before Your Right Honorable Worships that he would make every effort within his power; just as the undersigned, his fellow Councilors, dutifully assure Your Right Honorable Worships that they will grant him 1209. all help and assistance, so that we all may thereby become increasingly worthy of the confidence of Your Right Honorable Worships, and demonstrate to the same through deeds that in all things and everything, we intend nothing other than to serve the interests of the Honorable Company, as well as to maintain authority and preserve tranquility, peace, and harmony in this Colony. Section 54. After these ceremonies, the undersigned Commander made known to the Members of the Council into what confusion, upon his assumption of command, the affairs of this Government were found, both because many of the orders received from Your Right Honorable Worships and the High Indian Government have hitherto been kept unexecuted, and because many letters arriving at this Government have never yet been brought to the deliberation of the Council, 1210. and have thus remained unanswered, as well as the effort that would be required to put everything that has fallen into arrears onto a proper footing. That this would require not only constant activity from us all, but also uninterrupted assiduity in all departments, and most especially at the Secretariat of Police, where even the ordinary work—owing to the preparation of a multitude of voluminous documents for the Lord Governor—has partly fallen into arrears and partly had to be abandoned. For which reason he requested the Council to cooperate with him to bring all the affairs of this Government back onto a proper footing and into proper order, such as they previously were, and concerning which Your Right Honorable Worships have more than once been pleased to express your particular satisfaction. 1211. And we have therefore jointly not only recommended and ordered the Heads of the departments to cooperate in this matter, each in his own sphere with all zeal, but we shall also keep a watchful eye to ensure that the subordinate employees properly observe their duty. Section 56. In order to retrieve the affairs of this Government from the confusion in which they are found, we shall first confine ourselves to executing the orders contained in the very esteemed dispatch of Your Right Honorable Worships dated 2 October 1790; subsequently resume the venerated letters addressed to us by Your Right Honorable Worships on 4 January of this year; and finally, trace with all possible accuracy all the orders and commands whose execution has hitherto remained neglected, in order to put the same into execution; and we shall not fail to render dutiful report of these our proceedings successively, with every shipping opportunity, both to Your Right Honorable Worships and to the High Indian Government. 1212. Section 57.
