954 was, can be regarded as nothing other than a warehouse, and it is well known even to Your Right Noble Rigorous and Honorable Worships that there are no rooms to separate the sick from one another, no apartments or chambers where their bedding and clothes can be fumigated, no warehouses to store the goods of the sick, no dwellings for the servants, and to be brief, may it be permitted us to say with respect that the Regents find themselves destitute of place and room, both to properly accommodate the sufferers themselves and to properly store their goods brought with them. The departure of the Regiment Wurtemberg gives us hope that Your Right Noble Rigorous and Honorable Worships, convinced of the cramped storage place of the sufferers, will have the goodness to have this deficiency provided for, and for the service of the Hospital to have cleared and made available such dwellings and buildings as shall be vacated by the aforementioned Regiment and found useful and serviceable for that purpose; and since by this clearance and occupancy in the present unfinished state of this building the undersigned Regents cannot say they have been put in possession of a good and well-arranged Hospital, but thereby only come to have more room for the lodging of the sick and their goods, they are not in a position to introduce fully the plan of the Right Noble Rigorous Gentlemen Commissioners, but we take the liberty to offer annexed hereto to Your Right Noble Rigorous and Honorable Worships with all submission a draft plan drawn up by us, mainly agreeing with the principal intentions of the more-mentioned Right Noble Rigorous Gentlemen of the Military Commission, in order, with the pleasure of Your Right Noble Rigorous and Honorable Worships, to be provisionally introduced for observance until such time and while the approval of the High-Ruling Gentlemen Majores for the construction of a new Hospital shall have come in, or it shall have been resolved concerning the completion of the currently existing one, and that then the often-cited plan shall have to serve the Regents at that time as a rule and guideline. At the same time, may it be permitted us to present with all respect to Your Right Noble Rigorous and Honorable Worships our reflections on some points of the proposed interior management. The Right Noble Rigorous Gentlemen of the Military Commission desire that a housefather be appointed for this purpose, and that this man be taken from the burgher class; it would be unnecessary and superfluous to depict to Your Right Noble Rigorous and Honorable Worships the condition and way of thinking of the burgher at this corner of the earth, while it is well known that, with a little deliberation in conducting his affairs, he finds an ample and easy livelihood, and thus will by no means subject himself for a small salary to subordination, to which he is otherwise not very inclined. From this it is to be feared that the Regents would find themselves embarrassed to confer this post upon a well-disposed and honor-loving man, and would run the risk of receiving his resignation at the slightest disputes; since he is no longer bound to the Company, and the fixed pension of one guilder per day for ten years of service is not enticing enough to bind him thereby to the Regents, while 30 guilders a month barely amounts to the house rent of one of the smallest and most remote dwellings in this township. to employ someone who, through his bond to the Company, can be compelled by the Regents to perform his duty; under this housefather there would have to be a steward, who would have to be taken from the ships and retained for two years; here too, the undersigned fear that they will not succeed properly, specifically because the stewards have permitted goods with the Company, which they often load even for the Indies, and therefore cannot be taken from the ships without their ruin; and as it is only for two years, it is doubtful whether a respectable man will apply for this post; moreover, it is indisputable that the greatest part of the petty officers who sail with the Company are without education, which causes the undersigned to observe whether it would not be better to advance, in due time, one or another of the lower servants of the Hospital who had given the Regents proof of good conduct. Matrons would have to oversee the housekeeping of the Hospital and mainly keep the books and render written accounts of the linen. By resolution of 10 February 1710, the post of matron was abolished as incompatible for a female person; moreover, not inconsiderable difficulties would also arise for the Regents in the appointment to this post, and they take the liberty of setting down their considerations regarding this here as well. None but the lowest class of women would let themselves be employed for this, and from this it is to be feared that they would serve more to cause disorders and irregularities than to help maintain good order. It would be difficult to find persons who can write and cipher in order to render proper accounting. These persons would need to have a good salary, for the reason that they also find the opportunity—even if only by washing and ironing, which is paid excessively dearly here compared to Europe—to live in a comfortable manner for themselves. According to the frequently cited plan of the Right Honorable Gentlemen of the Military Commission, the goods of the sick who are sent ashore from on board into the Hospital must be properly inventoried, and each of them must bring in at least: 2 shirts, 2 underpants, 2 linen jackets, 2 nightcaps. Art. 6 Regents must meet once every month, and if the President deems that an extraordinary meeting must be called, he shall have the other Regents convened for that purpose in writing. The Bookkeeper of the Company's Hospital shall have to act as secretary at the meeting. Two of the Regents shall have the month, and during the same, go the rounds at least once a week and ask the sick whether they are well treated, are clothed, and receive the necessary attendance, and in whatever appears to them not to be in order, immediately give orders, inspect the kitchens to see if proper cleanliness takes place and the food is well prepared, and report on their findings in the meeting. Art. 2 Regents shall ensure that the first chief surgeon, who is provisionally the house Regent and has the interior management, properly accounts for everything that is under him. Art. 4 Regents must keep a watchful eye that each of the attendants observes his duty. 95 Regents shall every month in their meeting receive the reports of those who are charged with the details of supervision, and have the petitions signed by two members of their meeting. Daily a report must be submitted to the Regents who have the monthly duty, of all incoming, discharged, deceased, and escaped persons, as well as those present. Regents shall have the appointments of all officers and servants of the hospital, but regarding surgery, the first Chief Master must propose suitable subjects to the Regents. If anyone is permitted to lodge outside the hospital with his friends or acquaintances until his complete recovery, the Doctor shall make a written report thereof monthly, and name therein those persons who have this permission by first and last name, as well as by whom this permission was granted. All cradles in the hospital must be numbered, for which the Regents shall have to give the necessary orders, as well as that the chest or knapsack that each patient brings with him is marked with the same number as that on which he lodges. As often as the Chief Master deems that there are recovered patients, the Regents shall hold a discharge muster in the hospital. Every month the bookkeeper shall draw up a report, containing the number of patients who have been in the hospital each day, with specification of how many pounds of meat, alongside how many pieces of white and coarse bread, etc., have been consumed. If anything is lacking on the buildings, the Regents who have the monthly duty must request the necessary workmen from the Noble Lord Governor. Patients arriving from the ships shall, after being cleaned beforehand, be provided with clean linen, and their goods inventoried, and taken into custody until their recovery. No one must be accepted into the hospital unless he brings a note from the officer under whom he is ranked. Regents must keep a watchful eye that the patients receive the necessary clean change of clothes and are properly cared for, and the patients must be provided at least every week with clean sheets, shirts, and caps. On pain of arbitrary punishment, cursing, swearing, blaspheming the Lord's Name, and other scandalous words and deeds are forbidden. The Chief Ward Master or Indoor Father must take care and have the under ward masters see to it that no gambling or any other irregularities are committed in the hospital, much less that strong drinks are brought into the hospital in a direct or indirect manner, giving the sick the opportunity to become intoxicated. On the other hand, if anyone should have any valid complaints against the servants, he may bring the same to the knowledge of the Regents, who must make the necessary provisions therein. And if anyone should come to oppose this and scold the servants or inflict any other insults upon them, the same shall be punished by order of the Doctor or First Ward Master. If any of the hospital servants is found sleeping or absent at the time when he has the night watch with one of the sick, he shall, as a deterrent to others, be corrected for it by a public domestic punishment, according to the circumstances of the case. Careful supervision must primarily be kept over such patients who have delirious fevers or are insane, in order to prevent them from causing harm to themselves or to others, and those through whose negligence any misfortune should happen shall be held accountable for the consequences. By paragraph 34 of the aforementioned very respected letter, Their Right Honorable Excellencies please to order this Council distinctly to provide to them by a separate memorandum all the places and outposts maintained at the Cape and subordinate districts, with a specific indication of their size and situation, and of the men, slaves, and livestock employed for working and supervising the same, together with an accurate calculation of the costs expended thereon, both with respect to the buildings, the wages, and rations of the Company servants stationed there, and the maintenance of the slaves, as well as for the fodder of the livestock; and on the other hand a calculation of the grains and other products harvested on the same places, or of the benefits of the livestock, as otherwise, which can be obtained there for the Company, together with a statement of those posts that could be withdrawn, as well as a conscientious demonstration of the necessity regarding each of the others separately why they should be maintained, and the savings that in that case may take place; and, in order to dutifully fulfill all these points with the most possible accuracy, this investigation shall be assigned to such a committee as shall be expressly appointed thereto by the Lord Governor; and a respectful report of their findings shall be made to Their Right Honorable Excellencies. The undersigned, however, judged it necessary to have this extent surveyed; partly because it is not possible to sell that land in two or more parts as that many farms, given that across that entire extent water is produced by only a single spring, which must serve for watering people and cattle, and if that land were divided into two farms, one of the two would suffer a complete lack of water; and partly also because, if a division of that land took place, the cattle drive and grazing ground for a greater number of farms would be lacking; which cattle drive and grazing ground is indispensable to the arable farms here in this country, as for that purpose a sufficient open space of field is always found between such farms; in addition to which the land, through plowing and sowing, has lost most of its strength, and thus a large extent is required in order to always let a good part thereof rest each time. 987. of pasture should remain strictly necessary to this place, not only because of the barrenness of the field, but also because a single spring is located near the house, whereto the cattle, grazing to the left and to the right side, when they require watering at midday, would repeatedly have to be driven, to great disadvantage; while also, in addition, if this extent of pasture were curtailed and brought into a narrower limitation, whereby the use of the water at the Modder Rivier, the Klavervaly, and Cruywagenskraal would then also lapse, it is unanimously attested that this place, for which otherwise a great eagerness is shown, would then be worth very little. The undersigned can therefore not refrain from noting in this regard that the Modderrivier is indeed one of the places to which the Company's contracted butchers, pursuant to the lease condition, can make a claim for the grazing of their cattle; but that, considering the large number of places surrendered to that butchery pursuant to the aforementioned lease condition, which yielded a considerable space of land for that purpose, and the Modder Rivier itself has always formed a separation between the pasture of the Ganzekraal and Groenekloof, and it appears that with respect to the Modder Rivier no determination has been made as to how far the same ought to be considered a place for the Company's contracted butchers, it would therefore, on this occasion, be extremely serviceable and necessary that, in order to prevent all disputes that could result therefrom in time, such a determination be established. Having made an investigation into this, it appeared to the Commissioners that this determination could very conveniently take place at the location where the river that comes down from the Kranze Valy joins the Modder Rivier, so that from there downwards, the Modderrivier would separate the pasture of the Ganzekraal from that of the Groene Kloof, in order to also be able to water the cattle of the Ganzekraal there; and the opposite side of the Modderrivier from there upwards, together with this side of the same river, up to half of the extremity of the land surveyed for the Ganzekraal, must determine the pasture of the Company's contracted butchers or the place the Modderrivier. While concerning the outdrift to the Klavervaly, which place has served for an additional expanse of pasture for an excessively large number of the Company's horses at the post the Groene Kloof, and on which place the Klavervaly 988. only a small hut and chicken coop of no importance are built, the undersigned have found that if this place were possessed on its own by a private individual, separately from the Ganzekraal, and the pasture there were thus to lapse, no horses, so indispensable for agriculture, could then be kept on the place the Ganzekraal; which is greatly taken into consideration regarding the value of the Ganzekraal and would cause much disadvantage in its sale; and the undersigned therefore believe that in order to prevent this, at the sale of the Ganzekraal, it ought to be conditioned that the aforementioned place the Klavervaly shall be granted on loan, with preference, to the purchaser of this place against the usual annual recognition fee, which promise will always cause the price of the Ganzekraal to be proportioned to the value of those two places together. This being the most advantageous manner in which the undersigned have found that the two posts, the Vissershok and the Ganzekraal, could be sold with respect to the places themselves, they find themselves obliged to add thereto the following considerations; both regarding the manner of payment and the time at which those sales ought to occur, as well as regarding the slaves and the livestock, which could be monetized in a suitable manner on those occasions. Firstly: since in the month of April a start is generally made with agriculture, and thus if the sale took place later, a portion of the time thereof would expire, which is always taken into consideration when buying such places; that sale ought therefore to take place at the beginning of the upcoming month of April. Secondly: the sale of the Vissershok ought to precede that of the Ganzekraal, because with many more speculating on the Vissershok than on the Ganzekraal, whoever does not succeed in his first speculation would still always be able to turn to the Ganzekraal, whereby the number of competitors for that parcel would be preserved. Thirdly: because a great scarcity of money currently prevails, and the High Ruling Lords Masters have considered it contrary to the Company's interests to leave money with the inhabitants on interest, so that, if both the aforementioned parcels were sold according to the customary manner, to be paid in three installments or terms, whereby one presently promises privately to the buyers of real estate that upon the due date

And it will furthermore be stipulated in the conditions of sale that henceforth the place Klavervallei will be granted on loan preferentially to the buyer of Ganzekraal against the usual annual recognition fee. While furthermore the day of the sale of Vissershok is set for the 11th of April, and that of Ganzekraal for the 15th of that month, and these sales will take place under the condition of having to satisfy the purchase price in five equal installments, each one year after the other. As will also be written to the Landdrost of Swellendam to have the draft oxen of Zoetemelksvallei at the River Zonderend and the Buffeljachts River, insofar as they are in good condition and adequately grazed, brought in part to the sale of Vissershok to be turned into money at the same time; while the sale of the remaining portion of the oxen from Zoetemelksvallei and the Buffeljachts River will take place at Ganzekraal, together with the breeding cattle that are there, and conversely the worn-out and weak oxen of Vissershok and Ganzekraal will be sent back to the Buffeljachts River to be able to recover condition there by the time that that post is to be sold, or else until another convenient time, just as of the horses that graze at Groene Kloof, the fittest will be sold in part at Vissershok, and in another part at Ganzekraal, leaving the rest until a convenient time when they will be in better condition. And on the occasion of the sales of Vissershok and Ganzekraal, a good portion of the slave women assigned to Nieuweland and Rondebosch who have no children, and also with their husbands, will likewise be sold there. 1000. True copy Firstly, this sale is held in guilders, Indian valuation, at 20 light stivers each. The buyer of the aforesaid place shall be bound to bring forth and pay his promised purchase money in five equal instalments or terms, namely, the first in cash upon the striking of the bid, the other four instalments, each one year after the other, so that the last or fifth instalment shall fall due on today's date in the year 1795. The buyer of the said place, currently being excused from paying the lord's dues, shall nonetheless, with regard to the said place at all subsequent sales, be and remain subject to the payment of all such dues as are imposed on the sale of all similar real property. Terms and Conditions according to which the Honorable Gentlemen Oloff Godlieb de Wet and William Ferdinand van Reede van Oudtshoorn, being expressly commissioned thereto from the Honorable Council of Policy of this government, on behalf of the Dutch Chartered East India Company, intend to sell, either by Dutch auction or English auction, to the highest bidder, a certain place named het Vissershok, situated in this Cape district, measuring in extent six hundred nineteen morgen and thirty-four square roods, and furthermore bordered and bounded as the small map thereof drawn by the land surveyor shows in detail. 1001 And the buyer shall furthermore, above his promised purchase money, be obliged to pay for the writing of these purchase conditions, letters of transport and mortgage bond, the surveying of the land, and such further expenses as shall fall thereon. If the auctioneer should make a mistake, whether in raising or lowering the bids, in such a way that dispute or contention might arise therefrom, the same, to prevent all disputes, shall be redressed and the error not counted. Should it also happen that, in knocking down the bids, two or more persons happen to call mine at the same time, without it being possible to hear definitively which of them had priority, the said Honorable Gentlemen shall be at liberty to award the purchase to the one whom Their Honors shall judge to be the nearest. Terms and conditions pursuant to which the Honorable Gentlemen Oloff Godlieb de Wet and William Ferdinand van Reede van Oudtshoorn, being expressly commissioned thereto from the Honorable Council of Policy of this Government on behalf of the Dutch Chartered East India Company, intend to sell to the highest bidder, either by auction or Dutch auction, a certain place named De Ganzekraal, situated near the Groenekloof, measuring in its land two hundred seventy-nine morgen and three hundred seventy-five square roods, as well as bounded and demarcated as the small chart thereof drawn up by the surveyor clearly shows. Firstly, this sale is made in guilders Indian valuation at 20 light stivers each. The buyer remains bound to produce and pay his promised purchase money in five equal instalments or terms, to wit: the first in cash at the knockdown, the other four each one year after the other, so that the last or 5th instalment shall fall due on 15 April of the year 1795. The buyer of the said place, presently being excused from the payment of the dues to the lord, shall nevertheless in subsequent sales have the said place remain subject to the payment of all such dues as are imposed on the sale of all similar immovable property. And the buyer shall furthermore, over and above his promised purchase money, have to pay for the writing of these conditions of sale, deeds of transfer and mortgage, the surveying of the land, and such further expenses as shall arise therefrom. The buyer of this place shall also be bound immediately to provide, for his promised purchase money, two sufficient and sufficiently landed sureties in this government to the satisfaction of the said Honorable Gentlemen, which sureties shall have to bind themselves jointly and severally along with the buyer, with express renunciation of the benefits of order, division, and excussion, of whose force and effect the said sureties must keep themselves fully informed.

If the auctioneer, whether in bidding up or knocking down, should happen to make an error, such that disputes or grounds for disagreement might arise from it, the same shall, in order to prevent all disputes, be rectified and the mistaken action shall not be counted. If it should also happen that, in knocking down, two or more persons should happen to claim the bid at the same time, without it being possible to hear distinctly which of them had the precedence, it shall be at the discretion of the aforementioned Honorable Gentlemen to award it to the one whom Their Honors shall judge to be the closest.
