696 and in the presence of the Captain of the aforementioned vessel, Joost Masson, found: the rudder worked apart, the knee at the stem upon which the bowsprit rests split through, the stem and sternpost displaced, the foreyard decayed, the main topsail yard broken across the middle and at the yardarms, and now the maintop rotted in several places, and therefore the rudder will need to be provided with oak fishes and bands, likewise the stem with two oak knees and an iron band around the knee and stem where the bowsprit rests, as well as 2 iron knees against the sternpost; the foreyard and main topsail yard being unserviceable due to the aforementioned defects, the ship needs to be provided with: A new foreyard A ditto main topsail yard, and if the maintop does not also need to be made new, it should be repaired thoroughly, and the ship caulked inside and out. 700. In order dutifully to comply with this Resolution and order to the best of their ability, the undersigned has carefully examined the ordinance for levying the Collateral duty inserted into the aforementioned Placaat; whereby it has appeared to the undersigned, subject to respectful correction, that however much the first 13 paragraphs of the aforementioned ordinance, having a direct bearing upon the Impost of the Collateral itself, could not undergo the slightest alteration, the principal difficulties nevertheless arise in the following articles, as they mainly contain the manner and time in and within which the intended purpose ought to be fulfilled, and consequently this tax will be levied for the Honorable Company in the requisite order. Your Right Honorable Worships have already penetrated these difficulties upon the first reading of the ordinance, and judged them to lie principally in the difference between the state of affairs at Batavia and that establishment, which difference is indeed so great that it requires an entirely different arrangement in this Government, and especially in the outer districts, regarding the levying of the oft-mentioned impost than the High Indian Government has been pleased to prescribe in its ordinance. It is sufficiently well known that the arrangement of the city of Batavia and its environs or dependent possessions, contained within a very short perimeter, very well permit the collection of this impost to take place at the same time and in the same manner as determined in the ordinance, since one can be assured there that, generally speaking, the deceased estates can be brought to complete liquidation within the time of six months, and that the officers, along with aldermen and appraisers, can also betake themselves to the house of mourning within a short time in order to be able to appraise the goods according to the 26th and 27th paragraphs, and further perform such duties as the ordinance on this matter entails. But, Honorable and Worshipful Sirs! It is equally well known how very much the contrary is the case here, and that the aforementioned instructions and arrangements can never, ever be applied to this colony: since the inhabitants whose estates are also subject to the tax on the Collateral live here within the country widely separated from one another, more than 200 hours from the Cape, so much so that even the secretaries of the outer colonies, to whom, according to the same Resolution of the 6th of this month by interpretation of the 22nd paragraph, the collection of this impost in the outer districts has been assigned, will themselves frequently find it impossible to betake themselves, properly assisted, to the houses of mourning of persons whose residences are sometimes situated a whole month's travel from the Drostdyen, in order 701. When one furthermore takes into consideration the 15th, 16th, 23rd, 24th, and 31st paragraphs of the same ordinance, entailing: § 15 "That within the period of three months, calculated from the death of the person whose estate is inherited or acquired and is subject to the Collateral, the goods must be declared by the executors or administrators of the estate under oath to the College of Aldermen, otherwise the Court of Justice here, or the Landdrost and Heemraden in the outer colony, by means of a specific list, and they must at the same time ensure that the valuation of the immovables and effects belonging thereto takes place, on pain of being considered defrauders of the public revenues, etc." § 16 "That they must deliver to the Collector of this duty, within another three months, an authentic act regarding the valuation made of all the goods and effects without distinction upon which the Collateral must be paid, etc., and that they shall at the same time ensure that this duty is paid within the aforementioned three months." § 23 "That the Collector shall render an account to the Receiver General every half year, and thus every six months." § 24 "That the Collectors shall collect this duty within a period of six months, calculated from the day of the death of the testator or testatrix, or when the donations inter vivos shall have taken place." § 31 "That the gravediggers shall weekly submit a pertinent list of those who have died within that time, etc." Then one will immediately discover that none of this can ever be applied in such a manner to this colony, and that it will especially be these articles concerning which such alterations and amplifications must necessarily be devised as the local circumstances of this country and its particular arrangement absolutely require. For just as executors or estate administrators can never be constrained to pay or settle any encumbrance of the estate otherwise than out of the effects of the estate administered by them as such; so likewise, subject to correction, they cannot be placed under the obligation, when no cash is found in the respective inheritances with which the impost on the Collateral can be paid to the Honorable Company, to advance these monies from their private purse; for which reasons a postponement ought always to be granted.

ought to be granted, proportionate to the time which, according to local custom, is required to liquidate the estate by public sale; for which, as will be intimately known to your Honours, a period of nine months is required in the outer districts, namely two to three months during which the holding of the auction is advertised everywhere by bills, and furthermore, pursuant to the orders drawn up in that regard, a period of six months reckoned from the day of the sale in order to be able to receive the monies proceeding therefrom from the auction master, besides that one in the meantime also frequently, partly on account of the vastness of this colony and the trade among the inhabitants, really needs a period of six to eight months to notify the respective creditors by bills and to urge them to submit claims resting on the estate, without which submission it can also never be determined how much the net proceeds of the estate amount to, from which alone, pursuant to paragraph 14 of the aforesaid ordinance, the tax on collateral succession is levied. Likewise, one also encounters very many doubts in the manner in which the collectors ought to be informed of deceased persons whose estates are subject to the aforesaid payment, on the grounds that the post of gravedigger is known here only at the main settlement and the districts in which the respective churches are established, where the sextons usually perform that duty with respect to persons who are buried in the churchyards, while in the meantime private burial grounds are found not only on various homesteads of the countrymen, but also in the remote districts, being unprovided with any church, all corpses are interred on the deceaseds' own places and thus without the gravediggers obtaining any knowledge thereof; notice is merely given thereof by the heirs of the deceased to the churches under which they fall, in order subsequently to pay the church dues, which notice, however, occurs some months and even years after the demise of such persons. For which reasons the undersigned, under respectful correction, would believe that in order provisionally to remove the inconveniences which are presently situated in the aforementioned ordinance drafted for the levying of the tax on collateral successions, according to the condition of this country: In the first place, Considering the absolute impossibility in which one will continually find oneself to be able to levy the tax on the collateral succession by means of appraisal from all estates that are left behind here and are subject to this tax, it ought to be established in general that from all estates which are liquidated by public sale, the aforesaid tax will not be levied by appraisal, but from the net balances of the estate accounts formed by the estate administrators. Which accounts thus ought to be delivered in authentic copy and under oath to the Council of Justice, the receiver general, or collector, while furthermore only such property of the estate as remains unsold on account of legacies or other dispositions of the deceased will be appraised, and the value thereof included in the balance of the estate accounts. That, secondly, with respect to the 31st paragraph, it ought to be enacted: That the female gravedigger here will have to deliver weekly to the secretariat of the Honourable Council of Justice, and to the cashier or receiver general, a pertinent list of all those who have died within that week, indicating who among them to her knowledge died without leaving children, as well as by which persons, and in what capacity, the estate of the deceased is accepted, with orders to require this of such persons upon the usual note for opening the grave, on pain of the penalty which this paragraph carries. 3. That such notice ought also to be given by the sextons of the outer churches, namely of Stellenbosch, Zwartland, de Paarl, and the Land of Waveren, to the Landdrost and Heemraden of Stellenbosch, of all such corpses as are buried in the churchyards there, or are attended to by them as undertakers at private burial grounds; while, for the rest, all other inhabitants who have had any corpse interred on their places or elsewhere ought to give notice of the demise of such person immediately and without the least delay of time to the Landdrost in their district. 4. That regarding the 15th paragraph, at the Honourable main settlement and its subordinate district, within the period of three months reckoned from the demise of the person whose property is inherited or acquired and is subject to the collateral tax, the property, or rather the entire state of the estate, ought to be declared by the executors or estate administrators by a specific list under oath to the Council of Justice.

704. ought to be reported, and care should likewise be taken that the appraisals of such real property and effects as have been bequeathed, or according to the specific dispositions of the deceased must remain unsold, are carried out under penalty of being considered fraudsters of the public revenues. That also within the aforesaid time, those who come to accept any estate in this Capital and its subordinate district by virtue of testamentary or codicillary disposition as executors must deliver to the Receiver-General or the Collector an authentic copy, or else, to save costs, grant inspection of the aforesaid dispositions, in order to prevent any misunderstanding in assessing whether the inheritance left by the deceased is subject to the duty on collateral succession or not, on pain of being held liable for the damage which the Honourable Company might otherwise suffer thereby, and this granted inspection may be acknowledged by the Receiver-General or Collector with their signature beneath the will. That also in the same manner and under like penalty a declaration must be made of inheritances left intestate and accepted by heirs of age who are not children of the deceased and thus fall under the conditions to pay the aforementioned tax on their inheritances. 7 And since the submission of authentic copies or the granting of inspection of the testamentary dispositions should only occur to assist the ignorance of certain estate executors, who often do not understand the very will under which they act, and thus sometimes, in case the deceased, although leaving children, should benefit someone else in his last will, wherefrom the duties ought to be paid to the country, might in good faith conceal some dispositions under the assumption that the deceased leaves heirs in the descending line, and thus get into difficulties; the undersigned would nevertheless judge, under correction, that from this same rule the Orphan Masters of this city could be exempted, as they, upon accepting any estate, whether testamentary or intestate, should only be obligated to deliver such dispositions of deceased persons whose property is subject to the aforesaid tax, together with the declaration in the same manner of estates left intestate whereof the collateral duty must likewise be paid to the Honourable Company. 705. 8 That furthermore in the respective outer districts all those who, whether by virtue of testamentary or codicillary dispositions or as heirs of age, come to accept any estate for administration, ought not only immediately to give notice thereof to the Board of Landdrost and Heemraden, each in their subordinate district, but also forthwith hand over into their hands, in the manner aforesaid for inspection, the last will by virtue of which they are entitled to the administration of such estates, and furthermore, when intending as heirs of age to accept the property left intestate by the deceased, to declare as well to whom the property of the deceased devolves. 9 That additionally, Landdrosts or Secretaries in the outer districts, if the residence is situated near the house of mourning, and furthermore the respective field officers, could be recommended and ordered to make constant, careful inquiry as to who accepts the deceased estates as executors, and the aforesaid field officers should make a report thereof to the Landdrost or Secretary, and the latter in turn should summon the estate executors to submit both the will and a list of the deceased property, as well as to comply with everything to which they are bound according to this ordinance. 10. That although it is declared in section 13 of the aforementioned ordinance that the collateral duty shall be levied at the place where the house of mourning falls, and not at the place where the property is situated, some exception could nevertheless be made in this regard with respect to property left in the remote outer districts which, as often happens, is administered by the Orphan Chamber or by private executors residing here at or near the Capital, in which cases, for the sake of brevity, both the necessary notification and the delivery of the lists, estate accounts, and the payment of what is due to the Honourable Company ought to take place at this Capital itself. and 11 That any appraisals having to take place at this Capital or its subordinate district should be carried out, pursuant to section 26 of the aforementioned ordinance, by the sworn appraisers, in the presence of the Fiscal, two members of the Council of Justice, and their Secretary. 12 That an instrument in proper form of this appraisal, as dictated by the aforementioned ordinance, ought to be delivered to the executors or estate administrators, in order to be submitted to the Collector alongside the liquidation account of the estate.

That all Notaries should be ordered, when drawing up deeds of donation inter vivos, to give notice thereof immediately to the Collector by means of a proper certificate, so that he may be active on his part to ensure that the Honorable Company receives the impost hereon, for which certificate, however, no expenses should be charged other than seven stuyvers for the seal. 15) That if such deeds should happen to be executed underhand, in the presence of seven witnesses, as frequently occurs inland due to the lack of Notaries, then the donor and donee shall both be held and obligated to give notice thereof in the manner aforesaid, upon a certain penalty to be determined thereon by Your Honorable Nobilities. 16. That the appraisals in the respective outer districts should be carried out by the Messenger of the Heemraden or a sworn Appraiser, in the presence of the Landdrost, Commissioned Heemraden, and Secretary, namely in the event that the dwelling place of the deceased is located less than two days' journey from the Drostdy. However, should the distance of the house of mourning require a longer journey than two days, the Landdrost, Heemraden, and Secretary could, in case their presence at the Drostdy is required, be excused from this commission, and thus the Sworn Appraiser may proceed alone to the place of the deceased and perform the appraisal in the presence of a field officer or two witnesses, who shall sign the Deed of Appraisal and deliver it to the Landdrost and Heemraden for further review and confirmation. 18. That, for the rest, also with regard to section 29, the attendance fees of the Commissioners should be determined, and likewise it should be established who shall bear the costs of wagon hire, since under it the Commission is only allotted a salary in proportion to the parcels; it also pleasing Your Honorable Nobilities to declare by interpretation of the said section at whose expense the aforementioned salaries should be charged. And the undersigned would further be of the opinion that 19. At this Capital, the Collector of all gifts inter vivos should collect the tax on Collateral inheritance for the Honorable Company within the time of three months after the deed executed concerning the aforementioned donation has been delivered to him, and the Secretaries of the outer districts within six months. 707. 20) That with regard to section 24, the Collector should collect the revenue of Collateral inheritance, when the property is situated at the Capital itself, within the time of six months calculated from the day of the death of the Testator or Testatrix; but if any property is situated outside the Capital, within the time of nine months; as likewise the Secretaries in the outer districts, such as of the Colony of Stellenbosch, Drakenstein, and Swellendam, within 10, and in the far remote Colony of Graaff-Reinet within 12 months, likewise after the death of the Testator or Testatrix. 21) That the same Secretaries shall be bound to render account and justification of their collections annually to the Collector of the Capital with delivery of the sums received; and the Collector of the Capital should every year submit to the Receiver General a neat statement of all the items reported to him, all within the terms of section 23; while in the meantime, in order to prevent all carelessness in the administration of this branch of revenue so important to the Honorable Company, he could be ordered to keep his accounts and records in proper order, and to grant inspection thereof at all times, when requested, to the Fiscal's office and the Receiver General. 22. That, since the above-mentioned arrangements must necessarily entail an entirely different provision than that found in sections 17, 18, and 30 of the Ordinance, according to which no alienations and transfers of any property subject to this impost can take effect unless the payment of this revenue has previously been demonstrated, the undersigned in this regard would be of the opinion that the same paragraphs should only continue to take effect with respect to property, whether granted by donation inter vivos, or bequeathed by legacies, fideicommissa, or otherwise, or left unsold according to the express directions of the deceased; but that the same should be declared not to apply in any way against all other property that must be realized by public auction. 23. That, however, in order to exercise all possible precautions herein, not only could the respective estate administrators be ordered immediately after the sale to obtain an authentic extract of the vendue roll and deliver the same to the Collector so that, if necessary, it may be compared against the list of property previously submitted, but at the same time the Vendue Master could be instructed not to pay out to the same Executors on the due date more than half of their claims, and to retain the other half of the proceeds of the sold goods under his custody, until such time

quotes from a circular order of the High Indian Government dated 13 October 1791, whereby it is enacted that henceforth all damages which might be caused to any Company buildings on account of faulty management shall remain to the charge and for the account of the person upon whose direction reliance was placed. The undersigned, convinced of the equitable and indisputable right of the Honourable Company to claim some security for its indemnification in case it should happen that it had any lawful claim to the charge of outgoing servants, finds himself obliged in all respects to acknowledge the wisdom of the motives which have moved our High Authorities in general, and Your Right Honourable Worships in particular, to the enactment of sureties among the principal servants of this government. Yet, since it appears to him, subject to respectful correction, that the initial sum of 5 thousand rixdollars security, at which he was assessed by Your Right Honourable Worships in consideration of the offices held by him, must by no means be considered too small, but on the contrary as abundantly sufficient, the undersigned has the honour, with respect to the so unexpected supplement or increase of security deposit, to remark that therein lies a great and undeserved hardship for him, and that it appears to him, subject to respectful correction, that the resolution of the High Indian Government dated 13 October 1791 cannot be made applicable to him: First, because it is entirely extraordinary and without precedent that Directors of Fortifications or Engineers, who nota bene were not contractors and thus also enjoyed no profits therefrom, but served on behalf of their Lords and Masters as constructors and overseers during the erection of any works, should, after the completion of their term of service, be held responsible for defects in buildings constructed long ago under their management; since it is naturally to be supposed that they employed all their abilities at the time to that end, and no one can be obligated to act beyond his abilities. Secondly, because it is a property residing in the nature of things that all buildings must be properly maintained if they are not to be subject to various kinds of disasters and deteriorations or decay. Thirdly, that when architects or master craftsmen in the fatherland and locally, indeed even engineers in the Indies, have undertaken for their profit to construct any works or buildings, it is often stipulated that the maintenance and the repair of defects during the first or second year shall remain for their account; but that such is not the case here is clearly evident, since the undersigned has never acted as a contractor; moreover, a contractor will never leave said maintenance or repairs to the care of strangers, but will always retain the oversight or the management thereof himself. Fourthly, that if unexpectedly the undersigned, in his performances, should be confounded here with the aforementioned contractors or master craftsmen, he nevertheless, unlike these, could not inspect the maintenance of those buildings and their repairs himself on account of his upcoming departure, while it would be inequitable to require of him that he must rely in that respect upon the actions of others, and as it were remain responsible for them; besides which, Fifthly, the time for conditional maintenance, as is customary to determine in contracts, has long since expired, since the undersigned cannot be said to have had the ordinance nor supreme direction over the construction of the various guardhouses, prisons, and fortifications which were made or begun here during the last 4 or five years of the Honourable Lord Governor van de Graaff; because His Honour, to every engineer of the garrison,

736 we took the liberty of addressing Your Right Honourable Worships via the ship de Zwaan, which likewise commenced its journey to the Netherlands on the 21st of that month. In the meantime, on the 29th of the aforementioned month, we were pleased to witness the safe arrival in these Roads of Your Right Honourable Worships' outbound Chamber ship de Pollux, with 3 dead and 6 sick, which vessel, after having been repaired of such defects as were found upon it according to the accompanying report of the commissioned sea captains, and having been provided with all necessities, departed from here for Batavia on the 20th of March. We also have the pleasure of duly communicating to Your Right Honourable Worships the safe arrival of the following two return ships for your Chamber: On the 10th of March from Batavia, the Mentor with 10 dead, 12 sick, and on the 29th from China, Bletterswijk without dead or sick. The Mentor, of these ships, being presently ready to sail, we allow this to serve respectfully as an accompaniment to that vessel, and enclose for Your Right Honourable Worships a bill of lading and invoice for 20 Aams of assorted Constantia wine and 1 small box with sample wine shipped therein. To that invoice we add the account of what has been supplied to that vessel here, together with a list of the persons returning home with it, among whom is Johan Godfried Debler, former citizen of Batavia, to be sent to Europe as a useless and harmful subject pursuant to the resolution of the High Indian Government dated 8th of November 1790, having had to remain here last year due to illness from the ship Beverwijk. The city surgeon of Batavia, Ezechiel Lombaard, who returned home on the ship de Zwaan, having through his attorney here paid into the Honourable Company's treasury the transport and board money for a male slave named Fortuijn, brought with him from the capital of the Indies, after the muster of that vessel, this has caused the said Fortuin not to be recorded on the muster roll, of which notice is hereby duly given to Your Right Honourable Worships. 738 In the Castle of Good Hope, April 1792. the duplicate of our recent humble letters dated the 7th of this month addressed to Your Noble High Mightinesses per the ships Vreedenburg, the Mentor, Horssen, and the packet boat 'T Haasje, which jointly departed on the 14th of this month under the favor of a continuing southeast wind on the voyage to the Netherlands, where we hope and wish that through Heaven's goodness they may arrive prosperously and without mishap, as well as the bearers of this letter, the ships Christophorus Columbus, Blitterswijk, and Alblasserdam, which find themselves in a condition to undertake the homeward voyage. Enclosed we take the liberty of offering to Your Noble High Mightinesses a bill of lading and invoice for: 5 leagers of ordinary Cape wine, 32 whole aams of Cape Madeira wine, and 50,035 lb of Bourbon coffee beans in 500 bales, shipped on the ship Christophorus Columbus for the account of the Chamber of Amsterdam. To the aforementioned invoice we add the expense account of what has been supplied here to the bringers of this letter, together with the lists of persons who are repatriating on them, to all of which papers we respectfully refer. With the return vessels successively dispatched from here, we have, according to our bounden duty, given notice to Your Honorable High Esteemed of all that has occurred, been performed, and transacted in this Government since our respectful general letter of the 25th of October of the past year, and of which the latest is contained in our humble letter of the 14th of this current month. We now find ourselves enabled to bring under the eyes of Your Honorable High Esteemed the general report of the remaining matters which still relate to this Government, and will, under the Main Section of Letters and Papers, first advise that our aforementioned latest humble letters have been placed on the ships Christophorus Columbus, Blitterswijk, and Alblasserdam, which therewith undertook the voyage to the Netherlands on the 16th of this month. The manifold orders and instructions which it has pleased Your Honorable High Esteemed to prescribe to this Government for observance have not failed, both by their own nature and by their execution, and the further manifold tasks resulting therefrom, to increase the clerical work in this Government in general, but especially at the Political Secretariat, to such an extent that, notwithstanding all efforts made and uninterrupted activity, we have found ourselves in the absolute impossibility of preparing both of the sets of copies of our Resolutions required annually, as well as the copies of the outgoing Letters and the Journal kept here. Regarding the Main Section of Monetary Affairs, we shall respectfully inform Your Noble High Mightinesses that of the cardboard and paper currency struck and introduced from time to time, there was still in circulation as of the end of February last a sum of Rixdollars 636019: 36. At our Meeting of the 20th of January last, the first undersigned having produced the list of monies which the residents, after the posting of notices, had registered for remittance to the Fatherland; and since the excessive sums appearing on the aforementioned list could by no means be accepted according to the registration made, but an appropriate estimate absolutely had to be made in that regard, in order, as in previous years, to let each person share again in the Treasury allocation according to the business conducted by him; the undersigned Cellar Master and Dispenser were commissioned to make such a distribution. Since several requests had already been made to us in the month of December by some residents of this Colony to be permitted to enjoy the preference granted by Your Noble High Mightinesses to their principals or creditors in the Netherlands, to be allowed to remit certain sums to the Netherlands under the conditions requested by themselves or determined by Your Noble High Mightinesses; we then provisionally permitted them to have the sums held by them on account of their principals or creditors registered in the Treasury of the Honorable Company, with the intention to decide, upon making the aforementioned distribution, whether we could accept the aforementioned sums in their entirety or only in part, against which time we hoped and trusted that the Right Honorable Commissioners General would have arrived here, to whose honored pronouncement and decision we would then gladly have deferred the explanation of Your Noble High Mightinesses as to whether the sums for which Your Noble High Mightinesses had granted preference should be included under the prescribed amount of 5 Tons of Gold, at which the sum that may be received for remittance from the residents of this Colony was determined by Your Noble High Mightinesses, or whether the same might be calculated and accepted beyond that, in order to be able to leave the aforementioned 5 Tons of Gold for the convenience of the residents. But since we have awaited the so desired arrival of the Right Honorable Commissioners General in vain, we deemed that we could not or should not conveniently leave the aforementioned requests submitted to us any longer without a final disposition; and therefore, at the aforementioned meeting of 20 January last, we handed to the undersigned Cellar Master and Dispenser a statement extracted from Your Noble High Mightinesses' successively received letters of the persons to whom the same were pleased to grant such a preference, and commissioned them thereby to include all the preferential sums in the determined amount of 500,000 Guilders which we are qualified to accept annually; and this because we assumed from the preference that was granted by Your Noble High Mightinesses that we must deduce that it would possibly have been acting contrary to the intention of Your Noble High Mightinesses if, out of consideration for the residents of this Colony, we had intended to include the aforementioned sums belonging in the Netherlands outside of, and consequently also accept them above, the aforementioned amount of five tons. Concerning the Main Sections of Fortifications and Carpenter Works, we shall take the liberty to bring to the notice of Your Noble High Mightinesses that the repatriated Colonel Gelquin, pursuant to what was demanded of him by our resolution of 15 February of the past year, drafted and submitted to our meeting of 15 November two specifications of contracting, in order to be able to contract out, according to the same, the maintenance of the carpentry and masonry works of the fortifications and buildings of the Castle and its envelope, as well as of the various buildings, for the period of six years. However, considering how costly such a contracting would come to stand the Honorable Company, notwithstanding the well-considered order which shines through in both of the same specifications; and how very embarrassed we would find ourselves if, such a contracting having been made for so long a time, the Right Honorable Commissioners General, already expected at that time, should not approve the same, or should find it contrary—as will very apparently be the case—to the plan of retrenchment which Your Noble High Mightinesses, we have, for the aforementioned reasons, resolved to supersede the Right Honorable Commissioners.
