passed on a fixed day could make it unlawful, then even the assembly held at the time that the Heer van Reede van Oudshoorn brought this difficulty forward would suffer from unlawfulness, as being convened not on an ordinary court day, but outside the time determined by the government for the administration of justice. And as little as the time could have been detrimental to the legality of the deed of transfer, just as little does the undersigned believe that the place could have contributed the slightest to it, because the Political Secretariat is indeed the most suitable place to execute deeds of transfer, but by no means the only one, since it is nowhere forbidden that no deeds of transfer may be passed elsewhere than at the Political Secretariat. Yet even assuming such a prohibition, the transfer passed before the undersigned regarding the house and erf of the repatriated Heer Fiscaal would nevertheless not be unlawful, because all those in whose favor such a prohibition might exist were in complete agreement with one another to execute the deed of transfer at the house of the Heer van Lijnden, which consent is sufficient to lawfully exercise an act of voluntary jurisdiction anywhere and at any time. But whatever the case may be, this at least is certain: that in any case, whether a place is specified or not, it is a permissible matter to dispense someone from appearing at the customary place when the dignity of the person or other reasons require it, as Merula teaches us in his Manier van procedeeren Lib: IV: Tit: 65. Cap: 12, where he says: "The Commissioner ought to cause the witnesses to come to his house or where he is lodged, except some, to whom he himself ought to go out of respect, such as to distinguished personages of great prestige, dignity, and quality; To very old and infirm people; To women, principally of nobility." The undersigned trusts that each of your Honors will readily agree with him that an Independent Fiscal in this remote corner belongs without any doubt, as well as the other gentlemen members of the Political Council, to the class of distinguished personages of dignity and quality. And it is also solely this and no other reason that moved him to attend to the transfer in question at the house of the Heer van Lijnden; which attendances the fellow members are not unaware often take place for lesser reasons and with lesser personages. Finally, concerning the last difficulty, the undersigned judges that when a member of this assembly acts for his fellow member for approved reasons, nothing illegal is committed thereby, but on the contrary, everything is considered to have occurred in the proper order as if the member of the month himself had performed his functions. The daily practice among the members of this Council confirms this most strongly and completely removes all doubt regarding it. And since the Heer van der Riet, as was said, would be guarantor for the purchase sum, he cannot very appropriately attend as commissioner over the transfer. All these reasons have caused the undersigned to consider the transfer of the house and erf of the Heer van Lijnden, passed before the Heer van Echten and himself, as legal, and restrain him from deferring to the otherwise revered order of the government. He therefore also makes no objection to submit these grounds of conscientious scruple to the wise judgment of your Honors, in order that, in case they judge that he allowed himself to be used for impermissible acts, such measures may be taken whereby his misstep may be amended and the inhabitants in the future may remain safeguarded against similar irregularities and confusions. Yet if your Honors on the other hand find, as the undersigned respectfully trusts, that his conducted behavior has been lawful and that he acted in accordance with his duty without any malice, then the undersigned requests no less earnestly than respectfully that your Honors please maintain him as a fellow member of this assembly in the exercise of his functions, in order to prevent all unfavorable impressions which the public might easily form to his prejudice.

Copy 1012 No. 13 could form in his regard, in the event that the Honorable and Worshipful Political Council, contrary to hope, might see fit to insist on the cancellation of the aforementioned deed of transfer, and he were forced, notwithstanding his conscientious objection, to obey this order. The undersigned further requests that this all be inserted into the minutes of this meeting for his discharge. Underneath stood: Submitted in Council the 12th of August 1791. Was signed: A. Fleck. Lower: Agrees. Signed: I. D. Karnspek, sworn clerk. Agrees: Eg. Cleren. The undersigned, having to express his sentiment regarding the representation of the Council of Justice submitted to this Council concerning the nullification of the deed of transfer executed for the five houses sold by the Independent Fiscal Van Lynden to the Merchant Onkruyd, is of the opinion that since the President and further members of the Council made difficulties, upon the written notification of this government, to cancel and nullify the transfer in question, and raised many objections against the friendly reminders of this Council that such ought to be done because the Company's interest required this and was directly connected therewith, in order to avoid all unpleasantness in this regard for the future, the loss and damage which both the Honorable Company and this Government might come to suffer thereby ought to be left to them. Just as the undersigned, for his private part as a single member, also leaves this to them, in order, if required, to have the meeting regarding this matter conducted by the members of that Council who had objections to the cancellation of the aforementioned transfer and made further representations to this assembly. All the more because the Council of Justice, by silently passing over in their resolution of the 20th of June last that part of the undersigned's written proposition wherein he reserved the right, should the said Council make difficulties about declaring the transfer in question null and of no value, to enter a written Opinion of the undersigned Dispenser concerning the representation submitted by the Council of Justice at the meeting of August 1791. Goetz 1013 protest in the most solemn manner against all loss and damage which the Honorable Company or the undersigned might have been able to suffer thereby, has sufficiently, nay, clearly as daylight acknowledged and given manifest proof that they did not bring the resolution adopted upon that proposition into the world in their capacity as judges between Mr. Van Lynden and the undersigned, but as being presently appointed by the Honorable Company, in the first place, to watch over the obedience to its laws and orders, and bearing knowledge that both were being trampled, to use the authority entrusted to them to cause the same to be respected. The undersigned directly regarded the decision taken by the Council of Justice as proceeding from that weighty part of its solemn duty, and rejoices to find that, whereas all hope was lost of causing the laws and orders of the Honorable Company to be obeyed through the executive power of the magistracy by him who himself had sworn to protect the laws and was so clearly violating them, the Council of Justice, however, informed by the undersigned of how one sought to render the laws of our lords and masters illusory, in no way hesitated to cause the said orders and laws to be respected as far as lay in their power, and to that end to declare the transfer of the houses in question null and of no value until such time as the ordered and required security should have been posted by Mr. Van Lynden. With regard to the notion entertained by the Council of Justice as if the written notices of this Council were intended to cut off the legal avenues of the authorized agents of Mr. Van Lynden and thereby to obstruct justice, the undersigned briefly asserts that he believes no appeal, for the hearing of which request the undersigned was summoned, can take place except after preceding legal proceedings. That the undersigned frankly confesses never at any time to have had any legal proceedings with the Fiscal, nor ever to have had the intention to initiate any against him. That he merely suggested the nullity of the oft-mentioned transfer to the Council of Justice, and that he was also permitted to hear a resolution rendered thereon that conformed to law and equity; that in token of the approval of this Council over his steps taken herein, it was seen fit to return the transfer duty paid by the merchant Onkruyd to him, and they further fully conformed with all that which the undersigned, as a faithful servant of the Company, was forced to perform in this regard for its highest interests. That therefore, if the authorized agents of Mr. Van Lynden had found themselves aggrieved by that decision, it was the Council of Justice against which they ought to have acted before a higher court; that the undersigned gladly leaves this to the few

wishing to attribute to the little experience of the aforementioned attorneys in the manner of proceeding, as otherwise one would not have to bring unfounded complaints against it, just as the undersigned considers himself rightly aggrieved by the permission to sue granted by the Court of Justice and the summons that followed from it in a matter that concerned only the Court of Justice and with which the undersigned had nothing to do. It is also solely out of a conviction of the obligation of this Council not to obstruct the course of justice that the undersigned has believed that in this case not only could no appeal be requested or granted against him, but also that the Court of Justice, regarding itself as having acted in this matter out of duty against Mr. van Lynden for the indemnification of the Honorable Company, could by no means refer this matter on appeal or otherwise to a higher court, since the resolution of the Court of Justice, as the author of their address rightly observes, has brought about only a provisional suspension of the effect of the deed of transfer and not an annulment of the transfer itself, and that this resolution would immediately have lost, and still will lose, its effect if either Mr. van Lynden had provided the required indefinite surety or if the attorneys could now still see fit to provide the same to the satisfaction of the said Council, and that in default of such surety, the laws and enacted orders dictate that the goods of Mr. van Lynden and those of all the servants of the Honorable Company who might follow his example in refusing to post bail for what the Honorable Company might have to claim from him, shall then have to be held liable for it; thus the undersigned also trusts that the course of justice, by granting an appeal, which the Court of Justice has shown itself willing to hear requests for, could even be made difficult for the Lord of the Land himself, indeed even obstructed to some extent, since if that appeal were granted and a prompt judgment not delivered in Batavia, the Honorable Company—if it should see fit to impose pecuniary obligations upon Mr. van Lynden alongside the other interested parties—would certainly be prevented from recovering promptly, and as the laws in that regard dictate, what belongs to it from the property of Mr. van Lynden. Regarding the complaints of the members of Justice Salomon van Echten and Abraham Fleck about the contents of the letter addressed by this Council to the Court of Justice, as if the desire of the Council of Policy to have the transfer in question annulled by the same commissioners who were present at the passing thereof arose from a suspicion that they might have violated their duty in passing this transfer, the undersigned believes that the Court of Justice ought to be written to, to show these members of their assembly from the contents of the said letter, and to convince them, that not a trace of this suspicion is to be found therein, but that this desire rests solely upon the order of things, which does not permit an act once executed in proper form to be annulled except in the presence of those who passed the said act or gave their sanction to it. was signed: W. 1016 Answer and declaration of the Secretary of the Court of Justice of this government, Willem Stephanus van Ryneveld, and the Adjunct Fiscal Mr. Johannes Andreas Truter, in their capacity as general attorneys of the well-mentioned Mr. van Lynden; 2ndly, the Vendue Master of this government, Cornelis van Aerssen; 3rdly, the Merchant Titular and former Landdrost of the Colony of Swellendam, Constant van Nult Onkruydt: The first-mentioned attorneys in their aforesaid capacity, to hear the request for the decree of, and both the last-mentioned in order to obey, such attachment as the Honorable Impetrant, with prior consent of the Honorable Worshipful Acting Governor Johannes Izaac Rhenius, has caused to be levied: To the end that, if necessary, to satisfy the contents of the aforementioned resolutions, to take care of the rights of the sovereign authority, it is referred not only to all the vendue moneys resting with the Vendue Master and now co-defendant Mr. Cornelis van Aerssen; 2. to all the moneys from the house and some furniture sold out of hand by the same Mr. van Lynden to the co-defendant Constant van Nult Onkruydt, resting under the aforesaid Onkruydt to the amount of f 80000; 3. to all the further goods, effects, cash, credits, and whatever more belongs to the aforesaid Mr. van Lynden, resting with the first-mentioned three defendants in their aforesaid capacity. Furthermore, the three above-mentioned defendants request to be qualified in their aforesaid capacity: that whereas the gentleman of their government has always been inspired with those noble sentiments to properly and fully secure all those who might justify any slightest semblance of a claim against His Honor, the same attorneys, therefore in accordance with the intention of their principal, by the offer already made, namely to consign the sum of eighty thousand guilders to the knowledge of the schepenen, are willing, if necessary, to add to this all the moneys resting with the Vendue Master, thus together an amount of over one hundred thousand guilders Cape valuation; everything, however, on the term and condition that it shall be deferred and left to the judgment and decision of the Lords Directors whether and to what extent the Mr. van Lynden shall be obligated to pay the costs of the lawsuits in which His Honor might be held liable for the missing surety of 5000 rixdollars, as well as such sum of money as the Honorable Company, in the matter of customs and other revenues which Mr. van Lynden claimed to have accrued to the fiscal office, shall be found to be entitled to if restitution should be made to the Honorable Company, but also to be able to find and properly refund, in all cases, the costs of the lawsuits conducted by the said Mr. van Lynden both here in the first instance and on appeal in Batavia, according to the contents of the respective verdicts. However, in the unexpected refusal of this generous offer, the same declare, under benefit thereof, in case of condemnation, that they will obey the attachment insofar as any goods, effects, or moneys are resting under each of them respectively, under respectful protest, however, against all costs, damages, and interest already had and suffered or yet to be had and suffered by this attachment, with reservation for their principal to make use of his good right in this regard, as and wherever appropriate. Furthermore, the three first-mentioned defendants in their same capacities request to hear that the aforesaid attachment shall hold and take effect until such time as the respected orders of the Lords Masters from the fatherland concerning all this shall have been received here. Whereupon the Honorable Impetrant declared to leave the matter to the judgment of the Court. The said attorneys, however, persist in their presented statements. And also the said van Leeuwen, as attorney of the Merchant Titular Constant van Nult Onkruydt, and the Bookkeeper Jan Jacob Fredrik Wagenaar, for the Vendue Master Mr. Cornelis van Aerssen, declared that their principals will obey the attachment levied on them. Shows with due respect Master Jacob Pieter de Neijs; that upon the departure of the Independent Fiscal, Johannes Nicolaas Steven van Lynden van Blitterswijk, having been qualified by your Right Honorable and Honorable Sirs to act in the office of Fiscal, he was at the same time, by resolution of the Council of Policy dated 29 July of this year, ordered "not only in respect of the missing stipulated bail of 5000 Rixdollars, but also on account of the customs and other revenues which the said Mr. van Lynden has claimed to be attached to the Office of the Fiscal, whenever restitution in that regard ought to be made to the Honorable Company, as well as on account of the judgments, both by the Council of Justice here and on appeal from the Council of Justice at Batavia, against the goods and effects left behind by the Independent Fiscal, to institute such legal proceedings as he should find proper and serviceable for the due indemnification of the Honorable Company and other interested parties" See Letter A. That the petitioner, not being informed To the Right Honorable Sir Johannes Isaak Rhenius, Governor of the Cape of Good Hope and its dependencies etc. etc. etc. together with the Honorable Council of Policy. — 1019 of the intention of the attorneys appointed by Mr. van Lynden, deemed it his duty first to take the amicable route, and consequently had the court messenger serve upon the said attorneys, being the Fiscal's wife Madam Johanna Elisabeth Helt, together with the Secretary of the Honorable Council of Justice W. S. van Ryneveld and the Deputy Fiscal Master Johannes Andreas Truter, the aforesaid order of this Honorable assembly, with a serious inquiry whether they were willing amicably to furnish the required security satisfactorily, in order thereby to avoid further legal proceedings, which the petitioner declared he would take in hand in case of refusal. That the attorneys of Mr. van Lynden, instead of furnishing the demanded security, only declared themselves prepared "to consign a sum of Eighty Thousand Guilders, consisting of two mortgage bonds executed in favor of their principal under special hypothec of the house and erf legally and properly sold by him, until such time as the Lords Masters should have made the necessary determinations regarding the revenues enjoyed by their principal," adding some conditions which the petitioner, for brevity's sake, passes over as not being relevant to the matter, see the page annexed hereto under Letter B. That the petitioner, having received this answer, did not fail on 19 July to give the necessary notice of his action in a written memorial to your Right Honorable and Honorable Sirs, appending the aforesaid answer as it had been handed over to the petitioner by the court messenger, in order that your Right Honorable and Honorable Sirs might perceive therein the offer made to the petitioner by the several-times-mentioned attorneys, namely to be willing to consign two mortgage bonds to the amount of ƒ 80,000 under special hypothec of the house and erf legally and properly sold by Mr. van Lynden; the petitioner having at the time also inserted this offer literally into his said memorial, with a very respectful request that your Right Honorable and Honorable Sirs would be pleased to qualify him to accept the offer made, or otherwise to give such orders and make such provisions in that regard as you should deem proper. That, this intention of Your Right Honorable and Honorable Lordships having come to the knowledge of the Remonstrant, he first demanded de novo the posting of indefinite security from the attorneys by notice of service, and having received an unsatisfactory answer thereto according to the report annexed hereto under Letter D, he subsequently set in motion the necessary inquiries to learn whether all the goods, cash, etc., left by the Lord van Lijnden were under his attorneys, or whether anything thereof was also in the hands of strangers; whereupon it became evident to him that the Lord van Lijnden, already before his departure from here, had sold his houses and some moveable goods to the Titular Merchant Constant van Nieten Onkruijd, and that by the latter the purchase price thereof in the amount of ƒ 80,000 had not yet been paid, while the attorneys were busy turning the remaining moveable goods left behind into money by public sale. That, in order to proceed in this matter with the greatest certainty, the Remonstrant, after obtaining the consent of the Right Honorable Lord Acting Governor, not only caused to be placed under arrest, in the hands of the aforesaid attorneys, all goods, cash, credits, etc., still resting in their hands; but also in the hands of the vendue master the moneys proceeding from the sale of the remaining moveable goods, as also in the hands of the Titular Merchant van Nieten Onkruijd the aforesaid sum of ƒ 80,000, in which latter matter the Remonstrant had the less difficulty because Your Right Honorable and Honorable Lordships, without having made any the least reflection on the sale of the Independent Fiscal's house, rejected the offer of the attorneys by the mentioned honored Resolution of 20 July, not because there was no security of whatever name situated therein, but solely because they did not consider themselves sufficiently secured thereby, as being unable to determine how large the bail ought to be that the Lord van Lijnden should have provided. That in the meantime, by the wife of the frequently mentioned repatriated Lord Independent Fiscal, in her capacity as one of the General Attorneys of her husband, having first obtained veniam agendi, there was presented to the court roll a summons against the Member of this Council, the Honorable Lord William Ferdinand van Reede van Oudshoorn, in order to hear requested relief from the lapse of time and improper interposition of appeal on account of a certain dispositive ruling of the said Court of Justice whereby the conveyance of the houses and premises sold by her husband to the above-mentioned Titular Merchant Constant van Nieten Onkruijd was declared null and of no value, until such time as proper security should have been posted by the same. 1021 Your Right Honourable respected dispatch dated 3 August prior, whereby the Court of Justice, for the reasons set forth in the same dispatch, is ordered to strike and expunge the aforementioned citation presented on the roll by the wife of the Lord van Lynden against the Lord van Reede van Oudtshoorn. That the Court of Justice, having considered that it could not comply with the same order, at least not without having first submitted the grounds of the members' conscientious objection to Your Right Honourable and Honourable, and having implored their further disposition thereupon, addressed itself for that reason on the 19th of the same month of August aforesaid to Your Right Honourable and Honourable; with the result that Your Right Honourable and Honourable, on the 27th of the past month of September, replied that, since all proceedings in the aforesaid matter were to cease, they accordingly desired that the frequently mentioned citation presented on the roll by the wife of the Lord van Lynden against the well-mentioned Lord van Reede van Oudshoorn should immediately be expunged and stricken. You on the same day, contrary to our so clearly manifested intention, had decreed the aforementioned attachment, placed by the aforementioned interim fiscal, on the funds resulting from the supposed sale of the aforementioned Houses and Erven, we have not been able sufficiently to imagine the objections by which Your Honours said you were held back from proceeding to the immediate expunging or cancellation of the summons issued against the Lord of Reede van Oudtshoorn, and which compelled Your Honours to have to request our further orders in this regard, whereas Your Honours, however, in the meantime, by the aforementioned decreet of attachment on 4 August, had already legalised the transfer of the frequently mentioned Houses fully 14 days earlier, and as a consequence thereof had also confirmed the purchase thereof, and in doing so modified the resolution adopted by Your Honours, on the basis of which the attorneys of the Lord of Lynden believed they were able to draw the Lord of Reede van Oudshoorn into appeal, whereby consequently by Your Honours in the matter in question a final new pronouncement has been made such that, the cause for the appeal being entirely removed, the aforementioned citation has thus also lapsed of its own accord. The petitioner frankly declares that never, as long as he has had the honour to serve the Noble Company, has anything occurred to him which he could have regarded as a sign of displeasure on the part of his respective rulers concerning his maintained conduct and rendered services; on the contrary, he can assure Your Honourable Worships that he has always had the good fortune of having been able to carry away the approval of his superiors, and in particular of his Lords and Masters; notwithstanding that he has had the honour to hold posts the exercise whereof, if not more, required at least fully as much skill, courage, faithfulness, and prudence as the observation of the office of Fiscal in this remote corner. 1023. the attachment of the purchase money in the hands of the merchant titular Constant van Niel Onkruyt is not only in accordance 1st: with law and reason, and 2ndly: with the intention of Your Honorable and Worshipful Honors, but also 3rdly: perfectly calculated to watch over the security of the precious interests of his Lords and Masters: In order to prove further from this that the petitioner, by his conduct, has not acted contrary to the resolution of the Council of Justice dated 20 June; could not have acted otherwise without neglecting the interests of the Noble East India Company; and consequently can never be presumed to have requested consent from the Honorable Governor for anything other than the attachment of the purchase money both for the houses sold to the often-mentioned merchant titular Constant van Niel Onkruyt, and for the remaining movable property sold by public sale. In the first place, the petitioner states that, in attaching the purchase money in the hands of Constant van Niel Onkruyt, he has acted in accordance with law and reason; all impartial persons, as he trusts, will maintain this without the slightest hesitation when they merely consider that the Lord van Lynden, a few days before his departure from here, sold the houses owned by him, together with some movable property, to the said van Niel Onkruyt for the sum of ƒ 80000; that a proper conveyance of that sale was executed; and that the entire purchase sum was still resting with the buyer when the petitioner was ordered to proceed for indemnification against the left-behind property and effects of the Lord van Lynden: Indeed, nothing was then more natural and more in accordance with the dictates of sound reason than that the petitioner should search on all sides where and in whose hands any property or money was resting that belonged in property to the Lord van Lynden, or to which the same had any other right! In vain would one wish to object against this that the sale had to be considered null and void, and that therefore no purchase money could be seized in the hands of van Niel Onkruyt, because through the annulment of the conveyance the sale could also have no effect, and thus suffered from nullity: for in the first place, the wife of the Lord van Lynden had, at the time of the arrest, already obtained veniam agendi against the Lord van Reede van Oudtshoorn, and therefore already stood in opposition against the operative part whereby the effect of the aforesaid conveyance was suspended: of which opposition, if the opponent had triumphed in Batavia, the natural consequence could have been that the arrest, in case it had been laid on the houses, would fall away of itself as having been wrongly laid upon another's property, and thus the sale and the conveyance had to be considered valid ab initio; without the petitioner meanwhile having been able to prevent acts from being committed regarding the purchase sum, whereby the recovery thereof would be entirely frustrated. using her

1024 But on the other hand, Right Honorable and Honorable Sirs, circumstances presented themselves in the operative part of the ruling itself which gave the petitioner reason to fear that, even if the authorized agents of the Independent Fiscal did not appeal, they would avail themselves of the exception of nullity, consequently receive the purchase money from the buyer of the house, and that these same funds, as not being included under the attachment, might subsequently be remitted to Europe, whereby the entire security for the Honorable Company would have been fully three-fourths less than it currently is. The petitioner is all the more glad to have conducted himself so cautiously in this matter, since Your Right Honorable and Honorable Worships yourselves, in your honored response of September 27 last, indicate in no uncertain terms that the aforesaid operative ruling of the Council of Justice, whereby the transfer in question is declared null and void, suffers from nullity, as having been issued, as Your Right Honorable and Honorable Worships state, without prior legal proceedings or summons, which latter alone renders a judgment so null and void of effect that no appeal is required to deprive it of all force and effect. To all this was added that, even if the operative part of the ruling of the Honorable Council of Justice were declared legal everywhere, new disputes would once again have been at hand, because the buyer could have maintained that, since at the time of the contract no impediments had existed which either rendered the Lord van Lynden himself incompetent to contract, or could be said to affect the matter in such a way that the alienation thereof had to be considered prohibited, see Mr. A. de Rochefort, Civil Laws p. m. 127, no. 1, and also, after entering into the purchase, nothing had occurred between the contracting parties whereby the contract could be considered broken, the same Rochefort p. m. 136-143, that, the petitioner says, for that reason the house had to be ceded with preference to the buyer, who, as soon as the consent regarding the price and property was interposed, had obtained an actio venditi for delivery, and whose right had thus arisen earlier than that of the Honorable Company, in whose name the attachment, which moreover never granted preference, would only later have been laid. And this contention, even if it were not adopted anywhere, would meanwhile not have failed to call the certainty of the Honorable Company's interests into doubt, and might perhaps even have been the cause that the Lords Masters, judging that the sums received by the repatriated Lord Independent Fiscal had been enjoyed contrary to their orders and therefore ought to be refunded, would have this restitution made by servants who never received anything from those revenues; very likely also partly by the petitioner, in the event that he had exposed the precious interests of his High Commanding Lords and Masters to uncertainty. 1025 it clearly appears, then, that placing an attachment upon the houses was subject to difficulty, the consequence of which might very easily have been extremely detrimental to the Honorable Company, without offering, in any case, any well-founded promise of advantage; while, on the other hand, placing an attachment upon the purchase money, whereby the contract between the Lord van Lynden and Merchant van Nult remained untouched and uninjured, could not only take place without doubt, but also provided a double security; inasmuch as the house would then answer for the rest of the said unencumbered estate, and the same would remain jointly liable for the entire sum of ƒ 80000:— NB: under a special mortgage on the sold houses. The attachment upon the purchase money could, moreover, take place very appropriately; because not only did the buyer hold the conveyance to be lawful, but even the Honorable Council of Justice, by the condition added to the annulment of the conveyance, manifested most clearly that in case the value of the sold houses, at the time of the annulment, had been substituted in the place of the same houses, the conveyance would never have been annulled; which opinion of the well-mentioned Council was confirmed by the decreeing of the attachment upon the purchase money. Let this suffice to demonstrate that the petitioner has acted in accordance with law and reason. He proceeds now, in the second place, to show, with all respect, to Your Honors, that his conduct is also in accordance with the intention of this Honorable Council. As to the intention behind the order given by Your Honors to the petitioner, the petitioner testifies that he has always in good faith believed it to consist in this; that, since the Lord van Lynden departed from here without having properly provided surety pursuant to the order of our High Masters and the requisition of Your Honors, one was obliged to endeavor to secure oneself against loss in another manner, and that, since the wife of the said Lord van Lynden, as well as his other attorneys, inclined to the providing of surety; for that reason no other means of security remained than to seize and hold all the goods, cash, credits, etc., left behind by his departed self, until such time as it should appear whether and to what extent the Lord van Lynden was bound to make any restitution or compensation, either to the Honorable Company or to other interested parties. That the intention of Your Honors consisted in this, the undersigned has concluded from Your Honors' resolution of the 29 June, whereby the same enjoin upon the petitioner to initiate, against all goods and effects left behind by the Lord Fiscal, such proceedings as he shall find proper and expedient for the adequate indemnification of the Honorable Company and other interested parties. From this the petitioner judged that Your Honors wished the matters to be so directed by him, that the Honorable Company and other interested parties Honorable 1026. could, in time and in due course, be indemnified as much as possible, and that it was entirely indifferent to Your Honors whether property, or the value of property, were taken into security. And in this opinion of his, the petitioner has been fully confirmed, when Your Honors, by your revered resolution of the 20 July, made not the slightest reflection upon the offered consignment of two judicial recognizances to the value of ƒ 80000:— arising from the sale of the houses, but merely made it known that that offer was not sufficient, because the magnitude of the damages to be compensated and the revenues to be paid out could not be determined. On this ground the petitioner has proceeded, with complete confidence, just as he still respectfully trusts that his manner of acting was in complete accordance with the intention of Your Honors. And he may safely assure that no one will be able to point out a way by which one could have obtained any greater security, of whatever name, than by that which the petitioner, convinced in his conscience, has pursued without any deviation. Finally, to prove the third point, namely that his conduct was entirely designed to work for the security of the precious interests of his High Commanding Lords and Masters, the petitioner will further briefly add here that when one considers the difficulties, uncertainty and confusion, which the petitioner has shown as clear as day would have been the natural consequences of attaching the houses sold by the Lord van Lynden to the titular merchant Constant van Nult, one will then very quickly agree that the petitioner, by seizing the purchase money, has procured complete security, or at least all possible security, for his Masters. For was not, by this, as well as by attaching the moneys realized from the loose goods, the way entirely closed against removing anything, however small, from the attachment; was not the Company thereby secured against a multitude of unhoped-for and unforeseen harmful accidents, to which the goods in kind would have been exposed? Not to repeat now the arguments presented by the petitioner in the treatment of the first point to the attention of Your Honors in justification of his conduct, and which could likewise be adduced in support of this third point. 1027. the 20th of June, whereby the transfer of the frequently mentioned houses was declared null and void, until such time and while the necessary security should have been provided by the Independent Fiscal, then they will, as the petitioner trusts, perceive without difficulty that the attachment of the purchase monies is not contrary to that resolution: especially if Your Right Honorable and Honorable Sirs would be pleased to consider that the intention of the Council of Justice can never have been to diminish the security for the Honorable Company through the aforesaid resolution; but rather to prevent both property and price from being diverted, and thereby taking away all security which might otherwise have been obtained upon property or price. Since it subsequently appeared that the purchase sum was still entirely in the hands of the buyer, and thus the reason for the nullification of the transfer ceased to exist; it was the petitioner's duty to investigate where greater security lay, in attaching the purchase monies, or in seizing the sold houses; and finding, as has been demonstrated before, the greatest security to lie in the former, it was notoriously the petitioner's duty to attach not the houses, but rather the purchase monies, so that even if the operative part of the resolution of the 20th of June is held to be lawful, the petitioner can nevertheless never be convicted of having acted against it: the less so since he could never bring himself to suppose any other intention in the case in question on the part of the Council of Justice than the faithful preservation of the Company's interests. From this and that it simultaneously follows naturally that the petitioner could not have acted otherwise without neglecting the precious interests of his superiors, and that it is therefore not to be presumed that he sought the consent of the Right Honorable Governor for anything other than the attachment of the purchase monies, both of the sold houses and of the remaining movable property; especially since, if the attachment had only been requested on the monies arising from the movable property sold at public auction by the attorneys of the Lord of Lunden, as His Right Honor seems to have understood; the petitioner would have made himself extremely liable in the event that the operative part of the resolution of the 20th of July, whether in case of appeal or through the raising of the exception of nullity, had been declared null and void; 1028. void; for in such a case, as has already been shown above, the security for the Honorable Company could very easily have become three-fourths less than it is at present. Furthermore, because the petitioner watched over the interests of his Lords and Masters in good faith, to the best of his knowledge and belief, he had no need to pretend to have a consent which, in the case in question, acting in the public interest, could not properly have been refused to him; unless one had been able to suggest to him a better and more secure means to carry out the order of employment given to the petitioner by Your Right Honorable and Honorable Sirs. Since the petitioner therefore, in addition to the demonstrated necessity of his observed conduct, is also fully convinced of having requested and also obtained, without the slightest dissimulation, consent to attach the purchase monies from the Right Honorable Governor; he can deduce nothing else from the statement contained in Your Right Honorable and Honorable Sirs' esteemed rescript of the 27th of September last, that consent was never granted for this, than that in granting consent to the attachment, which usually occurs without deep investigation, that part of the petitioner's request which concerned the purchase monies of the sold houses escaped His Right Honor's attention. Yet, however much the petitioner is not accustomed to view the actions of his fellow men, especially of his superiors, from an unfavorable perspective, and on that account very gladly trusts that the Right Honorable Governor misunderstood him; the adverse impressions nevertheless do not in any way disappear which, by calling the obtained consent into question or making it appear pretended, must naturally arise in the minds of those who are not in a position or are unable to observe the petitioner's conduct closely. Nor can late posterity, finding the petitioner depicted in such unfavorable colors in the records of this Honorable Assembly, fail to regard him as an unfaithful servant, and perhaps even note him as the cause of unpleasantries, of which in the meantime only some effects have fallen to his lot.

While we, however, in the consignment, in so far as it concerns the judgments of the Honorable Court of Justice both here and at Batavia, only consent under this stipulation and condition: that it shall be left to the judgment and decision of the Lords Masters whether, and to what extent, a Fiscal is bound to bear any costs in lawsuits conducted by him ex officio, and thus in order to maintain the rights of the sovereign authority; to which decision we hereby respectfully refer ourselves. Extract from the Civil Court Roll held at the Cape of Good Hope, on The ex officio plaintiff, the Merchant and interim Fiscal, Mr. Jacob Pieter de Neijs, as enjoined and ordered by the venerated Council of Policy resolution of both 29 June and 20 July, to initiate such proceedings against all goods and effects left behind here by the repatriated Independent Fiscal, Johan Nicolaas Steven van Lynden, as shall be found proper and serviceable for the proper indemnification of the Honorable Company and other interested parties, produces the writ of attachment with the return of the Messenger, along with two extract resolutions from the Council's decision, the one of 29 June, the other of 30 July last; making request thereupon as in the presentation, against 1. Miss Johanna Elisabeth Helt, along with the Secretary of the Honorable Council of Justice of this government, Willem Stephanus van Ryneveld, and the Deputy Fiscal, Mr. Johannes Andreas Truter, in their capacity as general attorneys of the aforesaid Mr. van Lynden; 2. the Receiver General of this government, Mr. Cornelis van Aerssen; 3. the titular Merchant and former Landdrost of the Swellendam Colony, Constant van Nuld Onkruydt, the first-mentioned attorneys being heard in their aforesaid capacity, request decree of, and the two last-mentioned to obey such attachment as the Officer of Justice, with the prior consent of the Honorable Acting Governor Johannes Izaak Rhenius, has caused to be laid: 1. on all the auction proceeds remaining with the Vendue Master and presently co-defendant, Mr. Cornelis van Aerssen; 2. on the moneys of the house and some furniture sold out of hand by the same Mr. van Lynden to the co-defendant Constant van Nuld Onkruydt, remaining with the just-mentioned Onkruydt, in the amount of 80000 guilders; 3. on all further goods, effects, cash, and credits belonging to the aforesaid Mr. van Lynden, and remaining with the first-mentioned three defendants in their aforesaid capacity; in order, if necessary, to recover therefrom, not only according to the content of the aforementioned resolutions, the missing surety bond of 5000 rixdollars, together with such sum of money as the Honorable Company might sustain against his Honor on account of customs and other revenues which Mr. van Lynden has claimed to be attached to the Fiscal's office, whenever restitution on that account should be made to the Honorable Company, but also the costs of the proceedings conducted by the said Mr. van Lynden, both here in the first instance and on appeal in Batavia, to be found and properly refunded from it in all cases according to the contents of the respective verdicts. Answering for the first three defendants in their capacity as attorneys of the repatriated Independent Fiscal, Johan Nicolaas Steven van Lynden, I declare that since Mr. van Lynden has always been inspired by those noble sentiments to fully and properly secure all those who had or suffered, or still have and suffer, even the slightest semblance of a claim against his Honor, with reservation for his principals to use his legal right on that account as and where it is proper, the three aforementioned defendants in their aforesaid capacities therefore request, in accordance with the intention of their principals, to be permitted to add to the offer already made by one of them (namely to consign the sum of 80000 guilders in municipal bonds) if necessary, all the moneys remaining with the Vendue Master, thus together amounting to a sum of over 100000 guilders Cape currency; all, however, under this proviso and condition, that it shall be left deferred to the judgment and the decision of the Lords Directors whether and to what extent Mr. van Lynden shall be obligated to pay the costs of the proceedings, in which his Honor was referred ex officio, and thus to observe the venerated orders of their High Mightinesses, the respected masters from the Fatherland; but in the unexpected event of refusal of this generous offer, they declare, under the benefit thereof, in case of condemnation, that they will obey the attachment insofar as any goods, effects, or moneys are remaining with each of them respectively, under respectful protest nonetheless against all costs, damages, and interests already suffered and sustained, or yet to be had and suffered, caused by the attachment laid upon them. Furthermore, the three first-named defendants, in their capacities, request to be qualified to collect various outstanding claims related both to the revenues of the Fiscal's office and the private affairs of the aforesaid Mr. van Lynden which have not yet been collected, in order at least in this regard to prevent all damage. After which the Officer of Justice, the plaintiff, declared he would leave the matter to the judgment of the Council, the defendants' attorneys nonetheless persisting with their submitted statement. And the said van Leeuwen, as attorney of the titular Merchant Constant van Nuld Onkruydt and the late bookkeeper Jan Jacob Fredrik Wagener, before the Vendue Master Cornelis van Aerssen, also declared that their principals will obey the attachment laid upon them. We have, etc. Then, since subsequently at the end of the deliberations on that momentous subject, an extract from the Civil Court Roll held on Thursday the 4th of August last was laid on the table of our council by the Lord Administrator, which His Honor declared to have requested as soon as he had learned that the disposition described therein was brought into the world by you upon an alleged consent obtained by the ad interim fiscal, Mr. Jacob Pieter Deneys, from him, the Lord Administrator, to be allowed to include the purchase moneys of the aforementioned houses and plots under the requested arrest on the estate left by the Lord van Lynden, with the further declaration that His Honor had never given any consent to the arresting of those purchase moneys, but had understood that the arrest had only been requested on the moneys stemming from the movable goods monetized by the attorneys of the Lord van Lynden through public sale; and it having simultaneously appeared to us from that extract that you on the same day, contrary to our so clearly manifested intention, had decreed the aforementioned arrest placed by the aforementioned ad interim fiscal on the moneys originating from the valued sale of the aforesaid houses and plots; we could not wonder enough how you on the 19th of August following could submit objections to us by which you said you were restrained from proceeding to the immediate expunging and cancelling of the summons granted against the Lord van Reede van Oudtshoorn, and which compelled you to request our further order in that regard, whereas you nevertheless in the meantime, through the aforesaid decreeing of the arrest on the 4th of August, had already legalized the conveyance of the frequently mentioned houses more than 14 days earlier and, as a consequence thereof, had also legitimized the purchase thereof, and by doing so had modified the resolution taken by you on account of which the attorneys of the Lord van Lynden had thought they could involve the Lord van Reede van Oudtshoorn in appeal, whereby consequently such a final judgment was rendered anew by you in the matter in question as a result of which the grounds for the appeal, being entirely removed, therefore also caused the aforementioned citation naturally to lapse. it stood below: Agrees, was signed: W. matter officially to act in such manner as is more fully expressed in Your Right Honourable and Honourable Worships' honoured resolution of 28 October; That the petitioner, in dutiful compliance with the orders of this Noble and Worshipful Council, as promptly as his manifold official duties have permitted him, has examined both the aforesaid complaint and the documents produced by the aforementioned Mr. Gordon, and furthermore has lawfully obtained all such statements by which he believed the alleged acts imputed to de Sandol Roy could be verified, especially with the objective of investigating whether any weighty fact might result therefrom, the jurisdiction over which belongs to the Civil Judge, and whereby the petitioner might thus be enabled, in accordance with the intention of Your Right Honourable and Honourable Worships, to bring this matter to the cognition of the Noble Worshipful Council of Justice, and to have both the military and civil acts of him, de Sandol Roy, judged by the latter propter continentiam causae; Yet that from the evidentiary documents gathered by the petitioner, which he has the honour to present herewith to Your Right Honourable and Honourable Worships, nothing has appeared that could successfully subject the aforesaid matter to the jurisdiction of the aforementioned Council of Justice, since all the said statements contain no other circumstances than those which relate to any of the accusations appearing in the aforementioned documents placed in the hands of the petitioner; That therefore, since the facts appearing in the said documents, being considered criminal, ought without any doubt to be ranked among pure military offences, as having been committed by Major de Sandol Roy qua miles in his capacity as a military officer, the petitioner, subject to respectful correction, is of the opinion that following the establishment of a Military Court in this Government, the jurisdiction over the aforesaid facts cannot be evoked from the court-martial and, without the concurrence of the parties, transferred to the Council of Justice; at least in this case one has reason to fear that the defendant will avail himself of an exception and thereby, if not immediately bringing the matter back to the Military Judge, will at least, through the interposition of an appeal should the aforesaid exception be rejected, always know how to steer things so that the principal matter could not be initiated until after the lapse of entire years, whereby not only the punishment, si qua esset infligenda, would be of less effect, but also the ordered preliminary investigation could for the greatest part be made illusory; That besides these consequences, the initiating of proceedings before the Council of Justice, in the subject case, moreover exposes the petitioner to being condemned in the costs from his private purse for having summoned Major de Sandol Roy before a notoriously incompetent judge, which condemnation would not only do the petitioner little honour, but would also, in his straitened circumstances, be very ill-timed; That therefore the petitioner has deemed it his duty to bring the aforesaid inconveniences, which in his capacity he was bound to foresee, to the knowledge of Your Right Honourable and Honourable Worships, with the respectful request that Your Right Honourable and Honourable Worships may be pleased to devise such measures in this matter whereby they shall deem the aforementioned difficulties can be prevented, and the petitioner be enabled to initiate with effect the necessary proceedings against Major de Sandol Roy, for which he is otherwise in readiness.
