1053. curtailed, so that he, the appearer, had also received little or no money for the first four months of his service, but that for the remaining time he had enjoyed 2 Rixdollars and 5 Skillings every month. That on 21 April 1790, the appearer having been employed by his said chief in his trade as a joiner and carpenter, he had worked for a full two months without receiving any remuneration for it, wherefore he had lodged his complaints in this regard with his chief, which had had the result that the appearer was additionally granted 4 Skillings per week, subsequently receiving one Skilling daily, and when the days had become longer, the appearer and his other comrades who worked for the aforesaid Sandol received two Skillings daily from him for wages. Appeared before the undersigned commissioner members of the Honourable Worshipful Court of Justice of this Government, the soldier of the Honourable Company, Hendrik Rutgers, of competent age, who, at the requisition of the Deputy Fiscal Mr. Johannes Andreas Truter, as expressly qualified by the Honourable Worshipful Council of Policy by resolution of 15 November of this year to observe the office of Fiscal in this matter, declared it to be true: That the appearer, having arrived in the Cape roadstead on 1 April 1787 on the ship De Admiraal Juffrouw, was immediately placed here with the battalion among the supernumerary troops and furthermore did service under the Corps Spinola until the month of January of the following year, 1788; at which time he, the appearer, was employed in his customary trade of shoemaker by Major Simon Chevalier de Sandol Roy, who was commanding the aforesaid Corps, which work was continued by him, the appearer, until the month of June 1789, he in the meantime not having been permitted to enjoy the least remuneration for all his work; that the appearer, having made in the last month for his above-mentioned chief a pair of new boots and a pair of new shoes, as well as 4 pairs of shoes for his wife and 4 pairs of children's shoes, besides also repairing a pair of boots and a pair of shoes for the above-mentioned Major, the wife of the latter had nevertheless wished to demand of the appearer that he prepare a fifth pair of shoes for her; 1055. which the appearer—since he had already supplied all the consumed leather for his own account and, because he could obtain no payment, had even had to sell his buckles for it—had refused, whereafter the appearer was placed on command work, which labour, consisting of a fixed task, namely the delivery of 16 pairs of shoes each month, the appearer had also performed until the departure of the troops, while the appearer had had to make a pair of shoes every day during the last month before the said departure; that the appearer, having brought a uniform with him from the fatherland, had also subsequently received from his said chief a new uniform, as well as a piece of white kersey for underwear, for which ten Rixdollars had been charged to him, the appearer, and which uniform the appearer had also retained, while the appearer, after paying off that uniform, had enjoyed his full service pay monthly, except for the last month, when 20 Skillings in total were deducted from the appearer for a foraging cap and a cap made of sealskin, which the appearer never received; that the Sergeants Knobbel and Koert, in the name of the above-mentioned Major, had rented a room from the appearer to serve as a canteen for the men, of which room the aforesaid use had also been made until the departure of the troops, at which time the appearer was requested not to rent that room to private individuals but to leave it open, as he, the appearer, had then also left it unrented and had received no rent money for the duration of 7 months, wherefore the appearer's wife had gone to the house of the repeatedly mentioned Major to demand payment from him, and had then spoken to his wife, who, instead of granting satisfaction, had not only treated her in a bitter 1056. and mocking manner, but had furthermore also threatened her to have the appearer taken to the barracks and there, as she called it, have him thrashed. The appearer declaring lastly that, having been sent on a certain day to Sergeant Koert to collect a report which had to be signed by the Right Honourable Governor, the aforesaid Sergeant had not only refused to hand it over, but had furthermore placed the appearer under arrest and, four days thereafter, had caused him to be given several rattan strikes, about which treatment the appearer, wishing to complain to his repeatedly mentioned chief, had not been able to speak with him. Copy and Colonel Gordon having attentively read through the six-page memorial submitted at the last meeting of 17 February by the Deputy Fiscal Mr. Pieter Runten concerning his official actions in the inquiry ordered upon him into the case of Captain Sandol regarding the cadets, to which the Deputy Fiscal added eight statements obtained by him from some of those cadets, and which all most clearly demonstrate the highly punishable and shameful conduct maintained by him, the Captain, towards those cadets, further corroborated by three new statements, he, the Colonel, cannot sufficiently express his surprise at that memorial and the past conduct of the Deputy Fiscal in this so-called inquiry: firstly, that Mr. Runten, as appears from his first two obtained statements and other documents that speak so clearly, strongly, and plainly, only obtained the same on 12 December 1791, thus about a month after receiving the order and documents, after which the third statement was taken on 13 December, and the fourth, fifth, sixth, and seventh on the 15th of this month, and finally the last statement on 10 January 1792, thus this one again about a month after the first; if one now merely casts an eye upon this further legal treatment of affairs and then the delay of him, the Deputy, which he submitted on 17 February last, being five weeks after the last obtained 1058. statement, and a full three months after the inquiry was ordered upon him, then this conduct of his in this matter must strongly catch the eye. Also, all the statements, and then the cadets, would complain that they had been short-changed and mistreated, so that from the first statements of the cadets, as well as from the letter of complaint sent to this government by the High Government of India for a strict inquiry, in addition to the statements and other documents submitted by him, the Colonel, it could at once clearly appear whether the matter was military or not, and the Deputy Fiscal, in such an important matter, ought not to have delayed and acted in such an overly glaring manner, and finally, so many months after receiving the order, submit such a memorial, when the matter had already been initiated for more than two months; wherefore he, the Colonel, adds these notes and remarks of his to his previous ones of 3 February last and can take no satisfaction at all in this, requesting that the same may be transmitted both to the High Indian Government and to the Lords Masters, to his discharge. Honorable Sir, Honorable Sirs, The undersigned Major in the service of the Honorable Company, having learned that by your Honors a resolution was supposedly passed, whereby certain vehement complaints and accusations from Mr. Gordon, Colonel and Chief of the Military here, added to certain imputations of some insults of some soldiers among the cadets, 1060. the cadets, were placed in the hands of the Military Auditor in order to institute proceedings on that account before the Military Court Martial here against the undersigned; Has therefore now deemed it necessary to bring his legitimate grievances regarding this under the discerning eye of your Honors. Far be it from the undersigned that, as what is laid to his charge is considered to be of such a nature that the same ought to be remanded to a judicial inquiry, the undersigned will thereby be afforded the opportunity to defend himself and thus be able to justify his conduct before the entire public, as long as he may see his legitimate case placed in the hands of judges who are both competent and impartial enough to judge thereon. Yet, Honorable Sirs, saving all respect and deference for the president and members who here could be considered to constitute a court martial over the undersigned to judge in such capacity as judges over the undersigned, wherefore the undersigned, saving reverence, also recuses the same in the most solemn manner in that capacity; The reasons for this recusal are situated in this: Concerning the incompetence in which the Military Court Martial here finds itself to deliver a verdict over the undersigned, that the establishment of a court martial here has not yet been properly approved or confirmed by the Lords Masters, and moreover that the same cannot be composed otherwise than of one to two staff officers, and for the rest of captains and subaltern officers, whereas all military laws teach that a staff officer cannot be judged by any lesser than staff officers; in this regard, even Van Hasselt says in his Treatise on the Holding of Courts Martial and Garrisons of the State of the United Netherlands, page 70: "Here it should further be noted in a word that no members must be ordered to a court martial who are lower in rank than the person who is being put on trial; for jurisdiction involves a power over the person who is put on trial."

1061 is placed, for it would indeed be contradictory to exercise power over someone who is higher in power; this would therefore not be reconcilable with subordination, which ought to be observed to the utmost among military personnel. See Reyner Engelhart in Specimen Juris Militaris Naturalis § 1224. 2. Regarding the recusal, it will suffice merely to leave to the equitable judgment of Your Right Honorables whether the undersigned could ever—this being said, however, always with all due respect—place in the court-martial to be appointed that peace of mind which, in a civilized society, every individual must feel toward the one who will judge over him as judge. Indeed, it is fully known to Your Right Honorables with what animosity Colonel Gordon has always been prejudiced against the undersigned, and how very much His Honor has for a considerable time, on all occasions, displayed his steadfast inclination to persecute the undersigned and to show that the total ruin of the undersigned would provide His Honor with substantial satisfaction. Moreover, Your Right Honorables will still be very well informed that upon the incorporation of the undersigned as Captain into the Battalion here, the Gentlemen Officers of that time, considering themselves prejudiced thereby, authorized delegates from among their number to lodge a grievance about this with the Right Honorable, Valiant Lord Governor and Colonel, which then gives the undersigned no reason to be able to regard those Gentlemen (preserving their honor and dignity) directly as neutral judges; see Merula, Manner of Proceeding, Book 4, Title 40, Chapter 4, where among the well-founded reasons for the recusal of a judge the following are enumerated, such as: § 11 That I have a lawsuit pending with the Judge, as with a private person; § 12 That he is my mortal enemy, in all things punishable. Inclination Some 1062 Some go further and maintain that the defendant may recuse the Judge who formerly had been his enemy, notwithstanding the reconciliation between them both that followed thereafter; but certainly the defendant may recuse the Judge who has threatened to wish to harm him; § 13 That the Judge is all too familiar with my adverse Party, and bears too great a favor toward him; § 17 When he is a table-companion of my Party or of my enemy, and also resides in the same house with him; § 18 That he is under the Jurisdiction of my adverse Party or of my enemy, being his vassal, or that my Party is under his command, power, and dominion. The aforementioned Van Hasselt, in his instruction on the holding of Courts-Martial in our Republic, further says on Page 34: "Since according to law and sound reason, it must be an established matter that all partiality must be banished from all courts, and nothing harsher can be conceived for a Party than having to litigate before a suspect judge and allowing him to judge and pronounce judgment, special attention must therefore be paid that no Officers are admitted as Members in a court-martial to be held who, for one or another valid reason, are suspect, that is, behave as partial; for partial and consequently suspect in this matter is held the one who favors the one Party more, or appears to wish to favor, than the other." Indeed, who does not see, upon confrontation of these stated points with the qualities and requirements of a competent and neutral judge, that the undersigned, in a matter of so much consequence, can only with great hardship be submitted to the jurisdiction of the court-martial? Colonel Gordon will still be able to recall very well the serious representation made by His Honor in the Year 1785 to the Governor at that time on the occasion when Colonel van Nieuwen requested a Court-Martial to 1063 judge over the disputes between himself and the undersigned's Brother, the Lieutenant Colonel of the same regiment, and how very much His Honor constantly touched upon the attention of the Lord Governor concerning the influences that a Colonel has on the court-martial, especially in matters that concern him privately or in which he is a Party, which was then also the reason that no court-martial was granted to Colonel Gordon to decide over the conduct of him and the Lieutenant Colonel. The undersigned by no means wishes to evade the judicial examination of his case; on the contrary, he feels very well and is fully convinced that it must serve to justify his conduct and bring to light his innocence. He has also never failed to properly answer the questions put to him by a Commission expressly decreed for the examination of his affairs; however, he solely desires and expects from the justice of Your Right Honorables that he may see himself judged in this matter by judges competent and neutral. That Captain Sandol was, in the first place, appointed illegally and contrary to the orders of the Lords Directors, since they clearly prescribe in their letter to this Government that this could take place if it were consistent with the welfare of the service, and this was clearly the exact opposite, Captain Sandol himself being under a condemnation by a committee appointed by the Governor himself; secondly, two members of the Council, the Secunde and the Cashier, were absent on a commission to Swellendam; thirdly, no captain can be made a major without the nomination of the Head of the Military, who had not the slightest knowledge of it, and thus this appointment was made openly to spite the Head of the Military, whose aim is nothing but justice, equity, and the good of his Master's service, and to destroy all good order through reckless authority. 1068. and Honorable Worshipful Council resolution of the 15th prior, containing the authorization of the undersigned to investigate, instead of the Honorable Fiscal pro interim, the complaints against Major de Sandolroy sent hither from Batavia, along with the documents annexed here locally, and further to act therein as he should find consistent with the duties of the office of Fiscal: He, the undersigned, without any delay, pursuant to the order of the said Honorable Fiscal pro interim appearing in the aforementioned resolution, took over all documents relating to the aforesaid complaints, and further, setting aside matters requiring less urgency insofar as other matters of a more weighty nature permitted, examined those documents in order to investigate the nature of the offenses appearing in them, and to determine therefrom the course he, as an officer of Justice, ought to follow in pursuing the proceedings. That the undersigned, having soon perceived in this investigation that the matter requested of him was of such great extent and weight that, in view of his manifold official duties, it would not be possible for him to pursue and conclude this same matter in accordance with the desire of this Honorable Worshipful Council; for that reason he resolved to relieve himself of conducting the criminal proceedings before the respective Drostadyes, which had long been an encumbrance to him both in his official and other duties, and consequently immediately dispatched the necessary letters to the respective Landdrosts of Stellenbosch and Swellendam, whereupon a request was also already made by them in the month of December to your Honorable Worships and Honorable Worships to qualify another in the place of the undersigned. 1070. the undersigned was not able to make a beginning with obtaining the depositions before the 12th of December, and could not proceed therewith more expeditiously; all the less so because the taking of depositions in all matters of importance, according to the humble understanding of the undersigned, ought to take place judicially, and the undersigned thus also at times, both on account of business and because of the small number of members representing the Company in the Council of Justice, had to adapt himself in a fair manner to the Commissioner Lords; besides which the deponents, who were in various places, were frequently difficult to find. That just as the aforementioned reasons delayed the investigation of the matter in question, as well as the obtaining of the depositions, these same reasons by natural deduction were also largely the cause that the undersigned did not earlier submit his representation mentioned at the outset of this report: there being nevertheless in this matter a principal contributing cause, that notwithstanding the consent of the Right Honourable Lord Administrator granted in the month of December, to deliver to the undersigned a copy of the instruction drawn up for the military court-martial of this Castle, that same instruction was nevertheless only handed over to the undersigned towards the middle of the month of January of this year; whereupon the undersigned also immediately, according to the circumstances of the time, instituted his investigation as to whether, also according to this instruction, the case of Major de Sandolroy was purely military; which quality the undersigned found, according to common law, had to be attributed to the same in the strictest sense. That the undersigned, it is true, immediately after the investigation, was not only able to, but in fact did observe that the aforesaid matter was purely military; yet because the matter, constituted as it then was, having come from under the eyes of Your Right Honourable and Worshipful Honours into the hands of the undersigned, the undersigned, not without slighting the discernment of his masters, did not dare to suppose that Your Right Honourable and Worshipful Honours would be ignorant of the nature of the matter: from which he drew this natural conclusion, that for well-founded and equitable reasons, they wished to have brought this case by preference to the cognition of the civil judge; to which intention the undersigned in good faith was persuaded to hold, and, be it said with respect, still holds, that it could not be complied with in any better and more lawful manner than by investigating whether from the further matter in question any fact would also result weighty enough to be brought to the cognition of the civil judge, and at the same time so connected with the established military crimes that these would thereby necessarily have to follow to the civil judge: the Council of Justice not having been delegated in casu subjecto, quod bene notandum. These are the principal reasons, Right Honourable and Worshipful Lords, which prevented the undersigned from submitting his representation earlier; he trusts that these, conjoined with what has already been said concerning the investigation of the matters and the obtaining of the depositions, will be sufficient to convince Your Right Honourable and Worshipful Honours that in this matter no delay at least was caused through the actions of the undersigned; but that he, on the contrary, in accordance with the duties of an honest officer of justice, has acted with all such dispatch as his other duties, of no less importance, permitted him. 1073. have declared that they were already subject to enough taxes, and that due to a lack of ready cash the situation of this Colony became increasingly precarious and the means of subsistence ever more reduced, which from time to time comes to manifest itself in various conditions, and that they consequently could bear no more burdens of whatever name, the Petitioners in this matter being fully convinced of the truth of their remarks, and that these rumors among the Inhabitants in general had not only aroused much displeasure, but also that several expressions regarding this used by them in daily conversations have caused the Petitioners to fear the consequences, and considering the unfortunate condition in which the Inhabitants of this Colony currently indeed find themselves through the introduction of paper money, the increase of the currency, and various other burdens to which they nevertheless submitted without objection, in the expectation that our High Commanding Lords and Masters would also consider means to give the inhabitants of this Colony an opportunity to find a livelihood for themselves and theirs, since after all the prosperity of the Honorable Company is inseparably linked to that of the Inhabitants; if the Petitioners had not resolved to direct their attention solely to the matter of the Collateral for this time, they would find a wide field to demonstrate how all these newly introduced taxes and changes have brought the Inhabitants of this Colony to the brink of their ruin, the Petitioners are fully convinced that Your Honorable and Respected Worships must have full knowledge of this, since daily experience serves to manifest this statement of ours. Wherefore they, the Petitioners, both for themselves and on behalf of the Inhabitants of this Colony, have approached the Honorable Respected Lord Governor of this Government and requested of His Honorable Respect whether it might please His Honorable Respect to bring these grievances of theirs to the Table of Your Honorable Respected Worships and to direct matters so that the publication of the Collateral might be suspended until the arrival of the Right Honorable Lords Commissioners, to whom they, the Petitioners, would then defer all their interests. However, the Petitioners have to their regret had to experience that on the 2nd of this month, notwithstanding their humble solicitations, the public was notified of this tax by the ringing of the bell in the customary manner. Scarcely had this publication been made when it immediately had that effect which the Petitioners had feared, namely many fermenting minds, wherefore the Petitioners, fearing the consequences, were compelled to approach the Honorable Respected Lord Governor of this Government once more and declared to His Honorable Respect that for all the aforementioned reasons, they, the Petitioners, could not and would not allow themselves to be used as instruments to carry out that hardship and injustice, and therefore requested rather to be discharged from their posts as Burgher Councillors, since they had understood from the publication that they were to assist the Judicial Commissions, in order not to bring upon themselves the curse and hatred of the Inhabitants, which declaration the Petitioners hereby solemnly repeated in the absolute sense, whereupon they implore the attention of Your Honorable and Respected Worships. After the Petitioners had made this declaration, they were furthermore requested from all sides to indeed make their efforts effective so that this tax, as little as any other, would be introduced in this Colony, since they, the Inhabitants, would under no conditions whatsoever agree to pay the same. Subsequently, the Petitioners were requested by various prominent Inhabitants to assemble on the 8th of March to hear their grievances, for which purpose they, the Petitioners who were present, gathered at the house of the eldest among them, where a large number of Inhabitants appeared, who declared to the Petitioners that they made their grievous complaints known to the Petitioners as Burgher Fathers, that by a publication of the 2nd of this month the Inhabitants were notified that the High Commanding Lords and Masters desired to have the levying of the Collateral introduced in this Colony, that they were already subject to so many taxes which they had borne with patience, in the expectation that privileges would also be granted to them whereby they would be enabled to pay the same, but since this grounded hope of theirs had vanished in smoke, and they daily faced the bitterest poverty, they consequently could and would bear no more tax, and already found themselves burdened by all the previous levies, with the request that the Petitioners would intercede with the Government that they might be relieved of this as well as all the previous ones, whereupon the Petitioners could say nothing else than that they would employ their good offices to that end, but for this time had to limit themselves solely to the Collateral, with which this meeting came to an end. 3075. as well as military officers of the same Colony, the petitioners were also requested to assemble together on the 9th of this month, in order to likewise hear their grievances, for which purpose the petitioners gathered on that day at the house of the eldest among them, while the aforementioned Heemraden and military officers presented themselves at that place, making it known that they had learned with the utmost astonishment that the publication at this capital regarding the collection of the collateral tax had taken place on the 2nd of this month, at a time when they had rather expected that suitable measures would have been devised to timely prevent the downfall of this Colony, which was already on the brink of ruin; and by this declaration, on behalf of themselves and the inhabitants of the districts of their Colony, that they were not in a position to bear any burdens, by whatever name called; and since they had understood that in such commissions Heemraden would have to assist, they further declared that they did not wish to be employed as executors of any orders relating to the levying of the collateral tax, so as not to be tools to strip their fellow citizens, as it were, of their lawful property; and they requested the petitioners, as the voice of the people, whether they would convey this their candid and well-intentioned declaration to the government, adding thereto that if, contrary to hope, this tax must nevertheless be introduced, they desired to be discharged from their posts. The petitioners hold themselves assured that Your Right Honorable and Honorable, recognizing the matter according to its gravity and the dreadful consequences which are otherwise to be expected for lack of a timely provision, will certainly take the same into serious consideration, and pursuant thereto, for the general good, pursue the most suitable paths to avoid all troubles and divisions. 1077. land in that regard ought to take place, will mainly consist of: the appointment of commissioners; the determination both of the terms and of the manner in which here and in the respective outer districts the Liberal Gift shall be contributed, and the placement of the donation boxes required for this purpose, the undersigned has also deemed it necessary to investigate on what basis here in the year 1752 the 50th penny was likewise levied, in order to be able to submit with greater foundation and reassurance to Your Right Honorable Council what regulations should also presently be made on the part of the Government, in order, pursuant to the respected missives from the repeatedly mentioned Supreme Indian Government, to cause the transmitted placard for the collection of the 50th penny to serve locally. Upon this investigation, it appeared to the undersigned, subject to correction, that the arrangements made and established in this regard by resolution of this Board of 6 June 1752, in so far as the same are applicable to the present state of the Colony—with the omission, however, of such and such points that had their particular application to the placard issued at that time—could and ought presently also to be adopted and followed with respect to the placard at hand, at least, and in any case, that the 50th penny having to be levied, one could proceed in this matter in no other manner than according to the prescription found noted in that regard in the same Resolution: Pursuant to which guideline the undersigned is then, subject to correction, of the opinion: that the aforesaid Liberal Gift here at the main place ought to be drawn up, and the oath also taken in that regard, and that this should take place in the hands of expressly appointed commissioners, consisting of three Company servants and three on behalf of the burghers, who ought to sit in turns, and to whom, to perform the work of the pen, two clerks ought to be added. That in the respective outer districts there ought to be in session the Landdrost together with two Heemraden and two military officers of the same district, who ought to be appointed by the Landdrost, Heemraden, and military councils, each from their own body, from the most capable persons, and who, before entering upon their commission, ought to come up hither to take the oath prescribed for that purpose; while the secretaries of the said Colleges ought to be instructed to handle the clerical work each in his department for this commission. That furthermore, in order to proceed in this matter with all possible speed, and to make the necessary orders, subject to the approval of the Government, upon all difficulties that might arise in the execution thereof, two members of Your Right Honorable Council ought to be appointed as Chief Commissioners. That by the Paymaster of this Castle there ought to be drawn up, pursuant to A 1078. A list of all Company servants who shall be found in service locally, and by the Burgher Councilors a list of the burghers, free blacks, and all other such persons conducting burgher trade residing under the Cape, both to serve for the information of the Commissioners who will be in session here at the Cape for the collection of the repeatedly mentioned Liberal Gift or 50th penny; while for the Commissioners in the outer districts the nominal rolls of the inhabitants which rest at the Drostdy ought to serve. That whereas according to the 24th article of the aforesaid Placard there is required for the payment half in cash, sounding gold or silver coin, and the other half in bank certificates or letters of credit, this latter ought to be altered with the stipulation that the other half of the Liberal Gift shall be contributed in current paper or cardboard currency, by reason that no bank certificates or letters of credit are in circulation here. That the Commissioners of this main place, on such terms as Your Right Honorable Council shall be pleased to determine, ought to be in session here in the Reformed Church from eight to eleven o'clock in the morning and from three to five o'clock in the afternoon, and those of the outer districts at the house of the respective Landdrosts; the undersigned being of the opinion, however, that the terms of payment at the Cape and the Colony of Stellenbosch and Drakenstein could run from three to three months, but that for this purpose in the Colonies of Swellendam and Graaff-Reinet as much as five months would be required. And as in the year 1752 the country people who sustained themselves with cattle farming—among whom the most were found who were destitute of cash or silverware wherewith to satisfy the 50th penny—were accommodated by leaving it free to them to furnish the Liberal Gift with cattle, the undersigned, since this difficulty still indeed exists, could likewise find no other expedient for this.
