Today, the 3rd of November 1790 it has also been testified under oath 12. to have bought three bottles of wine from a woman 13 who, in the presence of the second court messenger expressly ordered thereto, they have declared to be the defendant in this case, 14 just as this all can appear ad evidentiam from the exhibits annexed hereto under Lit. B, A, C. For which and other reasons and means to be adduced in further detail in due course and time, if necessary, the plaintiff ex officio, making his demand, concluded that the defendant in this case, by definitive sentence of Your Honors, shall be condemned to the prescribed fine of one thousand guilders with costs, or to other etc. Signed: J. Appeared before me, Johannes Daniel Karnspek, sworn clerk at the Secretariat of Justice of the Castle of Good Hope, the hereinafter named witnesses being present, the cooper of the Honorable Company, Jan Jurgen Bergman, and the sailor Jacobus van der Does, who at the requisition of the Independent At the requisition of the Honorable Independent Fiscal of this government, I, the undersigned, went to and into the presence of the widow Sebastiaan Rijchard, and in the presence of the same asked the sailors in the service of the Honorable Company, Jan Jurriaan Bergman and Jacobus van der Does, whether she, the widow Rijchard, was the very woman from whom they had bought wine a few days ago and paid for the same; to which I received from both the answer: Yes, that is the very woman from whom we bought wine. Which I certify to have happened to me. Below stood: Cape of Good Hope, date as above. Signed: J. de Wit, Second Court Messenger. Fiscal, the Honorable Johan Nicolaas Steven van Lijnden, declared it to be true: That the appearers, having gone yesterday to a certain house situated in the Roeland Street in order to buy some bottles of wine there, just as the second appearer has fetched wine there on multiple occasions; that when the appearers, both together with three bottles of wine in order to proceed to the hospital, had come up to the corner of the house of the burgher Johannes Jacobus van den Bergh, the same van den Bergh had met them and had asked in substance: Where did you get that wine?, to which they answered: That is none of your business; but when the said van den Bergh informed them that he was a lessee, and wanted to know where the appearers had fetched those wines, the appearers showed the said van den Bergh, who had gone with them in person, the house where they had fetched those drinks; that the said van den Bergh, upon his arrival there, having searched the said house, then fetched two empty ankers out of the same, of which those people had in haste let one anker run out, which the appearers could see, since the entire backyard was covered with wine. Declaring nothing further, the appearers giving as reasons for their knowledge as in the text, being prepared, if required, to confirm the foregoing further with solemn oath. Below stood: That this thus transpired at the aforementioned Secretariat of Justice, present the clerks Marthinus Laurentius Neethling and Johan Bernhard Hoffman as witnesses, who, together with the appearers and me, the said clerk, have duly signed the minute hereof. Re-examination Appeared before us, the undersigned commissioners from the Honorable Council of Justice of this government, the aforementioned cooper of the Honorable Company, Jan Jurgen Bergman, and the sailor Jacobus van der Does, who, after this preceding declaration had been clearly and plainly read to them word for word, declared that they persisted with it, not desiring that anything should be added to or taken from it, and therefore, in confirmation of the truth thereof, each of them in particular, in the presence of the widow Sebastiaan Rijchard, whom the deponents recognized as that very woman from whom they had fetched the aforementioned wines, spoke the solemn words: So help me God Almighty. The plaintiff ex officio, for the maintenance of the lessee, thought fit to prohibit the continuation of that illicit trade to the defendant. 8. Yet the defendant, instead of obeying this, was able to forget himself to such an extent, 9. as to proceed, in contempt of the country's revered placards, with retailing wine bought up from private wine merchants, 10. not only to the people of the Schuur, but also to slaves, 11. as appears from the two annexed declarations under Lit. Today, the 13th of October 1789, appeared before me, Willem Stephanus van Rijneveld, Secretary of the Honorable Council of Justice of this government, present the undersigned witnesses, the Burgher Willem van Reenen, of competent age, who, at the requisition of the Honorable Independent Fiscal, Johan Nicolaas Steven van Lynden, declared it to be the truth: That on Sunday evening, the 11th of October last, around 7 o'clock, he, the deponent, in the company of the Lieutenant of the Burgher Cavalry, the Valiant Johannes Eksteen, was riding from the farm of the Burgher Jacobus Huising. That he, the deponent, having arrived at the land of the Schuur, saw two slave boys there, named Marthinus and Jacob, belonging to Mr. Wiese, coming out of the house of the under-overseers at the Schuur, having a bottle with them. That the said Eksteen then, having called those boys, asked them what they had in those bottles, which was substantially answered by one of those boys by saying, "Wine, my master, which we bought at the house of the under-overseers for 8 stuivers the bottle"; adding further thereto that they could buy as much of the small measure there as they desired, while they also declared to the deponent that they, that same morning, with several other boys and Hottentot women, had drunk wine there. Declaring nothing more, the deponent gives as reasons for his knowledge as stated in the text, being prepared, if required, to further confirm the foregoing by oath. Thus done at the aforesaid Secretariat, present the clerks Petrus Diemel and Christiaan Ludolph Neethling as witnesses, who, together with the deponent and me, the said Secretary, have duly signed the original minute hereof. that the deponent, on Sunday the 11th of October at 7 o'clock in the evening, coming with the burgher Willem van Reenen from a place belonging to the burgher Jacobus Heuning, was riding over the Schuursland, and had seen coming there out of the house of the assistant masters, of the Schuur, two slave boys named Martinus and Jacob, bondservants of Mr. Wieser, the said boys having a bottle with them; that the deponent had then called the same boys to him and asked them what they had in that bottle, which had been answered by one of them in these substantial words: Wine, master, that we bought from the assistant master in the house for eight stuivers the bottle, saying further that they could get as much for sale there by small measure as they needed, adding thereto that they that same morning, with yet more boys and Hottentot women at that place, had also bought wine. Declaring nothing more, the deponent gives as reasons for his knowledge as in the text, being prepared to confirm the foregoing at all times more closely by oath. Answer drawn up and very respectfully submitted to the Honorable Worshipful Johannes Isaak Rhenius, President, together with the further members of the Honorable Worshipful Council of Justice of this Government, by and on behalf of the assistant of the Honorable Company, Marinus Marinussen, in his said capacity, defendant, Honorable Worshipful Sir, Honorable Worshipful Sirs, as proxy of the assistant master of the Company's post the Schuur, Johan Philip Snegelsbergen, defendant in the case of smuggling, against the Honorable Worshipful Independent Fiscal, Johan Nicolaas Steven van Lynden, prosecutor in the said case. The defendant, having dutifully acknowledged his thanks to Your Honorable Worships for the granted copy of the claim, filed by the Honorable prosecutor a fortnight ago today before Your Honorable Worships, and proceeding to answer the same, says that his principal cannot deny that he sells wines and other liquors by bottles and small measures there to the people stationed at the post, as has taken place there from time immemorial, although almost every year protested against by the lessees of the Cape cool wines at the Rondebosch and the Bay, yet the same have always been rejected, because necessity demands that the people stationed at the post, both by day and by night, ought always to be present, and when they cannot get liquors at the post, they must of necessity betake themselves to the taverns, whereby such a post becomes totally disrupted. In consideration of which, the requests of the lessees in this regard have been turned down, so that the defendant principal trusts that he has not thereby made himself guilty of selling any liquors to others outside the post, much less to black boys, although such was brought forward by the lessee Johannes Eksteen, and two declarations given by the said lessee and his brother-in-law Willem van Reenen are produced by the prosecutor. Thus, in the first place, the defendant will give in consideration to Your Honorable Worships whether persons who give the declarations can legally be accepted, since the one is the lessee himself and the other his brother-in-law. But when one reads the declarations, they cannot but appear very suspect. Assuming, although it is not to be presumed, that this boy had made this statement according to the wish of the lessee, what credit shall such a statement from a boy merit, the more so as Your Honorable Worships see from the annexed letter of the Captain of the Burgher militia, the officer J. D. Wiese, who questioned his boys about it, not only those two, but even all his slaves. Today, 10 December 1789 To the Noble and Valiant Lord Governor and the Honorable Political Council, the defendant having given, as being of another forum, but only adding here that the far-reaching disobedience of the defendant has finally compelled the Plaintiff ex officio to have the quantity of wines, purchased by the defendant from private residents, taken note of, and strictly to have him, the defendant, prohibited from further selling wine unless the same had been purchased from the pachters. Wherewith the Plaintiff ex officio, trusting to have sufficiently refuted the difficulties raised in the answer, will conclude this document in the reasonable expectation that Your Honors will have no hesitation whatsoever to judge as was concluded in the claim. By virtue of which and other reasons and means, if necessary to deduce further, the Plaintiff ex officio, rejecting the grounds of the answer on mere impertinence and denial, persisted in his claim and the conclusion taken thereon for reply. That subsequently the appearers, on further orders from aforementioned Eksteen and Van Reenen, had proceeded to the defendant's post, and had requested one of the sailors stationed there to go and buy a bottle of wine from the underbosses, which was undertaken by the said sailor. That the appearers had thereupon made known to the said Eksteen and Van Reenen that they were very well aware that no wine was sold by the said underbosses to slave boys, but that such was only done with respect to the people belonging to the said post. Who then had also obtained a bottle of wine, and having handed it over to the appearers, the appearers had proceeded with it back to their estate and had there delivered the same to the aforementioned Eksteen and Van Reenen, who thereupon immediately departed again. He says regarding the article in which it was advanced that the question quod actus was supposedly not contradicted by the said proxy for the defendant; but, Honorable Right Honorable, that the defendant must acknowledge that wines were actually sold to the people stationed at that Post by the defendant in his capacity and his companion cannot be denied. But here the whole question will be whether, given that from time immemorial it has been a constant practice at that Post, and several leaseholders have opposed it, yet by reason of the high necessity that this Post demands the same were always rejected, and only now that wine-tapping can be counted under smuggling, if indeed already for immemorial times and by all the predecessors of the defendant they have made themselves guilty thereof. The defendant does not mean to say here that a custom of long-standing sins would ultimately exempt anyone from the laws. But since at the said times the leaseholders of that district were turned away, which certainly did not happen without urgent cause, which has not yet been removed, one can consequently not be considered as smugglers, with the Honorable Right Honorable Lords, but to enjoy that same privilege as the previous predecessors. The Honorable Ex Officio Prosecutor, or rather the leaseholder of that district, the Master Johan Paulus Eksteen, who also must clearly assume that the selling of wines by the defendant in his capacity to that Post's people stationed there could not be brought under the category of smuggling, must therefore seek to accuse him of selling wines to everyone, even to black boys, which has been directly contradicted by the defendant, and thus the question quod actus was very properly contradicted in the answer. Further, it is said by the Honorable Ex Officio Prosecutor from Articles 3 to 5 that the defendant has attempted to disguise the fact, to make Your Honorable Right Honorable, if it were possible, believe that the wine fetched by the boys of Master Johannes Eksteen did not come out of the house of the defendant. That, Honorable Right Honorable Lords, was never the intention of the defendant, but rather that the said boys did not purchase that wine at the place of the defendant, and thus that the declarations given in that regard by the said Master Eksteen and his brother-in-law Willem van Heenen must be entirely beside the truth, which also appears further from the declarations of the aforementioned boys produced by the Honorable Ex Officio Prosecutor in the reply, to whose reading and confrontation therewith the defendant wishes to make known that that wine did not come directly out of the house of the defendant, and thus was not purchased there by those boys, as they on the side of the Honorable Ex Officio Prosecutor have tried to make Your Honorable Right Honorable believe in the claim; but the defendant has indeed wished to demonstrate what strict discipline was maintained by the defendant in his capacity among those people, and upon what penalty they are forbidden from having any intercourse with boys or others, much less selling wine to the same, which nonetheless can happen without the fault of the defendant, the more so when some collusion takes place, which appears here most clearly. Now the defendant will proceed to the 6th article, whereby the Ex Officio Prosecutor proceeds to a further substantiation to demonstrate expensively that those wines truly came out of the house of the defendant in his capacity, with which the Honorable Ex Officio Prosecutor, enclosing Article 11, attempts to prove such. To the first-mentioned declarations the defendant most respectfully refers, from which Your Honorable Right Honorable will see that the said Master Eksteen with his brother-in-law must have had a fairly good telescope to have been able to see those boys with wine coming out of the house of the Assistant Master of the Schuur before the door of the defendant in a Captain's manner, without refuting the further contradictions from the one and the other, which the Honorable Right Honorable will see most clearly with a single eye.

but that which has been sufficiently proven by the aforementioned, which the declarations in this regard prove, which I therefore deem unnecessary to elaborate upon further. But in article 12, the honorable R. O. Plaintiff goes a step further, stating that the declaration will prove to Your Honors that the defendant sells wine to slaves, and specifically nominatim to the said boys of Burgher Councillor Wiese. Although the defendant has sufficiently demonstrated the contrary in previous statements, it will nevertheless be necessary to examine closely the declarations produced by the honorable R. O. Plaintiff from those two boys, wherein Your Honors will observe that the said boys, at the request of the said Eksteen and Willem van Reenen, answered them that they were well aware that the under-masters sold no wine to slave boys, but that such only applied to the people who belong to the said mess. Can one now produce anything clearer in favor of the defendant, and is article 12 of the reply not hereby contradicted as clear as day? Yet this did not deter the said Eksteen from trapping the defendant; those boys were then to fetch wine, as indeed happened, but NB they used one of the sailors for that purpose. If it is now considered that wine was sold to boys by the principal defendant, the defendant testifies that he can find nothing of that nature in this; it would not be strange for the defendant to think that that sailor also enjoyed a portion of that remaining money to help deceive his master, but however that may be, from everything the defendant's innocence appears as clear as day. Will it now be necessary for the defendant, every time a sailor comes for wine, to follow such a person to investigate where such a person is taking those wines, as the honorable R. O. Plaintiff seeks to demonstrate from article 14 et seq. of the law, since there is a strict prohibition not to hand over wines to anyone or to allow them to keep other strangers, much less slaves, there to drink it? The defendant in his capacity trusts that with such an order, he is fully purged of the act of smuggling charged against him. The honorable R. O. Plaintiff goes further from article 14 of the law to make Your Honors believe that the said fetching of wine took place so publicly in front of the defendant's door, and thus the defendant absolutely must have seen it. Then, Honorable Gentlemen, from the declarations of the said slaves, it is most clearly established that they were aware that the under-masters did not sell wines to slave boys; that it is indeed the highest presumption that, in order nevertheless to obtain a bottle of wine to please the said Eksteen, they would have acted in the utmost secrecy. They were very well aware that if the defendant had caught them at it, a beating would still await them, so that those statements of the honorable R. O. Plaintiff have not the slightest presumption in their favor, but must collapse of their own accord. The honorable R. O. Plaintiff refers from article 21 and further again to the declarations produced with the claim, that Eksteen and van Reenen were so close to that house that they believed those boys came out of the defendant's house with that wine, according to article 28; but that which has already been answered herefore, that the said Eksteen and van Reenen must have had a good telescope, all the more so since the boys depose in their declarations that they remained waiting at the place of the said Burgher Councillor Wiese until their return, so that everything said in this regard is beyond all possibility and therefore merits no further refutation. The honorable R. O. Plaintiff now proceeds further with article 30 to maintain the declarations of the said Eksteen and van Reenen, which are doubted by the defendant. Whereupon the honorable R. O. Plaintiff seeks to base the same from article 34, by saying they do not testify here in their own case, agitur enim de jure principis. Although such is true, Honorable Gentlemen, they nevertheless testify in their own case because they have an interest in it to enjoy the benefit thereof, and thus it is trusted on all reasonable grounds that the defendant must hold the same witnesses suspect and that they must be rejected according to law. Secondly, the honorable R. O. Plaintiff says that an informant is lawful as a witness, certainly, Honorable Gentlemen, but one ought... However, the defendant trusts to have already sufficiently shown that nothing of the smuggling is proven here by the honorable R. O. Plaintiff and that no presumptions apply that the defendant has made himself guilty of smuggling, and therefore he will pass over all that reasoning up to article 58 in silence, as consisting entirely of bare speculations, and proceeding further to the letter of the former Burgher Councillor Wiese, to which little reflection is to be given, as it operates nothing in favor of the defendant. Then, Honorable Gentlemen, it was only produced to convince of the untruth of the declaration produced with the claim under [illegible], and in that regard particularly to pay attention to whether that report carries any self-interest, yes, as is undisputed here, so that testimony is highly suspect, all the more so since the same is suspect by its very nature, as has already been shown above from the contradictions between the declarations produced in the reply; the aforementioned will also sufficiently refute the 38th article of the reply and the further articles up to 44 inclusive. The honorable R. O. Plaintiff proceeds further in articles 45 and 46 by saying that for smuggling, it does not need to be proven luce meridiana clarius, but rather that it is counted among those crimes which are satisfied with a less complete proof and with conjectures. To that end, having requested and also obtained from your Honorable Worships a citation to appear in person against the said Jan Smit Jurriaansz:, and subsequently also a decree whereby it was ordered to answer certain interrogatory articles submitted by the Officer Demonstrant, this has had the result that the said defendant did not dare to deny having revera salvaged some goods from an English shipwrecked vessel in the Kagelbaay, and having stored them at his place situated near the Palmiet River, behind the mountains of Hottentots Holland, as can be seen from his given responses, articles 15, 19, & 75, to which, for the sake of brevity, earnest reference is made. Only under the pretext pretended, that for this he had obtained a commission from certain authorized agents of the owners or commanders of the shipwrecked vessel. Since now the inquiry into whether substantially such a commission ever existed, and if so, whether and to what extent those authorized agents actually had the capacity thereto, is of higher scrutiny, the Officer Demonstrant therefore believes that there are more than sufficient reasons to turn to your Honorable Worships and hereby request from the same a decree of bodily apprehension against this defendant, since he himself has not dared nor been able to deny the fact itself, and he has consequently therefore well and truly contravened the clear and plain letter of the local orders and laws enacted against it, and therefore was really engaged in an act or illicit deed. The Officer having to trust that your Honorable Worships will have not the least hesitation regarding this: 1. Because his instruction prescribes him in Article 5 to govern himself in criminal matters as much as possible according to the Ordinance regarding the style of proceeding in criminal matters of the date 9 July 1570. 2. Because the same Ordinance, art: 4, entails "that the judges, when the truth of the fact is sufficiently evident, or at least by half-proof, vehement or probable suspicion, etc., shall decree provisional personal apprehension and detention of the person according to the quality of the delicts and crimes or of the persons, and according as the matter shall be disposed, upon the penalty mentioned in the aforesaid ordinance." 3. Because the widely renowned S: van Leeuwen, in his annotation to the 53rd Article of the ordinance on criminal justice regarding the relaxation and release of prisoners, further states: "For if the cases require corporal punishment, and there is some probability of the committed fact present, the judge may not (note well) provisionally release anyone from prison, because the cases otherwise turning out, the sentence would remain unexecuted, seeing that one cannot punish someone in his body whom one does not have." From which by legal consequence it then also flows that the judge in such a case, for that same reason, may also not refuse the requested apprehension. Van Leeuwen further adding hereto that also no bail can exist or be legally accepted for a crime to which corporal punishment is attached, because one cannot legally bind oneself to corporal punishment for another, and the corporal punishment earned by one person cannot be fulfilled by another, as consisting in one's own suffering over that which has been earned by the crime, an example to others and the amendment of oneself, which also accords with the custom and usages of these lands, as is more broadly treated in the Roman-Dutch Law, book 4, part 4, No. 6. 4. Because it is beyond all contradiction that the present case belongs among capital or corporal offenses, and appropriately under the quality of those crimes whereof Article 4 of the ordinance cited above provides that the judges shall decree provisional apprehension and detention against the perpetrators upon the penalty mentioned therein. 5. Because it is no less true that the truth of the fact itself is sufficiently evident, and there is already much more than a half-proof, vehement, or probable suspicion. 6. Because although the crime itself was committed in the month of September of the year 1778, and therefore a lapse of eleven years and three months has passed since then, this nevertheless can operate not the least in favor of the defendant, since it is a general rule in law, and constant practice in the Republic demonstrates, that the prescription of corporal crimes can only take place after the expiration of twenty full years after the day of the perpetrated delict, vide Wassenaar Prackt: Judic: Cap: 29 § 46. - Carpz: Capit: 133 § 4 and 5 L 12. the assertions set forth in that petition, however easily they might otherwise be refuted, in order not to tire Your Honorable Worships' attention, will solely and briefly state with regard to the request itself: That he, on his part, can neither may condescend thereto, because the nature of the crime de quo agitur is of such a character that it must absolutely be handled extraordinarily, as can be seen in the ordinance concerning the style of proceeding in criminal cases dated 9 July 1570, in Simon van Leeuwen, page 287, that in criminal cases proceedings shall take place ex officio in order to investigate the supreme truth of the facts, and that ordinarily and extraordinarily with short terms and intervals of time; ordinarily, that is according to the common course and train of proceeding by summons, claim, answer, and production, that is the disclosure of documents and the permitted defense. Which takes place in cases wherein the fact is doubtful, whether and by whom it was committed or not, and the same is not evident and is denied, or the nature of the fact is uncertain, and there is no means to arrive at torture and torment, or otherwise the insignificance of the case entails no corporal punishment. In which case the officer may not begin with imprisonment, or having begun therewith because of the doubtfulness, the same may request provisional discharge and admission to appear by proxy; or the accused, having been called in person, with a request for provisional incarceration, that is immediate imprisonment, as commonly happens, the defendant on the contrary requests to be admitted to ordinary proceedings and to be permitted to appear by attorney. Whereas, if the case entails undeniable corporal punishment and the fact is evident, whether the perpetrator is caught in the act or it was proven by prior testimony, one proceeds extraordinarily by summary justice, by immediate charge and imprisonment, and the perpetrator is heard, and upon his confession, which, if he refuses it, is extracted and drawn from him upon the evidence, justice is done without further form of trial. Since this ordinance has been prescribed here by our Lords and Masters as a law and guideline, it is indisputable that both the Honorable Judges and the officer are obliged and bound to conduct themselves strictly accordingly in criminal matters. This also agrees completely with the teachings of Damhouder in Practica Criminalis, chapter 3, number 3, as well as with L. 2. Cod. quorum appellationes non recipiuntur: Observare curabis nequis argumentis convictus testibus superatus voce etiam propria vitium scelusque confessus audiatur appellans. For indeed, in corporal punishment cases, an accused who has been summoned in person is never allowed a proxy or advocate, per textum in leg. pen. Ad legem Juliam de vi publica, to prosecute the crime of public judgment, in vain does a proxy intervene, even more so to defend, Voet, Commentarius ad Pandectas, tome 1, book 3, title 3, number 14: in criminal cases, however, a proxy is not admitted. The reason is that anyone summoned for any corporal crimes would have his cases defended by an attorney, and thereby, even if he lost the case, he would escape execution, because one may not execute an attorney for his master (so that even in the slightest doubt, no one would appear in person to defend his innocence, and it would render a completely fruitless judgment to condemn someone who was not there. Since it pleased your Honors on the last ordinary court day, by interlocutory disposition upon such representation as was submitted in this Council on 10 December by the Independent Fiscal regarding the proceedings of the first sworn clerk at the Political Secretariat Johannes Marthinus Horak and assistant Mollenstroom, to enjoin delegates from your Honors' assembly to examine precisely all the depositions obtained in that matter up to the present day, and to report to your Honors at today's assembly to what extent one has progressed with the aforesaid investigations, as well as what already appears therein to the debit and credit of the estate of the aforesaid Horak and Mollenstroom, in order to be able to take further measures herein as your Honors shall deem necessary: The undersigned, in dutiful fulfillment of the honored intention of your Honors, sat for that purpose on Tuesday the 29th of the past month of December, and take the liberty regarding their findings to respectfully present to your Honors herewith 13 pertinent lists marked from No. 1 to 13, in which the undersigned have briefly excerpted the contents of the depositions obtained up to now, containing: the 1st list of all such depositions as directly fall to the debit of the first sworn clerk Horak on account of the Lord's Dues; the 2nd list of depositions that are dubious, relating to the Lord's Dues; the 3rd list of attestations of those persons to whom the Lord's Dues were gifted; the 4th list of testimonies of persons who say they paid the Lord's Dues into the Honorable Company's treasury; the 5th list of declarations of those who say they handed over the Lord's Dues to the sworn clerk Diemel; the 6th list of persons who gave a commission to others for the payment of their Lord's Dues; the 7th list of declarations regarding recognition money which are directly listed to the debit of Horak; the 8th list of declarations regarding recognition moneys that do not fall to the debit of Horak or other known clerks.

the 10th List of declarations concerning those who testify to having charged others with the payment of the recognition money the 11th List of those who say they handed over their recognition money to the ordinary clerks at the Political Secretariat the 12th List of country people who state that they paid their overdue recognition money to Mollerstroom the 13th List containing such declarations as have been passed by some clerks at the Political Secretariat From which lists Your Honorable Worships will be able to establish that the aforementioned Horak received more money from some simple people for the Lord's Right and recognition money than was actually due to the Honorable Company, and thus also more than that for which he stands charged on the lists drawn up by the Gentlemen Commissioners who were appointed by the Honorable Council of Policy to investigate this matter; that on account of the Lord's Right, an amount of ƒ 880.- was handed to the late sworn clerk Diemel; that various people effectively declare that they were exempted from the payment of the Lord's Right to the amount of ƒ 4003.4.-, which sum, however, is also included under the ƒ 54004.6.- known on the aforesaid list; and that still others testify to having paid their Lord's Right into the Honorable Company's Treasury, amounting to ƒ 1233.12.-. While furthermore, what in the opinion of the undersigned deserves much reflection, among the declarations from Graaff-Reinet found here, there is one from the Burgher Jan Fredrik Potgieter, who testified that on 16 March 1788, for one year of recognition money on account of his farm named Kraggakoe, he delivered three oxen to the Honorable Company's post at the Buffeljagts River, the sworn clerk Diemel however being charged on the list of recognition money for 12 months on that account. And the undersigned have, among other things, observed from a minute held before the Landdrost and Heemraden at Swellendam, that the Heemraad Jan Andries Holtshausen, for whom Horak is charged on the aforementioned list under 7 April 1787 for 24 months of recognition money on the farm named the Mouth of the Carega, has nevertheless shown, by the production of a receipt signed by Horak which is found with that minute, that under that date he had paid for two years of recognition money for both the aforesaid farm the Mouth of the Carega and another situated across the Duivenhoks River (which latter mentioned farm, however, is not listed on the register) by delivering livestock to the Honorable Company's post at the Buffeljagts River. Meanwhile, it has occurred to the undersigned, under correction, that however much the necessity to continue with these inquiries and to bring them to an end, as far as possible with respect to all the persons who are noted on the two lists drawn up by the aforesaid Commissioners, is now all the more urgent because the effect thereof is already evident, this investigation and these inquiries will nevertheless take a considerable time yet, when one considers that approximately 450 affidavits (excepting some of persons who have died or departed from here) must come in, of which in the course of approximately 14 months since this investigation commenced, one has not been able to obtain more than 180; it is true that because of the measles that prevailed here, most people in the country were prevented from being able to appear either here or at the drostdies to which they were summoned, which having now ceased, gives the undersigned some hope that one will be able to proceed more quickly with obtaining the remaining inquiries. However, since from the districts of Swellendam and Graaff-Reinet, to whose Landdrosts the gathering of the declarations of those persons who are noted on the aforesaid lists and reside in their districts was assigned, a very small number of those declarations have been sent over, and also not all of those who were summoned by the Landdrost of Stellenbosch pursuant to the list sent over here by him have appeared; the undersigned therefore thought it would be very expedient that the said Landdrosts should be written to de novo, and that the first two mentioned should be ordered to obtain, at the earliest opportunity, the declarations of those persons who were prevented by illness or other legitimate obstacles from giving their testimonies up to now, and to supply them to this Council; as well as the last-mentioned Landdrost to order anew the still outstanding deponents to come Cape-wards at a certain suitable time according to the proximity or distance of their residences, with a very serious warning that the negligent or unwilling will be constrained thereto by efficacious means; there having also come into the hands of the undersigned, among the declarations of Graaff-Reinet, among others one from the Burgher Petrus de Buys, in which it is said that the appearer never held a farm under the name of the Bosjes Fontein by ordinance, but indeed a farm named the Klipfontein, and which declaration was also ordered to be sworn to, without having it stipulated therein whether the aforesaid Petrus de Buys (since very likely a clerical error could have occurred in this)

The undersigned must finally still declare to Your Honorable Excellencies, with regard to the transfer duty on the house bought by the aforesaid clerk Diemel, with which the aforementioned list is also debited for ƒ 325, that although the aforesaid transfer duty was also remitted to the aforementioned Diemel upon the purchase of his house, the undersigned nonetheless subsequently caused these very monies to be deposited into the Honorable Company's treasury by the sworn clerk Pieter Hendrik Faure, pursuant to an issued warrant. All of which the undersigned believed should serve as a dutiful report. Underneath stood: Delivered in the Council of Justice at the Cape of Good Hope on 7 January 1790. Thus, in consideration of the extreme necessity of continuing with the inquiries in which one has been engaged until now pursuant to the resolution adopted in the session of 2 October 1788, it was also resolved to proceed further therewith with all possible speed, and at the same time to determine that, with respect to the list mentioned in the memorial submitted by the Independent Fiscal on 10 December last, concerning such farmers as were said to have paid their arrears with supplied draught oxen, which draught oxen were however never received, that very investigation shall have to take place by obtaining the necessary declarations from all persons named on that list; furthermore, pursuant to the contents of the aforesaid submitted report, the necessary orders shall be dispatched to the respective landdrosts of Stellenbosch and Drakenstein, as well as Swellendam and Graaff-Reinet, and at the same time, regarding the declaration of the burgher mentioned in the aforesaid report, the Council's astonishment shall be brought to the attention of the last-mentioned landdrost. However, since due to the inconveniences presented by the condition of this country, it will still take a considerable amount of time to properly obtain such a large number of inquiries as are required in this matter from residents living mostly far inland, before this Council will find itself in a position to finally settle the aforesaid proceedings with regard to the monies found to be due to the Honorable Company; the assembly has nonetheless deemed it necessary on this occasion to enter into deliberations concerning the monies that, after deduction and satisfaction of the mortgaged and other preferential debts attached to the aforesaid estates of Horak and Mollerstroom, are held under its sequestration. And however much the sentencing of the aforesaid proceedings was postponed by resolution of 27 November 1788 until all the declarations to be obtained had been re-examined and sworn as far as possible, produced in council, and circulated with the case file among the respective members; it was nonetheless now approved, in consideration of the fact that, as aforesaid, a considerable time will yet elapse before this Council will find itself in a position to render judgment regarding the estates of the aforesaid Horak and Mollerstroom, to now take in hand the proceedings initiated against the persons of the frequently mentioned first sworn clerk Horak and assistant Möllerstroom. That the Prosecutor ex officio, trusting that this appropriate reflection will not escape the customary attention of the Court in judicando, therefore now renounces further production. The citizen Jacobus van Leeuwen, as authorized agent of the defendant, says thereupon that he has demonstrated in his Answer that a misunderstanding must have taken place between the servant of Villiers and the soldiers or sergeant of Wurtemberg; and that although it may well be that the note speaks of another case, the Officer nevertheless remains obliged to prove his assertion regarding the falsehood of that note stante pede, furthermore likewise renouncing further productions. The Court holds this case under advisement for circulation, with the declarations served herein being recollected and sworn as much as possible beforehand. The oft-mentioned Adjunct Fiscal, representative of the Honorable Independent Mr. J. A. Pieter for the Fiscal Johan Nicolaas Steven van Lynden, Prosecutor ex officio, produces a written claim to which 2 appendices are attached against the assistant of the Honorable Company, Willem Kolver, as representative of the citizen Jan Theron, defendant; the defendant requests a copy thereof in order to serve a written claim today four weeks, to answer thereto, and furthermore to proceed according to law in a case of committed mistreatment of a certain bondsperson of his named October of Mosambigue. The Court grants a copy and a day to answer. Whereafter the aforesaid Adjunct Fiscal further submitted a Memorial concerning a certain female slave named Rosie, belonging to the citizen Coenraad Warner, and requested whether the said Warner, who was summoned before the Council Chamber, might stand inside during the reading of the same Memorial; which being granted to the said Adjunct Fiscal, the aforesaid Memorial was furthermore found to be of the following content: To the Right Honorable and Respected Lords President and Councilors of Justice of the Castle of Good Hope. Shows with due respect the Independent Fiscal Johann Nicolaas Steeven van Lynden: That on the 8th of this current month of January, having appeared in the lord's prison a certain female slave named Rosie, belonging to the citizen Coenraad Warner, which slave declared that she had been sent by her master to fetch a note in order to have a deceased slave child of his buried, but that she had hesitated in the execution of this order, because her master had hung the aforesaid slave child from a chimney chain, and subsequently beaten it in such a manner that the death of the same child had been caused thereby; the Memorialist ex officio therefore had the corpse examined, in order to be convinced of the truth or falsehood of that accusation. That upon the examination, before the Commissioners from this Honorable Respected Court, assisted by the second Chief Surgeon Leuwer, nothing having appeared from which any mistreatment could be observed, the Memorialist ex officio was thus also at first glance of the opinion to return the aforesaid slave to him after a customary proper correction, as having falsely accused her master. Yet that on the one hand it has appeared to the Memorialist ex officio that the aforesaid Coenraad Warner had indeed not mistreated his slave child in such a manner as the slave Rosie had stated, but nevertheless, over the stealing of some money, had treated it in such a manner that the accusation can thereby be held more or less excusable, especially when one considers that the complainant, who was at the same time the mother of the child in question, may well have proceeded to this premature step out of grief over its passing. While on the other hand the Memorialist ex officio has been informed that Coenraad Warner is known to everyone as a person who daily indulges to excess in drink, even to such an extent that when the Commissioners performed the examination, he was barely able, due to drunkenness, to answer what was asked of him on that occasion. That the Memorialist ex officio, by the concurrence of these circumstances, in order not to sacrifice the aforesaid slave to the unrestrained and vengeful passions of the oft-mentioned Coenraad Warner caused by daily drunkenness, has not been able to resolve to return his slave to him according to custom, but on the contrary, to prevent misfortunes the consequences of which would redound both upon the master and his slave, has seen fit to address Your Right Honorable Honors and to submit for respectful consideration whether Your Right Honorable Honors, in this extraordinary case, might not incline to have the aforesaid slave Rosie sold publicly at the order of Your Right Honorable Honors to the highest bidder for the benefit of the citizen Coenraad Warner, and thereby remove her from the vengeance of her master. Honourable Sir and Honourable Sirs, Your Honours' very humble servant Menso Blankstein, as the assumed general attorney of the Burgher Anthony Fick, respectfully shows with all dutiful respect and submission: That in the year 1786, one of the petitioner's principal's bondservants, named Fortuyn, was confined to Robben Island by sentence of Your Honours for the term of three consecutive years on account of a certain crime committed by him, with the addition that if no further evidence should be produced during that time of three years, the petitioner's principal's slave boy would be sent back to his master after the expiration of three years, as appears from the sentence annexed hereto. However, since the petitioner's principal trusts that no further evidence has been produced to Your Honours to incriminate his aforementioned bondservant Fortuyn, and the cited three years in the annexed sentence of Your Honours already expired in the month of July of the past year, the petitioner therefore turns with all respect to Your Honours, humbly requesting that it may please Your Honours, in Your high favour, to release the slave boy Fortuyn from his imprisonment on Robben Island in accordance with Your Honours' sentence and to return him to the principal petitioner. The citizen Arend van Wieligh, as general agent of Maria Malang, widow of the late citizen Hendrik Engela, plaintiff, against the Honorable Independent Fiscal Johan Nicolaas Steeven van Lynden, defendant, in order to see an Answer served to his Claim filed under date of 7 January. The plaintiff serves his answer in scriptis, the same being furnished with annexes. Furthermore, pursuant to the provisional resolution of the last ordinary court day taken upon the request presented by the former secretary of the Colony of Zwellendam, Sieur Menso Blankstein, in his capacity as assumed attorney of the burgher Anthony Fick; the report of the Merchant and Landdrost of the Colonies of Stellenbosch and Drakenstein, the Honorable Hendrik Lodewyk Bletterman, having arrived today, the Council, since the said Landdrost declares in that same report that he on his part has found himself, and still finds himself, unable to obtain any, even the slightest, further or better evidence concerning the act whereof the slave Fortuin mentioned in the aforesaid request made himself suspect, than that which he had submitted with his statement presented on 27 July 1786, has therefore thought fit to grant the request made on behalf of the abovementioned Anthony Fick, with the stipulation, however, that the said slave Fortuyn, pursuant to the resolution of 27 July 1786, shall have to be sold by his owner far inland. Furthermore, the burgher Jacobus van Leeuwen, as attorney of the Valiant Captain of the Burgher Militia Pieter van Breda, presented the following request. How the principal petitioner requested at the Secretariat of Your Honorable Worships a copy of such statement as was exhibited by the Independent Fiscal of this place, the Honorable Johan Nicolaas Steven van Lynden, in his official capacity, on and against the proposition of the petitioner's brief of rejoinder regarding the striking out of various paragraphs in Your Honorable Worships' extraordinary meeting dated 8 October of the past year; That the Secretary of this Honorable Council, the Honorable Willem Stephanus van Ryneveld, was pleased to refer the petitioner with this request to this Illustrious Court, on the grounds that without its highest approval no copy of that statement could be given, having nevertheless delivered to him, the petitioner, the copy of the minutes without the insertion of the aforesaid statement. That furthermore, on 21 October of the past year, on behalf of the principal petitioner, it was requested of the Honorable Commissioner Members of this Illustrious Court sitting for the reviewing and swearing of the depositions, that minutes might be drawn up of such objections as the principal petitioner thought ought to be submitted from his side, regarding the disqualification from the oath of both the Valiant Colonel as denunciator, and also the soldiers belonging under the Regiment of the Commander who served as deponents, on grounds of law, which were submitted in writing on that day; and also that these minutes might be attached to the documents. That this request having been granted to the petitioner, it nevertheless appeared upon the swearing-in on the 2nd of this month that the same minutes were not found among them, although the principal petitioner maintains with good reason that these constitute by no means the least parts of his legal defense. That it is thus very painful for the petitioner to have to see that the statement of the Honorable Plaintiff in his official capacity, of which neither copy nor defense has been allowed to him, is found among the documents; Whereas, on the contrary, that part of his defense, namely the said minutes, has indeed been granted to the petitioner in copy, but has by no means been added to the documents. Dat alverder op den 21 October Ao„ passo van weegen den p=l suppl=t aan EE Heeren Gecomm: Hoe Leeden 62 65 Leeden deezer Illustre Vierschaar tot 't recolleeren en beEedigen der Verklaringen vaceerende, is verzogt, dat Notule mogte werden geformeerd van zoodanige bezwaaren, als den Ppl. supplt. vermeende dat van zyne zyde behoorden te worden voorgedraagen, over de onbe¬ voegdheyd tot den Eed, zo van de Manh: Heer Colonel als denuntiateur als ook de soldaaten onder 't Regi¬ ment van den Chef behoorende, dewelke tot deposan¬ ten hebben gediend, op gronden van Rechten, als ten daage dienende, daarvan in scriptis zyn overge= legd; mitsgaders dat deese notule by de stukken mogte gevoegd worden. Dat dit versoek den Supplt. geaccordeerd zynde egter by het evangeliseeren op den 2 deeser is komen te blyken, dat dezelve Notule daarby niet gevonden wierd, hoe zeer ook den pl suplt met grond sustineerd dat die geen de gerings te deelen zyner defensie in Rechten uytmaken. Dat het aldus den supplt. zeer zmartelyk valt te moeten zien dat het vertoog van den Heer r: O: Eyscher, waarvan hem nog Copia nog defensie is toegestaan, by de stukken gevonden word: Daar in teegendeel dat gedeelte zyner defen„ sie namelik de geme. Notule aan den Supplt. wel in Copia zyn verleend, maar geenzints by de stukken gevoegd zyn geworden.
